CALL TO ORDER
Acting Mayor Stover called the regular Council Meeting of Monday~ ~
March 24, 1986, to order in the Shorewood Council Chambers at 7:30 P.M.
PLEDGE OF ALLEGIANCE
Acting Mayor Stover opened the meeting with the Pledge of All~giance
and a prayer.
ROLL CALL
Present: Acting Mayor Stover, Councilmembers Haugen and Gagne.
Absent: Mayor Rascop and Councilmember Shaw (vacation).
Staff: Attorney Penberthy, Engineer-Norton, Administrator Vogt -
and Deputy Clerk Niccum.
APPROVAL OF MINUTES
Gagne moved, Haugen seconded, to approve the minutes of the
regular Council Meeting of March 10, 1986 as amended on pages
3 and 4. Motion carried - 3 Ayes.
PARK COMMISSION REPORT

discussion be deferred until the Cou~cilMeeting 04.A~;il/4, }986
SILVERWOOD PARK/LOAN PAYOFF TO SEWER FUND ~
Gagne moved, Haugen seconded, to accept the Park Commission
~ecommendation to repay the loan in the amount of $20,000, plus
any interest due to the Sewer Fund. The money is to be paid
out of the Park Capital Improvement Fund. (This money was
borrowed in June, 1985, to pay for "Silverwood Park"). Motion
carried - 3 Ayes.
CONSENT AGENDA
GARBAGE COLLECTORS LICENSES
Haugen moved, Gagne seconded, to remove Garbage Collectors
Licenses from the Consent Agenda - Motion carried - 3 Ayes.
CABLE COMMISSION APPOINTMENT

Haugen moved, Gagne seconded, to approve the Consent Agenda.

RESOLUTION NO. 21-86
Haugen moved, GaOgneseconded, _~p approve the following Garbage
Collector's Licenses: -

Motion carried by roll call vote - 3 Ayes.
TEMPORARY SIGN PERMIT
Lakeshore Equipment Sales - 19285 State Highway #7
Planner Neilsen explained that Lakeshore Equipment Sales erected a
blinking sign and banner without applying for a permit. He told
them to remove both signs and they have done so. They have also
put up 2 docks, a canopy and a trailer for display purposes.
Haugen moved, Gagne seconded to approve the temporary sign permit
pr,oviding that:
1. All docks, canopies, and trailers being displayed outside be
removed and,
2. Contingent upon the Planner's recommendation that the permit
be granted for seven (7) days only. Motion carried - 3 Ayes.
S.E. AREA TRUNK WATER STATUS REPORT
Administrator Vogt said Mike Pflaum of Near Mountain and Robert
Mason of Waterford are still negotiating and are close to a solution
relative to obtaining the final petition.
Councilmember Haugen asked what the last date is that they can get
project costs on the 1987 assessment roll and Administrator Vogt
replied October 10th, 1986.

Co~ncilmember Gagne mentioned that wintertime costs would be much
higher.
SHOREWOOD OAKS DEVELOPMENT AGREEMENT/WATER REQUEST STATUS REPORT
Administrator Vogt said they are close to a decision on the Develop-
ment Agreement, the finalization of it depends on the water situation
He sent a copy of the petition to Mr. Johnson in the hospital.
Engineer Norton said a cost not to exceed $300,000 is a safe figure.
He also said they are now working in the Shorewood Oaks Developmemt~
Administrator Vogt said Shorewood Oaks water can be part of the S.E.
water bond issue. He has talked to the bonding consultant who said
it would not be a problem to combine the two. '

SHOREWOOD OAKS DEVELOPMENT AGREEMENT (CONTINUED)
-:-.. The City of Shorewood and Mr. Tom Wartman of Boulder Bridge are
,negotiating on a time extension as well aa other possible changes
'._, in the Development Agreement for Boulder Bridge Farm.
RESOLUTION NO. 22-86
Haugen moved, Gagne seconded, that a Resolution be prepared directing
the City Engineer to prepare a Feasibility Report on the water main,
streets, curb and gutter, and the Highway #7 turn-off lane with the
understanding that the developer of Shorewood Oaks has agreed to pay
the costs. Motion carried - 3 Ayes.
Haugen moved to table further discussion on the Shorewood Oaks until
a full Council is present, Gagne seconded the motion. Motion carried
- 3 Ayes.
PLANNING REPORT
Near Mountain Development Agreement Status Report
Planner Niels~ said the Council may 'see a draft Development
Agreement at their next meeting if all of the details can be worked

Smithtown Circle - Petition for Public Improvement
Tl}~E"suba:i:v4--&~ezoning an..d.p.latting, was approved on 1979. A
ett r of creS!~s receivedapdthe park fees were paid. The
equa lzation charges still have to be made.
The owner is requesting that ,the City consider bonding for the
improvements and assessing the costs back to the property so that
the owner can get a building permit.
Mr. Steve Plowman appeared to discuss having a Feasibility Report
done. The Council informed him that it would be at his cost and
risk, because at this time they can't quarantee bonding. He also
asked if there was anything he can do to expedite things. The
Couqcil suggested he gather and present some background information,
~uch as why the project didn't go forward in 1979, and send this
information to the City. Plannp.I' Nielsen also suggested that he
get going on the title opinion.
Haugen moved, Gagne seconded, to table the issue until a full
Council is present. Motion carried - 3 Ayes.
Brom' s Market
Planner Nielsen mentioned that "Brom's Market" is displaying
signs of reopening. He will write a letter to Mr. Mason and
Mr. Cirpinski stating that there may be some concern over re-
opening the market, that the issue will be discussed at the
next meeting, and that one member of the Council showed concern
over health problems in connection with themotorhome on the
property.

ATTORNEY'S REPORT
Nephew Law Suit Update
Attorney Penberthy said Attorney Froberg has contacted our insurance
company and informed them that the City is considering putting in a
storm sewer for the entire area. Administrator Vogt said the 1984
cost for that area was $64,000. Nephew's insurance company wishes
to settle out of court and wants the City to put in a tile line.
ENGINEER'S REPORT
Cathcart Area Proposed Project
Engineer Norton said the reason for high cost on the Nephew property
is because there is a 30" - 36" pipe going through this area.
The total estimated storm sewer cost is $300,000.

Haugen suggested they discuss the Feasibility Report when the whole
Council is present. J
Sewer Request - Craig Kouba - 3520 State Highway 7
Engineer Norton was contacted by Mr. Kouba, who owns a house in
Chanhassen that was moved there as part of the preliminary work
done for the Shorewood Oaks Development. The sanitary sewer and
service has to come through Shorewood and the Shorewood Oaks project.
Sewer service was installed in January.
Gagne moved, Stover seconded, to accept Engineer Norton's recommend-
ation to hook up Mr. Kouba's home at 3520 State Highway 7 to Shore-
wood sewer service and allow occupancy. Motion carried - 3 ayes.
ADMINISTRATIVE REPORT
Murfin Le-t ter
A letter was received from Mr. Murfin's Attorney, Robert W. Reutiman,
Jr., and dated March 21, 1986, whereby Mr. Murfin stood by the
letter sent to Shorewood by him on March 10, and stated that Mr.
Murfin expects a reasonable reimbursement of $50 a day for everyday
after March 19, 1986, until the water main is removed.

Attorney Penberthy said Mr. Murfin has to show damage to warrant
$50 daily from March 19th on.
Haugen moved, Gagne seconded, to have Administrator Vogt do whatever
is necessary to remove the pipe and put City Hall and the Public
Works Garage on the Badger Water System. Motion carried - 3 ayes.
Robert Marshall - Notice of Claim
Administrator Vogt informed the Council that Robert Marshall is
considering a law suit with the City because he ran into a dirtpile
in the ditch off of 3rd Avenue. Vogt has informed our i~surance
company of the possible claim.
Temporary Secretary Position Discussion
Administrator Vogt said a "Kelly Girl" has been hired temporarily
from 12:30 to 5:00 PM to cover for Patti Helgesen due to medical
problems relating to her pregnancy. An ad has been placed for a
full-time temporary person while Patti is gone.
Councilmember Stover said she hoped the Receptionist/Secretary
could become a permanent position.
Administrator Vogt asked what pay to offer. The Council said up
to the midpoint of $5.50 per hour.
Response to Police Department Draft Contract
Haugen moved, Gagne seconded, to table the response until a full
Council is present to do the appropriate work. Motion carried -
3 ayes.
A special meeting is set for April 7, 1986 at 7:00 to discuss
the issue.
Proceeding with Public Works Equipment Purchase
Administrator Vogt said that replacement of the 1976 Ford is in
the budget and they are now proceeding with specs to take bids.
Race Routing Approval Request
Gagne moved, Haugen seconded, to recommend approval of the Easy
Race on April 27, 1986, and that AdministratorVogt send a letter
of approval. Motion carried - 3 ayes.
Minnehaha Creek Watershed District Maintenance and Repair Fund
The Shorewood request for funding to alleviate the Eureka Road
drainage problem was denied. Nine applications were received,
four were funded. Out of $160,000 requested, $31,000 was avail-
able. Richfield and the Minneapolis Park Board received the majority.

