(612) 474-3236 MEMO TO: Mayor and Councilmembers FROM: Dan Vogt '~ DATE: November 4, 1986 SUBJECT: Two-Way Radios - Mutual Aid Some time ago, the City Council authorized the Police Department to install the frequency for the Shorewood Public Works Department into the police radios. Although the radios have been used for mutual benefit in the past for such problems as slippery roads, an instancecwhich occured this past week is worthy of special note. In the mid-afternoon on October 29, a fuel truck overturned on Highway 7 near Pleasant Avenue in Shorewood. Fearing a spill getting into the storm drainage systems and possibly into the lake, the officer on the scene called the Shorewood Public Works Department on the radio requesting sand to block the drainage way. Within minutes members of the Shorewood Public Works crew were on the way to the accident scene with two loads of sand. Although no major spillage took place, the proper precautionary measures were taken with a great deal of expediency. This occured with the aid of the two-way radio system linking our crews with South Lake. As you can see, the decision to allow the sharing of the frequency is paying off as a benefit to all of our citizens. By the way, the contaminated soil from the spillage that did occur was re- moved under the direction of the Pollution Control Agency and all time and materials expended by the City is being billed to the owner of the vehicle involved. DJV/slt cc: Don Zdrazil SLMPSD A Re$idential Community on Lake Minnetonka's South Shore 8 ~ RESOLUTION NO. 43-86 WHEREAS, Shorewood Ordinance No. 78 provides for the regulation of highways, streets and alleys within the City of Shorewood; and WHEREAS, pursuant to such ordinance, the City Council had previously authorized the installation of a "No Left Turn" sign and barricade at Christmas Lake Road and Mill Street; and WHEREAS, Hennepin County had installed a "No Right Hand Turn" sign at said location; and WHEREAS, the City Council has determined that the existing situation at the intersection requires alternative measures of traffic control. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood, Minnesota, as follows: 1. That the "No Left Turn" sign and barricade be removed from the intersection of Christmas Lake Road and Mill Street. 2. That a "No Through Street" sign be installed at said location. 3. That Hennepin County be requested to remove their "No Right Hand Turn" sign at said location. 4. That upon removal of the "No Left Turn" and "No Right Hand Turn" signs and upon removal of the barricade at said location, vehicular traffic be permitted to make left or right hand turns at said intersection. Sla~~\!x~utive Director FROM: RE: Proposed policies and the policy adoption meeting Enclosed with this letter is a copy of the League of Minnesota Cities' 1987 Proposed City Policies and Priorities. Please consider them carefully and share them with other officials in your city. We are sending them out now, so you will have time to take formal action on them at a council meeting prior to the League's Policy Adoption Meeting on November 20, 1986. The Policy Adoption Meeting is in addition to the League's Legislative Conference which will be held on March 10, 1987. The League Board requested the change to boost participation in the policy adoption process and to give League lobbyists more time to prepare legislation before the session begins. The timing for policy adoption is only one of the changes in the process this year. The other major change was to bring up policy issues at the League's regional meetings so city officials could discuss the policies, offer comments, and express their opinions. League staff then took this information back to the policy committees for consideration. This gave more city officials a chance to mold the policies during the early stages of policy development. And, from the comments on the regional meeting surveys, League members appreciated this opportunity. Again, please study the enclosed policies, and plan to attend the Policy Adoption Meeting on November 20, 1986 to vote on them. Remember, each city has a vote at that meeting. The Policy Adoption Meeting will be at the Sheraton-Midway Hotel in St. Paul, beginning at 10:00 am. CALL TO ORDER The regular meeting of the Shorewood City Council was called to order at 7:30 P.M., Monday, October 27, 1986, in the Council Chambers. PLEDGE OF ALLEGIANCE AND PRAYER Mayor Rascop opened the regular Council Meeting with the Pledge of Allegiance and a Prayer. ROLL CALL Present: Staff Mayor.