APPROVAL OF MINUTES
Brancel moved, Gagne seconded, to approve the minutes of January 9,
1989, as amended. Motion carried - 4 ayes.
Gagne moved, Stover seconded, to approve the minutes of January 18,
1989 as written. Motion carried - 3 ayes (Brancel absent at that
meeting and did not vote).
COMMISSION REPORTS
PLANNING COMMISSION REPORT
Stover stated that a joint Planning Commission and Council meeting
was held on January 17, 1989. They discussed 1989 programs,
variance policy and inter-governmental communications.
PARK COMMISSION REPORT

Gagne stated that>no meeting has been held since the last report.
He did make a request to replace the windows on Badger Park
building because the plastic has become to clouded to see through.
Estimates have been obtained with the low bid at $340.
Gagne moved, seconded by Brancel to authorize the purchase and
installation of new window panes at Badger Park not to exceed
$340. Motion carried - 4 ayes.

FINDINGS OF FACT - Yanik Variance RESOLUTION No.10-89
Denial
Attorney Froberg reviewed what has taken place relative to Mr. Yanik's
request for a setback variance to construct a deck and gazebo. A
public hearing was held by the Planning Commission and their recommen-
dation was forwarded to the Council. Mr. Yanik then submitted addi-
tional information regarding his request and the Council referred him
back to the Planning Commission. After receiving a second recommen-
dation for denial by the Planning Commission, the Council voted to
deny the variance and directed the City Attorney to prepare a Findings
of Fact. Attorney ~roberg read the Findings for the Council.
Stover moved, seconded by Mayor Haugen to accept the Findings of Fact
as submitted. Motion carried - 4 ayes by Roll Call Vote.
FINDINGS OF FACT-LUNDGREN FENCE
VARIANCE DENIAL >
RESOLUTION No.11-89
Attorney Froberg reviewed Lundgren's request for a variance to install
a six foot fence along Highway 7 at the entrance of the Shorewood Oaks
addition. He read the Resolution stating Findings of Fact denying
the request as directed by Council.

Gagne moved, seconded by Stover to accept the Findings of Fact denying
Lundgren's fence variance. Motion carried - 4 ayes.
DISCUSSION OF GOOSE ROUND-UP
Mr. Jim Cooner with the Denartment of Fisherv and wildlife at the
University of Minnesota was present to explain the procedures of
rounding up and transporting geese. The geese are trapped during
their flightless period and the adults are transported to another
State and the young are moved to nor~hern Minnesota. Each year one-
half of the transported geese will re~urn. Each site for the round-
up will be charged between $700.00 and 51,000. The site may have
more than one capture but will be under the site round-up charge.
Once the sites are determined permission must be ob~ained from the
proper~y owners ~o use their property for trapping, then Mr. Cooper
will obtain the needed pe~=its from the DNR.
The public hearing was opened for public co~ments at 8:00 P.M. by
Mayor Haugen. Mr. and Mrs. Ferguson from Enchanted Island offered
their yard for a trapping area. Mr. Noonan and Mr. Robert supported
t~e round-up for Christ~as Lake. The public hea~i~g was closed a~
8:20 P.M. after receiving no further public COIT~ent.
Gagne moved, seconded by Stover to authorize funding for three sites
for the round-up to benefit the health and welfare of the City.
Motion carried - 4 ayes.
Mr. Cooper will forward a contract to the City. Details will be
finalized and Mr. Cooper will get DNR permits for a June round-up.
ACCEPTANCE OF EQUIPMENT BIDS
One Ton Four Wheel Drive Truck
Resolution No.12-89
Bids were received and opened on January 20, 1989 at 10:30 A.M.
for a new diesel powered one ton four wheel drive truck. Public
Works Director Zdrazil has recommended acceptance of Boyer Ford
Trucks bid in the amount of $16,389.
Gagne moved, secon,ded by Brancel to award the bid as recommended
to Boyer Ford Trucks at $16,389.
Sinqle Engine Hiqh Lift Four Wheel
Resolution No.13-89
Bids were received and opened at 11:00 A.M., January 20, 1989 for
the road sweeper. Public Works Director Zdrazil has recommended
acceptance of the bid from Boyum Equipment for a demonstrator in
the amount of $80,955.