ADMINISTRATIVE /REPORT continued
Corridor Study
Administrator Vogt attended a meeting on the Corridor Study. They
showed videos and the Vine Hill Intersection was given #1 priority
,as the.worst problem on the corridor.
He also said we have received a bill for $5000 for our share of the
study. A report and recommendation as to paYment of the bill will
be presented at a future meeting.
BURNED OUT BUILDING - 5580 COUNTY. ROAD 19
Councilmember Gagne showed concern for the dangerous state of the
building, afraid someone might get hurt.
Planner Nielsen said' the insurance company is involved in a contra-
versy, and the Fire Department will not tear the building down until
the cause of the fire is determined. An electrical test has to be
done and it costs a lot of money.
Council asked the City Attorney to check and see if the City can
p~y the cost and assess it back. to the property.
Councilmember Gagne also mentioned the general appearance of the
area, referring to the cars at "Limefire" and the trailers at
"Driskills".
FINANCE COMMITTEE
The Auditor and the Finance Committee will be present at the April 28,
1986, meeting to review the Audit Report for 1985.

Public Works Director Zdrazil explained that they dug down five feet, the dirt
out, and filled the area in with 6" pieces of blacktop and granular material, and
it will be topped off with crushed rock.
Commissioner Lindstrom offered to work with Public Works Director Zdraz.~landstake
out the road which will ,begin at Eureka Road, come around to the north...l.~eofthe
creek,and the final s~ep' will be joining the Eureka Road section with the other part
of the road that comes north,from Highway 7 past ,the ballfields and BMXTrack and
up to the south:side of the er~ek.
PublicrWorks Director Zdrazil will locate a site for storage of blacktop pieces, not

The ParkCotmDission is willing to have some outside Contractors haul in .blacktop pieces
but want to be sure they are reputable and will only bring in material allowed.

Vogel moved, Jurgens seconded, to approve the minutes as corrected. Motion carried
unanimously.
SKATEBOARD RAMP PROPOSAL FOR FREEMAN PARK
Chet Frantz, 950 Iris Circle, Excelsior (474-4150) and Jack Tobin, 27475 Blue Ridge
Lane, Shorewood (474-7805) appeared before the Park Commission to propose the building
of a skateboard ramp in Freeman Park.

SKATEBOARD RAMP PROPOSAL FOR FREEMAN PARK continued
The boys submitted photographs and plans, and the following information:
Ramps can be made of wood, ffberglass or concrete. they don't recommend concrere.
The plywood ramp that they submitted plans for costs approximately $1200.
Helmets, kneepads and elbow pads are worn.
They are working on volunteers to build the ramp. They have worked out a plan where-
by anyone volunteering 10 hours of labor will receive a free one year membership.
Others will pay $10 per year. They ask that the City pay for the material, with
the understanding that they should be able to reimburse the City within a three
year period.
A petition with 114 signatures was presented to the Commission.
The Commission was concerned about insurance. Staff had checked with the City carrier
and reported that they would either delete the insurance from the City policy, or
else the insurance would be very high. Commission asked staff to check on the exact
rate.
They were also concerned about injury, wondering how he wearing of protective gear
could b~ guaranteed.
Chairman Schmid told the boys that the Park Commission would take the issue under
consideration.
LANDSCAPING
No plans have been presented at this time.
PARK COMMISSION APPLICANT
The Commission requested that Staff run a news article advertising for a new Commissioner
using a deadline of May 1, 1986.
HOCKEY RIN~ - ROOFING CONSIDERATION
The Park Commission discussed the possibility of roofing the hockey rinks. Public
Works Director Zdrazil said it would save a lot of money in maintenance costs.
The Commission asked Staff to find out from Zdrazil how much it has cost over the
last five years to maintain the rinks. They figured it would have to be about
200' x 75' and may be cost prohibitive.
CHRISTMAS LAKE ACCESS
Hours
Kooi moved, Jakel seconded, to recommend to the Council that the hours be from
5:00 AM to 9:00 PM (Because people that fish like to start early, and it usually
gets dark around 9:00). Motion carried unanimously - 7 ayes.

put into the island nearest the ramp, so a light can eventually be put in if
vandalism becomes a problem, at the expense of the DNR. . Motion carried unanimously-

Maintenance
Kooi moved, Jurgens seconded, to recommend to Council that the annual maintenance
budget be increased by $10,000 a year to provide for upkeep of the access. Motion
carried unanimously - 7 ayes.
S1gnage
The Park Commission would like the DNR to provide two signs:
One stating the hours and information concerning the 25 horsepower limit at the
entrance to Merry Lane to prevent large boats from entering the road and then
discovering they cannot launch; and

one within the access similar to the sample with all the following information
included on the sign.

Vogel moved, Lindstrom seconded, to recommend to the Council that both grants be re-
submitted. Motion carried unanimously - 7 ayes.
MANOR PARK WARMING HOUSE/PAVILION
Commissioner Lindstrom said the City of Minnetonka has warming houses with cement
floors and concrete block walls, they can have a roof extension to use in the summer.
He will check with the City of Minnetonka to see what size they are and the cost.
He will also talk to Public Works Director Zdrazil to see if Public Works can dig
the footings.

Minnetonka Pool and Spa, Inc., on behalf of Mr. Warren Olson has requested
a building permit to construct an inground swimming pool and spa at the
above-referenced address (see Site Location map - Exhibit A, attached).
The applicant's site plan, shown on Exhibit B, complies with the requirements
of the Shorewood Zoning Ordinance, with one exception. The setbacks are
measured from the outer edge of the pool deck. This will require either
shortening the pool deck or moving the pool itself to comply with the rear
yard setback.
It should be noted that the 24 foot setback is consistent with the prov1s1on
allowing swimming pools to be located at 60 percent of the required rear
setback (.60 x 40 = 24).
If there are any questions relative to this request, please contact my
office prior to the meeting on 14 April.

CORRIDOR STUDY - REQUEST FOR PAYMENT

Attached to this memo you will find a billing for the Shorewood
share of the Highway 7 corridor study. Funding participation
was authorized by Resolution No. 91-85. In discussing this with
Ev, it is our recommendation to pay this bill at this time coding
it to contractual under Mayor and Council (code 5135) and to
place on the calendar for a formal budget amendment in November.
This amendment will then be done with any other amendment~ which
are needed for the year. Also, we will be better able to recommend
the source of the funds at that time of year. For example, excess
revenues or under spending may alleviate funds coming from the
Contingency Fund.
This item is placed under. the consent agenda for the meeting of
April 14 for your consideration. Call if you wish to discuss
this prior to Monday night.

WEED SPRAYING

The City has again received a quotation for weed spraying for
road right-of-way and parks from Mr. Jim Mahoney. The quotation
is attached. The total quote for 1986 is $2,390. This compares
with a total cost of $2,285 in 1985 or a 4.6% increase. Public
Works Director Zdrazil has discussed said spraying with other
firms and indicates that this is our best price for these services.
Also Mr. Zdrazil indicates that Mr. Mahoney has done an excellent
job for the City ip the past. Also, as. in the past, this is a
budgeted item. This year we budgeted $2,700 for this service
(code 6743).
I recommend acceptance of the 1986 quote for contracted weed
spraying from Mahoney Services, Inc. in the amount of $2,390.
This item appears on your consent agenda of your April 14 meeting
for your consideration. Call me if you have any questions.