~41cop, Councilmember Haugen and Stover. Shaw arrivearrt 9:00 P.M. (Gagne absent). Attorney Froberg, Engineer Norton, Planner Nielsen, Administrator Vogt and Clerk Kennelly. APPROVAL OF MINUTES Stover moved, seconded by Haugen, to approve the minutes of the Regular Council Meeting of Tuesday, October 14, 1986 as written. Motion carried 3-ayes. MATTERS FROM THE FLOOR Mailbox Location Complaint Stover presented a request received in writing from a resident requesting the establishment of an Ordinance to control the placement of residential mailboxes. Stover moved to authorize the staff to prepare a draft Ordinance, Haugen seconded for discussion. At the present time neither City nor the post office have a policy for the location of mailboxes. Rascop would like to see the reaction of the Post Office and other Cities regarding such a request. Motion carried-3 ayes. PARK COMMISSION REPORT Conrad Schmid reported on the items discussed at the last Park Commission meeting of October 20, 1986. The Commission reviewed the application of Jim Andrus of 4971 Kensington Gate for the vacancy on the Commission. A Freeman Park entrance sign needs repainting and rewording. The road repair fill has been buried as the base in the pro- posed new road access to the park. The Commission looked at the possibilities of getting the property around the proposed water tower near Highway 7. They feel that the location is unsuitable for Park Property and they feel the title problem should be cleared up. -1- COUNCIL MINUTE~ MONDAY, OCTOBE~7, 1986 page two - . PARK COMMISSION REPORT - cont. The Commission is obtaining bids to complete the Manor Park Field and Badger Park. The R.F.P. for the Manor Park warming house/pavilion have been sent out for bid estimate proposals. Commission would like to see a dock installed at Crescent Beach. This has been suggested by Community Services to teach swimming lessons. Tonka Bay is not in favor of the dock and will only be responsible for a raft. Vogt com- mented on the addition of insurance costs for Crescent Beach that will be added for next year. In previous years the beach was covered at no additional premium cost. This cost will be shared wi~h Tonka Bay. Haugen would like to see a dock length and depth diagram of the proposed dock. The Commission asked who was responsible for the installation and storage of the dock on the Christmas Lake Access. The DNR is responsible according to the agreement. Haugen would like to see added patrolling in order to control the after hours use of the access. She has received complaints on use of the access after the closing hours. The Commission has requested the purchase of a snowblower for Cathcart Park. A meeting between Aspen's Attorney and City Staff was held on the fill site at Badger Field. No agreement has been made, the Attorney will confer with Aspen and come back to the City with their decision. Attorney Froberg reported on his discussion with Earl Haug of the State Highway Department regarding the status of the highway easement needed for the water tower site. A report on the States need of thts parcel will be sent to MnDot of- fice in St. Paul. An appraisal of the appropriate acre needed for the water tower site will be made. We will re- ceive the notification of the value. This will only be for an interest in their easement. Norton doesn't feel we should purchase an interest in an easement, but possibly enter into an agreement with the State only. Gagne supports the relo- cation of the tower onto property we can get clear title to and increasing the height of the tower. CONSENT AGENDA APPROVAL OF ELECTION JUDGES A list of trained Election Judges was submitted for approval for the November 4, 1986 General Election. SWIMMING POOL PERMIT - 27190 EDGEWOOD ROAD A swimming pool permit request has been received from Brooks Hauser of 27190 Edgewood Road. The pool, deck and gazebo structure will be located so as meet all zoning requirements. The issue of filling in another area of the lot has been stopped until the appropriate permits have been obtained. This issue is not in relationship to the pool or the contractor requesting it. (Shaw and Gagne absent). , ATTORNEYS REPORT Eureka Road Drainage Easement An a.p~raiser will be out at the site this week. The appraisal should be ready to bring to the next meeting. ENGINEER'S REPORT Smithtown Road Replacement Project The final wear course will be put on this fall. It would cost an additional $2800.00 if the final course was not put on until spring. S.E. Area Deep Wel~ Engineer Norton spoke to Mr. Renner who indicated that the drilling has been completed at a depth of 415'. They anti- cipate pumping beginning the first week in November. Pump house plans will be submitted for approval at the next meeting. ADMINISTRATIVE REPORTS Corridor Study Update The Corridor Study has been completed. There is a great deal of information in this report. The staff