CALL TO ORDER
The Regular Council Meeting of the Shorewood City Council was called
to order at 7:30 p.m., Monday, December 14, 1987, in the Council
Chambers by Acting Mayor Haugen.
PLEDGE OF ALLEGIANCE AND PRAYER
Acting Mayor Haugen opened the Regular Council meeting with the
Pledge of Allegiance and a Prayer.
ROLL CALL
Present: Mayor Rascop (arrived at 7:32), Councilmembers Brancel,
Haugen, Stover, and Gagne.
Staff Attorney Froberg, Engineer Norton, Administrator Vogt,
Planner Nielsen and Clerk Kennelly.
APPROVAL OF MINUTES
Gagne moved, seconded by Brancel, to approve the minutes of November
23, 1987 as amended. Motion carried - 5 ayes.
MATTERS FROM THE FLOOR
Request For Time Extension - Junk Ordinance
A request from Kirt Koerting for a one week extension to clean up
his property in order to comply with the Junk Ordinance
notification was made. Nielsen stated that a review of the
property since the notice was sent, revealed good progress.
Haugen moved, seconded by Gagne, to grant a one week extension to Mr.
Koerting to comply with the Junk Ordinance notification. Motion
carried - 5 ayes.
PLANNING COMMISSION REPORT
No report was given, Stover stated that she didn't attend that
meeting but the minutes were included in this packet.
PARK COMMISSION REPORT
Commissioner Jim Andrus reported on the recommendations made at the
last park meeting.
The Commission recommended a cash donation in lieu of land for the
proposed South 40 subdivision. Motorized vehicles have been using
the storm sewer easement from Shorewood Oaks into the park from a
trail.

Union Agreement Radification
RESOLUTION NO.159-87
A new Union Agreement has been submitted to the Council for
acceptance for 1987-1988.
Fund Transfer
Liquor store funds in the amount of $18,800.00 will be transferred
to the General Fund.
Special Assessment Fund Transfer
Recommendation was made to transfer excess special assessment
funds, to pay bonds for the 1974 Sewer Improvement Project and
discontinue taxing for these bond funds at this time.
Budget Amendments
Budget amendments were recommended in the amount of $263,866.00.
All amendments were listed in a report dated 12/8/87.
COVington Vine Ridge - Acceptance of Improvements
RESOLUTION NO.160-87
Engineer Norton has inspected the utilities and streets in
COVington Vine Ridge and recommends acceptance of those streets and
utilities with a one year warranty period from the acceptance date.
S.E. Area Pum~house - Proiect 86-1C - Payment Voucher
Engineer Norton recommended payment Voucher #3 in the amount of
$51,450.14 to A & K Construction, Inc.
Towne Addition - Reduction of Letter of Credit
RESOLUTION NO.161-87
Staff has recommended a reduction of his letter of credit to
$30,000 to cover 150% of the remaining work to be done on the
utilities on the Towne Addition by Resolution.

Recommendation was made to hire Joseph Lugowski for the new
position on the Public Works Department.
Shorewood Oaks - Proiect 87-1 - Payment Voucher
Engineer Norton recommends payment of Voucher #6 for the Shorewood
Oaks Project 87-1 in the amount of $26,424.96 to Richard Knutson,
Inc.
Haugen moved, seconded by Stover, to approve the Resolutions and the
above listed items on the Consent Agenda. Motion carried by Roll
Call Vote - 5 ayes.
MILEAGE EXPENSE INCREASE
Staff recommended to increase the mileage reimbursement to $.22 1/2
per mile, which is the new limit that the I.R.S allows that does not
require listing as income.

Stover moved, seconded by Haugen, to approve the simple subdivision
subject to the Planners recommendations. Motion carried - 5 ayes by
Roll Call Vote.
DISCUSSION OF WATER LINE EXTENSION - MCLAIN ROAD
A request was received from residents along McLain Road to determine
the cost and feasibility for a water line extension along that road.

SEWER RATE DISCUSSION
Stover requested that the rate discussion be tabled to the next
meeting as requested by John Bridge of the Finance Committee.
Council asked when rates could be changed. Froberg felt that any
rate change should be established prior to the beginning of any new
quarter.

