CALL TO ORDER
A Sp~9ial meeting was called to order on Monday, March 6, 1989,
at~~p7 P.M., by. Mayor Haugen to review plans for a proposed new
inte.rsection at Old Market Road and State Highway 7.

PLANNING COMMISSION APPOINTMENT - MOONYEEN BONGAARDS
Brancel moved, seconded by Gagne to appoint Moonyeen Bongaards to
the vacancy on the Planning Commission. Motion carried. - 5 ayes.
MAYORS REPORT
Mayor Haugen commented on her concerns on possible Legislative
changes in the area of Comparable Worth, group home laws, City
economic authority and recycling issues.
INTERSECTION STUDY SESSION
Planner Nielsen submitted a revised design for a new intersection
that is proposed in conjunction with phase three of the Waterford
Project. Configuration changes have been made in order to comply
with MnDOT requirements. Staff has recommended submitting this
plan to MnDOT and request approval and funding. A response from
MnDOT should be expected within 30 days. MnDOT is currently support-
ing the improvement to the Vine Hill Road intersection. This would
include service roads behind the existing businesses and an improve-
ment to Vine Hill Road.
Jens Beck and Nick Boosalis, developers of Waterford 3rd Phase,
would like Council to consider funding methods like tax increment
financing for the intersection. The proportion of cost sharing
should be considered.
The commercial area of this project may contain a three story office
building with parking and retail center with auto service.
Council directed the staff to submit the plans to MnDOT for approval
and request funding. Alternative funding sources will be discussed
after MnDOT response is received.

Meetings are being held with affected neighborhoods to inform them
of the project proposals. The first phase will consist of town-
houses with two homes per building in the $180,000.00 to $250,000.00
range.

The Park Commission submitted a plaque to Marty Jakel in appreciation
for seven years of service on the Park Commission.

CONSENT AGENDA
Beaver Control Discussion - Continue
Brancel opposed this amendment,as it left open to many possible
interruptions and it needs additional restrictions.
Jane Kline supports live trapping and chemical treatment and
wrapping. She has offered volunteers to help wrap and apply
chemical treatment. These new chemicals do not repel all wild-
life. Roger Stein felt the problem will improve with the needed
rainfall.
Attorney Froberg reviewed the current Ordinance and after discussion
he felt that the Council can determine "nuisance animals." Beavers
and muskrats could be included as nuisance animals and could be
live trapped under the provisions of the current Ordinance.
Ms. Kuester questioned who is responsible for the Waterford pond-
ing area. Engineer Norton explained the design of the culvert
drainage of Waterford 2nd Addition and recommended that it be
maintained to allow drainage. Gagne directed that Public Works
cut stakes off on City property after property lines have been
determined.
Mayor Haugen would like to add live trapping by permit from the
City to a licensed DNR trapper only; Stover moved, seconded by
Gagne, for discussion. Mr. Rascop feels that a management plan
by the City is needed, he supports leaving the ordinance as it
exists, this change would restrict property owners to trap on their
own property. Motion failed - 1 ayes (Gagne) to 4 nays.
The Council discussed setting up a committee to draft a management
plan. Brancel offered to head up the committee. She asked for
volunteers. The committee will report back with a plan at the
April 24th Council meeting.
CDBG Funding Discussion
Clerk Kennelly asked the Council for suggestions on the use of the
$20,595.00 funds allocated to the City for Year XV funds. Ms.
Joanne Kawern was present to request $5,708.00 of the funds for
the South Shore Seniors as in the past year. Clerk Kennelly re-
commended that the balance of $14,887.00 be allocated for re-
habilitation of low income private property. A public hearing
will be held on March 27, 1989 to dedicate the funds.

CALL TO ORDER
The Regular Council meeting of the Shorewood City Council was
called to order at 7:30 P.M., Monday, March 13, 1989, in the Council
Chambers by Mayor Haugen.

Mayor Haugen opened the Regular Council meeting with the Pledge o.f
Allegiance.
ROLL CALL
Present: Mayor Haugen, Councilmembers Brancel, Watten, Stover and

APPPROVAL OF MINUTES
Gagne moved, Brancel seconded, to approve the Special meeting minutes
of February 6, 1989, as written. Motion carried - 4 ayes (Stover -
obstained due absent from meeting)
Gagne moved, Brancel seconded, to approve the Regular Council meeting
minutes of February 27, 1989, as written. Motion carried - 5 ayes.
COMMISSION REPORT
Park Commission Report
The Park Commission agreed to allow the Spring clean-up to be held
at Freeman Park. They would like the area fenced to prohibit
flying debris and to send out notifications to the residents in
Shorewood Oaks area of the clean-up days planned for April 29 and 30.
Planning Commission Report
Stover reported that there was no quorum. The members discussed
the need for a rental housing ordinance and further discussion will
continue at the next meeting.

Brancel moved, seconded by Stover, to approve the request as
submitted. Motion carried - 5 ayes.
South Forty Addition - Final Plat
Approval
Resolution No.20-89
Mr. Wayne pokorny of 24275 Yellowstone Trail was present to request
final plat approval for the South Forty Addition. Engineer Norton
clarified an error in the grading plan that will change the front
yard setback from 30' to 35'. Gagne asked about including all
building pad location at this time to alleviate variance requests
later on. Mr. pokorny would like to leave this up to the buyers
determination in order to reduce loss of trees on the lot. Engineer
Norton felt the lot by lot review of building pad will turn the
responsibility of proper drainage flow back on the building in-
spector.
Stover moved, seconded by Watten, to approve the final plat and
development agreement for South Forty Addition subject to the
Engineers approval of the grading plan and acceptance of the
Attorneys and Planners recommendations. Motion carried - 5 ayes.
Beaver Control Discussion
Mayor Haugen read a prepared statement reviewing the previous dis-
cussion on the beaver problem and assuring the residents that a
great deal of thought and concern have been made on this issue.
Mr. Al Nelson supported the use of the canabear trap and felt there
is a need for a wildlife management program to handle all animal
problems in the City. He felt live traps were not effective and
steel leg hold causes prolonged suffering where the canabear trap
causes instant death.
Ellen George, a member of the Board of Directors of the Humane
Society, opposes leg hold traps and encouraged the Council to
look at both sides of this issue. She supports management in a
humane manner to assist the property owners.
Gagne wants a solution to help the property owners but does not feel
tree wrapping is the solution. Stover is opposed to killing, she
supports creating an undesirable environment for the animals.
Brancel felt tree wrapping and chemical application should be tried.
Watten felt co-habitation can be accomplished.
Mayor Haugen offered an amendment to grant a trapping permit on
an emergency basis to license trapping. for a three month period.

