RD M I NUT E S CALL TO ORDER The Regular Meeting of the Shorewood City Council was called to order by Mayor Rascop at 7:30 P.M., September 24, 1984. PLEDGE OF ALLEGIANCE Mayor Rascop opened the meeting with the Pledge of Allegiance and a Prayer. ROLL CALL Present: Mayor Rascop, Councilmembers Shaw, Stover, Gagne, Haugen. Staff: Attorney Larson, Engineer Norton, Administrator Vogt, and Clerk Kennelly. APPROVAL OF MINUTES Gagne moved~ seconded by Haugen to approve the Minutes of the Special Council Meeting of September 5, 1984 as written. Motion carried-5 ayes. Haugen moved, seconded by Shaw to approve the Minutes of the Regular Council Meeting of September 10, 1984, as written. Motion carried-5 ayes. PARK COMMISSION REPORT Ice Rink Request A request for funds to have a gate built for the ice rink at Badger and to add additional mesh to protect the free skating area from the hockey pucks, was made. The work would be done by the Public Works Department. Shaw moved, seconded by Gagne to approve a transfer of $600. from the Park Capital Improvement Fund for this improvement. Motion carried unanimously. Shaw reported that the Hockey Association was discussing the use of Badger rink for organized hockey and Cathcart rink for unsupervised practice only. EXCELSIOR COVENANT TEMPORARY SIGN PERMIT David Julien of the Excelsior Covenant Church was present to request a temporary sign for a special announcement, this is the second request this year. This is a lit, but non-flashing sign. Haugen moved, seconded by Gagne to approve the request as submitted. Motion carried - 5 ayes. zL/ # . MINUT~ REGUL~COUNCIL MEETING September 24, 1984 page two . 1985 ANIMAL PATROL CONTRACT The 1985 animal patrol contract was submitted for approval by White Bear Animal Control, Inc. The contract is the same as in 1984 with an over all increase of 5%. Gagne moved, seconded by Shaw to approve and sign the White Bear Animal Control contract for 1985. Motion carried unanimously - 5 ayes. . NEAR MOUNTAIN - FINAL PLAN REQUEST FOR EXTENSION Mike and Peter Pflaum were present to request of the Council that a letter be sent to the City of Chanhassen stating the City's current water policy and that the City is in agreement with Near Mountain's request to connect to the Chanhassen water system if feasible. Mr. Pflaum reviewed his project plans for Near Mountain in Chanhassen and Shorewood. He would like to make some changes in his original plan from quad-units to single family on small lots similar to the units presently built in the Chanhassen portion of his project. When the final plan is completed and the arrangements for water have been completed he has agreed to sign the Development Agreement. Mr. Pflaum asked the Council for an extension of time to complete his Final Plan. He would like a one year extension from the current deadline of December 19, 1984. Planner Nielsen had no objections to the extension. The Park Commission would like to have an opportunity to comment on proposed park plans prior to finalization of plans. Haugen had some concerns on the water connection to Chanhassen, if Metro Council stepped in and forced Shorewood to connect a city-wide water system. Gagne moved, seconded by Stover to the current Shorewood water policy the developer to request to obtain Chanhassen municpal water system. (Haugen). direct a letter to Chanhassen stating and indicate the City's approval of water for his project from the Motion carried - 4 ayes - 1 abstain Rascop moved, seconded by Stover to grant an extension of the Final Plan to December 19, 1985, plans to be submitted by April, 1985. Motion carried unanimously - 5 ayes. ENGINEER'S REPORT Change Order - Project No. 84-2 Street Construction and Appurtenant Work Engineer Norton presented a Change Order in the amount of $676.40 additional to be added to the original bid by Valley Paving, Inc. This additional cost has been requested for 1985 pricing of bituminous, because Enchanted Lane will be done in 1985. This will also change the completion date from October 22, 1984 to July 1, 1985. Rascop moved, seconded by Gagne to approve the addition of $676.40 according to Change Order No. 1 subject to a letter being received from Valley Paving, Inc. asking to complete the Enchanted Lane in 1985. Motion carried, 3 ayes, 2 nays (Shaw and Haugen). ~ ,- -.