CALL TO ORDER
Mayor Rascop opened the Joint Council meeting of the Shorewood
City Council and Excelsior City Council at 6:05 P.M.
ROLL CALL
Shorewood: Mayor Rascop, Shaw, Stover, Gagne, Haugen (arrived late)
and Administrator Vogt.
Excelsior: Councilmembers Crow, Ryerson, Mayor Elect Olds and
Manager Gears.
DISCUSSION
A general discussion took place over dinner which covered a range of
topics which are of mutual concefn to the two cities. The major
topic of discussion was the Trunk Highway 7 Corridor Study. It was
stressed by the Shorewood Councilmembers and Mayor that it is not
the intent of the City of Shorewood to reduce the number of access
points into Excelsior in order to force more business transactions in
Shorewood's shopping areas. It was stated that Shorewood's approach
in reviewing the Corridor Study alternatives would be to support the
direction that the other cities participating in the study wish to
take relative to the portion of the Corridor which lies in their
City. The proposed improvements to the Christmas Lake Road inter-
section and the County Road 19 stop light were also discussed. It
was found that the electric bill for operation of other stop lights
in Shorewood comes to approximately $40.00 per month. The Excelsior
City Council stated their appreciation for the opportunity to discuss
matters which are of mutual concern to the two communities. It was'
also stated that it was good to clear up any misconceptions which
have occured relative to the Corridor Study.

The regular meeting of the Shorewood City Council was called to
order at 7:30 P.M. Monday, December 8, 1986 in the Council
Chambers.
PLEDGE OF ALLEGIANCE AND PRAYER
Mayor Rascop opened the Regular Council Meeting with the Pledge
of Allegiance and a Prayer.
ROLL CALL
Present: Mayor Rascop, Councilmembers Gagne, Haugen, Shaw and
Stover.
Staff Attorney Froberg, Engdneer Norton, Administrator Vogt,
Planner Nielsen, and Clerk Kennelly.
APPROVAL OF MINUTES
Haugen moved, seconded by Gagne, to approve the minutes of the
Regular Council Meeting of November 24, 1986 to include corrections
on page 2, Motion carried 5 ayes.
MATTERS FROM THE FLOOR
Woodhaven Well Discussion
Mayor Rascop was informed on Thanksgiving morning at 6:30 A.M.
that the well was not functioning. Stan Anderson of Munitech
was present to explain the problem. The cause was a faulty valve
that caused the loss of our pressure in the water tank so no
water could be pumped to the house.
Chris pehle, of 22075 Stratford Place questioned the reasons why
the well has gone out 5 or more times in the past year. Stan
Anderson explained the various problems, none of which have been
major problems. But,each causes an immediate loss of water be-
cause the storage tank loses pressure immediately unlike the
tower type having gravity pressure. Anderson referred to the
main tenance procedures now being followed. This should help to
eliminate further break downs but there will always be some
problems that are inforseeable.
Colleen Brown questioned whether the design and capacity of the
system was adequate to service the existing homes and additional
homes.
Engineer Norton confirmed the proper design of this system and
that it could adequately service 169 homes. He also referred to
a letter confirming adequate fire protection capacity from the
former Fire Marshail Rand.

Rascop supported Munitech for their high level of service and their
quick response time. He indicated that a continuing schedule of
good maintenance should alleviate additional problemsandif design
is any part of the problem, in the future this will be corrected.
PLANNING COMMISSION REPORT
Stover referred to two of the issues on this agenda that had
been discussed at the last action meeting of the Planning
Commission. There is a scheduled Public Hearing to hear a
request to vacate a portion of Ferncroft Drive to Lake William
and a comprehensive plan and zoning amendment on Chaska
Road for the Excelsior Farm and Garden store. Both of these
requests wer~denied~pthe Planning Commission.
7:45 PUBLIC HEARIN~~~
Denial of a Vacation of a Portion.of Ferncroft Drive
RESOLUTION NO. 135-86
Mayor Rascop opened the Public Hearing at 7:56 P.M. for public
comment on the vacation of a portion of Ferncroft Drive.
Mark and Jack Swedlund presented there request to vacate a portion
of a "fire lane" at the end of Ferncroft Drive to add to their
subdivision in order to create an additional building lot.
Rascop closed the Public Hearing at 8:00 P.M. after asking for
public comment and receiving none.
Gagne moved, seconded by Stover, to deny the request for vacation
of the '~ire lane" as recommended by the Planning Commission and
a previous decision of the Council not to vacate. Motion carried
by Roll Call Vote - 5 ayes.
CONSENT AGENDA APPROVAL
Haugen moved, seconded by Gagne, to remove item A - Animal Control
Contract from the Consent Agenda.
Gagne moved, seconded by Haugen, to remove item D - Kenko Payment
Voucher from the consent agenda.
Stover moved, seconded by Rascop, to remove item H - Precinct
boundary change from the Consent Agenda.

