CALL TO ORDER
The Special Council meeting ~o review resumes for the Adminis-
trators position was called to order by Mayor Haugen at 7:30 P.M.
on Monday, January 30, 1989 in the Council Chambers.

resumes that the Council has not used in past hiring. This
method ',vould use a camilli ttee of Administrators/Managers in the
area to narrow down the resumes. They would then interview ~he

Council discussed the use of a "head hunter" commen~ing on ";:;"I7',
Brimeyer from Sather and Associates. Watten felt that the resumes
should be reviewed. Council wen~ through the 37 resumes and re-
duced them to 14 after considering the experience and education.
Gagne asked if the Council would be able to make a final selection.
Stover supports a hiring of a professional search firm with the
knowledge of hiring and negotiating of contracts and wages.
Stover moved, seconded by Gagne for discussion to hire Jim
Brimeyer to search for an Administrator. Brancel offered an amend-
ment to exclude the current resumes from Brimeyer's search. Motion
carried-3 ayes to 2 nays (Br~~cel and Haugen). Brancel would
like the resumes considered in Brimeyer's search with some con-
sideration for pay differential.
Clerk Kennelly recommended that the Council select four or five
applicants and she would set interviews for this week, and if the
Council was not satisfied with the applicants, Brimeyer could be
hired by next week. Managers have already reviewed the applica-
tions and have made their recommendations to the Council.
Council directed Mayor Haugen to negotiate with Mr. Brimeyer for
a contract price.

INTERIM ADMINISTRATOR SALARY
Clerk Kennelly submitted a report on methods of salary increases
used by other Cities during the interim administration.
Gagne moved, seconded by Stover to approve a 25% of Administrators
salaries to be split 15% for Clerk Kennelly ($480.00) and 10% for
Planner Nielsen ($320.00). Mcticn carried - 5 ayes.
AUTHORIZE PLAQUE FOR DAN VOGT
Brancel moved, seconded by Gagne to approve the purchase of a
plaque for Dan Vogt in appreciation for his service to the City.
Motion carried-5 ayes.

ferred to a letter from Super Cycle agreeing to clean up the site

pest signs listing the items to be recycled. He will work with the
City to set up guidelines that will be followed. Additional trucks

SETBACK Vl\RIp.NCE-TABTED- 5351 SHADY HILLS CIRCLP
Mr. Cliff Anderson was represented by Phil Marsten in his requeSt
for a front yard setback variance to build a house and garage at
5351 Shady Hills Circle. Mr. Marsten felt that his hardship has
been proven due to the severe topography. This lot was platted and
zonea ror a single famlly dwe~~lng. He felt his design was in keep-
ing with the character of the neighbors and he would be able to
maintain the greater portion of the trees. The garage would require
a IS' variance from the road right-of-way, placing the garage between
38' and 40' from the paved surface. His builder stated his concerns
for meeting the sewer evaluation and need for pumps if the variance
is not granted.
Watten and Brancel felt a house could be better designed to SUlt the
lots topography. Mayor Haugen had concerns that the Council may set
precedence for three other undeveloped lots in the neighborhood if
this variance is granted. Mr. Cliff Anderson assured the Council that
variance would not be requested on his three other lots. Mr. Marsten
felt the two story design was needed to allow for reasonable living
space with the smallest foot print. The moving of the garage to
the end of the house would require a great deal of fill and added
removal of trees.
Mr. Jim Robertson was not opposed to the building but was opposed to
the granting of the variance, because no other houses were within
18 to 20' of their property line. Pat Malsten stated that the existing

homes were built in the middle of the lots and he was opposed to a

opposed to the set back variance and he feels the plans are not set
specifics and should be designed for the steep slope.

The staff reviewed the intersection plans submi~ted by the developers
of the Waterford 3rd Phase. The conceptual plan does meet with the
corridor study except for the lorcg range pIa:: for a bridge ever
Highway 7 from Covington Road to St. Albans Bay Road. Engineer
Osmundson will mee~ with the developers engineers to discuss problems
wi th access and design prior to returnL1'J.g to tb_e Council. Wa.tten
was opposed to an additional stop light along Highway 7.
Gagne moved, seconded by Brancel to direct the staff to make the

DISCUSSION OF USE OF PRIVATE PROPERTY AS LAKE ACCESS-HOWARDS POINT
ROAD
Ms. Maude Wadsworth of 5460 Howards Point Road was present to inform
the Council of a lake access beino created over Drivate orooertv.
She locai:ed the lot on a plat for-the Council and explai~ed-that it
was created as a walking lake access for a near by subdivision. This
lot was not to be used as an access for vehicles. She lives next
to the site and has seen cars, trucks, trailers and snowmobiles con-
tinually use this lot as an access. The owner Mr. Neil Spaulding
cleared the lot for use but was unable to obtain a variance to add
improvements on the lot. He put cables and flags across the lot but
they were cut. Mr. Spaulding would like to install a fence across
the lot with a gate for those that have easements granted. Planner

