MINUTES
CALL TO ORDER
The Regular Council meeting of the Shorewood City Council was
called to order at 7:30 P.M., April 10, 1989, in the Council Chambers
by Mayor Haugen.
PLEDGE OF ALLEGIANCE
Mayor Haugen opened the Regular Council meeting with the Pledge of

APPROVAL OF MINUTES
Brancel moved, Gagne seconded, to approve the Regular Council meeting
minutes of March 27, 1989, as amended. Motion carried - 5 ayes.
Stover moved, Gagne seconded, to approve the Special Council meeting
minutes of April 3, 1989, as written. Motion carried - 4 ayes, 1
abstained (Brancel).
COMMISSION REPORT
Planninq Commission
The Planning Commission reviewed a proposed rental ordinance apd
approved the concept. They would like to review ag~in after the
Council and t~e ~taff have made their re~ommended changes.
CONSENT AGENDA
Grant 1989 Weed Spraying Contract
A proposal for the 1989 weed spraying was received from Mahoney
Homes Services Inc. in the amount of $2,590. Public Works
Director Zdrazil has recommended acceptance of the bid which is
within the budgeted figures.

item, weed spraying contract. Motion carried - 5 ayes.

APPOINTMENT OF CITY ADMINISTRATOR
AND EM~LOYMENT AGREEMENT

RESOLUTION NO.31-89
Attorney Froberg reviewed the employment agreement for the Council.
Council made some changes and clarifications to the agreement.
Stover moved, seconded by Gagne,to appoint Larry Whittaker as City
Administrator effective April 17, 1989 and approve the employment
agreement as amended. Motion carried by Roll Call Vote - 5 ayes.
COMPARABLE WORTH UPDATE
Mr. Jim Schultz reviewed his progress report on the comparable worth
study, dated April 2, 1989. The job match used previously was not
adequate and he supports considering the subscription to the MAMA
study that includes 10,000 employee~ to match rather than to the
twenty positions as used in the study.
The State has been satisfied with the study that has been submitted.
There is no time limit to submit an amended study nor is there a
maintenance schedule in place. Mayor Haugen expressed concerns of
the added expense in joining the MAMA group. Funds would have to
come out of the general fund balance, she does not want this balance
reduced below the auditors recommended balance. Mr. Schultz will
proceed with the study. He felt the MAMA job match would be a good
tool to administer salaries. The Council will have time to consider
funding sources.
STRAWBERRY FIELDS 2ND ADDITION -
FINAL PLAT AND DEVELOPMENT AGREEMENT
RESOLUTION NO.32-89
Nanci Strickland-Balogh was present to request final plat approval
for Strawberry Fields 2nd Addition.
Stover moved, seconded by Watten, to approve the final plat and
development agreement for Strawberry Fields 2nd Addition as submitted.
Motion carried - 5 ayes by Roll Call Vote.
RENTAL HOUSING CODE REVIEW
The Council began the review of the draft rental ordinance anddis-
cussed verbage. Mayor Haugen suggested that each Councilmember
point out their concerns on the draft to the Planner and Attorney for
their review, to be revised and returned to the Council for further
consideration.
PLANNER'S REPORT
Recommendations: Permits for Small Utility Sheds
Construction Completion Deadlines
Planner Nielsen checked with other cities requirements for small
utility sheds. Three of twelve cities do require a permit. The
Planning Commission recommends no permit requirement for sheds

Recommendations: Permits for Small Utility Sheds
Construction Completion Deadlines
under 120 square feet, but sheds must meet setbacks of their zone
and the State building code.
The Planning Commission also discussed the regulation of the
completion of construction of structures. They have recommended
a one year limit for exterior of buildings and two years for
completion, and one year for total completion of accessory buildings.
Council agreed with the Planning Commissions recommendations but
added time restrictions on sheds not requiring a permit. The time
limitation for sheds is six months for exterior and one year for
completion; or six months from a filed complaint, if a construction
starting date can not be determined.
Planninq Commission Resiqnation - Betsy Robertson
Mayor Haugen read Ms. Robertson's letter of resignation. Council
felt she was an excellent member and thanked her for her good
service to the City.
Council is accepting letters of interest and resumes from citizens
who might be interested in filling the position. The policy has
been to fill the vacancy with a person representing the same area
as the member resigning did.
Siqn Request - Goodyear - (Temporary)
A request to temporarily place a Goodyear sign, 1 X 4, at the
Shorewood Food Mart was submitted by planner Nielsen. This sign
would be placed on the post that is designated for the Dairy Queen
until the time that they intend to build. The visibility for the
Goodyear shop is poor.
Gagne felt the visibility would improve when the pile of contaminatec
soil is removed along Country Club Road. Watten suggested a re-
vised use of the current billboard sign on site. Council did not
act on the request and asked them to return for their request when
the contaminated soil has been removed from the site.
ICO Sign Violation
Planner Nielsen- sent a notice of removal on sign violations to the
ICO station. No response was received nor was compliance made
until last Friday, April 7, 1989. The Attorney has prepared n.
complaint and filed in court and a court schedule has been set.
Council recommended continuation of action on the violation.

