MINUTES
CALL TO ORDER
The Regular Council meeting of the Shorewood City Council was called
to order at 7:30 P.M., Monday, May 23, 1988, in the Council Chambers
by Mayor Rascop.
ptEDGE OF ALLEGIANCE AND PRAYER
Mayor Rascop opened the Regular Council meeting with the Pledge of
Allegiance and a prayer.
ROLL CALL
Present: Mayor Rascop, Councilmembers Brancel, Haugen, Stover and
Gagne.
Staff: Attorney Froberg, Engineer Norton, Administrator Vogt,
Planner Nielsen and Clerk Kennelly.
APPROVAL OF MINUTES
Gagne moved, Stover seconded, to approve the minutes of the Board of
Review of May 5, 1988 as amended to include corrections on page 3.
Motion carried - 5 ayes.
Brancel moved, seconded by Stover, to approve the minutes of
May 9, 1988 as amended. Motion carried - 5 ayes.
AMEND AGENDA
Rascop amended the Agenda to hear the Park Commission report as
item number 2, prior to the matters from the floor.
PARK COMMMISSION REPORT
Commissioner Gordy Christensen reported on the meeting of May 16, 1988.
They met at Manor Park and looked over the new volleyball court,
ball field condition, and the newly purchased property. They then
returned to City Hall and met with Dave Fisher regarding the use
of the BMX track at Freeman Park. .
Mr. Fisher was present at the Council meeting to make a request
to improve and use the BMX track for ABA members. He submitted
a packet of information to the Council regarding the operating
procedures and the medical and insurance coverages provided.

PARK COMMISSION REPORT - continued
Christensen moved, seconded by Weatherly, to recommend that the
Council approve Mr. Fisher's request to upgrade and operate the
BMX track. The Park Commission approved this motion.
The Commission recommended the installation of three 8' x 16' sand
boxes to be placed in Badger, Cathcart and Manor Parks at an
estimated cost of $1,000.00.
Christensen, Zdrazil and Niccum attended a demonstration of the
Bauer moving sprinkler system. This system could be moved for use
in all the parks if water hydrants are available. The unit could be
rented or purchased for $5,600.00, an inground system at Freeman
Park was estimated at $24,000. Zdrazil would like to look at other
systems prior to making a recommendation.
The Commission asked that an area between the retaining wall and
the tennis court be filled in with blacktop, and that the fence
be moved to open up the newly acquired property to the rest of the
park. Zdrazil felt that the ballfield can be seeded and repaired
by the Public Works Department. Bids on the warming house pavilion
will be evaluated by Christensen.
Brancel moved, seconded by Gagne , to authorize the use of the BMX
track by Mr. Fisher subject to his replacing the starting gate,
preset speakers, providing satellites, $200 escrow deposit, and
a $1,000,000 insurance policy with a "hold harmless" to the City
provision. Motion carried - 5 ayes.
Brancel moved, seconded by Gagne, to authorize the installation
of three 8' x 12' sandboxes in the park. Haugen questioned the
cost of cleaning the boxes.
Haugen moved, seconded by Stover, to table the request to consider
the cost of cleaning prior to installation. Motion carried -
3 ayes - 2 nays (Rascop and Gagne).
Brancel moved, seconded by Gagne, to authorize the relocation of
the fence to the new property line. Motion carried - 5 ayes.

Drainage Problem
Dennis Snyder of 5985 Eureka Road was present to ask for the
City's help to eliminate a drainage orponding problem in the
rear of his property. This water collects in his back yard
from a culvert draining from Seamans Drive. Engineer Norton

stated that this area is 3' below the new culvert elevation at
Eureka Road. The City would have to obtain easements prior to
going onto the property to do work. Snyder feels that if he
filled his property, it would only move the problem to someone
elses property.
Council instructed the Engineer to determine the City's responsibility
and to return to the Council with additional information.
Insurance Claim
Mr. Charles Nelson submitted a bill for replacement of his wind-
shield. A rock was thrown up from the tire of the loader
while traveling out to the islands and hit Mr. Nelson's wind shield.
The City's insurance company has turned down the claim stating
that the City was not negligent in any way. Mr. Nelson questioned
whether the loader is legal for road travel.
Haugen moved, seconded by Gagne, to direct the Attorney to check
on the legality of road travel by the loader. Motion carried.
CONSENT AGENDA
City Hall Expansion - Payment Voucher #5
Staff recommends payment of Voucher #5 in the amount of $3,035.25
to Zastrow - Nasset Construction for work done on the City Hall
expansion project.
City Hall Expansion - Change Order
Staff recommends acceptance of Change Order #4 which represents
a $540.00 credit to the original estimate cost.
C.U.P. Propulsion Enterprises
Resolution No. 45-88
A Resolution was submitted for approval granting a C.U.P.
to Wayne Warnke and Dick Moore to operate an outdoor sales,
outdoor storage and auto repair at 24470 Smithtown Road.
C.U.P. for a Planned Unit Development -
Bayswood Shops
A Resolution was submitted for approval to grant a C.U.P. for
a planned unit development, and general concept plan approval
was granted to Dreher Associates for the property located at
5620 and 5660 Manitou Road.

Engineer Norton recommended payment Voucher #2 for payment to
Widmer, Inc. in the amount of $34,596.50 for work completed on
the Freeman Park project.
Gillette Curve - Street Light Request
A request has been received from residents of Gillette Curve
to install a street light for the end of Gillette Curve.
The Conservation Improvement Program
Resolution No. 48-88
A Resolution was submitted for approval to authorize an
application for grant funding to the Minnesota Department of
Public Service Energy Division through West Hennepin Human Services.
Gagne moved, seconded by Brancel, to move approval of the items
listed on the Consent Agenda including Resolutions 45-88, 46-88,
47-88, 48-88 and Ordinance No. 210. Motion carried by Roll Call
Vote - 5 ayes.
BILLING INQUIRIES
Haugen asked what "Querry" was, Vogt explained that it was software
that allows access to obtain data. Council recommended that the
office cleaning services be billed on a more timely basis.
PRESENTATION OF CERTIFICATE OF RECOGNITION
Rosella Schmidt presented a Certificate of Recognition to the
Council. She also submitted a packet of information on projects
done by the South Shore Seniors. Council thanked her for the
Certificate.

RESOLUTION NO. 49-88
RESOLUTION NO. 50-88
Mike Pflaum and his Engineer, Rich Sathre, were present to address any
questions the Council may have regarding their plats. Engineer
Norton has a meeting scheduled for Thursday to discuss the grading
plans, building pad locations and easements locations. He stated
that a catch basin has already been corrected.
Nielsen referred to his Planners' Report of 5-19-88 and stated that
his requirements, No.2 and 3, will be incorporated into the
development agreement. Park fee schedule has been established, water
assessments will remain as charged and spread over the proposed
lots and sewer equalization has been assigned. The plat will not
be released for filing until the Engineer has accepted the grading
plans.
Haugen moved, seconded by Gagne, to approve the final plat of
McKinley Place 4th Addition at Near Mountain subject to the Engineer
and Planners recommendation. Motion carried - 5 ayes by Roll Call Vote.

APPEAL OF JUNK ORDINANCE VIOLATION - 25355 BIRCH BLUFF ROAD
Greg Sorenson of 25355 Birch Bluff Road was present to appeal his
notice to remove miscellaneous building materials and lumber. He
stated that most of the lumber is to be used for fencing, and he
applied for a fence permit today.
Haugen moved, seconded by Stover, to grant a 30 day extension in
order to use this lumber for the fence installation. At the end of
30 days the Council will review the property. Motion carried - 5 ayes.
DISCUSSION OF EQUITY SHARING CONCEPT - POLICE BUILDING
The Council reviewed the equity sharing concept proposal submitted
by the City of Excelsior. They had various disagreements with
portions of this proposal.
Stover moved, seconded by Gagne, to submit the proposal to the
Financial Board for their review and comments. Motion carried -
4 ayes - 1 nay (Rascop). Rascop would like a meeting with
Excelsior to review the proposal.

PLANNERS REPORT
Arvidson Dock/Retaining Wall
A letter was received from the watershed district denying the
Arvidson dock/retaining wall. This denial supports the City's
position of denial. Their denial did not include a time limit
for removal. Council would like a time limit placed on the
removal by the watershed.
Request for Water Extension - Galpin Lake Woods
Jeff Scheonwetter was present to discuss his request for a water
extension from the Woodhaven well to his Galpin Lake Woods project.
He submitted a letter dated May 20, 1988 stating five requests of
the City to consider. Most of the requests differ from current
policy. Request No. 4 - oversizing reimbursements and No. 5 -
alternative security ag{eement, have been dealt with to some
degree with other developments. Staff did discuss this letter
at the staff meeting today. After Council discussion of the
items requested, Council directed the staff to make their
recommendation and return them to Council for further consideration.
Barbara Jo Arens felt that a public hearing should be held again
if this issue is to be discussed. She also requested her
connection fee be waived. Haugen asked if she was willing to
contribute to the cost of the line extension, Arens responded
"No". Gagne supports the current policy.
ATTORNEYS REPORT
Property Line Dispute - Arens/Galpin Lake Woods
A letter has been received from Arens Attorney, Mr. Van Putten.
He stated that a torrens action is being pursued to determine
boundary line. Froberg has spoken to Arens and the developer's
Attorney and they stated that their Engineers were going to meet
and try to arrive at a boundary line agreeable to both parties.
Stover questioned whether the City should have approved the project,
Froberg stated that the Development Agreement holds the developer
responsible in obtaining all easements.
Request for Maintain of Right-of-Way
A written request has been received from Jerry and Linda Peterson
of 20600 Gordon Road to maintain the right of way between their
property at Bayswater Road. They would like to plant bushes
and maintain this area in a natural state. Froberg referred to
the Resolution No. 155-87 previously passed and also stated that
a permit would be needed to plant bushes.
Stover moved, seconded by Haugen, to grant permission to Peterson's
to maintain their side of the right-of-way along Bayswater Road.
Motion carried - 5 ayes.