BACKGROUND
Mr. Wallace King, 25620 Birch Bluff Road, has requested approval of a subdivision
which would allow him to purchase the northeast corner of the lot located at
25625 Birch Bluff Road (see Site Location map - Exhibit A, attached). The
properties in question are separated by the right-of-way of Birch BI~ff Road.
The reason for the request is that the actual traveled surface of Birch Bluff Road
strays out of its r.o.w. as it intersects with Eureka Road. As can be seen on
Exhibit B this creates a small triangle of land which is physically separated
from the southerly lot by the street. From a practical perspective the triangle
relates more to Mr. King's lot than to the southerly lot.
Since the southerly lot is already substandard in size (9,656 square feet, not
includin~ the street surface), and the proposed division reduces it further, the
appli~ant has requested a variance.
ANALYSIS/RECOMMENDATION
It is easy to see that the small triangle of property is worthless to the southerly
lot. This situation is also considered to be a problem for the City in that the
traveled surface wanders from the r.o.w.
Having discussed the matter with the other staff, it would be to everyone's
advantage to resolve the problem. The recommended solution, however, is somewhat
different than the applicant's request. It is suggested that the City require
that the property containing the paved roadway, plus 10 feet along its south side,
be dedicated to the City. In turn, any portion of the existing right-of-way in
excess of 50 feet be vacated and conveyed to Mr. King. This is illustrated on
Exhibit C.

Although the road will not quite be centered on the new r~o.w." the 10 feet will
at least provide the minimum necessaryr.o.w. for road maintenance.
Vacation of the street will require a separate public hearing which could be
held by the City Council at its meeting on 12 May. Surveying must be done to
prepare legal descriptions for the new r.o.w.,and for the portion of the old
r.o.w. to be vacated. Normally, this would be the responsibility of the applicant.
However, since the recommendation of the staff benefits both the applicant and the
City, the City may wish to split the costs with Mr. King.
As a final note, the applicant must provide an up-to-date title op1n1on for the
southerly property prior to finalizing the subdivision/street vacation process.

BACKGROUND
Mr. David Haskins has requested approval of a setback variance to build a home on
Lot 2, Block 1 of the Robert S.C. Peterson Addition (see Site Location map-Exhibit A,
attached and plat - Exhibit B, attached). As shown on Exhibit C the house which
Mr. Haskins proposes to build does not fit on the lot he has chosen.
The property is zoned as a planned unit development. You will recall that
Robert Peterson was allowed to plat smaller lots, clustered ona private road
with reduced setbacks, as part of the P.U.D. approval.
Although the development agreement went so far as to include a copy of the plat
with setbacks shown shaded in (see Exhibit D, attached), the applicant was
apparently given a copy of some preliminary lot layout showing different (lesser)
setbacks. His house design was based on that preliminary drawing. The applicant's
justification for his request is contained in Exhibit E, attached.
ANALYSIS/RECOMMENDATION
Having advised against the lot configurations in the Peterson P.U.D., it is
somewhat frustrating from a planning perspective for the first building permit
in the subdivision to require a setback variance.
While oddly configured lots (triangular lots being among the worst) invariably
result in reduced buildable area, lot configuration is not the primary reason for
the applicant's plight. The proposed house simply has not been designed for the
lot in question. Following are reasons why a variance is not justified:

1. There is ample room on the property to place a house and still take advantage
of the lake view (see Alternative Designs - Exhibit F, attached).
2. While the City has been understanding relative to the need for garages in the
Minnesota climate, it is difficult to demonstrate hardship for a triple garage.
3. One of the criteria for evaluating variances is that the situation can not
have been created by the owner. If the lot configurations are not something
which was created by the owner, certainly the design of the house is.
4. The applicant has indicated that redesigning the house causes problems with
the financing he has arranged. Consistent with State law, our Zoning
Ordinance states that hardship shall not be based solely on financial consider-
ation.
It is felt that the City demonstrated extreme flexibility in approving the Peterson
P.U.D. In view of the preceding analysis plus the previous recommendation relative
to lot configurations, the request for variance is considered completely unjustified.
Denial of the request is therefore recommended.

A.
The partnership of David Haskins and Michael Nelson (Ridge View Heights
Properties) respectfully request a variance as shown on the attached survey to
accommodate the proposed house.
1. The change from the preliminary Plat set backs of 30' at the street and
30' at the southern border have made it impossible to site our house along the
lines intended by the original Poll.D.
The variance requested on the west boundary of the road would be approximately
5 feet and the set back required on the south boundary, the variance would be
approximately 9 feet.
1. There would be no impairment of adequate light suppy of air to adjacent
property.
2. This would not cause any unreasonable increase of congestion to' the private
street.
3. There would be no increase of danger of fire or endangerment of public
safety.
4. There would be no diminished value of adjoining property values.
5. There would be no violation of the city comprehensive planned unit development
as the purpose of the planned unit development, as one of the purposes of the
unit development plan is to develop unusual shaped properties and increase tax
revenues for the city.

1. These special circumstances regarding the triangle shape of the land, the
best utilization is to have the home facing south and southwest to create the
most attractive view and be in concept with the whole planned unit development
proposal. The existing site makes the best use of existing topography to
facilitate drainage.
Due to the unusual triangle shape of the land and narrowness caused by the
misunderstanding of the setback, this would be the best use of the land. It
would also leave as many mature i:trees standtngasc'possible.
2. Literal interpretation of these setbacks would deprive this applicant of
reasonable development of this site. Further, we would assume similar variances
have been"granted by the city in similar cases.

The applicants believe, for the reasons set forth above, this would make the
most reasonable use of the land and the minimum variances necessary.

BACKG~OUND
Mr. Warren Olson has requested approval of a simple subdivision of his property
located at 5600 Grant Lorenz Rd. (see Site Location map-Exhibit A, attached).
The property contains approximately 90,239 square feet in area and is located in
the R-1A, Single-family Residential District. Mr. Olson proposes to divide the
property into two lots as shown on Exhibit B.
ANALYSIS/RECOMMENDATION
The property in question consists of Lot 1, Block 4, and part of Outlot A,
Oak Ridge Estates Second Addition. As you may recall, Mr. Olson requested the
combination of the two parcels back in the late part of 1981, prior to the platting
of Oak Ridge Estates Third Addition. Mr. Olson now proposes to redivide the
two parqels.
Both parcels conform to the mlnlmum lot size requirements of the R-1A district.
Mr. Olson's residence has been located on the westerly half of the property so
that it complies with the required setbacks.
Since the construction of Mr. Olson's house, it has been noted that a relatively
high water table exists on the easterly parcel. As a result, a soil test was
requested from the applicant as part of his application information. A soils
report, dated 29 October 1985, prepared by Advance Surveying and Engineering
Company, recommends the following corrective measures prior to construction:

a. Remove all organic material beneath the proposed structure and 10 feet beyond.-
b. Place granular, compacted fill up to footing and floor levels.
c. The lowest floor level should be no lower than the level of the existing
ground to avoid water problems in the basement.
Since the proposed lots comply with current zoning requirements, and the new lot
is suitable as a building site, it is recommended that the division be approved
subject to the following:
1. The applicant must provide a new 10 foot drainage and utility easement along
the west side of Lot 1, Block 4.
2. A park dedication fee ($500) must be paid prior to release of the resolution
approving the division.
3. The applicant is responsible for sewer equalization charges. These can either
be paid now or assessed against the new lot.

4. An up-to-date (within the last 30 days) title opinion must be submitted for
review by the City Attorney.
5. The division must be recorded within 30 days of the applicant's receipt of
the Council resolution approving the request.

BACKGROUND
Last year the City approved a subdivision called Harding Acres (see Site
Location map - Exhibit A, attached). As you may recall a preliminary plat was
approved for 18 lots. A final plat was then approved for the six lots having
frontage on Wedgewood Drive and Smithtown Road. Network Development Inc. i~
purchasing the property, and has requested approval of a final plat for the
remaining 12 lots.
Since the Shorewood Subdivision Ordinance requires that final plats must be
submitted within six months of preliminary plat approval, the project technically
requires a new preliminary plat. As a practical matter, however, the plat is
exactly the same as the one approved in 1985 (see Exhibit B, attached).
RECOMMENDATION
Since the plat is consistent with the previous approvals, it is recommended that
both preliminary plat and final plat be approved subject to the following:
1. Approval of the plans and specifications for street and utility improvements
by the City Engineer.
2. The applicant must submit an up-to-date title opinion for review by the City
Attorney.
3. Park dedication fees ($500 per lot) must be paid prior to release of the
plat.