SUPER CYCLE COMPLAINTS-SHOREWOOD CENTER
Many complaints have been received en the recycling site at the
Shorewood Shopping Center. The recyclino are not being placed into
the bins and a great deal of garbage is being dropped off. Mayer
Hauoen authorized Public Works Denartment to keeD the site cleaned.

Clerk Kennelly was in touch with Supercycle and was assured that the
site will be cleaned as previously agreed 2....'1d that the representative
would be contacting her to discuss the problem.
Brancel asked about moving the drop off site to the Public Works area.
Public Works Director Zdrazil felt the dumping would ccn~inue even
at Public Works, he also did net feel there was an approprla~e loca-
t.1.or.i. on site.

Mr. Rascop felt that City wide garbage pick up should be reconsidered,
as currently being done in Excelsior and Tonka Bay.
DOG ORDINANCE AMENDMENT DISCUSSION
Mayor Haugen felt the Dog Ordinance should be discussed at a separate
meeting.
Gagne is pursuing a leash law due to the many complaints he has re-
ceived from residents. Sample ordinance from other Cities were
submitted previously for review by the Council. Brancel supports a
total leashing ordinance. Stover feels to force an ordinace without
enforcement would not be effective.
Council directed the staff to see if funds are available to add
additional patroling by Midwest Animal to enforce the current Ordinance
to eliminate the man~ complaints.
RESUME REVIEW PROCEDURES
Council set a special meeting for January 31, 1989 at 7:30 P.M. to
review the resumes received for the City Administrator's position.
After further discussion, Council directed Mayor Haugen and Clerk
Kennelly to ask other City Administrators to review the resumes and
make recommendations on the best applications. Clerk Kennelly would
also copy all the resumes for each of the Councilmembers review.

PLANNERS REPORT
Siqnaqe - State Highway 7 (West of Hiqhway 41)
Kirk Hanson of the Department of Transportation asked for comments
the Council may have on their proposal to sign all intersections
along Highway 7 West of Highway 41. The existing signs will re-
main and unsigned intersections will be identified. Council had
no suggestions or objections to the proposal.
ATTORNEYS REPORT
S.L.M.P.S.D.-Leasp Aareement
A wording change to the Police Building Lease Agreement was re-
quested from the City of Shorewood. Council discussed the errects
of prepayment of the principal and how it would affect the other
Cities in the agreement. Attorney Froberg didn't feel the re-
wording would change the intent from the original agreement.
Mayor Haugen moved to recommend that the issue be tabled and have
the Attorney return with a financial analysis on the effects of
the prepayment of principal on the Police Building by Greenwood,
Gagne seconded t_he motion.
ACC~PTANCE OF QUOTATTON OF EASEMENT APPRAISAL-WEDGEWOOD ROAD ALIGNMENT
Attorney Froberg requested acceptance of Johnson and Liedl Appraisal to
do the appraisals of easements on five parcels along Wedgewood Road.
They have given a fee of $350.00 per parcel for the condemnation in
order to straighten out Wedgewood Road. Attorney Froberg has re-
ceived one of the deeds for easement.
Gagne moved, seconded by Brancel to accept Johnson and Liedl Appraisal
for the easement appraisals on Wedgewood Road. Motion carried -4 ayes.
LMCD REPORT
LMCD representative Robert Rascop reported on the current actions
being handled by the LMCD. Many applications for dredging have been
~eceived, including one from Tonka Bay, for their community dockage
area. Mr. Rascop feels the current regulations should be reconsidered.
The DNR feels that owners have the right to get to water. During the
last drought wells were drilled and were used to pump water into the
lake. These wells have been ordered filled because they go directly
into aquafiers.
The LMCD is presently working on a management plan to deal with the
Eurasian Water Milfoil. There is no known method to kill the weed.
They are proposing to purchase three harvesting machines. Mayor
Haugen would like to ask the DNR to close the access to Christmas Lake

Stover stated that Jim Schultz will submit a proposal including a
time line and present information to staff and Council.
Interim Administrator Appointment
Stover moved, seconded by Gagne to appoint City Clerk Sandra
Kennelly as interim City Administrator. Motion carried-4 ayes.
Clerk Kennelly would like to present a proposal that would include
Planner and a temporary salary increase.
Gagne asked to notify him of scheduled union negotiation meetings.

