COSTLY HAZARDOUS WASTE CLEANUP
Builders owe it to their future financial solvency to be mighty careful about the building sites they purchase. If the land
has ever served as a dumping ground for hazardous waste, the owner of the site could get stuck with a bill for cleanup
costs well in excess of the property's value. In 1986, the average cleanup of a hazardous waste site came to $12 million.
Such are the rules under the newly strengthened Superfund law administered by the Environmental Protection Agency
(EPA). It can hold any owner, past or present, liable for the problem. The potential for liability may change the way lenders
do business. They are expected to become increasingly cautious, demanding that builders and other borrowers demon-
strate the land is "clean." This will increase the cost of obtaining a loan, slow down transactions and cause disputes
between builders and lenders concerning warranties and who takes the risk.
APPRAISER CERTIFICATION
In response to evidence that poor and fraudulent appraisals have contributed to big losses on foreclosed real estate,
California and Nebraska have set requirements governing appraiser certification and accuracy. Several other states are
considering similar measures, and Congress is looking at the possibility of establishing minimum standards and qualifica-
tions for appraisers.
UNION PROTECTION BILL PASSES
The House approved a bill that bans the use of both union and non-union operations in a single area by construction
companies. The measure to curb so-called double breasting in construction work is designed to prevent what unions call a
common practice among contractors--creating non-union subsidiaries that siphon off business from higher-wage unionized
units. Construction companies bitterly oppose the legislation. They say that while it would prevent some "sham" setups,
which they insist are banned already by the National Labor Relations Board, it also would scuttle legitimate dual-shop
arrangements, in which a management has both union and non-union operations. Contractors regard such arrangements
as necessary in order to compete with totally non-union companies.
UPPER BRACKET HOUSING TRENDS
California builder Lance Mortenson has a new marketing idea in this country club development near San Francisco. He
sells million dollar homes fully furnished and set up and running with all life-support systems in place: utilities, pool heater,
cable television, Waterford crystal and a Hoover vacuum. "People don't trust their own taste," says Mortensen, "and they
are too impatient to wait three generations for taste to develop. Now they can have it in the length of time it takes a bank to
issue a mortgage." Mortenson takes the worry out of being rich.
HOME PRICE COMPARISON
For what you'd pay for a three-bedroom home in Beverly Hills, you could buy 1 0 of them in Tulsa, Oklahoma. That's one
of the findings of Coldwell Banker's Home Price Comparison Index, which tracks what a typical corporate transferee would
have paid in 1986 for a home in 136 areas of the USA. Criteria for homes in the survey: 2,000 square feet, two bathrooms,
dining area, family room, two-car garage and upscale neighborhood.
. The findings:
. The homes are cheapest in Tulsa, $74,817; Eugene, Ore., $75,000; Spokane, Wash., $78,630; and Colorado Springs,
Colo., $80,000.
. They're most expensive in Beverly Hills, Calif., $775,000; Greenwich, Conn, $520,000; San Francisco, $385,000; and
Menlo Park, Calif., $370,000.
. The average priced home in the survey is $156,208, and its value increased 9.61% in 1986.
LAND USE DECISION
Lawsuits challenging local land-use regulations could proliferate after a recent landmark Supreme Court ruling. The court
said landowners deprived of "all use" of their property because of government regulations can file suit for compensation.
Possible targets of lawsuits: flood plain, and coastal zone and environmental regulations if courts deem them to be "uncon-
stitutional takings" of land.

to order at 7:30 p.m., Monday, June 22, 1987, in the Council Chambers
by Mayor Rascop.

Stover referred to the minutes of the Planning Commission included
in the packet. The Commisslon acted on the Danser variance; the
Brentridge rez~ning from R-1A to R-1C in an area of homes on 25,000
square foot lots; and the Spaulding variance requests that were
denied unanimously.