Doq Ordinance Amendment Discussion - Continue
or fenced provision for the ordinance. Chief Young of the Police
Department and Rick Stenberg of Midwest Animal Patroling were
present to clarify Council's questions on enforcement of the
ordinance.
The Council reviewed the current ordinance and offered amendments
that will appear in a new draft to be submitted to Council for
acceptance at the next Council meeting of March 27, 1989. A
resolution will also be submitted in conjunction with the ordinance
that will state a fine schedule and authorization to issue citations.
Chief Young did clarify that the Police Department will respond to
animal complaints when the animal patrol is not available. This
response will be handled after emergency situations have been
completed.
TAX FORFEITED PROPERTY STATUS - 26620 SMITHTOWN ROAD
A request has been received to release for sale a parcel of land
located at 26620 Smithtown Road. The Council placed a "hold" status
on this property last November. They wanted to review possible City
uses for this property prior to releasing. The County informed us
that the City has to determine a use for this property within one
year and initiate that use within five years. Planner Nielsen re-
commended postponing any change in action until a study of the uses
can be completed. This study will be completed for review prior to
the November deadline.
SALE OF WATER REQUEST - AMESBURY
The Amesbury Home Association has asked the Council to stipulate
conditions under which the City would sell them water to restore the
levels of their ponding areas. They have stated that they will drill
a well if the drought conditions remain as is. A permit from the
City and DNR would be needed to do so.
Council's consenus was that filling the ponds was not an appropriate
use of water in a period of drought.

Status of Park District Litigation
The Court has ruled against the City of Minnetrista in their suit
against the Park Board in their pursuit of land acquisition.
Minnetrista intends to file an appeal.

An appeal has been filed by the plaintiff in this case.
Glen Road Drainaqe Project
The responses regarding the request for drainage easements in
the Glen Road area have been very negative thus far.
Staff recommends that a special meeting be held to answer the
questions from the residents regarding the project plans and
easements. The meeting will be held at 7:30 P~M., April 3, 1989,
if an engineer from the Minnehaha Creek Watershed District can
attend to answer questions.
Planner Nielsen will obtain a cost estimate for needed property
appraisal work.
Enqineers Report
Acceptance of Utilities and Streets
WCL Acres
Resolution No.21-89
Engineer Norton has recommended taking over ownership of the
utilities and streets within the WCL Acres subdivision, subject
to receipt of the asbuilt information and a one year maintenance
bond on the utilities and streets.
Mayor Haugen moved, seconded by Gagne, to accept utilities and
streets within the WCL Acres subdivision subject to engineers
recommendation. Motion carried - 5 ayes.
Administrative Reports
Special Meetinq Schedule
Resume Review - The Council will meet, Tuesday, March 14, 1989,
at 7:30 P.M. to review the resumes received for the Administrators
position.
Interviews - The interview for the finalist will begin at 4:00 P.M
on Tuesday, March 28, 1989.
Glen Road Drainaqe - A special meeting is proposed for Monday,
April 3, 1989 at 7:30 P.M. Council directed that the dis-
cussion of water service to Bayshore Shop be placed on that
agenda also.
Weekend Workshop - Staff recommended the Council to select a
date for the workshop at the next meeting and offer suggestions
for the agenda.

Christmas Lake Road/Lane Cul-de-Sac Complaint
Complaints have been received regarding the maintenance of the
cul-de-sac at Christmas Lake Road and Lane. The first complaint
asked that it be plowed to allow emergency vehicles, the second
complaint, is that it is now accessible to all traffic who chose
to use it.
Attorney Froberg felt this area is to be accessible for emergency
vehicles and pedestrian traffic. Council requested the Attorney
to review the development agreement and determine who is responsible
for the replacement of "safe hits" at this time.

MAYORS REPORT
Mayor Haugen will attend a meeting with the residents of the Water-
ford area to discuss the proposal for the 3rd phase of Waterford.

Gagne moved, seconded by Brancel, to adjourn the regularly scheduled
meeting of the Shorewood City Council at 11:05 P.M. on Monday,
March 13, 1989, subject to approval of claims for payment. Motion

SETBACK VARIANCE - RECONSIDERATION
Cliff Anderson - 5351 Shady Hills Circle
This request was originally presented to the Planning Commission at its 7 February
meeting. A revision of the request was presented to the Council who referred the
proposal back to the Planning Commission.
Chair Schultz reopened the public portion of the public hearing at 7:43 P.M.
Planner Nielsen explained the change in the request as presented in two alternative
forms: 1) a 5 foot front yard setback variance for a corner of the garage, with a 12
foot rear yard setback variance for a corner of the house; or 2) a 21 foot rear yard
setback variance, with the house meeting the front yard setback. Nielsen said that any
of the proposals would be acceptable in demonstrating hardship including the original
proposal.
Dexter Marston, representing Peggy and Phil Marsten for the proposal, reviewed the
history of the lot. He stated that the site meets the hardship criteria for severe
topography (40%), lot configuration/shallowness, and said that no other lot in the
neighborhood has this combination of physical constraints. Site alteration would be far
less necessary with the proposed plan. -
Schultz asked which alternative was desired by the applicant. Peggy Marsten said that
the plan described as Exhibit A-3 of the Planner's Report dated 16 March 1989 is their
preference.
Scott Sandell, 5345 Shady Hills Circle, asked if the current house proposal is the same
as originally proposed, and if the garage could be moved back or reduced in size or
eliminated? Peggy Marsten said yes it is the same and the length of the garage cannot be
shortened if it is to meet building code. Planner Nielsen stated that the zoning
ordinance requires a site plan to show where a two car garage can be located on the site,
whether it is planned to be built or not.