4. The applicant's engineer must submit an estimate of the cost of constructing
required improvements.

5. Subject to the City Engineer's approval of the estimate, a letter of credit
for 150 percent of the estimate must be provided by the applicant to
ensure construction of the improvements.
6. It is recommended that the staff be directed to prepare a standard subdivision
development agreement covering the above-mentioned items and including
provisions for scheduling and inspection of improvements, reimbursement of
City expenses, building permits, etc. This could likely be reviewed at the
28 April Council meeting.

7. The applicant's engineer should prepare a detailed grading plan showing
proposed elevations of building pads. Once this has been reviewed by the City
Engineer, grading work may be commenced.

BACKGROUND
In September of last year, the City was approached by the Christmas Lake Homeowner's
Association to accept the donation of a piece of property located on Merry Lane as
a public access to Christmas Lake. After considerable study and lengthy negotiations
between the Association, the DNR, Interstudy and the Shorewood City Council, an
agreement was reached between all concerned parties to locate the access on a site
immediately north of the originally proposed site owned by Robert Fayfield.
In addition to the different site location, the access proposal has undergone
considerable change from the original proposal. As proposed, development of the
access site requires several zoning approvals from the City. These are enumerated
in a letter to Frank Fallon, dated 19 February 1986 (see Exhibit A, attached).
A letter trom Frank Fallon to members of the Christmas Lake Homeowner's Association,

dated 17 February 1986, summarizes the agreement which has been reached. A portion
of that letter is attached (Exhibit B) for your review.
ISSUES AND ANALYSIS
In the initial review of the access proposal, several issues and concerns were
raised by the Park Commission, Planning Commission and City staff. Nevertheless
the City Council determined that it was in the public interest to enter into the
agreement with the other parties. It is worth noting that an overriding factor in
the Council's decision was that if the City did not accept the site, it would be
donated to the DNR and the City would lose any voice it may have had as to how the
site would be developed, operated or maintained.

To a large degree, signing the agreement made the subdivision, conditional use
permit and variance processes somewhat of a formality. Consequently rather than
dwelling on the appropriateness of straying from zoning standards, this report will
focus on site"sesign and making sure the access functions properly. In this regard
there are several issues to be considered.
A. Fayfield Property. There is one variance which should not be simply overlooked.
The nonconforming structures on the Fayfield property should be removed as a
condition of approval by the City. Although this parcel is no longer proposed
as the access site, it is still involved in the conveyances between the
Association, lnterstudy and the City.
There are two reasons why it is recommended that the buildings be removed.
First, the access proposal was originally "sold" based on the idea that despite
the access being substandard in terms of zoning requirements, other nonconform-
ities (the old buildings) would be eliminated. To quote the Association's
original proposal: "At present there is a derelict single family home that
will be removed as part of the site development...(The existing home is getting
water from the neighbor's well on a temporary basis only.)"
Secondly, since the property must be combined with the lnterstudy, the lnterstudy
site would contain two principal uses on one lot.
B. Site Design. The proposed site plan is shown on Exhibit C. Setting aside the
variances necessary to accommodate the access proposal, it should be realized
that the proposed site plan can't really be done much differently than shown.
Fortunately it has been improved over previous plans, specifically:
1.
Although lot sizes have not been included in the information submitted by
the applicants, the new site is somewhat larger than the Fayfield lot.
2.
The new site is closer to Radisson Road than previously proposed. This
not only shortens the length of the access road, but will ultimately result
ip less disruption of residential use at such time as the lnterstudy
property is developed.

3.
The proposed access road has been widened. While it still does not conform
with the SO foot minimum street width requirement, the proposed 30 foot
width is better than 10 feet which was initially proposed. The narrow
width has resulted in problems with backslope on the lnterstudy side. The
DNR has gotten approval from lnterstudy, however, to encroach on their
property somewhat in order to soften the grade. Consideration should be
given to acquiring the additional 20 feet of right-of-way at such time as
the lnterstudy property is developed.
4.
Overall circulation has been improved. All parking spaces are in a
pull-through design with adequate turning radii.

5. The parking lot and access road will be paved. Parking will be striped
and the perimeter of the lot curbed on the easterly side and around center
islands.
6. The parking lot will be broken up by the three landscaped center islands.
Landscaping has been increased significantly.
7. Drainage has been accommodated as follows:
a.
In addition to curbing on the east side of the parking lot, the lot
is sloped to the west so that virtually all runoff is directedito the
grass ditch on the west side of the site.

b.
From there the water is piped under the road to the center landscaped
island which serves somewhat as a sedimentation basin.
c.
The water then passes through an oil skimming device before being piped
under the parking lot into the lake.
Scott Bracke, DNR, will attend the meeting on 1 April. Undoubtedly he
will elaborate on the proposed design and be able to answer any
questions which may be raised.
C. Subdivision. The applicant's attorney is currently updating title op1n10ns for
the properties involved. These must be submitted as quickly as possible to
ensure that the subdivision/lot combinations can be recorded and that the City
can receive clear title to the site in time for the proposed construction start
(1 June).
New property surveys and legal descriptions must be submitted as soon as
possible in order for the Council resolution to be prepared on schedule.
D. Landscaping. Proposed landscaping is shown on Exhibit E. The plan takes into
consideration comments from both the staff and the Christmas Lake Association.
As proposed, the landscape plan accomplishes the following:
1. The parking lot and toilet facilities are screened from the lake and from
adjacent residences.
. ~
2. The combination of existing and proposed vegetation provides a physical
buffer between the .access and adjoining properties. This is intended to
._ discourage encroachment from access users onto adjoining lots.

Since the facility will be considered as a city park, the Park Commission raised
some concern over maintenance of the facility. Commissioner Lindstrom later
talked to another landscape architect regarding minimizing the amount of area
which has to be mowed. It was suggested that some other kind of ground cover
which requires less maintenance be considered. White clover, ground ivy or
lamium, or some kind of Spiria, were suggested examples. Given the estimated
annual cost of maintenance (see item E. following) these suggestions appear to
have merit.

E. Maintenance. In signing the agreement the City Council agreed to own, operate
and maintain the access facility. Early estimates relative to annual
maintenance costs were as high as $8,000. While these were considered at first
to be unusually high, a recent estimate by the Public Works Director indicates
that maintenance could run somewhere between $6,000 and $8,000.
Maintenance costs include trash patrol and disposal, satellite toilet rental,
mowing, sign replacement, snowplowing, and striping, sealcoating and patching
of the access road and parking area. Obviously these costs will necessitate
an adjustment to the current City budget.

F. Engineer's Comments. The Engineer's comments are contained in his ~eport,
dated 11 March 1986 (see Exhibit D, attached). While most of the issues raised
therein have been resolved, the road design is still a topic of debate. DNR
proposes a two inch thick, bituminous road surface. The City Engineer
proposes a three inch thick surface.
Given the projected maintenance costs already discussed herein, it behooves
the City to consider this issue carefully. It should be realized that the
road serves two residents to the south and therefore will experience snowplow
and garbage truck traffic.
Possibly, if DNR is unwilling to comply with the recommendation of the City
Engineer, they would be willing to compromise by sharing in the cost of
maintenance for some specified period of time.
G. Shoreland Impact Plan. Most of the areas of concern have already been 6iscussed
in other sections of this report (e.g. screening, stormwater runoff, landscaping).
The only item which has not been addressed is erosion control during and after
construction.
During construction a silt screen will be placed along the entire length of
the site. Disturbed areas which will not be paved will be sodded to prevent
erosion.
RECOMMENDATION

Dear Frank:
As you are aware Dan Vogt and I met with representatives of DNR and Interstudy on
12 February to discuss the preliminary design plans for the Christmas Lake access.
Based on those plans it will be necessary for the City to grant the following
approvals: 1) subdivision; 2) conditional use permit; and 3) several'variances.
Due to the number of parcels of property involved, I have attached a map which
identifies the subject parcels for (hopefully) easier reference.
Following is a more detailed explanation of the necessary actions plus the required
information necessary for each approval:
1. Subdivision/combination. It will be necessary to divide Interstudy B fDom
Interstudy A then legally combine B with Interstudy C. Also the Fayfield parcel
must be combined with Interstudy A. For this purpose we'will need surveys and
legal descriptions of all the existing parcels, including the locations of all
structures, easements, etc. We will then need new surveys of all the resulting
parce ls.
In addition you must submit current (within the last 30 days) title opinions
for all the affected properties.
Finally~ the enclosed application form must be signed by all involved property
owners.
2. Conditional Use Permit (C.U.P.). This is required for the development of a
substandard lot and is subject to the provisions of Section 200.04, a copy of