Rascop asked that Peterson's letter be sent to the Amesbury West
Association for comment.
ENGINEERS REPORT
Elevated Tower Construction
The materials have been dropped off at the site and construction
will begin soon. Council asked if a building permit has been
issued to the City. Norton will check and make sure a permit is
issued.
FINANCE DIRECTOR REPORT
Audit Report Scheduled
Beck stated that the audit report will be held Tuesday, May 24, 1988,
she questioned whether that Agenda had been changed. Vogt stated
that the audit report will begin at 7:30 P.M., but
that the meeting will begin at 7:00 P.M. to hear a matter on
the Marcus Development project.
ADMINISTRATIVE REPORT
Secretary/Receptionist Status
Vogt has completed interviews and will check out references and
will recommend appointment of Wendy Stranik.

Rascop feels this is very important to support this Resolution
keeping the management of Lake Minnetonka with the LMCD and
not the County or the State.
Gagne moved, seconded by Haugen, to adopt the Resolution of
support as submitted. Motion carried - 5 ayes by Roll Call Vote.
Drainage Project - Glen Road/County Road #19
The project study is being finalized, ponding areas and connections
of these areas are being reviewed.

Council Break
9:20 - 9: 32 P.M.
Vogt requested a Council break to confer with the CityCAttorney.
Personnel - Grievance - Complaint
Vogt stated that a grievance was filed by one City employee on
another employee. A date to discuss the grievance was not agreed
upon, so he set a meeting for today. The parties came to no
acceptable solution, so it was brought to the Council to hear.
Attorney, Sue Stingley, representing Evelyn Beck, asked for a
postponement of this discussion until after the audit report.
Council chose to hear the grievance. Stingley then asked the
procedure. Rascop stated that the grievance would be heard at
this open session and if any disciplinary action was to be taken,
it would be done in an executive session. The grievance was heard
by Council and Beck denied all allegations. Various members of
the staff, Sue Niccum, Jean Sorensen, Patti Helgesen and Sandy
Kennelly commented on other staff problems with Beck.
Council heard lengthy comments and asked questions of all attending
staff personnel.
Stover moved to adjourn the Council meeting subject to payment
of the bills and to continue this discussion after the audit
report, Haugen seconded. Motion failed - 2 ayes (Stover and Haugen)
to 3 nays. Continued discussion insued with added complaints
and allegations. Froberg stated that the Council should respond
to the grievance by taking some type of action.
Beck and her Attorney requested time to supply documents. Council
granted their request.
MAYORS REPORT
Mayor reviewed invitation for open house at Springsted's, the
School Board, and a training session on leadership.
COUNCIL REPORTS
Haugen attended an AMM meeting on property tax reform.
Council directed Nielsen to inspect on the progress of the
Meisen house on Shore Road.
Gagne and Haugen will attend the Highvay 7/Comty Road #19 signal
light meeting on May 24, as well as Vogt.
Brancel submitted a list of expenses on the new computer system.
The total cost to date totals $32,531.00, this is more than
$10,000 over the budget amendment. Vogt will review and return
to Council with additional information.

Gagne questioned a $120.00 charge from Renner Well for estimating
the cost of repairs on three wells. This will be confirmed.
Funds are still being held for completion of the repair project
on these wells.
PERSONNEL - CONTINUED
Beck returned with a memo and copies of three time sheets showing
overtime hours by an employee. Helgesen questioned relevance
to the grievance filed. Council and staff continued to discuss
personnel problems. Staff members referred to a previously
held meeting where staff complaints and concerns regarding
Beck were not settled.
Executive Session
Tape on executive session is being held at the City Attorney's
office.
Personnel Disciplinary Action
Rascop stated that the Council voted unanimously to fire Evelyn
Beck as Finance Director, effective immediately. (Complete tapes
of this meeting are on file in the Clerks office.)

Haugen moved, seconded by Stover, to adjourn the Regular Council
meeting of Monday, May 23, 1988 at 1:05 A.M. (May 24, 1988) subject

MINUTES
CALL TO ORDER
The Special Meeting of the Shorewood City Council was called
to order at 1:00 P.M. on Tuesday, May 24, 1988 to hear a request
from Marcus Development. The Audit Meeting was called to order
at 1:30 P.M., on Tuesday, May 24, 1988 to hear the Audit Report
for 1987.
ROLL CALL
Present: Mayor Rascop, Councilmembers Brancel, Gagne, Stover
and Haugen.
Staff: Attorney Froberg, Administrator Vogt, Clerk Kennelly,
Planner Nielsen and Public Works Director Zdrazil.
C.U.P. AND VARIANCE - MARCUS DEVELOPMENT CORP.
AND DEVELOPMENT AGREEMENT
RESOLUTION NO. 52-88
Mark Senn was present representing Marcus Development Corp. in
their request for a C.U.P. and variance to build a convenience/
service center at 24365 Smithtown Road.
The Council reviewed the Development Agreement and went over changes
as requested in that draft.
Item #5 regarding billboards was discussed at length. They added
additional working to insure that no "embelishments" are made to
the Naegele billboard when it is relocated.
Senn requests that no assessments be added now or in the future in
exchange for granting the County Club Road easement. The Council
did not agree to that stipulation because they felt it could tie
the hands of future Council's.
The water main servicing the City Garage will have to be removed
and a replacement line will have to be installed from the Badger
water system. The cutting and capping of the water line will be
a responsibility of the development. Engineer Norton will return
with a cost estimate for relocation and connection to the Badger
system.
Gagne was concerned about the current violation of the junk
ordinance on this property. Staff will submit a list of violations
to be cleared up within the next 30 days.

AGREEMENT - CONTINUED
Fencing and landscaping to the rear of the property was discussed.
Senn felt that the City Garage was screening the area and that
any landscaping or fencing would be destroyed by snow removal
storage in that area. The trash enclosure will be fenced.

AUDIT REPORT PRESENTATION
City Auditor, Jim Maiser, presented the audit report. He began
by reading the audit letter going through the audit report and
finalizing by going through the management letter.
He stated that 55% of all City funds come from general taxes
and 45% are generated revenue from sale of service, permits,
homestead credits and miscellaneous interest and investments.
Financial notes are included in the report as well as special
assessment information.
Rascop stated that he would like to see all overtime salary
budgeted for and shown when expended.
Maiser reviewed and answered Councils questions as he went through
each page of the report.
Rascop asked about the sewer rate increase and if it could be
reduced. Mr. Snyder of the Finance Committee stated that added
expenses were for repairs and televising of the sewer lines in
an effort to free up additional connections for future developments.
The MWCC will release additional connections if the City can
reduce its flow by repairing and reducing infiltration into the
sewer system. Stover would like the Financial Advisory Board to
review the sewer fund again this fall. Vogt felt the water
revenues would increase because revenue no longer has to be
paid to the City of Minnetonka for their water.
The Liquor Fund is showing a increase of 11% in their profits.
$18,800.00 was transferred to the General Fund. Dean Young
questioned the increase in salaries charged. This came in the
area of added bookkeeping expenses.

7:30 P.M. PUBLIC HEARING - PRELIMINARY PLAT - SOUTH FORTY ADDITION
Wayne Pokorny - 24275 Yellowstone Trail
In November of 1987 Mr. Pokorny had submitted a preliminary plat proposing 10
single-family residential lots. which the Commission advised him to have redesigned in
conformance with the subdivision ordinance. Mr. Pokorny has now submitted a revised plat
containing 9 single-family residential lots. Planner Nielsen pointed out that the
proposed cul-de-sac now accesses Wood Drive rather than Yellowstone Trail. He said all
lots meet or exceed the subdivision and zoning regulations with the exception of Lot 5
which is 10 feet under the required width of 100 feet. This can be resolved by shifting
the lot line between Lots 5 and 9 ten feet to the west. The Engineer's report addresses
concerns about proposed contours. drainage. grading and existing buildings.

Watten acknowledged a letter as submitted by Paul Swanson. Yellowstone Trail opposing the
proposal due to concern over increased traffic on Yellowstone Trail.
Mr. Pokorny said he has recently submitted a new grading plan to the City Engineer which
he has not had the opportunity to report on as yet. He said he plans to comply with all
City Planner and Engineer recommendations.

