"" ~~~'~U~~~~B~~~B ROAD 7:30 PM M I NUT E S CALL TO ORDER The regular meeting of the Shorewood City Council was called to order at 7:30 PM, August 25, 1986 in the Council Chambers by Mayor Rascop. PLEDGE OF ALLEGIANCE AND PRAYER Mayor Rascop opened the Council meeting with the Pledge of Allegiance and a prayer. ROLL CALL Present: Mayor Rascop, Councilmembers Shaw, Gagne and Haugen (Stover absent) Staff: Attorney Froberg, Engineer Mogan, Planner Nielsen, Administrator Vogt and Clerk Kennelly APPROVAL OF MINUTES Gagne moved, seconded by Haugen, to approve the minutes of the regular Council meeting of August 11, 1986, as written. Motion carried unanimously. PARK COMMISSION REPORT Badger Park Football Field Commissioner Ken Vogel reviewed an estimate of $3~350.00 to repair Badger Football Field. This would include the removal of the bad fill, replacement of fill, and seeding and fertilizing. Attorney Froberg submitted a letter for approval to be sent to Aspen Excavating requesting the removal of the bad fill received from them. The request is to have the fill removed in 10 days or the City will remove it and bill Aspen for the work. The City should scrape the fill off and pile it for pick up. The Park Commission feels the Manor Park Baseball field needs aerating and additional fill. Commissioner Jakel can get use .of the Minnetonka High School's machinery to aerate the field. Hockey Goals and Safety Netting on North End of Cathcart Rink The Park Commission requested $500.00 to replace the hockey goals and add a safety net on the north end of the hockey boards. Gagne moved, seconded by Shaw, to approve the request for goals and safety net. Motion carried - 4 ayes. -1- I COUNCIL MEETING ... MONDAY, AUGUST 25,~86 page two . PARK COMMISSION REPORT - continued Badger Football Field Commissioner Laberee submitted two bids to remove, pile, replace i'Jll, seed and fertilize (once) Badger Field: ~ Don's Sod ........ ......... $ 3,350.00 .' C. G. Brown Turf .......... $ 3,650.00 Commissioner Jakel will contact Minnetonka School's Groundskeeper to get an expert opinion on repairing Badger Park and Manor Park fields. Manor Park Warming House/Pavilion "Request for Proposal" The Manor Park warming house/pavilion R.F.P. has been completed and is ready to be sent out for architectual proposals. Haugen moved, Gagne seconded, to approve the R.F.P. for submittal for proposals. Motion carried - 4 ayes. TEMPORARY SIGN PERMIT - OUR SAVIOR'S LUTHERAN CHURCH A request was received from Our Savior's Lutheran Church at 23290 State Highway 7 for 2 consecutive 7 day temporary sign permits. Gagne moved, Haugen seconded, to approve the requests as submitted. Motion carried - 4 ayes. REQUEST FOR MUNICIPAL WATER Jerry Peterson has requested to connect his new home at 4660 Bayswater Road to municipal water. Planner Nielsen referred to the staff discussion and setting policy for these types of requests. The cost of the ass€ssment should be equal to the cost assessed against the Amesbury project plus interest. Haugen felt this should be an upfront payment, like a well installation would be. Shaw moved, seconded by Gagne, to approve the water connection at a rate equal to the projects assessment plus interest. Motion carried - 4 ayes. DOCK REQUEST (RECONSIDERATION) - DON SHAFER RESOLUTION NO. 98-86 Don Shafer of 23880 Smithtown Road reconsideration of their denial of at 5570 Timber Lane. He feels the dock constitute an existing dock. abandoned, and no notice was given has asked the Council for a dock to go with the property dock pilings and portions of This dock should not be considered as stated in the City Ordinance. Gagne moved, seconded by Haugen, to move to reconsider the Resolution of denial. Motion carried - 4 ayes. Gagne did feel there was portions of the dock still existing. The sign, shown on Exhibit A, is consistent with the requirements of the Shorewood Zoning Ordinance. As you will recall, the Ordinance limits the size of such signs to 50 square feet, but allows larger signs for large P.U.D.'s. The assessment is being calculated on a unit basis. The amounts to be as- sessed to the four developments in the area have been discussed with each developer. The petitions which were received from the developers contained a unit cost amount and the number of units to be assessed. The cost per unit was petitioned at $1,800 to 1,900. To find the as- sessment rate for each developer, staff mulitiplied the total amount of bond issue with the number of units in each development and divided that amount by the total number of units. The house, located at 5270 Howard's Point Road (see Site Location map - Exhibit A, attached), is five feet too close to the Howard's Point Road right-of-way, making it a nonconforming structure, the expansion of which requires a C.U.P. As can be seen on Exhibit B, the new deck measures 8' x 29.5' and is located approximately 30 feet from the north property line and 65 feet from the shore- line of Lake Minnetonka. ANALYSIS/RECOMMENDATION Despite