PARK COMMISSION REPORT
Brancel reported on the review of the Silverwood Park plan. This
plan will require 20,000 cubic yards of fill. Engineer Norton has
reviewed the plan and indicated that the low areas will require 4'
of fill for the installation of a small ball park. There will also
be a ponding area.
Brancel moved, seconded by Gagne, to support the Park Commission
request to accept up to 20,000 cubic yards of clean fill. Motion
carried - 5 ayes.
CONSENT AGENDA
APPROVAL OF PAYMENT - PROJECT NO. 87-1 - SHOREWOOD OAKS
Engineer Norton recommended payment in the amount of $272,569.08 to
Richard Knutson, Inc. for Project 87-1 - Shorewood Oaks, Payment

STREET LIGHT REQUESTS: SHADY HILLS ROAD & HIGHWAY 7 FRONTAGE ROAD
AND GLEN ROAD AT UNITARIAN CHURCH
Administrator Vogt required the lnstallation for street lights as
requested by residents for: Shady Hills Road at the frontage road
of Highway 7. Also a light on Glen Road near the parking lot of
the Unitarian Church.
Stover moved, seconded b,y Gagne, to approve the above listed items
on the Consent Agenda. Motion carried - 5 ayes.
VARIANCE DENIED - DANSER - 21640 LILAC LANE
Eric Danser presented his request to add a screen porch onto an
existing non-conforming deck. ThlS deck does not meet the front
setbacks. He stated that the setbacks across the street in
Chanhassen where 301 instead of 501 as in Shorewood. The house was
built many years ago and placed in the present location that is now
non-conforming. Mr. Danser doesnlt feel the 7 x 20 screen porch
should be considered adding to the non-conformity of the house
structure. Mr. John Breckenheirner of Lilac Lane spoke in favor of
the porch addition, it goes with the architectural design of this 100
y'ear old house.
Haugen moved, seconded by Rascop, to adopt

BRENTRIDGE - CONCEPTUAL APPROVAL
Dave Johnson presented his request for reconsideration of his
preliminary plat and rezoning for the Brentridge subdivision. He
referred to the neighborhood meeting he held with the residents
around the proposed subdivision. He has reduced his subdivision
request from 26 lots to 24 lots, removing two lots from the west side
backing up to the existing homes on Howards Point Road. He feels his
project is conducive to the area. He would like to deed the balance
of the land to the City. This land could be used as a wild life
preserve or some other use.
Irene Gallagher, current property owner, referred to the neighborhood
meeting where Johnson and the neighbors agreed upon the 24 lot
proposal. Susan Sano of 5685 Howard Point Road supports the 30,000
square foot lot size (R-IB) not R-IC. Sally Brown of 5875 Howards
Point Road is opposed to any zoning change and feels the Council
should uphold the current Zoning Ordinance. Haugen asked if they had
considered when they built their home that this land would be
developed someday. Mrs. Brown stated that they anticipated some
building but not 24 homes.
The proposed iota average square footage lS 26,339 if R-IB (30,000)
only 21 lots could be developed. The existing ~otb in this area are
24,377 square feeL. It was recommended to provide two easements for
trails to access the wetland area. Johnson fe~t that 20 feet on the
north could cause one of the lots to be unbuildable.
Gagne moved, seconded by Brancel, to approve the 24 lot subdivision
to lnclude 2 accesses, for discussion. Rascop suggested 2 lots be
removed flom the west side. Nielsen stated that the rezoning should
be done prlor to the subdivlsion approval. Council discussed the
rezoning and the possibilities of the plat being dropped and returned
with lot sizes of the R-IC zoning. Also the request for an
environmental impact statement should be addressed. Gagne withdrew
hlS motion, accepted by Brancel. Stover questioned the proposed
rezoning, whether it be R-IC or R-IB and what does the area residence
prefer. Nielsen stated that ~ lots in the area would be
non-conforming if zone R-IB. ~
Haugen moved, seconded by Gagne, to grant conceptual approval subject

Attorney Joseph Finley, representing David Littlefield of 24775 Glen
Road, has requested a delay in approving the final plat of the Towne
Addition until watershed approval has been granted. He stated that
he wants the Council to follow the procedures set forth in the
Ordinances. He asked if a development agreement has been completed
and securities posted to date, drainage easement shown, grading plan
approval, and review of storage ponding area. Engineer Norton has
reviewed the ponding area and has requested verification on the
calculations from Ecoff's Engineer. Finley felt there will be added
storm water run off onto the Glen Road area due to this project. Ed
Bergslein of 24785 Smithtown Road questioned the use of the utility
areas. Nielsen stated that the setback requirement would not allow
someone to use utility easement area for buildlng. Attorney Fin~ey
felt the ponding area should be platted as an Outlot and maintain
under a nome owners association instead of one owner having the
responsibility.
Brancel asked Engineer Norton if the ponding area was adequate to
retain a 100 year rain. Norton felt the ponding did provide for
adequate retention. Mr. Littlef1eld explained the current drainage
problems 1n his area. Gagne commented on the need for a storm sewer
improvement for the Glen Road area.
Brancel moved to table the final plat approval until comments can be
obtained from the watershed or not longer than 60 days. Motion
carried - 5 Ayes.