Pat Malmsten, 5350 Shady Hills Circle, said that his original concern was having the
house too close to the front, but now he is concerned about having the house too close to
the wetlands.
Phil Marsten explained that there is 50 feet of neighboring property behind his lot
before the wetlands even begin.
Sandell questioned location of wetlands. Nielsen provided a topography sketch of the
Johnson property which is adjacent to Marsten's and which contains the wetlands in
question.

Benson moved, seconded by Robertson to recommend to Council approval of a front yard
setback variance of 5 feet and a rear yard setback variance of 13 feet as shown in
Exhibit A-3 of the Planner's report dated 16 March 1989. Motion carried unanimously by
roll call vote - 4 ayes.

8:00 P.M. PUBLIC HEARING - PRELIMINARY PLAT - MARILYNWOOD 2ND ADDITION
K & H Builders - South end of Riviera Lane
Mr. Gerald Kelsch, representing K & H Builders and Developers is requesting approval of a
preliminary plat to divide approximately 4.98 acres of property located at the south end
of Riviera Lane into three single-family residential lots. The proposed lots would
exceed the R-1C district area requirements by 3 to 4 times in size, and also exceed the
district's dimension requirements.
Planner Nielsen reviewed his recommendations, and added one that would require that the
City Engineer review drainage at the time of final plat approval due to a neighborhood
concern of a drainage problem which already exists at the end of Riviera Lane.

21 March 1989
Larry Hanson of Schoell and Madsen (project engineer) expressed concern over the ability
to maintain a less than 8% grade for the driveway on Lot 2. Planner Nielsen said the
right house design would work on this grade. Hanson discussed possibilities with his
clients. and said that although they don't know at this time what type of house will be
built on that lot. building it at the front setback if necessary should accommodate the
grade.

Robertson moved. seconded by Benson to recommend to Council approval of the preliminary
plat subject to the Planner's recommendations as set forth in his report dated 14 March
1989 including the added recommendation that the drainage be subject to the City
Engineer's review and approval. Motion carried unanimously.

8:15 P.M. PUBLIC HEARING - C.U.P. TO EXCEED 1000 SQ. FT. OF ACCESSORY SPACE
Paul Bardine - 6085 Riviera Lane
Public portion of the public hearing opened at 8:29 P.M.
Planner Nielsen explained that Mr. Bardine is seeking C.U.P. approval to construct
accessory space in excess of 1000 square feet on his property. His house is currently
under construction and contains a triple garage facing Riviera Lane. He would like to
include an additional tuck-under garage beneath the main garage and access the lower
level from the opposite direction (south). The total area of accessory space (1380 sq.
ft.) does not exceed the "footprint" of the principal structure (1556 sq. ft.). nor does
it exceed 10% of the required lot size for the R-1A district (4000 sq. ft.).

Benson moved. seconded by Robertson to recommend to Council approval of the C.U.P.
Schultz asked the applicant his purpose for this amount of accessory space. Mr. Bardine
said it is intended for storage of his boat and other recreational equipment. Motion
carried unanimously.
Benson said he felt that requ~r~ng the C.U.P. process for this particular type of request
seems totally unnecessary. The Commission discussed the various reasons for the C.U.P.
provisions and decided it could be discussed as part of the Zoning Ordinance study.

8:30 P.M. PUBLIC HEARING - PRELIMINARY PLAT.... DUTCHER ADDITION
Phil Dutcher - West side of Wedgewood Drive
Public portion of the public hearing opened at 8:46 P.M.
Planner Nielsen explained that Mr. Dutcher would like preliminary plat approval to divide
this site into four single-family residential lots. The property is currently zoned R-1C
and contains approximately 2.66 acres. He said the plat meets or exceeds the zoning and
subdivision requirements. Sewer connections are limited at this time due to the MWCC
moratorium.

MATTERS FROM THE FLOOR
Schul tz asked about the reforestation "policy" which was brought up at the Joint Study
session by Jan Haugen. and the potential for the City adopting such a policy. Stover
said she will bring it up to the rest of the Council.

The total amount of allocation to Shorewood for year XV is $20,595.00. I
am attaching a request from the South Shore Senior Center for fundings
in the amount of $5,708.00 to go toward daily operations, specifically in
the area of salaries.
In the past we have allocated funds to Rehabilitation of private property.
I would suggest that the remaining balance of $14,887.00 be so allocated.
If you have added funding suggestions, these should be identified prior to
the public hearing of March 27, 1989.