the applicant's failure to apply for a building permit (for which he will be charged a double fee), the deck complies with the requirements of Section 200.03 Subd. 1 of the Shorewood Zoning Ordinance, specifically: 1. The deck does not increase the nonconformity of the existing house. The setbacks for the property are 20 feet on the north side and 50 feet from the" lake. 2. DENNIS - C.U.P., EXPANSION OF A NONCONFORMING STRUCTURE FILE NO.: 405 (86.34) BACKGROUND Mr. Dennis Jabs recently constructed a deck on the east side of his home without first obtaining a building permit. When told he needed a permit, it was also discovered that a conditional use permit was needed because his house does not comply with the setback requirements of the R-1C zoning district. The house, located at 20915 Radisson Road (see Site Location map - attached), is only three feet from the Radisson Road right-of-way. feet is the required setback. ANALYSIS/RECOMMENDATION For the most part, Mr. Jabs' deck complies with the prov1s1ons of Section 200.03 Subd. 1k. It is complicated, however, by the fact that the property in question exists as three separate parcels of land, each having its own property identification number. As can be seen on Exhibit B, the deck extends over the property line between the two main parcels. The result is that the deck substantially increases the nonconformity of the house. The solution to this problem is quite simple and inexpensive. It only requires the applicant to request that the County combine the three parcels into one. Not only would the deck conform to the Zoning Ordinance, but the nonconformity of the house would also be decreased. It is currently nine feet from the middle lot line where 20 feet is required. Re: Jabs, Dennis-CUP 26 August 1986 Mr. Jabs is concerned about this solution, however, having purchased the property with the understanding that it was two lots. While he has no current plans to sell either of the lots, he prefers to keep the option to do so open. ltis important to realize that the three parcels combined constitute a standard buildable lot in the R-1C/s zoning district. Separately, however, the lots are grossly substandard in both area and width and are considered unbuildable. The westerly parcel is only 60 feet wide and contains 12,840 square feet of area. The easterly parcel is 65 feet wide and contains only 10,692 square feet of area. The R-1C district requires 100 feet of width and 20,000 square feet of area. Not only do the lots not meet 70 pre cent of the width and area necessary to be considered buildable, but the 20 feet side yard setbacks required for lots in the "s" district result in only 20 and 25 foot strips in which a building could be located. When this was discussed with the applicant he cited the fact that the property has been assessed for two sewer units as proof that the lots are buildable. This has not been the case in Shorewood in the past. The last time the City was confronted with a similar situation, the additional sewer assessment was simply refunded. In view of the preceding, it is recommended that the conditional use permit be granted and the deck should be allowed to remain as constructed. This should be specifically conditioned on the applicant legally combining the parcels in question within thirty days of the Council's approval of the C.U.P. To make matters worse, the building is located only 22 feet from the shoreline of Lake Minnetonka (see Exhibit B, attached). When confronted with the order to remove or relocate the structure, Mr. Joe Sazenski, the resident of the property asked if he could apply for a variance to leave the building in its current location. Despite being advised that a variance was unlikely, he chose to apply on behalf of the owner, a Mr. Jim Sidwell. According to the applicant, the building measures 10' x 14'. His justification for the variance is a need for storage of lawn mowers, boat supplies, fishing equipment, snow shovels and a dog kennel. ANALYSIS/RECOMMENDATION Based upon field inspection of the site and review of Section 200.05 Subd. 2b. of the~horewood Zoning Ordinance, there appears to be no justification for a variance in this situation. The setback requirements of the Zoning Ordinance would not deprive the applicant of rights commonly enjoyed by other properties located in the same zoning district. Furthermore, to grant the variance would confer a special privilege on the applicant that is denied to other property owners. Finally, the request fails to meet a basic test - that the structure can not be built within the setback requirements of the Ordinance. AND VARIANCE, EXPANSION OF A NONCONFORMING STRUCTURE FILE NO.: 405 (86.38) BACKGROUND In June of this year, Mr. Robert Bergstrand received a setback variance to build a garage on his property located at 27100 Edgewood Road (see Site Location map - Exhibit A, attached). He now proposes to add a second story and extensively remodel the existing cabin located on the site. As you may