Right of Entry Agreement - Tower Site
Attached you will find a Right of Entry Agreement which has been executed
by Robert H. Mason on behalf of Trivesco. The Agreement gives the City
access to the site for the Southeast Area Water Tower. This Agreement
is necessary due to the fact that the roadway known as Old Market Road
terminates just prior to the Tower Site. Also, the property adjacent to
the site is unplatted.
It is recommended that a Resolution be adopted which approves the Agreement
and authorizes the Mayor and City Clerk to execute the Agreement on behalf
of the City.
This item appears on the Consent Agenda of your October 26. 1987, meeting
for your consideration.

WHEREAS, the City desires to commence construction of said road and
utilities across said lands immediately.

stated, the parties agree for themselves, their administrators, personal
representatives, heirs, successors, and assigns as follows:
1. Onners hereby grant to the City the right and privi lege of entry
upon the tract of land described in attached Exhibit A, for the construction of
a road and utilities.
2. The City agrees that all electrical service brought across the
property described in Exhibi t A shall be underground and wi 11 be brought in
from the south if possible.
3. The city further agrees that no major clearing, grubbing or
grading work will be done north of the south 90 feet of the property described
in Exhibi t A.
4. It is understood that this Right of Entry shall continue until
such time as Old Market Road is platted as a public road providing public
access to the property described in Exhibit B.

Re: Lake Virginia Lift Station and

Dear Dan:
We have reviewed the plans for the lift station and forcemain relative to any
impact the construction will have on public and private facilities. The plans
have not been reviewed from a structural engineering or hydraulic engineering
concern because the proposed facil ities are not City owned, maintai ned or
operated. The following comments are referenced to the lift station plans and
the forcemain plans, respectively.
1. Lift Station
A. No reference is made to any erosion or sediment control measures to
prevent materials from reaching Lake Virginia. This must addressed.
B. The site plan appears to have been modified to meet the City's
landscaping wishes. Please check the enclosed photo copy to verify
this.
C. The noise and odor contrnl requirements of the Conditional Use Permit
will be addressed directly by the M.W.C.C. and are not addressed in the
plans and specifications.
2. Force Main
A. One or more substantial trees will be removed or harmed to some extent
on the R.T. Bowlen property (North side of Town Road - Property LV-3;
Plan Sheet 7). Proper notification and easements are required for any
work on private property.

B.. The West 62nd Street north half right-of-way is owned by the City of
Shorewood. The south half right-of-way is not owned by the City of
Victoria, but by private owners. The City of Shorewood will pay for
their half of the proposed upgrade in the street section, but only if
the City of Victoria or others will pay for the Victoria half.

Shorewood will not be liable for the upgrading of the full right-of-way
width for West 62nd Street. If the City of Victoria or others do not
have sufficient funds to pay for the upgrade on thier half the City of
Shorewood requests that the street be replaced as is.

projects contractor and will be paid for out of project funds.

SUBJECT: Proposals to Demolish House at $620 County Road 19
As you may be aware, on October 19 the City had the authority to go on.
. the property at 5620 County Road 19 to demolish the house. At your
meeting held on October 13, the Council opted to have the house torn
down rather than burned.
I have obtained thre~(3) quotes to do said work. Each quote includes
demolition pf the house, disposal of debris including footings and slabs,
cap sewer line, fill hole and grade. The q~otes are as follows:

Grouting the well and capping was discussed. The cost of this work was
included in the quote from Scott Zdr~zil. Merle Yolk stated that this work

Based on this information, it is recommended that the proposal from
Scott Zdrazil be accepted provided that a performance bond or other
acceptable bid security be provided along with a certificate of insurance.

BACKGROUND
In January of this year a public hearing was held to consider expanding the
City offices into the house located south of the existing City Hall. The
Planning Commission questioned whether enough study had been done to
determine whether converting the house to office space was the best long term
solution for expanding the City offices. Questions were raised as to how
much space was needed - both long and short term. architectural compatibility
of the two structures. and. to some degree. the potential impact on the
surrounding neighborhood. The Commission's recommendation to the Council was
that the conditional use permit should not be approved. and that the Council
should hire an outside source to prepare a needs analysis to determine how
much space would be needed in the future and to present possible alternatives
to using the adjoining house.
Based upon the Commission's recommendation. the Council hired an
architectural firm. EOS Corporation. to prepare the study. Excerpts from
that study are attached as Exhibit A. Although the amount of space
determined to be necessary was almost the same as that which was provided by
the house. the architect has convinced the Council that adding new space
would be more efficient and cost effective than remodeling the house. Plans

The proposed addition will add 1600 square feet of office space to the main
floor ~f the building. The existing basement will also be expanded by 1600
square feet. A proposed site plan. floor plans. building elevations and

ISSUES AND ANAYLSIS
Representatives from EOS Corporation will be at the public hearing scheduled
for 20 October to present the plans for the proposed office expansion. They
will be prepared to answer any questions the Planning Commission or public
may have relative to the building or the needs analysis.
From a zoning perspective. Section 1201.11 Subd. 4a. of the Zoning Ordinance
allows governmental buildings as a conditional use in the R-1C zoning
district. The only specific condition for such use is that the property
should be screened and landscaped when abutting residential property.
Landscaping is but one of many issues raised in the staff report prepared for
the original expansion proposal. dated 16 January 1987. That report
suggested that the City correct existing zoning deficiencies on the City
Hall/Badger Park facility in conjunction with any plans for expansion. This
approach is similar to how a private development request would be handled.
Following are zoning provisions with which the City Hall property does not
comply.
A. Zoning Requirements (Section 1203 of the Shorewood City Code).
1. Subd. 20. requires outdoor storage to be screened from adjoining
properties.
2. Subd. Sd. (8)(f) limits curb cuts to 25 feet in width except where
approved by the City Engineer.
3. Subd. Sd. (8)(g) requires driveways to be at least five feet from
property lines.
4. Subd. Sd. (8) (l) requires concrete curbing around nonresidential
parking areas.
5. Subd. Sd. (8)(m) requires curbing around existing metal buildings.
6. Subd. Sd. (8)(n) requires parking areas to be striped.
7. Subd. Se. provides for the maintenance of parking. curbing and
landscaping.
8. Subd. Sf. (1) states that parking must be set back from the street
r.o.w. 35 feet.
9. Subd. Sg. precludes uSe of required parking area for outdoor storage.
10. Subd. Sh. requires 36 parking spaces for the City offices and 50
spaces for Badger Park.
11. Subd. 7 precludes metal buildings.