Haugen directed the staff to request the DNR to close the lake access
on Chrlstmas Lake.
Council discussed the funding for ~he control of the milfoil. Mr.
Rascop asked for runds equalling the T.MCD dues $8,913.
Watten moved, seconded by Gagne to authorize funds of $5,000.00 to be
followed by ~he b~lance of $3,913. The $5,000.00 will be submit~ed
on March 1 and S3:913.00 on May 1. Motion carried - 4 ayes.

the roots.
There currently are no dredging permits being considered in Shorewood
at this time. Mr. Rascop's neighbor may request a permit for dredg-
ing that will include digging a larger hole in the lake and filling
i~ wi~h rocks. A pipe will ~un from the rock bed to a dry hydrant
on land that a fire truck hooks up to for fighting fires. This
could improve the fire protection on the island and reduce insurance
ra-ces.

Siqnaqe Request - Shorewood Oaks Drive
Planner Nielsen received a petition for signage for Shorewood Oaks
Drive in an effort to slow traffic through the project. He in-
formed them that "slow children" would not be recommended. Staff
will request added patrolling and report back on further recommenda-
tions.

Financial Resource Analysis
Finance Director Rolek prepared a report on source of financial

of Eurasian milfoil. Gagne and Brancel would like the Dog

City Wide Garbaqe Collection Discussion
Mayor Haugen would like the issue of City wide garbage collection
returned to the Council for further investigation. Her concern
is to protect the City streets and supply a service at a lower
cost to the residents. Brancel would like public input in this
matter.

Doo Ordinance Review
Gagne would like ~o review ~ne curren~ Dog Oralnance ~o requlre
stricter recrulations. This issue will be returned at the
March 13th Council meeting.
Martv Jakel Resiqns from Park Commission
Gagne reported the resignation of Marty Jakel who served seven
and one half years on the Park Commission. The Park Commission
will be presenting a plaque of recognition.
Spring Clean-Up
The Spring clean-up will be scheduled for the last weekend in
April. The site will be reviewed for possible changes due to
the completicn of a new cev~lopment.
Cable
Brancel reported the resignation of the Cable Administrator, they
are currently advertising for the position.
Planning Commission Issues
Brancel would like the Commission to deal with action items on
the study session meetings if the discussion will be short. She
would like to see controls set for small accessory buildings,
permits or time limitation set for completion.

Council discussed the control of design on aesthetics of new
buildings in reference to site location. Some members don't
feel the City should be tha~ res~rictive.
Liquor Stores
The manager would like to upgrade the interior of the liquor
store. He would alsc like to eliminate feed ser~ice t~bles i~
the hall in front of the store.
Recvclinq Site-Leaque of Women Voters
Brancel spoke with the League of Women Voters regarding the news-
~ape= =ec7c~i~; S~~2. T~ey wo~ld lik~ ~c cc~~inue having the
site but they do not want to man the site. They may consider
dcnatinq so~e of the revenue to the clean-up effect to enable
the continuance of the recycling site.

and the City of Shorewood. I genuinely believe my

employees and general interest in the City's affairs will
be beneficial to the continued effective administration
of employees' salaries.
OBJECTIVES
It is necessary that administration of City of Shorewocd
employees' salaries comply with State of Minnesota
c0illparaole wor~n requiremenLs. I~ lS approprlaLe ~na~
administration of salaries continue to reflect the sound
philosophies historically endorsed bv the Council and the
City's adminis~ra~ion.
Members of the Council recognize that salary administra-
tion policies and practices must enable the City to
attract and retain employees with requisite skills,
experience and other qualifications. It is their desire
to be able to reward employees for their overall con-
tributions to the successful provision of services to the
residents of the City. Further, Council Me~bers fully
recognize their responsibility for the effective ad-
ministration of the public funds with which they have
been entrusted.
Therefore, the objectives of this project are to --
1. Incorporate into salary administration policies and
practices those elements which will assure com-
pliance with State of Minnesota comparable worth
requirements.
2. Maintain comparability of salaries paid to Shore-
wood employees to salaries paid to employees
performing similar jobs for other employers with
whom the City of Shorewood competes for employees.