7:45 P.M. PUBLIC HEARING - PRELIMINARY PLAT - GWK SECOND ADDITION
Thomas Wickenheiser - North of Hwy 7 at the end of Wiltsey Lane
In May of 1987 Mr. Wickenheiser had received approval of the preliminary plat for this
subdivision. however. he did not submit the final plat for approval within the six month
deadline as required by the Subdivision Ordinance. Consequently. he has had to resubmit
his application for preliminary plat approval.
Planner Nielsen said the two proposed single-family residential lots are 46.000 and
67.000 square feet in size. He said the proposed division complies with all of his
recommendations.

Mr. Wickenheiser said he would like his $250 application fee refunded because he wasn't
aware of the six month deadline.

8:00 P.M. PUBLIC HEARING - REZONING
City of Shorewood - Division Street
The City Council has initiated a public hearing to consider rezoning the area on and
around Division Street from R-1C to R-2A in order to bring the existing two-family
dwellings into conformity. The consideration is in response to a neighborhood petition
received by the City in favor of rezoning to allow two-family dwellings. The petition
was circulated by the owner of one of the two-family dwellings who would like to build a
garage on their site. They were told that a permit can not be issued because they have a
nonconforming use of property (a two-family dwelling in a single-family district).
Public portion of the public hearing opened at 8:16 P.M.
William Kahl. 5865 Hillendale Road. said he would like Hillendale Road to remain
single-family. but he supports the Planner's recommendation to rezone the area.
Susan Morrell. Division St.. Excelsior. said she is concerned about additional
multi-family dwellings and the traffic they would generate.
Dan Hoo. Division Street. asked what this rezoning could do to his taxes. Planner
Nielsen said that zoning changes do not affect taxes. although properties which are not
conforming to their zoning district are perhaps lower in value than they should be. He
said the City Assessor should address this concern.
Daniel Slattenberg. 5897 Division St.. said that he has one of the doubles and was given
a permit to build a garage 12 years ago. Benson said that zoning laws have changed to
improve planning.

Will Johnson. Lot 16. said he did not sign the petition. but he would not object to a
building permit so that a garage could be built on the two-family site.
Planner Nielsen explained the zoning ordinance provisions for nonconforming structures
and uses. In this case. under the current zoning. the two-family dwellings would have to
be converted to single-family before a building permit could be issued for anything that
would otherwise increase the nonconformity.
Debbie Anderson. lives next to Lot 9. she said she has been told that values of property
adjacent to two-family zoning districts will decrease.
Dave Wingert. 5832 Christmas Lake Road. does not want to see property values decline. He
said he does not object to the garage permit. he objects to rental property. He said the
Excelsior Apartments are a problem for the entire area.
Debra Midland. Lot 7. said she is not against the garage permit. She would like more
information regarding property values which may result from rezoning.
Rod McPherson. (Excelsior Councilmember). lives near proposed rezoning. He said
neighbors have approached him in concern over increased traffic. especially since
Christmas Lake Road has been dead-ended. He requested that Planner Nielsen contact the
Excelsior City Manager regarding this issue. Nielsen said he would.
Dave Wingert said. if approved. the zoning boundaries could spread in the future.
One resident said he would like his name removed from the petition he signed. Nielsen
said he needs to submit that request in writing.

Schultz asked why a variance is not appropriate in this case. Nielsen said variances
have applied to nonconforming structures. not uses.
Mason asked how these existing two-family dwellings got there in the first place.
Nielsen said the Ordinance did not regulate two-family dwellings prior to 1973.
Schultz asked if these existing two-family dwellings have garages. Nielsen said the
party desiring a permit to build one is the only two-family dwelling without one.
Mason questioned if it isn't considered a hardship to not have a garage in this state.
Nielsen said that is the City's policy. although the City has not allowed the expansion
of nonconforming uses.
Schultz moved. seconded by Mason to recommend to Council denial of the rezoning f!om R-1C
to R-2A. Motion was split by roll call vote 3 ayes (Benson. Mason. Schultz) - 3 nays
(Leslie. Watten. Robertson).

8:15 P.M. PUBLIC HEARING - SIMPLE SUBDIVISION AND ACCESS VARIANCE
Michael Spear - 22570 Murray Street
Mr. Spear is requesting approval of a simple subdivision to split his lot into two lots
and access the rear lot via driveway easement. He is requesting a variance to create a
lot which has no frontage on a public street.. Planner Nielsen said that the City's
policy has been to discourage private roads where there is potential for further
development beyond a total of three lots. He said Mr. Spear's property is capable of
being divided into at least three lots. and parcels on both sides of the Spear property
are also capable of future division. Nielsen has suggested that the division be prepared
as a formal plat. dedicating the access road to the City but not developing the street at
this time. This would avoid piece-meal development in the future.
Mr. Spear said he is not interested in further development of his property other than
what he is proposing at this time and would prefer access via easement. Nielsen said
that the City Attorney suggests that protective covenants be placed on the rear lot to
prevent further division without the City's consent to lift the covenants. Also. access
easement should be granted to adjacent property to the east.

Mr. Spear presented written statements by himself and his neighbor to the east. both
objecting to the platted street and further development.

naming the City as a party to those covenants.

subject to zoning setbacks and subdivision requirements. including dedication of an
additional 12 feet of r.o.w. for Murray Street; and approval of the access variance
subject to protective covenants being placed on the rear lot restricting further division
of same and naming the City as party to those covenants. and the easement also being
granted to the adjacent property to the east. Motion carried by roll call vote - 6 ayes.

8:30 P.M. PUBLIC HEARING - PRELIMINARY PLAT - MAYFLOWER ROAD ADDITION
Dale B. Peterson - 6070 Galpin Lake Road
Mr. Peterson would like to divide his property which contains 5.46 acres into three
single-family residential lots located in the R-1C district. The majority of the site is
low and wet. and a designated wetland is located in the center of the property. Planner
Nielsen said the property is capable of at least seven lots which can be served with
existing streets and sewer service. For that reason. some lot line adjustments are
suggested. especially Lot 3. where the northerly lot line should be shifted to the north
at least 40 feet to take better advantage of the high ground on the north end. The most
significant concerns are engineering due to the drainage pattern of the area.
The Watershed District recommends hydrologic analysis of the 100-year flood elevation of
the site accounting for all offsite tributary drainage.

information is needed to determine the appropriate size of the ponding area.
Watten felt more information is warranted before a decision should be made. Planner
Nielsen said that preliminary plat approval may be given subject to approval of needed
information by the Watershed District and City Engineer.
Leslie moved. seconded by Robertson to recommend approval of the preliminary plat
contingent upon the City Engineer's recommendations regarding grading and drainage as
well as recommendation and approval by the Watershed District.
Leslie amended the motion. seconded by Robertson to include the shifting of the north lot
line of Lot 3 to the north by 40 feet as shown on Exhibit C of the Planner's report dated
31 May 1988.
Motions carried by roll call vote - 5 ayes - 1 nay (Watten).

REVISED PRELIMINARY PLAT - STRAWBERRY FIELDS
Nanci Strickland-Balogh (Strickland Ventures II) - 5915 Strawberry Lane
In April of 1988 the Council denied a preliminary plat for this site based on proposed
R-1B zoning. The applicant has now returned with a preliminary plat in conformance with
the existing R-1A zoning. All lot sizes have been calculated by her surveyor and they
meet or exceed the 40.000 square foot size requirement. The width of Lot 5 needs to be
adjusted by comply with the 120 foot requirement. Nielsen said the width should be
corrected even if it causes a lot to result in less than 40.000 sq. ft.
Schultz moved. seconded by Benson to recommend to Council approval of the preliminary
plat subject to correction of the width of Lot 5 and maintain at least 40.000 square feet
of all lots. Motion carried unanimously.

SIMPLE SUBDIVISION
Erna Meier (and Minnewashta Church) - 26620 West 62nd Street
Minnewashta Church. representing Mrs. Meier. is requesting approval to divide the
property into two single-family residental lots located in the R-1D district. It is
proposed to divide off Lot 2 from Lots 3. 4 and 5. Lot 2 would then have a minimum of
10.000 square feet. The Planner's report also suggests that the City acquire an
additional 12 feet of r.o.w. for Church Road which is currently a substandard street.
Doing so would cause the narrowest portion of the lot (Lots 3. 4 and 5) with the house on
it to front on West 62nd Street and thereby maintain setbacks for the house.

Lance Detrude, 26620 West 62nd Street (Lots 3, 4 and 5), said that when he signed the
purchase agreement for the house there were some apparent discrepancies. He wasn't aware
that the Church was going to obtain Lot 2 when he signed the agreement. He said his
purchase agreement included Lot 2 in the sale.
Lee Heatherington, representing Minnewashta Church, asked who is going to pay for the
acquisition of the 12 feet of r.o.w.? Planner Nielsen said it is the City's policy to
acquire necessary r.o.w. whenever the opportunity presents itself.
Schultz moved, seconded by Benson to recommend to Council approval of the subdivision
subject to the City's acquisition of the additional 12 feet of r.o.w. for Church Road and
the removal of the nonconforming garage on Lot 3, and subject to the Planner's
recommendations as set forth in his report dated 2 June 1988. Motion carried 4 ayes - 2
nays (Leslie and Mason).
Nielsen said that the required updated title op1n1on will clarify the purchase agreement
discrepancies and the subdivision will not be recorded until this is resolved.