ATTORNEYS REPORT
Marcus Development Meetinq
-
Attorney Froberg will be meeting with the Marcus Development
people and. staff to clear-up problems with the platting and discuss
a mechanics lien.
Christmas Lake Road Cul-de-Sac
Engineer Norton recommended sending a letter to CDS to replace the
missing "safe hits" and supply three sets of the "safe hits" to the
City prior to the expiration of their letter of credit, June 6,1989.
Gagne moved, seconded by Brancel, to authorize the submittal of the
letter requesting the "safe hits" repair and supplies of new hits.
Motion carried - 5 ayes.
Attorney Froberg has requested payment from CDS for costs expended
on the cul-de-sac lawsuit thus far.
Restraininq Order - Carlson Homes
The City was served with a motion for a temporary restraining
order on a weight limit restriction. Carlson Homes asked for a
five ton limit on a four ton street in order to get cement to a
job at 5476 Carrie Lane. The court took the action under advise~
ment for Council action. The builder stated that he will lese
his financing if the home is not completed by April 17, 1989.
The Public Works Director does have the right to issue a permit
waiving the weight restriction in the case of danger to public
health. The only time a permit was issued was when a well went
dry in an inhabited house. Planner Nielsen reviewed the Rottlund
lawsuit and the basis for the Court action. Engineer Norton re-
ferred to a test that the developer could do to test the road for
flexibility to determine the weight that the road could handle.
It would be expensive and could prove the road weight capable of
handling more or less than the current restriction.
Gagne moved, seconded by Brancel, to deny the request for a permit
waiving the weight restriction and to direct the Attorney to prepare
findings of fact. Motion carried - 5 ayes by Roll Call Vote.
Watten asked what it would cost to replace the section of road in
question. Engineer Norton estimated $200,000.

ENGINEERS REPORT
Glen Road/County Road 19 Direct Drainage Easement to be Drawn
Engineer Norton referred to his letter of April 6, 1989, on the
cost of determining needed easements for the drainage project.
.Total cost is estimated at $9,000.00 with $2,500.00 if re-drafting
of easements is needed due to revising of ponding on piping areas.
These costs can be assessed to a storm water project if done and
may be reduced if surveys are supplied by the affected residents.
Gagne moved, seconded by Watten, to authorize the proceeding with
the storm water project by allocating funds from the general fund
not to exceed a total cost of $11,500. Motion carried - 5 ayes.
Tonka Bay is holding a meeting on Tuesday, April 11, 1989, at
6:30 P.M., to discuss their ideas on the storm sewer project.
Clerk Kennelly will inform Tonka Bay that Stover, Mayor Haugen
and Gagne may attend that meeting.
Attorney Froberg has obtained an estimate of $4,800.00 to establish
appraisal for easement purchases needed. This cost could be re-
duced if residents granted the necessary easements.
LMCD REPORT
Mr. Bob Rascop reported on the progress to control the Eurasian
Milfoil in Lake Minnetonka. He thanked the City for their donation
for the control of the milfoil. A large contribution of $500,000.00
was received to be used for the purchase of hardware. Five harvesters
will be purchased with the funds, two of the harvesters will be used
as barges. The balance of the donations will be used for operations.

A new plan is being developed to remap and designate" all wet lands

The dredging regulations are being changed to Rule K. Permits will be
issued from the DNR and watershed without inspections, the LMCD may
offer to do the inspections. Planner Nielsen will be attending the
LMCD committee meetings on wet lands.
Mr. Rascop updated the Council on the testing and research being done
in an effort to combat the milfoil.

Animal Control - Added Patrolling
Watten supports advertising the animal control ordinance to obtain
compliance and target problem areas with added patrolling.
Gagne moved, seconded by Brancel, to add five additional hours of
patrolling from April through June. Motion carried - 4 ayes -
1 nay (Watten).
ADMINISTRATIVE REPORTS
Support of West Hennepin Services .~ Enerqy Program
Bruce Larson, of WHHS, has asked the City to support his concerns
that the Community Energy Council will not consider grants for
those cities contracting with the WHHS energy program.
Council supports the submittal of a letter to the Department of
Public Services of the Energy Division encouraging the consideration
of continuing grants for their energy programs. '

MAYORS REPORT
Policy Settinq Session
Stover moved, seconded by Gagne, to ratify the hiring of Jim Brimeyer
of Sathe and Assoc. to mediate a policy setting session on Monday,
May 1, 1989. The meeting is to begin at 6:30 P.M., with Council and
head of staff. Motion carried - 5 ayes.

Recyclinq Complaints
A great deal of complaints have been received regarding recycling
service.
Council directed staff to obtain information on other recycling
companies.

MAYORS REPORT ...

DNR Response --Denying Request to Close Christmas Lake Access
Mayor Haugen read the response from the DNR on the City's request
to temporarily close the Christmas Lake access to attempt to pre-
vent the spread of Eura~ian Water Milfoil in that lake. They have
refused the request and feel that educatio~ of the lake users can
help to prevent the spread.
Recycling Recognition Luncheon - A luncheon will be held in re-
cognition of participating cities in the recycling program on April 19,
at 11:30 A.M.