Gagne moved, seconded by Brancel to adjourn the regular Council meeting
of January 23, 1989 at 10:07 P.M. subject to approval of claims for
payment. Motion carried - 4 ayes.

Thank you for this opportunity to be of service to you
and the City of Shorewood. I genuinely believe my
professional background, familiarity with the Council and
employees and general interest in the City's affairs will
be beneficial to the continued effective administration
of employees' salaries.
OBJECTIVES
It is necessary that administration of City of Shorewood
employees' salaries comply with State of Minnesota
comparable worth requirements. It is appropriate that
administration of salaries continue to reflect the sound
philosophies historically endorsed by the Council and the
City's administration.
Members of the Council recognize that salary administra-
tion policies and practices must enable the City to
attract and retain employees with requisite skills,
experience and other qualifications. It is their desire
to be able to reward employees for their overall con-
tributions to the successful provision of services to the
residents of the City. Further, Council Members fully
recognize their responsibility for the effective ad-
ministration of the public funds with which they have
been entrusted.
Therefore, the objectives of this project are to --
1. Incorporate into salary administration policies and
practices those elements which will assure com-
pliance with State of Minnesota comparable worth
requirements.
2. Maintain comparability of salaries paid to Shore-
wood employees to salaries paid to employees
performing similar jobs for other employers with
whom the City of Shorewood competes for employees.

3. Provide structure and guidelines for the ad-
ministration of salaries to recognize employees'
contributions to achievement of the City's mission.
Because of the importance of salaries to the City and
employees, it is of utmost importance that Council
Members and employees understand and, as appropriate,
participate in the processes that govern administration
of those salaries.
PROJECT OUTLINE
It is proposed that the following steps be followed to
achieve the above stated objectives.
1. It is understood that Sandy Kennelly has been
designated as Acting City Administrator and will
help to coordinate the project.
2. The consultant will meet with employees whose jobs
will be affected by the project to explain back-
ground, philosophy, process and their roles.
3. Employees and their respective supervisors will
review and, as required, rewrite job descriptions
recognizing the intended uses to include deter-
mination of salary values for their jobs. Other
uses include evaluation of performance, recruitment
and training. Format and assistance will be
provided by the consultant throughout this process.
4. The Council, with guidance from the consultant,
will select a method to be used for determining the
relative values of jobs. possible methods include
job match (the method used by Labor Relations
Associates, Inc.), ranking or job evaluation. The
job match method should be sufficient if there is
understanding and active involvement by the Council
and others who are familiar with the jobs involved.
If job evaluation is to be used, it will require
development of a system of evaluation for the City
of Shorewood or purchase of an established system.
5. The method for determining relative job values
selected in Step #4 will be applied to the jobs
using a committee of three--City Administrator,

designated Council Member and the consultant. The
resulting values and ranking will be presented to
the Council for review, challenge, adjustment and
ultimate approval. (It is expected that a new City
Administrator will be on staff to participate at
least at this stage; if not, an alternative
approach will be chosen.)
6.
Jobs will be ranked on the basis of relative values
as determined in Step #5 and merged with market
survey data to determine salary values. Survey
data to be used may be the published Stanton survey
which has been used historically, other published
surveys and/or a survey to be conducted specifical-
ly for the City of Shorewood. The survey approach
to be used will be determined by the Council with
guidance from the consultant.
7. A salary range will be established for each job (or
group of jobs with comparable points) with the
range midpoint to represent the position which the
City of Shorewood intends to maintain relative to
the same or similar jobs. Most commonly the
midpoint is the average paid for comparable jobs;
however, the Council may choose to target a point
higher or lower than the average depending on their
pay philosophy. A minimum and maximum for each
range will establish limits for administration of
salaries based on service, performance and/or other
criteria as determined by the Council with guidance
from the consultant.
8. Salaries of individual employees will be ad-
ministered relative to the ranges and criteria to
be used. Guidance will be provided by the consul-
tant as required.
FEE
It is estimated that 50 hours of consultant time will be
required for completion of the project as outlined above.
This does not provide for the development or purchase of
a job evaluation system (Step #4 above) or a special
survey of salaries paid by comparable municipalities
(Step #6 above). The fee for this project will be

determined on the basis of $80 per hour applied to actual
hours spent. The City will be billed monthly for hours
expended during the previous month. Payment is due when
billed.