Limitations on Use of Badger Park
In addition to the issues enumerated above. it should be realized that the
City' suse of Badger Park property is limited. When the proI>;~rty~as
originally purchased. 80% of the money used was from the park fund. Since
there are very specific statutory requirements relative to the use of park
dedication. nonrecreationa1 use of the park property is limited to 20%. The
Park Commission as well as area residents were assured that the City Hall and
public works facilities would not further encroach into the park. Currently.
nonrecreationa1 use of the site occupies approximately 18% of the area. This
suggests that any further expansion of the Public Works Department or City
Hall will be quite limited.
It is worth noting that the City Council has directed the staff to begin a
needs analysis for the Public Works Department. This study will be conducted
in the next several months.
RECCI1MENDA TION
While the focus of attention is currently on the proposed addition. it is
recommended that the City not lose sight of the need for overall improvements
of the existing site. The recommendations contained in the 16 January staff
report are still considered valid. The following improvements should be
programmed in conjunction with the expansion project.
1. Parking areas should be curbed. striped and landscaped. Landscape
islands not only provide definition to the parking lot but partially
screen the public works area from City Hall. Striping will increase the
capacity of the parking lot. The parking lot should not be used for
outdoor storage.
2. By observing the front yard setback for parking. additional green space
can be achieved. Driveway access points should also be narrowed and
better defined.
3. Installation of an opaque screen on the north side of the tennis courts
will block the view of the public works facility from nearby residences.
It will also enhance the atmosphere for tennis players.
4. Additional evergreen trees should be planted along the southerly edge of
the park to break up and screen the view of the park and public works
facilities from adjoining residential property.
5. It is suggested that a four foot earth berm be constructed along the
secondary access drive on the north side of the park. In addition a
five-foot wooden fence should be erected as a visual barrier for the park
and residential property to the south. The south side of the fence
should be landscaped to soften the effect of the fence and eventually
increase the height of the. screen. The berm and fence will create an
enclosure for an outdoor storage area for public works.

6. The plan suggests that the northernmost corner of the site may be useable
for public works storage. The Public Works Director questions the
useability of this area for efficient storage. The Park Commission has
subsequently suggested the possibility of additional parking for the park
in that location.
7. The existing hockey rink will have to be moved southward to accommodate
the proposed berm.
These recommendations are highlighted on Exhibit F (obviously.
recommendations regarding the house south of the City Hall should be
disregarded). It is recommended that these improvements be listed as
conditions of approval for the C.U.P.
In order to ensure that these improvements are implemented. the City should
begin to incorporate them into a capital improvements program. Some of the
improvements are quite inexpensive (e.g. planting evergreens. installation of
tennis court screen) and should be done immediately. Improvements relative
to the Public Works area may be delayed pending outcome of the needs
analysis.

Solution: Provide adequate area and equipment to accomodate future use of computers at
each workstation.

Eauioment: There has been little standardization of equipment purchases over the years.
Desks. files. chairs and other equipment do not relate in material, style, or color. Also the
existing phone system has limitations for expansion.
Solution: Establish standards for all new equipment Items and begin replacing old equipment
as budget allows. Paint files and other metal equipment items to coordinate colors.
Install a new phone system that will meet the current and future needs of City Hall.

Aesthetics: There are too many colors, patterns and textures within the interior spaces due to
the variety of equipment and finishes.
Solution: Since remodeling will affect the existing space. the new carpet and wall coverings

After review of design alternatives which addressed current and future space needs, the City Counc.
directed us to proceed with providing adequate space to handle a staff of twelve people on the main
level.
To accommodate the staff and supporting spaces, an addition of 36 feet by 44 feet (1584 sq ft) is
needed. Also, remodeling of the existing space is necessary to provide for more efficient use of space
and better aesthetics.
The lower level of the addition will also be 24'x44' and will be designed to convert into useable space.
Approximately 50% of the wall area will be available for window locations.

Wetland drainage across North America is largely responsible for
decreasing waterfowl numbers in this century. In response to these
trends, concerned landowners have increasingly become interested in
i~proving their property for waterfowl. Although restoring a drained
wetland is AL~~YS the most preferred option, excavation within hiqh
~ater table areas to create small potholes is another commonly applied
improvement technique. Because ducks and geese use sma 11 i so 1 ated open
water area for mating activities and establishing nesting territories,
these potholes or "dugouts" can be beneficial to waterfowl IF they are
properly constructed. Dugouts are valuable for these activities if
natural small wetlands are lacking in the area, and are particularly
beneficial fer brooding sites if constructed in sufficient size.

The purpose of this brochure is to describe how and where dugouts
should be constructed for maximum waterfowl benefit. Guidelines
presented are general. For actual specifications. professional
assistance should be sought.
When are Duaouts a Good Idea?
-
Before t~ckling a dugout project. the landowner must decide if the
project will be feasible and beneficial; both for him- or herself and
for waterfowl. Constructing a dugout that won't hold water. destroys a
natural wetland, or isn't used by wildlife is a VERY expensive mistake.
Even a small dugout can cost in excess of S800.
To determine if the project is wise, the landowner should seek
advice on vlhether a dugout is feasible from a qualified professional
concerning project site, soil types and water availability. Good
dugout locations should have clay or peat soils, or both, and a
reliable water source. If the water table is near the surface, a
dugout will almost always hold water regardless of the soil type.
Water levels during the breeding season must be consistently high in a
dugout to attract waterfowl. Local USDA Soil Conservation Service
(SCS) staff are trained to answer such questions. Their offices are
located in Waconia, Farmington~ Wayzata, and Jordan for Carver, Dakota,
Hennepin and Scott Counties, respectively. The Department of Natural
Resources (DNR) Area Hydrologist should also be consulted at this stage
to determine if the project site is a protected wetland, v.Jater, or
watercourse. You may also need approval for the disposal site of the
excavated soil. Their address and phone number is provided at the end
of this brochure.