Our office has received requests from the developers of Harding Acres 2nd
Addition (see Exhibit A) and residents of Boulder Bridge Farm (see Exhibit B)
for street light installation. The proposed locations for the requested
lights are shown on Exhibits A-2 and B-2.
With the exception of the midblock light proposed for Harding Acres 2nd
Addition, the lights are consistent with Shorewood's past policy for
locating street lights. It is therefore recommended that approval be
granted for all of the requested locations except the one between Lots
8 and 9, Block 1, Harding Acres 2nd Addition.
If you have any questions relative to this matter, please contact me
prior to Monday night's meeting.

We are entering into an agreement with Northern states Power
for the installation of gas in our subdivision. During our
discussions they stated that we should have them install the
street lights at the time the gas distribution lines are
installed.
It is our request that you authorize the installation of the
lights at the following locations:
1. Northeast corner of Lot 1, Block 2
2. Between Lots 8 & 9, Block 1
3. Between Lots 5 & 6, Block 1

Dear Mayor and City Council Members:
I am writing on behalf of the residents and property owners of the
Boulder Bridge Farm. On March 11th at our annual meeting attended by the
residents and property owners it was unanimously voted that we request
street lighting on Smithtown Road directly across from the east and west
entrances to the subdivision. Currently no lighting exists, the nearest
lighting being at the entrance to Virginia Highland subdivision. We have
noted that el ect i calli ne posts e:-( i st on the south si de of Smi thtown Road
across from each entrance. We request that the lighting be placed on these
posts as soon as possible. During inclement weather it is dif+icult to
find the entrance roads at night. As there have been a series of near
misses at night and since many of the teen agers at Boulder Bridge meet
the ec:\I~ly (6:45AM) school bus outside o.f the propel~ty on Smithtown Road,
it would be desireable if this matter were taken up and resolved as
rapidly as possible.
As President of the Association I am empowered by our covernanc.e to
make this request on behalf of the home and property owners. I have
attached a list of the voting members.

The owners of the above-referenced facility, located at 5540 County Road 19
have requested a temporary sign permit. They propose to erect a 4' x 8'
temporary rental sign.
Section 1201.03 Subd. 11 c. (4) of the City Code provides for the use of
temporary signs twice within any 12 month period. seven days at a time and no
larger than 32 square feet in area. Our records indicate that this site has
not had a temporary sign permit within the last 12 months. They propose to use
two permits back to back for 14 days.
The sign must be located five feet from any property line and can not obstruct
visibility for automobiles entering or exiting the site.

Dear Mayor.and Councilmembers:
I have owned and resided at 6120 Strawberry Lane since 1983. Two years
ago Shorewood Oaks development began construction across the street from
my property. The main street within the project, Shorewood Oaks Drive,
intersects with Strawberry Lane directly in front of my house. Since
Shorewood Oaks Drive also accesses State Highway 7, it picks up a lot of
traffic. Some of this traffic, either lost in its way or touring the
Shorewood Oaks project, tends to make U-turns at the end of Shorewood
Oaks Drive across Strawberry Lane. Many of the U-turn attempts stray
off of the edge of the road onto what would otherwise ~e, and used to
be, grassed right-of-way.
Since construction began in Shorewood Oaks two years ago, the boulevard
on Strawberry Lane in front of my property has never quite been the same.
The contractors had sodded it over, but other utilities (the telephone
company) came along right after and turned the soil over. Last year's
drought didn't help either. Most of the sod died. Last fall I spent
a lot of money on grass seed in an attempt to restore the right-of-way
to its original color (green). . However, due to the car tires frequently
traveling over it, no form of plant life has been able to survive. The
cars also leave ruts in the soil and break up the edge of the bituminous
surface of the street.
I feel the result of this problem is an eyesore. T~e boulevard along
Strawberry Lane is green and consistent until you come along the stretch
across from Shorewood Oaks Drive. Also inevitable for consideration is
t~e road maintenance problem due to the straying tires breaking up the
edge of the road.
I am requesting that you please consider some form of barrier or hinderance
to control U-turn traffic at the intersection of Strawberry Lane/Shorewood
Oaks Drive, such as curbing, posts or signage (although personally I
feel signage would contribute to the eyesore aspect). We have been advised
that placing obstructions such as rocks or logs along the road creates a
hazard for cars and particularly snow plows. The purpose of this request
is to allow restoration to the original appearance of the Strawberry Lane
boulevard, as well as to protect the street from further damage.

A special meeting of the Lake Minnetonka Conservation
Board of Directors was called to order at 7:45 A. M.

Consultant David Arndorfer, Frank Mixa.
Absent: Bert Foster, Deephaven; Dave Cochran, Greenwood; Bob
Pillsbury, Minnetonka; John Lewman, Minnetrista; Ron Kraemer,
Spring Park; Bob Rascop, Shorewood. Chair Burr announced that
Mark Westlund, Wayzatat had submitted his resignation.
TEMPORARY DOCK EXTENSION PERMITS
The Board was convened to consider Applications for Permits
for Temporary Dock Extensions beyond the authorized dock use
area, pursuant to Resolution No. 53 which declared a low water
level. All permits are issued on a temporary basis for one year
only or at such time the water level reaches 929.4 feet. All
extensions shall be temporary, seasonal typ~ docks, shall meet
all requirements of the LMCD, including the license requirements,
other than the length limitation requested, the extension shall
only be permitted during the time the level is below 929.4 feet,
the extension, together with the original dock, shall not be used
to provide storage space for a greater number of boats or
watercraft than are authorized under the LMCD Code or for a
greater size or number of boats or watercraft than are licensed
'if a license for the dock is required under the LMCD Code.
All applications are to be made a part of the applicant's
permanent file.
In certain cases additional requirements are to be met, as
noted. The applications were considered in the order received.
BOARD OF GOVERNORS, BIG ISLAND VETS CAMP (Orono)
Application to add sixteen foot dock extension in addition
to present thirti-si~ foot dock, total dock distance - sixty-four
feet.
It was moved by Reese, seconded by Bjorlin, to approve the
temporary dock extension permit, in effect amending the dock
license for this year. Motion carried unanimously.
CHAPMAN PLACE MARINA (Mound)
Application to add one hundred forty-five foot extension in
addition to present one hundred twenty-nine foot dock, total dock
distance - two hundred seventy-four feet.
It was moved by- Reese, seconded by Bjorlin, to approve the
permit, in effect amending the dock license for this year and