did meet on Thursday and reviewed this report. Council should set a separate meeting to review it. Special Meeting Set - November 5, 1986 The Council set a speCial meeting for November 5, 1986 at 7:30 PM to review the Corridor Study, Canvass of Election, and an Executive Session of Union negotiations. Munitech Contract Approval Administrator Vogt submitted a new two year contract with a requested 15% increase in cost for sewer and water mainten- tance by Munitech. Rascop moved, seconded by Haugen, to approve the Munitech contract as submitted. Motion carried-3 ayes. Shorewood Oaks Development Update Dave Johnson is interested in proceeding with the Shorewood Oaks project. No one was proceeding with the project during his illness. We have received a request from Mr. Johnson to add the cost of his underground improvements onto the bond and assess them back to him. Staff will return with a status report on his project. -3- . Vogt did a cost comparison and total cost of the insurance packages. These costs will be covered by the budgeted amount. Haugen moved, secondeq by Stover, to accept the insurance coverage proposal from the Ken Jarcho Agency. Motion carried - 3 ayes. LMCD Comp Plan Grant Approval The grant to prepare a Comp Plan for Lake Minnetonka has been approved. The agreement for a three year pay back to the City will be reviewed by Attorney Froberg. He will then submit the review and contract for Council approval. MAYORS REPORT A Public Hearing will begin on plans to acquire park property on Lake Minnetonka by the Hennepin County Park Board. The legislature does have to allocate funds for these acquisitions. Haugen would like to see added patrol during the lunch time at the Vine Hill intersection. Shorewood Logo pins have been received. The staff and volun- teers will receive one pin each at no cost. The pins will be sold for a minimum of a $2.00 donation. (Shaw arrived at 9:00 PM). (612) 474-3236 FROM: Mayor and Councilmembers Dan Vogt W November :: ~986 MEMO TO: DATE: SUBJECT: Tax Forfeited Property In the past two (2) weeks Hennepin County has made us aware of several parcels which are classified as tax forfeited land. The first map which is attached shows where each parcel is located in the City. The subsequent series of maps shows each parcel as it shows on the % section maps. Below I will discuss each parcel and give staff's recommendation as to how we feel the parcel should be handled. Parcell: This parcel shows up in our tax books as belonging to the State Land Department. The parcel is located on Enchanted Island and is believed to have a portion of the street known as Enchanted Point located over and across part of the parcel. At this time, Staff recommends that the City re- quest a conveyance of the property to Shorewood for Public use. Parcel 2: This parcel shows up in our tax books as belonging to the State Land Department. The parcel is located on Smithtown Road and is currently known as the Woodside Cemetery. In discussing this with Sandy, it was found that the City alerted persons affiliated with the Cemetery of the title problems some time ago. Obviously, the problem was not taken care of. At this time, it is the recommendation of staff to hold this parcel from Public auction. Contact should then be made with those associated with the Cemetery to have them correct their title problems. Parcel 3: This parcel shows up in the tax books at City Hall as belonging to the State Land Department. The parcel is a land locked piece of property lo- cated at approximately 1100 feet south of Edgewood Road midway between Grant Lorenz Road and Howards Point Road. In reviewing this parcel with Planner Nielsen, it was found that this property is in an area designated as "wetland." Due to this fact, it is the recommendation of staff to request a conveyance of the parcel to the City for Public use. Parcel 4: This parcel consists of all five (5) lots in a subdivision known as Shorewood Circle. This subdivision is located on Smithtown Road just east of Grant Lorenz Road. Hennepin County shows the owner as Karl E. Dahl for all 5 lots. Our tax book ~hows the tax payers for all 5 lots as Thomas V. Selseth and Dwayne Knigge. Staff recommends that the 5 lots be approved for Pubic auction. A Residential Community on Lake Minnetonka's South Shore G~ . . Parcel 5: This parcel shows up in our tax book as belonging to the State Land Department. This parcel is legally known as Outlot A of Shorewood Acres 2nd Addition. The outlot is a center island for Valleywood Circle. Due to the location of the parcel, staff recommends the conveyance of the parcel to the City for Public use. Parcel 6: This parcel shows up in our tax books as belonging to the State Land Department. The parcel is located just north of St. Albans Bay Road and just west of Manor Road. This parcel is very small. From our standpoint, the City has no use for this parcel. Therefore, staff recommends that this parcel be offered at auction to adjacent property owners. Below I will summarize staff recommendations for each parcel. FALSE INFORMATION TO POLICE. 