ATTORNEYS REPORT
N.S.P. Franchise Agreement
ORDINANCE NO.202
Froberg reviewed the changes in the agreement~ that he felt were in
the City's best interest. The staff and Froberg were satisfied
with the change from 10 years to 5 years for the City to be charged
for the relocation of utility lines, and an agreement for
pre-notif~cation prior to cutting into city streets for the
protection of city utilities.
Stover moved, seconded by Brancel, to accept the amended N.S.P.
Franchise Agreement Ordinance adopted by Roll Call Vote - 5 ayes.
SEWER RATE DISCUSSION - CONTINUATION
Rascop referred to the Finance Committees recommendation for a lower
sewer rate rather than increasing the rate to cover total current
expenses, and pursue reducing the MWCC charges. He also referred to
a report from Arnie Carlson's office listing $54.54 as a state per
capita yearly sewer rate. Haugen felt that this report indicates the
unfair rates charged by the MWCC to the Metro Area cities. She would
lke to contact MWCC to see if a reduction in charges could be
obtained. The Council reviewed the $66,000.00 increase in MWCC
charges this year, and discussed the cost of repair and maintenance
to sewer lines and lift stations. Rascop supports the increase sewer
rate of $56.75 be charged for the first quarter, and supports a
reduction in that rate if expenses can be reduced.

ENGINEERS REPORT
Freeman Park Grading Bid Tabulation
Bids were opened at 11:30 a.m., December 14, 1987, for the Freeman
Park grading project. Engineer Norton will be reviewing the other
bids in comparison with the low bid. The Enginee~s estimate was
$37,950.00, the lowest bid carne in $11,400.00 more than that
estimate.

COUNCIL BREAK - 8:35 - 8:40 P.M.
Beverly Drive/Cajed Lane Traffic Count and Cul-de-sac Request
Review
Staff has reviewed the traff~c study and they would like to further
review prior to making their final recommendation. Gagne asked
what traffic counts were obtained. Engineer Norton stated that the
counts were taken in Department and they found that 22 cars
traveled that area per hour in the A.M. and 24 in the P.M. There
are 19 houses along Cajed and Beverly Drive. A resident questioned
whether the road restoration had been completed at the time of the
study. Norton will check the dates to determine that.
S.E. Area Pumphouse Status
The start up process began a week ago. A valve was damaged by
Metro Waste Control. Harold Volk, of MWCC has been contacted a
month ago to make those repairs. Norton would like this completed
now in order to proceed with the start up.
S.W. CORRIDOR ADVISORY MEETING
Haugen left at 8:50 p.m. to attend the last meeting of the Corridor
Advisory Committee. She recommends that the alternative volunteer
for that advisory comm~ttee be adv~sed if the committe reorganizes.
PLANNERS REPORT
City Hall Expansion
Nielsen reported that all the soil and foundation work on the
addition have been completed. A change order will be needed for
underpinning the existing foundation which did not extend down to
below frost level but an equal cost was saved by changing the new
foundation.
January and February Council Meetings will have to be held at
Minnewashta School because the Council chambers will be converted
to office space while the addition is being completed.

Enchanted Point - Survey Cost Estimate
A request was received from a resident to purchase a tax forfeited
p~ece of property on Enchanted Point. The road currently runs over
a portion of th~s lot. Vogt has obtained two bids to survey this
lot. He feels it is to the best interest of the City to determine
the actual location of the lot lines of th1s lot. Included in this
survey would be locations of the platted road and the fire lane
area at the point. Attorney Froberg stated that the survey cost
could be charged against a street improvement project if done
within a year.

Purchase of a New Telephone System
Vogt has looked at eight (8) different telephone systems. The cost
of these systems vary from $10,000.00 to $6,600.00. Vogt may need
additional funds over the $6,000.00 budget figure to obtain a new
system.
Stover moved, seconded by Gagne, to allow flexibility to exspend
additional funds over the $6,000.00 budget for the new telephone
system. Motion carr~ed - 4 ayes.
Status of Stop Lights Highwav 7/Countv Road 19
A meeting with MnDOT has been held regarding the need for a stop
light on Highway 7 at County Road 19. They have offered two
alternatives for that installation. Temporary lights could be
installed in 1989 requir1ng a cost share on that installation or
permanent lights will be installed in 1990 that will only require
the cities to pay for operation and ma~ntenance of those lights.
MnDOT wants compliance with their corridor study that would include
the closing of a h1ghway crossing at Galpin Lake Road. Exe1sior is
opposed to that closing. The Council stated their support for the
permanent lighting to be installed in 1990.