contingent upon inspection by the Water Patrol to determine
there is no problem with navigation. Motion carried unanimously.
COCHRANE'S BOATYARD, INC. (GREENWOOD)
Application to add twenty feet in addition to present two
hundred foot dock, total dock distance - two hundred twenty feet.
It was moved by Reese, seconded 'Qy Bjorlin, to approve the
permit, in effect amending the dock license for this year,
because it is a minor adjustment. Motion carried unanimously.
GIDEONS POINT HOMEOWNERS ASSOCIATION (TONKA BAY)
Application to move interior docks adjacent to current
exterior docks, all within the one hundred foot dock use area.
It was moved by Boswinkel, seconded by Reese, to approve the
permit, in effect amending the dock license for this year by this
reconformation. Motion carried unanimously.
BOULDER BRIDGE FARM (SHOREWOOD)
Application to move six docks from the lagoon to the main
lake, all within the one hundred foot dock use area.
It was moved by Reese, seconded by Bjorlin, to approve the
permit, in effect amending the dock license for this year by this
rearrangement. Motion carried unanimously.
AL AND ALMA'S SUPPER CLUB (Mound)
It was moved by Reese, seconded by Grathwol, to

CEDARHURST ASSOCIATION (Deephaven)
Application to add twenty feet to existing forty foot dock -
total distance sixty feet. An accompanying cover letter and
drawing indicates this is an addition to a swimming dock and they
would further request an expansion of their buoy field.
It was moved by Reese, seconded by Bjorlin, to approve a
.permit for the dock extension but the permit does not include the
buoys, in effect amending the dock license for this year. Motion
carried unanimously.

CITY OF MOUND (Mound)
Application indicates the City has four hundred twenty docks
at various locations over four and one-half miles of lakeshore
and it would be difficult to determine what would be needed.
Mixa reported they do not need a shallow water permit as
most will stay within the one hundred feet. They would either
need an amendment to their dock license or each individual
needing an extension will have to apply to the District.
It was moved by Bjorlin, seconded by Boswinkel, to approve
the permit up to one hundred feet as permits have been allowed in
the past, in effect amending the dock license for this year.
Motion carried unanimously. Grathwol asked that the record show
he has represented the applicant in the past.
LAKEWINDS ASSOCIATION (Mound)
Application to add forty-eight feet to existing one hundred
foot dock - total distance one hundred forty-eight feet.
It was moved by Bjorlin, seconded by Grathwol, to approve
the permit noting these are seasonal docks, in effect amending
the dock license for this season. Motion carried unanimously.
LIBBIS BAY BOAT CLUB (Wayzata)
Application to add. twelve feet to existing one hundred
thirty-five foot dock - total distance one hundred forty seven
feet. The addition is actually the width of two boats proposed
to be tied to the outside of the dock - no additional dock as
such.
It was moved by Grathwol, seconded by Malinka, to approve
the permit, in effect amending the dock license for this year.
Motion carried unanimously.
ROCKVAM BOAT YARDS, INC. Dock 2 (Spring Park)
Application to add seventy six feet to existing one hundred
twenty-eight foot dock - total dis~ance two hundred four feet.
It was moved by Reese, seconded by Grathwol, to approve the
permit subject to review by the water patrol to assure there is
no interference with navigation, in effect amending the dock
license for this year. Motion carried unanimously.
GRAYIS BAY RESORT AND MARINA (Minnetonka)
The owner of the subject property stated they cannot extend
their docks because of the location at the channel but will store
boats on trailers on their property.
Board took no action as this is matter addressed by the City
but the letter of information will be attached to their dock
license application.
MINNETONKA BOAT WORKS (Orono)
Application to add one hundred foot extension to existing
one hundred foot dock - total distance two hundred feet.
It was moved by Bjorlin, seconded by Boswinkel, to approve
the permit because it presents no problem, in effect amending the

dredging permit but would like consideration of the use of
outdoor dry storage.
It was moved by Grathwol, seconded by Bjorlin, to table the
request until the Board knows more about the dredging and further
to ascertain whether the dry storage would require an amendment
to their dock license. Motion carried unanimously.
MINNETONKA EDGE WATER APARTMENTS
Application for an extension of twenty-four feet to the
existing one hundred foot dock - total length one hundred twenty
four feet. .
It was moved by Boswinkel, seconded by Bjorlin, to approve
the permit, in effect amending the dock license for this year.
Motion carried unanimously.
LOW WATER ORDINANCE
LeFevere presented a proposed Ordinance which would give the
Board flexibility to deal with low water situations. The easiest
way would be to give temporary variances, except public hearing
requirements cpuld be waived if the Board wished to do so. All
would be subject to inspection for compliance.
Discussion followed on whether the need was economic or