Motion carried - 5 ayes.
Item D - Kenko Payment Voucher.
Gagne questioned whether the road repairs were done by Kenko or paid
for by Kenko relating to repairs that were needed to Covington Road and
done by the City. Engineer Norton'indicated that all costs will be
deducted from the payment.
Gagne moved, seconded by Haugen, to approve Payment Voucher No. 9
and Final, Project 84-5, to Kenko Inc. in the amount of $79,055.99
less previous costs to repair covIngton Road. Motion carried - 5 ayes.
Item H - Election Precinct Boundary change - Stover would like to
retain Precinct IV (Islands) and asked Clerk Kennelly what is nec-
essary to retain this precinct. Kennelly stated that the polling
place, a garage, is very difficult to heat and has had a great deal
of difficulty finding judges to work this precinct. If a new lo-
cation can be found and election judges can be obtained, the ballots
can be counted at another Precinct in the new scanning equipment.
This would require an additional set of prom packs to be installed
in the scanner after the counting procedure has been completed in
the precinct. The cost of the prom packs will be $450.00 additional.
Gagne moved, seconded by Stover, to retain Precinct IV without
scanning equipment and authorize the purchase of the additional
prom packs. Motion carried - 4 ayes, 1 naye (Shaw).
Item A - Animal Control Contract - Midwest Animal Control.
Stover would like the contract amended to require proof of ob-
taining a dog license prior to the dog returned to the owner.
Haugen moved, seconded by Shaw, to approve signing the contract as
amended, with Midwest Animal Control. Motion carried - 5 ayes.
CORRIDOR STUDY DISCUSSION
Rascop explained to the audience that the Corridor Study encom-
passes areas of Highway 7 from Highway 101 west past Highway 41.
This study has been divided into 4 areas of which staff & Council
have attended meetings on each of these areas as they affect
Shorewood. A special meeting with Excelsior Council prior to this
meeting to hear their concerns was held.
Planner Nielsen reviewed each area of the study and the recom-
mendations of BRW, the firm preparing this study, and
the recommendation the City supports. He pointed out the pro-
posals for the audience on an overhead projector and answered
residents questions as he reviewed each area. The proposals in-
clude expanding to 5 lanes, adding turn lanes, eliminating some
current accesses, adding service roads along the highway, redi-
rect traffic through existing roads to accesses and add lights at
County Road 19.

CORRIDOR STUDY DISCUSSION - cont.
The City questioned service roads that are proposed through areas
of great elevation changes, and will not support these proposals.
Bruce Benson of 5820 Christmas Lake Road submitted a letter and
petition signed by 100% of the residents on Christmas Lake Road
and Christmas Lane, requesting the culdesacing of these roads. The
land needed for the culdesac has been donated by Rodney Peterson.
The area residents are even willing to pay for the improvement.
$250,000 has been allocated for improvements to the Christmas Lake
intersection. The residents would like the city to approve the
culdesac prior to the improvements on the Christmas Lake Road and
Highway 7 improvements.
COUNCIL BREAK - 9:23 to 9:32
CONTINUATION OF CORRIDOR STUDY DISCUSSION
Rascop explained the reasons for MnDOT and the Metropolitan Council
requiring the corridor study at this time. Shorewood proposed a
new intersection with full access to the south and a new collector
street, Old Market Road, to alleviate the traffic problem at the
current intersection of Vine Hill Road. The cost would be borne
by the developer of Trivesco. Minnetonka was opposed to Shorewood's
proposal. BRW is now proposing a 1 million dollar bridge over
Highway 7 from Covington Road to St. Albans Bay Road. They do not
address any improvements to these roads. The proposal simply creates
a north/south flow of traffic leading through residential streets.
Mr. and Mrs. Buesgens, Betsy Robertson and Attorneys for Jim Pyle,
owner of the Skipperette, spoke in opposition of a new intersection.
They feel the intersection will cause additional accidents, addi-
tional traffic through Shady Hills, and will reduce business for
the commercial area. Andrew Schmidt of Video Update feels there
would be no decrease in business traffic with the new intersection
and new access road. He feels a safer intersection" and good service
road will create additional business traffic.
City recommendations are to be to the Metropolitan Council by
1/31/87, Metropolitan Council will then review and submit their
response to MnDOT. Council will act ona recommendation for Met
Council at the 2nd meeting in January.
OUNCIL BREAK - 10:25 to 10:20
XCELSIOR FARM & GARDEN STORE - PRELIMINARY APPLICATION FOR COMP
PLAN AMENDMENT
Mr. Dick Mattila of 6020 Chaska Road, and his Attorney Leroy Hauglund
asked the Council to consider a request to rezone his property to C-3
(Commercial) to allow the relocation of the Excelsior Farm and Garden
Store. Mr. Mattila's realtor, Ed Yaeger, indicated that the pro-
perty was for sale for 6 months and did not sell as a residential
site. They feel because of the R-C use next door and Highway 7
traffic, that this is not a good residential site. The current
zoning is R-2. This requ~st would require rezoning and a comp
plan amendment. Mr. Mattila felt he could get a petition from
neighbors to support his request.