DISCUSSION OF DISPOSITION OF CITY PROPERTY AT 5795 COUNTRY CLUB ROAD
AND OFFICE SPACE NEEDS ANALYSIS
Nick Ruehl of EOS dlscuBsed the use of the house versus adding onto
the current City Hall. He reviewed space, design, elevation
differences, vaulted ceiling - ~ighting problems, hallway and stair
width, basement height, electrical services, and mechanical needs.
Ruehl estimated a total cost for the house, link, remodeling and
additional project costs to be $185,000.00. He feels the addition to
the building is less expensive and more efficient, and there would
still be future expansion room available toward the parking lot.
Stover would like to have some additional time to review the
proposals. <

JoAnne Carroll asked if the addition could go other directions
without disturbing the parking lot. Ruehl felt there was room, but
the Council commented on the restriction of no more than 20% of
property is to be used for other than park purpose.
Brancel moved, seconded by Rascop, to authorize the staff to propose
alternatives for the disposal of the property at 5795 Country Club
Road. Motion carried - 5 Ayes.
Rascop moved, seconded by Gagne, to proceed with surveying and soil
testing. Motion carried - 5 Ayes.
SPAULDING REQUEST DENIAL - ORDER FINDINGS OF FACT
Rick McCarthy, Arch~tect, respresented Neil Spaulding of 5460 Howards
Point Road, in his request tor a Conditional Use Permit and two
variances for a substandard lakeshore lot. Mr. McCarthy reviewed the
proposed plans for accessory structures, benches, a service bar and
deck on a lot across the street from Mr. Spauldings pr~rnary lot. He
would also like to install lot line fences and a dock.
Stover stated that the Planning Commission recommended a unanimous
denial of the request. Written and verbal opposition has been
received from the Einhorns, Stinchflelds, Payne, Thompson and
Wadsworth. Some of these people have deeded easements or walking
accesses granted over thlS lot.
Mr. Spauldings Attorney, Gary Hurd, explained that the easements
would be provided for. This area would be improving the current
property and would be used for picniclng, not as buildable lots.
Hurd stated that the original propert~i access agreetlent stated that

TETON LANE AND LILAC LANE TRAFFIC FLOW SUPPORT
A letter of request has been received from the Teton Lane and Lilac
Lane Homeowners Association asking for the Council's support of their
alternative #4 to protect their propelty from added trafflc
maintenance and safety on their roads. This would be caused by a new
subdivision that would open access from thlS subdivision onto Lilac
Lane.

SPEED ZONE STUDY REQUEST - WEDGEWOOD ROAD
Brancel offered an agenda amendment to hear the speed zone request by
Mr. and Mrs. Aagaard. Wedgewood Road currently has two different
speed limits posted, 20 MPH and 30 MPH. Cheif Young has stated that
this does cause inforcement problems. Mr. Aagaard would like to see
the speed reduced in order to protect the pedestrians using that
road.
Rascop moved, seconded by Haugen, to refer this request to MnDOT for
recommendation supporting a speed reduction under 30 MPH.

Table Subdivision Reapproval - Cvcil Kerber
Nielsen requested the Council to table action on the reapproval of