Study Session
Rascop moved, Seconded by Gagne, to set a study session for
8:00 a.m. 2:00 p.m. Saturday, January 9, 1988 to discuss the
"future direction" of the City, this meeting will include the
Council, Planning, Park and Financial Commissions. Motion carried
- 4 ayes.
MAYORS REPORT
MWCC - Reauest to Attend Meeting
Rascop directed that a request be sent to MWCC to have a staff
member attend a Council meeting to discuss the rates they are
charging Shorewood. Stover directed the Attorney to obtain
information on the steps necessary to take to dispute the MWCC
charges.
Mavor Meeting
A area Mayors meeting will be held January 19, 1988 at the
Minnetonka Community Service Building.
LMCD - Directors Position
The flnalist for the Directors position has withdrawn. They will
be readvertising for the position. Mr Mixa has agreed to stay on
for an additional six (6) months.

The Special Council Meeting of the Shorewood City Council was called
to order at 7:30 p.m., Thursday, December 3, 1987 in the Council
Chambers by Mayor Rascop.
ROLL CALL
Present: Mayor Rascop, Councilmembers Haugen, Stover, Gagne and
Brancel.
Staff Planner Nielsen and Administrator Vogt.
CITY HALL EXPANSION PROJECT
- CONSIDERATION OF BIDS AND CONTRACT AWARD
RESOLUTION NO.158-87
Administrator Vogt explained that bids for the City Hall Expansion
Project were opened at 2:00 p.m. today (December 3). Bids were
received from seven bidders. Project Architect Nick Ruehl of EOS
Corporation reviewed the bids which ranged from a low base bid of
$128,500.00 to a high of $163,874.00. A series of five alternatives
to the base bid were discussed in detail by the Council and
Architect.
The alternatives were discussed as follows:
Alternative No. 2 includes the sheetrocking of the entire basement.
It was felt by the Council that it may be more cost effective to do
the actual sheet rocking at a later date when a floor plan for
utilizing the basement is completed. Council requested the floor
plan to be done in 1988 so that the sheetrocking could take place in
1989. If the sheetrock is installed now, a great deal of it may need
to be torn out later to accomodate the final floor plan.
Haugen moved, seconded by Gagne, to eliminate Alternative No. 2 from
the bid, sheetrocking the basement ceiling, until a plan for the
basement is completed. The bid amount for this alternative is
$4,930.00 which will not need to be spent at this time. Motion
carried - 5 ayes.
Alternative No. 4 includes a reduction in the base bid of $2,000.00
to do the work ln the spring rather than now.

CITY HALL EXPANSION PROJECT - CONTINUED
Alternative No. 3 includes work elim~nation in rooms 103, 106 and 202
being the coat room, kitchen and vault repectively.
After short discussion, Haugen moved, seconded by Brancel, to
eliminate work in rooms 103, 106 and 202 creating a project cost
savings of $3,870.00. Motion carried - 5 ayes.
Council discussed the code interpretation for the building's
restrooms. The additional cost to the project for the additional
restroom facilities is $5,075.00 and is included in Alternative No.
1.
Stover moved, seconded by Brancel, to accept Alternative No. 1 which
adds $5,075.00 to the base bid. Motion carried - 5 ayes.
Jack Zastrow of the firm which presented the low bid, Zastrow-Nassett
Construction, Inc., was present to answer any questions the Council
may have. It was found that the firm is based in Shorewood and has
been together for approximately 8 years. Mr. Zastrow stated that the
firm has done several jobs in the area including The Bank Excelsior,
Mount Calvary Lutheran Church in Excelsior, and The B. Dalton
Bookstor~. n Minnetonka. Haugen questioned if this is the original
company another company which has been re-formed. Mr. Zastrow
stated t t this is the original company.
Motion b~~HaUgen, seconded by Stover, to award the contract by
Resolution for the City Hall Expansion Project to Zastrow-Nassett
Construction, Inc., in the amount of $126,705.00 and authorize the
Mayor and City Clerk to sign the construction contract. The amount
of the contract is derived by taking the base bid as well as the
alternate additions and deletions to total the contract price.
Motion carried by Roll Call Vote - 5 ayes.
1988 STAFF SALARIES
Administrator Vogt reviewed the amount of funds needed over the
existing funds allotted for 1988 Union and non-Union staff salaries
excluding the Administrator. Haugen stressed the need to take the
current economy and market conditions into account when calculating
wages. Stover stated that she and Vogt have reviewed each position
and proposed salary and recommends approval. $30,000.00 is budgeted
for salary increases and benefits for 1988.
Motion by Stover, seconded by Gagne, to approve the 1988 staff salary
increases over 1987 amounts for all Union and non-Union employees
excluding the City Administrator by a total amount of increase not to
exceed $18,750.00 including the city share of PERA at 4.25% and PICA
at 7.51%. Motion carried- 5 ayes.