constitued a hardship; whether granting the variances to non-
conforming situations offered an advantage to the holder; would
this be something that could be delegated to the cities or would
Board control guarantee more uniformity; would this allow the
Executive Director to issue permits within the one hundred foot
line and the Board handle the ones past one hundred feet; if the
Executive Director retains some autho~ity, the Board would
establish guidelines for his direction.
It was moved by Hurr, seconded oy Reese, to waive the second
and third reading and adopt An Ordinance Providing for Issuance
Temporary Low Water Variance; Amending Code Section 1.07, Adding
Subd. 9, and authorize its publication. Motion carried
unanimously.

Executive Director, at the direction of the Chair, be authorized
to advertise for bids for weed harvesting equipment. Motion
carried unanimously.

When the City Hall addition was being constructed. it was suggested that the
old retaining wall at the southeast corner of the building should be rebuilt in
conjunction with the new ones. Since this would have resulted in increasing
the project cost to over $150.000. the Council chose to wait to correct the
problem.
The old wall has continued to lean and is now beginning to erode at the
bottom. Joe Pazandak and I have discussed the problem and we both agree that
it must be corrected as soon as possible.
Money was not specifically budgeted for this purpose for 1989. However.
$20.000 has been budgeted in Dept 157 (City Hall) for parking lot improvements
etc. Since there is some question as to whether any work will be done on the
parking lot this year. possibly this money could be used to rebuild the wall.
As of this writing. I do not have an estimate of cost for this work. Such an
estimate will be ready for discussion at the 24 April Council meeting.

SUBJECT: ELIGIBILITY FOR MEMBERSHIP IN PERA FOR BILL JOSEPHSON,
LIQUOR STORE MANAGER
BACKGROUND:
From the beginning of his employment with the City of Shorewood, in
July, 1984, Bill Josephson has been ineligible for membership in PERA be-
cause, as a teacher, he already makes contributions into the Teachers Re-
tirement Association. This fact waS confirmed many times. While working
for the Tonka Bay Liquor Store, Bill contributed into PERA, but was informed
by PERA at that time that he was ineligible for membership. Subsequently,
all his contribution were refunded to him. When he began work for the City
of Shorewood, his status with PERA was confirmed. Discussions with officials
at PERA since the start of Bill's employment have further confirmed his elig-
ibility status. Also, being ineligible for PERA, Bill's wages were not sub-
ject to Social Security withholding.
NEW INFORMATION:
While attending a PERA seminar recently, I was informed that the law
which made Bill ineligible for PERA was changed in the 1988 Legislature.
Effective July 1, 1988, Bill became eligible for PERA and membership became
mandatory at that time. Notification of this came in the PERA Newsletter
dated June, 1988. However, no contact was made with PERA officials regard-
ing the change in status. Consequently, no PERA or FICA contributions have
been deducted from Bill's pay. Matching contributions from the City also
have not been paid.
OUTCOME:
Commencing immediately, deductions are being made from Bill's paycheck
for PERA and FICA and matching contributions are being paid. There remains
the matter of PERA and FICA contributions retroactive~to:July~1;:1~88. The
following information was given to me by PERA and the Social Security Admin-
istration.

1, 1988. According to State Law, the City is responsible for its contri-
butions and Bill is held responsible for his contributions back to July I.
The total cost will be certified to the City by PERA and the IRS. However,
an estimate of the cost to the City is $1,066.49 for PERA and $1,091.38 for
FICA. The amount that Bill would be responsible for is $132.93 for PERA and
$1,091.83 for FICA. These amounts are based on Bill's earnings since July 1,
1988 which total $14,538.31.
I have stated the amounts for which both the City and Bill are responsible.

in part or in full.
I intend to write PERA to protest any retroactive contributions due to inad~
equate notification of the change in statute. However, should the protest
be denied, we will be res.ponsible for retroactive contributions.

A RESOLUTION APPROVING THE ELECTION OF LAURENCE WHITTAKER
TO BE EXCLUDED FROM THE PUBLIC EMPLOYEES RETIREMENT ASSOCIATION
WHEREAS, Laurence E. Whittaker was duly appointed City Administrator
and chief administrative officer by the City Council of the City of Shorewood
on April 10, 1989, and,
WHEREAS, Minnesota Statutes Section 353.028 provides that the chief
administrative officer of a municipality may elect to be excluded from mem-
bership in the Public'Employees Retirement Association, and,
WHEREAS, Laurence E. Whittaker has notified the City Council of his
election to be excluded from membership in the Public Employees Reti~ement
Association.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Shorewood hereby approves the election of Laurence E. Whittaker to be excluded
from the Public Employees Retirement Association according to Minnesota Sta-
tutes Section 353.028.

