CALL TO ORDER
The regular meeting of the Shorewood City Council was called to
order by Mayor Rascop at 7:30 P.M., Monday, June 10, 1985,' in the
Council Chambers.
PLEDGE OF ALLEGIANCE AND PRAYER
Mayor Rascop opened the meeting with the Pledge of Allegiance and
a prayer.
ROLL CALL
Present: Councilmembers - Mayor Rascop, Haugen, Shaw, Stover,
and Gagne.
Staff: Attorney Froberg, Engineer Norton, Planner Nielsen,
Administrator Vogt, and Clerk Kennelly.
APPROVAL OF MINUTES
SPECIAL MEETING - May 20, 1985
Haugen moved, seconded by Gagne, to approve the minutes of the
Special Meeting of Monday, May 20, 1985 as written.
Motion carried - 5 Ayes.
BOARD OF REVIEW MEETING - May 23, 1985
Shaw moved, seconded by Haugen, to approve the minutes of the
Board of Review Meeting of Thursday, May 23, 1985 as written.
Motion carried unanimously - 5 Ayes.
REGULAR COUNCIL MEETING May 28, 1985
Haugen moved, seconded by Shaw, to approve the minutes of the
Regular Council Meeting of Tuesday, May 28, 1985 as written.
Motion carried, 5 Ayes.
MATTERS FROM THE FLOOR
REQUEST FOR SWIMMING POOL - 5490 Valleywood Circle
Carol Bauman of Valleywood Circle was present to request permission
to install a swimming poo~ that meets all setbacks according to the
zoning district at the above address. She also agrees to fence in
the pool in accordance with the Fence Ordinance.
Shaw moved, seconded by Gagne, to approve the request as submitted.
Motion carried - 5 Ayes.

GARDEN PATCH C.U.P.- Charles Crepeau
,RESOLUTION NO. 40~85
Charles Crepeau, owner of the building at 23425 Smithtown Road
that houses the "Garden Patch" business, has been informed that
the Conditional Use Permit issued to operate the Garden Patch
will expire June 9, 1985, and that the current uses are in viola-
tion of the C.U.P. as it was issued.
Mr. Crepeau was present to request an extension of time in order
to apply for rezoning and obtain a needed survey. Haugenasked
if a time extension would also cover the uses not listed in the
C.U.P. Attorney Froberg felt a 30 to 60 day extension was feas-
ible. Some of the current uses will not be allowable uses under
the zoning but can be allowed by C.U.P.
Shaw moved, seconded by Stover, to extend the C. U. P. for 30 days.
Motion carried - 4 Ayes, 1 Abstain (Haugen), by roll call vote.
REQUEST FOR SIMPLE-SUBDIVISION - LAKE LINDEN DRIVE
Joe Gorecki presented a request for a simple subdivision of the
property north of the Sullivan Center, located at 24000 State
Highway 7. Nielsen indicated that a grading plan was recently
submitted and the Engineer has not had a chance to review it yet.
Rascop would like to review the staff report and the Engineer's
recommendation on the grading plan. Council tabled action until
the staff report can be obtained.
PUBLIC HEARING - SETBACK VARIANCE
l(enneth Koester
Mr. Koester of 24825 Amlee Road was present to request a variance to
allow the placement of a garage 10' from the rear property line.
Mayor Rascop opened the Public Hearing at 7:52 P.M. Council discussed
with Mr. Koester the possibility of a relocation that would preserve
the trees and the kitchen window, as were expressed concerns of the
applicant. Gagne indicated that Mr. Koester has obtained signatures
of adjoining property owners approving the location of the structure.
After calling for public comments and receiving none, Mayor Rascop
closed the hearing at 8:21 P.M.
Gagne moved to allow a variance as requested, seconded by Haugen for
discussion. Shaw felt there was a better solution and requested that
the motion be withdrawn.
Shaw moved, seconded by Stover, to table the variance request.
Motion carried - 4 Ayes, 1 Abstain (Gagne).

RESOLUTION-NO. 41~85
Mayor Rascop opened the Public Hearing at 8:16 P.M. to hear a re-
quest by RobertZaun of 5815 Ridge Road to expand a nonconforming
structure. The existing structure. does not meet the road setback
but the expansion does not increase the nonconformity. After call-
ing for public comments and receiving none, the Mayor closed the
Public Hearing at 8:18 P.M.
Haugen moved, seconded by Gagne, to approve the variance to expand
a nonconforming structure. The variance was granted by roll call
vote, 5 Ayes.

