NCIL CHAMBERS COUNCIL MEETING 5" 55 COUNTRY CLUB ROAD SEPTEMBER 22, 1986 7:30 P.M. f M I NUT E S CALL TO ORDER The regular meeting of the Shorewood City Council was cal~ed to order at 7:30 P.M. September 22, 1986 in the Council Chambers. PLEDGE OF ALLEGIANCE AND PRAYER Acting Mayor Gagne opened the Council Meeting with the Pledge of Allegiance and Prayer. ROLL CALL Present: Acting Mayor Gagne, Councilmembers Haugen, Shaw and Stover (Mayor Rascop arrived at 9:05 P.M.) Staff Attorney Froberg, Engineer Norton, Planner Nielsen, Administrator Vogt and Clerk Kennelly. APPROVAL OF MINUTES Haugen moved, seconded by Stover, to approve the minutes of the September 8, 1986 Council Meeting to include corrections on pages 5 and 6. Motion carried - 4 ayes. PLANNING COMMISSION REPORT Gagne referred to the Planning Commission minutes of September 16, 1986 submitted with the Council packet. PARK COMMISSION REPORT Shaw reported on the last Park Commission meeting that Administrator Vogt attended. H~ explained the reason for the change of loca- tion of the well on the Silver Wood Park site. He also reviewed the ptatus of various other projects in the City currently in progress. He also indicated that the LAWCON grant application has been denied. The Commission approved the storage location of fill to be removed from the Badger field, for later removal. The Commission thanked Administrator Vogt for attending their meeting and for the status report on current projects. CONSENT AGENDA APPROVALS RESOLUTION NO.109-86 Covington Vine Ridge - Reduction of Letter of Credit A request for a reduction of a Letter of Credit for the Covington Vine Ridge project has been received from Ron Helmer of United Mortgage Company. The Council approved the reduction of their Letter of Credit to $336,000.00 as recommended by staff. -1- Ill- COUNCIL MINUTES . MONDAY, SEPTEMBER~2, 1986 page two . Near Mountain Street Lighting Request A request and location diagram was received requesting street lighting for Chestnut Ridge at Near Mountain 9th Addition and Sweetwater at Near Mountain. Acceptance of Quote For The Compl~tinn of Badger Park Football Field Park Commission has recommended acceptance and authorization to complete the work needed to Badger Football Field. They recommend the Bid be given to Don's Sod Service in the amount of $3,350.00 this being the lowest bid received. Approval of Equipment Purchase Publicwcrks Director is requesting to purchase a 16' trailer and replacement of a garage door for the maintenance building. Gagne has recommeded the expenditure at a total cost of $5,620.00. Shorewood Tanning Center - Building & Occupancy Permit A request has been received for a building permit and occupancy for a 10 booth tanning studio in the Shorewood Shopping Center. Nielsen recommended approval subject to compliance with all health and building codes. Haugen moved, seconded by Stover, to approve all items listed on the consent agenda. Motion carried - 4 ayes. (Rascop absent) WCL ACRES - FINAL PLAT & DEVELOP~lliNT AGREEMENT APPROVAL RESOLUTION NO. 110-86 Staff has gone over the current WCL Acres plans and has made some plan revisions that will be finalized for review by the Engineer, with those changes the staff recommended approval of the final plat and development agreement. Haugen moved, seconded by Gagne, to approve the final plat and development agreement subject to Engineers approval of drainage plans and receipt of revised plans. Final Resolution to be held until staff has reviewed all information as requested. Motion carried by Roll Call Vote - 4 ayes. MANITOU PROPERTIES REQUEST OF WITHDRAWAL A letter has been received from John J. Smith representing his clients, requesting withdrawal of their application for a C.U.P. for an outdoor storage facility at 5620 County Road 19. Shaw moved, seconded by Stover, to accept the withdrawal, not to be continued without a new application being submitted for this property. Motion carried - 4 ayes. REVISION OF THE MCDONALD VARIANCE RESOLUTION NO. 111-86 Nielsen reviewed the variance granted to Mike McDonald of 4695 Lagoon Drive granting (me variance and requesting that the garage be relocated as not to require a lakeshore setback variance. Mr. McDonald has returned to request a lakeshore setback variance due to the survey being incorrect. -2- COUNCIL MINUTES MONDAY, SEPTEMBER 22, 1986 page three . . REVISION OF THE MCDONALD VARIANCE-cont. " Two alternative plans have been submitted, of which, Mr. McDonald prefers plan B that requires a 14 variance but allows him to retain two additional trees. Nielsen recommended Plan A which requires a nine foot variance. Haugen moved, seconded by Gagne, to support Plan A and grant a 