- . _UTES ULAR COUNCIL MEETING September 24, 1984 page three TRIVESCO UPDATE REPORT Engineer Norton reviewed for the Council what was discussed at the Preconstruction Meeting on the Trivesco project. They covered under- ground utilities, needed permits, construction works, shop drawings, construction traffic, erosion control, field office site, and emergency contacts. The contractor would like to start the sewer installation from Covington Road and head north through the Bruce property. Shaw expressed concerns about obtaining control of part or all of the Bruce property for road access and park area. Vogt and Larson will continue to work with Bruce to finalize an agreement for that area for the road access and also try to come to an agreeable price to purchase the area requested by the Park Commission. The developers have asked to have additional improvement added to the original bid work to put utilities in Chartwill Hill at this time. The bonding consultant indicated that the change would delay the bonding sale date to mid-November. Engineer Norton pointed out some errors and missing dates in the traffic study. He is ready to review the study whenever the Council would like to schedule it. BUDGET REVIEW The Council reviewed various areas of the proposed Budget for cuts ot readjustments. Steve Frazier representing the Finance Committee commented on areas that the Committee had concerns. The Committee felt that storm water projects should be assessed to the effected areas as long has the City is not fiscally sound instead of the cost coming out of the general Budget. Haugen felt a contigency fund should be set up and the projects be paid for out of that fund on a first come first serve basis or as they occur. Rascop moved, seconded by Gagne to remove $75,000. from Fund No. 10 - General - Street and Roadways, Capital Outlay No. 63 - (other improve- ments) for storm water projects and place in a contingency fund. Storm water projects to be assessed to effected areas. Motion carried - 4 ayes, 1 nay (Stover). 2-Way Radio Bids Administrator Vogt submitted a bid for 2-way radios for the Maintenance Department. The bid included VHF base radio, antenna system and remote unit at a cost of $4,787.00 Rascop moved, seconded by Gagne to authorize the purchase also to include additional equipment that is needed, not to exceed the $12,000. . budgeted in 1984. Any additional equipment in excess of $12,000. will come out of the 1985 budget. Motion to approve the request was unanimous - 5 ayes. . . . _UTES uULAR COUNCIL MEETING September 24, 1984 page four Budget Review, continued: Frazier questioned Engineering and Attorney costs and suggested possible ways of lowering that cost to the City. Shaw motioned to separate $10,000. from legal services and place in miscellaneous service for the purpose of litigation. Seconded by Haugen, motion carried - 5 ayes. Chief Young was present to answer budget questions. Council discussed the possible merger of Deephaven and Greenwood and the affect it would have on the Department personnel. Chief Young said that a 12th man would be laid-off if that merger was completed. Chief Young submitted a request to purchase emergency siren at a cost of $12,000. to be shared by Shorewood and Excelsior. He submitted a plan of additional sirens to complete an area-wide plan to protect the south lake area in the future. Gagne moved, seconded by Rascop to approve the expenditure of $6,000. for the siren. Haugen motioned to cover the cost by CDBG Funds or secondly, by Revenue Sharing Funds, amendment accepted by Gagne and Rascop. Motion carried unanimously - 5 ayes. BUDGET APPROVAL RESOLUTION NO. 68-84 Haugen moved, seconded by Gagne to adopt the General Fund and Revenue Sharing Fund for 1985 as corrected. Motion carried unanimouslY-5 ayes. RESCHEDULE COUNCIL MEETING October 8th meeting will be rescheduled for October 15th because of Columbus Day on the 8th. Motion carried unanimously. 7:30 PUBLIC HEARING - REZONING FROM R-4 to R-C - 5580 COUNTY RD. 19 - ANGIE KOENIG Applicant withdrew request. VARIANCE - FRONT YARD SETBACK - JOHN LUCE - 5855 RIDGE ROAD Mr. John Luce appeared to request a garage setback 20', rather than the required 50', from Ridge Road. He cited topography (a steep slope requiring considerable fill and a large retaining wall along the easterly side of the driveway needed to hold the fill - this is with the variance, without it much more would be need ed) as his reason. His architect and Engineer have reviewed the area at length and feel that this is the best solution. The wall will begin at 10' and taper to 3'. The plans for thewall have been approved by the Engineer. Commissioner Leslie asked if the City Engineer has seen this and was told yes by Administrator Vogt. Leslie moved, seconded by Boyd, to recommend to Council to approve the variance request for a 20' front yard setback contingent upon the following Planner's recommendations: 1. The landing at the top of the driveway should be enlarged to accomodate 2 cars (Mr. Luce said this has already been done). 