recall, the subject site is quite substandard for the R-1A zoning district, particularly with regard to width and area. In addition to the nonconformity of the lot, the cabin is nonconforming in that it does not meet the required side yard setbacks. While 20 feet is required, the cabin is only five feet from the easterly lot line and almost touches the westerly lot line. Due to this nonconformity, any expansion requires a conditional use permit. Since the expansion will increase the non- conformity of the structure, a variance has also been requested. The existing cabin measures approximately 24' x 42' and contains 1024 square feet. The proposed second story addition would double the floor area and convert the single-bedroom cabin to a three-bedroom house. Plans for the expansion and remodeling are shown on Exhibits C - F. ANALYSIS/RECOMMENDATION Despite the extent of nonconformity of the site and the existing cabin, there are several factors which suggest that the variance allowing an increase in the nonconformity may be justified. First, the cabin is considered to be very small. One bedroom homes are extremely difficult to market. Even a couple with no children would typically want more space. Secondly, lot configuration (in this case, extreme narrowness) cited in the criteria for oonsideration of variances. Re: Bergstrand, Robert-CUP & Variance 28 August 1986 Relative to the development of substandard lots, the Zoning Ordinance imposes a maximum floor area to lot area ratio of 30 percent. Even with the new garage and the proposed addition, the ratio would only be 22 percent. Finally, it is worth noting that there is a vacant 21-foot strip of land on the east side of the property. The owner is not interested in selling it because, she feels that the lake access enhances the value of her property across the street. Since this property is unbuildable, it creates some open space between the subject property and the property to the east. -~ If the City is willing to grant the variance, it is suggested that the following conditions be imposed: 1. The proposed plan extends the easterly wall approximately two feet beyond the existing foundation wall. This would not be a problem except for the location of a large oak tree near the southeast corner of the building. It is likely that additional excavation near the roots of that tree will result in loss of the tree. It is recommended that the building not extend beyond the existing walls, or it should be designed so as to not disturb the roots of the tree. 2. The Council resolution approving the request should clearly state that in granting the variance, it is intended that no further expansion of the structure should be allowed. (612) 474-3236 MEMORANDUM TO: PLANNING COMMISSION, MAYOR AND CITY COUNCIL .,4 FROM: BRAD NIELSEN DATE: 28 AUGUST 1986 RE: AMERICAN LEGION - SETBACK AND DRIVEWAY VARIANCE FILE NO.: 405 (86.39) BACKGROUND In their continuing program of upgrading their club, the Clarence Clofer American Legion Post 259 proposes to pave, curb and stripe the parking lot on their property located at 24450 Smithtown Road (see Site Location map - Exhibit A, attached). In order to maximize the number of parking spaces and accommodate drainage at the same time, they have requested a five foot setback variance along the northerly 155 feet of their easterly lot line (see Exhibit B, attached). In addition to the setback variance, they have requested a variance allowing them to have two driveways. The proposed parking lot contains 72 paved spaces with a stormwater retention pond located on the north end of the parking lot. Their site plan also includes seven unpaved spaces for sub-compact cars just north of the building. In addition to simply wanting to upgrade their site, the proposed parking lot provides additional parking space which will allow future expansion of their existing building. ANALYSIS/RECOMMENDATION Requirements for parking lot design are contained in Section 200.03 Subd. 5d.(8) of the Shorewood Zoning Ordinance. Despite the two variances being requested, the applicant's engineers have done an excellent job of complying with the detailed specifications contained in the Ordinance. Areas of compliance include stall and aisle size, driveway spacing, maximum grade, surfacing, curbing and stiping. With regard to the setback variance along the easterly property line, it must be realized that the narrowness of the rear portion of the site makes it very difficult to accommodate three rows of parking, even with angled stalls. Conse- quently, they have shifted the parking as far to the east as possible, anticipating A Residential Community on Lake Minnetonka's South Shore 1c2- I . . Re: American Legion-Variances 28 August 1986 that in the future the rear of the Tom Thumb store property will also be used for parking. For this reason they have also shown bituminous curbing along that edge of the parking lot. Again as a result of narrowness of the site and the need for angle parking, it is