BACKGROUND .
Mr. Clifford Anderson proposes to build a single-family home at 5351 Shady
Hills Circle (see Site Location map - Exhibit A, attached). Due to the
topography and configuration of the lot he has requested setback variances
which would allow him to build on the highest and most level location on the
site (see Exhibit B).
The property is located within the .t<.-1C. Single-Family Residential District.
Land use around the property consists of single-family homes on the north and
west. a vacant lot on the east and a large designated wetland area on the
south. Mr. Anderson requests a variance of 15 feet on the front which would
place the garage approximately 20 feet from the street right-of-way.
ANALYSIS/RECOMMENDATION
The applicant's request letter (Exhibit C) references severe topography as
justification for the proposed variance. What has not been mentioned is the
limited depth (96 feet) of the property. particularly where the lot is most
buildable.
As can be seen on Exhibit B. the existing grade where the buildable area of
the lot is the deepest is approximately 40 percent. To try and build there
would result in a driveway grade well in excess of what is considered safe.
Furthermore. sewer service in Shady Hills Circle is not deep enough to
accommodate the house in that location. Any attempt to build further east on
the site would result in extensive site alteration. and likely drainage and
erosion problems.

It is worth noting that the applicant's first plan for the site proposed to
locate the structure only 15 feet from the r.o.w. At the suggestion of this
office. Mr. Anderson moved it back approximately five feet. This still
provides for a reasonably level driveway. while creating enough length to
allow a car to be parked L~ the driveway. entirely on private property.
While not shown on the applicant's building plans. it is likely that some
sort of deck will be desired on the rear of the house. Since the house is
already at the rear yard setback line. this will require further variance.
It is recommended that in addition to the front yard variance. a variance of
no more than 12 feet should be granted for purposes of constructing a deck at
the rear of the proposed structure.

We have received a request from residents of the Shorewood Oaks development for
additional speed limit signs and "slow children" or "children at play" signs on
Shorewood Oaks Drive (see attached petition).
Past policy has precluded the latter type of sign because it is not consistent
with the Minnesota Manual on Uniform Traffic Control Devices. Experts advise
that such signs are not enforceable and can actually lull people into a false
sense of security.
Staff will be prepared to discuss possible locations, if any, where additional
speed limit signs may be appropriate. The local police department has been
advised, by copy of this memo, that a problem exists which may warrant
additional patrolling.

We respectively request the Planning Commission to consider a variance
of set back restrictions on Lot 9, Block 4, Shady Hills.
As shown 1."1 t.he attached topographic drawing the lot is extreme in
slope varying approximately 50-0 feet from the highest elevation to the
lowest.
If the variance is granted the proposed dwelling can take advantage
of the higher portion of the lot. Under t.he present ordinance the basement
floor level would be below the sewer connection in the street.

BACKGROUND
Ms. Kathryn Johnson, representing Ann Staver, has requested approval of a
preliminary plat to subdivide the Stover property, located at 25270 Smithtown
Road (see Site Location map - Exhibit A. attached). into three lots (see
Exhibit B).
The property is currently zoned R-1C, Single-Family Residential and contains
approximately 82,016 square feet of area. Ms. Stover's home and garage will
remain on the lot fronting Smithtown Road. The two northerly lots will front
on a cul-de-sac proposed to be extended from Harding Lane.
ANALYSIS/RECOMMENDATION
The proposed lots all conform to the area and width requirements of the R-1C
District. Although Lot 2 is somewhat shallow on its northeasterly side, the
depth along the west side of the lot provides for more than adequate
buildable area on the lot.
The plat has been designed so that the owner's existing buildings will remain
in conformance with R-1C setback requirements.
Based on the preceding it is recommended that the preliminary plat be
approved subject to the following:
1. The applicant must submit an up-to-date (within 30 days) title opinion at
the time she submits a final plat.