Besides being feasible, a dugout project should provide other
ingredients which may be lacking in the area to be beneficial to
~Iildlife. For waterfowl there must be good nesting cover in addition
to many pair territories and brood-rearing wetlands in the immediate
vicinity. Grasslands. old fields, and islands make good nesting sites
if the cover is not cut or disturbed before August and are within

o~e-half mile of the dugout. Cavities in large hardwood trees such as
elm, ~!~le,cr hasswood, or construct~d nest box~s, in t~e absence of
natural sites, also provide nest locations for wood ducks. After
hatching, the brood needs temporary to semipermanent wetlands for food
and cover. The best brood-rearing areas provide a variety of wetlands,
however, the focal point are semipermanent wetlands, two acres or more
in size exhibiting a good amount of emergent and submergent vegetation
interspersed with open water. Dugouts should be within one-quarter
mile of this type of brood-rearing wetland to be really beneficial. If
your dugout project has been determined to be feasible by the SCS
technician and meets the above two location requirements, there is good
potential for your project.
People are sometimes interested in improving wet areas which go
dry during the summer. Actually, these temporary wetlands are
extremely valuable AS THEY ARE for nesting hens. These sites produce
high quantities of insects vital as food to the hens. Any attempt at
modifying these wetlands will probably decrease their value to
waterfowl and should be discouraged. If in doubt, consult your local
DNR Wildlife Office for assistance.
How Should n~gouts be Constructed?
Or.ce you've determined you have a high-potential project, you must
decide what the dugout will look like. Things to consider are size,
shape, c:~th. bottom contour, and treatment of surrounding uplands.
Each of th!se strongly affects waterfowl use of dugouts. Let's look at
each of :h~s~ factors and discuss how to make it most attractive to
waterfowl.
A. Size - Dugouts should be no smaller than 2000 square feet in
size (1/25 acre) with a minimum width of 30 feet. No size is
really too large for wildlife, but costs get quite high. Some
experts say that several adjacent small dugouts are better
than one large pond, if your desire is to provide more breeding
territories. S~acing between dugouts should be at least 200
feet except in heavy emergent cover where they can be much
closer.
B. Depth- The maximum desirable depth for dugouts is four feet.
Deeper water discourages plant growth and may encourage rough
fish survival. Most of the basin should be less than two feet
deep. This keeps food within the reach of dabbling ducks.
Shallow dugouts of this sort with a maximum depth of four feet
will allow desirable emergent vegetation growth and have
sufficient depth for muskrats. Muskrats function to keep
cattail growth checked. This is discussed more in the next
section.
C. Shape and bottom contours - Mated waterfowl are territorial
and tolerate very little interference from other pairs of the
same species in their area. A pothole with an irregular shore-
line provides more pairs isolation from each other than

potholes with a straight shorel ine. The three sketches belo',",

rectangular designs.
The sket~hes alsQ show contour lines (one. foct interval) to
get the i:eal water depths for waterfowl. Shallow water area
is maximized, but a four foot "hole" is provided allowing'
muskrats to survive over winter. Spoil from the dugout should
be spread over the existing upland. leveled to a maximum height
less than three feet, and seeded immediately to grass (i.e.,
reed ca~:ry), or a grass-legume mixture (wheatgrass, switch-
grass, a1falfa) depending on the soil type. (Alternatively
spoil may be removed by truck from the area.) Black dirt
should be placed on the bottom of the dugout to encourage

D. Surrou~dii;g upland - Dabbling ducks, as well as many other
animals, need grassy cover to nest. Large blocks of undis-
turbed cover next to good wetlands provide ideal nesting
territory for ducks. On larger brood-rearing dugout projects,
four 2:res of upland nesting cover should be included for
every or.e acre of wetland created. If small dugouts are
being constructed for breeding territories, the amount of new
nest cove~ should be determined by its availability for the
natural jrooding area that the landowner is trying to enhance.
Native grasses or planted grass-legume mixtures are best for
nestir.g c~ver. This includes species like tall and inter-
mediate ~heatgrass, switchgrass, and alfalfa. It is best to
mow this every four years (after August 1) once it is estab-
lished. This keeps the cover healthy and dense. Grazing
should not be allowed in this cover.
E. Techniques - Three methods have typically been employed for
constructing dugouts: blasting. draglines, and bulldozing.
Blasting may be applicable in some cases, however, resultant
dugouts generally tend to be too deep for waterfowl and the
side slopes are too steep and tend to slump or erode. Also,
damage to surrounding property may result from the shock of
the explosion. This type of work is very dangerous and, if
used, should be done only by a licensed blaster. Draglines
must be used in some wet or boggy situations, but the.costs
tend to be quite high. Generally. the best method of con-
structing dugouts is by using a bulldozer. Costs are moderate
and the design of the dugout can be insured.

Costs a~c nth~r Considerations
Anyone interested in constructing their own dugout must eventually
consider.. the cost of construction. In 1934, a typical 1/4 acre dugout
cost anYhhere between $800-$1400 to excavate. Costs vary dependin~ on
the co~~r=ct~r. soil wetness, site accessibility and project
sp~cificat~c15. It is wise to get estimates from several contractors
before sele~:i~g one. In the past, the Department of Natural Resources
w?s able to sr.:re construction costs for dugouts. Currently, however,
little ~on=j is available for wetlands projects and the high cost of
dugouts (vers~s impoundments) usually rules out DNR cost-sharing. In
some cases, th? local USDA Agricultural Stabilization and Conservation
Service (ASCS) office can offer cost-sharing assistance, and. should be
consu 1 tea.
Finally, any work done in a state Protected Waters, Wetlands, or
\Jatercourse requires a DNR permit. Several additional restrictions and
specificaticns may apply. Your local Wildlife Manager and the ONR
Division 07 ~aters can provide further information about this.