Dear Neighbors,
The purpose of this letter if three fold: first, to describe
the settlement we finally reached with DNR concerning the public
access: second, to thank the many people whose efforts made this
settlement possible: and third, to request your financial suppoft

to help pay the remaining costs.
1) The Settlement. As you probably read in the newspaper, on
January 30th we signed an agreement with DNR and the City of
Shorewood providing for a donated pUblic access on Merry Lane,
and the DNR dismissed its condemnation proceedings against the
former Christmas Lake Motel property. We also signed an agreement
with Interstudy the day before, providing for an exchange of
property between Bob Fayfield and Interstudy and for the granting
of the necessary roadway easement by Interstudy.
In summary, the agreements contain the following provisions:
The Fayfield property will be donated to Interstudy.
(at 5695 Merry Lane)
~roperty owned by Interstudy Oh th~ eQ~L &~de of Merry
Lane, north of the Fayfield parcel and south of Paul
Ellwood' s cabins., will be donated to the City (or possibly
the State) for the public access..
The public access will contain a concrete boat launching
ramp (at the south end of the parcel) and parking spaces
for seven cars with boat. t.railers.
The access will be designed and built by QNR at its expense
(estimated by them at $50 - $75,000). Ad$quate screening
is to be provided from adjacent properties.

Association by March 1st for review and comment, and
requests for a conditional use permit and necessary
zoning variances will be submitted: and considered promptly
thereafter. (If all of the necess.ry approvals are not
granted by May 1st, the property will be donated to the
state instead of the city.)
If the city grants the necessary zoning approvals, the
access site will be donated to the city, who will own,
operate, and maintain the access subject to the agreement
with DNR. If the site is donated to the state, DNR will
,
enter into an agreement with the city under which the ~
city will operate and maintain the access. In either
event, the access will be free and open 16 hours a day,
between the hours of 4:00 A.M. and 10:00 P.M., and may be
closed only in emergencies or with ONRls approval.
Interstudy will grant a 30 foot roadway easement (to either
the city of the state) across its property so that Merry
Lane can be widened and improved to the south end of the
access.
An amendment to the restrictions contained in Interstudy's
deed will be recorded, increasing from seven to ten the
number of dwelling units which may be built on their
property. (This does not change the existing zoning
requirements.) In addition, the Board of the Association has
agreed to support certain changes in Interstudy's conditional
use permit, if requested within the next five years.
Construction is expected to start about June 1st and to
.. be ,completed by--July 31st.
For seven boating seasons, all boats launched at the
public access will be subject to a limitation of not more
2S horsepower motor size. (No limit. is imposed on residents.
not using the public access to launch their boats.)
Thereafter, boats launched at the public access will be
subject to the same limits (if any) that residents are
subject to.

BACKGROUND
Mr. Baylon Leiferman has requested a building permit which would allow him to
tear down his existing garage and replace it with a room addition. He would then
propose to build a new detached garage at the rear of the existing house. Since
the house, which is located at 5775 Grant Lorenz Road (see Site Location map -
Exhibit A, attached), does not comply with the setbacks of the R-1A zoning
district, any expansion or structural alteration requires a conditional use
permit pursuant to Section 200.03 Subd. lK. of the Shorewood Zoning Ordinance.
As can be seen on the attached site plan (Exhibit B, attached), the applicant's
current garage encroaches on the property immediately north of it by approximately
five feet. The existing garage would be torn off back to the existing house.
This would leave the existing structure approximately 7.5 feet from the property
line. He then proposes to add a small room to fill in the northwest corner of
the building. Since the house is already closer to the street than the R-1A
district allows (approximately 40 feet instead of 50), the room addition
represents an increase in the nonconformity. For this reason the applicant has
requested a setback variance.
ISSUES AND ANALYSIS
This is considered a difficult request to try and explain verbally. Hopefully,
the attached drawings will make it easier to understand. It is also difficult
to separate the variance from the C.U.P. in this case. However, since the C.U.P.
does not do the applicant much good without the variance, the variance will be
addressed first.

A. Setback Variance. As shown on the attached building plans, the applicant
proposes to build a small room addition in the northwest corner of the house.
While the addition will be jogged in to comply with the 10 foot side yard
requirement on the north side, it will line up with the existing front of
the house which is approximately 10 feet too close to the front of the lot.
There is a provision in the Zoning Ordinance (see Section 200.03 Subd. 3d.)
which allows a reduced setback where adjoining structures are closer to the
street than zoning requirements might otherwise allow. As can be seen on
Exhibit B, Mr. Leiferman's house lines up with both the house to the north and
the house to the south. It is therefore considered consistent with the
Zoning Ordinance to approve the variance.
B. Conditional Use Permit. One of the requirements for granting a C.U.P. to
expand a nonconforming structure is that the nonconformity should not be
increased. The preceding paragraph addresses the justification for variance
from this requirement.
Mr. Leiferman's plans bring the house more into conformity with regard to
side yard requirements than what currently exists (instead of encroaching on
the property to the north, he will create a 7.5 foot side yard). Ideally,
the structure would have been brought back to the 10 foot requirement.
However, to do so would result in potential structural problems due to the
location of footings.
It is worth mentioning that Mr. Leiferman is negotiating with the owner of the
20 foot strip north of his property to purchase all or part of the strip.
This would result in complete conformity with side yard requirements.
RECOMMENDATION
Mr. Leiferman's request is considered reasonable and consistent with the prov1s10ns
of the Shorewood Zoning Ordinance. The current encroachment of his garage makes
a strong case for requiring surveys with building permits. Despite the variance
involved, the overall plan improves the conformity of the property to Shorewood
zoning requirements. It is therefore suggested that the Planning Commission view
the applicant's request favorably in making their recommendation to the City Council.

BACKGROUND
Mr. B. Thomas Bauman and Leo Meloche have requested a simple subdivision/lot
combination for their properties lo~ated at 26140 and 26120 Birch Bluff Road,
respectively (see Site Location map - Exhibit A, attached). Mr. Meloche's lot
is quite narrow (50 feet) while Mr. Bauman apparently has more property than
he needs. The purpose of the division/combination is to make the lots more
equal in size and to allow Mr. Meloche to improve his property by building a room
addition on the west side. Since neither lot meets the zoning requirements of the
R-1A district in which they are located, a conditional use permit is required
for development (or redevelopment in this case) of the property.
The Bauman property is currently 120 feet wide and contains 20,880 square feet
in area. The Meloche property is 50 feet wide and contains 8,750 square feet
in area. If the division/combination is approved both lots would be 85 feet wide
and contain 14,815 square feet in area.
While Mr. Bauman is willing to convey approximately 30 feet of his property to
Mr. Meloche (see Site Plan - Exhibit B, attached) he is concerned about being
able to build a future garage on the east side of his house. His new garage
plus Mr. Meloche's room addition and new garage are shown with a 10 foot side
yard. Since the Zoning Ordinance requires 20 foot side yards for lakeshore
property, they have requested variances to allow a reduced setback.
The site plan also shows the location of three accessory structures which
currently exist on the properties. The two garages on the south ends of the
properties in question are proposed to be removed. The applicants have requested
that a small boathouse situated near the lakeshore be allowed to remain despite
its not meeting zoning standards.