PERSONNEL MATTERS
A member of the office staff wishes to listen to the tapes of an
Executive Session held last June relating to a personnel matter.
Council discussed that the statement was made that the tapes would be
available. Haugen questioned what purpose that listening to the
tapes would do. Further information was requested.
A letter from the Administrator placed in a member of the office
staff's personnel was requested to be removed. A similar situation
took place whereby letters were not placed in other staff files. A
determination was not made.
ADMINISTRATIVE REPORTS
MASON RESPONSE
A response from Bob Mason relative to the letter forwarded to him
from the City's financial consultant, Springsted, regarding bond
issue interest was received. Mr. Mason indicated that he was not
fully aware that he had already been credited for additional interest
earnings than that which was estimated on the 1984 bond issue.
PUBLIC WORKS EMPLOYEE
It was indicated that a new Public Works employee would be hired on
December 4 to start work as soon as possible.
UNION CONTRACT
It was reported that the two-year Union Agreement being negotiated
for over a year has been approved. Formal Council action on the
'87/'88 Agreement is set for December 14.
WATER CONNECTION REQUEST - GLENCOE ROAD
A request has been received from Ridgewood Development of Minneapolis
for a water connection to the Shorewood watermains with water
provided by the City of Excelsior for Lot 5, Block 1, Ball's Addition
to Excelsior along Glencoe Road in Shorewood.
Motion by Gagne, seconded by Brancel, to approve the water connection
provided that an agreement is signed whereby the resident will accept
any future assessments levied by the City of Shorewood for future
water improvements. Motion carried - 5 ayes.
COUNCIL REPORTS
Member Stover initiated discussion on the sewer rate increase which
was approved at the November 23, 1987 Council meeting. Stover
indicated that the true cost of cleaning and televising sewer lines
will not be known until a contract is awarded. The estimate in the
1988 budget may be high. This is why the Financial Advisory Board
recommended a rate increase to $49.75 per quarter now and wait to see
if another rate hike is needed in 1989.

The Financial Board also wants to know how long the sewer connect~on
fee has been $100.00. Staff indicated since 1981 at which time it
was raised from $50.00. It was indicated that this fee should equal
the cost of obta~ning the permit and inspecting the connection. It
was felt by staff that the current fee is adequate. Further, the
Financial Board wants the City to go to the MWCC and try to get a
rate reduction by reducing the flow which is calculated as corning
from Shorewood. It is felt that a good deal of flow charged to
Shorewood does not originate in Shorewood's lines.
A majority of the members present continue to support the $56.75 rate
as established at the last meeting. Haugen stated that is the rate
proves to be too high, she would like this Council to be the first to
lower the rate. It was also stated that attempts have been made
previously to get a rate reduction from the MWCC to no avail.
Finally, Stover mentioned that Commercial rates were not addressed at
the last meeting. She.~ that this rate should be increased also.