We have reviewed the submitted drawing and City Planner comments concerning the
John Pastuck Wetland Alteration Permit request. The following items should be
addressed by the applicant:
1. A detailed grading and erosion control plan should be submitted to the
City for staff review and approval prior to beginning the project (as
per City Planner Memo). Of major importance to the project is the
disposal location of the dredged material. If the dredged material is
to be sidecast into adjoining wetlands or if the spoils are to be
removed and placed on the "highlands" or "uplands" area determines
which permits must be applied for and ultimately permit approval. The
Grading and Erision Control Plan should show in detail:
a. A site survey showing existing and proposed contours, clearly
defining cut and fill areas.
b. Types of vegetation to be planted and method of planting in the
fill areas.
c. The location and installation details of a silt fence which is
placed around the dredged material allowing water to drain back to
the wetlands while holding back the solids.
d. On the Erosion Control Plan, a contact person with phone numbers
who is resopnsible for the maintenance of the silt fence.
2. Permit applications should be made to and according to the fol1o~ing
criteria:
a. A Minnehaha Creek Watershed District Permit must be applied for.
The Watershed District requires a permit for any work done in a
wetlands area greater than 1/2 acre. The wetlands area in
question is approximately 0.9 acre, according to the submitted

drawing. The Watershed District's main concern is the disposal
location and erosion control measures taken. The contact person
. for the permit is Kevin larson, E. A. Hockock and Associates, 545
Indian Mound, Wayzata, Minnesota 55391, phone 473-4224.
b. A State of Minnesota Dep~tment of Natural Resources Permit is not
required because the wetlands in question is not a designated DNR
wetland.
c. An Army Corps of Engineers Permit Application must be filed only
if the dredged material is to be sidecast into the adjoining
wetlands area. If the dredged material is to be placed on the
surrounding highlands or trucked off site, an Army Corps of
Engineers Permit is not required.
3. According to the Comprehensive Storm Water Study (January 1975), the
wetlands in question is part of the Carson Bay District and has 1-1/2
acres of water surface area at elevation 978. The natural overflow is
to the southeast over elevation 993. This restricts the building of
homes in the area to have a basement elevation higher than the 993
elevation unless a constructed outlet (culvert or ditch) provides a
lower outlet.
4. The property owner directly east of the Pastuck property should be
informed of the proposed pond construction and its effects on the
wetlands on his property. The pond construction could be viewed as a
detriment to his property value. Written permission should be
obtained by all property owners of this wetland and the City should
receive copies of such.

Dear City Officials:
The Brentridge Development proposes the installation of 6 inch watermain off of
an existing stub on Smithtown Road, north. along Howards Point Road, thei1. east,
north and west through the development on Brentridge Drive back to, Howards Point
Road where it would be plugged until future development occurs. The City
Engineer has proposed that the Developer install 12 inch watermain in lieu of the
6 inch watermain throughout the project to provide the required water for future
de~elopment to the north and west.
As shown on Attachment A, the difference in cost between the installation of 12
inch or 6 inch watermain from Smithtown Road to Brentridge Drive is $3,292.00.
As shown on AttachmentB. the difference in cost between 1,2 inch or 6 inch
watermain installation throughout the entire Brentridge Development project is
$23,685.00.

WHERFAS, Otristmas Lane/Otristmas Lake Road (the street) is a
public street in the City of Shorewoad connecting County Road 82 with State
Highway No.7, both arterial highways; and
WHERFAS, the street passes through a residential neighborhood in
the course of interconnecting the two arterial highways; and
WHERFAS, the Ci ty has detennined that the through traffic on the
street has created a safety hazard to the residents of the area and has
ordered that the street be closed to through traffic; and
WHERFAS, the City has further detennined that such street closure
can best be effected by the construction of a cul-de-sac on Otristmas Lane
approximately 150 feet east of its intersection with Brand Circle; and
WHERFAS, Peterson is the owner of certain land legally described
in Exhibit A, attached hereto and made a part hereof, and has offered to
donate a portion of such land to the City for the purpose of constructing
such cul-de-sac; and
WHERFAS, a>8 has offered to pay all costs incurred in connection
with the closure of such street and the construction of such cul-de-sac.

City the land required for the construction of said cul-de-sac as shown in
the plan attached hereto as Exhibit B.

install and perfonn all work and furnish all materials and equipnent in
connection with the closure of Otristmas Lane and the construction of a
cul-de-sac thereon, to include the following:

installed in accordance with engineering plans and specifications approved by
the City Engineer and the requirements of applicable City ordinances and
standards, and that all of said work shall be subject to the supervision of
the City Engineer.
5. M<\TERIALS AND I..A'OCR. All of the materials to be mployed in the making
of said inprovements and all of the work performed in connection therewith
shall be of uni fonnly good and workmanl ike qual i ty, shall equal or exceed
City standards and speci fications, and shall be subj ect to the inspection and
approval of the City. In case any materials or labor supplied shall be
rejected by the City as defective or unsuitable, then such rejected materials
shall be removed and replaced with approved material, and rejected labor
shall be done anew to the satisfaction and approval of the City at the cost
and expense of (])S.
6. S<lIEUJLE OF w:EK. (])S shall subnit a wri tten schedule indicating the
proposed progress schedule and order of coopletion of work covered by this
Agreement, which schedule shall be a part of this Agreement. Upon receipt of
wri tten notice fran (])S of the existence of causes over which (])S has no
control, which wi II delay the coopletion of the work, the City, at its
discretion, may extend the dates specified for coopletion.
It is understood and agreed that the work shall be fully coopleted
by , 1987.
7. PLANS AND SPEX::IFICATIrnS. (])S agrees to cause its engineers to prepare
all plans and specifications necessary for the installation of all
inprovements set forth in Paragraph 3 above, said plans and specifications to
be subject to the final approval of the City Engineer.
8. REIM3URSElVENl' OF CDSTS. (])S shall reinburse the City for all costs,
including reasonable engineering, legal, planning and adninistrative expenses
incurred by the City in connection with all matters relating to the
adninistration and enforcement of this Agreement and the perfonnance thereof
by (])S. Such reinbursement shall be made wi thin fourteen (14) days of the
date of mailing of the City's notice of costs to the address set forth in
Paragraph 18 below.
9. DISCIAIMER BY CI'IY. It is understood and agreed that the City, the City
Counci 1, and the agents and mployees of the Ci ty shall not be personally
liable or responsible in any manner to (])S, (])S's contractors or
subcontractors, materialmen, laborers, or any other person, finn or
corporation whansoever, for any debt, claim, demand, damages, actions or
causes of action of any kind or character arising out of or by reason of the

execution of this Agreement or the perfonnance and cmpletion of the work and
irrprovements hereunder; and that (DS will save the City, the City Council,
and the agents and mployees of the City hannless fran any and all claims,
damages, demands, actions or causes of action arising therefran and the
costs, disbursements, and expenses of defending the same.