RESOLUTION NO..42.".85
Mayor Rascop opened the Public Hearing at 8:20 P.M. by hearing a
request from Jim McKinnon, representing Marvin Boote, in his vari-
ance request to expand an existing nonconforming structure. This
request does not expand the nonconformity. Rascop closed the Public
Hearing at 8:21 P.M. after calling for public comments and receiv-
ing none.

Stover moved, seconded by Gagne, to approve the variance as requested.
Motion carried by 5 Ayes, by roll call vote.
SIMPLR SUBDIVISION REQUEST-.".-P~te~Holmberg
Peter Holmberg would like to be granted a Simple Subdivision to
divide and combine to realign the lot line of the properties located
at 5955 Cajed Lane and 27055 Smithtown Road. He would like an ex-
tension of 5 months on his request because the property located at
27055 Smithtown. Road is in probate at this time. Attorney Froberg
indicated that. the division request would have to be made by the
representative of the estate and Mr. Holmberg.
Haugen moved, seconded by Gagne, to table until the next meeting for
the purpose of clarification of the application.
PARK,COMMISSION.REPORT
Martey Jakel indicated that the Park Commission did not have a quor~'
but they did discuss the temporary installation of ' posts at the ManQ~;'
Ball field until the fenc~s can be installed. The posts would be to's,

The Commission would like, the Engineer to study the water ptoblem a~

PARK COMMISSION REPORT. (Continued)
Jakel is in the process of painting the Cathcart Park building and
equipment with volunteer help from the neighborhood youths. The
Council expressed their appreciation to the volunteers for their
time given.
PLANNING COMMISSION. REPORT
The Planning Commission minutes are in this packet with the recom-
mendations they made on issues that will be handled during this
meeting.
Stover reported that Mary Boyd has resigned from the Planning Commi-
sion. Stover would like a notice placed in the local paper inform-
ing the residents of the vacancy on the Commission.
SIGN PERMIT ~ I.C.O.
Tom Wilharm of the I.C.O., located at 5680 County Road 19, presented
a request for signage. Attorney Froberg stated that this request
does not comply with the present ordinance and it cannot be consid-
ered under the new ordinance until it has been published in the offi-
cial city newspaper. He indicated that he could also request a vari-
ance requiring a public hearing if he chooses not to wait for the
ordinance publication.
Haugen moved, seconded by Shaw, to table Mr. Wilharm's request to
the Council Me~~ July 8th.
WESTLAWN II -~ PLAT APPROVAL RESOLUTION NO. 43-85
George Larson of 26405 Smithtown Road was present to ask for Final
Plat Approval for his subdivision, Westlawn II. The subdivision has
met the requirements of the Planner and the City. Attorney Froberg
has requested that Mr. Larson submit a "title opinion" to him for
review.
Shaw moved, seconded by Gagne, to approve the final plat subject to
approval of the "title opinion" and any and all fees and assessments
due the City. Final plat was approved by a roll call vote - 5 Ayes.
PUBLIC.HEARING ~ VARIANCE TO EXPAND A
NONCONFORMING STRUCTURE - 20940 Ivy Lane
RESOLUTION NO. 44-85
A request to expand a nonconforming use was made by Scott Tompkins
of 20940 Ivy Lane.
The Public Hearing was opened by Mayor Rascop at 8:45 P.M.

Attorney Froberg reviewed the steps that Trivesco agreed to prior to
the City requesting the temporary water service for that proj~ct; the
development contract, preliminary platting, and water franch1se agree-
ment. Mr. Pflaum does not feel these agreements are pertinent at this
time. He would like to make changes in his plat and needs to know if
the water service can be obtained in order to determine his final platt-
ing, Pflaum has done a feasibility study to determine that Minnetonka's
water system is adequate to service the 90 connections he is requesting.
Shaw had concerns that Minnetonka may table, the Trivesco request if a
second request is received at this time.