EXCELSIOR FARM & GARDEN STORE - PRELIMINARY APPLICATION FOR COMP
PLAN AMENDMENT - cont.
Stover felt the R-C was a good buffer between commercial and
residential, but the request is not allowed in the R-C zone.
Gagne felt this location was a poor location for residential.
Shaw felt this request could be a reasonable use. Council in-
dicated that he could return to the Council with a formal ap-
plication for rezoning accompanied by a petition from the neighbors.
WILD DUCK 2ND ADDITION - OUTLOT A DISCUSSION
Jim Dutcher asked the Council what can be done to his Outlot A
at the end of Wedgewood Road. He reviewed the history of his 2
family development in that area. Haugen referred to a document
that prohibited any structures, topography changes or use for
parking. This document was not filed with the subdivision as
agreed upon when the 2-family density was allowed. The Council
will support this easement even .hough it was not filed.
Dutcher has been asked by Tonka Bay for a portion of this pro-
perty to use as additional park land. The Council has no ob-
jection to that use.
GWK ADDITION - FINAL PLAT
RESOLUTION NO. 136-86
Torn Wickenheiser submitted a final plat for approval containing
2 lots on Yellowstone Trail with an Outlot with access to Wiltsey
Lane. This would allow further development at a later date.
Gagne moved, seconded by Stover, to approve the final plat subject
to the planners recommendation. Motion carried by Roll Call Vote -
5 ayes.
CURFEW ORDINANCE - 3RD READING
Stover began the discussion supporting the past amendment and
sees the need for uniform curfew times to be set for the sur-
rounding cities. But she feels the time limitations are the
only restriction needed for a curfew Ordinance. Possible ju-
venile problems should be handled outside of this Ordinance.
Council feels the City Attorney should draft a curfew Ordinance
instead of the Police Department.
Gagne moved, seconded by Rascop, to accept the 3rd reading and
adopt the Curfew Ordinance. Adoption denied 1 aye Gagne to 4 nayes.
PLANNERS REPORT
City Hall/Badger Park Concept Plan Review
Planner Nielsen submitted a plan showing added landscaping, park-
ing lots with stripes, opaque screening of tennis courts, berms
to screen off City Building from residential views, walk way
addition to City Hall and many other suggestions. He noted many
current non-compliance s to the City Ordinances such as setbacks,
metal buildings, outdoo~ storage, curbs and parking lot striping.
The issue of cost of landscaping and possible relocation of the
Public Works Department was discussed.
Council thanked Nielsen for the presentation and all the work
done on it.

PLANNERS REPORT - cont.
Near Mountain P.U.D. Status Report
The 10th Addition will be submitted in January for approval. In
February they will be submitting plans for the SE corner of the
property. These plans will be changed from townhouses to single
family homes, with a reduction of 30 units.
New Planning Commission Member
Mr. John Annin of 20885 Radisson Inn Road has expressed his in-
terest in the vacancy on the Planning Commission. Council di-
rected a letter to be sent to him thanking him for his interest
and inform him that applications are still being accepted.
ATTORNEYS REPORT
Prosecution Matters
Froberg reported that the Gray sodomy case was dismissed declaring
.
the State sodomy law unconstitutional according to Hennepin County
District Court. The Minnesota Attorney Generals Office is filing
an appeal to the Supreme Court. They will be doing the prosecution.
The City Attorney will no longer have to be involved unless appeal
is won.
LMCD Grant Loan Agreements RESOLUTION NO. 137-86
Attorney Froberg submitted two loan agreements between the
Metropolitan Council and the City of Shorewood, and, the LMCD
and the City of Shorewood.
Gagne moved, seconded by Haugen, to accept the agreements as
submitted and authorize the signature on the agreements by the
Mayor. Motion carried by Roll Call Vote - 5 ayes.
ADMINISTRATIVE REPORTS
Budget Amendments - (Computer Purchases)
The staff has proposed to purchase an IBM AT system, monochrome
display, dot matrix printer for the Finance Department at an
estimate cost of $6,000.00. Also a typewriter is needed for
the front desk. Cost is estimated to be $700.00 to be charged
to the General Government Services Department. Funds for
these purchases are available in the 1986 budget from interest
expense not being used inthe General Fund.
Planning and Zoning would like to purchase an IBM XT system,
monochrome display, letter quality printer and hardware. The
revenues are available in the overage from the building permit
revenues, estimated cost of $4,500.00.
Haugen moved, seconded by Gagne, to approve the above purchase
requests and approve the budget amendments as stated. Motion
carried - 5 ayes.
Sewer/Water Budget
Council reviewed the SewerjWater budget for 1987 within a memo
dated December 4, 1986 from Administrator Vogt.
Haugen moved, seconded by Gagne, to accept the Sewer/Water budget
as submitted. Motion carried - 5 ayes.