10. WRITIEN 0lAN]E aIDERS. (DS shall do no work and furnish no material for
which reinbursement is expected fran the Ci ty unless a wri tten order for such
work or materials is received fran the City. Any such work or materia.ls
which may be done or furnished by (DS without such written order fi~st being
given shall be ~t ~ its riSk" cost and expense and (DS hereby agrees that
without such written "hrder, (DS wi 11 make no claim for coopensation for work
or materials so done or furnished.

11. PER.R:H\1AriK:: <I1ARANI'Y. For the purpose of assuring and guaranteeing to
the City that the irrprovements to be constructed, installed and furnished by
(DS, as set forth in Paragraph 3 above, shall be constructed, installed and
furni shed according to the terms of thi s Agreement, and to ensure that (DS
shall pay all claims for work done and materials and supplies furnished for
the perfonnance of this Agreement, and that (DS shall fully cmply wi th all
of the other terms and provisions of this Agreement, (DS agrees to furnish to
the City either a cash deposit or an irrevocable letter of credit approved by
the City in an amount equal to 150% of the total cost of said improvements as
estimated by (DS's engineer and approved by the City Engineer.
12. REPLACE\1ENI'. All work and materials performed and furnished hereunder
by (DS, its agents and subcontractors, found by the City to be defective
within one year after acceptance by the City, shall be replaced by (DS at
(DS's sole expense.
13. LIABILIlY INSURANCE. (DS shall take out and maintain during the life of
this Agreement public liability and property damage insurance covering
personal injury, including death, and claims for property damage which may
arise out of (DS's work or the work of its subcontractors, or by one directly
or indirectly mployed by any of them. This insurance policy shall be a
single limit public liability insurance policy in the amount of
$1,000,000.00. The City shall be named as co-insured on said policy and (DS
shall file a copy of the insurance coverage with the City.
Prior to cannencement of construction of the irrprovements described in
Paragraph 3 above, (DS shall file with the City a certificate of such
insurance as will protect (DS, its contractors and subcontractors fran claims
arising under the workers' cmpensation laws of the State of Minnesota.

14. ~ OF IMPIVVEVJENI'S. Upon cmplet ion of the installat ion by (DS
of the irrprovements set forth in Paragraph 3 above in accordance wi th the
plans and specifications hereunder and the written approval by the City, (])S
and Peterson shall convey said property and irrprovements to the City free of
all liens and encumbrances and with warranty of title.

property of the City without further notice or action on the part of either
party hereto, other than acceptance by the City.
15. RE\1EI)IES tJKN DEFAULT.
a. Assessments. In the event (])S shall default in the perfoImaIlce
of any of the covenants and agreEments herein contained and such default
shall not have been cured within ten (10) days after receipt by (])S of
written notice thereof. the City, if it so elects. may cause any of the
ilIJ>rovEments described in Paragraph 3 above to be constructed and installed
or may take action to cure such other default and may cause the entire cost
thereof, including all reasonable engineering, legal and administrative
expenses incurred by the City to be recovered as a special assessment under
M.S. Olapter 429, in which case (])S agrees to pay the entire arommt of such
assessment within thirty (30) days after its adoption. CDS further agrees
that in the event of their failure to pay in full any such special assessment
within the time prescribed herein, the City shall have a specific lien on all
of (])S's real property within the City.of Shorewood for any amount so unpaid,
and the Ci ty shall have the right to foreclose said lien in the~er
prescribed for the foreclosure of mechanic's liens under the laws of the
State of Minnesota. In the event of an Emergency, as detennined by the City
Engineer, the M.S. Olapter 429 notice requirements to (])S be and hereby are
waived in their entirety, and (])S shall reimburse the City for any expense
incurred by the City in remedying the conditions creating the emergency.
b. PerfoImaIlce Guaranty. In addition to the foregoing, the City
may also institute legal action against (])S or utilize any cash deposit made
or letter of credit delivered hereunder, to collect, pay, or reimburse the
Ci ty for:
(1) the cost of conpleting the construction of the ilIJ>rovements
described in Paragraph 3 and Paragraph 12 above; and
(2) the cost of curing any other default by CDS and Peterson in
the perfoImaIlce of any of the covenants and agreEments contained
herein.
(3) the cost of reasonable engineering, legal and
administrative expense incurred by the City in enforcing and
administering this Agreement.
c. Legal Proceedings. In addition to the foregoing, the City may
institute any proper action or proceeding at law or at equity to abate
violations of this AgreEment.

17. PIIDF OF TITLE. Peterson shall furnish the Ci ty with a ti tle insurance
policy in the sun of $10 . 000.00. issued by a reputable title ccnpaIty,
insuring the City against loss or damage incurred by the City by reason of
any defect, 1 ien or encurbrance on the ti t Ie. to the land to be conveyed in
Paragraph 2 herein.
18. NOTICES. All notices, certificates and other communications hereunder
shall be sufficiently given and shall be deemed given when mailed by ,
certified mail. return receipt requested, postage prepaid, with proper
address as indicated below. The City and a:>s and Peterson by wri tten notice
given by one to the other, may designate any address or addresses to which
notices. certificates or other communications to them shall be sent when
required as contenplated by this Agreement. Unless otherwise provided by the

Attached you will find information received from the Riley-Purgatory-Bluff
Creek Watershed District. Said information is a request for approval for
the establishment of a Water Maintena 'n accordance

Although the 1980 law relates to Nine Mile Creek and Riley-Purgatory Creek
Watershed Districts, the Minnehaha Creek Watershed District has similar
authorization. The City of Shorewood has in the past applied for Minnehaha
Creek funds. Most recently funds were applied for cleaning the Eureka Road
drainage ditch. According to staff, funding has never been received.