ENGINEERS REPORT
Glen Road/Badger Watermain Extension Report
Engineer Norton read a report describing various methods to assess
improvement proJects. He requested that a workshop session be set
up to discuss the various methods to develop a policy on assessing.
Gagne questioned if this policy would pertain to the Badger
extension only or for ensuing projects. Rascop felt it would be
difficult to establish an overlay policy when the projects are
"piece mealed". Different type of improvements would need
different policies.
Council set the workshop session for July 18, 1987 at 9:30
a.m. (Saturday).
1987 Street Improvement Proiect
Engineer Norton would like approval to change the Street
Improvement bid date to July 13, 1987.
Gagne moved, seconded by Brancel, to approve the date change.
Motion carried - 5 Ayes.
Norton then submitted a new estimate list of costs of various road
improvements.
Council discussed budget amounts of improvements and what roads
could be completed within the budget.
Gagne moved, seconded by Stover, to accept the street improvement
project deleting Beveriy Drive and CaJed Lane, to be done next year
to al~ow for settlement due to new 1nstaliation of water utilities.
Motion carried - 5 Ayes.
S.E. Area Water Connection Status Report
Engineer Norton informed the Council that staff felt there are mOl-e
than 90 permits issued for water connections in the south east
area. The agreement with Minnetonka allows for no more than 90
water connections to their system.
Council asked what would be entailed in changing the water service
over to Shorewood's well at this time. Norton estimated $35,000 to
$40,000 to instali the necessary equipment to do the temporary
change over until the overhead water tower is in.
Gagne moved, seconded by Haugen, to d1rect the Adm1nistrator to
discuss the issue with Mr. M1ller at Minnetonka. Motion carried -
5 Ayes. Council will determ1ne what action wil~ be taken after the
meeting.

The'" City has received an estimate from NSP for excessive footage
changes for street light extension in Waterford 2nd Addition, in

1988 Budget Suggestions
Administrator Vogt asked for direction for beginning the budget
process.
Council is supportive of taking all the allowable 3% mill level
limit set. Since projects suggested were, construct salt shed, all
load improvements removed from this years l1.st should be
reinstated, possible new public works location, office expansion,
new phone system and public address system. These were some of the
Council priorities.
Union Negotiation Meeting Set
An Executive Session will be held on July 9th at 7:30 p.m. for the
purpose of Union Negotiation Strategy.
Auto-Dialer Purchase
Gagne moved, seconded by Brancel, to authorize the purchase of an
auto-dialer to be installed on the Woodhaven well, the cost is

Street Light Request - Water ford 2nd Addition
You may recall at the June 22, 1987, Council Meeting that Mason Homes
requested approval of the installation of street lights in Water ford
2nd Addition. At that time, I reported that NSP would charge $1,005.00
for the installation which is to be paid by the City. Since that
meeting, I have requested and subsequently received the check for the
installation from Mason Homes.
Approval of the installation is now recommended. A map showing the
locations of the lights is attached for your review.

guarantee period of.~~ As we have been involved in the construction
inspection and utility testing on these improvements, I know they have been
installed properly and have passed the required tests. I therefore recommend
that the City of Shorewood take over those specific utilities as listed
previously for public ownership and maintenance as of August 1, 1987. The
bond from the Contractor guaranteeing the work for a period of one year
should be received prior to August 1, 1987.
Acceptance of the remaining items, namely:
1. Curb and gutter
2. Blacktop streets
3. Boulevards
Will be considered when they finish their street work.

Our office represents Eric Danser owner of the above-described
property. It is our understanding that at the last City
Council meeting a vote was made on a variance application --
the vote was negative. We now ask that this matter be placed
upon the City Council calendar for the July 13th meeting for
considering the issuance of a permit herein pursuant to
Shorewood Code Section 200.03, Subd. 1, paragraph (k) exclusive
of any variance application previously voted upon. It is our
position that permits may be issued under the cited section
without the need for a variance.
Assuming the City Council reconsiders the matter pursuant to
the above section, I request the opportunity to address the
Council in regard to the permit application. We presume
that the materials on file with the City are adequate to
advise the City Council of the circumstances of the application.

WHEREAS,Eric Danser has applied for a variance for the
construction of a screened porch on an existing deck at the front of his
home located at 21640 Lilac Lane in the City of Shorewood; and
WHEREAS, the screened porch proposed to be constructed does not
meet the front yard setback requirements for the subject property and
therefore requires a variance to the Shorewood Zoning ~dinance; and
WHEREAS, a Public Hearing was held and the application reviewed
by the Planning Coomission on June 16, 1987; and
WHEREAS, a further review of the application was had before the
City Council at their regular meeting held on June 22, 1987; and
WHEREAS, a motion to adopt a resolution approving the requested
variance failed to obtain a 4/5 majority vote
and the City Attorney was directed by the Council to prepare findings and
conclusions denying applicant's request for a variance.

