Chairman Jakel called the meeting to order at 7:05 PM.
ROLL CALL
Present: Chairman Jakel, Commissioners Lindstrom, Andrus, Christensen, and
Laberee; Council Liaison Brancel and park Assistant Niccum
Absent: Commissioners Vogel and Nicol (both informed me ahead of time)
APPROVAL OF MINUTES
Christensen moved, Andrus seconded, to approve the minutes of June 1, 1987, as
written. Motion carried unanimously.
CATHCART PARK - ROAD PROPOSAL
Mr. Gary D. Carlson approached the Commission to see if they are interested in
putting in a road on the south side of Cathcart Park. He said he could not
guarantee what people would put in their backyards facing the park-sheds, fences,
etc., and asked which the Commission would prefer, having backyards facing their
park, or a road as a buffer? The City would be expected to share the road cost.
The opinion of the Commission was that there are already roads on three sides of
the park, a forth road is not necessary.
Mr. Carlson then said he would be willing to sell his 9+ acres of property for
the assessed valuation of $170,000 to the City for additional parkland. The
Commission thanked him for his input. They declined his offer and suggested he
continue dealing with the City of Chanhassen as long as the property is in their
City.
CATHCART PARK - POWER POLES
When Gary Carlson was present, he also suggested that the City contact the power
company and have them pick up the power poles stored behind the Cathcart tennis
courts. He felt the creosote was dangerous. He thought the power company would
pick them up and replace them with newer poles that do not contain creosote if
requested to do so. The Commission asked staff to check with Public Works Director
Zdrazil to get his opinion.

Commissioner Lindstrom talked to Ted Lepowsky about the plans.

FREEMAN PARK SIGNS
MnDOT Signs
The Commission was pleased with Administrator Vogt's suggestion to have MnDOT
put brown signs with white lettering reading "FREEMAN PARK" and an arrow facing
traffic in both directions on the r.o.w. They are in full agreement and thank
him for his suggestion.
Signs on Little League Field
Park Assistant Niccum is in the process of getting bids. One has been received
from Moore Sign Company to repaint the scoreboard and put 3 sheets of duraply
over the existing "Welcome to South Tonka Little League". They would paint
"Welcome to Freeman Park - City of Shorewood" on the duraply in their shop,
then install it at the field. Their cost would be $1200.
FREEMAN PARK FILL
The Commission discussed the placement of the fill in Freeman Park. Commissioner
Laberee asked to see the grading plan done by OSM. He went over it with the
Commission, showing them where fill would be added and where it would be removed.
Chairman Jakel mentioned that he had been out there. He said there appears to
be some debris but that they did a nice job of leveling it. Council Liaison
Brancel said she had been told by the Administrator and Engineer that the debris
would be buried when the final grading is done.
FREEMAN PARK MASTER PLAN
During the grading discussion an idea that had cropped up before, that of moving
the southernmost ballfield and relocating the parking lot, was reviewed. The
Commission then reviewed the master plan. The possibility of having all the ball-
fields in one area was discussed. It was felt that this could save on fencing
and expenses by using on fence for two fields, plus locating all "like" activities
in one area. The possibility of a mud problem caused by the central location
of the rinks in a heavy traffic area was brought up by Commissioner Laberee.
The Commission asked staff to send them copies of the master plan so they could
cut out the various athletic facilities and parking lot and try to come up with
alternative suggestions in time for the next meeting (7/6/87).
CATHCART PARK - PARKING/TRASH PROBLEM
Staff reported the following steps have been taken:
1. Letter to Little League requesting them to ask their coaches to discuss
the trash and parking with the kids and their parents.
2. Phone call to Mr. Roberts of the Soccer League requesting them to ask their
coaches to discuss the trash and parking with the kids and their parents.
3. Request to Don to empty barrel (done).
4. Return call to resident explaining what's been done.

MANOR PARK - PLAYGROUND/VOLLEYBALL COURT
Park Assistant Niccum reviewed the comments received so far from various contractors.
C. G. Braun and LanDeCon will be submitting estimates. She will continue to work
on this. Commmissioner Laberee said he thought, considering the soil type at
Manor Park, that drainage tile running toward the pond should be put in or there
could be a water retention problem in the sand.
MANOR PARK - BALLFIELD
Due to extreme heat and lack of rain, only about 10% of the seed planted is growing.
A lot if it has died. The Commission suggests it be cut starting now. They also
suggest that in August possible the crew can loosen up the soil and plant more
seed. They will discuss this in more detail at a later meeting.
CATHCART PARK - PARKING LOT
The Commission discussed the proposed parking lot location in Cathcart Park.
They are considering the idea of moving the ballpark and putting a parking lot
in the northeastern area of the park with the entrance on West 62nd Street.
They also discussed eventually putting in a warming house similar to the one going
up in Manor, with the warming house convenient to the rinks and the pavilion conven-
ient to serve as shelter for sports spectators.
MATrERS FROM THE FLOOR
Cathcart Park - Basketball Court
Council agreed to have the work done on the Cathcart basketball court for $1,270.
The court will have a 2" mat.
Freeman Park - Eureka Entrance
Administrator Vogt is sending a letter to Engineer Norton regarding surveying
to determine the setback for the gate and road.
Harvey Strom of "Country Signs" had dropped off
three sample post tops for the Commission's
consideration. They looked them over and
chose the cut at the right.
Freeman Park - Trees
The Commission asked if the trees had been removed. Niccum replied no, that
all the fill is done and none was dumped in that area. Because of this it is
not the high priority item it was, Staff would prefer to wait because they want
to see II some of the trees can be transplanted, also if any trees should remain
in the park if they do not interfere with the athletic areas. They can be cut
and fill dumped on top at the time of final grading. Commissioner Laberee said
the trees are Ash and cutting them off and covering them may not be thebe~t
thing to do because they are tough and could send up shoots and regrow.. He
said taking roots and all out with a backhoe would be a better way to do it.

Silverwood Park - Grading Plan
Staff reported the grading plan is done and calls for 20,000 cubic yards of
till.
Laberee moved, Andrus seconded, to recommend to Council that they direct Staff
to take any and all clean fill up to 20,000 cubic yards for use in Silverwood
Park. Motion carried unanimously.
Crescent Beach
Council Liaison Brancel reported she had spent a lot of time at Crescent Beach
last weekend. She brought up the following issues:
- The weed problem is really bad, up to 4 feet of floating weeds. She asked
who cleaned the beach. Niccum replied that Shorewood and Tonka Bay crews
alternate maintenance every morning, but not on weekends. Brancel asked if
the lifeguards are responsible for keeping it clean on weekends.
- 3 caps are missing off the dock.
- A lifeguard was sitting in a lawn chair on the dock with her back to some
swimmers.
- Why does the lifeguard blow her whistle and call everyone out of the water?
- The lifeguard told someone on a floatation device that was outside beach limits
and had not entered from the beach that they were breaking an Ordinance. Why?
Staff will research above.

When Gary Carlson was present he mentioned having power poles stored behind
the Cathcart tennis courts picked up by the power company. He felt the creosote
was dangerous to children.
Staff asked me to check with Public Works Director Zdrazil. He said we can't
ask them to pick them up becuase we got them from the power company in the
first place. He said he doesn't have any use for them right now but feels
they can use them in the future.
FREEMAN PARK MASTER PLAN
Maps were sent to the Park Commission on Tuesday, June 16, 1987. Park
Commission - please have your suggestions ready for the next meeting.
CRESCENT BEACH
I talked to Julie Light of Community Services regarding the beach questions
raised in the minutes:
Julie said it is the lifeguard's job to clean up weeds on weekends, however,
they are not supposed to do this if anyone is in the water. She will instruct
them to come 10 minutes early and call everyone out of the water while they
clean the beach. The fact that they start at noon, and it's been so hot
that the beach has been really crowded when they arrive has caused the problem.
Also, there was a substitute on duty that Saturday, that person was not as
familiar with various procedures. .
There is a lifeguard meeting coming up and Julie will go over everything
we discussed with the lifeguards.
Light informed me that when someone is close to the beach on a floatation
device the lifeguards are instructed to inform them that floatation devices
are allowed on part of Excelsior beach and to suggest they go over there.