Stover moved, seconded by Gagne, to have staff do a rate study
and return to Council by June 1, 1986.
Union Update
Vogt stated that he is still opposing the higher salary for
sewer line cleaning. Haugen indicated that private industry
is cutting back on medical benefit coverage.
Shady Hills Back-Up
The sewer back-up damage to two residents of Shady Hills has been
covered by the City insurance carrier.
Conrad Schmid Retirement Party
There will be a retirement party for Conrad Schmid, 9 year member
of the Park Commission. It will be held on December 15, 1986 at
the American Legion.
MAYORS REPORT
There will be a luncheon held on December 19, 1986 at 12:30 by the
Hennepin County Board regarding recycling. Vogt will be attending.
COUNCIL REPORTS
Christmas Lake Road petition
Stover moved, seconded by Haugen, to direct the staff to complete
a report on Christmas Lake Road dead end request including rec-
commendation from Police and Fire Departments. Motion carried -
5 ayes.

on the Council.

Covington Vine Ridge
I have attached a letter from United Mortgage Corporation regarding a further
reduction in the Letter of Credit for Covington Vine Ridge.
Staff has discussed this request and is in agreement with it. Work has been
completed to our satisfaction and lein waivers received. The remaining amount
of Letter of Credit will cover the remainder of the work to be completed by
150%.
Based upon the validity of the request and staff review, it is the recommendation
of staff to pass a resolution approving the reduction in the Letter of Credit
provided by United Mortgage Corporation to a new total Letter of Credit amount
of $29,000 as requested.
This item appears on the consent agenda of your October 14 meeting for your
consideration.

Site grading, utilities and street construction have been completed at the
subject project, with the exception of the wearing course which is scheduled
for summer of 1987.
Enebak Construction Company has submitted a copy of a lien waiver to the
City of Shorewood in the amount of $48,000 for street and utilities
construction. The bid price for the wearing course is $18,848. Therefore, we
request, on behalf of United Mortgage Corporation, that the letter of credit be
reduced to $29,000.

The residents and neighbors of Christmas Lake Road
(
are opposed to the upgrading of the Highway 7/Christmas
Lake Road intersection. We agree that there is a safety
problem at the intersection. However, we are also extremely
concerned for the safety of Christmas Lake Road residents
and users.
Christmas Lake Road is a neighborhood consisting
of approximately 34 families with an estimated 30 children
under age 18. Our street is a typical residential road.
With the view of the lake from the road, it is very common
.
to see bikers, walkers, joggers, and young families with
strollers enjoying a unique and safe outing. Additionally,
as part of the road runs between the lake and the homes,
families are constantly crossing on their way to the water.
In short, the road is a residential street with no side-
walks, poor sightlines due to hills and bends, and in many
places just enough room for two cars to pass. Increased
traffic would create many problems.
It is only logical that an easy access left turn
lane onto Christmas Lake Road at westbound T.H. 7 will
create a re-route for people who wish to avoid Excelsior's
five stop intersection and to go south into Chanhassen.
This coupled with Excelsior's assumed resistance to up-
grading the County Road 82 access to and from T.H. 7 and
the increased eastbound traffic from the increasing density
of Chanhassen will insure Christmas Lake Road as a thorough-
fare.