2. The plans for the retaining wall and foundation walls for both the garage and the house should be reviewed by the City Engineer for their structural ability to withstand lateral pressures from the soil. 3. Proposed drainage will also be subject to review and approval by the City Engineer. Particular attention must be paid to erosion control measures during and after construction. The City Engineer has suggested that hay bales or some other method of diverting water be placed above the excava- tion area to prevent it from washing out. 36 . PLANNING~MISSION TUESDAY, OCTOBER 2, page two MINUTES 1984 VARIANCE - JOHN LUCE - continued Motion carried unanimously. VARIANCE REQUEST - EXPANSION OF A NONCONFORMING RESIDENTIAL STRUCTURE ERIC DANSER - 21640 LILAC DRIVE Mrs. Danser was present. This variance request is to add a 16' x 20' single story addition onto a nonconforming structure. The addition would be to the rear of the house and conform with both rear and side setbacks. Reese moved, Leslie seconded, to recommend to Council to approve the variance request for expansion of a nonconforming structure, as recommended by the City Planner. Motion carried unanimously. VARIANCE REQUEST - EXPANSION OF A NONCONFORMING RESIDENTIAL STRUCTURE LARRY DE WITT - 28090 WOODSIDE ROAD Ernest O'Neill, current owner and Larry DeWitt, prospective buyer, appeared before the Commission. Mr. O'Neill said that the sale of the property is contingent upon the variance. He pointed out two differences from the Verdoorn example used in the Planner's Report. 1) His neighbor, Mr. Ellis' house is 70' from the property line with a grove of trees in between the two homes, and; 2) The two feet will create a vast difficulty with the garage. He also said it would ruin the lines of the house. Mr. DeWitt pointed out that when the house was built in 1959, the setback was eight feet and the house was a conforming structure. He also said that he felt that moving the proposed additions back two feet would ruin the lines of the house and lower the value. Mr. Ellis, the neighbor to the south, said he has inspected the drawings and he doesn't have any concerns. He said that being 70' from the property line plus having a large grove of trees between them, he can't see any problem with the variance. He said he applauds the attempt to improve a lovely old house. Commission discussed the question of a procedure setting problem. Commissioner Benson said he thinks it can be redesigned to limit the noncon- formity. Boyd moved, Benson seconded, to recommend to Council to deny the variance. Motion carried unanimously. Ms. Carol Brown asked to make a statement. She said when you have a property as large as this and as valuable as this, and you have an architect design it to begin with, then you have an architect now add to the house, it has to be in conformity with the actual style and value of the house. This house is so unique that for the architect to do less than first class would be difficult. . PLANNING ~MISSION TUESDAY, OCTOBER 2, page three MINUTES 1984 8:00 PUBLIC HEARING - PRELIMINARY PLAT - HARDING ACRES The Public Hearing opened at 8:07 PM. Mr. Ed Otto and Mr. Bernard Harding were present to submit a preliminary plat for property located in the northeast quadrant of the intersection of Smithtown Road and Wedgewood Drive. Property is zoned R-2 and is approximately 10.8 acres. They propose 18 single family lots, to be phased, 7 lots on existing streets first. Comments from audience: George Latterner-25295 Smithtown Road - Mr. Latterner feels that there is a discrepancy in the lot line abutting his property. Commissioner Benson explained to Mr. Latterner that he would have to contact an attorney or another surveyor to pursue this problem. Mr. Ed Otto told Mr. Latterner that his land is a Registered Land Survey, and that they had measured from the markers on Mr. Latterner's property. Mr. John Force-25380 Smithtown Road - No objection to the proposed development. Does object to having the City take 5' of his land for road. He went down and got a survey map of his property and the man there told him it looks like 10' of the paved surface of the road is already on his property, he is concerned about this. Traffic situation, noise and speeding, on Wedgewood road is bad and this will make it worse. Why wasn't Wedgewood continued into County Road 19? The area on the north end of Wedgewood is already a fire hazard. Commissioner Benson explained to Mr. Force that Planner Nielsen was not request- ing 5' of easement from him at this time, however, if he subdivides his property, he will then be asked for the easement. Chuck Amlaw-25270 Smithtown Road - Says he understands that the property to be developed is actually 9.5 acres, not the 10.8 acres mentioned in the Planner's Report. He is concerned with the lot sizes, house sizes and what it will do to the value of his just