NEAR MOUNTAIN ADDITION REQUEST (Continued)
Haugen questioned the possibility of him going together with Trivesco
for a joint well for both projects. Pflaum wants a separate system
in order to maintain control of his own system.
Shaw moved, seconded by Haugen, to direct the Administrator to request
Minnetonka for temporary water service for 90 units or four (4) years
service whichever comes first. Motion carried - 5 Ayes.
KENNEL LICENSE REQUEST - Jane Kline
Ms. Kline came to the Council requesting a Kennel license for her 6
or 7 dogs. She plans to purchase the property located at 5990 Straw-
berry Lane and plans to install a large fenced in area to keep her
dogs. Attorney Froberg felt the current ordinance does not allow for
non "show dogs" as she is requesting.
Stover questioned the possibility of granting a variance or possible
ordinance change to grant her request.
Gagne moved, seconded by Shaw, to deny the request. Motion carried
4 Ayes, 1 Naye (Stover).
Stover would like to see some alternatives to the present ordinance
reviewed.
PLANNERS REPORT
COVINGTON VINE RIDGE EXTENSION OF P.U.D.
A request has been made for a six month extension for their P.U.D.
rezoning. The project has been sold and some changes may be made,
but they intend to proceed with the project.
Haugen moved, seconded by Gagne, to approve the six month extension.
Motion carried - 4 Ayes - 1 Abstain (Stover).
SHOREWOOD OAKS - EXTENSION OF PRELUlINARY PLAT
A request to extend the filing for preliminary plat approval for
six months has been made. The project plan is progressing but an
extension of time is needed.
Haugen moved, seconded by Gagne, to approve a six month extension.
Request approved - 4 Ayes, 1 abstain (Stover).
JUNK COMPLAINT UPDATE
Planner Nielsen and a Police officer will be inspecting the Blood
property again this week on ordinance violations. Minnetonka Yacht
Club has cleaned up their violation. The Glen Road complaint has
also begun cleaning up their property.

ATTORNEY'S REPORT
FINDINGS OF FACTS - SHOREWOOD YACHT CLUB
On request from the Council, Attorney Froberg reviewed the back-
ground and the court decision granting the right to operate the
Shorewood Yacht Club.
Haugen questioned what rights the court granted the Yacht Club.
Froberg felt that if changes were made that were listed in the
C.U.P., that the Council would have the chance to review.
Rascop also referred to the contract signed with the new owners,
Snug Harbor, listing all their conditions for that operation.
ENGINEER'S REPORT
CATHCART AREA STREET AND STORM SEWER PROJECT
Engineer Norton submitted variations in construction types and
costs for road improvements and installation of storm sewer for
the Cathcart area. Council asked him to clarify the various
types of construction methods and the longevity of each type of
construction. Council would like to see additional information
on benefited areas and cost to those residences. It has also
been suggested by the Public Works Director that a ten (10) year
Capitol Improvement Project be implemented beginning with the
1986 budget.
Staff will return with suggested ways of assessing this project
to determine the feasibility of the improvement.
WATERFORD PROJECT 84-5 - CHANGE ORDER #3
Engineer Norton explained the various changes in the contract
plans and recommended approval of change order #3.
Haugen moved, seconded by Gagne, to approve tbe change order as
submitted. Motion carried - 4 Ayes (Stover temporarily absent).
SEAL COATING COST ESTIMATE
Engineer Norton submitted a list of roads recommended for seal
coating this year in the total amount of $54,700. Council dis-
cussed using the $66,000. surplus in the 1984 budget, recommended
by the auditor, to be placed in a contingency fund.
Gagne moved, seconded by Rascop, to authorize the Engineer to
draw up specifications and advertise for bids.
Motion carried - 5 Ayes.