Shorewood as follows:

1. That the subject property is located in an R-lA zoning
district which requires a 50-foot front yard setback.
2. That applicant proposes to construct a screened porch within
the front yard of the subject property at a distance of 36.6 feet from the
front yard lot line.
3. That applicant's requested construct ion requires a front yard
setback variance of 13.4 feet.
4. That applicant has sufficient area at the rear of his house
to construct the proposed screened porch without need for a setback
variance.

1. That the variance requested constitutes a substantial
deviation from the requirements of the zoning ordinance.

SUBJECT: Southeast Area Water - Temporary Service
As you are aware, the City of Shorewood has a Water Service Agreement with
Minnetonka to provide water to not more than 90 residential units in the
Southeast area. There are currently 56 actual water users of Minnetonka
water in Shorewood with over 100 building permits issued.
Since our last Council meeting I have met with Minnetonka staff to discuss
this matter at which time they indicated that their concern lies with the
actual connections and not the number of permits issued. Also, I inquired
if it would be possible to at least double the number of allowable
connections. Staff indicated that this would not be possible due to the
sprinkling ban already in place in Minnetonka. In an off peak situation
such as winter, staff indicated that they may be able to favor an increase
in connections at that time.
An interconnection with Chanhassen is another possibility. However, they
too have a sprinkling ban in effect. Also, and perhaps more importantly,
the interconnection would occur in an area of the Near Mountain
Development that they will not be constructing the improvements in until
1988.
Also, we have met with all of the developers and builders in the Southeast
area to explain the situation to them. As a result of that meeting, the
developers asked the City to find out the interest to be earned on the
bond issue over and above the interest income calculated as part of the
bond issue. Of this amount, any shortage of this interest inco~e versus
the cost to construct a temporary water pumping system would be picked up
by the developers. An estimate of the cost to install the temporary
system was reported to you at your last meeting of between $35,000 and
$40,000. This estimate was obtained from the contractor building the
permanent pumphouse for the Southeast area.

It was agreed at the meeting with the developers that the temporary system
must be constructed. Staff is currently estimating the interest which
will be earned on the bonds for the Southeast Area Water System through
the final construction costs. We know the interest earned to date exceeds
the amount estimated to be earned at the time of the bond issue. Also. we
are researching whether or not it is legal to use said interest to pay for
the temporary construction expense.
Finally. if it is financially possible. and it is your determination to
construct the temporary system. it is the intention of staff to have the
same contractor do the work as is constructing the pumphouse. This work
would be authorized by change order to the contract with A & K
Construction. Inc.

The City of Shorewood has suggested that they would issue a
permit if I could get some indication from you that our plans
are in keeping with good design practice. I think you mentioned
to Mr. Backlund that this proposal would not require a formal
review by your board.

Several weeks ago our office received a complaint from residents of Amesbury
West that the boulevard along the west side of Bayswater Road (see Site
Location map - Exhibit A. attached) had been disturbed during installation of
utilities for a new home located at 20600 Garden Road and that the boulevard
had not been restored. They talked to the homeowner. Mr. Jerry Peterson. who
indicated that he had no intention of restoring it. and that he preferred a
more natural style of landscape on and adjacent to his property.
The Amesbury residents have requested permission to restore the boulevard and
maintain it (water and mow the grass) similar to how its being maintained on
the east side of the street. I advised them that if I could not convince the
owner to do it. I would check with the City Attorney to see if there was any
legal reason why they could not maintain the boulevard themselves. The
Attorney advises that we do not have any regulations relative to this issue.
He states that it is cammon practice for the adjoining property owner to
maintain the boulevard portion of the public right-of~ay in front of his
house. However. he sees no legal problem with allowing the Amesbury Homeowners
Association to provide a higher level of maintenance than what Mr. Peterson or
the City are willing to provide. He advises that the authority to maintain the
public r.o.w. should only be delegated by the City Council. Consequently. this
issue is scheduled for consideration at Monday night's meeting.
Amesbury residents will undoubtedly be there to state their position relative
to the level of maintenance which should be provided for the boulevard of
Bayswater Road.

Mr. Peterson objects to anyone other than the City maintaining the r.o.w.
adjacent to his property. He also feels that Amesbury is trying to impose
their taste on his side of the street. He may not be able to attend the
meeting on Monday. so we've asked him for a letter. elaborating on his
position.
This problem is not likely to be easily resolved. The only thing the staff can
suggest is that the City should consider the plans which were originally
approved for Bayswater Road. If they showed a seeded or sodded boulevard.
perhaps this is how it should be maintained. The Council will still have to
determine what level of maintenance is appropriate. The Engineer will be
prepared on Monday to inform us how the road was originally planned.
If there are any questions or if the Council would like additional information.
please do not hesitate to contact my office prior to the meeting.