CRESCENT BEACH - CONTIBUIID
Light also said when a beach is in a residential area, they have to be
concerned with people abusing the use of private property next to the
beaches. She also said if one person is using a floatation device right
outside the beach area, it can encourage other people to do the same, if
there were several people outside the actual beach limits on these devices,
it would end up with the lifeguard guarding half the lake.
The guards are taught to do drills. They blow their whistle and call every-
one out of the water for 5 minutes. This allows families to reunite, mothers
to keep track of their children, and mothers and lifeguards to take a restroom
break. They are encouraged to do these drills when the weather is hot and
the beach is crowded, maybe 5-6 times a day, if the weather is coller and
there are only a few people, they may not be necessary at all.
Light felt it would probably be impossible, too dangerous, to screen off
the weeds. She suggested I check with the DNR.
I talked to Howard Krosch at the DNR about the weed problem and whether it
is possible to screen off the area in any way. He said the main problem
with weeds right now is a weed called "Curly Leaf Pond Weed". It has a
short life cycle, then it dies. He said the season should be over in about
1-2 weeks.
Regarding screening of the beach, he told me that the "Hennepin County Park
Reserve District" has closed off a couple beaches. They have used a very
expensive process, using oil spill screen and having it custom made. The
reason in their case was to prevent "swimmer's itch". He did suggest a
inexpensive method of control that their rules allow. That is taking 3'
lengths of cheap plastic, draping them over the buoy ropes, weighting them
with light chain or bolts, and stapling them to the ropes. They do not
have to go all the way to the bottom, in fact they prefer that they don't.
I informed Julie Light of this conversation. She will have her lifeguards
keep an eye on the weed situation and keep me informed. I will report on
this at the July 7th meeting.

NONCONFORMING STRUCTURE
Eric Danser - 21640 Lilac Lane
In April of 1987 Mr. Danser was found to be constructing a screen porch onto the deck
located on the south end (front) of his home without having applied for a building
permit. Tbe construction encroaches into the front yard setback (50 feet) of his
property which is located in the R-1A zoning district. Mr. Danser is requesting a 13.4
foot front yard variance to allow him to complete the porch.
Staff analysis of the request shows that the variance does not appear justified based on
criteria provided in the Zoning Ordinance.

Schultz said he finds it hard to believe that with all the information circulated about
building regulations (e.g. City newsletter. etc.). that anyone would be ignorant of the
laws. He said that with all of the buildable area on Mr. Danser's property. a variance
for the requested location does not seem justified.
Benson said he feels the setbacks across the street in Chanhassen being less should lend
room for negotiation. although rezoning the area seems too severe.
Leslie asked if there have been any other cases where increasing the nonconformity was
granted. Planner Nielsen said John Hodgdon was allowed to increase a nonconformity with
his garage setback. but he also removed two more nonconforming structures from his
property.
Leslie said she doesn't feel that allowing the porch to be built on the front of the
house would do anyone any harm. but: she said she is concerned about setting precedence.
Mr. Danser said that finances are also a hardship for him.

BRENTRIDGE - RECONSIDERATION OF REZONING AND PRELIMINARY PLAT
Dave Johnson - 25.9 acres. approx. 150 feet east of Howards Point Road and 250 feet north
of Smithtown Road
Mr. Dave Johnson (developer of Shorewood Oaks) has taken assignment of the Brentridge
development from United Mortgage Corporation. The plat as presented by United Mortgage
for a 26 lot subdivision was denied by the City Council. Mr. Johnson requested that the
Council postpone acceptance of the Findings of Facts in order to allow him to represent a
revised plat for reconsideration.
Chair Watten re-opened the public hearing at 7:55 P.M. at the recommendation of Planner
Nielsen.
Planner Nielsen gave a review of the presentation to date.
submitted a 24 lot preliminary plat. The lots average 155
square feet in area on the west side of the proposed road.
He said that Mr. Johnson has
feet in width and 26.339
Mr. Johnson reported that the consensus of the neighborhood meeting was that they would
support a 24 lot subdivision. He said he would agree to place protective covenants on
the development to assure quality homes similar to or greater than the value of that
which exists on Howards Point Rd. He will relocate trees from the Shorewood Oaks project
and place them in locations agreeable to the adjacent lot owners. He said he would be
paying for improvements to the project rather than assessing.
Jerry Brecke. 27450 Pine Bend. said he doesn't think changing two lots does a whole lot
for the subdivision. He said a previous owner of the property was denied a lower density
zoning because the former Planning Commission didn't think the property should be
changed.
Mr. Johnson responded that the Comprehensive Guide Plan shows that the area should be
down zoned to half-acre lots.
Don Anderson. Howards Point Road. feels the development should stay with the 30.000
square foot lots as previous recommended by the Planning Commission.
Sally Brown. 5875 Howards Point Rd. said the Planning Commission should stick to the
current zoning. and consider the neighbors who have to look at it.
Mr. Johnson commented that the existing neighborhood contains more density than what is
proposed.

Brentridge reconsideration. continued:
Susan Sano. 5685 Howards Point Rd.. said that the recommended trail easements should
necessitate elimination of at least one more lot.
Bill Gabby. 5705 Howards Point Rd.. said that although he would like to see the density
along the swamp reduced. his major concern was the lots that are adjacent to his
property. He said that Mr. Johnson has reduced the lots that are adjacent and he
therefore supports the project.
Eileen Gallagher (owner of subject property) said that she bought the land to develop it
and it has proven to be a hardship.
A resident on Pine Bend said he is concerned that lowering the zoning will set a
precedence on down the road.
Sally Brown said she isn't against sale or development of the land. she opposes rezonng.
She asked what is happening with the EAW. Planner Nielsen said that a memo from the
Quality Review Board stated that the need for an EAW would have to be considered prior to
final approvals.
Public portion of the public hearing closed at 8:23 P.M.
Schultz asked what the Comp Plan refers for this area and why is wasn't zoned
accordingly. Planner Nielsen said that the Plan states that this area would be
appropriate for 1 to 2 units per acre because of the existing lot sizes along Howards
Point Road. but the City chose to decide rezoning on a case by case basis. or at the time
of proposed development. rather than rezone that land all at once.
Watten asked about the average lot sizes and widths along the east side of the proposed
road. Mr. Johnson read aloud the individual lot sizes. the average being approximately
25.000 square feet. Average lot width is 100 feet.
Watten said that it seems it is the consensus of the neighbors that they could live with
30.000 square foot lots. Benson said that would require the plat to be reduced to 21 to
22 lots.
Schultz said that if the lots along the east side of the proposed road were reduced by
two. the development would be more aesthetically pleasing. He said he appreciates what
Mr. Johnson has done on the west side of the road.
Schultz moved. seconded by Leslie to recommend to Council to rezone the property to R-1B.
30.000 square foot minimum lot sizes.
Planner Nielsen reminded the Commission that an R-1B zoning would require that all lots
be 30.000 square feet and 110 feet wide at the minimum.
Leslie commented that this motion does not address the request at hand. which is a
request for approval of a rezoning to R-1C. not oR-lB.
Schultz withdrew his motion. Leslie concurred.

the property to R-IC. Motion carried by roll call vote - 5 ayes - 1 nay (Benson).
Leslie commented that she is concerned about rezoning the area to R-IB at this time
because it would lock in the lot sizes to 30.000 square foot minimum. when a developer
could present a very decent plat with variation from 25.000 to 32.000 square foot lots.
Planner Nielsen cautioned that the Commission should be careful not to apply zoning to a
particular plat. but rather apply zoning appropriate to the land itself.
Mr. Johnson said he would like the Commission to consider making a statement to the
Council that they would recommend approval of rezoning to R-IC contingent upon specifics
being applied to a particular plat design.
Schultz said tbat he would like to see a guideline established consistent with the Comp
Plan for development of this area.
Schultz moved. seconded by Watten to recommend to Council that the property be rezoned to
R-IB. 30.000 square foot lots.
It was noted that a Planned Unit Development would allow for the flexibility desired by
the developer.
Motion to recommend rezoning to R-IB tied by roll call vote - 3 ayes (Mason. Watten.
Schultz) - 3 nays (Leslie. Benson. Robertson).
Benson moved. seconded by Leslie to recommend to Council denial of the preliminary plat
based on the proposed density. Motion carried unanimously.
This item will appear on the Council agenda of 22 June 1987.