Road 82 and Christmas Lane and the speed limit are not

being enforced. The increased traffic from additional
developement to the South will only increase the potenti~l
number of violators.
As it exists, the intersection is very poorly planned
at T.H. 7. This area is geographically the narrowest
portion of the corridor, approximately 400'from Lake
Minnetonka to the North and 400' from Christmas Lake to
the South. We realize that something must be done to
upgrade T.H. 7 but we call on all surrounding communities
~
to help solve this problem.
The above concerns have led us to propose a necessary
dead ending of Christmas Lake Road at Christmas Lane. This
will be accomplished by using a land donation from the
Rodney Petersons~ A crash gate, similar to the type pro-
posed at Amesbury Development in Shorewood would facilitate
emergency vehicles. A cul-de-sac would be installed to
accomodate the city's maintanance equipment. This would
result in routing traffic through Excelsior or along Third
Avenue. Third Avenue has recently been improved and can
easily handle additional traffic as most of the traffic
from the intersection is going to the ~apartments located
along it.
We know that our road and Christmas Lake have been on
your agenda quite frequently lately. This is a very big
concern for us and we appreciate and thank you for your
attention to this matter.

BACKGROUND
Mr. David Albrecht has requested approval of a simple subdivision for property
owned by him and Barbara Albrecht. The property is located at 5860 Eureka Road
(see Site Location map - Exhibit A, attached). As shown on Exhibit B, Mr. Albrecht
proposes to divide the site into two lots.
The subject property is currently zoned R-1A, Single-family Residential and is
occupied by a single-family home and detached garage. Surrounding land use and
zoning are as follows:
North, east
and south: Single-family residential, zoned R-1A
West: Freeman Park, zoned R-1C
ISSUES AND ANALYSIS
In evaluating the applicant's request, the following issues should be considered:
A. Lot Sizes. The table below shows how the proposed lots conform to the
requirements of the R-IA zoning district.

B. Required Setbacks. The existing buildings on Lot B exceed the minimum
required setbacks of the R-1A District.
C. Street Ri~ht-of-Way. Since Shorewood's Subdivision Ordinance requires streets
to be a minimum of 50 feet in width and Eureka Road is only 33 feet, it is
considered substandard by today's standards. As-in past similar subdivision
requests, it is recommended that the applicant be required to dedicate
additional r.o.w. Since the existing r.o.w. is 17 feet too narrow, it is
suggested that 8.5 feet be dedicated from the subject site. An additional
8.5 feet will need to be acquired by the City from the east side of the
street at some future date.
While this will reduce the sizes of Lots A and B by 4946.4 square feet and
7032.6 square feet, respectively, they will both still exceed the minimum
size requirements for the R-1A District.
D. Easements. Pursuant to Section V.B.1. of the Shorewood Subdivision Ordinance,
the applicant should provide drainage and utility easements, 10 feet on each
side of all side and rear lot lines for both lots. These easements should
be prepared by his attorney and reviewed by the City Attorney.
E. Park Dedication. The Subdivision Ordinance requires that park dedication
fees ($500 per lot) be paid when land is subdivided. Since credit is allowed
for the lot with the house on it, only $500 must be paid.
RECOMMENDATION
Given the compliance of the proposed lots with Shorewood's zoning and subdivision
requirements, it is suggested that the applicant's request be approved contingent
upon the following:
1. The applicant must convey 8.5 feet of street r.o.w. across both lots.
2. The applicant must provide drainage and utility easements 10 feet on each
side of all side and rear lot lines for both lots.
3. A park dedication fee of $500 must be paid prior to release of the Council
resolution approving the division.
4. The applicant must submit a title opinion (up-to-date within 30 days) for
review by the City Attorney.
5. The applicant must provide new legal descriptions for the two new lots and
the required street r.o.w.
6. The above-mentioned must be completed within 30 days of the Council's approval
of the request. Once the applicant has received the resolution approving the
division, he must record it within 30 days.

BACKGROUND
Mr. Robert Norenberg has submitted plans for an addition to the house located
at 27470 Pine Bend (See Site Location map - Exhibit A, attached). As can be
seen on Exhibit B, the applicant proposes to extend the east end of the house,
32.5 feet along the building line which currently exists. Since the house is
19 feet too close to the r.o.w. of Pine Bend, a variance of 19 feet is required
for the addition.
The property is located in the R-1A, Single-family Residential District.
Required setbacks are 50 feet in front, 50 feet in the rear, 10 feet on the side
and 50 feet on a side yard abutting a street. The existing house meets all of
these requirements except the side yard abutting a street, which in this case is
only 31 feet.
Based on the information available the existing house appears to contain approx-
imately 3000 square feet of gross floor area. The proposed addition, which
contains a walk-in closet for an existing bedroom, two bedrooms, a bathroom,
basement area and one additional garage space, will increase the gross floor
area by 912 square feet.
ANALYSIS/RECOMMENDATION
It is important to point out that there is 20 feet of buildable area on the south
.side of the house. While the house could be expanded in that direction, the
addition would not relate very well to the existing floor plan. Besides that
there are three factors which tend to support a variance in this case. First,
the configuration of the lot is r~latively narrow, especially for a corner lot.
Typically, corner lots should be wider, to accommodate the increased side yard
setback abutting the street.