CALL TO ORDER
Acting-Chair Leslie called the meeting to order at 7:35 P.M.
ROLL CALL
Present: Acting-Chair Leslie; Commissioners Robertson. Mason. Schultz and Spellman;
Council Liaison Stover; Planner Nielsen; Planning Assist. Helgesen.
Absent: Commissioners Benson and Watten (ill).
APPROVAL OF MINUTES
Schultz moved. seconded by Spellman to approve the minutes of 1 December 1987 as written.
Motion carried unanimously.
7:30 P.M. PUBLIC HEARING - SETBACK VARIANCE
Melissa Reifenberger - 4995 St. Alban's Bay Road
Planner Nielsen reviewed his staff report.
Public portion of the public hearing opened at 7 :37 P.M.
Public portion of the public hearing closed at 7:40 P.M. without comment.
Spellman moved. seconded by Schultz to recommend to Council approval of the setback
variance. Motion carried unanimously.
This item will appear on the Council agenda of 11 January 1988.
SIMPLE SUBDIVISION
Ilka Priest - 24270 Yellowstone Trail
Planner Nielsen said that the subdivision meets all of the requirements of the
Subdivision and Zoning Ordinances.
Mrs. Priest said that the southwesterly piece to be divided and conveyed to the neighbor
to the west is only 20 feet in width and will allow them a driveway turnaround.
Spellman moved. seconded by Mason to recommend to Council approval of the simple
subdivision subject to the Planner's recommendations:
1. The applicant must provide an up-to-date (within 30 days) title opinion for review by
the City Attorney.
2. The applicant must legally combine Parcel 2 with the adjoining lot to the west.
Parcel 3 must be legally combined with her adjoining property to the north. For
purposes of preparing a resolution. the applicant must provide new legal descriptions
for the resulting parcels.

Priest Subdivision, continued:
4. The applicant must pay one park dedication fee of $500.
5. The nonconforming buildings must be removed prior to release of the Council
resolution approving the request. If the applicant proposes to delay such removal,
the City should require a $1000 escrow deposit to ensure that the buildings are
removed within 180 days. The resolution should include this condition.
6. The applicant must resolve items 1 and 3 - 5 above within 30 days of the Council's
approval of the request. Once she has received the Council resolution approving the
request, it must be recorded within 30 days.
Motion carried unanimously.
This item will appear on the Council agenda of 11 January 1988.
MATTERS FRCI1 THE FLOOR
Commissioners discussed items which they felt should be discussed at the Special Meeting
of 5 March 1988. Suggested items includ.ed a financial overview telling how tax dollars
are being used, especially in light of the current rapid building growth; recreational
use of the trail system; variance requests.
REPORTS
Council Liaison Stover reviewed the 14 December 1987 Council agenda.
The Commission was reminded that the meetings in February and March will be held at the
Minnewashta Elementary School due to the City Hall remodeling.

Schultz moved, seconded by Spellman to adjourn the meeting at 8:34 P.M. Motion carried
unanimously.

RE: 1988 legal notice rates
We are pleased to inform South Shore cities considering
designation of an official newspaper for 1988 that rates for
insertion of legal notices in the South Shore Weekly News will
actually decline by about nine percent, from 39 cents to 35
cents per line for 1988.
We are able to offer this cost savings to cities by placing
legal notices in the appropriate local edition of the Weekly
News, rather than In our entire circulation. The South Shore
legals will, of course, be placed in the South Shore Weekly
News, with a circulation of 12,500.
It has been our policy to offer ourselves as an official
newspaper only in those cities where we provide regular news
coverage. With the exception of Greenwood, this is the case
with the other four cities in the area. Regardless of the
decisions made by city councils on an official publication for
1988, we will continue to provide the 5ame, or better, news
coverage in 1988.
The rate quoted is for first and subsequent insertions.
Return of'tearsheets with notarized affidavit of publ ication
is included. Deadline will continue to be at 5 p.m. on
Monday for publication that Thursday. A representative of
the newspaper will be on hand for your organizational

We would appreciate your designation of the Excelsior/Shorewood
Sailor to be your official newspaper for the year 1988.
The new rate structure for legals effective January 1, 1988 will
be:
1 column width
49.7 cents per line - first insertion
27.2 cents per line - subsequent insertions
This new rate is based on our new column width of 11.5 picas com-
pared to our former width of 9.3 picas. This represents more than
a 20% increase in line length.
We will provide, at no additional charge, two notarized affidavits
on each of your publications. Additional notarized affidavits, on
request, will be furnished at 35 cents each.
All publications should reach this office by Wednesday a.m. pre-
ceding our Monday publication. However,wewould appreciate re-
ceiving any large quantities of legals or any lengthy legals at an
earlier time.
In order to expedite our services to you, it is requested that you