PROPOSED ACTION
To make final recommendations on the Hwy. 7 Corridor Study and submit it to the
Minnesota Department of Transportation (MnDOT).

BACKGROUND
The purpose of the Hwy. 7 Study was to develop a plan to improve the operation
of Hwy. 7 as a regional highway while. accommodating planned growth in the
area. MnDOT and the cities of Chanhassen, Deephaven, Excelsior, Greenwood,
Minnetonka and Shorewood participated in the study. The Metropolitan Council
was the lead agency for the study. BRW, Inc. was the consultant on the
project. The study was conducted during 1986 and was completed in December of
tha t year.
The six participating communities submitted positions on the report in January,
1987. The following month the Systems Committee reviewed the report's
recolllDendations and the community responses to them. The reaction to the report
was mixed; Chanhassen, Deephaven and Minnetonka generally supported the
recommendations; Greenwood, Excelsior and Shorewood were seriously concerned
about specific project recommendations affecting their communities. The
committee recommended that staff continue to meet with the cities to fine-
tune some of the recommendations in order to reach compromise positions.
STUDY RECOMMENDATIONS
The study recommends:
1. A four-lane expressway as the long-range plan for the six mile stretch of
highway west of Hwy. 101.
- 2. ,Reducing the number of direct access points from 43 scattered, uncoor-
dinated locations to five signalized intersections within the study area
spaced at approximately one mile intervals. Signalized at-grade
intersections with HWY.7are recommended at Hwy. 101, Vine Hill Road,
ChristllBs Lake Road, CR 19 and Hwy. 41.
3. An interchange at St. Alban's Bay Road/Covington Road which would provide
full access to Hwy. 7 for the areas both north and south of the highway.

OUTCOME OF DISCUSSIONS WITH COMMUNITIES
Council and MnDOT staff analyzed Greenwood's positions and believe most of
their concerns can be adequately addressed. Discussions with the City of
Excelsior lead to a compromise recommendation. Discussions with the City of
Shorewood and the developer were not as fruitful. Shorewood continues to
support its original plan for the Vine Hill intersection (alternative 1) in the
report. Staff proposed a different alternative as a "compromise" which is also
compatible with the Waterford developer's plans. Responses to the individual
communities' positions are described below:
GREENWOOD
Greenwood opposes upgrading the Christmas Lake Rd. intersection and recommends
removing the existing traffic signal and installing a center median to permit
only right-in and right-out turns from both the north and south sides of the
Highway. The City also wants a barrier constructed on the north side of
Highway 7 to protect pedestrians and bicyclists.

Response

Removing the traffic signal and installing a median to prevent other than right-
in and right-out movements at Christmas Lake Rd. would seriously affect local
traffic patterns by causing unsuitable and inconvenient access to the east for
Greenwood residents and to the west for Shorewood residents; increasing traffic
volumes on Mill Street and, impeding access to the public boat launch on
Christmas Lake.
A barrier to protect bicyclists and pedestrians using the path on the north
side of Hwy. 7 could be an appropriate safety measure. However, the pathway
was constructed by the city on the Hwy. 7 right-of-way by permit from MnDOT.
The path is in the location of the city's choosing, adjacent to Hwy. 7.
MnDOT had suggested that it be built north of the frontage road away from
Hwy. 7 traffic. Under these circumstances Greenwood bears responsibility
for constructing a protective barrier. MnDOT does not object to a barrier as
such, provided that safety and design standards are met.
EXCELSIOR
The City of Excelsior objects to the design standards required to develop a
"partially controlled access expressway", especially as it relates to
elimination of businesses along Hwy. 7.
The city is also opposed to the recommended alternate for Excelsior Area East
if it means closure of Division Street north of Hwy. 7 (which would affect
business access) and the Mill Street access onto Hwy. 7 because it would
take four homes.
The city finds the recommended alternate for Excelsior Area West acceptable, if
reasonable access can be retained for all existing businesses along the north
side of Hwy. 7.

The relocation of Hwy. 1 to the north in the vicinity of the high school
was never considered a viable alternative because of the expense.
Shorewood continues to support its original proposal (alternate 1) for a new
access to Hwy. 1 at Old Market Rd., between Vine Hill Road and St. Alban's Bay
Road/Covington Road. Alternate 1 is the lowest ranked of the study
alternatives, including the "do-nothing" alternate. Old Market Road is being
constructed as a collector street to serve the development and traffic
originating south of it. Construction has stopped approximately one-quarter of
a mile south of Hwy. 1.
Shorewood's objection to the improvements recommended in the report for Vine
Hill Road intersection is that they could not afford to acquire the needed
right-of-way.
The City does not present any costs for their proposal to compare to the Vine
Hill option. The grade separation at St. Alban's Bay Road was proposed because
the topography lends itself to this type of intersection, which would be less
expenSive, in this unusual instance, than constructing an at-grade intersection.

DSU, Inc., consultants for Trivesco, state "the solution found in Alternative 5
is far less expensive and more practical than the grade separated bridge
solution (recommended alternative 4)." This suggestion was discussed with
Shorewood and the developer. The City does not believe a north-south
connection between Old Market Road and St. Alban's Bay Road is necessary but
they do not express specific objections to the concept.
FINDINGS
1. That the Hwy. 1 Corridor Report recommendations represent a good, long-term
access plan for the highway, supported by MnDOT and consistent with Council
transporta tion policy plan criteria for major arterials.
2. The alternatives recommended for the Vine Hill/Old Market Road and
Excelsior Area East are not supported by Shorewood, Greenwood and Excelsior.
3. The Vine Hill intersection, although located in Shorewood, provides an
important access to Highway 1 for Minnetonka, Deephaven and Chanhassen
residents.
4. Shorewood's objection to Vine Hill/Old Market alternative 4 is based on its
cost. However, sufficient cost information is not available to support
this con ten tion.
4. Greenwood's proposed removal of Christmas Lake Rd. traffic signal and
installation of a center median would seriously affect local traffic

RECOMMENDATIONS
1. That the Metropolitan Council adopt the Highway 1 Corridor Study report,

The Shorewood City Council has directed me to write you this letter to
share our thoughts regarding the T.H. 7 Corridor Study which is in the
final approval process by the Metropolitan Council.
A number of years ago. the City of Shorewood adopted a Comprehensive Plan
to guide us into the future. Part of the Plan dealt with transportation
policies. A transportation need suggested for further study in the Plan
was the upgrading of the intersection of Vine Hill Road with T.H. 7. A
traffic study was subsequently completed by the City in 1984 which
proposed a way to address this problem. Upon submittal of our study which
came to the Met Council in the form of a Comp Plan Amendment. a new
intersection onto T.H. 7 was sugg.ested to be constructed which would
coincide with proposed commercial and residential development in the
area. A study of the entire T.H. 7 corridor from T.H. 101 to the western
boundary of Chanhassen then ensued and is now complete. The T.H. 7
Corridor Study Final Report does not agree with the alternative suggested
by Shorewood with regards to the Vine Hill Road area. The Shorewood
proposal calls for traffic traveling south of T.H. 7 to use a new
intersection known as Old Market Road rather than tbe existing Vine Hill
Road intersection. Traffic would continue to use Vine Hill Road north of
T.H. 7 as it exists today. The proposed Old Market Road intersection is
located approximately 2000 feet west of the Vine Hill Road intersection.
The findings of the Corridor Study suggest two full movement
intersections. One located at Vine Hill Road. and one located at Old
Market Road.