Notice is hereby given that the. city of Shorewood in
cooperation with Hennepin County, pursuant to Title I of the Housing and
Community Development Act.of 1974, as amended, is holding a public hearing on

The public hearing is on the housing and community development needs of the
city and Urban Hennepin County, the Urban Hennepin county Community Develop-
ment Block Grant Program Statement of Objectives, and the proposed use of the
Year.y:.J Urban Hennepin County Community Development Block Grant Program
Planning Allocation of $ 20,595.00 by the city.
The Statement of Objectives consists of seven program areas, basically: (1)
Administration, to maximize program benefit and effectively administer program
funds; (2) Housing, to rehabilitate and assist in the development of housing
which is affordable to low- and moderate-income households; (3) Neighborhood
Revitalization, to maintain and preserve viable neighborhoods through concen-
trated community development activities; (4) Public Facilities, to improve
existing and assist in the development of new public facilities which-benefit
low- and moderate-income persons; (5) Economic Development, to provide
financial assistance to businesses which will provide or retain employment to
the benefit of low- and moderate-income persons; (6) Public Services, to
expand and improve the quantity and quality of public services available to
low- and moderate-income persons; and (7) Removal of Architectural Barriers,
to remove material and architectural barriers which restrict the mobility and
accessibility of elderly or handicapped persons.
The city of Shorewood is proposing to undertake the following

Cliff Anderson has submitted revised plans to build a house at 5351 Shady Hills
Circle. You will recall that the Planning Commission. at its 7 February
meeting. referred Mr. Anderson's request for a variance to the Council with a
2-2 split vote. The City Council subsequently tabled the matter at the
applicant's request while he explored modifications to his original plans.
Having since met with Vern Watten. Mr. Anderson prepared an alternative plan
(Exhibit A-3) which moves the house back on the lot so that only aUve foot
front yard variance for the northeast corner of the garage is required. In
moving the house back. however. a thirteen foot rear yard variance is
required. The plan shows the house twisted on the lot so that only corners of
the building encroach into the setback areas.
After further consideration the applicant has also submitted an alternative
plan which simply pushes the house straight back to the 35 foot building line
(Exhibit A-2). This results in a 21 foot rear yard variance. This is the plan
the applicant prefers. but he is agreeable to either alternative. Mr. Anderson
elaborates on how his request complies with Shorewood's variance provisions in
a letter. dated 14 March 1989 (see Exhibit B. attached).
From a design perspective. both of the alternative plans require more site
alteration than the original plan. but nowhere near what would be required to
move the house to the east. The excavation and filling which would be required
to build a house entirely within the buildable area of the lot (see Exhibit
B-4) would likely require the removal of virtually all vegetation. with the
possible exception of the southwest corner of the site.

The alternative plans should satisfy the concerns of neighboring residents
relative to the proximity of the house to the street. There is justification
for the rear yard variance because the land behind the subject site is likely
unbuildab1e (severe slopes dropping into a large designated wetland).
The Planning Commission and Council must decide which alternative is
preferrab1e - either is considered justifiable.

We respectively request the Planning Commission to consider
a variance of set back restrictions on Lot 9, Block 4,
Shady Hills. Due to the topography and configuration of
the lot we are unable to build on the lot without a variance.
Our original request was for a front property variance of
15 feet. Some of the neighbors were concerned about the
house appearing too close to the street in relation td other
homes in the neighborhood. In order to address their concerns
we are proposing to move the house back. See 2 attached
proposals.
The first proposal would require a rear variance of 15 feet.
The second proposal would require a front variance of 5 feet
for only a front corner of the garage. Also we would need
a rear variance of 13 feet. .
It would appear that approval for this request would apply
to Shorewood Ordinance 1201.05 Subd. 1 and Subd. 2. We feel
that we meet the requirements for approval of a variance
as stated inShorewoodordinance 1201.05 because of the
special conditions and circumstances which are peculiar to
this property. The special conditions include the configuration
of the lot which has the buildable area narrowing to 20 feet
on the west end of the property. A 40% slope and the environ~
mental impact of building on this steep of slope and the fact
that building in the area with the steepest slope would place
the elevation of the house below the sewer connection in the
street.

RE: Request for variance on Lot 9 Block 4, Shady Hills
In order to explain the process of building on this lot with such extreme
topography and without a variance, I would Ilike to outline the problems involved.
Let us assume that a house measuring 261 x 501, which is the average size
of house built in Shady Hills, were to be built within the boundries of 35'-0
set back from the street and within the 401-0 rear lot line. (Topographical
survey attached).
The highest corner of the basement floor would be 121-0 below the highest
part of the lot. The opposite diagonal part of the basement floor would be 291-0
below the highest point or 171-0 below the corner described above. Building a
required foundation of 11 courses or 94" height would require at least the equivil..
ant of 2 foundations on top of each other to bring the foundation up to level with
the point of basement which is already 121-0 below the lot high point.
Every tree within about 251-0 of the basement would have to be removed to
accommodate the tons of fill required to bring the basement floor level inside up
to grade. Additi ona 1 fill woul d be requi red outs i de the foundati on to have at
least a 101-0 level area around the walkout basement and to cover at least half
the front so the concrete blocks wouldnlt be exposed.
Viewing the east end of the house from the road the peak of the roof would
be 51-0 above road level.
Connecting to the sewer would also require a grinder pump to lift the sewage
to sewer level.
Building an attached garage with grades described would result in a driveway
so steep as to become dangerous.
As required by Ordinance the notice for the previous request for a variance
was sent to 25 owners of surrounding properties of the lot in question.
It is understood that only 3 parties voiced their opinion in opposition to
the granting of the variance.
Specifically, the parties objected to the original request for a lessor
set back from the street than the required 351-0. This problem has been solved
by the new request staying within the 351-0 or an alternate proposal infringing
only 61-0 on one corner.
One party mentioned the environmental aspect stating some trees would be
destroyed. This request for a variance would result in the least amount of tree
destruction if placed on the higher portion of the lot.