reasonable to have two driveways, even though the Ordinance requires 125 feet of street frontage per driveway opening. The site has 210 feet of frontage on Smithtown Road. Approval should be given with the understanding that the existing driveway on the east side of the site should be eliminated and sodded over. ..... At such time as the new addition is proposed or sooner, the Legion should reorient their existing handicap ramp to the new parking lot. The applicant's engineers propose to collect surface drainage at the north end of the site with a catch basin. Water will be piped into a small retention pond and released through an outlet structure. Detailed runoff calculations and plans for the stormwater facilities have been submitted and should be subject to review and approval by the City Engineer. One improvement in design is strongly suggested. Given the length of parking lanes and the need to maintain proper aisle widths, it is suggested that the proposed paint-striped islands in the center of the lot be changed to concrete islands similar to the one on the north end of the lot. This will help to maintain a straight row and proper angle of parking, particularly when there is snow on the ground. Based upon the preceding, it is recommended that the variances be granted subject to installation of concrete center islands and review and approval of drainage plans by the City Engineer. AND SETBACK VARIANCE, EXPANSION OF A NONCONFORMING STRUCTURE FILE NO.: 405 (86.35) BACKGROUND Mr. William Gullifer has requested a building permit to build a room addition on the southwest side of his home, located at 20655 Manor Road (see Site Location map - Exhibit A, attached). The house does not meet the rear yard setback requirement for the R-1C zoning district. As can be seen on Exhibit B, the garage is located only 17 feet from the rear lot line, while the Zoning Ordinance requires 40 feet. Since the structure does not conform to the setback requirement, a conditional use permit is required to expand it. The applicant has also requested a 13 foot setback variance on the St. Alban's Bay Road side of the house. His application cites the following reasons for the variance request: " layout blends well with the existing building/landscape - south side of house selected for ease of conversion/practical layout - well is located approximately 12 feet east of bedroom #2 - there are three very large evergreen trees behind garage area - being on a corner lot, we have two front yard setbacks of 35 feet - we need a variance on the St. Alban's Bay Road side. " The proposed addition measures 24' x 26' on each of two levels. A 10' x 24' deck is proposed on the northerly side of the addition. Re: Gullifer, William-CUP & Variance 27 August 1986 ANALYSIS/RECOMMENDATION When the City relaxed its zoning regulations to allow the expansion of noncon- forming structures, the primary criteria for evaluating such requests was that the expansion should not increase the nonconformity of the property. Therefore the focus of this request should be whether or not the variance to increase the nonconformity is justified. The applicant states that the room addition is necessary to accommodate the increasing size of his family. Given the size of the existing house, however, there appears to be ample room in the lower level to add one or more bedrooms. Even if it were critical to have all the sleeping rooms on one level, there is adequate room to expand within the buildable area of the lot, despite the location of the well and the trees. This is illustrated on Exhibit C. With regard to the property having two 35-foot setbacks, this is true of all corner lots. If an exception is to be made for this reason, the Zoning Ordinance should be changed to apply to all corner lots. This is not recommended. Given the size of the existing structure and the buildable area available, it is difficult to demonstrate that any hardship exists which would warrant a variance. It is therefore suggested that the Planning Commission recommend denial of the variance request and approval of the conditional use permit with the stipulation that the addition be redesigned to comply with setback requirements. Vogt MEMORANDUM TO: MAYOR AND CITY COUNCIL FROM: BRAD NIELSEN DATE: 4 SEPTEMBER 1986 RE: WCL ACRES - FINAL PLAT FILE NO.: 405 (86.29) In June of this year the City approved a preliminary plat for a seven-lot subdivision called WCL Acres. As you recall, the property is located south of Yellowstone Trail, approximately 200 feet east of Minnetonka Drive. The developer, Richard Larsen, has now requested final plat approval for the project. Issues pertaining to the final plat are primarily engineering in nature. The City Engineer has reviewed the plat and will provide his comments in a separate staff report. From a planning perspective, the final plat is consistent with the preliminary plat which was approved in June. It should be noted that there is one difference between the preliminary and final