10. Never mix RO-PEL with other chemicals or use it on an area that bas been
treated with other chemicals, since they can have a catalytic and/or deleterious
effect on the active ingredients in RO-PEL. If these active ingredients in RO..
PEL arc neutralized, the product will be rendered useless and ineffective. If.
properly applied however, RO-PEL can last a season or longer.
. 11. RO-PEL is a contact repellent. An animal has to experience RO-PEL's
obnoxiously vile, bitter taste before he will stop chewing and go on to something
more palatable. This presents no problems when an antmal takes a bite out of a
mature plant. A bite taken out of a taxus shrub for instance, will hardly be
noticed but just one bite taken out of a newly planted petunia seedling can
reduce the plant to a nub. Even in the case of the mature taxus, if a large herd of
deer are present and each one takes just one bite the RO-PEL may work but the
poor shrub will still show the results of this taste testing. .
Along these same lines all the artimals in a herd or colony must
experience RO-PEl.'s vile taste. Animals which have tasted RO-PEL might have
left the area only to be replaced by those who haven't as yet, leaving the
applicator to assume that the product Isn't working, when in fact tt is.
12. RO-PEL should be used on non-edible crops only. Although safe, RO.
PEL's unique long-term penetrating ability can ruin the taste of fruits and
vegetables. RO-PEL can safely be used year round on non-bearing fruits and
during the dormant season on bearing fruits. RO-PEL should not be used on
sugar maple trees if the sap is to be harvested.
13. In the event the surface designated for application is non-porous (such as
plastic, epoxy, vinyl, etc), it is unlikely that RO-PEL will be able to penetrate
and/or stIck to the surfa. ce for lengthy periods of time. Constant re-appl1cation or
painting the surface with a shelfac, vinyl; urethane, varnish, or an acrylic-type
finish, (incorporating RO-PEL into the formula), has been used to achieve
satisfactory results. A commercial spreader sticker, added to RO"PEL, is another
possible alternative.
14. Although RO-PEL has proven non-phytotoxic to hundreds of commonly
grown plants, It is best to test it on a single plant or area before widespread
application begins. Particular caution should be observed when applying RO-
PEL to any plants which are known to be sensitive to standard garden chemicals.
A test should also be made when other chemicals will be applied, either
t)rjor to or after, application of RO-PEL. It is advisable to apply RO-PEL first,
felting it thoroughly dry before using any other chemicals.

PRINCETON NURSERIES, ~EW JERSEY - Using RO-PEL, with excellent results, to combat deer br.owsing. Not
only are they using it in bulk now, but they are also distributing it.
CITYSCAPE LANDSCAPING - PORT OF rf~l~B.!yPORT OF NEW YORK - The Port Authority was working
on an e~eriment to see what plants would grow in a toxic land fill site. The plants did well but the one factor that
they forgot was the rodent and rabbit population. They ate all the plants down to the nubs. On the next planting
they treated aU .the plants with RO-PEL and with the exception of an occasional nibble, there was no damage. They
were extremely pleased with RO-PEL's performance and will be expanding their use.
CODY ANIMAL HEALTH & SUPPLY INC.. CODY. WYOMTNG - "I have been retailing your product fOf the
past 18 months. We have used RO~PEL primar.ily to keep horses from chewing on fences and have met with great
success. Other areas of use: - To keep puppies from chewing slippers, shoes, and other household items. -. On

of RO-PEL and win continue to use and recommend its use.
lJEfARTMENT OF INTERIOR - Used RO-PEL at Pecos National Monument to deter flickers (woodpeckers) on
wood sidingmvery effective. Are planning to use it next to treat telephone poles, and are eager to seck approval
from Washington to apply to hitching racks to prevent livestock from chewing on them.

the trials been successful, they are telling their landscape contractors to see for themselves, and are recommending
RO-PEL to several pest contml distributors and are specifying RO-PEL for use at their other locations.
PENNSYLVANIA STATE PARKS AJ."'lD RECREATION - Chapman State Park was used as a test site to see if RO-
PEL would protect the cedar siding on their buildings from being ravaged by porcupine.s. After several months of
review and examination, only a chew mark here and there. As of this letter, five more state parks arc now using

ANIMAL, RODENT and BIRD REPELLENT
Animals, both wild and domestic, can and do cause
untold browsing damage. In most cases, we do not
want to harm the animals in any way (some of the
most destructive ones are family pets). We simply
want to curtail the damage they might cause, and In
the case of wild animals, discourage them from re-
turning.
Unlike most other animal repellents, RD-PEL is
es~;entially non-toxic to plant and animal life. Yet,
when applied correctly, RO-PEL can keep animals
away for a year or longer. It Is an ecologically sound
arid environmentally safe method for preventing
foBaga destruction and many other forms of property
damage.
HOW DOES RO.PEl WORK?
Ropel works on an entirely new principle. The vilest,
most bitter substance ever discovered, Is combined
into a special solvent system which allows it to
penetrate into the bark of trees and the surface of
many other objects, and to remain, despite rain, snow,
dust, wind, dirt Or other atmospheric conditions. Thus,
when any attempts to bite, lick, nibble or chew are
made, the animal gets a "bitter reminder" that this
property Is off limits.
Often the animal's sense of smell will be condi.
tioned to avoid areas treated with RO-PEL. Yet, there
is no offensive smell as with other animal repellents.
WHICH ANIMALS DOES RO-PEL REPEL?
RD.PEL is incredibly effective against most
animals, large or small, which have gustatory andlor
olfactory senses. Among those on whom it has
already been tested are:

WHAT CAN BE TREATED WITH RO.PEL?
RD-PEL is safe and effective, when used as In-
structed, on siding, fences, posts, telephone poles,
unpainted furniture, trees, plants, bulbs, seedlings,
saplings, seeds, seeded areas, even garbage bags
and cans.
HOW IS RO-PEL APPLIED?
RD-PEL can be applied by brush or sprayer. It
shoufd be used full-strength and should never be mixed
with other chemicals. Stainless steel or poly sprayers
are recommended for industrial or professional use.
Annual reapplication is recommended, but is not
always necessary. For deer and other browsing
animals, the optimal time for application is ju~t prior
to the onset of the browsing season. Application on
dry surfaces is preferable, but not essential. Addi-
tional application may be necessary on new growth of
seedlings and saplings, or on non-porous surfaces.
WHAT PRECAUTIONS ARE NECESSARY?
Although AD.PEL is essentIally non-toxic to plant
and animal life, certain precautions are necessary.
Painted surfaces, plastics and fabrics should be
tested first since some could be affected by the
special sol~ents. While RD.PEL is non-phytotoxic, it
shOUld not be used on diseased plants or trees.
RO-PEL is not recommended for use on edible
crops and plants, on the fruits or nuts of trees, or on
sugar maple trees. (RO.PEL could possibly affect the
taste of the product.) For experimentation in this ar~a,
application should be limited to the dormant penod
only. No warranties, express or implied, are made for
this product if it is used on fOOd-bearing plants or
trees. The user assumes all such risks for improper
usage.

RQ-PEL APPLICATION INFORMATION
1. RO-PEL is formulated as a ready to use product and should be used.
full strength without dilution.
2. Use the self contained trigger sprayer included with the pint or quart
sizes Or any conventional pesticide sprayer to apply RO.PEL. Do not use mist'
blowers or ultra low volume applicators.
3. RO-PEL must be thoroughly applied to the parts of the plants or
surfaces of objects which are to be protected. RO-PEL should be sprayed on-
similar to other pesticides by thoroughly wetting or coating the surface to the
point of run off.
4. For best results, a second application three to seven days following the
initial one jd recommended. .
5. The same guidelines for the application of any pesticide appJy to RO-
PEL. Apply only to dry plant tissue and allow material to dry before irrigating.
Do not apply RO-PEL if rain or snow is expected within ei~t hours. Applying
RO-PEL in the morning with temperatures expected to nse will insure rapid
dryin%~ Do not apply RO-PEL when the temperatures and/or humidity are
exceflslvely high. Do not apply to stressed plants.
6. RO-PEL is a contact repellent. All surfaces to be protected must
rer:eive treatment. Any new growth, both foliage and floral must be treated in
order to be protected.
7. For flants with waxy surfaces, particularly the broad leaf evergreens,
rhe addition 0 a spreader sticker is recommended. This will prevent RO-PEL
from running off and allow the active ingredient to penetrate the plant tissues'
surface.
8. Apply RO-PEL when temperatures are above freezing. At
temperatures below freezing the plant tissue can be frozen and will resist RO-
PEL's penetrating action. .
9. Animals that are staxving to death, particularly during the winter
season; might in spite of RO-PEL's vile side-effects, continue eating. This can be
true when other food sources are either limited or unavailable in the area.
Starving animals have been known to eat their own feces or resort to
cannibalism. RO-PEL is most effective when an alternate food source is
available. Additional saturation with RO-PEL can be tcied in the hope of
warding off the animals. Should this not work however, there is very little that
can done be short of shooting or trapping the animals.....

BACKGROUND
Mr. Rick Murray. representing B-T Ventures. has requested approval of a
simple subdivision for the property located at 23620/23622 Smithtown Road
(see Site Location map - Exhibit A. attached). The lot is currently occupied
by a two-family dwelling (see Exhibit B. attached). Pursuant to Section
1201.03 Subd. 16 of the City Cod~ the applicant proposes to divide the lot
and building for the purpose of individual ownership (zero lot line).
The existing lot contains approximately 32.691 square feet of lot area. which
complies with the base lot requirement for the R-2A. Two-Family Residential
District in which the property is located. Since one of the proposed unit
lots (shown on Exhibit B) is smaller than the 15.000 square feet required by
Section 1201.15 Subd. 7.. the applicant has requested a lot area variance.
The applicant explains his request in a letter dated 9 February 1989
(Exhibit C).
ANALYSIS/RECOMMENDATION
The existing building was constructed prior to Shorewood having any provision
in its zoning ordinance for dividing lots with two-family dwellings on them.
Even had the current rules existed when the structure was built it would have
to have been located where it is now. This is dictated by a significant low
wet area on the west half of the lot.