REPORTS
Council Liaison Stover said that the Council discussed possible building permit violation
penalties. It has been determined that doubling the permit fee cannot be used as
punishment, it is used as a measure to defray the additional administrative costs.
Building code violation is a misdemeanor and may be processed legally, however the legal
fees would probably outweigh the potential fine which may (or may not) be imposed by a
court of law.

Interfund Loan For House Purchase
As was discussed by the Auditor at the Audit Meeting, it is
recommended that the loan which exists in the Sewer Fund be
paid off with funds from the General Fund. You will recall
that the reason for the loan was to payoff the contract for
deed on the house purchase next to City Hall. A loan was
taken with the Sewer Fund since the Working Capital Fund as
part of the General Fund would have gone below the minimum
balance of $500,000 as set by the Council. Now that the
Working Capital Fund has a balance of nearly $700,000, the
loan should be paid off. All transactions relative to the house
will then be part of the General Fund.
It is therefore recommeded that your approval of the Consent
Agenda as part of the June 13 meeting include approval of the
payoff of the interfund loan in the amount of $98,207 from the
Sewer Fund to the General Fund with funds from the Working
Capital Fund. This language was discussed with our Auditor.

Change Order No. 1 - 1988 Sanitary Sewer Maintenance Work
As you are aware, the 1988 Sanitary Sewer Maintenance project is
currently underway out on the Islands. When the project was bid,
manhole grouting as a method of leak sealing was not included in
the specifications. Alternative methods for sealing the leaks were
under consideration. Now that the work is taking place, it appears
as though the contractor performing the work, Visu-Sewer Clean and
Seal, Inc., can do the work that will take care of a good deal of
the problem. As can be seen on the attached proposal, the work in
that manholes will cost an additional $315 per manhole worked on.
If the contractor can't do the work, they will make recommendations
at no charge on any necessary rehabilitation to eliminate leakage.
It is estimated that 20-25 manholes will require grouting.
It is highly recommended that the work contemplated by the Change
Order be approved. As the work progresses, it is being found that
the manholes are a major source of groundwater leaking into the
system. Since the contractor is at the site, it makes sense that
they do the work at this time.
This item appears for approval on the Consent Agenda of your June 13
meeting.

Visu-Sewer will grout all manholes showin.g signs of infiltration, where grouting is the
preferred rehabilitation technique within the designated work area described in the
sanitary sewer rehabilitation contract date May 23, 1988. The cost for grouting each
manhole will be $315.00.
Also, Visu-Sewer will at no cost to the City make recommendations to the City of Shorewood
on any additional rehabilitation necessary to eliminate both inflow and infiltration from
the manholes within the work area.

NSP has informed me that there will be no extra charges for the installation.

I know from past experiences and times. you have helped
us out that you are a very fair person. Therefore I'm'
asking you to consider a si tuationc.
The week of May 12th, some residents that had their cars
parked in the street, or protruding into the street of
Gillette Curve were vandalized. Two cars from the Brooks
residence (see attached sketch), one motorhome protruding
from the Peterson property into street right of way,
and a car at the Neal residence. By the way, several residents
cars were outside and not vand~l~zed (7 to be exact) that
were parked on their own property. Within two days Mr. Peterson
and Mr. Brooks had appealed to Dan Vogt, Shorewood Administrator,
for a streetlight to be erected at the end of Gillette Curve,
(see sketch), as a further note, this was done without consulting
any of the other residents as to whether or not we wanted
this light shining at the end of the street. The street light
request was put before the cot:.n:ll.on May 23rd as part of
the consent agenda. We were represented at that meeting, however,
no mention of the streetlight was ever made, apparently the
consent agenda gets approved as a whole without a reading of individual
items. Keith attended that meeting until 12100 midnight, the former
finance director had your attentions, and then gave ~p and came home.
His intention was to delay the erection of the light until we
had feedback from the others on the street.
As this light will only benefit two, possibly three residences
who have had only isolated vandalism, we decided their needed
to be a voice stating opposition to this light. So we met with
9 of the residents who all signed a petition against the light.
This petition was dUly presented to Dan Vogt on fu~~~d~,; . ~
May 31st for his opinion and assistance. We .have discussed the
situation and he feels also it should warrant further discussion.
As Peterson's were supposedly going on vacation the 2nd two
weeks of June, we thought it only fair to delay any action or
discussion until their return, so we asked Dan to consider us
to be on the agenda for the last meeting in June.

Well, to make a long story short, when Peterson's and Brooks
found out we were trying to delay their light, they started
a counter-petition and Marge Brooks even called Marianne Apenitis
and threatened her. An hour later at the Apenitis residence,
even though Marianne had told Mrs. Brooks that she was still
against the light, Cathy Peterson appeared at the Apenitis to
pressure her into signing a counter petition in favor of the
light. This is r:..:iiculous !! .
To even think that a light can be erected, and the NSP
standard is not exactly good looking (several real estate agents
-told me that it will deface and decrease our property values)
I repeat, to think that a light can be erected in front of
one's house on a dead end, not even an intersection where it
could serve several people, just on a.moment's notice at the
balance of the taxpayers' of Shorewood's expense is ridiculous.
If every homeowner who had their house tee-peed or egged, etc
got a streetlight erected on two days notice in Shorewood, our
taxes would double in just a few weeks. It~seems to me also,
that unless you have someone stand guard all night to watch
who passes under the light, you'd never catch a vandal anyways,
only scare him away.
If we are going to continue to erect streetlights at the
whim of only two residents on the block, correction now increased
due to the incorrigible pressure of Brooks and Peterson, it
would seem to me that perhaps we should have city investigation,
or a drive by, or some kind of policy concerning streetlights,
to make sure their is value in this investment, and not just
to satisfy an angry resident. Perhaps a member of the council,
or city staff could personally drive by a proposed site, and
make it mandatory, like we do with fences, that all residents
on-the adjoining properties would be in favor of an action.

action on this light until the last meeting in June. We will
be out of town for 2 weeks also, but will return in time for
that meeting. If you get a chance, you might drive down Gillette
Curve and form your own opinion. The attached sketch should
make it easier to understand.

Street Light Request - Gillette Curve
Enclosed you will find a Petition in opposition to a street
light which was requested for Gillette Curve. You may recall
that the request appeared on the Consent Agenda of the May 23
Council Meeting. Approval of the Consent Agenda consequently
gave approval of the light.
Due to the ~etition which has now been received, additional
background information is necessary.
A request for the placement of the streetlight was made by
Mr. Brooks and Mr. Peterson. I then drafted a short memorandum
and recommendation to approve the light. Said memorandum was sent
to ALL residents along both sides of Gillette Curve. I received
calls as to the actual location of the light and whether or not
any extra charges would be involved. It was agreed that the
light would be located on the Brooks/Peterson property line.
Also NSP stated that there would be no extra charges to install'
the light. The City picks up the monthly electric bill to
operate the light. During my conversations with area residents,
the last thing I heard was that the light would not be opposed
since the location and expense questions were cleared up.
Also, the residents that I talked to were told that the item
would appear on the Consent Agenda. They were also told that this
could be removed from the Consent Agenda by requesting said removal
under the Agenda item known as "Matters from the Floor."
Had I known of the opposition to the light up to and including

Dear Mr. Vogtl
It has come to our attention that two residents (named above)
on our street have requested, without consulting any of the
other adjacent residents, a streetlight to be erected for
their use.
We believe that this light will not eliminate or
discourage crime. Residents in the middle of the block
would not benefit from a light at either end and have also
been vandalized, even during daylight hours.
We were represented at the Monday, May 23rd meeting,
but the subject of the streetlight on our street was not
mentioned. Apparently, it was passed through a consent
agenda that does not verbally get any individual item
attention, only group approval.
At any rate, it is our feeling that this light will
only increase our taxes. If every two residents in Shorewood
can get their own streetlight on a two day notice like this,
without a neighborhood petition or even the knowledge and
approval of neighbors, our taxes would easily double in
one year. As this is an isolated case of vandalism for the
two residents involved that requested the light, w~ the under-
signed, request that any erection of this light be post-poned
until the June 27th meeting and at that time discussed openly.

SUBJECT: Street Light Request - Gillette Curve
Since my memo dated June 3, 1988, which has attached to it a petition
against the proposed street light on Gillette Curve, I have now received
another petition (copy attached) in favor of the light. You will notice
that some of the same names are on both petitions. Based upon this, it
seems to me that the residents should now sit down and agree on whether
or not a street light should be installed.
After your last meeting on May 23, a letter was sent to NSP to install the
light. Upon receipt of the petition against the proposal, I contacted
NSP to hold off installation until the June 13 Council Meeting.
Representatives of NSP stated that it was doubtful that the light would
go up prior to the 13th anyhow, but would certainly hold off until they
heard from the City to proceed. With a petition against the light signed
by a number of area residents, I anticipated that your action would be to
hold off with installation until the residents could agree. Also, if the
light went up and the City decided to take it down, the City would have
incurred expense for the removal. If I anticipated your action incorrectly,
I will contact NSP to proceed. However with the level of disagreement on
whether or not to install the light, I recommend that you ratify my action
relative to NSP and direct the residents to work out their differences
prior to the June27 Council Meeting. The Council could then take action
upon whether or not to install the light.