3. Provide structure and guidelines for the ad-

Because of the importance of salaries to the City and
employees, it is of utmos~ importance ~ha~ Council
Members and employees understand and, as appropriate,
participate in the processes that govern administration
of those salaries.
PROJECT OUTLINE
It s proposed that the following steps be followed to

uses include evaluation of performance, recruitment
and training. Format and assistance will be
provided by the consultant throughout this process.
4. The Council, with guidance from the consultant,
will select a method to be used for determining the
relative values of jobs. possible methods include
job match (the me~hod used by Labor Relations
Associates, Inc.), ranking or job evaluation. The
job match method should be sufficient if there is
understanding and active involvement by the Council
and others who are familiar with the jobs involved.
If job evaluation is to be used, it will require
development of a system of evaluation for the City
of Shorewood or purchase of an established system.
5. The method for determining relative job values
selected in Step #4 will be applied to the jobs

designated Council Member and the consultant. The
resulting values and ranking will be presented to
the Council for review, challenge, adjustment and
ultimate approval. (It is expected that a new City
Administrator will be on staff to participate at
least at this stage; if not, an alternative
approach will be chosen.)

Jobs will be ranked on the basis of relative values
as determined in Step #5 and merged with market
survey data to determine salary values. Survey
data to be used may be the published Stanton survey
which has been used historically, other published
surveys and/or a survey to be conducted specifical-
ly for the City of Shorewood. The survey approach
to be used will be determined by the Council with
guidance from the consultant.
7. A salary range will be established for each job (or
gro~p 0= :cts ~ith =~=~2=a~le ~~in~3) w:t~ ~~e
range midpoint to represent the position which the
City of Shorewood intends to maintain relative to
~ne same or similar jobs. Most commonly the
midpoint is the average paid for comparable jobs;
however, the Council may choose to target a point
higher or lower than the average depending on their
pay philosophy. A minimum and maximum for each
range will establish limits for administration of
salaries based on service, performance and/or other
criteria as determined by the Council with guidance
from the consultant.
8. Salaries of individual employees will be ad-
ministered relative to the ranges and criteria to
be used. Guidance will be provided by the consul-
tant as required.
FEE
It is estimated that 50 hours of consultant time will be
required for completion of the project as outlined above.
This does not provide for the development or purchase of
a job evaluation system (Step #4 above) or a special
survey of salaries paid by comparable municipalities
(Step #6 above). The fee for this project will be

hours spent. The City will be billed monthly for hours
expended during the previous month. Payment is due when
billed.