ADMINISTRATIVE REPORT
PHOENIX GARDENS - WINE/SUNDAY AND 3.2 SALE RESOLUTION NO. 37-85
Shaw moved, seconded by Gagne, to grant Phoenix Gardens a Wine,
Sunday Sale and Non-intoxicating Malt Liquor License subject to
approval of insurance coverages. Motion carried by roll call
vote - 5 Ayes.
REFUSE COLLECTION PROPOSALS
Council reviewed the five (5) alternative suggestions for types
of removal. Rascop added #6 - "Post all roads to a 4 ton limit".
After discussion of the alternatives, the general concensus was
to direct the Administrator and Attorney to draft an ordinance
reflecting the procedures in alternative #2.
FRANCHISE DISCUSSION MEETING AT MINNETONKA
Council directed City Attorney Froberg to attend the Minnetonka
City Council where they will be discussing the Water Franchise
Agreement with Trivesco of June 24, 1985.
BUDGET AMENDMENT
Stover moved, seconded by Gagne, to amend the Budget to transfer
$16,482. from the Council contingency fund to the Public Works
budget to cover increased wages, on-call expenses, overtime, and
wage increase for Assistant Public Works Director.
Motion carried - 5 Ayes.
REQUEST TO CLEAR FIRE LANE
A request has been received from William Dixon to clear the Grant
Lorenz Road "fire lane" for summer use. Council denies the request
until the "fire lane ordinance" is in tact. The City crew will be
directed to clean up the junk and diseased trees on that property.
REQUEST TO CLOSE CITY OFFICE - JULY 5
Council denied the request to close the city office on July 5th,
to be used as an employee vacation day.
MAYOR'S REPORT
POLICE FORMULA MEETING
A request has been made for two representatives from Excelsior
and Shorewood to get together to discuss a new police formula
for the new contract. Haugen and Shaw volunteered but feel that
once the meeting date is set that there should be representatives
from Tonka Bay and Greenwood asked to attend.

CABLE COMMISSION
A part-time (20 hour week) has been hired to administrate the
Cable Commission at a rate of $10,000. a year.

Council directed the Planner to check on possible zoning violation
at the Skipperette.

GENERAL RECOMMENDATZONS
1. General data indicate. that the administrative staff for a
city of Shorewoods size may be too large. Consolidate personnel
by combining job responsibilities and reducing staff.
2. Use part time help to fill in clerical and non-salaried
positions, thus reducing labor and benefit costs.
3. The mill rate needs to be brought into line with surrounding
communities. This could be achieved by reducing per capita
spending. The average mill rate of the four reference cities in
the study is 18.16 while Shorewood is at 24.08 which ranks us in
the bottom third of Minnesota cities (between 69-73rd) with those
on the top having the lowest mill rates. Therefore, the budget
needs to be trimmed $250,000 to 290,000.
4. Shared services and personnel should be considered with
surrounding communities to reduce personnel and equipment costs.
5. Continue to explore all potential sources of funds from state
grants to service fees.
6. When possible use liquor sales revenues to alleviate
expenses.
7. The City Councilor its representative should meet with
persons in the top three categories of delinquent taxes and
assessments to discuss their delinquencies and arrive at possible
ways to payoff or reduce them.
8. Council should approach Senator Gen Olson and discuss
possible legislation which would allow cities and other
governmental units to charge current interest rates on unpaid
taxes and/or assessments where applicable.

BACKGROUND
Mr. Duane Barth, Tingewood, Inc. has requested concept stage approval for a
planned unit development consisting of a three-story, 39-unit condominium
project. The proposed site is located at 5620 County Road 19 (on the west
side of Co. Rd. 19, just north of the Tom Thumb store - see Site Location
map, attached).
The property consists of one parcel, 253,792 square feet in area (5.83 acres).
The land is divided by two zoning districts. The west 345 feet (2.21 acres) is
zoned R-2, and the remaining 3.62 acres is zoned C-3. The site is occupied by
a single family residence. Surrounding land use and zoning are as follows:
north: church, zoned R-2; proposed apartment project, zoned R-4;
single family dwelling, zoned R-4
east: shopping center in Tonka Bay, zoned commercial
south: convenience grocery store, gas station, American Legion Club,
apartment building and undeveloped land, zoned C-3; single
family residences, zoned R-2
west: undeveloped rear yard of a large single family lot, zoned R-2