Mr. Meloche has requested a variance to locate his new garage closer than 50 feet
to the street (44'). He cites Section 200.03 Subd. 3d. of the Zoning Ordinance
which allows the City to reduce setbacks where structures on adjoining property
are closer to the street than current zoning might allow.
ISSUES AND ANALYSIS
Mr. Meloche has cited several factors justifying approval of the C.U.P. and
variances. Most important to him is that the approvals would allow him to improve
his property thereby enhancing the neighborhood and improving property values.
Other, more objective factors, are as follows:
a. The property was platted prior to any form of zoning laws.
b. Changes in laws over the years (the most recent of which is the 20 foot
side yard requirement) have resulted in older buildings becoming nonconforming.
c. The lots were not platted perpendicular to the street or the shoreline. The
resulting lot configuration has some affect on the buildable area of the lots.
This is true of most of the lots along Birch Bluff Road.
d. The character of the area would not be adversely affected as a result of the
variances. A case in point is the property immediately east of the Meloche
property, where the existing garage is appro~tely three feet from the side
lot line and three feet from the street right-of-way. A drive along Birch
Bluff Road quickly reveals older development with many garages close to the
street.
While all of these factors are considered to have merit, there is one issue which
may outweight the others. When the Zoning Ordinance was being studied, it was
mentioned that the Birch Bluff Road area may be inappropriately zoned. As such it
was flagged for further study.
Upon review of the lot size analysis which was prepared with the Zoning Ordinance,
the median lot size for lots fronting on Birch Bluff Road is 23,522 square feet
in area. Out of 56 lots, 36 (64%) are less than 30,000 square feet in area and
only seven (13%) meet the requirements of the current R-1A zoning. It is little
wonder why substandard lots in that area can not meet the current setback
requirements geared toward larger lots.
RECOMMENDATION
If the property in question was located in an area that was characterized by large
lots which conformed to R-1A standards, the suggested recommendation would be to
deny the applicants' request. However, given the existing character and the
questionable current zoning of the area, the request is considered reasonable. It
is worth noting that removal of the two existing garages improve the conformity
of the property relative to front setbacks.

In view of the preceding analysis, it is recommended that the applicant's request
be granted subject to the following:
1. The applicant must provide new surveys of the two newly configured lots, along
with new legal descriptions of the lots. This should be done wrthin 30 days
of the Council's approval.
2. The applicants must submit up-to-date tit.le opml.ons (within the--last 30 days)
showing their control of the property. This will be subject to~satisfactory
review by the City Attorney.
3. The division/combination must be recorded with Hennepin County within 30 days
of the applicant's receipt of the Council resolution approving the request.
4. The two southernmost garages must be removed within some reasonable length
of time. It is suggested that this be done in conjunction with building
permits for Mr. Meloche's addition or within one year from date of Council
approval, whichever comes first. The City should give serious consideration
to requiring the nonconforming boat house to be removed (or moved back) as well.
5. The property division should be designed so as to leave adequate room for
Mr. Bauman's garage plus a 10 foot side setback and a 50 foot front yard
setback. The proposed garage is not acceptable in ,its current location -
33 feet from the street r.o.w.
It is strongly suggested that in addition to the above, the City consider rezoning
the Birch Bluff Road area to R-1C. While this would not accomplish complete
conformity it should significantly reduce the need for variances and conditional use
permits. It is felt that this could be done iri conjunction with the final adoption
of the new Zoning Ordinance.

Mr. James Harmsen has been working with Mr. Robert Erickson to resurrect the Tingewood
P.U.D. project. They apparently have received the backing of the Bank of Minneapolis
and Trust Company to complete the project (see Exhibit A - letter, dated 19 February
1986). I've met with Mssrs. Harmsen and Erickson to discuss what needs to be done
in order to reinstate the previous building permit and the P.U.D. status of the
project.
A. Building permit for existing structure.
1. Sewer and water lines must be tested to the satisfaction of the City Engineer.
2. Final inspections of completed units.
3. Final plumbing inspection of completed units.
4. Erosion control measures must be reestablished to the satisfaction of the
City Engineer.
5. Ponding area in the southwest corner of the site must be cleaned out.
6. The developer must provide a new building permit fee. The State Building
code provides for one half of the original fee.
B. Reinstate P.U.D.
1. The developer must submit an up-to-date title opinIon showing ownership
. and clear title to the property.
2. The developer should provide a detailed explanation of the current status
of the project, including how the financial problems have been resolved.

3. A new landscape plan, prepared by a professional landscape architect, must
be submitted. The landscaping should restore the center island to something
closer to the original development plan. Once approved, a letter of credit
must be submitted for 150 percent of the estimated cost of the improvement.
4. A new phasing plan must be submitted specifying anticipated starting and
completion dates for the remaining units.
5. Estimated cost of completing the project and evidence of financial commit-
ment from financier. '
6. The staff should be directed to prepare a revised development agreement
between the City and the new owner of the project. To ensure that City
expenses are covered, it is recommended that an escrow of $1,000 be submitted
by the developer.
In the interest of completing the first three units and achieving occupancy for
those units, the developer has requested approval of the building permit necessary
to complete the units. Provided the items listed in A. above are resolved, this
is considered acceptable. In fact, there are advantages to seeing the units
completed (e.g. maintenance of the private street should no longer be a problem).
The developer will attend the Council meeting on 14 April to discuss the project
and answer any questions you may have. If there are any questions prior to the
meeting, please contact my office.

I. TYPE OF WORK
This work consists of the construction of approximately 6400
L.F. of 6 inch through 16 inch trunk watermain, 5600 L.F. of
bituminous street surface and aggregate base and subgrade
stabilization, including right turn lane off S. T. H. 7, and
10,700 L. F. of concrete curb and gutter and appurtenant
work.
II. LOCATION
The proposed project area is in the western portion of the
Ci ty of Shorewood in Sections 31 and 32 of Township l17N,
Range 23W which will serve the plat of Shorewood Oaks.
III. DESCRIPTION OF PROJECT
The proposed facility locations are shown on the attached
Sheet "A" and are outlined below.
Included in this project is the construction of
approximately 6400 L.F. of 6 inch through 16 inch watermain
from a western beginning at the existing 12 inch stub at
Boulder Bridge Drive and Smithtown Road to an eastern
terminus at the intersection of Strawberry Lane and propsed

SUBJECT: Police Department
Since the special meeting held last Monday night, I have done some
investigating as to alternatives of aiding the City in planning for
the start of a Police Department.
Two alternatives seem to exist: Hire a chief, or, hire a consultant.
Either way, some strategy for advertising should be developed. It is
my feeling that a consultant could be hired locally with knowledge of
Minnesota laws for setting up the department. A chief may not need
to be hired locally and advertising could be done nationally in an
international police chief's magazine. In either case, a set of
criteria for hiring should be used.
To hire a chief, the City should set certain requirements, such as
prior chief experience and good organizational and management skills
to establish the department. The City should also state that it is
a new departme~t which needs to be established from the ground up. I
would recommend that this approach be the City's second choice.
Similar to how the Liquor Store situation was handled, I recommend
that the City hire a consultant to guide us through the planning pro-
cess. I have then8me of a person who may be able to help who lives
and is employed here in the Twin Cities Metropolitan Area. To date,
I have not been able to make contact with this individual. I under-
stand that he will be back in his office prior to your meeting on
Monday night. Upon my contact with him, I will discuss our situation
with him and try to get an idea as to what services he can provide,
length of time his study will take arid- cost. - I will also discuss with
him if he would hire a chief or a consultant, if he had a similar situ-
ation. If this person cannot serve our needs, perhaps he will know
someone who can. I will update you at the meeting.

To advertise for a police chief in the League of Minnesota Cities
Magazine in May, an ad must be in on Tuesday (April 15). If the City
chooses to hire a chief, this would give me Tuesday to write an ad. I
don't see this as a problem. Other media sources would be the Minneapolis
Star and Tribune and the Minnesota POST Board. Ads can be called in on
short notice. The City would not need to advertise to hire a consultant
I would merely request a proposal from qualified persons or firms.
Hopefully, the information contained herein will assist you in the dis-
cussion on Monday night.

PUBLIC WORKS UNION
As you are aware, the position of Assistant Public Works Director
was ordered by a Mediator to be included as a job within the AFSCME
unit. Therefore, the job classification of Assistant Public Works
Director will be incorporated into Appendix A of the Agreement
along with the salary already established. Because of this ruling,
Howard Stark will be placed back to the position of Light Equip-
ment Operator/Laborer at the established rate of pay for this
position. Dues deduction for Howard will resume.
As to filling the new position, the current Agreement states that:
"All job openings shall be posted for ten (10) calendar days.
Among qualified applicants, as determined by the employer, selection
shall be by seniority." The union wants the City to post the posit-
ion per the Agreement for filling at this time. Since the City has
the authority to assign work, I would recommend that the position
not be posted and filled immediately as the Union would like. I
would like to instruct Don to assign work which will give us an
indication as to who is the most qualified to fill the position.
We may then decide to fill the position later in the year.
Call me if you have any questions relative to this issue prior to
the meeting on the 14th.