QUESTIONS RAISED BY THE TETON / LILAC LANE ISSUE
SAFETY
It is my understanding that one aspect of the current consideration
of "Teton" and Lilac Lane involves safety requirements for future
Chanhassen residents. In my opinion, a "Teton" and Lilac Lane
connection to future streets may not be the best solution.
1. It is not the most direct access for future residents to
potential sites of residents.
2. Alternative, shorter accesses are available.
3. It is a right angle access at "Teton" and Lilac Lane and not a
right angle meeting of Lilac and the County roads.
4. The Lilac Lane traffic must merge with county traffic of
confusing speeds. Thirty MPH from the left and 45MPH from the
ri ght.
5. A traffic increase on "Teton" and Lilac Lane will deminish the
safety of current residents.
6. What are the Cities critera for evaluating citizen safety in
respect to roads?
FINANCIAL RESPONSIBILITY
It is my understanding, at this time, that adjacent property holders
to "Teton" and Lilac Lane are likely to be financially burdened by
potential changes. Many of the potentially affected property
holders will be asked to finance the access changes providing
service to future Chanhassen residents, but receive decreased safety
and no identifiable increase in service or general environment. It
is also likely, that to incur the financial burden, they will be
required to sell their land to satisfy safety and planning
requirements.

2. Is it normal Chanhassen and Shorewood practice to asses~
residents for "improvements" to meet the objectives of developers?
3. Has Chanhassen or Shorewood ever required a developer to bear
the financial burden of "improvements" required for its' project?
4. What is Chanhassens' and Shorewoods' criteria for weighing
financial responsibility of the current residents for .~he community
and the benefit and profit of (1) a developer? (2) Future residents?

The State Plannina Agencv (SPA) is the administrator of Justice Assistance Act funds in Minnesota.
Based on the response to the survev* sent by SPA to Minnesota criminal justice personnel, four
program priorities were adopted by the Governor's Interagencv Task Force on Criminal Justice Policy
for funding under the federal Justice Assistance Act. Those program priorities are:
Community Crime Prevention~ Victim and Witness Assistance; Juvenile Restitution~ and Career
Criminal Prosecution.
To inlplement the above proarams, the SPA IS contracting with the following state agencies. It is
anticipated that all available funds will be dispersed to local communities. If you are interested

homesteaded property from $122,000 in 1986 to $130,900 in 1987. He
asked if all lots increase at the same percentage. Assessor Erlckson
revIewed this area and felt the Increase was Justified due to
valuation end niarket pI ices. Eeutiman was not opposed to the
valuatIon. CouncIl took no actIon on this request.
He opposed an 11.5% increase on hIS rental property at 23365
Yellowstone TraIl. He stated that he had an "opt~0n to bu~" slgneo
February 5, 1985 for $80,500.00 that can be executed within 5 years.

laws" to be directed by the County Assessors. Mr.Witrak stated that

the proposed rate.

area, fill and type of flll. A letter has been sent to the property
owner directly across fr'om the Eureka Road entrance asking for comment
regarding the entrance location. No response has been received from
them to date. Administrator Vogt will obtain an agreement with MnDOT to
install entrance signs on the Hlghway 7 road right-of-way.

Swimming Pool Approval - 28130 Boulder Bridge Drive
A request to instali a swimm~ng pool at 28130 Boulder Bridge Drive has
been received from Steve and Jean Klocksien.

Glen Road/Badger Watermain Report
Engineer Norton presented a cost estimate of $156,900.00 to extend the
watermain from Badger well to Glen Road. Staff will discuss specifics
and assessment POllCY and return with the additional information at a
later meeting. Stover asked if this policy would become policy for
future assessments. Norton felt that this ~olicy may not apply to other
proJect improvements.
Street Improvement Proiect - Plan and
Specification & Authorize Advertisement for Bids
RESOLUTION NO 78-87
Council revIewed the list of streets, type of repairs to each street and
costs of improvements proposed for the 1987 street improvement project.
They discussed changes and additions to the present list. They looked
at adding 4' to West 62nd Street after the MWCC improvement is
completed, and added improvements to Beverly and Cajed after the water
line and stubs are installed, and removing Enchanted Lane from the
project.

OFFICE SPACE NEEDS ANALYSIS REPORT
Nick Ruehl of EOS Corporation presented a booklet of the City Hall Needs
Analysis. Rascop asked if the adjoining house had been considered. Ruehl
felt the use of this house would not be functional. Ruehl reviewed the
analysis for the Council. The questioned the type of office furniture
proposed, location for future staff, electrical needs, fire proof area for
downstairs filing and access to lower level.
Haugen asked about cost of remodelIng versus new construction. Gagne
feels the house should be reviewed prior to any determination being made.
Haugen moved, seconded by Stover, to authorize EOS Corporation to obta1n
information on the house and submit an architectural opinion on it.

This letter is in regard to our -;:;hcne conversation of Frida", ~'la'y 22.
I am requestir~ a street light be installed at the corner of the service road
to hiway 7 just west of the Vine Hill intersection, and our small connecting
street (no name); between the Waterford property and Minnesota ~jini Storageo
It would seem most logical to put it on the Waterford side, although I'M sure
if you decide to O.K. installation, N.S.P. will determine placement.
This spot is terribly dark and difficult to see at night which proves to
be somewhat dangerous at times. We also, in the summertime have some problems
with young people gathering there to drink beer and discard their cans and
bottles; which leaves quite a mess for us to clean up every weekend. We are
hoping that by having this area well lit, it will solve both problems.
Thankyou for your help and attention to this matter. Below you will
find signatures from the immediate neighbors. If there is anything else you
need from me, let me know.

NONCONFORMITY OF A NONCONFORMING STRUCTURE

BACKGROUND
In late April of this year our office received inquiries as to whether a
screen porch being constructed at 21640 Lilac Lane (see Site Location map -
Exhibit A. attached) complied with the setback requirements for the area in
which it is located. Upon inspection of the property it was found that the
porch was being built without a permit and that it was not in compliance with
the 50 foot front yard setback requirement for the R-1A zoning district in
which it is located.
The owner. Mr. Eric Danser. subsequently requested to informally appear
before the Planning Commission to see what his chances might be of receiving
a variance to leave the structure in its current location. As explained in
his letters. dated 6 May and 11 May (see Exhibits Band C. attached). he had
hoped to get some reasonable assurance that a variance would be granted
before he spent the money for a survey of the property. which is required for
variance requests.
At the 19 May Planning Commission meeting the Commission advised Mr. Danser
that a survey was necessary to make any kind of determination as to whether
the variance is reasonable.

Mr. Danser has now acquired a survey of his property (Exhibit D. attached).
As can be seen. the existing house is 43.6 feet from the Lilac Lane
right-of-way. The porch is seven feet closer to the street. a distance of
36.6 feet. The resulting variance being requested is 13.4 feet.
Mr. Danser has submitted letters (see Exhibits E and F) from the four other
Shorewood residents along Lilac Lane. stating that they have no objection to
Mr. Danser's porch. Exhibit G contains additional information provided by
the applicant.
ANALYSIS/RECOMMENDATION
Section 200.05 Subd. 2b. of the Shorewood Zoning Ordinance provides criteria
for granting variances. Upon review of these criteria. the applicant's
request does not appear justified.
1. Although the applicant mentions drainage problems. these are not
considered peculiar or unique to the subject property. Such problems are
commonly resolved by installation of gutters. site grading and
landscaping. draintiling and waterproofing.
The applicant has not suggested that economics are the justification for
the variance.
2. Although Shorewood has numerous nonconforming structures. the City has
established a fairly consistent pattern of not allowing nonconformities
to be increased. For examples. refer to past decisions regarding
requests by Gullifer. Jabs. Sanders. Setterholm and Burger King.
3. The applicant states that he was unaware of the need for a building
permit. While he undoubtedly did not intend to violate the City's
regulations. ignorance of the laws are not justification for breaking
them. In no way should the fact that the work has been half completed be
considered as justification for granting a variance.
4. The City should be concerned about the precedent which would be
established by granting the variance - not only from the perspective of
zoning standards. but also from the standpoint of the building permit
process. While we have no reason to question the innocence of Mr.
Danser's mistake. we are extremely concerned that others with substandard
structures may see this variance as a signal to build what they want
without a permit and. if caught, request a variance, pay the double
building permit fee and expect to be treated the same as Mr. Danser.
Much of Mr. Danser's case has to do with the requirements for property in
Chanhassen. Given the extent of boundaries Shorewood shares with other
communities. granting variances based on the requirements of other cities,
may not be a desirable precedent. If the request is considered reasonable.
the City should consider either changing the setback requirement for the R-IA
district or rezoning the area in question to R~lC.