The merits of owner-occupied housing can be argued in different ways. While
some communities may be concerned about maintaining a certain amount of
rental housing stock. it is safe to say that most prefer owner-occupancy.
Given past discussions with City officials. Shorewood adopted the current
provisions with the intent of encouraging owner-occupancy. In this regard
granting the variance could be considered to be in the "public interest". It
is worth noting that this request is virtually identical to one approved for
Highway 7 Properties in June of 1986.
In view of the preceding. the request is considered reasonable. Given that
the structure and lot already exist. the variance will not result in a
greater number of lots or living units. It is therefore recommended that the
division and variance be approved subject to the following:
1. The maintenance or "party wall" agreement (a portion of which is attached
as Exhibit D) should be subject to favorable review and recommendation by
the City Attorney.
2. Each unit must be served with its own sanitary sewer service. Wells may

Gentlemen;
Enclosed please find our application to the City of Shorewood for a subdivision
of the referenced lot together with a variance relating to minimum lot sizes
for structures within an R-2B zoning district. I have also included for your
review and information a copy of a surveyor's certificate depicting the entire
lot together with the new lot line separating the lot into two parcels;
Parcel A and Parcel B.
The entire parcel measures slightly more than 31,000 square feet, however,
because of the unbuildable nature of the western side of this lot, the twinhome
unit was positioned on the east side of the property. Although, the entire lot
contains an adequate amount of square footage to allow a lot split within
the ordinance) the configuration of the building on the lot when divided along
the extensions of the party wall creates a substandard lot to the east of
the lot division. It is for this reason that we are requesting a variance
as well as the lot subdivision.
We are in the process of modifying and drafting party wall agreements which
we have used in other twinhome subdivisions. We have found these effective
and acceptable to buyers in lieu of formal homeowners' associations. I am
enclosing a copy of an agreement we used in 1988 for a subdivision in Oakdale,
MN. As soon as our draft is finished for this particular party wall agreement
I will be forwarding it to your attorney for review.
It is our intention to investigate a market which we are not certain exists
in the Shorewood-Excelsior area. It appears to us that these twinhomes, when
marketed as individual units, could help fill a void which exists in the
southwestern Lake Minnetonka area. Namely, this void is for moderately priced
housing which would provide an alternative to renting for many new families.
Our Realtors have advised us that there is a great deal of demand for a newer
housing stock in the $75,000-80,000 price bracket. This particular lot
division will allow us to look at both ends of this pricing range. We would
anticipate that Parcel B (the smaller of the two parcels) would be priced
somewhere between $75,000-77,0000. We would anticipate that Parcel A would be
priced in the range of $79,000-83,000. Since the units are relatively
identical the pricing differance would be based on the size of the lots.
The reason that we are interested in pursuing this lot subdivision is because
we also own four twin units along Woodduck Circle, across County Road 19,
which is directly south of this parcel. If the Realtors are not correct and

if there is no market for this kind of housing unit in Shorewood, we will
be able to discover this without starting lot subdivisions along a cul-de-sac
where 13 buildings could be split. We are optimistic, however, because our
market research shows an existing need for this type of housing, and if
successful, it could help resolve the difficulties surrounding Woodduck Circle.
Again, we are hopeful that the "experiment" on the referenced property
represents an opportunity both for ourselves and for the City of Shorewood. I
look forward to meeting with you and discussing our proposal in greater detail
in the next few weeks.

(b) Each wall which is built as part of the original construction of any twin
home unit (Uvtng Unit) upon the property and placed on the dMdlng line
between two (2) Twin Home Lots shall constitute a party wall and to the extent
not inconsistent with the provisions of this Section, the general rules of law
regarding party walls and of liability for property damage due to negligent or
willful acts or omissions shall apply thereto.
(c) The cost of reasonable repair and maintenance of each party wall shall
be shared by the OWners who make use of the wall in proportion to the use.
(d) If a party wall is destroyed or damaged by fire or other casualty or by
physical deterioration, any OWner who has used the wall may restore it, and
shall have an easement over the adjoining Living Unit for purposes of making
such restoration, and if other owners thereafter make use of the wall they shall
contribute to the cost of restoration to such use without Prejudice, howeVer, to
the right of any such OWner to call for a larger contribution from other OWners
under any rule of law regarding liability for negligent or willful acts of omissions.
(e) Notwithstanding any other provision of this Section, any OWner who, by
his negligent or or willful act, causes any party wall to be exposed to the
elements or excessive heat or cold shall bear the whole cost of furnishing the
necessary protection against such elements or heat or cold, and repairing the
party wall from damage caused by such exposure.
(f) The right of any Owner to contribution from any other OWner under this
SectIon shall be appurtenant to the Twin Home Lot and shall pass to such
OWners successors in title.
(g) In the event of any dispute arising concerning a party wall, or under the
provision of this Section, each party shall choose one arbitrator and such
arbitrators shall choose one additional arbitrator, and the decision of a majority
of all the arbitrators shall be final and conclusive of the question involved. If
either party refuses or fails to promptly appoint an arbitrator, the same may be
appointed by any Judge of the Minnesota District Court for washington County,
Minnesota. Arbitration shall be in accordance with the rules of the American
Arbitration Association.
(h) If any portions of a Living Unit shall actually encroach upon any other
Twin Home Lot, or if any such encroachment shall hereafter arise becaUse of
settling or Shifting of the building or other cause, there shall be deemed to be an
easement in favor of the OWner of the encroaching LMng Unit to the extent of
such encroachment so long as the same shall exist.
(i) Each Owner of a Living Unit (-Defaulting OWnerj agrees to indemnify
and hold harmless the OWner of an adjoining Living Unit for any mechanic's
liens arising from work done or material supplied to make repairs or
replacements for which the Defaulting OWner is responsible.