plats. Originally, the developer showed the street with a 50 foot r.o.w., consistent with the Subdivision Ordinance. In order to overcome street grade problems, he has increased the r.o.w. width to 60 feet. While this has the effect of reducing the area of the lots, all lots still meet or exceed the minimum lot size for the R-1C zoning district. .,' Assuming there are no problems from an engineering standpoint, it is recommended that the final plat be approved subject to the following: 1. Drainage and utility easements along side and rear lot lines must be widened to 10 feet. 2. The developer should submit an estimate of costs for construction of site improvements (site grading, utilities and streets, etc) for review and approval by the City Engineer. Park dedication fees of $500 pek lot (credit is given for the lot with the house on it) must be paid prior~to release of Council resolution approving the plat. 4. It is recommended that the staff be directed to prepare a standard development agreement incorporating these items and other requirements of the Shorewood Subdivision Ordinance. Final plat approval should be subject to the developer entering into this agreement with the City. Hopefully, the agreement will be done in time for the meeting on 22 September. Newspaper reporters will likely include this agenda material and discussion in their articles. I thought you'd appreciate a little advance information on the subject. As you may remember from last year, there were six options under consideration: three which would keep West Junior High closed and three which would reopen WJH. Very briefly, the first three would cost more capital dollars over ten years ($3+ million). The second three would cost more operational dollars ($10+ million) over ten years. All six remain viable at this point. Internal discussion this summer of how best to proceed led to yet another two options, hoping somehow to accommodate rising student memberships in lower grades while keeping additional costs to taxpayers at reasonable levels. This brainstorming led to two additional options: #7: Reopen WJH which is large and close to Excelsior Elementary School which is small. or #8: Reopen WJH which is large and close to Minnewashta Elementary School which is small. In both options, School District 276 would continue to operate just eight school buildings for students, but a smaller elementary school would be traded for a larger one (WJH). We have not yet done all the cost calculations for a ten year period. Nor have the student memberships for this fall been finalized--school begins September 2, 1986--which is a critical determination of future space needs. As we carry out this homework, word of it will eventually be moving through the ~ community. I thought you'd appreciate some advance word on it. Also, if you'd kindly share it with other councilpersons, we'd be grateful. I anticipate the School Board will be adopting a decision-making timeline at their first meeting in September. The timeline will likely include three public hearings on the entire student/space match question. Motion carried unanimously. 7:45 PM PUBLIC HEARING - CONDITIONAL USE PERMIT TO EXPAND A NONCONFORMING STRUCTURE Dennis Jabs - 20915 Radisson Road # Public portion of the public hearing opened at 7:45 P.M. Mr. Jabs presented photos of a previous deck and handicap ramp which had extended over the lot line which divided two of his three substandard lots. He recently built a deck at the same location without obtaining a building permit. His house is only three feet from Radisson Road, making it a nonconforming structure. He was informed that he needs a C.U.P. to expand his structure and to combine his three parcels so as to eliminate the lot line over which the deck extends. Mr. Jabs said he objects to all the fees for special permits. He said his neighbor had been allowed to work on a deck attached to a nonconforming structure with only a building pemrit. He cited Minneapolis zoning standards and said they allow structures to be placed over lot lines. He feels he will lose value in his land if he is forced to combine the lots. He thinks the lots are buildable separately because they were each assessed for sewer separately. Susan Sidwell, daughter of Jim Sidwell was present to represent the applicant. As explained in the Planner's report, a boathouse was constructed without a building permit and built only 22 feet from the shoreline of Lake Minnetonka (setback from the lake is 50 feet). Ms. Sidwell said that a rock wall as well as some fuel tanks prevented relocation of the structure to comply with the 50 foot setback in the area that it is currently placed. In order to accommodate the maximum number of parking spaces as well as drainage, they have requested a five foot setback variance along the northerly 155 feet of the easterly lot. Mr. Guy Streater of the Legion said he has spoken to the owner of Tom Thumb who has told him that he has no objection to the setback variance for the east lot.