Secondly, the proposed addition is basically in line with a recent addition built
by the property owner to the east of the subject site. He was granted a variance
pursuant to the section of the Zoning Ordinance whiE:h allows a lesser setback
where adjoining structures are closer to the street than otherwise allowed.
Finally, if the addition were built within the required setback area, it would
likely have a detrimental affect on the 'house located immediately to the south
of the subject site. The two houses would only be 15 feet apart.
In view of the preceding analysis, it is suggested that the variance be favorably
considered. However, so that the applicant is not given a special privilege not
enjoyed by others in the zoning district (see Section 200.05 Subd. 2b.(4)), it
is recommended that the Council resolution approving the request should specifically
state that no future construction will occur within the 20 foot buildable area
on the south side of the lot. In essence this will ensure that the front yard
setback discrepancy will be made up and that the appropriate amount of open
space is maintained on the lot.

Mr. James Funk, representing Sungold Homes, Inc. has requested a house moving
permit to locate a manufactured home at 6115 Riviera Lane (see Site Location map -
Exhibit A, attached). The building, shown in Exhibits Band C, will be moved in
in two parts and placed on a permanent concrete block foundation. The proposed
house requires a house moving permit pursuant to Shorewood Ordinance No. 143.
Following is how the house complies with Shorewood's ordinances:
A. Zoning Requirements. The property in question is zoned R-1A, Single-family
residential.
1. Lot Size and Setbacks. The property in question measures 140' x 377.5'
and contains 52,850 square feet of area. The proposed house is to be located
as shown on Exhibit D. The house will be set back 240 feet from Riviera Lane.
All other setbacks greatly exceed R-1A requirements. A detached two-car
garage will be located forward of the house, approximately 168 feet from
the street.
2. Building Construction Requirements. Section 200.03 Subd. 7b of the
Zoning Ordinance contains requirements for residential dwellings.
a. The house will be constructed on a permanent concrete block foundation.
The house has a full basement.
b. The house measures 27.3' x 52' and contains 1420 square feet of area
on the main floor.
c. Proposed roofing consists of asphalt shingles.
d. The applicant has applied for a building permit. The proposed house
complies with State Building Code requirements.

B. Other Requirements.
1. Application fees are to be paid prior to issuance of the building permit.
2. Ea€h half of the proposed structure is 14 feetwidg and approximately the
same length ~s a semitrailer.
3. The structure is brand new and will display the required HUD seal certifying
that it complies with manufactured housing requirements.
4. The proposed mover is bonded and licensed by the state.
5. The proposed structure complies with all state and local code requirements.
The applicant proposes to move the structure the week after the Council meeting on
26 January. They are open to whatever time of day the City may suggest.
They propose to bring the structure up from Highway 41 to the service road north of
Highway 7, then west to Lake Linden Drive, north to Yellowstone Trail, west to
Riviera Lane and south to the subject site. Prior to the move the City Engineer
and the Chief of Police must approve the proposed route. The structure weighs
approximately nine tons with a weight per axle of 4420 pounds (approximately 2 tons
per axle).
When the applicant submitted the required information for his permit I erroneously
told him that the permit was only subject to Council review dnd approval. Upon
preparation of this report I discovered that the Planning Co~ission must also
review the application. While the application has now been scheduled for their
review on 20 January, the applicant has arranged for his subcontractors to begin
work after the Council meeting on 12 January. Feeling that the applicant should
not have to suffer for my mistake, I propose to issue an excavation and foundation
permit on Tuesday, unless the Council has objection. The actual moving permit
could either be approved subject to Planning Commission recommendation or come back
to the Council on 26 January.

I have been a resident of the City of Shorewood since 1983 and a
resident of the area since 1979. Although I am not an active
real estate investor, we own our family home in Shorewood and I
am sincerely interested in the planned and orderly development
of our city.
Personally, I am married, with three college-age children and hold
engineering degrees in mechanical and agricultural engineering from
the University of Wisconsin. I have been employed by Farmhand, Inc.
since 1963. I have held a variety of engineering and manufacturing
positions with Farmhand and have been Vice President of Operations
since 1983. Our corporate offices are in the former Minnetonka
West Junior High School Building.