Finally, there is one basic test for variances which the City has
consistently considered. If the addition can be accommodated without a
variance, it is typically not justified. Mr. Danser's lot is larger than the
minimum lot size for the R-IA zoning district. Despite Mr. Danser's concern
for aesthetics there is ample room at the rear of the house to build a screen
porch.
Based upon the preceding the ~ariance request is not considered justified.
It is suggested that the applicant be directed to rebuild the porch within
the buildable area of the lot.

Dear Building Inspector, Planning Commission ~embers,
and Members of Shorewood City Council,
My hppe in composing this letter is to p~rsuade
you to grant a variance for my house in order that I
may construct a screened-in-porch over the existing
wood deck in the front of my house.
My house was built around the turn of the cen-
tury and now stands about 49 feet fron Lilac Lane.
which runs in front of the house. The outside edge of
the, existing deck is 42 feet from the road. By build-
ing this screened porch over the deck, it will not be-
come any closer to th~ r~d.
My wife, Jane, and~just- had our first baby four
months ago and we ~ould all love to be able to sit out-
side in the evenings this summer without being "eaten
alive" by mosquitos. Another reason we: need the porch
is to shed water away from the house to keep ~base-
ment dry. The third reason is that the soffiting around
the house has quite a lot of rotten wood in it from
leaking water. I was going to have to rebuild it this
summer, but by roofing over the existing deck I can
remove the rotting wood and shed the water properly
away from the house. All three of these concerns can
be addressed and remedied by the proposed porch.
I have obtained from all our neighbors along Lilac
Lane written and signed letters stating that they have
no objections to the proposed porch. Please find them
enclosed .
. The residents along the North side of Lilac lane
are situated in the city of Shorewood, while those on
the South side are located in the city of Chanhassen.
The front setback requirements for a house in Chanhas-
sen is only JO feetfrom the road easement. In Shore-
wood, along Lilac Lane, the front setback requirement
is 50 feet. It does not seem fair to me that on one
side of Lilac Lane a porch such as the one I propose
may be built with no problems, yet on my side we may
not. . I am willing to pay the variance fee and other
fees required in order for permission to be granted.
The front of the house really is the only place
to add the porch, for aesthetic as well as practical
reasons. Every picture we have seen in books and mag-
azines of this type of country farmhouse with a gambrel
roofline (like our house) has a roofed porch on the

front gable end of the house. This is traditionally
where a porch liKe this should be located. It does not
make aesthetic sense to locate it on some other side
of the house. We have put a lot of thought and con-
sideration for traditional building style into the
placement of our porch. 'l
fhe practical side of its placement is this,
already existing is a wood deck over which a roof can
be built. and the front door to the house is also
located right there. It would not make sense to cut an
opening for a door in a wall on another side of the
house and then proceed to build another wood deck over
which to build a roof and screen in.
Our only desiredis to be able to build a roof
over our deck and screen it in. It will enhance the
looa of our house and increase the property value.
in turn increasing tax revenues for the City of Shore-
wood. There is still plenty of fronttyard between
our house and Lilac Lane.
Please cansider carefully my request for a var-
iance. the plans for the porch. and the accompanying
literature and grant us a favorable decision.

Dear Members of the Shorewood Planning Commission,
My name is Eric Danser. I live at 21640 Lilac
lane in Shorewood. Presently I am experiencing an
unpleasant situation stemming from having begun con-
struction of a screened porch without first having
obtained a building permit. My only defense for be-
ginning without a permit is my ignorance. There is
already a wood deck existing along the front of my
house. Ky thoughts were to merely build a roof over
the deck and screen it in. I tied into the soffiting
in the front of the house which extends 20 inches from
the face of the house and extended it another 6 fee~.
I honestly did not think a permit was required.
I started work on the project on April 25. On
April 28 Brad Nielsen's Assistant, Joe, dropped by
my house and told me to stop construction until a per-
mit was obtained. I stopped constuction on the pro-
ject as instucted and called up Brad to see what this
was all about. This is when A whole "bucket of worms"
began to unravel.
Yes indeed, I did need a permit! Plus, a double
permit fee would be assessed. He also said I would
have to apply for a variance before a permit would be
issued, since my house is a non-conforming structure.
To apply for a variance I would also need to have a
survey of my property done, since all I have is a
legal description of the property on my deed. the
variance fee is $125 and the cheapest survey cost we
could find was about $500. This comes to about $625
just to find out if we could p1'iet a variande- which
did not look too promising since I had already started
without a permit. My other option was to tear it down.
I feel terrible about the whole situationl I was
not trying to do something illegal or dishonest. Brad,
who I know is onl~ carriing out his job, made me feel
like I had done an unforgiveable act and was going to
have to pay dearly for it.
The porch is still only half built and I haven't
pounded in one morenail since told to stop. It is con-
st~ucted very well and easily meets code requirements.
I am petitioning you at this meeting tonight to
just listen to my side of this unfortunate incident
and guide; me in the decisions that must be made. I am
very sorry for having started this pro~ect on the wrong

As you are aware, Dave Johnson has taken over the proposed Brentridge
development from United Mortgage Company. As explained at the last meeting, he
requested that the Council delay action on a resolution denying a rezoning and
26-lot preliminary plat until he could put together an alternative plan.
He has since held a neighborhood meeting with area residents to discuss the
project. Based on that meeting he has submitted a revised plat (see Exhibit A,
attached). The new plat shows 24 lots. Two lots have been removed from the
west side of the proposed street. The resulting lots now average 26,339 square
feet in area.
For those of you who may have discarded the original staff report, a copy of
the report is enclosed for your review.
Relative to the revised plat, the requirement of trail easements is still
highly recommended.

Re: Brentridge Subdivision Approval
It was obvious from the comments made by members of the council and
from Brad that I will be appearing before the Planning Commission with
the Brentridge project before the council will grant approval. If
that's the case then there is no point in my appearing at the council
meeting on June 8th. The conflict with my dialysis can be avoided, plus
we can get the project approved properly if we follow the following
schedule:
1. Please ask the council to delay action on the findings of
fact resolution until the meeting on June 22nd.
2. Schedule my appearance on the Planning Commission agenda
prior to June 22nd.
3. Place project on agenda for council on June 22nd.
4. Schedule a neighborhood meeting on a Tuesday or Thursday
evening prior to the Planning Commission meeting.
This should give Brad plenty of time to notify the neighbors of the
above schedule. It will also give me an opportunity to find out the
concerns of the neighbors and to properly address them. I understand
that there were more things than just the density that they were
questioning. I am a reasonable person and quite willing to discuss
reasonable and logical objections to find the proper solution.

NOTICE TO RESIDENTS
Subject: Zoning Ordinance Amendment Request
Proposed Brentridge Subdivision
At its regularly scheduled meeting held on Tuesday, May 26, 1987,
the Shorewood City Council voted unanimously to reconsider the
application for an amendment to the Shorewood Zoning Ordinance
which was submitted by United Mortgage Corporation. The City
Council further determined to refer the matter to the Shorewood
Planning Commission. Such consideration by the Planning Com-
mission will take place at their meeting to be held on Tuesday,
June 16, 1987.
Inasmuch as you have previously been notified of this proposal,
we are informing you that this matter will be discussed by the
Shorewood Planning Commission on the abovementioned date at
which time the Commission will hear comments. If you wish to
comment, you may do so by appearing before the Planning Com-
mission on June 16. Written Comments will also be accepted.
The Developer has indicated that he will hold a neighborhood
meeting to solicit input prior to the June 16 Planning Commission
meeting.

replant them near the westerly lot lines adjacent to the
Howards Point property owners. (4 - 6 per lot)
3. Have declaration of residential covenants,conditions and
restrictions to be recorded with the. 91at,.
The neighbors will then support my proposed plan. This should enable
me to get the support of the city staff, the planning commission, and
the city council, resulting in plat approval.