under 2 acre property. He wanted to know if the house size can be regulated by the City. Commission Benson said the house size is up to the developer. Mr. Amlaw objects to the cul-de-sac on his property. He does not want to lose 1/8th of an acre. He also feels that if he did subdivide his property, two driveways coming together at the south end of Harding Avenue would be sufficent. Commissioner Benson said that he didn't think the cul-de-sac would go in unless Mr. Amlaw developed, and that they couldn't just take his land. . . . PLANNIN~MMISSION TUESDAy,~TOBER 2, page four MINUTES 1984 Bob McDougall-25110 Glen Road - Mr. McDougall is concerned with the direct effect of opening Glenn Road. The road is not designed to carry more traffic, the surface on the 12'-13' Glen Road would present a problem. Entering unto County Road 19 would be dangerous as the traffic on it is already bad. He recognizes the valid concern over the length of the road regarding emergency vehicles, but feels the negative aspects involved in connecting the roads outweigh the good that would be done. He feels that to attach the roads, widen the road, assess the Glenn Road residents to benefit the new property would indeed be ironic. Roger Fishbasch-24885 Glenn Road - Glen Road is almost a single lane road. There are no sidewalks and our children have no place to ride their bikes and play except in the road. Added traffic will create a dangerous situation. It also seems as if the City is out to benefit developers and doesn't care about it's longterm residents. The City bends over backwards for the developers and the people end up getting assessed to benefit development. Jerry Meier-25135 Glen Road - You can't blame the developer, he was not the one that suggested connecting the roads. The residents were not even consulted as to their opinions. He doesn't feel the road would be able to handle the in- creased traffic and urges the Planning Commission not to do it. Jim Hoban-5525 Manitou Lane - People bought and built in this area because it was a dead end, and their children would be protected. If the roads were connected the residents on Wedgewood would also use the road as a cutoff to County Road 19 and create more traffic problems. I would like to see Glen Road remain as it is, with the same width and accessibility. Jan Towne-24740 Smithtown Road - Smithtown can't stand the added traffic. What about the water, will there be one well or eighteen wells. Will it affect me? Commissioner Benson said the choice is up to the developer. He didn't think it would affect her but coundn't say for sure. Greg Suddendorf-5685 Star Lane - said there is some question of whether Star Lane would be extended to Glenn Road. Are there any plans for this? Commission and Staff said no. Mr. Suddendorf also asked the value per lot. Mr. Harding said he'd say the average lot value would be approximately $22,000, and that it would be to the developer's advantage to build $100,000-$120,000 homes. Ms. Mara also asked about staying in character with the area because there are many large lots. Commissioner Benson said that the area is zoned R-2 which is 20,000 sq. ft. lots. The developer is allowed to subdivide their property and do their own designing. Star Circle and Star Lane have 20,000 sq. ft. lots and the homes would probably be similar. Dave Littlefield-24775 Glen Road - What right do the citizens have to allow or not allow that access. There is no safety enhancement, no upgrading of the neighborhood, the objective of extending that development is s1mply and only to serve the developer of 20,000 sq. ft. lots. Bob McDougall - Why the sudden concern over the safety factor? One half of Shorewood has the same problem and one half the City would have to be torn up to correct the problem. Commissioner Benson - Yes it would, from a planning prospective we upgrade when we can and when the chance comes along to do so. The Public portion of the hearing was closed at 9:10 PM. Commissioner Reese said he has not had time to study the Engineer's Report and he is not prepared to make a statement at this time. Commissioner Leslie mentioned putting a cul-de-sac at the northern end of the proposed Harding Avenue, thus alleviating the increased traffic onto Glen Road, yet servicing the entire proposed project. Commissioner Leslie also asked Mr. Harding about his phasing. Mr. Harding said if he could sell the first 6 lots he would begin building immediately. Commission discussed the issue and felt that they neede time to study the Engineer's Report (received at meeting) and would like Planner Nielsen's input. As shown on Exhibit B the garage would be 20 feet from Ridge Road rather than 50 feet as required in the R-1 District. The property measures square feet