605.01. FALSE INFORMATION OR NAME No person shall communicate to a law enforcement officer: a) any false or incorrect name or identity, knowing that it is false or incorrect; or b) any false information, knowing that it is false and upon which an officer may reasonably act in reliance. 605.02. REFUSAL TO IDENTIFY No person shall refuse to correctly identify himself or herself or provide his or her present address and birthdate: a) upon any lawful demand on reasonable grounds of a law enforcement officer; or b) upon legal arrest or during a valid investigatory stop while driving a motor vehicle. 605.03. AN ORDINANCE RELATING TO THE OPERATION AND REGULATION OF MOTORIZED GOLF CARTS The City Council of the City of Shorewood, Minnesota, CHAPTER 803. MOTORIZED GOLF CARTS 803.01. OPERATION BY HANDICAPPED Persons who are physically handicapped as defined in Minnesota Statutes, Section 169.345, Subdivision 2, are authorized to operate motorized golf carts on designated roadways or portions thereof within the City. 803.02. PERMIT REQUIRED FOR OPERATION No person shall operate a motorized golf cart without obtaining a permit provided herein. Subd. 1. Application for Permit. Every application for a permit shall be made on a form supplied by the City and shall contain the following information: , a) The name and address of the applicant. b) The nature of the applicant's physical disability. c) The roadways or portions thereof on which the motorized golf cart will be operated. d) The time of operation of the motorized golf cart. e) Such other information as the City may require. Subd. 2. Permit Fee. The annual permit fee shall be Subd. 3. Terms of Permit. Permits shall be granted for a period of one year and may be renewed annually. Subd. 4. Conditions Required for Issuance of Permit. No permit shall be granted unless the following conditions are met: ~ . . a) The applicant must demonstrate that the applicant is a physically handicapped person as defined in Minnesota Statutes, Section 169.345, Subdivision 2. b) The applicant must submit a certificate signed by a physician that the applicant is physically able to safely operate a motorized golf cart on the roadways desig~ated, and a certificate from a driver's trainer instructor for the handicapped that the person has the skills and training necessary to safely operate the motorized golf cart. c) The applicant must provide evidence of insurance for liability coverage in the amount of $50,000 because of injury to one person in anyone accident, and $100,000 because of injury to two or more persons in anyone accident, and $25,000 because of injury or destruction of property to others in anyone accident. 803.03. USE OF GOLF CARTS ON ROADWAYS. Subd. 1. Designation of Roadways. The Chief of Police or his representative shall designate City roadways or portions thereof upon which motorized golf carts will be permitted to operate. Signs shall be posted on such roadways to advise the public that the use of motorized golf carts is permitted thereon. Subd. 2. Times of Operation. Motorized golf carts may only be operated on designated roadways from sunrise to sunset. They shall not be operated in inclement weather or when visibility is impaired by weather, smoke, fog or other conditions, or at any time when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of 500 feet. Subd. 3. Slow Moving Vehicle Emblem. Motorized golf carts shall display the slow moving vehicle emblem provided for in Minnesota Statutes, Section 169.522, when operated on designated roadways. Subd. 4. Crossing Intersecting Highways. The operator of a motorized golf cart may cross any street or highway intersecting a designated roadway. . . Subd. 5. Application of Traffic Laws. Every person operating a motorized golf cart under permit on designated roadways has all rights and duties applicable to the driver of any other vehicle under the provisions of Chapter 169 of Minnesota Statutes, except when those provisions cannot reasonably be applied to motorized golf carts and except as otherwise specifically proviqed in Minnesota Statutes, Section 169.045, Subdivision 7. 803.04. SUSPENSION OR REVOCATION OF PERMITS The City Council may suspend or revoke a permit granted hereunder upon a finding that the holder thereof has violated any of the provisions of this section or Chapter 169 of Minnesota Statutes, or if there is evidence that the permittee cannot safely operate the motorized golf cart on the designated roadways. 