Would you please forward a copy of this letter to the Mayor and all
the members of the council? As you know I have taken an assignment of
United !40rtgage Corporation's interest in this project. They were
unable to get plat approval based on a 26 lot density. (average size
24,313 square feet). I was aware of this problem even though I felt that
the plan was good and the density should be acceptable at this level.
Everyone that I talked to seemed to think that if United Mortgage
Corporation had been willing to decrease the number of lots by 2, to
24, the project woul d have been acceptable. When I took over it was
pretty clear that I wouldn't get 26 lots approved. I proceeded to hold
a neighborhood meeting (refer to letter dated June 10, 1987) at which
time I started with the original 26 lot proposal and let them beat me
into submission on coming back with a plan eliminating 2 lots on the
west side of the street. For this they agreed to support me at the planning
and council meetings. I started with 26 lots because I knew if I went
in with 24 they would want 22 and so forth. For a perfect example of that
type of thinking one had only to listen to Susan Sano at last night's
planning commission meeting. Of all the people in attendance at the
neighborhood meeting that \'Jere going to support me, only Mr. & Mrs. Gabby
voiced their support last night. The rest either didn't come, were
silent or pushed for a further reduction.
The arguments for a decrease in density below 24 lots (average size
26,339 square feet) does not have merit. The marshland to the east cannot
be calculated into the average lot size although its existence is
certainly a factor in considering a zoning change to R-l-C that would
allow approval for the proposed plat.
When the people involved in the decision making process for establishing
a comprehensive guide plan for the future development of the city were
considering this issue they arrived at their conclusions based on logic.
They were not confronted with the emotional issues that are prevalent at a
time like this. There were no pleas from neighbors about to lose the
physical and visual benefits that they had enjoyed by having undeveloped
open land available for their use at no expense to them.

There were no landowners that would be harmed by an inability to sell their
property even at a break even price if the plat is not approved. There
was also no developers around complaining about the fact that a density
of 26 or 24 lots was barely acceptable economically. Their conclusions
were based solely on what they felt would be good for the entire city in the
long run. They had to consider the fact that there were already 8 lots
along Howards Point Road adjacent to this property with an average lot
size of 24,377 square feet.

DISTRICT 2
This District is bounded by the Shorewood/Chanhassen
border and Smithtown Road on the south, lake Minne-
tonka on the west and north, and the large wetland
area just east of Howard's Point Road on the east. The
area is currently zoned for acre sized lots, but contains
many lots half an acre in size. A commercial marina
is operated on Howard's Point Road in the northern
.portion of the District. Nearly the entire eastern edge
of the District consists of one of Shorewood's largest
wetland areas.
Proposed land use for this District is mainly semirural residential west of Howard's
Point Road. The area between Howard's Point Road and the wetland area to the
east i$ proposed forlow density residential (one to two units per acre). This is easily
justified due to the area's proximity to Smithtown Road - a collector, and the
number of existing half acre lots in the area. Also, the existence of the wet-
lands to the east will still maintain an overall density of less than two units
per acre.
The Shorewood Long-Range Parks Plan has identified a multi-purpose trail
around the large wetland w hi ch borders this D istri ct on the east. If, upon
re-evaluating the Parks Plan, the City decides that this is a desirable element
of Shorewood's park system, all development requests received for the area
should include dedicotion of necessary easements for trails.

Please note the fact that this use would be in the best interest of the
city for the reasons stated above. Additionally you have the increase in
the tax base, and the user fees from city sewer and water that will help
maintain and support existing expenses. This plan would also provide 24
more homes to support the city when the problems of a comolete city water
system are addressed. This plan will also provide one more upgraded
street to serve city residents. This guide plan clearly indicates that
my proposed plan fits exactly with what was intended for this area. Please
use this fact as justification for approval rather than bowing to the
increased demands of the neighbors.
I need a response from the council approving the plat as proposed. (from
the 26 lot original down to 24 by removing 2 lots from the west side of
the street). I will also submit a copy of a 24 lot plan with 1 lot each
removed from east and west sides of the street. This would permit a trail
easement along the marsh as recommended by your planner, Brad Nielson.
Either plat is acceptable to me. There is a third possible plan that I
will produce a copy of. This would be 23 lots by taking 2 from the
west and 1 from the east. I don't feel that this would be fair but I need
an approved plat by Monday night. This plan would require rr~ to negotiate
a reduction in my land purchase price.
Please see your way clear to approve the first 24 lot plan. I thank

Mr. William Ecoff has submitted a final plat for his proposed Towne Addition
(see Exhibit A. attached). As can be seen the plat still shows 10 lots. You
may recall that he earlier proposed to revise his preliminary plat to nine
lots. intending for the existing house to have more area than the other lots.
Since he wishes to leave the option open to redivide the larger lot in the
future. he has shown it as two platted lots. which he will legally combine
until such time as he wishes to sell it. From a planning perspective. this
approach is advocated because it will simplify a redivision later. Although it
will need to be processed as a simple subdivision at some future date. the
resulting lots will have lot and block legal descriptions rather than metes and
boundS descriptions.
The proposed grading plan shows an existing garage on Lot 3 which did not
appear on the preliminary plat. Since the garage is located too close to the
proposed right-of-way. it should be required to be removed. If the applicant
wishes to move it into compliance with the setback requirements. he must apply
for a conditional use permit to have two garage structures and to exceed 1000
square feet in accessory space.
Preliminary grading. drainage and utility plans have been referred to the City
Engineer for review. He advises us that based upon information received to
date. the plans are acceptable. He has indicated that the road in one location
is too flat and suggests moving the high point of the road northward to achieve
a minimum of .75% slope. He also needs detailed plans and specifications for
the street and utilities. The applicant's engineer must also provide his
calculations for stormwater runoff for verfication that the pond is properly
sized. The plat must be revised to provide a drainage easement over the
ponding area.

Once the detailed plans and specifications are approved. the applicant's
engineer must provide cost estimates for the required improvements. from which
the amount of a letter of credit can be determined.
Park dedication fees must be paid prior to release of the final plat. If Lots
2 and 3 are to be combined. the amount owing is $4000. If they are not
combined. the amount is $4500.
Prior to release of the final plat. the applicant must provide an up-to-date
(within 30 days) title opinion for review by the City Attorney. The applicant
must also advise the City Clerk as to how he wants to pay sewer equalization
charges on the new lots.
It is recommended that the final plat be approved subject to the applicant
entering into Shorewood's standard development agreement. incorporating the
recommendations contained herein.

representatives and governing bodies which provide economically,
the safety, service and general environment of their respective

BACKGROUND
The developer has proposed an 81 home development on tne 56 acre
site, tCI be kYtclwYI as "Cut'ry Farms", a.nd has received prelimiYlary
approval of a portion of that plan. The developer has purchased
an option on a privately owned road known as Teton Lane, and
proposes to deed that road, unimproved, to the City of
Chanhassen. The City would then improve the road to municipal
street standards providing the necessary third access to Curry
Fat'ms.
The developer has stated to the Planning Commission and the City
Council that they will not contribute money toward the
maintenance or improvement of the road beyond the purchase of the
t t~act .
The property owners in the general area of Teton and Lilac Lanes
have formed the Teton and Lilac Lane Homeowners Association and
are concerned for: 1) the safety in the neighborhood, 2) loss of
property to right of way, and 3) the associated cost burden for
future improvements to Teton and Lilac Lanes. It is our position
that a safer, and less costly alternative be constructed by the
developet'.

1. The City Planning Department Staff directed the developer to
incorporate Teton Lane as one of three accesses to the Curry
Farms site. The plat presented to the City Council shows that
the developer will build the Southern access from Lake Lucy Road,
the Eastern access from County Road 17 directly south of the

horse boarding and riding stable which has operated under a
conditional use permit granted by the City of Chanhassen. That
operation has moved from the site. Traffic over Teton Lane is

made by the seven residents having easements over the road.

WHEREAS, such application seeks approval for the placement of
fill on the property within twenty (20) feet of the shoreline; and
WHEREAS, Shorewood "Shoreland District" ordinance provisions
prohibit the grading or filling of land within twenty (20) feet of the nonnal
high water mark; and
WHEREAS, a Public Hearing was held and the application reviewed
by the Planning Coomission on May 19, 1987; and
WHEREAS, a further review of the application was had before the
City Council at their regular meeting held on May 26, 1987; and
WHEREAS, the City Attorney was directed by resolution of the
Council to prepare a resolution setting forth Findings of Fact and
Conclusions approving applicant's request for said variance.

be lowered to 15 MPH.