Dear Municipal Officials:
At its recent budget hearings, the Board of Managers of the
Riley-purgatory-Bluff Creek Watershed District authorized
establishment of a Water Maintenance and Repair Fund in accordance
with special legislation adopted in 1980 by the Minnesota
legislature. Previously, the Nine Mile Creek Watershed District
has authorized the establishment of a fund for that District which
was approved by all affected municipa 1 i ties. This Di str ict now
believes that given various problems which have occurred within
the Riley-purgatory-Bluff Creek Watershed District over the past
several years, the time has now come to fund this program for this
District. This will result in having available nearly $30,000 to
undertake water maintenance and repair projects for water
resources located throughout the District.
In order to properly fund this program, approval from local
municipalities are required in accordance with the special
legislation adopted in 1980. On behalf of the District, we
request your City Council to give its approval to this program.
Assuming all seven municipalities within the District approve
the undertaking of this program, we would then appreciate
receiving a request from you for projects you wish the District to
consider. We have already received initial inquiries from the
City of Eden prairie to undertake various water maintenance
programs. We would request the same from all municipalities in
order that the Managers can properly evaluate all requested
municipal proposals from the beginning of this program.

RESOLVED, that the City Council of the City of

September 10, 1987
A special meeting of the Board of Managers of the Ri ley-
Purgatory-Bluff Creek Watershed District was called to order by
Chairman Fiskness at 7:30 p.m. at the Eden Prairie City Hall, Eden
Prairie, Minnesota.
Managers Present: Peterson, Fiskness, Cardinal, Rahr
Managers Absent: Alsaker
Also present were board advisors Robert Obermeyer and
Frederick Richards.

1988 Budget and Tax Levy Authorization/Administrative Fund
Chairman Fiskness announced that the purpose of. the special
meeting was to consider the adoption of a budget for the District
for 1988. Those matters to be considered by the Managers included
budgets for its administrative fund, basic water management levy,
and establishment of a water maintenance and repair fund. The
District's attorney noted the various affidavi ts for publication
giving notice of this public meeting. Those affidavits were
ordered filed with the District's records.
The Managers proceeded to review the various accounts of the
District pertaining to its current regulatory activities and its
special and cooperative projects. Mr. Obermeyer made a
presentation regarding various projects which the Board has
ongoing and which it might also consider for 1988. The District's
engineer commented upon various programs done periodically,
including the lake water qua 1 i ty study, which the Board has been
doing over the past several years. The Managers also commented
upon the need to update its data regarding the floodplain
deliniation for the several water courses throughout the District.
This was of particular concern to the Managers inasmuch as various
citizens have recently commented to the District about the need to
evaluate that data at the present time.
FOllowing discussion of the proposed budget and the necessary
fund levy to be considered by the Board for the ensuing year, it
was moved by Cardinal, seconded by Rahr, that the following
resolution be adopted:

Budget for 1988, the Administrative Fund balance estimate at the
end of calendar year was discussed. The Managers estimated that
fund balance would be in the amount of $120,000. Accordingly, the
Managers noted the District's need to levy the amount of $117,500
for the 1988 Administrative Fund Budget. It was then moved by
Cardinal, seconded by Rahr, that the following resolution be
adopted:

$117,2.00 levied upon all taxable property in the Riley-
Purcriitory-Bluff Creek Watershed District, No.4, Hennepin
County and Carver County, Minnesota, for the year 1988, for
the purpose of paying the administrative expenses of the

Management Project

The Managers noted that last year was the first year for the
levy of Eden Prairie Chain of Lakes Improvement Project under the
basic water management provisions of the Minnesota Watershed Act.
The Managers discussed the continued need to levy each year for
this project which is anticipated to be constructed yet this
year. FOllowing discussion, it was moved by Cardinal, seconded by
Rahr, that the following resolution be adopted:
That a mill rate of one-third (1/3) of a mill be levied
upon all taxable property in the Riley-Purgatory-Bluff Creek
Watershed District, Hennepin and Carver Counties, State of
Minnesota, for the year 1988, for the purpose of raising
funds to be used by the Managers to pay management features
of the Eden Prairie Chain of Lakes improvement project
initiated by the petition of the City of Eden Prairie and
that said annual levy shall be in addition to the annual
administrative expense fund levy.

Water Maintenance and Repair Fund Program
The Managers discussed the need of the District to establish
a Water Maintenance and Repair Fund. In that regard,
correspondence from the City of Eden prairie was circulated to the
Managers. This correspondence from the Eden Prairie City Engineer
noted the City's request that the District participate in various
maintenance cost sharing programs. General discussion followed
during which the Managers noted that they had considered the
establishment of this fund in past years but had not felt that the
fund should have been established. However, noting the various
requests for participation in maintenance projects given the need
to work on the watercourses throughout the Dist.ict as well as a
number of sedimentation basins and other water bodies being in
need of care and maintenance, the Managers expr.essed a concensus
for the establishment of a Water Maintenance and Repai r Fund.

Mr. Richards stated that the law establishing the District's right
to establish any fund may be up to $30,000 in the first year and

FOllowing the adoption of these three separate funding
resolutions for 1988, the Managers instructed that certified
copies of these resolutions be prepared and transmitted to
Hennepin and Carver Counties no later than October 1, 1987. The
Managers were also advised by the District's attorney that
resolutions need to be obtained from the municipalities having
property within the District granting local approval of all local
governmental units affected by this resolution. Mr. Richards was
instructed to draft correspondence. to contact the municipali ties
to obtain the necessary authorizing resolutions. Further, the
Managers concurred that the District should inform all
municipalities of actions taken by the District to initiate a
Water Maintenance and Repair Fund. As part of that correspondence,
the Managers instructed Mr. Fiskness to request further proposals
from municipalities as to what possible projects the District
might consider undertaking in 1988 once this fund has been
properly funded with monies from the just-adopted mill levy
authorization. Following that discussion, it was moved by
Peterson, seconded by Rahr, that Mr. Fiskness correspond with the
municipalities forthwith in that regard.