Another party objected to the variance because they enjoyed looking at
the undeveloped lot across the street and didnlt want to see a house built.
All of the above reasons for denying the variance should have no bearing
on the decision.
Furthermore, when Ordi nance 1201. 05 was adopted the Council must have
anticipated situations like this to remedy the problem and grant variances.
The Subd. 2 or Ordinance 1201.05 outlines as follows:
Subd. 2. Conditions Governing Consideration of Variance Requests:
a. In considering all requests for a variance and in taking
subsequent action, the City staff, the Planning Commission
and the City Council serving as the Board of Adjustments
and Appeals shall make a finding of fact that the proposed
action will not: .
(1) Impair an adequate supply of light and air to
adjacent property.
(2) Unreasonably increase the congestion in the
public street.
(3) Increase the danger of fire or endanger the
public safety.
(4) Unreasonably diminish or impair established property
values within the neighborhood, or in any other way. be contrary
to the intent of this Ordinance.
(5) Violate the intent and purpose of the City Comprehen-
sive plan.
b. A variance from the terms of this Ordinance shall not be granted
unless it can be demonstrated that:
(1) Special conditions and circumstances exist whi.ch are
peculiar to the land, structure, or building involved and which
are not applicable to other lands, structures, or buildings in
the same district:
(a) Special conditions may inclUde exceptional tOpOgraphic
or water conditions or, in the case of an existing lot or
parcel of record, narrowness, shallowness or shape of the
property.
(b) Special conditions and circumstances may not be
primarily economic in nature.
2 Literal inter retation of the rovisions of this
Ordinance wou deprive the applicant of rightsc~nly enjoyed
by properties in the same district under the terms of this Ordinance.
(3) The special conditions and circumstances do not result
from the actions of the applicant.
14) Granting the variance requested will not confer on the
applicant any special privilege that is denied by this Ordinance
to other lands, structures, or buildings in the .same district.

c. Application for a variance shall set forth reasons that the
variance is justified in order to make reasonable use of
the land, structure or building, and that the variance is
the minimum variance necessary.
Referring to (2) and (4) under b. it is noted that the adjoining house
on Lot 8, Blk 4 (5355 Shady Hills Circle) is definitely encroaching on the
rear set back restriction.
According to Brad Nielsen this lot has the most extreme in topographical
problems and should have a variance granted. It is understood that variances
have been granted for lessor reasons than what has been proposed.
Please consider this variance for which the intent of Ordinance 1201.05
was adopted. Let it be also known that taxes, sewer assessments, etc. have
been paid on this lot since 1956 and should have the same advantages as other
properties in Shady Hills.

BACKGROUND
Mr. Gerald Kelsch, representing K & H Builders and Developers, has requested
approval of a preliminary plat to divide approximately 4.98 acres of
property, located at the south end of Riviera Lane (see Site Location map -
Exhibit A, attached), into three lots (see Exhibit B).
The property currently consists of three parcels - Lot 6, Outlot D and
Outlot E, and is located in the R-1C zoning district. Lot 6 is occupied by a
single-family dwelling and detached garage. The applicant's request is
explained in greater detail in his request letter, dated 7 February 1989
(Exhibit C).
ANALYSIS/RECOMMENDATION
When Marilynwood was originally platted, the subject parcels were set up for
possible resubdivision into as many as six residential lots. Outlot E was
designed as one half of a future cul-de-sac. Apparently the cost and site
alteration which would be required to extend the road into the site were
prohibitive, thus the three lot proposal.
The proposed lots all meet or exceed the requirements of the R-1C district as
can be seen by the following:

Preliminary Plat

The proposed preliminary plat states that existing easements on Lot 6 will be
vacated and rededicated on the new plat. The applicant must submit legal
descriptions of these easements so that the Council can hold the necessary
hearing. The final plat should show easements 10 feet on each side of each
side and rear lot line and over the portion of the pond located in the
northwest corner of Lot 1.
The cul-de-sac at the end of Riviera Lane is substandard relative to pavement
diameter. As part of this plat the developer should be required to add
approximately 15 feet of bituminous to the east side of the cul-de-sac to
round it off.
It is recommended that the preliminary plat be approved subject to the
following:
1. The applicant must submit up-to-date (within 30 days) title op1n10ns for
all properties involved, at the time the final plat is submitted.
2. Park dedication fees totaling $1000 (credit is given for the lot with the
house on it) must be paid prior to release of the final plat.
3. The applicant should advise the City Clerk as to how sewer equalization
charges should be spread against the lots.
4. Legal descriptions for easements on existing Lot 6 must be provided by
the applicant. Upon receipt of the descriptions, a public hearing will
be scheduled to vacate them.
5. The final plat must be submitted within six months of approval of the
preliminary plat.
6. Upon receipt of the final plat the staff will prepare a simple
development agreement to address the recommended cul-de-sac improvement.
7. As part of the final plat, the applicant should be required to show that
a driveway less than eight percent in 'grade can be provided for Lot 2.
8. A dilapidated outbuilding on Lot 2 must be removed prior to approval of
the final plat.

Dear Mr. Nielsen:
We would respectfully request your review concerning the potential for the
replatting of a certain subdivision located within the City of Shorewood.
Specifically, we are requesting the replatting of Lot 6, Block 1 and
Outlots D and ~ in the original "Marilynwood Plat" to the "Marilynwood 2nd
Addition" plat located adjacent to State ~ighway No. 7 at the end of Riveria
Lane.
At this time we have had the firm of Schoell & Madson, Inc. prepare a
preliminary plat for your inspection and review, which has been included with
this correspondence. As you will see, we are proposing to divide the existing
parcel into three (3) single family residential lots. Each lot will contain
well in excess of the 20,000 square feet per lot size requirement as specified
in the zoning ordinance. Lot No. 1 will contain approximately 89,000 square feet
or 2.0432 acres, Lot No.2 will contain 64,500 square feet or 1.4807 acres and
Lot No.3 will contain 57,400 square feet or 1.3177 acres. Site area for roads
wilT make up the remaining 5,927 square feet or 0.1361 acres, for a total
replatted area of approximately 4.98 acres.
For the purposes of properly locating future single family building pads,
setback lines have been included on the proposed preliminary plat in conformance
with the R-IC zoning classification.
We should further indicate that our proposal for the future development of
the above lots shall be cognizant of and sensitive to the following items:
1. Conformance with the City's master plan for future land use and all
other City ordinances, policies, provisions and codes.
2. All environmental issues and impacts will be addessed as required.