We would like to clarify our position on the petition we signed
regarding the ~bove mentioned street light.
When werecieved notification from the City of Shorewood that a
street light h~d been requested for the terminal portion of Gillette
Curve, we had no opinion about it as it would not affect us directly.

After the resolution was passed, Mrs. Lisa Wendt came to us. She

expls1ned that the light would be located on her property. She
also stated that her husband, Keith Wendt, had attended the council
meeting but that the resolution had passed without the opportunity
for discussion. She then.asked us to sign a petition requesting
the council to permit them to present their views before proceed-
ing with the installation of the light.
Our signatures on that petition should in no way be construed to
mean that we oppose the installation of the light. It only indicates
our belief that the views of the property owners directly affected
by this action be given due consideration.

BACKGROUND
Mr. Wayne Pokorny has submitted a revised preliminary plat for his property
located at 24275 Yellowstone Trail. You will recall that he submitted a plat
last November that contained 10 single-family residential lots. A staff
report. dated 24 November 1987 (enclosed for your review) raised a number of
issues and recommended that the plat be redesigned. Background information
relative to the property is contained in that report.

ANALYSIS/RECOMMENDATION
While there are still a number of issues which need to be resolved. the
revised plat is considered to be greatly improved over the original. In
reviewing the plat. the following should be considered:
A. Zoning Requirements.
1. Lot Area. All lots meet or exceed the minimum lot area for the R-1C

2. Lot Width and Depth. All lots except Lot 5 comply with the minimum
lot width (100') and depth (120') requirements. Lot 5 is ~nl~ 90 fe~

Lots 1-4 should also occur in order to maintain continuity of drainage
and utility easements.

Approval of the preliminary plat should be contingent upon
verification that existing buildings conform with setback
requirements. Any accessory buildings which do not conform to zoning
requirements should be removed prior to final plat approval. As an
option the developer could post a letter of credit to ensure that the
buildings would be removed within six months of final plat approval.
B. Subdivision Requirements.
1. The street width and cul-de-sac diameter comply with Shorewood's
requirements.
2. As part of the applicant's final plat submission. !he City spould

3. The applicant has shown what appear to be drainage and utility
easements around the lots. Lots 7 and 8 should have similar easements
along the Wood Drive sides.
C. General Design. The developer has addressed virtually all the design
issues raised in the previous staff report. While there is likely to be
a negative reaction by Wood Drive residents to the proposed cul-de-sac.
it should be noted that the revised plat only results in one more lot
using Wood Drive for access. By the same token. the traffic issues
relative to Yellowstone Trail have been mitigated by the revised plat.
D. Engineering Concerns. Preliminary grading plans have been reviewed by
the City Engineer. Grading and other engineering issues have been
,addressed in a separate report dated 17 May.
E. Park Dedication. The Park Commission. at its 7 December 1987 meeting.
has recommended that park dedication be in the form of cash rather than
land. Based upon the proposed nine-lot division. the park fees amount to
$4000.
RECOMMENDATION
The revised plat is considerably improved over the original and. if the
recommendation contained in A.2. herein is followed. complies with all
requirements of Shorewood's Zoning and Subdivision Ordinances.
In view of the City Engineer's report it is recommended that the preliminary
plat be specifically contingent upon the developer's engineer resolving the
issues raised prior to submission of a final plat.

Following is a summary of recommendations relative to approval of the plat:
1. Adjust Lot 5 to comply with minimum width requirements.
2. Require applicant to submit.a survey showing exact property dimensions.
topography. location of existing buildings and proposed lot lines prior
to submission of final plat information.
3. Require soil tests for Lots 7 and 8 and Rampartt Court. The City
Engineer should determine the number and location of borings.
4. Drainage and utility easements must be provided 10 feet on each side of
each side and rear lot line.
5. The applicant's engineer should work closely with the City Engineer to
resolve the issues raised by the City Engineer prior to submitting the
final plat.
6. The applicant should submit an up-to-date title opinion for the property
with his final plat information.

7. The final plat must be submitted within six months of approval of the
preliminary plat.
8. Once all required information has been submitted for the final plat. the
City staff will prepare a standard development agreement which will
govern the development of the site.

Dear City Officials:
We have reviewed the pre1 iminary p1 at and grading p1 an for the South Forty
Subdivision at Wood Drive and Rampartt Court as prepared by Rhonda Rae for Mr.
Wayne Pokorny. Our review comments will address the following items:
- Sanitary Sewer
- Water
- Storm Drainage and Grading
- Streets
- Erosion Control
SANITARY SEWER: Sanitary Sewer service will be required off of both Yellowstone
Road and Wood Dri ve and can be supp 1 i ed wi th re 1 at i ve ease. From an exi st i ng
manhole at the intersection of Wood Drive and Tee Trail a line would have to be
extended approximately 400 feet to the proposed Rampartt Court. The 1 ine has
sufficient depth to serve lots 5, 6, 7, 8 and 9.
lots 1-4 will be served from an existing manhole located on Yellowstone Road, ap-
proximately 600 feet west of Riviera lane. lots 2 and 3 can connect directly into
the existing line, but lot 1 will need an extended service line. Additionally, the
house pad for lot 1 will need to be raised in order to be served by the existing
sewerline.
WATER: The municipal water system is not located within the project vicinity.
Therefore, we understand individual well systems will be incorporated into each
lot.
STORM DRAINAGE AND GRADING: The proposed grading plan for the South Forty plat
needs several revisions and additions. The grading plan does not include any
storm sewer or storm drainage plan. The storm sewer plan should conform to the
Comprehensive Storm Water Study.
Three buildings, shown on the city's contour map, are not identified on the
preliminary grading plan. All existing foundations, wells, and sewer drainfie1d
should be noted on the grading p1 an, and wi 11 need to be properly abandoned.

The proposed contours are not properly drawn and require several corrections:
1. The proposed 982 contour splits into 2 contours in lot 9.
2. The proposed 980 contour ties into an existing 984 contour.
3. The existing 976 and 980 contours are not properly tied off.
lots 1-3 have driveway slope problems. lot 1 has negative slope to the streett
which may cause drainage towards the house. The house pad needs to be raised for
the sanitary sewert which could solve this problem. lots 2 and 3 appear to have
driveway slopes exceeding 18%t which will not be allowed. This item should be
addressed.
lots It 8 and 9 all have land-locked backyards regarding drainage. There is a low
area located in lots 1 and 9 that collects all of the drainage from these lots. A
storm sewer network will need to be instituted in order to correct the problem.
STREETS: The cul-de-sac property line diameter must be 120 feet with a roadway
diameter of 100 feet. The grading plan does not specify any street gradest but
the street appears to have a very 1 imited grade. The contours around Rampartt
Court are not laid out very well. They are not connected properly and are there-
fore difficult to interpret. Additional information will be required to properly
review the proposed slope for the new street.
EROSION CONTROL: Erosion control should be shown along the east side of the
deve 1 opment and on any areas subject to eroded materi a 1 carryi ng onto adj acent
property.

BACKGROUND
Mr. Wayne Pokorny has submitted a preliminary plat for his property located at
24275 Yellowstone Trail (see Site Location map - Exhibit A. attached). As
shown on Exhibit B. Mr. Pokorny proposes to divide the property into 10 lots.
Two of the lots front on Yellowstone Trail. two front on Wood Drive and the
remaining six front on a proposed new street.
The property is currently zoned R-1C and is occupied by a single-family
residence which will remain on Lot 4. Surrounding land use and zoning are as
follows:

The property is characterized by rather significant changes in topography. The
northeasterly third of the site consists of high ground reaching an elevation
of 1002 feet. The southerly and westerly two-thirds of the site are quite low.
dropping to an elevation of 975. approximately 27 feet below the high point of
the property.
ISSUES AND ANALYSIS
Review of the proposed plat. Shorewood's Comprehensive Plan. Zoning Ordinance
and Subdivision Ordinance raises several issues which should be considered in
evaluating the acceptability of the proposed subdivision.

A. Comprehensive Plan. The proposed Land Use plan designates the area south
of Yellowstone Trail as Low Density Residential (1-2 units per acre).
Based upon a 40,000 square foot acre the proposed plat results in a net
density, after street r.o.w. is subtracted, of 1.75 units per acre.
B. ZoninR Ordinance Requirements. As can be seen on Exhibit C all of the
proposed lots meet or exceed the 20,000 square foot lot area requirement.
Several of the lots, however, do not meet width or depth requirements.
Specifically, Lots 1, 7 and 10 are not at least 100 feet wide, and Lot 9 is
not at least 120 foot deep at its shallowest point.
There are several existing outbuildings located on the site. One appears
to be located too close to the east property line and three others will end
up on lots other than that which the house is located. Prior to release of
any final plat, the applicant should be required to remove these buildings.
C. Subdivision Ordinance Requirements.
1. The Proposed street right-of-way varies in width from 45 to 50 feet.
The minimum requirement is 50 feet.
2. The cul-de-sac should be enlarged from the proposed 90 foot diameter
to the required 100 foot diameter.
3. The lots should be renumbered. Lot 2 should be Lot 1, Lot 3 should be
Lot 2, etc.
4. Given the low elevation on several of the lots, the City may wish to
require soil tests to ensure that all lots are buildable.
5. Drainage and utility easements, 10 feet on each side of each side and
rear lot line must be provided.
D. General DesiRn Comments.
1. The proposed street should be shifted somewhat to the east. This will
avoid headlights from shining into the house immediately north of
Yellowstone Trail. It will also take better advantage of the high
ground on the property. The City Engineer should advise the applicant
of the best location for the proposed intersection so as to provide
the safest possible site lines along Yellowstone Trail.
2. Our current Subdivision Ordinance does not require grading and
drainage plans until review of the final plat. However, given the low
elevation of the buildable area on at least five of the lots, the need
for substantial filling appears likely. It is recommended that the
City require at least preliminary plans for review and comment by the
City Engineer at this time.
3. Corner lots should be wider to accommodate the additional setback
which is required on the side yard abutting the street.
4. Lot lines should radiate from the center of the cul-de-sac. Side lot
lines should be as close to perpendicular with the r.o.w. as possible.