The applicant proposes to convert the existing house to a small office. Since
P.U.D.'s involving mixed use require a minimum land area of 20 acres, he pro-
poses to divide off 10,832 square feet for the office, leaving the zoning C-3.
The remainder of the site is included in the P.U.D. The office would share
joint parking area with the condominiums.
ISSUES AND ANALYSIS
The proposed project has taken the planned unit development approach for two
reasons. First, it consolidated the two zoning districts which currently ex-
ist on the property, allowing for cohesive land use of the total site. Sec-
ondly, development is allowed to be concentrated on the front one third of the
site, minimizing street and utility costs and allowing the developer to avoid
area within an existing drainageway while at the same time creating a holding
pond to minimize drainage problems.
What has been presented is the General Concept Plan for the P.U.D.. Based up-
on review of the Shorewood Comprehensive Plan and the Shorewood Zoning Ordi-
nance, particularly Section 27.A. related to planned unit development, the
following issues are presented:
A. Required Information. The information required for a P.U.D. has been in-
cluded in the applicant's plans. The Site Summary contained on Exhibit B
should be of particular interest. According to the applicant, units will
range in price from $70,000 - $95,000. Six of the units are proposed as
three bedroom units, with the remaining units divided between one and two
bedroom units.
The only items not submitted to date are the articles of incorporation, by-
laws, etc. for the condominium. Since these are fairly standard, it is
suggested that the requirement be waived until the Development Stage of
the project (assuming Concept Stage is approved). This would allow any
items required by the City to be included in the documents.
B. Land Use. As in any rezoning request, the primary issue to be resolved is
one of land use. Although the C-3 District currently allows multiple fam-
ily residential by conditional use, it must be realized that the C-3 Dis-
trict is typically used and intended for commercial activity. Therefore,
the proposed use involves a change from the previously intended use of the
property.
In evaluating this change in use, the Comprehensive Plan should serve as
the basic decision-making guide. Although the Proposed Land Use Plan shows
a commercial pattern for the eastern portion of the subject site, it must
be realized that this was based largely upon existing zoning. The area
plan for Planning District 6 suggests somewhat more flexibility, supporting
the Shorewood Condominiums request. The concept of higher density residen-
tial uses located near activity centers and along major traffic carriers is
reiterated. The area plan specifically states that three to six units per
acre is acceptable as a land use transition from commercial activity and
County Road 19 to lower density areas to the west. Although the Plan sug-

gests townhouses and quadraminiums, given the desirability of concentrating
development on the site, the proposed housing style is considered consistent
with the Plan.
In further evaluating the request, the advantages and disadvantages of resi-
dential as opposed to commercial use should be considered.
1. Site Impact. There is little doubt that the proposed use results in far
less impact than if it were developed as commercial. Commercial zoning
would allow as much as 80% of the site to be covered with structures and
blacktop. As proposed, the condominiums cover only 14.4% of the site.
Although development has been concentrated on the front one third of the
site, it is still less than commercial development might allow and the
remaining two thirds of the site are left as open space.
It should be noted that the ponding area being created presumably takes
care of stormwater runoff from the site itself, possibly even allevia-
ting drainage problems outside of the site. This should be subject to
review and comment by the City Engineer.
2. Traffic. This is an obvious concern due to the existing volume and con-
gestion on County Road 19. Thirty-nine condo units will generate between
5 - 7 trips per unit per day - a total of 195 - 273 trips per day. Al-
though we can only speculate as to what type of commercial activity might
occur on the site, it is reasonable to assume that even a moderately suc-
cessful commercial area could generate a much greater volume of traffic.
One thing that might be expected relative to traffic is that residents'
familiarity with existing traffic patterns and problems may result in
fewer accidents than the occasional commercial users might.
3. Parks. The proposed condominiums will have greater impact on area parks
than commercial development would. The Comprehensive Plan notes that
although park facilities are nearby, they are separated by busy streets.
Given the amount of open space included in the project, smaller children
should have ample room for play area on the site. Older children wish-
ing to use organized sports facilities should be able to negotiate
the necessary streets and intersections.
The Shorewood Parks Commission should review and comment relative to
Park issues.
4. Tax Base. Based upon the applicant's estimated unit price range. the
development would be valued at approximately $3,217,500. As condomini-
ums, homestead credits would apply. In this light, it is reasonable to
assume that commercial development, taxed at its full value, could easily
generate more taxes. This is somewhat balanced by the fact that the City
will not have to take over and maintain any roads or utilities. Thus max-
imum taxes are generated while need for additional services is minimized
(this assumes that police and fire service would be the same for either
commercial or multiple family development).