9' lakeshore setback variance, Motion carried - 4 ayes. C.U.P. - GULLIFER - 20655 MANOR ROAD RESOLUTION NO. 112-86 Mr. and Mrs. Gullifer of 20655 returned with revised addition plans to their home that would not require a setback variance, as the Council had suggested at the previous meeting. Shaw moved, seconded by Haugen, to approve the CUP to add to a non- conforming structure. Motion carried by Roll Call Vote - 4 ayes. SIDvlliLL DENIAL - FINDINGS OF _FACTS RESOLUTION NO. 113-86 Attorney Froberg submitted the finding of facts to deny the request of Mr. Sidwell of 5000 Shady Island Point for a setback variance. Findings of Fact were submitted and drawn in accordance with Council direction at the September 8, 1986 meeting. Stover moved, seconded by Shaw to accept the Resolution of denial as submitted. Motion carried by Roll Call Vote - 4 ayes. WILD DUCK 2nd ADDITION - OUTLOT DISCUSSION Mr. Jim Dutcher came before the Council to discuss the possibility of developing the Outlot of Wild Duck 2nd Addition. He would like to build 4 single family dwelling on this 3 acre parcel with 15,000 square feet going to Tonka Bay for Park property. Mr. Dutcher reviewed the history of the zoning being R-1 when he built his 9 double units. The zoning has changed to R-2 and now R-2A. Haugen understood that the reason the density was allowed was based upon the Outlot being open spaces,. Stover indicated that this project instituted the PUD ordinance. Council was given a copy of an easement to the City of Shorewood that was unsigned and unfiled that stated that the Outlot remain unbuildable. The orginal copy was never filed with the plat as the City had requested. Gagne questioned whether the zoning changes may warrant a reconsider- ation of its use. Shaw moved, seconded by Gagne, to obtain additional history and the effects the variance zoning changes have had on the property. Motion carried - 4 ayes. ATTORNEYS REPORT Water Tower Site Condemnation Status Attorney Froberg has received corresponsence with the State Hwy Dept. regarding the acquisition of the property for the SE Area wa~er tower site. -3- COUNCIL MINUTES ~ MONDAY, SEPTEMBE~2, 1986 page four . ATTORNEYS REPORT-cont. Water Tower Site Condemnation Status-cont. . The State wants to reconvey the land easement back to the heirs of the original owners, with the agreement that the City continue condemnation proceedings. Then at the completion of the condem- nation, the City would then grant an easement back to the State for the portions of the property they need for road use only. This would get the City the water tower site and some additional land. Shaw felt the State was asking to City to clear up a mistake that was made years ago. This would also turn over the responsibilty of the picnic area to the City. The Council feels the only area they choose to obtain would be for the water tower site only. Froberg will respond to the Highway Department with the Council's decision. ENGINEERS REPORT S.E. Area Deep Well Status Report E.H. Renner and Sons have the casing set and the alignment test done,if the progress continues, the well cost may come in lower than the bid. NEAR MOUNTAIN SIGN PERMIT RESOLUTION NO. 114-86 Lundgren Bros. have requested two sign permits for entrance mon- uments for the Sweetwater Addition and for the north entrance of the Near Mountain project. These requests are in compliance with the ordinance. Stover moved, seconcted by Gagne, to approve the sign permits as requested. Motion carried by Roll Call Vote - 4 ayes. ADMINISTRATORS REPORT Minnetonka High School - Slip Ramp Administrator Vogt attended the meeting regarding the traffic problems at the School. The School feels they will try to solve the problem internally by new traffic flow plans. MAYORS REPORT Hennepin County Park Group - Boat Ride Gagne reported on the boat ride and bus ride he attended, reviewing the various marinas, accesses and proposed new sites. Rascop arrived at 9:05 P.M. Metropolitan Council Report on Airports Council directed Planner Nielsen to respond to Metro Council, not accepting the report due to the lack of comments regarding the impact of air traffic to Lake Minnetonka. -4- COUNCIL MINUTES ~ MONDAY, SEPTEMBER~, 1986 page five . COUNCIl, REPORTS ~ Liquor Store I Lease Discussion The Store I lease is up for renewal on November 1, 1986. Gagne and Stover recommend a letter be drafted and sent by the Attorney to Mr. Niemela extending the lease for 6 months at the current rate. This would allow time to further negotiate the new lease agreement. The Council was in full agreement with the request. SHOREWOOD SHOPPING CENTER COMPLAINTS A letter has been drafted to Mr. Driskill regarding the violations of storage