5. The plat should be prepared from a survey so precise measurements can be
determined.
6. Since double fronted lots result in poor alignment of setbacks and poor
relationships between yards (especially front to rear). they should be
avoided to the extent possible.
RECOMMENDATION
Given the deficiencies noted in the preceding analysis. approval of the plat
can not be recommended at this time. It is suggested that the applicant enlist
the services of a design professional to resolve these issues. A revised plat
should be submitted within 60 days.

Mr. Thomas Wickenheiser has submitted a final plat proposing to replat Outlot
A. GWK Addition. into two lots. A preliminary plat for the subdivision was
approved in May of 1987 (see attached staff report. dated 29 April 1987. copied
in yellow). however the final plat was not submitted within six months as
required by the Subdivision Ordinance. Consequently. the applicant has had to
start over in the process.
The new plat. shown on Exhibit A. complies in all respects with the approval
previously granted by the City. Approval of the plat is therefore recommended
subject to the following:
1. The applicant must submit an up-to-date (within 30 days of final plat
approval) title opinion for review by the City Attorney.
2. Prior to release of the final plat. the applicant must pay $500 per lot in
park dedication fees.
3. Once the applicant has received the resolution approving the plat. it must
be recorded within 30 days or the approval shall be considered void.

BACKGROUND
Mr. Thomas Wickenheiser has requested approval of a preliminary plat for
Outlot A. GWK Addition. The property contains approximately 2.6 acres and is
located at the east end of Wiltsey Lane. north of State Highway 7 (see site
Location map - Exhibit B. attached). As can be seen on Exhibit B. the
applicant proposes to divide the property into two lots.
The property is currently zoned R-1C. as is all the property to the north.
east and west. Surrounding land uses include single-family residential to
the north and east and a vacant lot to the west.
ANALYSIS/RECOMMENDATION
The proposed division is considered poorly designed and. given the zoning of
the site. an inefficient use of land. It's apparent that the applicant wants
to avoid the costs of extending the street and utilities into the site.
While this is not the City's concern. the City must be concerned with lot
configuration and potential future resubdivision of the lots.
While nothing can be done about the irregular border of the property formed
by the Highway 7 r.o.w.. the location of the proposed division line results
in an odd-shaped buildable area for Lot 2. This will necessitate an
excessively long driveway and sewer service for Lot 2.

The lots are substantially larger than the required 20.000 square foot
minimum for the R-1C district. The concern here is that some future owner
will come back at a later date wanting to resubdivide one of the lots.
It is recommended that the lot line be straightened out as shown on Exhibit
C. Not only will the lot lines conform with the topography of the site. but
the buildable area of the lot is closer to the street and sewer service.
Furthermore. if Lot 2 is made to be 50 feet wide at Wiltsey Lane. adequate
access can be provided for future resubdivision.
Kegardless of whether the City approves the request as submitted or the
recommended alternative it is recommended that the Council's resolution
specify that it is not the intent of this Council for the property to be
resubdivided.
Also. whichever layout is approved. the following conditions should be
imposed:
1. The final plat must include 10 foot drainage and utility easements along
each side of each side and rear lot line.
2. The applicant must submit an up-to-date (within 30 days of final plat
approval) title opinion for review by the City Attorney.
3. Prior to release of the final plat. the applicant must pay $500 per lot
in park dedication fees.

BACKGROUND
At its 25 April meeting the Shorewood City Council agreed to consider. on its
own initiative. a petition from a number of Shorewood residents requesting
that properties in the vicinity of Division Street be rezoned from
single-family residential to single and two-family residential (see attached
staff report. dated 21 April 1988 - copied in yellow).
Based on direction by the Council a study area has been determined (see
Exhibit A) and a public hearing has been scheduled for 7 June.
Exhibit A identifies various parcels within the study area. and Exhibit B
provides information relative to lot size and land use. Exhibit B also shows
which residents signed the petition.
All of the lots within the study area are zoned R-1C with the exception of
parcels 17 and 18. They are zoned R-1A.
ANALYSIS/RECOMMENDATION
A. Comprehensive Plan. As in any proposed rezoning. the Comprehensive Plan
serves as the guide for evaluating change. The only specific reference
to the area in question is the proposed land use map which suggests a
residential density of 1-2 units per 40.000 square feet.
To determine how a proposed zoning change would comply with the
Comprehensive Plan it is necessary to project what development would
occur. The following table is based on a change from current zoning to
R-2A.

The study area contains approximately 10.7 acres (466.527 square feet).
not including parcels 03 and 04. Due to lack of access to these lots it
is recommended that their zoning not be changed at this time. The 21
potential units which could be generated by a change toR-2A would result
in a density of 1.8 units per 40.000 square feet of area. This would be
consistent with the Comprehensive Plan.
B. R-2A or R-2B1 The legal notice for the proposed rezoning stated that the
City would consider a change to either R-2A or R-2B zoning. The
difference between the districts is that R-2A allows two-family dwellings
on 30.000 square foot lots. while the R-2B district requires a 20.000
square foot lot. While the numbers have not been explored. it is felt
that the density resulting from R-2B zoning would exceed the 1-2 units
per acre suggested by the Comprehensive Plan.
R-2A zoning is the most restrictive zoning district which would provide a
conforming use status for two-family dwellings. while at the same time
minimizing the impact of additional future development.
If the City feels that the character of the area is one and two-family
dwellings (four of the eleven parcels being considered contain two-family
dwellings). rezoning to R-2A would be consistent with previous changes in
zonings which reflected existing development.
C. Recommended Zoning Boundary. As mentioned in A. above parcels 03 and 04
are not recommended for change until access can be determined. Initially
there was some concern over whether parcel 17 should be included because
it is vacant and orients to Hillendale Road. a predominantly
single-family residential street. If. however. the zoning is changed to
R-2A. the lot would be buildable for a single-fam.ily dwelling without
need for a variance.

RE: DIVISION STREET - REQUEST FOR REZONING

Mr. Jeff Thompson and Ms. Loxie Mock own a two-family dwelling at 5875 Division
Street (see Site Location map - Exhibit A. attached). Since the property is
zoned R-1C. Single-family Residential. their home is a nonconforming use in
that district. The nonconforming use status of the property precludes them
from adding a new garage.
Upon discussing the procedure for applying for a variance. it was brought up
that there are several other two-family dwellings in their neighborhood. It
was suggested to them that they may wish to present a petition of area
residents requesting that the City initiate a rezoning for the area.
Given the number of residents on the petition and the number of two-family
dwellings in the area. there appears to be some merit in considering a change
in the current zoning. Further detailed study would reveal if rezoning is
justified and. if so. which two-family district might be most appropriate (R-2A
or R-2B).
It is recommended that our office be directed to study the matter further and
if there appears to be justification for rezoning. prepare the proper notices
for a public hearing.

Mr. Michael Spear has requested approval of a simple subdivision to split his
property. located at 22570 Murray Street (see Site Location map - Exhibit A.
attached). into two lots (see Exhibit B). Since he proposes to access the
northerly lot via a driveway easement across the southerly lot. he requests a
variance to create a lot which has no frontage on a public street.
The property in question is occupied by Mr. Spear's residence. contains
approximately 117.100 square feet of area (2.7 acres). and is zoned R-1C.
The north end of the site is bounded by Galpin Lake.
ISSUES/ANALYSIS
Although only two lots are proposed at this time. there are at least two
significant issues which should be considered prior to making a decision.
A. Future Development. The area in question was originally developed into
large. deep parcels. Presumably. houses along Galpin'Lake were first
developed and later the lots were chopped up to allow additional houses
closer to Murray Street. The proposed division perpetuates this kind of
piece-meal development.
The property in question is capable of being divided into at least three
lots. Furthermore. parcels on both sides of the Spear property are also
capable of future division. It is worth mentioning that our office has
had an inquiry within the last several weeks relative to the possibility
of dividing one of the adjoining parcels.
The sketch shown on Exhibit C illustrates how the subject site could be
developed in conjunction with property to the east of it.