BACKGROUND.
Ms. Melissa Reifenberger has submitted plans to construct a room addition on
the north end of her existing home located at 4995 St. Alban's Bay Road (see
Site Location map - Exhibit A. attached). The house. built in approximately
1930. does not meet the current side yard setback requirement of the R-1D
zoning district. As can be seen on Exhibit B. the house is five feet from
the right-of-way of Woodend Place and 39 feet from the rear of the lot.
Although the addition will be further back from the r.o.w. (nine feet) it
still requires a setback variance of 21 feet. Furthermore. the proposed
addition will require a five-foot rear yard variance.
As shown on Exhibit C the proposed addition will enlarge an existing 7.5' x
9.5' bedroom to 10' x 12'. The existing 5' x 7' bathroom will be enlarged to
6' x 9.5' and relocated so that it can be accessed from a hallway.
Currently. the only access to the existing bathroom is through the bedroom.
The total area of the existing house is approximately 740.5 square feet. The
152 square foot addition will increase the area to 892.5 square feet.
ANALYSIS/RECOMMENDATION
The applicant cites the small size of the existing bedroom and bathroom and
the location of the bathroom as the primary reasons why the variance is
justified. She points out that the current bathroom does not include a
bathtub. only a shower stall. This shower facility consists of only a shower
head with a curtain. The water runs to a floor drain. She adds that FHA
will not loan money on a home unless it has a bathroom with a bathtub.

To illustrate how small the existing bedroom is. she explains that the door
can not be fully opened with a standard double bed in the room. There is
only eighteen inches in which to walk between the bed and the wall.
Having inspected the property. three other factors were discovered which
suggest that the variance is justified. First. a small hill located in the
northwesterly corner of the lot precludes the addition from being located
back further on the lot. To do so would likely result in drainage problems
unless the site was substantially altered. Secondly. the applicant proposes
to line up the addition with an existing garage rather than with the main
portion of the house which would require a greater variance. Finally. the
right-of-way for Woodend Place is 60 feet wide rather than the 50 foot
current standard for r.o.w. Consequently. the property has more open space
than one with a house similarly located on a standard street. There is 26
feet between the proposed addition and the edge of the street.
This request is considered almost identical to a recent variance request
which was approved for Dennis Wolter on Suburban Drive. The proposed
improvements are considered to be the minimum which are necessary to make the
home livable. From a zoning perspective. few variance requests fit the
criteria for granting a variance more than this one. Approval is therefore
recommended.

BACKGROUND
Mrs. Ilka Priest and her husband have recently purchased three acres of land
located on Yellowstone Trail approximately 310 feet east of Country Club Road
(see Site Location map - Exhibit A. attached). Mrs. Priest proposes to
subdivide the property into three parcels. as shown on Exhibit B. She
proposes to convey Parcel 1 to a propsective buyer as a buildable lot.
Parcel 2 consists of a 25 foot strip which would be conveyed to the property
owners to the west of the site. Parcel 3 would then be retained by the
Priests for development at some future time.
The property is currently zoned R-1A. Single-family Residential. Although
the applicant's survey indicates that there are no buildings on the site.
there are two old outbuildings located at what will be the northwest corner
of Parcel 1. Proposed lot sizes are shown on Exhibit B.
ANALYSIS/RECOMMENDATION
The proposed division complies with the lot size requirements of the R-1A
zoning district. While Parcel 3 appears to be landlocked as a result of the
proposed division. the applicant proposes to combine it with additional
property which they own north of the site.
Ordinarily it is recommended that a resubdivision sketch be provided in cases
where land has potential for future development. Since the property is being
combined with more property. such a sketch is not necessary at this time. In
reviewing the topography maps for the area in question. it appears that
Parcel 3 would best be served by a future street along the north side of the
site. The old streetcar r.o.w. in that location serves as a natural road
alignment.