5. Elimination of Commercial Zoning. The proposal reduces the amount of
commercial land, which is already in short supply in Shorewood. Judg-
ing from recent comments by some City Officials and residents, it is
difficult to know whether this is an advantage or disadvantage. By the
same token, the project increases the amount of multiple family residen-
tial area which is in even shorter supply.
In considering land use acceptability the issue of density inevitably arises.
Although the existing C-3 District allows multiple family dwellings, by con-
ditional use permit, the Ordinance is somewhat vague as to what density is
allowed. Using the R-5 requirement of one unit per 3500 square feet of lot
area, there could be as many as 37.8 units on the commercial portion of the
site alone. This translates to 12.5 units per acre. The Comprehensive Plan
allows just over six units per acre (considering the 10% increase for P.U.D.'s).
Given what could occur in a C-3 District, the 6.99 units per acre being pro-
posed is considered reasonably consistent with the Comprehensive Plan.
C. Site Design. The following general comments relate to the overall design
of the project.
1. Direct access to County Road 19 is minimized.
2. Impact on surrounding land uses is minimal. The existing house north
of the project is the only one affected. The R-4 zoning of that prop-
erty suggests that apartments could be built there in the future.
3. Underground parking minimizes the amount of site coverage and visual
impact of the parking lot.
4. The layout is consistent with the setback parameters established by
the P.U.D. District.
RECOMMENDATION
In view of the preceding analysis, the Shorewood Condominiums project is con-
sidered consistent with Shorewood's Comprehensive Plan and zoning requirements.
Assuming favorable review and comment by the City Engineer it is recommended
that the City grant Concept Stage approval for the project as proposed.
Subsequent Development Stage review should focus on the details of site drain-
age, access and landscaping.

BACKGROUND
In 1983 the City granted concept stage approval for a planned unit develop-
ment consisting of a three-story, 39-unit condominium project which was
to be built at 5620 County Road 19 (Shorewood Condominiums). Prior to
receiving development stage approval, the applicant's deadline expired
and the project was dropped. The owner (and previous applicant) has
now arranged to sell the property to Wellesly Homes, Inc. Ms. Kristin
Spencer-Barney, president of Wellesly Homes, has now resubmitted plans
to continue the project under the name of Gideon's Orchard.
While the proposal must be treated as a new application, it is so similar
to the previously approved request that the previous staff report, dated
15 April 1983, is enclosed herein as a background for the new request.
Applicant has submitted a letter, attached as Exhibit A, and a modified
site plan, ~ttached as Exhibit B.
ANALYSIS/RECOMENDATION
Despite modifications to the site plan, the issues raised in the 1983
review of the Shorewood Condominiums P.U.D. proposal are still pertinent.
In addition, the following should be considered:

A. Commercial Use. The Shorewood Condominiums request proposed to
convert the small existing house on the site to office space. As
explained in the seventh paragraph of Exhibit A, the .new proposal
would convert the house to a retail clothing store.
B. Drainage. The earlier proposal included a ponding area at the center
of the site to accommodate drainage. Although not shown on Exhibit
B, the ponding area has been discussed with the applicant. Assuming
the concept stage is approved, the ultimate size and design of the
ponding area should be addressed in detail in the development stage
of the P.U.D. process.
C. Setbacks. Respective of the single-family dwelling to the north,
the site plan shows the building and parking 50 feet from the northern-
most property line. Since the proposal was submitted che zoning of
the property to the north has been changed to R-C, and a conditional
use permit has been approved to convert the house into an office build-
ing. Consequently, the setback on the condominiums could be reduced
somewhat. This would allow the builder to avoid an area of question-
able soils at the south side of the site. Site drainage may also
be better facilitated by moving the building northward.
D. Financial Assurances. In the past the City has not involved itself
in the financial capability of a builder to develop a project. Recent
experience has suggested that the City should be concerned over whether
a project can be completed. While this is no reflection on the appli-
cant, it is recommended that, as a condition of approval, evidence
of their financial capability to complete the project should be sub-
mitted for staff review. This should occur prior to issuance of a
building permit.
Site improvements such as parking, landscaping and construction of
the ponding area, will be covered by a performance bond or letter
of credit in the amount of 150 percent of the estimated cost of the
improvements.
Based upon the previous approval from 1983, and the analysis contained
in this report and the report from April of 1983, it is recommended that
the concept plan for the Gideon's Orchard P.U.D. be approved. The applicant
should be directed to prepare devleopment stage plans, paying particular
attention to the design of the site drainage and retention pond.

We, the undersigned Citizens of Shorewood, wish to show our concern for the
safety of the children in our neighborhood (ie. at the bus stop which includes
approximately 30 children at different times, at Manor Park where many children
play all year around, and in the streets where many ride their bicycles).
We have been informed that Greenwood is putting up a Stop sign at this inter-
section, but covering the traffic coming from the other direction. We feel
that it is very important and necessary to cover both directions due to the
fact that traffic coming down the hill moves very fast, many times exceeding
the 25 m.p.h. speed limit (many of us have already called several times to
report this).
We would like to request that you consider this problem at your next council
meeting on June 24, 1985. Thank you.