B. Private Road Easement. Shorewood's Subdivision Ordinance requires that
all lots front on a public street. The applicant has requested a
variance to access the northerly lot by an easement over the easterly 50
feet of the southerly lot.
Several years ago. due to a number of problems generated by private roads
and "back lot development". the City adopted a policy which limits the
number of lots served by a private road to three. Since then the City
has been consistent in approving private roads only where a 50 foot
easement could be provided and only where there was no potential for more
than three lots to be developed.
Considering the potential for future division shown in A. above. the
proposed easement access is not recommended.
To put a public road in at this time. for one new lot. is not likely to
be feasible for the applicant. As a compromise and in order to avoid
inappropriate piece-meal development. it is suggested that the division
be prepared as a formal plat. as shown on Exhibit C. dedicating the
access road to the City but not developing the street at this time. A
development agreement and possibly a declaration of covenants would be
required stating that at such time as either the applicant's northerly
parcel would be divided or the lot immediately east would be divided. the
property owners would construct the street and utilities.
C. Zoning and Subdivision Requirements.
1. Zoning Requirements. The proposed new lot complies with width. depth
and area requirements of the R-lC district. The proposed house does
not. however. comply with R-1C setback requirements. The required
setbacks are shown on Exhibit B.
2. Subdivision Requirements. In addition to the recommendations made in
B. above the following should be required:
a. The proposed 50 foot access should be shifted over to the easterly
lot line to eliminate the sliver of "no man's land" currently
shown. If the applicant wishes to take advantage of the existing
driveway until such time as a street is built the right-of-way
should be widened accordingly.
b. Since Murray Street is substandard in width. the applicant should
be required to provide an additional 12 feet of r.o.w. along the
south side of his property. The remaining r.o.w. needed to
achieve the standard 50 feet can be acquired from the south side
of the street at such time as that property is divided.

RECOMMENDATION
While the applicant may object to the approach suggested herein. it is
important for the City to remain consistent with its policies and past
actions relative to private roads. Planning for future development will. in
the end. result in better development for the site. as well as for the area
in which it is located.
Unless the recommendations contained herein are followed. there is no basis
for granting a variance and the proposed division should be considered
premature.

BACKGROUND
Mr. Dale Peterson has requested approval to divide his property, located at
6070 Galpin Lake Road (see Site Location map - Exhibit A, attached) into
three lots (see Exhibit B).
The property in question is occupied by Mr. Peterson's residence, contains
237,979 square feet of area (5.46 acres), and is zoned R-IC, Single-family
Residential. The majority of the site is low and wet. A designated wetland
is located in the center of the property. Area drainage converges from the
southwest and the southeast onto this site before continuing to the north.
ANALYSIS/RECCMMENDATION
The proposed division raises a number of development issues, perhaps the most
significant of which are engineering concerns. The City Engineer has
submitted his review comments in a separate report dated 17 May 1988
(attached for your review). Following are zoning and subdivision issues
which should be considered in evaluating the plat.
A. Future Development. Given the proposed lot sizes and the current zoning
of the property. it is reasonable to expect that the City will be faced
in the future with requests for resubdivision of at least Lots 1 and 2.
As land becomes more scarce. even marginal sites become more attractive
as building sites. This is evidenced by the proposed filling on Lot 1.

There are some minor changes which could be made at this time which may
allow further divisions to be made without need for variances in the
future. The southerly portion of Lot 2 should be widened to accommodate
future division into two lots. 20.000 square feet in area. exclusive of
the wetland area. The northerly lot line for Lot 3 should be shifted to
the north at least 40 feet to take better advantage of the high ground on
the north end. This will also better accommodate the 40 foot rear yard
setback for that lot.
The property is capable of at least seven lots which can be served with
existing streets and sewer.service. The three lots currently proposed
should anticipate such redivision. Exhibit C illustrates how the
property could be divided. It should be noted that any resubdivision of
Lots 1 and 2 would involve site alteration similar to that which is
proposed for Lot 1. Consequently grading and drainage for those sites
would require review and approval by the City Engineer.
B. Subdivision Requirements. Considering the development potential cited in
A. above. it is recommended that the Council resolution approving the
plat clearly state that any future division of any of the lots will
require formal platting. This will ensure that grading and drainage
concerns are properly addressed at the time.
The plat should show drainage and utility easements 10 feet on each side
of each side and rear lot line. Additionally. drainageways should be
identified and easements provided as per the City Engineer's
recommendation. Grading and drainage are also subject to the review and
approval of the Minnehaha Creek Watershed District.
Park dedication fees for the plat will be $500 per lot. with credit given
for the existing house.
In view of the preceding analysis it is recommended that the preliminary plat
be approved with the modifications suggested herein. The applicant should be
directed to submit a final plat addressing these concerns as well as those of
the City Engineer and Watershed District within six months of the Council's
approval of the preliminary plat.

Dear City Officials:
We have reviewed the preliminary plat for the Dale Peterson Subdivision at Chaska
Road and Mayflower Road as prepared by Coffin and Gronberg, Inc. Our review
comments will address the following items:
- Water
- Sanitary Sewer
- Storm Drainage and Grading
- Streets
- Erosion Control
SANITARY SEWER: Service will be provided by an existing 9 inch PVC line which
encompasses the property. The services can be directly connected to the existing
1 ine. Currently there are no services stubbed out for these additional lots.
WATER: The municipal water system is not located within the project vicinity.
Therefore, we understand individual well systems will be incorporated into each
lot.
STORM DRAINAGE AND GRADING: The City's Comprehensive Storm Water Study calls for
a 12 inch storm water outlet from the wetland located within the property. This
outlet is to be located on the northwest corner of the wetland and tie into the
storm drainage network along Chaska Road.
The 12 inch culvert at the corner of Galpin lake Road and Mayflower Road outlets
into lot 3. This drainage must be accommodated for as part of the lot 3 develop-
ment.
The existing driveway entrance for lot 2 is not contained within the property
boundary. To ensure access continuity, an easement should be obtained across the
adjacent lot or the driveway moved.
The filling of lot 1 should not proceed until adequate soil borings are obtained
within the proposed house pad location. The area appears to be marshy and may not
be able to handl e any substantial 1 oadi ng wi thout subsurface soil correct ion.

The side slopes on the filling should be 4:1 or greater to reduce the chances of
extensive erosion into the wetland.
EROSION CONTROL: Erosion control should be establ i shed around all fi 11 areas
until permanent vegetation is established.

Proposed subdivision of a 5.46 acre lot located at
6070 Galpin Lake Road by its owner Mr. Dale Peterson
Dear Mr. Nielsen:
Mr. Dale Peterson has submitted a permit application to the Minnehaha Creek
Watershed District for review to allow filling of a residential lot in
Shorewood. The filling activity is proposed in an area designated by the City
as a stormwater detention ponding area in the 1975 Shorewood Comprehensive
Stormwater Study.
The permit was reviewed in April and May by the MCWD Board of Managers and
currently is tabled pending receipt of:
1. Hydrologic analysis establishing a 100-year flood elevation for the site
accounting for all offsite tributary drainage.
2. Review and approval by the City of Shorewood.
The site is located along an existing drainage path which ultimately flows
along Highway 7 into Galpin Lake. Under the present system, during large,
infrequent storm events, runoff is detained in this area. Detention time in
this low area cuts peak rates of runoff to downstream facilities and provides
an opportunity for suspended sediments to settle out thereby improving the
quality of the stormwater. The drainage system proposed in the City's 1975
stormwater study bypasses the wetland area and discharges directly into the
Highway 7 system.
The Managers encourage the use of natural pondi ng areas to real i ze the
aforementioned rate and water quality benefits in lieu of larger storm sewer
systems. As you are aware, the preservation and use of natural water storage
and retention systems are also major focuses of the Chapter 509 Surface Water
Management La\'i passed by the legislature in 1982. With these policies in

mind, the District encourages the City and/or Mr. Peterson to perform a
hydrologic analysis of the subwatershed tributary to this site in order to
establish a lOO-year flood elevation in the area and to protect available
storage to that elevation. When this information becomes available for
District review, the Managers will be able to clarify the future effects of
the proposed development.

BACKGROUND
Having had her request for R-1B zoning and preliminary plat denied in April
of this year (see staff report. dated 28 March 1988). Ms. Nanci
Strickland-Balogh has submitted a revised preliminary plat based on R-1A
zoning requirements.
The plat. shown on Exhibit A. proposes eight single-family residential lots.
including the lot with the existing house on it.
ANALYSIS/RECOMMENDATION
A. Comprehensive Plan. The proposed plat is consistent with the Shorewood
Comprehensive Plan.
B. Zoning Requirements.
1. Lot Area. Not all of the lots meet the minimum area requirement of
40.000 square feet. For example. Lot 1 is 39.207 square feet. The
developer's surveyor should provide exact lot areas. If the lots
average at least 40.000 square feet. no adjustment is suggested.
However. if lot areas average less than 40.000 square feet. the plat
should be adjusted to comply. It may be possible to shorten the road
somewhat to obtain additional area for the lots.
2. Lot Width. Lot 5 does not meet the 120 foot lot width requirement.
3. Lot Depth. All lots comply with the minimum 150 foot requirement.