Section 1. NINE MILE CREEK AND RILEY.Pl'RGATORY CREEK
WATERSHED DISTRICTS; WATER MAINTENANCE AND REPAIR FUND;
CREATION OF FUND; TAX LEVY. Notwithstanding any other law to the
contrary. the Nine Mile Creek Watershed District in Hennepin County and the
Riley.Purgatory Creek Watershed District in Hennepin and Carver counties are
each authorized to establish a fund to be known as the water maintenance and
repair fund which shall be kept distinct from all other funds of the district. This
fund shall be maintained by an annual ad valorem tax levy on each dollar of
assessed valuation of all taxable properly within the Nine Mile Creek Watershed
District sufficient to raise an amount in the first year following enactment of this
legislation of up to 530.000 and thereafter in subsequent years an amount of up to
$15.000 in each district. The board of managers of the district shall adopt each
year by resolution the amount to be raised by mill levy for the fund for the
ensuing year, which amount shall then be levied, collected and distributed to the
district in accordance with Minnesota Statutes, Section 112.611. and is in addition
to any other moneys levied, collected and distributed to the district thereby.
Sec. 2. PURPOSE OF FUND. The water maintenance and repair fund may
be used for any maintenance, repair, restoration, upkeep and rehabilitation of any

natural or artificial, lying wholly or partly within the district. Any work perform;d
in accordance with the purposes of this act may include, but is not limited to,
stream and watercourse clean up and maintenance and stream and watercourse
bank and bed repair and stabilization.
Sec. 3. WORK; MUNICIPALITIES. Any work to be undertaken and paid
for from the water maintenance and repair fund under this act shall be ordered by
the board of managers of the district according to law, Before the commencement
of any work so ordered, any affected municipality shall be notified in writing by
the district about the proposed work and estimated costs, Within 30 days
following receipt of the wrillen notice, any affected municipalities may notify the
district in writing that it will perform the work ordered by the district. If the
municipality undertakes such work, it shall be paid as previously prescribed by the
district from the water maintenance and repair fund. If any affected municipality
fails to perform any work ordered by the board of managers, the district may
have such work performed in any other manner as authorized by law.
Sec. 4. EFFECTIVE DATE. This act is effective for each district named in
section 1 upon approval by a majority of the board of managers of the respective
districts, and upon compliance with the provisions of Minnesota Statutes, Section
645.021.

645.02 EFFECTIVE DATE AND TIME OF LAWS.
Each act, except one making appropriations, enacted finally at any session of the
legislature takes effect on August I next following its final enactment, unless a different
date is specified in the act. A special law required to be approved by the local
government unit affected before it goes into effect becomes effective as to the approving
unit the day following the day on which the certificate of approval prescribed by section
645.021, subdivision I, is filed with the secretary of state, unless a later date is specified
in the act. When approval of such a special law is required by two or more local
government units before it may become effective, the day after the day when the last
of the required certificates is filed is the effective date, unless a later date is specified
in the act.
An appropriation act or an act having appropriation items enacted finally at any

Subdivision I. A special law as defined in the Minnesota Constitution, article XII,
section 2, shall name the local government unit to which it applies. If a special law

government unit or units affected, except as provided in section 645.023. Approval
shall be by resolution adopted by a majority vote of all members of the governing body
of the unit unless another method of a roval is s ecified by the particular special law.
Subd. 3. The chief clerical officer of a local government Unt ,
unit has approved a special law, file with the secretary of state a certificate stating the
essential facts necessary to valid approval, including a copy of the resolution of
approval or, if submitted to the voters, the number of votes cast for and against
approval at the election. The form of the certificate shall be prescribed by the attorney
general and copies shall be furnished by the secretary of state. If a local government
unit fails to file a certificate of approval before the first day of the next regular session
of the legislature, the law is deemed to be disapproved by such unit unless otherwise
provided in the special law.
Subd. 4. Laws 1959, chapter 368, does not apply to any special law heretofore
enacted, whether or not it has been approved by the local government unit affected, but
such unit shall file with the secretary of state a certificate of approval for such law as
required in subdivision 3.

Dear Mr. Vogt:
A considerable amount of time has been expended reviewing the terms
and provisions contained in the developnent contract dated December 17,
1980, between the City of Shorewood and Boulder Bridge Fann, Inc.
It is my understanding approval has been obtained on two plats wher~in
lots in the plats will utilize the water system installed and paid for
by Boulder Bridge Farm, Inc. Approximately 73 lots have now been
connected to the Boulder Bridge Farm municipal water system in the
SHOREWOOD OAKS DE.VELOPNENT with an additional 24 connections to be
made within the new approved plat of BREN'TRIDGE. There should be
additional connections along the way similar to the two connections
,made pursuant to your letters of September 3, and September 18, 1987.
It is further my understanding there still remains due and owing
Boulder Bridge Farm, Inc. the SllIl of $158,000.00 together with
interest from June 23, 1981. Two check en forwarded but
remain uncashed in the total amount of ,920.00 I believe a
lump sum payment should be made and the c e OIl be returned.
On the other hand, if it is more feasible 0 just pay the balance,
the sum of $5,920.00 should be credited to e amount owing Boulder
Bridge Fann, Inc.
In accordance with the terms and provisions cont: ined in the agreement
referred to herein, payment will be expected with 30 days for the
73 connections ,"-'hich have been made together with i. terest due (additional
$5,920.00 if above referenced checks are to beret ).

Attached is the latest projected schedule from the Contractor on this job, CBI
Na-Con, Inc. This revised schedule is a result of a conversation I had with Mr.
Joe Sloan at CBI Na-Con regarding a pre-construction meeting and the start of
work this fall. It became apparent that the date for the pre-construction meeting
was somewhat irrelevant with regard to their scheduling. However, after emphasiz-
ing our desire to have the foundation in this fall, CBI revised their schedule to
that shown on the attached sheet.
There will still be a pre-construction meeting at the Shorewood City Hall
Thursday, November 12, 1987 at 10:00 a.m. The Contractor will make arrangements
to have their people in attendance with their complete construction schedule. At
the present time, the project engineer from CBI Na-Con is intended to be Mr. Rick
Gorder.

Dear Verne:
Brad has suggested I write you regarding a personal dilemma
concerning my continued membership in the Planning Commission.
I have just taken advantage of an early retirement program here
at the hospital and at the end of October will be terminating my
employment with Abbott-Northwestern.
Most of the year this will mean more time to spend with community
activities such as the Planning Commission. However. since my
husband is also retiring at the end of the year. our vacation
schedule will prevent me from attending meetings in January.
February and March. as well as the meeting of November 19th.
Brad suggested the possibility of an LOA. which. of course. I
would like to request. I do realize. however. this could place a
strain on other commission members who might and will have
planned or emergency absences. If you feel this is a feasible
plan. would it be possible to bring this to the other commission
members at our October 20th meeting? If you feel this is not an
appropriate request. please give me a call so I can send a
resignation to Mayor Rascop and the Planning Commission members.