803.05. AN ORDINANCE IMPOSING A JUVENILE CURFEW WITHIN THE CITY OF SHOREWOOD, MINNESOTA, AND IMPOSING PENALTIES FOR VIOLATONS THEREOF ORDAINS: THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA, CHAPTER 606. JUVENILE CURFEW. 606.01. JUVENILES 14 AND YOUNGER It shall be unlawful for any juvenile 14 years of age or younger to be on or present upon any public street, alley, park, playground, or place open to the' public, or place of amusement and entertainment, vacant lot, or other unsupervised place in the City of Shorewood between the hours of 10:00 p.m. and 5:00 a.m. of the following day. This section shall not apply when the juvenile is accompanied by its parent or legal guardian. 606.02. JUVENILES 15 THROUGH 17 It shall be unlawful for any juvenile 15, 16, or 17 years of age to loiter, idle, wander, or play in or upon any public street, avenue, alley, park, playground, or place open to the public, or place of amusement and entertainment, vacant~ot, or other unsupervised place in the City of Shorewood between the hours of 12:00 midnight and 5:00 a.m. of the ~day. This section shall not apply when the --juvenile' is accompanied by its parent or legal guardian. 606.03. UNLAWFUL GATHERING It shall be considered unlawful for any juvenile under age 18 to be present at a gathering of two or more persons when the following conditions exist: a. When a juvenile has reason to believe that illicit drugs are present or being used at the gathering. For the purpose of this section, illicit drugs shall be deemed to be those prohibited by Minnesota Statute. b. When a juvenile is at a place uncontrolled by its parent(s) and has reason to believe that alcoholic beverages are being used unlawfully, as defined by Minnesota Statute. , r , . . . 606.04. LIABILITY OF PARENT(S) It shall be unlawful for any parent, guardian, or other adult person having authorized care, custody, or control of any juvenile under age 18, to knowingly permit such juvenile to violate the provisions of sections 1, 2, and 3. 606.05. LIABILITY OF PROPRIETOR It shall be unlawful for any person operating or in charge of any place. of amusement, entertainment, or refreshment, or other place of business, to knowingly permit any juvenile under the age of 18 years to loiter or idle in such place contrary to the provisions of sections 1, 2, and 3, and he/she shall immediately order such juvenile person to leave. If such juvenile refuses to leave such place, he/she shall immediately notify the South Lake Minnetonka Public Safety Department of the violation. 606.06. PENALTY a. Any juvenile under the age of 18 years found on or in any public street, avenue, alley, park, or other place, in violation of sections 1, 2, and 3 may be sent or taken home or placed under proper custody by any police officer of the South Lake Minnetonka Public Safety Department. b. Any juvenile who violates the provisions of sections 1, 2, and/or 3 shall be deemed a juvenile petty offender as defined by Minnesota Statute. c. Any parent, guardian, or other adult person(s) who violates the provisions of section 4 shall be guilty of a petty misdemeanor. d. Phone calls to: S1M Public Safety department referred me to: Shorewood Administration who referred me to: City Council Members None could offer a solution or option to accomodate temporary parking on Christmas Lake Road. I know the reason for the No Parking signs; however, we house- holders were here first; plus the fact that few residences have excessive off street parking for parties, weddings,.reunions, and any other congregating affairs needed occasionally, should make necessary that Shorewood Officials restudy the problem and offer some solutions. I was surprised, in the first place, when I sa~ city workers installing the signs, that we effected property owners were not notified by letter or phone, to offer our input to the new regulation. I believe from previous conversations there was a consensus on having one similar to Excelsior's. One such as this is shown on P. 20 of the "HYDROSTORAGE" Catalog I gave you some time ago. Another popular model many communities have used is the fluted column or "Hydropil1ar". Thi s would be 11 ke Minnetonka's elevated tower at Ridgedale. A picture of a "Hydropillar" is shown on P. 3 of the catalog. Some things to take into consideration are: 1. A Hydropillar is usually cheaper than a Pedestal Sphere (about $10,000 0~_~_~O~~_QQQ~~11()JL to we r ) . i.e. Pedestal $440,000 Hydropillar $430,000 $ 10,000 2. The riser space on a Hydropillar can be used for a storage space with a garage door access as an optional item. Examples of this are shown in the catalog.