Reese moved, seconded by Benson to approve the minutes of February 18, 1986 as

7:30 PUBLIC HEARING - CONDITIONAL USE PERMIT AND SETBACK VARIANCE
Baylon Leiferman - 5775 Grant Lorenz Road
Public portion of the hearing opened at 7:38 P.M.
Mr. Leifetman was present to explain his request for a building permit in order to
remove his existing garage and replace it with a room addition. He also proposes
to build a new detached garage at the rear of the existing house. Since the house
does not comply with the R-1A setbacks, any expansion or structural alteration
requires a CUP. In addition, since he would like to add a small room onto the
northwest corner which would increase the nonconformity, he is requesting a setback
variance. Public portion of the hearing closed at 7:41 P.M. without comment.
Planner Nielsen noted that Section 200.03 Subd. 3d of the Zoning Ordinance provides
for a reduced setback where adjoining property structures are closer to the street
than zoning requirements might otherwise allow. Therefore it would be considered
consistent with the Zoning Ordinance to approve the variance.
Watten moved, seconded by Spellman to recommend to Council approval of the conditional
use permit a~d setback variance. Motion carried unanimously.
SIMPLE SUBDIVISION
.Warren Olson - 5600 Grant Lorenz Road
Mr. Olson explained that he owns approximately two acres within the Oak Ridge Estates
subdivision (5600 Grant Lorenz Road) which he proposes to divide into two lots. Both
lots would meet the requirements of the R-1A zoning district in which they are located.
Planner Nielsen commented that since a detailed report of this request is not available
to the Planning Commission he wanted to report that soil tests were done because of
the wetness of the proposed easterly lot and these tests show what corrections are
needed; the addresses of the lots would be off of Noble Road; a survey is needed
showing where Mr. Olson's house is located to assure that it meets proper setbacks;
and that a park dedication fee will need to be paid on the newly created lot prior
to the Council releasing a Resolution.

8:00 PUBLICHEAkING - SIMPLE SUBDIVISION AND LOT AREA VARIANCE
Wallace King - 25620 Birch Bluff Road
Public portion of the public hearing opened at 8:00 P.M.
Mr. Gerald Carroll, attorney, representing Mr. Wallace King pointed out how the paved
traveled surface of Birch Bluff Road strays out of its right-of-way, which physically
separates the northeast corner of the lot to the south of Mr. King's property and
appears to adjoin it to Mr. King's lot. For this reason Mr. King wishes to divide it
from its existing lot to the south and have it combined with his own lot. Since the
southerly lot is already substandard in size (9,656 square feet, not including the
street surface), and the proposed division reduced it further, Mr. King is requesting
a lot area variance as well.
Planner Nielsen said that the staff recommendation is that the City require that the
property containing the paved roadway, plus 10 feet along its south side, be dedicated
to the City. In turn, any portion of the existing r.o.w. in excess of 50 feet be
vacated and conveyed to Mr. King. This would require surveying to prepare legal
descriptions of the new r.o.w. and for the portion of the old r.o.w. to be vacated.
As stated in the Planner's report, since the recommendation of the staff benefits
both the applicant and the City, the City may wish to split the costs with Mr. King.
Mr. Carroll said that the Kings' are agreeable to sharing the cost of the survey.

Commissioner Reese said he felt it should be to the Council's descretion as to whether
the City should share the cost for the survey.
Commissioner Watten asked what advantage there would be to the owners of the south
lot. Planner Nielsen responded that although the total lot area would be reduced, the
lot would-no'longer be split by the road surface.

Mark Harland, 5300 Eureka Road wondered if this street vacation would affect the fire
lane. Planner Nielsen said no, the fire lane is simply an extension of Eureka Road.
John Russell, whose grandparents own nearby property, said he recalls previous owners
of the south lot having had many problems with the fact that a portion of the lot
was separated by the surface of the roadway. They felt they should have been able
to park there, etc.
Benson moved, seconded by Reese to recommend to Council approval of the simple
subdivision, lot area variance, and vacation of the right-of-way, subject to the
staff recommendations including the recommendations in the Planners report requiring
the applicant to provide an up-to-date title opinion for the southerly property prior
to finalizing the, subdivision/street vacation process. Motion carried unanimously.

8:15 PUBLIC HEARING - SIMPLE SUBDIVISION, CONDITIONAL USE PERMIT AND VARIANCES
Meloche/Bauman - 26120/26i40 Birch Bluff Road
Public portion of the public hearing opened at 8:20 P.M.
Mr. Leo Meloche of 26120 Birch Bluff Road explained that he would like to purchase
approximately 35 feet of land from his neighbor, Mr. Thomas Bauman of 26140 Birch
Bluff Road. Mr. Meloche said this would allow him to build a garage on his property
and also have the option of adding onto or remodeling his house in the future.
Mr. Bauman is willing to convey the approximate 35 feet of his property to Mr. Meloche,
but is concerned about being able to build a future garage on the east side of his
house. His new garage plus Mr. Meloche's room addition and new garage will allow for
a 10 foot side yard, however, the Zoning Ordinance requires 20 foot side yards for
1akeshore property, therefore the applicant's have requested variances to allow a
reduced setback.
The sites contain a total of three existing accessory structures, two garages on the
south ends of the properties, and a small boathouse near the 1akeshore. Mr. Meloche
said he is willing to remove the westerly garage immediately, but would not want
to remove the easterly garage within one year as recommended in the Planner's report.

It wasc1arliied that the applicants need a simple subdivision in order to relocate
the lot line, a conditional use permit to develop substandard lots, and a variance
for reduced side yard setbacks.
Mr. Meloche said he does not want to be held to the one year limitation of the
conditional use permit and he was told that the zoning ordinance does provide for
extensions of same.
Spellman moved, seconded by Watten to recommend to Council approval of the simple
subdivision, conditional use permit, and setback variances, all of which pertain to
both the Meloche and Bauman lots, and subject to the Planner's recommendations as
listed below. Planner Nielsen suggested that Mr. Meloche be required to remove the
westerly" garage within one year from the date of Council approval, and remove the
easterly garage when a building permit is issued. Spellman amended his motion to
reflect this. Motion carried unanimously.
1. The applicant must provide new surveys of the two newly configured lots, along
with new legal descriptions of the lots. This should be done within 30 days of
the Council's approval.
2. The applicants must submit up-to-date title opinions (within the last 30 days)
showing their control of the property. This will be subject to satisfactory
review by the City Attorney.
3. The division/combination must be recorded with Hennepin County within 30 days
of the applicant's receipt of the Council resolution approving the request.

Recommendations, continued:
4. The two southernmost garages must be removed within some reasonable length of
time. It is suggested that the westerly garage be removed within one year from
the date of Council approval, and the easterly garage be removed when a building
permit is issued. The City should give serious consideration to requiring the
nonconforming boat house to be removed (or moved back) as well.
5. The property division should be designed so as to leave adequate room for
Mr. Bauman's garage plus a 10 foot side setback and a 50 foot front yard setback.
The proposed garage is not acceptable in its current location - 33 feet from
the street r.o.w.
The Commission also gave consideration to the issue of rezoning the Birch Bluff area
to R-1C. Reese moved, reconded by Spellman to delay any decision on the rezoning
issue until the Study Session meeting. Motion carried unanimously.
8:30 PUBLIC HEARING - SIMPLE SUBDIVISION, CONDITIONAL USE PERMIT AND VARIANCES
Christmas Lake Association/DNR - Merry Lane
Public portion of the public hearing opened at 8:46 P.M.
Planner Nielsen reviewed for the Commission a summarization of the current requests.
As detailed in his letter to Frank Fallon, dated February 19, 1986, Planner Nielsen
explained that a subdivision will be necessary to divide Interstudy B from Interstudy A
and then legally combine B with Interstudy C. Also, the Fayfield parcel must be
combined with Interstudy A. A conditional use permit is required for the development
of a substandard lot. Finally, several variances are needed for lot area, lot depth,
setbacks, etc.
Scott Bracke, Landscape Architect for the DNR presented a drawing of the plans for the
access site which included landscape, bituminous road surface and parking facilities.
Public portion of the public hearing closed at 8:53 P.M. without comment.
Comm. Spellman questioned who would be responsible for maintenance, and if it were
owned by the, DNR, wouldn't they maintain it? Council Liaison Stover said that it
was her ynderstanding that the City would maintain it to its own standards regardless
of who oWned it. If the access was opposed by the City, the DNR would acquire the
site and develop it without any voice by the City. Mr. Fallon said that agreements
have provided that the taxpayers will pay for maintenance costs, and the DNR will pay
for the capital costs. Annual estimated costs to the City include about $200 for
insurance, and $6,000 - $8,000 for maintenance.
Comm. Spellman said that he doesn't feel that the 2 inch bituminous surface of the
road and parking area, as proposed by the DNR, is sufficient. Mr. Bracke responded
that the DNR feels it is.
Margaret Hottinger of Interstudy asked if they may have the optkm of keeping the
substandard buildings on the Fayfield property. Planner Nielsen said that he feels
strongly that these buildings be removed, although the time limit is open to discussion.
Ms. Hottinger said the buildings are rental homes and they will need some time to
notify the tenants. Planner Nielsen said he would not recommend allowing the buildings
to remain for longer than one year.