BACKGROUND
Mr. Paul Bardine has requested a conditional use permit. pursuant to Section
1201.03 Subd. 2d. (4) of the City Code. to construct accessory space in excess
of 1000 square feet on his property at 6085 Riviera Lane (see Site Location
map - Exhibit A. attached). The house. currently under construction.
contains a triple garage facing Riviera Lane (see Building Elevations -
Exhibits B and C). An additional tuck-under garage will be located beneath
the main garage. Access to the lower level will be from the south (see
Property SurVey - Exhibit D).
The property is located in the R-1A. Single-Family Residential District. The
proposed house contains 1556 square feet of area on the main level and 1451
square feet on the lower level. The upper level garage will contain 660
square feet and the lower level garage will contain 720 square feet.
ANALYSIS/RECOMMENDATION
Following is how the applicant's request complies with Section 1201.03 Subd.
2d. (4) of the City Code:
a. The total area of accessory space (1380 square feet) does not exceed the
"footprint" of the principal structure (1556 square feet).
b. The total area of accessory space does not exceed 10% of the required lot
size for the R-1A District (4000 square feet).

c. The additional garage space is designed as an integral part of the house.
If not for the 8' x 7' overhead door it would be considered to be part of
the basement. As part of new construction. overall site grading and
drainage have been designed to fit the lot.
d. As mentioned above the only thing which differentiates between the
proposed lower level garage and a basement is the small overhead door on
the south side of the house. It is worth noting that by facing the
garages in different directions. the overhead doors can not be seen from
anyone direction.
Based upon the preceding it is recommended that the c.u.p. be approved as
presented.

BACKGROUND
Mr. Phil Dutcher has requested approval of a preliminary plat for property
located on the west side of Wedgewood Drive. immediately south of the
Hennepin County Regional Railroad Authority right-of-way (see Site Location
map - Exhibit A. attached). Mr. Dutcher proposes to divide the site into
four single-family residential lots (see Exhibit B). The property is
currently zoned R-1C and contains approximately 2.66 acres.
ANALYSIS/RECOMMENDATION
The proposed lots meet or exceed the m~n~mum requirements for lot area. width
and depth in the R-1C district. Lots range in area from 20.099 to 31.187
square feet and average 27.107 square feet in area.
At the request of this office the applicant has platted 15 feet of additional
right-of-way for Wedgewood Drive. which is currently substandard in width.
Combined with r.o.w. acquired from the Harding Acres plat on the other side
of the street. this portion of Wedgewood Drive will now meet current
standards.
The property in question is located in the area which is affected by the
Metropolitan Waste Control Commission's restriction on sewer extension
permits. City staff has submitted a formal request to the MWCC for
additional sewer connections due to leakage which was repaired in existing
sewer lines last summer. While we are confident that these units will be
available soon. the proposed plat can be accommodated by existing sewer
service - either from the east side of Wedgewood Drive or from the existing
sewer located in the H.C.R.R.A. r.o.w. The applicant may wish to have his
engineer examine the various alternatives for sewer service for cost
effectiveness prior to submitting his final plat.

It is worth noting that Lot 1 actually contains more buildable area than that
shown on the preliminary plat. The rear setback for triangular lots is
typically described as a radius from the rear point of the lot. The correct
setback is shown on Exhibit B in a heavy dashed line.
Approval of the preliminary plat is recommended subject to the following:
1. The applicant must submit a final plat within six months of preliminary
plat approval.
2. An up-to-date (within 30 days) title opinion must be submitted with the
final plat.
3. The final plat should provide drainage and utility easements 10 feet on
each side of each side and rear lot line.
4. The applicant must adivse the City Clerk as to how he wants sewer
equalization charges spread against the lots.
5. Park dedication fees totaling $2000 must be paid prior to release of the
final plat.

In September of last year, the City approved a division/combination for
properties owned by Mike Newberg and Dave Voaklander (see Staff report, dated
1 September 1988). After considerable effort. the applicants were unable to
obtain clear title to the Voaklander property. Mr. Newberg now wishes to
revise the subdivision to simply acquire the 25 foot strip on which his
driveway is located.
While the original division/combination was desirable in terms of resolving
existing nonconformities (building setbacks), the revised division/combination
is still consistent with Shorewood's zoning and subdivision regulations.
Approval is therefore recommended.

AN ORDINANCE AMENDING CHAPTER 701 OF THE
SHOREWOOD CITY CODE REGULATING THE
KEEPING OF DOGS
THE CITY COUNCn. OF THE CITY OF SHOREWOOD, MINNESOTA, ORDAINS:
Section 1.
follows:
City Code Section 70,1.01, Subd. 4 is hereby amended to read as
"Subd.
4. RESTRAINT: A dog is under restraint if it is on the
premises of the person harboring or keeping the dog, or if
the dog is with the person having custody of it and is
effectively restrained by a leash or chain or is within ten
(10) feet of the person having custody of it and is obedient
to the command of that person."
Section 2.
City Code Section 701.02 is hereby amended to read as follows:
"701.02: ENFORCEMENT:

Section 4. City Code Section 701.05 is hereby amended to read as follows:
"701.05: RUNNING AT LARGE: No dog owner, as defined in this
Chapter, shall permit his dog to run at large. The finding of any
dog running at large shall be prima facie evidence of violation of
this Section by the owner of said dog."
Section 5. City Code Section 701.06 is hereby amended to read as follows:
"701.06: DOG NUISANCES: It shall be unlawful for any owner to fail
to exercise proper care and control of his animals to prevent them
from becoming a public nuisance. It shall be considered a nuisance
for any animal to bark excessively, continuously or untimely, to

molest, annoy or bite any person if such person is not on the
property of the owner or custodian of such animal or to It:ituallY
frequent school grounds, parks, or public beaches, chase ve cles or
molest, defile or destroy any property, public or private. Failure
on the part of the owner or custodian to prevent his animals from
committing an. act of nuisance shall Subject the owner or custodian
to the penalty hereinafter provided."
Section 6. City Code Section 701.07 is hereby amended to read as follows.
"701.07. CONFINEMENT OF CERTAIN DOGS. Every dog in heat shall be
confined in a building or other secure enclosure, in such manner
that such dog cannot come into contact with another dog, except for
planned breeding."
Section 7.

4. Redemption by Owner. Every owner or person having the
custody of a dog may redeem the same from the Animal
Enforcement Officer by paying for board and associated costs
for each day or fraction thereof as such animal is held in
custody by the Animal Enforcement Officer and obtaining a
license for said animal in accordance with this Chapter if
the license has not hereinbefore been issued for said
animal. Such associated costs shall include an impounding
fee set by resolution of the City Council from time to time.
In determining the impounding fee, the Council may establish
a schedule of fees based on the number of times a dog has
been impounded. In addition to the payment of the board,
licensing and associated costs set forth in this Section, the
owner shall remain subject to all other penalties contained
in this Ordinance."

pedestrians or interferes with the driving of automobiJ.es in
the public streets or highways ~

The judge or clerk of said Court shall issue a summons directed to
the owner of the dog commanding him to apPear before said judge to
show cause why the dog should not be seized and euthanized by the
Animal Enforcement Officer or otherwise disposed of. Upon such
hearing and finding the facts true as complained of, the judge may
ei ther order the dog euthanized or the owner or custodian to remove
it from the City, or may order the owner or custodian to keep it
confined to a designated place. If the owner or custodian disobey
such order, he shall be in violation of this Chapter the Animal
Enforcement Officer may, upon disobedience of said order, impound or
dispose of the dog described in said order. The costs of all
proceedings described herein shall be assessed against the owner or
custodian of the dog, if the facts in the complaint are found to be
true ~ or to the complainant if the facts are found to be untrue."
Section 11. This Ordinance shall be in full force and effect from and
after its passage and publication.

A RESOLUTION SETTING A FEE SCHEDULE FOR '!'HE
REDEHP'l'ION OF .ANIMALS
WHEREAS, Shorewood City Code Section 701.08, Subdivision 4
provides for the redemption of animals by the owner thereof upon payment
to the Animal Enforcement Officer certain charges for board and associated
costs~ and
WHEREAS, said Subdivision provides for the City Council to set by
Resolution a pay schedule of impoundment fees payable upon the redemption
of such animal.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
(1) That the initial impoundment fee for redemption of an animal
impounded by the Animal Enforcement Officer shall be $25.00.
(2) That the fee for redemption of an animal impounded by the
Animal Enforcement Officer the second time within a period of twelve (12)
months shall be $50.00.
(3) That the fee for redemption of an animal impounded by the
Animal Enforcement Officer the third time within a period of twelve (12)
months shall be $100.00.
(4) That such impoundment fees shall be in addition to boarding
charges, license fees, and any fines that may be assessed against the
owner of the animal.

A RESOLUTION DESIGNATING AN AGENT TO
ISSUE CITATIONS FOR VIOLATIONS OF
CHAPTER 701, DOGS
WHEREAS, Shorewood City Code Section 603.10 provides for the City
to designate by Resolution certain employees, officers and agents to issue
citations whenever the officer's, employee, or agent has probable cause to
believe that the person cited has commi.tted a misdemeanor which the
officer, employee, or agent has the duty to-enforce; and
WHEREAS, Shorewood City Code Section 701.02 provides for the
Council to appoint an Animal Enforcement Officer or enter into a contract
to enforce the Chapter which provides for the keeping and disposal of
animals; and
WHEREAS, the Council has contracted with Midwest Animal Patrol to
serve as Animal Enforcement Officer and to enforce the provisions of
Chapter 701.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
(1) That Midwest Animal Patrol is hereby designated as Animal
Enforcement Officer and hereby charged wi th the enforcement of the
provisions of Shorewood City Code, Chapter 701.
(2) That as Animal Enforcement Officer, said Midwest Animal
Patrol shall be authorized to issue citations to parties in violation of
the provisions of said Chapter of said City Code.
(3) This designation shall remain in effect for a period of one
year from the date hereof unless sooner revoked.

Dear Friend of Trees,
Have you hugged your trees today?
All too often trees are taken for granted. Their benefits
too easily are lost in the fast pace of today's society; oxygen,
summer shade, purification of air, wildlife habitat, wind
breaks from winter winds, soil erosion control, lumber,
paper and other forest products, and beauty in our
communities name just a few.
But the day is coming to honor these leafy, green neighbors:
Arbor Day!
Arbor Day is Apri128. 1989
Whether you're a mayor, city forester, media person, librarian
or community gardener, you can have an impact. You
can develop your own community or company Arbor Day
Program. Display the enclosed poster in a prominent place
for starters!
If you need ideas or additional materials, we're here to
help. Remember, May is Arbor Month in Minnesota, and
by April 28th the planting is just getting started.
Join your friends and neighbors during Arbor Day and Arbor
Month.