of tractor trailers on his property. VILLAGE PUMP COMPLAINT Gagne would like to see the property at Village Pump cleaned up, he feels additional controls should be instituted. If the business remains closed more than 90 days, an occupancy permit will need to reopen. The grandfathering items will no longer exist. At this time controls can be established when requesting a new occupancy permit. OUTSIDE STORAGE USE DISCUSSION Shaw questioned when and why the Outside Storage provlslon was established. Nielsen stated that it was put into the new zoning Ordinance without any specific request in mind. Stover moved, seconded by Gagne, to direct the Planning Commission to reconsider the Ordinance that provides for the primary use being outside storage. Motion carried - 5 ayes. DRAINAGE PROBLEM - AMLEE ACRES DOCU~ffiNT Gagne submitted a letter from former Mayor Frazier dated September 24, 1978 regarding drainage through Lot 15, Amlee Acres. He would like this letter placed with the property file. APPROVAL OF CLAIMS AND ADJOURNMENT Rascop moved, seconded by Shaw to adjourn the September 22, 1986 Council Meeting at 9:30 P.M. subject to approval of claims. Motion carried unanimously - 5 ay.es. ROLL CALL Present: Mayor Rascop, Councilmembers Stover, Gagne, Haugen and Shaw (Haugen and Shaw arrived at 7:45 PM) Staff Administrator Vogt, Finance Director Beck, Planner/ Bldg Inspector Nielsen, Public Works Director Zdrazil, Clerk Kennelly, and Finance Committee Member Bridge. BUDGET REVIEW Administrator Vogt began the 1987 Budget Review with an explanation of this years procedures. The actual mill rate will no be cal- culated until the end of this year, but this budget currently reflects approximately a l~ mill increase. The City's assessed valuation has gone up from last year as in the past. Vogt reviewed the Summary of disbursements; Infrastructure Replacement Fund proposed at $108,000; Revenues; Contributions from Liquor Stores for revenues; contingency Fund (December 1985 contingency fund amount at $249,363.00); Equipment Certificates; and Salaries. Council would like to see the intended salaries split out separately for each employee and held in the contingency fund. (Rascop left the Meeting at 8:30 PM) Administrator Vogt continued the possibility of contractual maintenance for the Parks. Park Commission will be studing this issue and returning with a recommendation to the Council. John Bridge, Finance Committee member, indicated that they had gone over the items in this budget and felt that it was acceptable, he would prefer if it could be kept equal with inflation. PUBLIC HEARING SET The Public Hearing to adopt the budget will be held on Monday, September 29th, in the Council Chambers at 7:30 PM. The public will have the right to comment and review the budget at this time. Inspector Nielsen, Public Works Director Zdrazil, Clerk Kennelly, and Finance Committee Member Bridge. CALL TO ORDER Mayor Rascop called the meeting to order at 7;30 PM, Monday, September 29, 1986. Administrator Vogt informed the Council of the need to postpone the Public Hearing set for 7;30 PM to create an Infrastructure Replacement Reserve Fund. Due to an error in not publishing the hearing notice two weeks successively, by the official newspaper, the hearing cannot be held. Stover moved, seconded by Gagne, to postpone the Infrastructure Fund public hearing until October 20, 1986. Council discussed further the need for this road replacement fund. Rascop will not support a 24 mill budget nor does he feel complete road replacement should be done to roads until water lines are installed. The Council does support the establishment of this fund but not at this time. Motion to set the Public Hearing was denied - 1 aye (Stover) 3 nay - 1 Abstain (Shaw). 8;00 PM PUBLIC HEARING - General Budget Mayor Rascop opened the Public portion of the Budget hearing at 8;20 PM. After receiving no public comment the hearing was closed. Acceptance of the 1987 Budget RESOLUTION NO. 115-86 Gagne moved, seconded by Stover, to approve the City Budget for 1987, without the Infrastructure Fund, at a total of $1,632,523.00. The Budget was adopted by Roll Call Vote - 5 ayes. Authorization of Advertisement for Bids and Set Bid Letting - Project e6-1E - SE Area Watermain Extension RESOLUTION NO. 116-86 Engineer Norton has made a request to advertise for bids to extend the Watermain to provide water to Waterford's 2nd Phase. Gagne moved, seconded by Haugen, to authorize bids and set bid letting for 11:30 AM on October 14, 1986. Motion carried. by Roll Call Vote - 5 ayes. -1- IG I . . While a new kennel may cost $200 to $300 new, a good deal of work would be necessary to remove the existing structure. Due