During the last couple of months the staff has met with representatives of
Sherman-Boosalis Companies. Trivesco and ~~Or to discuss the proposed Old
Y~rket Road/State Highway 7 intersection. Sherman-Boosalis proposes to develop
the commercial and multiple-family residential phase or tile wate...Zord project.
Tneir engineers have now submitted :,. ans for ...:....e proposed intersection (see
attached Exhibit).
Since the third phase of Waterford is dependent upon access to Highway 7 and
since the plans must be approved by MNDOT. the developer has asked tr~t the
City forward the plans to MNDOT for formal review. It is worth noting that the
developer has submitted concept and development stage plans for review at the
March Planning Commission meeting.
Toe plans are being reviewed for geometric design by the City Engineer. He
will be prepared to carrment at Monday night's meeting.
Tne plans are considered to be consistent with the final recommendation of the
:iighway 7 Corrider Study. A", you rece.11. the Old M;::....j..~t Road intersection was
approved as an interim access to Highway 7 until such time as MNDOT could come
up with $4-5 million (todays dollars) to build a bridge at St. Alban's Bay
Road. Presumably such a project would occur. ~: ever. at the end of the 20
year program for corridor improvements.
It is recommended. subject to the City Engineer's approval. that the
developer's plans be referred to MNDOT for formal review. In subsequent
meetings it will be necessary to discuss how the project will be funded.

reduction of principal. Interest is at 7%, and it is anticipated that it

are made according to t..'1e proposed "amortization schedule." The
Coordinating Committee may "pre-pay" the contract at any time without
penalty, thus avoiding future interest charges of 7%. When the contract
is "paid off", the committee will not get the usual "warranty deed", but
instead be permitted to continue leasing the building for one dollar a
year.
If any member city represented by the Coordinating Committee wishes to
withdraw from the agreement, it will be "refunded" all of its "principal"
payments made to Excelsior by Excelsior in monthly payments made over the
same period of time the member city made its payments into Excelsior
(while a party to the Joint Powers Agreement). The member city will also
receive interest at the rate of 7% of its principal balance during the
period in which the refund payments are being made to it.
The City of Greenwood wishes to modify the pre-payment clause in the
"contract" to provide for an indi.vidual member city to pre-pay its
individual share of the contract balance and thus avoid future interest
charges. The language submitted by the Greenwood City Attorney
contemplates that the individual city would be allowed to "pay up" its
share of the principal balance on the basis of "the principal monthly

rental payments as computed and assigned to them L~ ~~e amortization

to payment.s of principal and interest by the Coordinating Committee as a
whole. The indiVidual share of each of the member cit~es is allocated by

The Formula factor is a simple allocation between the c~t~es, attribut~ig

The Demand factor is a much more complicated allocation, based upon five
year averages of ndemand data.n

Furthermore, if the total monthly rental payments due the lessor are not
reduced in amount at the time a prepayment is made,. each of the
non-prepaying members of the lessee will be required to pay a larger share
of the total rental payment each month. Depending upon current interest
rates at the time, this larger monthly payment could have some financial
effect on the non-prepaying cities.
In order to solve this dilemma and still satisfy Greenwood's request for
individual prepayment privileges, I propose language such as the following
be added to the existing language of the lease agreement:
WAn individual city within the membership of the Lessee shall
have the right to individually prepay at any time without penalty
its share of the total principal monthly rental payments, as such
share may be determined by the Joint Powers Agreement from time
to time. Such prepayment shall be applied to the monthly rental
payments according~to the amortization schedule then in effect"