Media Release: 1989 Arbor Day and Arbor lVbnth State Cerenx>nies in Minnesota.
Governor Rudy Perpich is continuing a long-standing tradition of proclaiming the
last Friday in Apri 1 as Arbor Day and Mayas Arbor Month. This year Arbor Day is
April 28, 1989.
The official Arbor Day celebration will be held at canterbury Downs racetrack on
Apri 1 28. The festivities wi 11 begin at noon.
Governor Perpich has been invited to participate in planting the tree--perhaps a
horse chestnut. Also participating will be about a hundred children fram Shakopee
schools, who wi 11 plant seedlings around "Arbor Pond," a Imn-Jllide body of water
inside the track area.
Other distinguished guests will include Smokey Bear, Elmer the Elm Tree, Woodsy
Owl, and Treesa the Tree. A band will play songs with tree themes.
The public is invited to the event, which will take place before racing starts.
Free trees and Arbor lVbnth posters will be given to early arrivals at the racetrack.
The Imin racing event of the day will be the Arbor Day Stakes Race. Admission to the
grounds is $3.00.
Regional State Arbor Day and Arbor Month events also are planned throughout
Minnesota. They include:

From the Governor...
This year, as in the past, I have proclaimed the last Friday in
April--April 28, 1989--to be Arbor Day and the Month of May
1989 to be Arbor Month in Minnesota. Trees are an increasingly
vital resource and need to be recognized. They purify air and
water, help conserve soil and energy, create jobs through a
large forest products industry, serve as recreational settings,
provide habitat for wildlife of all kinds, and make our cities
more liveable. The benefits of these leafy, green neighbors
called trees are really something to celebrate.
For those of us who enjoy trees, the celebration will continue
into 1990. It will be a year of special activities all across
Minnesota, community improvement and beautification projects,
sports events, festivals, arts experiences, and celebrations
that showcase all that is outstanding about Minnesota. with
visitors coming to the state for the U.S. Olympic Festival in
1990, we can showcase Minnesota to the rest of the
nation...show off how very special Minnesota is--to visit and
to live in. Since trees are one of the most wonderful things
about Minnesota, Arbor Day and Arbor Month will be key elements
in the Celebrate Minnesota 1990 festival.
The American Forestry Association has launched a nationwide
campaign--Global ReLeaf--to encourage Americans to plant 100
million trees in their communities by 1992. With their
"cooling effects" and ability to reduce carbon dioxide
build-up, trees can help lower global temperatures that are the
highest they've been since records were first kept.
Minnesota's 1989 Arbor Day and Month activities will not only
contribute to Celebrate Minnesota 1990's beautification
objectives, but will help make a world difference in our future.
I urge all citizens to become aware of the importance of trees
and to plant, nurture, protect, and wisely use this Minnesota
treasure.

For those of us who love trees, 1990 will be an exceptional year. It is a year of special
activities all across Minnesota, community improvement and beautification
projects, sports events, festivals, arts experiences, and celebrations that showcase all
that is outstanding about Minnesota.
Why all the activity? Because the U.s. Olympic Festival-'90 will bring thousands
of amateur athletes, trainers, and spectators to Minnesota from all across the nation
during July of 1990. There will also be a border-to-border bicycle tour, a sailing
regatta in Duluth harbor and a canoe voyage on the mighty Mississippi. There will
be arts events ranging from a Jazz Festival to the opening of the Panza Project, a
contemporary art exhibit.
With all of the visitors coming to Minnesota for these events, we can showcase
our state to the rest of the nation. ..show off how very special Minnesota is - to visit
and to live in. That's why hundreds of communities are cleaning up and
beautifying their downtowns, parks, riverbanks, town entrances and historic
buildings. They want to put on our best face for the nation. They will invite old
friends and relatives back to Minnesota in 1990 for a homecoming celebration.
Arbor Day and Arbor Month will be key elements of Minnesota's celebration
activities in 1990. After all, trees are one of the most wonderful things about
Minnesota. From food and shelter for wildlife, to windbreaks to stop blowing snow
and soil, to resources for our forest products industry, to shade and beauty for our
cities, trees playa vital role in Minnesota's quality of life.
Plans are being made to celebrate trees in 1990 in many ways:
~ Cities, towns and other "communities" are planning to plant trees in their
parks, by their town entrances, and along their main streets.
~ The Minnesota Department of Transportation and the Iron Range
Resources and Rehabilitation Board are working with groups across the
state to plant trees, shrubs and wildflowers along many miles of state
highways.
~ Drawing and photo contests will be held on the theme "Trees in the places
we call home."
We hope you will decide to be a part of Arbor Month and Arbor Day in 1989 in
preparation for Minnesota's great celebration and homecoming in 1990. And then
turn the page for a preview of the plans for 1990.

SPECIAL
EVENT ...
In 1990, we want to make Arbor Day really unique in Minnesota. Plans are
underway for a statewide Arbor Day event involving every student in Minnesota.
The Arbor Month Committee wants to help every student plant a tree. With your
help, 1,000,000 trees will be planted in backyards, parks, wildlife areas, along
riverbanks, and in town centers. Every community can plant a tree of its choice.
There will be no charge to the students for the trees to be planted. Trees will be
available to plant in many exciting places:
~ In school projects on the school grounds
~ At home
~ In community parks and recreation areas
~ Along mainstreet or the city center
~ As part of a highway beautification
~ As part of a windbreak or shelterbelt
~ To create a wildlife refuge
Numerous state agencies and private organizations are working together to
make this very special event happen. They are developing the Arbor Month kit for
1990 that will provide all the details on how to organize your Arbor Day program,
where to get help, and how you can order trees for your school.
So mark your calendar now for Friday, April 27, 1990. You and your friends will
want to be part of the celebration. Start planning in1989 by scouting out the sites for
your trees and studying the kinds of trees that are best for your area of the state. Not
only will you be doing something that can make a difference in the greenhouse
effect, but Minnesota will be an even more beautiful place for each of us to call
home.