to the fact that concrete would need to be broken out around the posts, Mr. Flesness has offered $75 for the 3-sided kennel. Also, it may be worth while to have the kennel removed to eliminate any fears by the neighbors that the City might use the kennel in the future to impound dogs. This item has been discussed with Attorney Froberg who sees no legal pro- blem with this sale of excess property by the City. Therefore, it is staff's recommendation for the City Council to authorize the sale of the dog kennel located at 5795 Country Club Road to Mr. Kermit Flesness of 5810 Echo Road for the sum of $75.00. Relative to the storage building, the most significant of the requirements is that it be screened from view. Given the relatively small size of the building, the distance from the road, and the amount of vegetation on the site, it is doubted that it will be seen from outside the site. The house, located a 5435 Timber Lane (see Site Location map - Exhibit A, attached), is thirteen feet too close to the easterly lot line and three feet too close to the westerly line, making it a nonconforming structure, the expansion of which requires a C.U.P. The applicant proposes to divide off two, one-ac!e lots on Yellowstone Trail (see Exhibit B, attached). The remaining south 2.6 acres will be set aside as an outlot for future resubdivision. Land use and zoning surrounding the site are as follows: East and West - single-family residential, zoned R-1C North - golf course, zoned R-1A South - State Highway 7 ANALYSIS/RECOMMENDATION Basically the proposed division complies with the requirements of Shorewood's zoning and subdivision ordinances. There are, however, several issues which should be addressed as part of the approval process. 1. Formal Plat. Even though the division proposes only two lots and an outlot at this time, it is recommended that it be considered as a preliminary plat. For this, a plat name should be provided and Lots 1 and 2 should be designated as Block 1. These items may be included as part of a final plat. Drainage and utility easements must be included on the final plat. Easements are required to be 10 feet wide along each side of each side and rear lot line. Easements should also be provided around the periphery of Outlot A. 3. Building Setbacks. While the existing house complies with building setback requirements, the garage located on Lot 2 does not. Furthermore, since the garage is an accessory building, it would be a nonconforming use without a principal dwelling on Lot 2. It is therefore recommended that it either be removed from the site or relocated on Lot 1. This should be done within 30 days of the applicant's receipt of the Council resolution approving the final plat. 4. Outlot A. As per direction by this office, the applicant has prepared a resubdivision sketch, or "ghost plat", showing how Outlot A can be redivided at some later date. The purpose of such a sketch is to demonstrate that the division being approved will not adversely affect the future development of the remaining property. It also serves as a guide for reviewing any future request for subdivision of the outlot. Although the resubdivision sketch shown on Exhibit B is simply a guide for future division, it should comply with zoning requirements as closely as possible. The minor revision shown on Exhibit C shows that the property can be divided into four lots which conform to the requirements of the R-1C district. While it need not be resolved at this time, it is worth noting that Wiltsey Lane, the street which provides access to Outlot A, exists as a gravel road. Presumeably an improved road will be required for the future lots in Outlot A at such time as it is divided. The question as to whether the existing road will have to be paved or not should be answered at that time. 5. Park Dedication. Prior to release of the final plat, a park dedication fee ($500) must be paid by the applicant. Credit is given for the lot with the existing house and additional fees will be collected at such time as Outlot A is developed. Subject to the preceding it is recommended that the preliminary plat be approved. The applicant should be directed to prepare a final plat incorporating these recommendations. As you know the increase from 10 feet to 20 feet has resulted in a considerable number of nonconformities being created. Consequently, many variance requests have been received. I explained this situation to Judy Boudreau, our area hydrologist from the MNDNR. She indicated that given the circumstances (i.e. extent of existing development, more stringent lot size requirements, and restrictions on lake- shore encroachment, etc.) it shouldn't be a problem to reduce