The Annandale Advoca~e newspaper sued to have the records released to t..~e
public. On January 20, 1989, the Minnesota Supreme Court held that the
investigative report was private and could not be released to the media or
the public.
In reaching its decision, the court considered both the Minnesota Open
Meeting Law and the Minnesota Government Data Practices Act, which, in
some areas, have conflicting provisions.
The Open Meetinq Law, Minn. Stat. 471.705, requires that all meetings of
local government, with the exception of labor negotiation strategy, be
open to the public, and copies of all printed materials relating to the
agenda be available to the public. An intentional violation of this
requirement subjects a council member to "a civil penalty in an amount not
to exceed $100."
The Data Practices Act sets up classifications for all government data,
some of which are classed as. "public data" -- for release to the media and
to the public, and some of which are "private data" -- not for release to
the media or to the public. Personnel data-on individuals is generally
private, except for certain data on government employees, which include
among other things, name, salary, job title and description, dates of
employment, and the final disposition of any disciplinary action (and
support documents) which is public. In the case of a willful violation of
the law, a city is responsible for exemplary damages to the person damaged
up to the amount of $10,000 for each violation.

This ruling, in effect, creates a limited exception to the Open Meeting
Law and overrules an earlier Court of Appeals' decision in the matter.
In a second case, Northwest Publication Inc. etal v. City of St. Paul, the
Minnesota Supreme Court ruled that the St. Paul City Council could not
close a meeting to discuss a proposed controversial ordinance with the
City Attorney (restrictions on nude dancing in bars), even though the
council had been advised that it would be sued if it passed the
ordinance. The court held that although a limited exception to the Open
Meeting Law exists for attorney/client meetings for the purpose of
discussing litigation strategy, this exception "will almost never extend
to the mere request for general legal advice or opinion." This decision
serves to confine the attorney/client privilege to "immediate, active
litigation." Legal opinions given in situations where a party "may" sue
the city must be given in open meetings.

In the case of interviewing applicants for employment, the Data Practices
Act states:
"Names of applicants shall be pr~vate data except when certified
as eligible for appo; ntment to a vacancy or when applicants are
considered by ~~e appoL~tL~g au~~ority to be finalists for a
position in public employment. For purposes of ~~is subdivision,
"finalist" means an individual who is selected to be interJiewed
by ~~e appointing authority prior to selecticn."
Inasmuch as early interviews could not reasonably be held without
revealing ~~e applicant's name, the LiterJiews would necessarily be at
closed meetings. However, once the individual is determined to be a
"finalist", all information concerning veteran status, relevant test
sccres, ~~k on eligible list, job hi~ri, education and trai~~g, ~~d
work availability becomes public. All c~~er personnel data on trie
L~dividual remains ~rivate, but may be released pursu~~t to a c=urt order.
In t.'1e Annandale case, the court stated, "we fully realize w'1a1: the
s~tutes we have considered Li w~is opL.ion may be open ~o different
int.erpretaticns. Our opi!'.ion, however! is an attempt to reconcile
honestly all applicable statutes withou1: judicial legislation."
I shall try to keep you informed of the court's attempts to reconcile the
statutes in this important area.

Enclosed please find the letters of interest for the Planning Commission seat
which was vacated when Vern Watten was appointed to the Council. To-date we
have received two letters of interest.
Since there is no written policy relative to precedure for filling such

We have received a request from residents or the Shorewocd Oaks development for
additional speed limit signs and "slow childrenll or "children at play/! signs on
Shorewood Oaks Drive (see a~~ached petition).
Past policy has precluded the latter type or sign because it is not consistent
with the Minnesota Manual on Uniform Traffic Control Devices. Experts advise
that such signs are not enforceable and can actually lull people into a false
sense of security.
Staff will be prepared to discuss possible locations, if any, where additional
speed limit signs may be appropriate. The local police department has been
advised, by copy of this memo, that a problem exists which may warrant
additional patrolling.

A RESOLUTION STIPULATING TO THE REGISTRATION OF CERTAIN LAND
BY DAVID H. SAXON AND TERI L. SAXON
WHEREAS, David H. Saxon and Teri L. Saxon, Applicants, have
commenced a registration proceeding in District Court, Hennepin County,
Court File No. 19522, for the purposes of registering title to certain
land in the City of Shorewood~ and
WHEREAS, the City of Shorewood requires an easement for drainage
and utility purposes over a portion of the land to be registered~ and
WHEREAS, the Applicants have agreed to provide the City of
Shorewood with such an easement over such land pursuant to the Stipulation
attached hereto and made a part hereof as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood:
1. That the Mayor and City Clerk are hereby authorized to