Attached you will find information received from Hennepin County relative
to a parcel of property located in the City of Shorewood which has gone
Tax Forfeit. A location map is included which shows the configuration of
the property.
Upon review of area and topographic maps, this 10.44 acres appears to have
no unique factors which would point to a reason for tax forfeiture. However,
it is felt that there may be a public purpose for this property such as
the Public Works Department. Therefore, it is recommended that a Resolution
be passed which will put the property on hold from any further action at
this time pending completion of a needs analysis.
This item appears on the Consent Agenda of your meeting on October 26, 1987,
for your deliberation.

Attached you will find information received from Hennepin County relative
to a parcel of property located in the City of Shorewood which has gone
Tax Forfeit. A location map is included which shows the configuration of
the property. .
Upon review of area and topographic maps, this 10.44 acres appe~rs to have
no unique factors which would point to a reason for tax forfeiture. However,
it is felt that there may b~ a public purpose for this property such as
the Public Works Department. Therefore, it is recommended that a Resolution
be passed which will put the property on hold from any further action at
this time pending completion of a needs analysis.
This item appears on the Consent Agenda of your meeting on October 26, 1987,
for your deliberation.

municipality. The described parcels forfeited to the State of Minnesota for
non-payment of property taxes.
As provided in Minnesota Statutes 282, we request that you either approve the
parcel(s) for public auction, auction to adjacent owners if Minnesota
Statutes 282.01, Subdivision 7A is applicable, or request a conveyance to your
municipality for public use.
We require a certified copy of the City Council Resolution authorizing any
action taken. If you request that a parcel be conveyed to your municipality,
we also require that the form "Application By A Governmental subdivision For
Conveyance of Tax Forfeited Land" be completed and mailed to this office.

Dear Brad:
It is my understanding that the City refuses to issue a permit so that I
may have the fire department burn the above building. As I stated in my
letter of September 24, 1987, I have been ready to burn the building since
early July and wish nothing more than to do s~. The fire department was
also ready and the only thing which stopped us was the failure of the
City to issue a permit.
If the City has this building demolitioned, it is over my very strong
objection, the cost to have the building burned and the remaining foun-
dation demolitioned and filled will be about four hundred dollars. The
cost of demolition will be about four to five thousand dollars. A cost
increase of ten fold. I refuse to pay this difference.
Again, I request the City to issue a permit so that I may have the
building burned.

WHEREAS, the Ci ty Q)lmcil has received a peti tion by the
residents on Clristmas Lake Road and Clristmas Lane concerning the problEmS
created by through traffic on these streets; and
WHEREAS, this peti tion was duly considered at a regular meeting
of the Ci ty O:>lmci 1 on January 12, 1987, and the O:>lmci 1 has determined that
the through traffic creates a safety hazard to the residents of the area; and
WHEREAS, the O:>lmcil has reviewed the reports of the neighbors,
the South Lake Minnetonka PUblic Safety Department, the Excelsior Fire
Department, and other interested organizations; and
WHEREAS, the Ci ty Counci 1, at a regular meet ing on February 23,
1987, voted unanimously to install a cul-de-sac closing off Clristmas Lane,
provided that the total cost of constructing such cul-de-sac would be borne
by the peti tioners or adjacent property owners, and therefore directed the
Ci ty Attorney to prepare a developnent agreement covering the work to be
performed.

WHEREAS, Shorewood City Code Section 903.03, Subd. 4, provides for
the City to charge a property owner who wishes to connect with the lIRlI1icipal
water system "a connection charge as determined by resolution of the City
Counc i 1"; and
WHEREAS, by its Resolution No. 80-87, adopted June 22, 1987, the
City Council prescribed certain factors for determining such connection
charges; and
WHEREAS, the Developer and owners of the plat of Brentridge are
subject to the water connection charges as set forth in said resolution; and
WHEREAS, the Ci ty has requested the Developer of the plat of
Brentridge to construct oversized watermains within the plat so as to provide
additional capacity in order to serve other developnents outside the plat of
Brentridge; and
WHEREAS, the Developer has agreed to construct such oversized
watennains with the understanding that it will receive a special credit to be
applied against the nonnal water connection charges prescribed by Resolution
No. 80-87.
Rl\7, 'rnERERJm, BE IT RESOLVED by the City Counci 1 of the City of
Shorewood as follows:
1. That the l1J.Ulicipal water connection charges for lots within the
plat of Brentridge shall be cooputed in the manner prescribed by Resolution
No. 80-87.
2. That a special credit shall be applied against these charges,
which credit shall be an amount equivalent to the di fference between the
Developer's cost for construction of 6-inch watermains within the plat of
Brentridge and the Developer's cost for the construction of 12-inch
watennains within the plat, as requested by the City.
3. That such credit may be apportioned and applied to each lot
within the plat or, upon the Developer's request, paid out in total to the
Developer at the time of coopletion and acceptance by the City of the said
12-inch watennain system wi thin the plat.

WHEREAS, the Minnesota Twins play professional baseball
in the American League West Division; and
WHEREAS, the Twins placed first in the West Division
during the 1987 professional baseball season;
and
WHEREAS, the Twins defeated the East Division Champion
Detroit Tigers in the American League Championship
Series to advance to the World Series; and
WHEREAS, the Twins played the National League Champion
St. Louis Cardinals in the World Series; and
WHEREAS, the Minnesota Twins defeated the St. Louis Cardinals
in the World Series four games to three to become
World Champions of Professional Baseball~
NOW, THEREFORE BE IT RESOLVED, by the City Council of the
City of Shorewood as follows:
1. That the Shorewood City Council representing
all of the citizens of the City of Shorewood
are extremely proud of the Minnesota Twins and
their World Championship.
2. That it is a tribute to the entire Minnesota
Twins organization to field a team that not only
has won the World Championship but also represents
all of the citizens of the region so well.
ADOPTED by the Shorewood City Council this 26th day of