C. Subdivision Requirements.
1. Proposed Street. The proposed street is approximately 520 feet long
and complies in all respects with the requirements of the Shorewood
Subdivision Ordinance. Detailed design requirements will be reviewed
by the City Engineer as part of the final plat process.
2. Grading. Drainage and Utilities. Proposed grading and drainage have
not changed from the previous proposal. These will be subject to
review and approval by the City Engineer and Minnehaha Creek Watershed
District prior to approval of the final plat.
While the City is still restricted relative to sanitary sewer
extensions. the outlook for additional connections is positive.
inspection has already revealed one significant leak which could
up over 100 residential connections once fixed.

City water is. of course. no longer proposed.
3. Park Dedication Requirements. The proposed plat will generate $3500
in park dedication fees.
D. Removal of Shed. As mentioned in the earlier request. the shed located
in the northeast corner of Lot 1 should be removed.
Based upon the preceeding the applicant should be directed to prepare a final
plat addressing the concerns expressed herein. The final plat should be
submitted within six months of the Council's approval of the preliminary
plat. At that time the staff will prepare a standard development agreement
which will govern installation of improvements.

BACKGROUND
Minnewashta Church. representing Ms. Erna Meier. has requested approval to
divide Ms. Meier's property. located at 26620 West 62nd Street (see Site
Location map - Exhibit A. attached). into two lots (see Exhibit B).
The property is occupied by Ms. Meier's residence. contains 35.100 square
feet of area and is zoned R-1D. Single-family Residential. The Church
proposes to buy the westerly lot to increase the size of its adjoining
property.
ANALYSIS/RECOMMENDATION
As you can see from Exhibit B. the lot line between Parcels A and B does not
coincide with the original lot line for Lots 2 and 3. This was done at the
suggestion of this office in order to keep the existing house from becoming
nonconforming. For corner lots the narrowest width on the public street is
defined as the front. Therefore. if Church Road becomes the front of the lot
due to being the narrower dimension. the house would become nonconforming.
Upon detailed review of the proposed division. it was found that Church Road
is grossly substandard in terms of right-of-way width. Consistent with past
City policy of requiring substandard road r.o.w. to be widened at such time
as adjoining property is divided, it is recommended that the City require 12
feet of r.o.w. along the east property line. Doing so eliminates the need to
change the old lot line between Lots 2 and 3.
Both of the resulting lots comply with the lot area (10.000 square feet). lot
width (75 feet). and lot depth (120 feet) requirements of the R-1D district.

It is recommended that the division be approved subject to the following:
1. The proposed dividing line should be moved back to coincide with the
previous lot platting for Lots 2 and 3.
2. The applicant must provide drainage and utility easements 10 feet along
each side of each side and rear lot line. If the Church intends to
legally combine Lot 2 (Parcel A) with its property immediately. easements
will not be required along the west side or rear of the lot.
3. The applicant must provide an up-to-date (within 30 days) title opinion
for the property for review by the City Attorney.
4. Park dedication fees are required in the amount of $500 (credit is given
for the existing house). If the Church combines the westerly lot with
their property immediately. no park dedication fee is required.
5. The applicant must submit the above-mentioned information within 30 days
of the Council's approval of the division. They must then record the
division with Hennepin County within 30 days of their receipt of the
Council resolution approving the request.
6. The nonconforming accessory building must be moved into compliance with
setbacks or removed. If the applicant wishes to record the division
prior to removal of the building. the City should require a $1000 cash
deposit or letter of credit to guarantee its removal within six months.

Re: Fourth of July 1988 Fireworks Display
Dear Mayor and Council Members:
Traditionally the Fourth of July Celebration for the South Shore
has been held on the Commons in Excelsior. This patriotic
national holiday has always been topped with a fireworks display;
upwards of 15,000 people attend.
The Chamber of Commerce is organizing this year's display, but we
are in great need of financial help to assist in paying for the
ever-increasing expense. To meet that expense we are asking that
each of the four communities consider a donation to the Excelsior
Chamber of Commerce to defray the cost of fireworks, a $5,000
expense, on behalf of their citizens who do enjoy the event.
Additionally, the Chamber of Commerce would like to suggest that
the cities consider incorporating a donation on an annual basis
within their future park and recreation budgets. In this way
hopefully we can develop a far more certain funding mechanism for
the fireworks and provide a base level from which public
solicitations for the event can be launched.
I have asked this matter to be placed on your agenda for
consideration. I would be happy to answer any questions you may
have at that time.

We have received a letter from Ms. Susan Sano (see Exhibit A) requesting that
her property located at 5685 Howard's Point Road (see Exhibit B) be included in
the R-1C zoning district. It was her understanding that her lot had been
included in the rezoning which was approved for Brentridge and several lots
along Howard's Point Road.
The legal notice. and ultimately the actual rezoning. included Brentridge and
eight substandard lots on Howard's Point Road which were bounded by the
Brentridge project.
Ms. Sano now wishes to build a deck which would be too close to the lot line.
based upon R-IA requirements. She asks that the City rezone the property on
its own initiative.
The request is considered to be a logical and reasonable extension of the R-1C
district. If the Council concurs. it is recommended that the owners of 5665
and 5675 Howard's Point Road be contacted to see if they want their lots
included in the rezoning at this time.
If the Council agrees. a public hearing can be scheduled for the 5 July
Planning Commission meeting.

In April of this year Ms. Vicki Stalvey received approval of a simple
subdivision to divide her property at the end of Wood Drive into three lots.
The division was prepared as a preliminary plat and was approved subject to a
number of conditions.
The applicant has now submitted a final plat (see Exhibit A) which addresses
the concerns raised in the review of the preliminary plat. Specifically. lot
lines have been straightened and made to radiate from the center of the
cul-de-sac.
It is recommended that the final plat be approved subject to the following:
1. The applicant must provide an up-to-date (within 30 days) title opinion for
review by the City Attorney.
2. Park dedication fees must be paid prior to release of the resolution
approving the division. The amount due is $1000 ($500 credit is allowed
for the existing house).
3. The applicant must inform the City Clerk as to how she wants sewer
equalization charges spread against the three lots.
4. These items must be provided within 30 days of the Council's approval of
the plat. after which the applicant will have 30 days to record the plat.
FAILURE TO COMPLY WITH '1HESE DEADLINES WILL VOID THE CI'lY'S APPROVAL.

Dear' City Officials:
At the May 23, 1988 council meeting, Mr. Dennis Snyder brought to the attention
of the council a drainage or ponding water problem in a low area southeast of
his property on the east side of Eureka Road. We have reviewed the situation
further and estimated construction costs for two alternative solutions.
The first alternative studied is providing an outlet for the low area with 18"
concrete pipe which would run westerly approximately 500 feet, crossing Eureka
Road and emptying into the wetland area west of Eureka Road. This piping only
alternative is estimated to cost approximately $17,000. The second alternative
is constructing a ditch from the low area westerly along the same alignment as
the piping alternative, outletting into the same wetland. This alternative,
including pipe under Eureka Road, is estimated to cost approximately $9,200.
Both alternatives would require permanent and temporary construction easements.
These estimates do not include any costs in acquiring these easements. A more
detailed cost estimate and a map showing the proposed alignment are attached for
your review.

WHEREAS, Shorewood City O>de Section 903.11 provides that in the
event the City O>uncil detellDines that a shortage of water threatens the
City, the O>uncil, by resolution, may limit the time and hours during
which water may be used fran the water system for lawn and garden
sprinkling, irrigation, and car washing; and
WHEREAS, the O>uncil has made a detellDination that the City is
present ly threatened wi th such a shortage of water.
lOV, 'IH.ERERIm, BE IT RESOLVED by the City O>uncil of the City of
Shorewood as follows:
1. That residential and business addresses ending with an odd
nmi>er shall be restricted to the use of water fran the municipal water
system for sprinkling, irrigation, and car washing on odd numbered days
only, and residential and business addresses ending with an even nmi>er
shall be restricted to the use of water fran the municipal water system
for sprinkling, irrigation, and car washing on even numbered days only.
2. That new sod may be sprinkled daily for the first week after
the sod is laid, after which time sprinkling shall be on alternate days
only.
3. That appropriate notice of this restriction shall be given to
each municipal water user.
4. That this restriction shall remain in effect until further
notice.

Re: Cathcart Park Easement Agreement
Church Road Improvement Project

Honorable Mayor and City Council:
As requested in your April 12, 1988 letter, the City of
Chanhassen, as reimbursement for granting an additional 17 feet
of roadway easement along Lot 5, Schmid's Acre Tracts, agrees to
do the following in conjunction with its Church Road improvement
projects:
1. The overhead NSP utility lines currently existing along the
west side of Church Road shall be buried and poles removed.
2. Any trees damaged during construction which are notcompen-
sated by the Metropolitan Waste Control Commission will be
replaced with trees of equal caliper inch.
3. The realigned Church Road shall be moved no more than
necessary while keeping as reasonable a boulevard area as
possible.
4. The City of Chanhassen agrees to have installed a low-profile
(4-foot) chain link fence along the boundary of the park pro-
perty which abuts Church Road commencing at the southerly
edge of the existing backstop area and extending to within 10
feet of the southerly property line of Lot 5 (approximately
380 feet).
As consideration for the City of Shorewood granting the attached
easement agreement, the City of Chanhassen agrees to comply with
the above-mentioned conditions.