the setback. It is our understanding that you are the current owner of the property and, consequently, responsible for it. The Council directed the staff to evaluate the property relative to possible zoning violations and have any such violations corrected as soon as possible. Our preliminary investigation suggests that the subject property does not conform to several of the requirements of the current Shorewood Zoning Ordinance. Such things as building setbacks, surfacing of parking areas, screening, and outdoor storage are all subject to question. The Zoning Ordinance does allow certain nonconformities to remain for either some specified period of time or until some alteration or expansion of the nonconforming building or use is proposed. This is often referred to as being "grandfathered in". The City Attorney has advised me that these "grandfather" rights typically only apply to permanent structures. This would not apply to two of the more notable problems on the site - parking and outdoor storage. This is particularly true on the east side of the property, where cars in various states of repair and auto- mobile parts are strewn across the site. The problem has been multiplied recently with cars, boats, trailers and various other materials and equipment being stored on the south side of the existing building. While it is realized that a certain amount of outdoor storage is necessary to an auto repair operation, it is felt that such storage Gan be accommodated without having a blighting influence on the area in which it is located. This is most often accomplished through screening and landscaping. For example, a fenced-in enclosure and some iandscaping would reduce the visual impact the site has. on the surrounding area. SHOREWOOD, MINNESOTA 55331 · (612) 474-3236 MEMORANDUM TO: PLANNING COMMISSION FROM: BRAD NIELSEN DATE: 2 OCTOBER 1986 RE: OUTDOOR STORAGE FILE NO.: 405 (Zoning Ordinance) At the last meeting of the Planning Commission, the Commission recommended that the City Council deny a conditional use permit for an outdoor storage facility proposed on County Road 19 across from the Plaza Shopping Center. As you may be aw~re, the applicant withdrew his request prior to its reaching the City Council. While this resolved the matter for the present, the City Council was somewhat surprized and concerned that such a use was even allowed by our Zoning Ordinance. They suggested that the Planning Commission study the issue and make a recommendation. The discussion which took place at the previous two meetings raised some very valid concerns relative to the acceptability of outdoor storage, especially as a permitted use. Security, screening, and aesthetics were among the issues discussed. Some- thing which was not discussed was the fact that very little tax base is generated by an open storage facility. This, combined with the potential need for police and fire service, su~st6 the possibility of a negative balance between contribution to and demand for public service. It would be unrealistic to completely eliminate outdoor storage from the Ordinance. However, an answer to the problem would be to limit such activity to being an accessory use to some other principal or conditional use. In addition, the area for outdoor storage could be limited to the area of the principal use or fraction thereof (e.g. fifty percent). A draft ordinance amendment incorporating these suggestions will be submitted to you at the meeting on Tuesday night. It is hoped that after discussing the matter, a public hearing can be scheduled for the November meeting. SIMPLE SUBDIVISION Tom Wickenheiser - 24655 Yellowstone Trail Mr. Wickenheiser was present to request preliminary plat approval to divide a portion of his 4.6 acre parcel into two, one-acre lots on Yellowstone Trail. He proposes to set aside the remaining 2.6 acres as an outlot for future resubdivision. The Planner's report recommends that the existing detached garage be removed or relocated so that it meets setback requirements on Lot 1 where the principal dwelling will be located. Mr. Wickenheiser said that he plans to have this taken care of. Mr. Wickenheiser asked who would be responsible for developing the road extending from Wiltsey Lane to serve the future subdivision of the outlot. Planner Nielsen said the developer would need to develop that portion up to City standards, although they would not be responsible for developing the existing gravel portion of Wiltsey Lane. Minutes Planning Commission Meeting October 7, 1986 7:45 PM PUBLIC HEARING - CONDITIONAL USE PERMIT - EXPANSION OF A NONCONFORMING STRUCTURE Pat Tarzian - 5435 Timber Lane Public portion of the public hearing opened at 7:A6 