BACXGROUND
Mrs. Jean White is the owner of Lots 5. 6 and 7. Block 1. Ball's Addition to
Excelsior (see Site Location map - Exhibit A. attached). In the past the
lots were legally combined as one tax parcel. Mrs. White now proposes to
separate Lot 5 from the other lots to create another building site to the
north of her existing home at 5865 Glencoe Road. The division is shown on
Exhibit B.
The subject property contains approximately 41.336 square feet of area and is
currently zoned R-1D. Single-family Residential. The new lot will contain
13.208 square feet of area. The remaining parcel with the existing house on
it will contain 28.158 square feet.
ANALYSIS/RECOMMENDATION
As can be seen on Exhibit B. the southerly lot line of the new lot does not
quite coincide with the old lot line. This is due to the location of Mrs.
White's existing garage. Angled northward as it is shown. a lo-foot setback
is maintained between the garage and the lot line. The new lpt meets both
the width (75') and area (10.000 square feet) requirements of the R-1D
district.
Mrs. White's application requests the separation of Lot 5 from Lots 6 and 7.
Her survey. however. provides legal descriptions for only L.ot 5 and Lot 6.
If this was an oversight. it is simply a matter of adding Lot 7 to the legal
description for Parcel B. If Lot 7 is intended to be separated from Lot 6.
the application should be revised as such. The lot is wide enough and large
enough in area to be a separate building site. If it is to be separated. the
shed on Lot 6 (Parcel B) must be moved northward to comply with the 10-foot
side yard setback requirement.

It is recommended that the proposed division be approved subject to the
following:
1. The applicant must provide an up-to-date (within 30 days) title opinion
for review by the City Attorney.
2. The applicant must provide drainage and utility easements 10 feet along
each side of each side and rear lot line.
3. Prior to release of the Council resolution approving the division. the
applicant must pay park dedication fees - $500 if one new lot is being
created. $1000 if two new lots are created.
4. The above-mentioned items must be completed within 30 days of the date of
Council approval.
5. The applicant must record the division with Hennepin County within 30
days of the date she receives the Council resolution approving the
division.

BACKGROUND
Pursuant to Section 200.03 Subd. 2d. (4) of the Shorewood Zoning Ordinance.
Mr. James Simondet has requested a conditional use permit to build an
addition to his garage which will put the total area of accessory space on
his property in excess of 1000 square feet.
The subject property is located at 5390 Shady Hills Circle (see Site Location
map - Exhibit A. attached) and is zoned R-1C. Single-family Residential. The
proposed addition is shown on Exhibit B. attached. Mr. Simondet proposes to
convert approximately 154 square feet of his existing two-car garage into
living space. then build a 28' x 30' addition on the north side of the
house. At the rear of the new space. he proposes to build an 8' x 28' three
season porch. The resulting total area of accessory space is 1115 square
feet.
ANALYSIS/RECOMMENDATION
The existing house is technically a nonconforming structure. Since the north
end of the lot is narrower than the west side. the north end is the front of
the lot for purposes of determining setbacks. Consequently the house is 17
feet too close to the rear lot line (south end).

Expansion of nonconforaing structures is allowed. subject to the requireaents
of Section 200.03 Subd. 1k.. the most significant of which is that the
nonconformity can not be increased. That section also states that where a
setback discrepaney exists the City may require that it be aade up on the
opposite side. The applicant's addition complies with this requirement.
Whereas the total setback area for front and rear yards in the R-1C district
is 75 feet. the subject property will have a total of 77 feet.
The Zoning Ordinance contains four specific criteria which must be met in
order for the C.U.P. to be granted. Following is how the applicnt's request
complies with these requirements. ·
a. The proposed accessory space (1115 square feet) does not exceed the
footprint area of the principal dwelling (1844 square feet).
b. The total area of accessory space does not exceed 10 percent of the
minimum lot area for the R-1~ district (10% x 20.000 sq. ft. =
2000 sq. ft.).
c. Despite the nonconformity of the existing house. the proposed addition
fits well on the site. Following is how the addition complies with R-1C
setback requirements:

d. The proposed single-story. hip roofed addition is considered to be
consistent with the architectural character of the existing building.
In view of the preceding the applicant's request is considered to be
consistent with the requirements of Shorewood's zoning requirements. While
the applicant has indicated that the proposed garage is intended for strictly
residential use. the City should be concerned with the potential for future
use in some kind of home occupation. We have already received two calls from
neighboring residents concerned with this possibility. In this regard. the
C.U.P. should advise the applicant that the City has specific regulations
relative to home occupations and that any future use of this nature must
comply with such regulations.