Lot 11, Radisson Inn Addition - Request for Building Permit

As I mentioned at a recent meeting, Adrian Johnson has requested a building
permit for the above-referenced property. Although I informed him that I
would not issue him a permit, due to his failure to complete the Tingewood
project, he is still interested in knowing whether the property is build-
able. Presumably, someone else will apply for the permit.
Having received a $500 deposit to cover legal expense for the City Attor-
ney's opinion regarding existing easements on the site, the request is now
referred to the Council for review. As background information the follow-
ing is attached:
- memo to Finance Department re: receipt of $500 deposit, dated
20 June 1985
- memo to me from City Attorney's office re: Legal opinion, dated
4 June 1985
- letter from David Walker, dated 1 June 1985
- Watershed District variance to allow 50 foot lake shore setback,

Considering the timing of the request relative to the status of the new
Zoning Ordinance, it is likely that the request will be subject to the
requirements of the new Ordinance.

This concerns the proposed development of Lot 11 of the
Radisson Inn Addition on Christmas Lake. Presently, the lot
is subject to an easement over and upon said lot, existing in
favor of all of the lot owners in the Radisson Inn Addition
for the purpose of ingress and egress to the bathing beach
adjoining the said lot. Lot 11 is also a substandard lot of
record because of inadequacies concerning the width and depth
of the lot. The sole issue for the City of Shorewood is
whether or not a building permit, for the construction of a
dwelling, should be issued.
First, because this is a substandard lot in a shore land
district, a conditional use permit is required, and the applicant
must show under Shorewood Zoning Ordinance S 200.24 Subd. 5(b)
that:
1. The lot meets all standards of the applicable zoning
use district.
2. The lot is in separate ownership from abutting lands.
3. Except for lot area, all other sanitary and dimensional
requirements of the shore lan~ district are complied with
insofar as practical (70% with and set back requirements) .
A "shore land impact plan" must also be filed and approved,
see S 200.24 Subd. 6.
The problem with the easement in this case is a private matter
between the owner of Lot 11 and the residents of the Radissonlnn
4~'-
Addition. The City of Shorewood should only be concerned with
whether it can issue a conditional use permit under its zoning
ordinance. Nevertheless, my research on the issue indicates that
a dwelling could legally be built upon Lot 11, as long as the
dwelling does not obstruct access to the bathing beach adjoining
Lot 11. Also, the dwelling must not limit the use of the beach
as a bathing beach, or for the uses intended when the easement
was granted. See, Chabot v. Paradise, 272 N.W. 2d 251 (Minn, 1978);
Minneapolis Athletic Club v. Cohler, 287 Minn 254, 177 N.W. 2d
786 (1970); Bartlett v. Stalker Lake Sportmen's Club, 283 Minn 393,
168 N.W. 2d 356 (1969); and Farnes v. Lane, 281 Minn 223, 161 N.W.2d
297 (1968).

Ordinance.
168, entitled
Council adopted
Ordinance No. 168 is an interim Ordinance which serves as a comprehensive re-
vision to Ordinance No. 77 as amended. It is the intent of the City Council to
enforce this Ordinance for a period of six months pending further study of sever-
al detailed provisions within the Ordinance. At the end of six months the Ord-
inance will either be adopted as written, or modified based upon conclusions of
studies conducted by the Planning Commission and City Council.
The purpose of Ordinance No. 168 is to protect the public health, safety and
general welfare of the community and its people through the establishment of
minimum regulations governing development and use of land within the City of
Shorewood. This Ordinance shall divide the City into various land use districts
and establish regulations pertaining to location, erection, construction. re-
construction, alterations, and use of structures and use of land. These regu-
lations are established tp promote orderly development and redevelopment; to
provide adequate light, air and convenience of access to property; to prevent
congestion in the public right-of-way: to prevent overcrowding of land and
undue concentration of structures by regulating land, buildings. yards and den-
sity of population: to provide for compatibility of different land uses; to
provide for the administration of the Ordinance; to provide for amendments;
to prescribe penalties for violation of such regulations and to define powers
and duties of the City staff, the Board of Adjustment and Appeals, the Planning
Commission and the City Council in relation to the Zoning Ordinance.