P.M. Ms. Tarzian explained that she had an existing deck expanded by 6 to 8 feet, rather than building a complete deck, and she did not realize that she needed a permit for this. The house does not meet current setback requirements and is therefore a nonconforming structure. The deck itself does meet all zoning requirements. Mike Kramer, 5425 Timber Lane, submitted a photograph and a copy of his written comments saying that the deck obstructs his view of the lake, especially when sitting in his favorite reading chair. Marjorie Yaeger, 5445 Timber Lane, submitted a letter stating objection to the request. Public portion of the public hearing closed at 7:59 P.M. Spellman moved, seconded by Watten to recommend to Council approval of the C.U.P. Motion carried unanimously by Roll Call Vote - 7 ayes. Schultz clarified for Mr. Kramer that the deck itself does meet the zoning requirements. STUDY SESSION Side yard setback - lakeshore lots (continued from September 16, 1986) Mr. Larry Reed was present because he has a request coming up next month to expand his lakeshore home which is located 10 feet from the side yard lot line. Planner Nielsen presented a map of the City showing the number of undeveloped lake- shore lots - less than ten on Lake Minnetonka. This means that the majority of the homes built at the original 10 foot setback are now nonconforming structures. This has accounted for an increased number of conditional use permits and variance requests. He stated that setbacks are intended to create or maintain a certain open space character. Given the amount of shoreline which has been developed, the character has already been established. He also felt it would be unfair to impose a stricter standard on a "handful" of remaining undeveloped lots. Commissioners discussed the validity of forcing lakeshore property owners to maintain open space for nonlakeshore property owners. It was also noted that it is easier to relax from a higher to a lower standard, but not from a lower to a higher standard. Benson moved, seconded by Schultz to bring this before a public hearing at the November 18th Planning Commission meeting with a draft ordinance changing the lakeshore side yard setback to 10 feet. Motion carried by Roll Call Vote - 6 ayes, 1 nay (Spellman). Modify Section 200.21 Subd. 4d. (outdoor storage) - accessory use only As a result of a recent request for an outdoor storage facility, the City Council took notice of a section of the Shorewood Zoning Ordinance which allowed for outdoor storage as a principal use. It was suggested that the Planning Commission study this section and make a recommendation. - 2 - . .. Minutes Planning Commission Meeting . October 7, 1986 Study Session, continued: Planner Nielsen suggests that one solution to the problem is to limit outdoor storage activity to being an accessory use only to some other principal or conditional use. He submitted a draft ordinance amendment which reads: "d. Open and outdoor storage as an accessory use provided that: (1) Such use does not constitute more than thirty (30) percent of the lot area and no more than the floor area of the first story of the principal structure. (2) The area is fenced and screened from view of neighboring.....'. Council Liaison Stover asked if a large principal building would allow for a large area of storage space. Planner Nielsen said that a large building would reduce the buildable area of the lot, and the required parking space would take up a lot of the rest. Spellman said he would like to see the green areas preserved. Schultz asked if storage must be related to the principal use. Planner Nielsen said yes, it does, and the term "accessory" takes care of that. Reese moved, seconded by Benson to set a public hearing for the November 18th Planning Commission meeting to make a recommendation for amending Section 200.21 Subd. 4d. of the Zoning Ordinance. Motion carried unanimously. MATTERS FROM THE FLOOR Watten said he was approached by John Cross with the idea of building a "mini-storage" behind the Tonka Plaza where is owns some acreage. Planner Nielsen informed the Commission that Manitou Properties is planning to propose a mini-storage on Co. Rd. 19. Watten also reported that the Legion now wants to further expand their building toward the lCO gas station (to the east). Planner Nielsen.said the side yard setback for commercial is 15 feet. REPORTS Council Liaison Stover reported that the mill rate is going down slightly while the City's assessed value is going up. Also, the Police Contract has been renewed, and the City is looking to buy some land for salt and sand storage. ADJOURNMENT Watten moved, seconded by Benson to adjourn the meeting at 9:19 P.M.