The Priests' acquisition of the property and their request to subdivide
presents two desirable opportunities from the City's perspective. First. the
portion they intend to keep will be combined with their adjoining property.
enhancing the future development potential of all the property. Secondly.
the City can now require. as a condition of approval. that the two
nonconforming outbuildings be removed. While the buildings are not currently
considered hazardous. they are quite dilapidated and the City has had
neighborhood complaints about them.
In view of the preceding. it is recommended that Mrs. Priest's request be
approved subject to the following:
1. The applicant must provide an up-to-date (within 30 days) title opinion
for review by the City Attorney.
2. The applicant must legally combine Parcel 2 with the adjoining lot to the
west. Parcel 3 must be legally combined with her adjoining property to
the north. For purposes of preparing a resolution. the applicant must
provide new legal descriptions for the resulting parcels.
3. The applicant must provide drainage and utility easements as shown on the
attached Exhibit C. Her surveyor should provide legal descriptions for
the easements so that her attorney can prepare the necessary deeds.
These deeds should be recorded prior to. or in conjunction with. the
combination of the parcels.
4. The applicant must pay one park dedication fee of $500.
5. The nonconforming buildings must be removed prior to release of the
Council resolution approving the request. If the applicant proposes to
delay such removal. the City should require a $1000 escrow deposit to-
ensure that the buildings are removed within 180 days. The resolution
should include this condition.
6. The applicant must resolve items 1 and 3 - 5 above within 30 days of the
Council's approval of the request. Once she has received the Council
resolution approving the request. it must be recorded within 30 days.

Attached is the revised cost estimate for the proposed water main extension to
serve McLain Road and Elder Turn. The cost per unit of $4,212.50 to serve just
McLain Road is less than the cost per unit of $4,413.33 to serve McLain Road and
Elder Turn together!
This does not follow the normal course of events where as the project size gets
larger the unit cost goes down. However, there are a number of reasons that
explain this.
1. Project Size: The project size, whether it serves McLain Road or McLain
Road and E1 der Turn, is so small that as a port i on of the project is
expanded the resulting increased cost could exceed the connection charges
from the additional users. That appears to be the case in this instance
but will be discussed further under item number 3.
2. Uniqueness of the Area: How the area is 1 aid out affects the cost to
service the area. For example, all the homes along McLain Road are on one
side while the homes on Elder Turn are equally split on both sides. As a
result, it costs more to serve the homes on the opposite side of the road
due to the service pipe crossings and restoration required.
3. Connection Charge and Benefitted Property: As mentioned earlier, it
appears there is a higher unit cost if Elder Turn is done as well as
McLain Road. However, if the method of changing the benefitted properties
is different now from how it was shown in my January 6, 1988 letter, it
would be cheaper per unit if Elder Turn was done as well. This then
follows the common understanding that as a project size gets larger, the
unit cost goes down.

As can be seen wi th the one change of del et i ng one (1) lot, Lot 4, the
unit cost goes down as the project cost goes up.
Another item that could affect the cost of the project is the method of financ-
ing. We have not anticipated the total costs for selling bonds for a project of
this size or for capitalized interest or an Allowance for Discount Bidding. As
you and I have discussed, the financing would probably come from the fund set up
to cover these water extensions and be paid back as the connection charges are
received. If this were not the case, it would affect the amount of Indirect Cost
used.

Dear Park Board Members:
On December 14, 1987, the City received bids on Project No. 87-5 "Freeman
Park Site Grading and Appurtenant Work." The low bid received was $49,355.
(Attached is a copy of the Bid Tabulation.)
The Bid Proposal Form was made up of four (4) items three of which are unit
price items. The fourth item, Common Excavation, is a Lump Sum Bid Item. It
is this item that makes up the majority of the construction cost. The Common
Excavation amount on the low bid was $31,100.' Compared to our.estimate of
$14,250, the amount on the low bid is approximately twice as much.
In discussions with the low bidder, and other contractors, it became apparent
that the bid on the common excavation item reflected a certain degree of
concern on the part of the contractor. They i ndi cated a concern about the
desire for the work to be done as soon as possible, even though the onset of
winter may make the work physically impossible. They also indicated a concern
that because the common excavation was a lump sum bid item, the responsibility
for either more or 1 ess earthwork woul d be borne by the contractor. As a
result, they justified their bid price by stating that the estimated dirt work
was a net result of our attempt to balance the cut and fill when actually the
number of yards of dirt moved would be more than that amount.

estimate of $37,950, we feel the bid is responsive and approximately reflects
the cost of accomplishing the site grading and appurtenant work. We therefore