quirements (setbacks) for each zoning district are summarized in the Table of
Bulk and Dimensional Requirements published as part of this summary.
Among other things the Ordinance con~ains provisions and regulations relative
to the following:
a. Nonconforming structures and uses.
b. General building and performance requirements.
c. Accessory buildings, uses and equipment.
d. Fences.
e. Screening and landscaping.
f. Performance standards related to traffic visibility, glare, smoke, dust,
odors, noise, refuse, exterior storage, waste material, bulk storage,
radiation, and electrical emissions.
g. Off-street parking and loading.
h. Building construction requirements.
i. Grading and filling.
j. Essential services.
k. Signs.
1. Home occupations.
m. Development along shorelines.
The Ordinance contains rules and procedures for amending the Ordinance and grant-
ing variances and conditional use permits. An appeal process is also establish-
ed for instances where it is alleged that an error has been made in the enforce-
ment of the Ordinance. Public hearings relative to amendments. variances, con-
ditional use permits and appeals are required pursuant to statutory requirements.
The Ordinance provides for the enforcement of zoning regulations by allowing
for the designation of a Zoning Administrator and specifying penalties for the
violation of the Ordinance.

offices located at 5755 Country Club Road during regular office hours.

BACKGROUND
Mr. Joe Gorecki, representing R.W. Reutiman, has requested approval of a
simple subdivision to divide the property located immediately north of the
Sullivan Center office building at Lake Linden Drive and Highway 7 (see
Site Location Map - Exhibit A, attached). The site contains approximately
88,250 square feet of area. As shown on Exhibit B, the applicant proposes
to divide it into two, approximately equal parcels.
The property in question is zoned R-C, Residential Commercial and is
currently occupied by a single family dwelling. Surrounding zoning and
land use are as follows:

ANALYSIS/RECOMMENDATION
The applicant's request was discussed on an informal basis at the Planning
Commission meeting held on 5 March. At that time it was discussed that the
lot sizes were generally acceptable for the R-C zoning district. A
preliminary site sketch showing a proposed office building was submitted
by the applicant to illustrate that the site could accommodate such a use
(see Exhibit C, attached). It should be noted that review and approval
of the subdivision request will not constitute approval of the applicant's
site sketch. That will require a-5eparate conditional use permit.

Relative to the proposed division, two areas of concern have been raised;
1) site access, and 2) site grading. The access issue is based upon the
topography of the property in question (see Exhibit 0, attached) and its
location on the curve of Lake Linden Drive. The proximity of the proposed
access drive to the Sullivan Center driveway is also in question. While
our current Ordinance is vague regarding spacing between commercial
driveways, the new Zoning Ordinance requires a minimum of 40 feet between
driveways.
Upon field checking the site, the City Engineer and I have concluded
that if the property is to be divided, the City should require that the
two new lots be served by a common access drive located approximately
at the flat part of the high point on Lake Linden Drive (shown on Exhibit D).
Even with one driveway access, the entry will require considerable grading
to improve sight lines along the street. The applicant has been asked to
provide a detailed grading plan for review by the City Engineer. The
grading plan should include the entire site plus everything within 100 feet
of the property boundary in order to evaluate how the site will relate
to surrounding property. Finally, the grading plan should illustrate how
the northerly parcel, which drops over 20 feet from south to north, will
be made useable.

Dear Dan:
We have reviewed the simple subdivision for the Reutiman Property on Lake Linden
Drive. Following are our review comments regarding the simple subdivision and
the grading plan:
1. The plan shows two driveway accesses to Lake Linden Drive. Due to the geo-
metries of Lake Linden Drive and the marginal sight distance, there should only
be one common driveway access.
2. Sanitary sewer is available to the site, but additional sewer stubs may have
to be installed to service the property.
3. Municipal water is not available to the sight.
4. Storm sewer is not required on the sight but eventually may be needed in Lake
Linden Drive. At that time, the benefitted area will be determined, which this
property will be a part of.
5. The grading plan shows .a significant change in relief to accommodate the two
building pads. There appears to be some errors in the new contour lines tying
into the old contour lines. The developer should review this. Also, the drain-
age on-site appears to be trapped in the northwest corner of the property.
Relief for this should be incorporated into the grading plan without dumping
water onto the adjacent property. Prior to initiating an extensive grading plan
like this, we suggest a soil boring be obtained in the building pad site of the
north lot.

Definitions

Peddler or Solicitor. A peddler or solicitor is a person without a