Dear Mr. Alexander:
The City of Shorewood has joined with other Lake Minnetonka communities, the
LMCD, DNR and other agencies in a canmitment to control the spread of Eurasian
Water Milfoil in Lake Minnetonka. Current wisdom suggests that hundreds of
thousands of dollars will be spent in coming years to simply control, not
eliminate, the weed.
While efforts are under way to fight the problem in Lake Minnetonka, Shorewood
is extremely concerned that it may spread to other nearby lakes and waters,
particularly Christmas Lake. Although signs advising people to clean their
boats and motors are being displayed at accesses on Lake Minnetonka and at the
Christmas Lake access, it appears to be just a matter of time and one
~~~~~!~~~~~~~ividual before the weed finds its way to Christmas Lake.
Until such time as better solutions are discovered to eliminate Eurasian Water
Milfoil, Shorewood requests that your department give serious consideration to
closing the public access to Christmas Lake. We realize that this is a
sensitive matter. However, we can not afford, economically or ecologically, to
allow the Milfoil to destroy one of this area's most valuable resources - our
lakes.

Annmldale Advocate v. City of Annandale
In October, 1986, the police chief of Annandale was indicted on a charge
of recklessly discharging his service revolver. After an investigation of
other charges of misconduct and incompetence, the Annandale City Council
fired the chief and sealed a report of their findings.
The Annandale Advocate newspaper sued to have the records released to the
public. On January 20, 1989, the Minnesota Supreme Court held that the
investigative report was private and could not be released to the media or
the public.
In reaching its decision, the court considered both the ~Iinnesota Open
Heeting Law arid the Hinnesota Government Data Practices Act, which, in
some areas, have conflicting provisions.
The Open Heetinq Law, Hinn. Stat. 471.705, requires that all meetings of
local government, with the exception of labor negotiation strategy, be
open to the public, and copies of all printed materials relating to the
agenda be available to tlle public. An intentional violation of this
requirement subjects a council member to Ita civil penalty in an amount not
to exceed $100."
The Data Practices Act sets up classifications for all government data,
some of \vhich are classed as "public data" -- for release to the media and
to the public, and some of which are "private data" -- not for release to
the media or to the public. Personnel data on individuals is generally
private, except for certain data on government employees, which include
among other things, name, salary, job title and description, dates of
employment, and the final disposition of any disciplinary action (and
support documents) which is public. In the case of a willful violation of
the law, a city is ,responsible for exemplary damages to the person damaged
up to the amount of $10,000 for each violation.

Position Profile
The Community
The City of Shore wood is a suburban Twin Cities community, located in Hennepin
County, on the south shore of Lake Minnetonka. It incorporates 3,600 acres and
is 6 miles long and 1 mile wide. Highway 7 runs east/west through the City.
The City is primarily a residential community, with limited commercial
establishments along State Highway 7. Two of the larger employers in Shorewood
are Northern States Power Company and the Minnetonka Country Club. There are
approximately 1,900 single family homes and 80 multi-family units in the City.
The quality of homes ranges from moderately priced to expensive, especially
those located on Lake Minnetonka and Christmas Lake. The 1980 census showed.
a population of 4,646 - the 1988 estimated population is 5,094. The City of
Shore wood has six parks, totalling approximately 90 acres and a public beach
that is open from Memorial Day to Labor Day. The majority of the City is
within the Minnetonka School District #276, which operates an elementary school
within the City. District #276 has an approximate enrollment of 5,254. A
portion of the City also lies within the WestTonka School District #271, which
has an approximate enrollment of 2,646.
The Oreanization
Shorewood was organized as a village in 1956 and became a statutory city in
1974. The City operates under a Mayor/Council form of government. The City
Council consists of four members elected at large to four year terms. The
Mayor is elected to a two year term. The City Council meets every second and
fourth Monday of the month. The City Administrator is the chief appointed
staff member and is responsible for overall City operations. The City has a total
of 17 full-time employees and 35 part-time employees. Shorewood has a joint
powers agreement with the cities of Excelsior, Tonka Bay and Greenwood to
provide police protection. The agreement establishes a police protection agency
called the South Lake Minnetonka Public Safety Department. The Department has
twelve sworn and ten reserve officers. Fire protection is available under contract
from the Excelsior and Mound Volunteer Fire Departments. The City owns and
maintains sanitary sewer laterals throughout the developed portions of the City
and there are approximately 1,900 connections to the system. Major sanitary
sewer and scepters and waste water treatment facilities throughout the
metropolitan area are owned and operated by the Metropolitan Waste Control
Commission. MWCC builds its underlying units for service cost. Municipal water
service is currently supplied to approximately 450 users. The majority of
residences and businesses of the City are supplied by private wells. The City's
municipal water system is supplied by six wells.

The Position
* Plans and directs all City operations to ensure efficient municipal services
and development in line with objectives and general guidelines established by
the City Council.
* Provides overall responsibility for City financial, personnel, and
administrative functions.
* Responsible for advising the Council regarding the impact of policy decisions
and representing the interests of the City in metropolitan, county and state
activities, as delegated by the Council.
* Supervision responsibility includes City Clerk, Finance Director,
Planning/Building Official and Public Works Director.
* Plans and directs the general administration of City services.
* Attends and participates in all Council meetings.
* Coordinates preparation of agendas and supporting data for all Council
meetings, relieves the Council of other administrative work, and implements
Council decisions. .
* Directs communication activities to keep the public informed of City plans
and operations.
* Represents the City in local, regional and state meetings and functions as
delegated by the Council.
* Initiates action to develop the annual budget for presentation in appropriate
form for review and consideration by the City Council, with the Finance
Director - makes Council aware of when budgetary problems occur.
* Monitors the management of the liquor stores and the liquor store funds and
makes reports to the Liquor Commission in regard to business activities.
* Plans and, with Council approval, develops and directs personnel programs,
policies, procedures which will result in the development of the work potential
of each employee in the organization.
* Recommends employee benefits and personnel policy programs and coordinates
all phases of personnel administration.
* Makes recommendations to the Council on the selection of employees to fill
positions and regarding dismissal of employees.
* Represents the City Council in negotiations governing wages, hours and
conditions of employment.

* Works in cooperation with the Council's appointed attorney and City Engineer.
Backl!round and Exoerience
Bachelors Degree in Public or Business Administration preferred, with a
minimum of two to four years of municipal experience (Masters Degree
desirable ).
Specific experience and background in the following areas is beneficial:
* experience in a similar community or as an Assistant.
* experience with computers.
* good record in dealing with employees and the public.
* understand zoning and subdivision ordinances.
* experience in development and working with developers.

Budget Matters-Sale of Equipment
FROM:
SUBJECT:
The sale of the Public Works pick-up/plow has given
rise to the question of what should be done with the
proceeds or if the money may be added back to the
budget. There are many acceptable methods of deal-
ing with this situation.
First, if the truck is used as a trade-in on another
piece of equipment, no amendments need be made to the
budget; it has effectively been done through the
transaction.
Secondly, if the equipment is sold out right, the
proceeds should be recorded as a sale of equipment
in the General Fund. A budget amendment may be made
by the City Council to increase the equipment bud-
get by the amount of the proceeds. The City Council
may wish to leave the proceeds in the General Fund
without amending the budget. It is the prerogative
of the City Council whether or not any action is taken
in this regard.
This should outline some options available to the City
Council. Should there be any questions I would be
happy to discuss them with you.