BACKGROUND
Mr. Michael McDonald proposes to add a second level to his existing home at
4695 Lagoon Drive (see Site Location map - Exhibit A, attached). Since the
house does not meet current setback requirements, it constitutes a
nonconforming structure. The addition will increase the nonconformity,
necessitating a variance.
The property is located in the R-1C zoning district and is also subject to
shore1and management regulations. As can be seen on Exhibit B, attached, the
subject property forms a penninsu1a of land which extends into a small lagoon
on Lake Minnetonka. The existing house contains approximately 1200 square
feet of area in a single story. Mr. McDonald originally planned to add a
second story above the existing house. Based upon the recommendations of his
soils engineer, however, he now intends to jack up the existing structure and
build a basement under the house. The result is that rather than seeing a
full additional story, the house will appear half a story higher. The
applicant also proposes a future deck across the south side of the house
which does not require a variance, plus an 8' x 8' entry porch on the north
of the house which requires a 12 foot variance. The applicant's building
plans are shown on Exhibits C and D.
ANALYSIS/RECOMMENDATION
As shown on Exhibit B, the 50 footlakeshore setback renders very little
buildable area. Approximately 46 percent of the existing house encroaches
into the required setback.

Based upon the criteria for evaluating variances contained in Section 200.05
Subd. 2 of the Shorewood Zoning Ordinance. the variance appears to be
justified. Specifically. the configuration of the lot and proximity of the
lakeshore make the lot virtually unbuildable. The soil condition described
in the applicant's soil report also justifies the variance. Finally. by
going down with the structure rather than up or out. the variance is
minimized. The result is considerably less visual impact as the property is
viewed f rom the lake.
In view of the preceding. the applicant's request is considered reasonable
and consistent with the provisions of Shorewood's Zoning Ordinance. Approval
is therefore recommended.

BACKGROUND
Mr. Paul Seifert has requested approval of a setback variance to expand the
house located at 20780 Radisson Inn Road (see Site Location map - Exhibit A.
attached). As explained in his request letter (Exhibit B. attached). Mr.
Seifert proposes to build a 25' x 25' addition with a tuck-under garage
beneath it on the north end of the existing structure. Due to the limited
buildable area of the subject property (shown on Exhibit C). the applicant
has requested a 17-foot variance.
The subject property contains approximately 10.296 square feet of area and is
zoned R-1C. Single-family Residential. The existing building measures 25' x
25' and contains 900 square feet of living area on two floors. The northeast
corner of the building encroaches approximately three feet into the front
yard setback. making it a nonconforming structure.
ANALYSIS/RECOMMENDATION
Section 200.05 Subd. 2 of the Shorewood Zoning Ordinance contains criteria
for the evaluation of variance requests. Based upon these criteria. the
applicant's proposal appears to have merit. Both the configuration and the
shallowness of the parcel are specifically mentioned in the criteria for
variance.

It should be noted that Mr. Seifert's letter mentions the possibility of
adding on to the south end of the building. As can be seen on Exhibit C. the
rear yard setback precludes building in that direction without a variance.
If the addition were built on the rear. the necessary variance would be
considerably greater. The applicant's comment relative to topographical
constraint is also considered quite valid. Considerable site alteration
would be required to build anywhere else on the lot.
In his letter Mr. Seifert references photographs of neighboring properties.
While we are not able to reproduce the photographs. they will be available at
the meeting for your review. The Planning Commission and Council may wish to
visit the area in question to see how the proposed addition relates to the
neighborhood.
The existing building is quite small. If the Planning Commission and Council
feel that enlarging it is reasonable. it is important to note that no other
way exists to do so without a variance. Since the variance is not considered
to be primarily economic in nature. nor is the situation the result of any
action by the owner. it is recommended that the variance request be favorably
considered.