SUBJ: Revised Sewer Alternate, Church Road Sewer Improvement Project
At the May 18, 1987, meeting, the City Council authorized plans
and specifications for installation of sanitary sewer on Church
Road to service the Wanous and Campbell properties only. This
would be accomplished by connecting to the Shorewood Interceptor
on West 62nd Street (see Exhibi: G). Since that time, Mr. Gary
Carlson has continued to petition the City in an attempt to pro-
vide sewer and water across his pro9osed development, i.e. Lots 3
and 4, Schmid's Addition (see attac~ed letter).
In reviewing this with our consultant, we have arrived at
a revised alternative which perhaps addresses service to Wanous
and Campbell as well as the Carlson property. As shown on
Exhibit L-2, this would be accomplished by reversing the flow of
the sewer and bringing it across Lot 4 of the Carlson property.
As documented in his letter, Mr. Carlson is completely in favor
of this alternative and is willing to provide all easements at no
cost to the City and accept the costs for sewer and water along
his property. This could, in fact, result in a reduction in the
assessments to the City of Shorewood, Wanous, and Campbell prop-
erties as identified in Attachment #4. In addition, this alter-
nate, unlike Exhibit G, would allow for extension of sanitary
sewer in the future to service the south-end properties of Church
Road should this become necessary.
Since the Carlson property has not been platted at this point,
the City needs some assurances that will bind Mr. Carlson to the
providing of easements and likewise payment of the costs of the
sewer and water across his property. 'rhe City Attorney has pre-
pared the enclosed agreement to address this concern.
It is therefore requested that the City Council approve this
revised alternative for sewer service to the area contingent on
Mr. Carlson entering into the attached agreement with the City
and guaranteeing that the assessments to the City of Shorewood,

THIS INDENTURE made this day of , 1987, by
and between GARY D. CARLSON and MAUREEN G. CARLSON, husband and
wife, hereinafter jointly referred to as "Grantors", and the CITY
OF CHANHASSEN, a municipal corporation organized under the laws
of the State of Minnesota, the Grantee, hereinafter referred to

The Grantors, in consideration of One and No/IOO Dollars
($1.00) and other good and valuable consideration to them in hand
paid by the City, the receipt and sufficiency of which is hereby
acknowledged, do hereby grant unto the City, its successors and

INCLUDING the rights of the City, its contractors, agents,
servants and assigns, to enter upon the easement premises at all

maintain public sewer and water utilities over, across, on, under
and through the easement premises, together with the right to
grade, level, fill, drain and excavate the easement premises, and
the further right to remove trees, bushes, undergrowth and other

the facilities here to our standard with curb and gutter, sanitary sewer and
watermain for all properties is probably going to run upwards of $65.00 per
front foot of assessments just to give you a general feel. Tbtal construction
dollars at $177,000.00 to $178,000.00. We thought it appropriate to look at
that at this time because it is a feasibility. The original petition that was
received by the City addressed a request for sanitary sewer and watermain for
the area and was supported basically by the Wanous and Campbell property in
this area. This alternative basically provides service specifically for those
properties and would connect to an existing stub and would hook up to the
Metro interceptor to the north. Likewise, again the watermain as was shown in
the original alternate proposal with trunk watermain coming across, the
watermain for the whole area here and just a stub out into the Carlson
property because of the uncertainity as to exactly when that would happen but
again, providing us for the ultimate connection for looping our system. The
costs associated with just specifically providing sanitary sewer runs for the
Wanous and Campbell property and the City of Shorewood, would run
approximately $32.00 per foot or assessment per unit of roughly $5,000.00 per
unit. This last option here would be for providing watermain and sanitary
sewer and it does show roadway improvements but basically the recommendation
that I have as a second option would be that the roadway be left as a rural
section without a curb and gutter and that would reduce the roadway assessment
by maybe $4.00 or $5.00 per lineal foot. Dick Koppe is here from Westwood
Planning if you have any specific questions and with that introduction I guess
I would turn it back to you Mayor.
Mayor Hamilton: Okay, I would like to ask for comments. Any residents here
have any comments they wish to make?
Merle Wanous: I would like to ask Mr. Warren, how did he get the willingness
of Shorewood to accept to pay for the watermain? Have you contacted them?
Gary Warren: In planning I talked with Dan Vogt, the adminstrator from
Shorewood. We have a letter from them stating that they are not in favor of
the sewer but because of the park and sprinkling of the ice rinks up there
that they were okay on the water.
Merle Wanous: I talked to him today and their water is going to be in on
Strawberry Lane and West 62nd Street so they are running a main for that new
development, 73 homes that are being built so I don't think they would be
interested in the watermain there at all and he definitely was against the
assessment. He said there was no way the village, they drafted a letter and
he said he didn't think they would get involved with water so that's why they
didn't particularily address it. We did ask for a small project. It was
going to be cost saving but we're coming to the point now where it's getting
to be a financial burden. We like the sewer, as far as the option that we
have from Campbell and us to the end if it could be put in now and a saving
to us. We could hack the $5,000.00 but adding of the curb and gutter. I
guess we can live without the water. His first study indicated that we had to
have an 8 inch watermain otherwise the water would be stagnant to the other
lots because it wouldn't be moving and now because of the change, because of
the new development, 6 inch would be okay. I just can't see that I guess and
if Shorewood does put water in, we probably could get water from Shorewood a

All we did when was we took up a petition, me an Wanous for that sewer. We
didn't take up for curb serv ice or 28 foot road or water and all that stuff.
We thought as long as they're going to dig that road out, we might as well
give us our sewer in there because our septic tanks we may be having trouble
because they've been there a long time but as far as the water, no because I
just put a brand new well in and so did Jim and I don't care to have the water
one bit. The rest on the system there, I can't go for it. If you ain't going
to put in more for that, I'm going to have to sell out. I'm going to have to
leave that. The other thing is, dividing my property to two lots. I've got
200 foot frontage on my property and I'm 95 feet from Jim's property. Now
where are you going to get that to put another house in there, I don't
understand that. That's going to be an awful small lot to stick a house in.
That's all I got to say.

Jim Frizzell: I guess lny feeling on it WaS, this is the option we kind of
walked out of the last meeting when we accepted the feasibility study. This
was the option that looked the best. We answered the questions of the
petition of getting sewer in to Harry and Mr. Wanous and we didn't address the
other items, water and enlarging the road because we didn't want it virtually
and I think I speak for Kerber also. He didn't want any of that. This latest
addition, which came after the last meeting and after we accepted the
feasibility study, we just got in the mail on Saturday, I haven't had a chance
to review it too much but it looks like we're bearing quite a bit of cost for
an addition that we might not want anyway. I guess if I voice my opinion, I
like that option the best. I think it answers the needs of the petition that
was set out in the first place.

Councilman Geving moved, Councilman Horn seconded to close public hearing.
All voted in favor and motion carried.
Councilman Johnson: It's a complex issue of looking on one hand into the
future and say what's going to happen with this proprty and what's best to be
done to support the future and at the same time looking into current residents
and saying what can we do for our current citizens. It seems to be two
opposite things. The citizens don't need the wider street. They don't want
the wider street. They don't want the water as far as the three that started
the petition in the first place. I'm torn to tell you the truth between the
two. Between good planning and taking the opportunity to make a small
improvement to the benefit of a small group of people. That's all I want to
say right now.
Councilman Geving: I agree, it's a tough decision. We got into this because
of the petition for sanitary sewer and when we went for the feasibility study
we said let's take a look at all of them. Let's take a look at the
possibility of improving the road way in and giving water and I think now that
the numbers are before us and the citizens have had a chance to see what those
numbers would cost in terms of an annualized interest and assessment for each
of the 10 or 20 years for whatever it's assessed, what they're telling us is
if this were a project that we approved lock, stock and barrel with all three
of those items in there, that they probably couldn't afford to stay in the b
area. I think the feasibility told us exactly what we wanted to know. It's
certainly feasible. Definitely feasible to put in sanitary sewer, water and

guess I feel that it's one of those things where if you're paying the bill
it's awfully tough I suppose to have the water put in. At the minimum, I
think we should do the sanitary sewer because it's crazy to miss the
opportunity and I would susPeCt that in the long run, missing the opportunity
of the water is going to be deemed to have been a mistake but from the City
standpoint, I would support sewer and I would sure like to have somebody else
talk a little bit about the road. It disturbs me but I'm not sure what to do
with it.