Christmas Lake Access, continued:
The Commission discussed the Planner's end City Engineer's recommendatiOns as listed
in their reports, on an itemized basis.
The Planner's recommendations, as amended, are as follows:
1. Substandard buildings on the Fayfield property should be removed before January 1,
1987.
2. The Fayfield property should be legally combined with the Interstudy site.
3. The small parcel to be conveyed to Paul Ellwood must be legally combined with
his property north of the access site.
4. The applicants must submit up-to-date title opinions, new surveys and new legal
descriptions of the reconfigured parcels.
5. Other types of ground cover should be considered for the center islands and
easterly borders of the parking area.
6. The City should require the access road to be constructed in compliance with the
recommendation of the City Engineer.
The City Engineer's recommendations are as follows:
1. Traffic signs should be installed to identify the site and to route traffic flow
on the site. A public lake access sign should be installed at the intersection
of the S.T.H. 7 service road and the lake access road.
2. On site traffic should be signed to maximize boat launching movements and queing.
3. The typical street section of a 2" bituminous surface over 6" of Class 5 aggregate
base is less than the Mn/DOT recommended street cross-section minimum. Mn/DOT
recommends a bituminous surface granular equivalency of 7. The 2" bituminous
surface yields a granular equivalence of 4 to 4.5.
4. As prftsently shown on the plans, side slope construction extends beyond the
30 foot wide easement in conjunction with construction of the access road.
5. Sod should be placed to the edge of the 2 foot aggregate shoulder where no curb
exists rather than to the edge of the bituminous mat.
6. Due to the traffic loads which will be imposed on the shallow corrugated metal
pipe culverts, exceptional pipe bedding installation procedures should be specified,
or consideration given to the installation of a reinforced concrete pipe culvert
to resist crushing.
7. A trash rack should be installed at the upstream end of Culver No.1, along with
aprons on the other ends of the culverts.
8. Flow lines could be shown on the bituminous parking lot plan sheet to help the
contractor during construction.

9:00 PUBLIC HEARING - PRELIMINARY AND FINAL PLAT
Harding Acres Second Addition - Wedgewood Drive
Public portion of the public hearing opened at 9:55 P.M.
Planner Nielsen reminded the Commission that last year the City approved an 18-lot
preliminary plat for Harding acres. Final plat approval was given for six of the
lots and they are now requesting approval of the 12-lot second phase. The drawings
are consistent with the previous request and meet all zoning requirements.
Darwin Meyers, Wedgewood Drive asked about the drainage plans. Planner Nielsen
pointed out that the developer is installing a pipe to drain runoff to a holding pond
which would release it to a natural drainage flow to the wetlands to the north.
Chuck Amlaw, Smithtown Road, wanted to know that all the lots will meet the 20,000
sq. ft. ~inimum, and also if there is planned to be a cul-de-sac from the south.
Planner Nielsen responded that yes, all lots will be at least 20,000 sq. feet, and
a cul-de-sac from the south is not planned.

and final plat subject to the provisions of the Subdivision Ordinance. Motion

9:15 PUBLIC HEARING - SETBACK VARIANCE
David Haskins - 5472 Carrie Lane
Public portion of the public hearing opened at 10:07 P.M.

Mr. Haskins was present to request a setback variance to the road as well as the south
border of his property. He explained that he had designed a house according to the
preliminary plat which showed a 30 foot setback all around the lot. Planner Nielsen
said that the final plat, as signed by Robert S.C. Peterson, contained a 35 foot
setback on the east and a 50 foot setback on the south. Mr. Haskins said that alter-
native designs for the house would result in having to remove additional trees from
the lot and would also upset the drainage pattern.
Richard Gay, 5480 covington Road, said he was denied a 10 foot variance which he was
requesting for similar reasons about one year ago. He said that if Mr. Haskin's
request is approved he would like to see a condition placed which would prohibit
removal of any vegetation from the lot.
Walt Jones, 5520 Covington Road, is also concerned about preservation of trees and
aesthetic character of the lot. He said he is pleased with Mr. Haskin's site design
as proposed and has no objection to the request.

variance. Comm. Benson said that he supports the recommendation for denial because
it is apparent that Mr. Peterson misrepresented the lot at the sale, and he feels
that a house could be adequately designed within the current setbacks. Motion
carried by Roll Call Vote - 6 ayes.

MATTERS FROM THE FLOOR
Chair Leslie read aloud a letter received from the Heritage Residence applicants which
requests an additional extension of time beyond the original 60-day delay which was
approved at the February 4, 1986 Planning Commission in order to continue to assess
the water service situation. Reese moved, seconded by Spellman to approve an additional
60-day extention. Comm. Benson said he would like to see a Market Feasibility Study
submitted prior to this additional 60-day extension. Reese amended his motion to
reflect this requirement. Motion carried unanimously.
Mr. Ste~e Bruce, representing Allen K. Larson of 6050 Ridge Road presented for comment
a proposal for a C.U.P. to allow construction of a detached garage. This would be
the fourth accessory building on the lot as well as exceeding the 1,000 sq. ft. maximum
accessory space allowed. The Commission indicated that they would not likely recommend
approval of this proposal as it would be setting precedence.
REPORTS
Council Liaison Stover reminded the Commission of the Corridor Study meeting to be
held on Wednesday, April 2, 1986 at Minnetonka High School.
ADJOURNMENT
The next meeting of the Planning Commission is scheduled for Tuesday, April 15, 1986
at 7:30 P.M: Commissioner Schultz has already notified staff that he will be out of
town on ,that date.

AND APPURTENANT WORK

I. TYPE OF WORK
This work cons;sts of the replacement of the existing street surface with a new
bituminous pavement surface, and a rolled bituminous curb or concrete curb and
gutter, whichever is selected. Also included in this project is the construction
of approximately 4,300 feet of 12 inch through 42 inch storm sewer and appurte-
nant work as shown on Sheet A.
II . LOCATION
The proposed project area is in the western portion of the City of Shorewood in
Sections 31, 32 and 33 of Township 117N, Range 23 West, and includes property in
the following described plats (also see attached map on Sheet A):
Afton Meadows, Blocks 1, 2, 3, and 4
Lots 1, 2, 3 & 4 Minnewashta Acres
Lot 10, Auditor Subdivision No. 247 & Wild Duck Second Addition
III. DESCRIPTION OF PROJECT
Streets to be replaced with either 30 or 24 foot face to face bituminous streets
are as follows:
Afton Road from Cathcart Drive to Smithtown Road,
Beverly Drive from Cathcart Drive to Cul-de-sac,
Cajed Road from Beverly Drive to Smithtown Road,
Cathcart Drive from W. 62nd Street to Smithtown Road, and
Wedgewood Drive from Mallard Lane east to cul-de-sac.
Included in this project is the construction of 1,000 lineal feet of storm sewer
in Cajed Road from Beverly Drive to a Lake Minnetonka wetland outlet, and 3,300
lineal feet of storm sewer in Cathcart Drive from W. 62nd Street to a Lake
Minnetonka wetland outlet.
IV. FEASIBILITY
From an engineering standpoint, this project is feasible and can be accomplished
as proposed and does not have to be done in conjunction with another project.
V. ESTIMATED COST
The estimated project cost of the facilities are as outlined on the following
pages.

We the neighborhood of Beverl y Drive and Cajed Lane would like to see a
dead-end at Cajed Lane and Beverly Drive. This would greatly reduce through
traffic, thereby cutting down on wear and tear on the road. We do riot feel
this will create a safety hazard as much as it would a safety feature.