This letter is in response to the position that is open on the City
Planning Commission. I am very interested in the position, and believe
I have the ability neccessary to fill that opening.
I was born and raised in the lake area, so I have great concerns for
the future of our city. My husband and I have recently purchased a
home on Shady Hills Road, which is adjacent to the Waterford building
site. This was the first of many interest~ and concerns that got me
started on the way to improving my insights into our cities future.
I have frequented the city council meetings overthe last several months,
and have had the privilege of meeting you and all of the council
members, including the City Administrator, City Planner, City Engineer,
and the City Attorney. I felt this was in my best interest, as I am
aware the planning commission works closely with all of you, since it
is strickly advisory in nature, and all final decisions are made by the
city council.
I fe~l I have a good understanding of the basic planning and zoning
principles of our city and I am continuing my research, as there is so
much for me to learn about Shore wood as a developing community. I have
followed closely with the Hwy 7 corridor study-which I found to be
exttemely interesting, and have great concerns for all involved. If I
were to obtain the position on the planning commission, I would try to
make the best decisions possible, based on the zoning ordinances and
comprehensive plan for the good of the entire city, not just one or two
neighborhoods. These decisions would be based solely on facts and not
personal opinions.
I will close by asking you to give my application serious consideration
and please contact me if you have any comments or questions regarding my
application. I would be happy to discuss the position with you during
an interview if you feel it neccessary.

As you know, we have been working hard to bring exciting NBA
Basketball back to Minnesota. It has been 26 years since the
Lakers left, and our chances are excellent for an NBA franchise
to be awa~ded April 20, 1987, when the league has committed to
announce expansion sites.
In order to maximize the input of our fans, we have had a
"Name The Team" contest which ended December 15. After only one
advertisement, we received suggestions from over 5,500 people!
We have decided upon two finalists, and want to ask for your help
in choosing the eventual team name. We see your council and the
other city councils throughout Minnesota as representatives of
all parts of our state. Each council has one vote, and we hope
that you will consider the two name alternatives and write us
with your choice at the address above by January ~~. The majority
will rule, and the choice of the most city councils will be our
NBA team name.

marketable, consider the personality of our state and its people,

PROPOSED CLOSING - CHRISTMAS LAKE ROAD
At the 8 December Council meeting, residents on the west side of Christmas Lake
presented a petition requesting that a cul-de-sac be constructed on Christmas Lane,
approximately midway between Christmas Lake Road and Mill Street (County Road 82).
The purpose of the request is to discontinue through traffic along Christmas Lane
and Christmas Lake Road. Residents in the area have historically complained that
the route is used as a shortcut between Mill Street and State Highway 7 by nonlocal
traffic. The Council has referred the request to the staff for review and comment.
While the staff understands that the Council is under tremendous political pressure
to close off Christmas Lake Road, we simply cannot recommend in favor of this
proposa~. Shorewood's Subdivision Ordinance provides design criteria for public
streets. Section V.A.9. limits the length of cul-de-sac streets to 2000 feet.
This has been noted as being far too liberal. Proper planning and engineering
typically dictates a maximum length of 500 feet for cul-de-sac streets. The
proposed Subdivision Ordinance recognizes Shorewood's larger lot sizes and provides
for a 700 foot limit. As a matter of policy this has been what has been enforced.
Cutting off Christmas Lake Road as proposed would result in a cul-de-sac street
3600 feet long - over three fifths of a mile.
Given Shorewood's geographic features it must be realized that we will likely
always have more cul-de-sac streets than other communities. There are several
reasons, however, why the City should concern itself with the length of such streets.
1. Even if a gate is installed and keys are given to the police and fire departments,
response time for emergency vehicles will increase. Presumeably ambulances
would be limited to one access unless the police arrived first. Police and fire
department concerns will be addressed in separate memorandums from those agencies.
Concern has also been raised relative to the reliability of a gate. (e.g. frozen
locks, etc.).