Mayor Hamilton: Did you have anything addition to say about the road?
Gary Warren: We have for example West 65th and Crestview are roads that
developed in the past which is similar to what Church Road would be here.
Basically, they are being maintained under the current road construction,
sewer construction up in those areas. It's a very visible area. It's wide
open. It's not like you've got steep bluffs on either side of the road so
from that standpoint and there is a lot of clearance between the road and
abutting property so you can see PeOple, kids, whatever, approaching you so
I guess that's why I say it's not a hazard based on it's width.
Councilman Johnson: Do PeOple park up there? I know the Chanhassen Little
League plays on that field. What happens when they have a Little League game?
Merle Wanous: They park in the church parking lot and walk across.

Councilman Johnson: Because that's not much of a road.
Merle Hanous: It has never been much of a road. It has always been, we've
been kind of stuck up there but to have us pay to improve the road when
everyone else is using it, seems to be very unfair.
Councilman Johnson: I would agree with you there. Gary, is there an estimate
in here about keeping a rural section but widening it or did it go just either
20 foot road or?
Gary Warren: There isn't per se on the feasibility study. I just ran some
numbers before I came down and strictly the widening of curb and gutter would
add about $5.00 per front foot.
Councilman Johnson: What's that per person?
Gary Warren: That depends on their frontage. You're looking at about
$500.00 to maybe a $1,000.00 for a rural section.
Councilman Johnson: It is used by a lot of folks other than the people who
live there for one thing, this year Little League is still playing there.
South Tonka Little League which includes the City of Chanhassen. People all
the way down to the south side of TH 5 go up there during the summer to that
road. Is there a way that we can improve, I know there's not much money left,
but widening the road the $5.00 per foot for 4 foot wide, we build a 24 foot
wide?

Gary Warren: Yes, it's not a big problem.
Councilman Horn: What about the end of that park. '!hat field stays pretty
wet. It's been a number of years since my son has been in Li ttle League. I
know people park along the road up there. '!hey don't all park in that church
parkirg lot. They park alorg the road am the em of that field is wet
because it doesn't drain properly. It seems to me that our approach with the
Metropolitan Waste Control Commission is that we tell them the 20 feet doesn't
meet our standard and as long as they are upgrading the road they need to
bring it up to our city standards which to me is a 24 foot street with
concrete curb and gutter.
Gary Warren: My approach I guess is to just tell them that's what we want
replaced am let them take the initiative if that's what they will to say we
replace what we take out and what you have is a 20 foot section. I'm
certainly not going to offer that we volunteer that extra cost. We may be
able to negotiate that with them as far as easements and additional things
that relate to the whole project so I'm guessing we'll have some opportunity
to get them to be flexible.
Councilman Horn: I think we talked about this before but if water were to go
in later, would that go beside the road or through it?
Gary Warren: It could go beside the road especially if it was left the rural
section.

Councilman Horn: So that would make a difference?
Gary Warren: If we go to a full section then we would cut into more of the
right-of-way. We've got a very narrow right-of-way right now as it stands but
I guess if you have it given where you have a recently redone paved surface,
that would depend on the condition of that roadway. Whether we would go under
the roadway or go on the side.
Councilman Horn: Are you talking about a 20 foot rural section road?
Councilman Geving: That's correct. That's all that's there now.
Councilman Johnson: Would you like any comment on that as far as encouraging
finding other funding or encouraging Met Councilor somehow or another to
improve the roadway if we can talk them into it?
Councilman Geving: I think we should encourage the City Engineer and Staff to
look to the Metropolitan Council for the potential for increasing the width of
the road and hopefully fiming the funding to do that.
Mayor Hamilton: I hope that's a given that Gary is going to get as much as he
can out of Met Council. If he can get curb am gutter and an extra 4 feet of
paved, then go ahead.
Councilman Geving: I think you're right. '!hat's a given item. '!hat is
Gary's job.

Budget Preparation for 1988 is underway and we are seeking input from the
Council.
First. a few comments regarding the restriction of revenues. The new tax
law passed by the legislature this past session imposes a three percent
levy limit on all cities for payable 1988. In the past. cities with less
than 5000 in population were excluded from levy limit restrictions. A
copy of a memo from the League of Minnesota Cities is attached which
discusses the levy limits.
Also. Local Government Aid is frozen at 1987 levels. Revenue Sharing has
been eliminated and Community Development Block Grant. CDBG. funding is
becoming more restricted.

Legislature Imposes Tighter Levy Limits

The new tax law, signed by Governor Perpich on May 28, imposes a
very stringent three percent levy limit on all cities beginning
for payable 1988. Unless changed next year, the new law will
also tighten levy limits on cities in 1989 and subsequent years
as well as permanently subject small cities (with populations
under 5,000) to levy limits.
Along with the freezing of Local Government Aid (LGA) at 1987
levels, these levy limits will make city budgeting extremely
difficult. The impetus for tighter limits came from
legislators' fears that, unless unilaterally restrained, local
property tax levels would increase dramatically next year, a
result of changes in the school aid formula, the loss of federal
assistance (particularly revenue sharing) and the limits placed
on state aid through the LGA and homestead credit programs.
This memo is intended to provide detailed information about the
new levy limit law and the appeals process that is available to
cities. League staff would also like to request that, as your
city's prepares next year's budget, information about problems
caused by the levy limits be forwarded to the League so that we
can effectively argue against levy limits when the Legislature
considers changes in the law next year. This information will
also be valuable as the League meets with Department of Revenue
officlals to discuss specifics of the appeals process and to
assure that the Department plans to adhere to the full intent of
the law in administering the appeals process.
How the 1988 Levy Limit Will Work
In payable 1988, all cities (including small cities) will be
subject toa tightened three percent levy limit. The payable
1988 levy limit will be determined as follows:
1) the levy limit base is equal to: the city's payable 1987

levy (excluding amounts levied for debt service and unfunded
accrued pension liabilities) plus 1987 LGA, taconite aid, and
wetlands/native prairie reimbursements;
2) the levy limit base determined in step 1 is increased by
the percentage growth in population or in number of households,
whichever is greater, for the most recent l2-month period (if no
population growth or a population decline is experienced, the
levy limit base determined in step 1 remains the same);
3) multiply the amount resulting from steps 1 & 2 by 103%;
4) the amount determined in step 3 is reduced by the amount
of LGA, taconite aid, and wetlands/native prairie reimbursements
certified to be received in 1988;
5) Step 4 yields the 1988 levy limit except that amounts
levied for debt service, unfunded accrued pension liabilities,
income maintenance and social service programs are exempt from
the levy limit.
Appeals Process
For payable 1988 only, a city will be allowed to appeal to the
Commissioner of Revenue for an adjustment in its levy limit base
if the city "can provide evidence satisfactory to the
commissioner that its levy for taxes payable in 1987 had been
reduced because it had made expenditures from reserve funds, or
for any other reason, or that it is necessary to levy additional
amounts for taxes payable in 1988 which were not levied in
1987." Although this language is very broad and could be
interpreted liberally, it is likely that the Revenue Department
will attempt to construe it narrowly. For example, at this
point it is not clear whether the Revenue Department will allow
an adjustment in a city's levy limit base for moneys lost in
general revenue sharing or other federal or state funding.
1989 Levy Limit
For payable 1989 and beyond, the levy limit law generally
reverts to the levy limit language that was in effect for
payable 1987, with two exceptions: the inflation (implicit price
deflator) factor will be capped at 3 percent, instead of 5
percent as under prior law, and small cities with populations
under 5,000 would be permanently brought under levy limits. The
levy limit base used in determining the payable 1989 levy limit
will be equal to the base determined for payable 1988. (This
section of the new law contains a drafting error which would
exempt ~tatutory cities from levy limits; this error is likely
to be corrected next year.)