2. Jim Schmidt, Minnetonka School District, informs us that elementary school
children will have to walk to either Mill Street or Third Avenue for bus
service. Apparently children in the upper grades already do this.
While closing the street to through traffic will reduce the number of cars
traveling Christmas Lake Road it will not eliminate traffic. There will still
be approximately 30 properties using the street - all at one end. The concern
here is that the increased walk for elementary school children will simply
increase the exposure to traffic for many.
3. Harry Drahos, Excelsior Postmaster, has stated that from a mail delivery
perspective, they would prefer not to have to retrace their route, particularly
on so long a deadend. Obviously, this would increase their time and expense.
4. Snowplowing time and expense will increase. While this can be said of any
cul-de-sac street, the necessary cleanup to keep the gate operable year round
will take considerably more time than an average cul-de-sac.
5. The staff is very concerned about the precedent which will be established for
future requests. There have always been, and likely always will be, requests
to close off streets. We will be reviewing such a request for Beverly Drive
and Cajed Lane at the next meeting. It is important to realize that when streets
are closed off, it generally puts more pressure on other streets.
While complaints relative to shortcutting were reduced considerably when turning
movements were restricted at the Mill Street intersection, the staff recognizes
that problems still exist. It is apparent that the route is so desireable that
northbound cars on Mill Street will actually make U-turns and come back to turn
left onto Christmas Lane. Cars coming down Christmas Lake Road make similar
U-turns to get southbound on Mill Street. Complaints have also been received
that northbound cars on Mill Street will make right turns onto Christmas Lane
despite signage and posts which have been installed to discourage such movements.
In view of the preceding the staff recommends an alternative to closing the
street. It is proposed that the intersection at Mill Street be redesigned as a
northbound outlet only. The turning lane from Christmas Lane to northbound
Mill Street would be narrowed to a single lane at such an angle that the right
turn from northbound Mill Street onto Christmas Lane would be physically impos-
sible. This would be accomplished by the construction of permanent paving and
curbing instead of temporary wooden posts. If this does not completely resolve
the problem, "No U-turn" signs could be placed on southbound Mill Street.
While this will admittedly inconvenience some residents on the west side of
Christmas LaKe, it will be no more so than closing off the street, and the
safety concerns will have been addressed.

Christmas Lane Cul-de-sac
I have reviewed the request from the neighbors and residents of
the Christmas Lake Road area for a cul-de-sac on Christmas Lane.
The purpose is to prevent through traffic on Christmas Lane and
Christmas Lake Road.
I take great exception to the statement that "At present the
making of illegal left turns at County Road 82 and Christmas Lane
and the speed limit are not being enforced." I have certainly
had no requests for information on enforcement of the mentioned
violations. Since I am the only source of such information that
I am aware of~ the statement must be based on unsubstantiated
perceptions of the writer.
I can assure you that citations~ and warnings where appropriate,
are issued for violations of traffic laws at this location in the
same manner and with the same consistency as with any other like
traffic laws anywhere in the City of Shorewood.
The only real concern I have with the proposal is the access for
emergency vehicles. There is reference to a "crash gate". I am
unfamiliar with such a device and therefore can not adequately
assess what effect it would have on emergency vehicle access.
Without knowing the effect on emergency vehicle access, I have to
oppose the plan as submitted.

Dear Brad:
I have discussed with Chief Doug Sweeney the proposed street
closure of Christmas Lane near Brand Circle. The intent of a
barrier to eliminate through traffic on Christmas Lane and
Christmas Lake Road could have a direct negative affect on the
Excelsior Fire Department when responding to emergencies in the
mentioned area.
As a result of a street barrier, travel distance to south end of
Christmas Lake Road would be increased resulting in an increased
response time. With there not being a municipal water system
with fire hydrants serving residents in the mentioned area, the
Fire Department needs to use water tankers to shuttle water supply
to the fire for fire suppression. As a result, the route to the
nearest water supply for re-filling tankers shuttling water to
fires on the south end of Christmas Lake Road would be increased.
If adequate water supply is not readily available the life safety
of residents and firefighters could be affected or additional
structural damage could result.
The road closure would also not allow the Fire Department two
separate means of ingress to the area in the occurance of a road
. closure due to fallen trees or washed-out roadways as a result of
a storm.
Please contact me if you have any questions or if you would like
a representative from the Fire Department to attend the Council
meeting when this is discussed.

Dear Dan,
Please transmit this to the city council as our request for
reappointment as the city's official publ ication.
Our rate for 1987 will be 35 cents per line for first and subsequent
insertions. Deadl ine will continue to be Monday for publ ication on
Thursday. Legal notices will be publ ished in both editions, with a
total circulation of 20,000 each week. Price includes mailed return
of a signed affidavit of publ ication and as many tearsheets as the
city requ ires.
In the past year, we have added several distribution spots in
Shorewood, including the American Legion and Arnold's. Circu-
lation also continues to grow steadily at Shorewood Shopping
Center, Burger King and the municipal I iquor store at Vine
Hill Rd. It is also apparent that Shorewood residents increas-
ingly look to the South Shore Weekly News for official news
about the city.
It has been a pleasure for our staff to work with the city as
it grows and expands. We look forward to continuing that
relationship in 1987. A representative of the newspaper will
be on hand for the organizational meeting on January 12.