in area. severely to the east. the variance request. approximately 150' x 330' and contains 49,500 As illustrated on Exhibit B, the site drops off The applicant cites topography as the reason for ANALYSIS/RECOMMENDATION It should be noted that the contours shown on Exhibit B represent five- foot intervals rather than two-foot intervals. Although the proposed house will comply with the 50 foot setback requirement, the garage has been placed forward on the lot to minimize the amount of fill required to achieve an acceptable grade for the driveway. Even with the garage closer to the road a considerable amount of fill will be required. Furthermore, a large retaining wall will be necessary along the easterly side of the driveway to hold the fill. In view of the site topography, the variance is considered justifiable. The amount of fill already needed plus the retaining wall will obvious- ly prove quite costly. Moreover, without the variance the site would require an even more inordinate amount of filling or create an undesir- able driveway grade. As proposed the driveway will have approximately 10 percent slope. . A Residentia' Community on Lake Minnetonka's South Shore . First, the landing at the top of the driveway should be enlarged to accommodate two cars. The dashed line shown on Exhibit B, illustrates the &uggested size. This will allow vehicles to be parked at the top of the driveway and off the road in the event of severe snowfall. Secondly, the plans for the retaining wall and foundation walls for both the garage and the house should be reviewed by the City Engineer for their structural ability to withstand lateral pressures from the soil. Proposed drainage will also be subject to review and approval by the City Engineer. Particular attention must be paid to erosion control measures during and after construction. The City Engineer has suggested that hay bales or some other methoa of diverting water be placed above the excavation area to prevent it from washing out. Assuming these suggestions are complied with, it is recommended that the variance be granted and that the applicant should be directed to prepare the appropriate drawings for review by the City Engineer. Since the existing house is only 45' from the front property line, and the R-1 District in which the property is located requires a 50 foot setback, the house is a nonconforming structure. Any expansion of a nonconforming structure requires a variance. The property in question measures approximately 191' x 256' and contains approximately 48~896 square feet in area. Exhibit B illustrates the loc- ation of the applicant's existing house and garage and the proposed addi- tion. As proposed, the addition will be 20 feet from the east side of the property. The addition will be single story and measure 16' x 20'. ANALYSIS/RECOMMENDATION The Shorewood Zoning Ordinance totally prohibited the expansion of any nonconforming structure until May of this year. At that time the City amended the Ordinance to allow variances for the expansion of nonconform- ing single-family residential structures (see Ordinance No. 159). The amendment is consistent with the provisions of the proposed Zoning Ord- inance Revision. When Ordinance No. 159 was being reviewed, one of the criteria which was discussed for granting such a variance was that the variance would not increase the nonconformity. This criteria is consistent with Section 11, Subdiv. 3 which states "...No yard or lot existing at the time of passage of this ordinance shall be reduced in size or area below the minimum re- quirements set forth herein..." The sale is contingent upon Mr. DeWitt being able to obtain a variance to expand the existing home. As shown on the applica- tion survey (Exhibit B, attached) the house is located eight feet from the side lot line. The R-1 district in which the property is located requires a 10 foot setback from side lot lines. Consequently the house is a non- conforming structure. Mr. DeWitt proposes to extend the building eastward 24 feet to increase the existing garage space and westward to add a family room. Exhibit C was prepared by the applicant's attorney and summarizes the request. ANALYSIS/RECOMMENDATION As you are aware, Section 10, Subd. 4 of the Zoning Ordinance formerly precluded any expansion of nonconforming structures. Ordinance 159 amend- ed the Zoning Ordinance to allow variances for expansion of nonconforming structures in certain instances in which the nonconformity would not be increased. In this particular request the nonconformity would be increased. Instead of 26 feet of building encroaching into the required side yard, 65 feet of building would encroach. The present building line is approximately 8 feet from the lot line; however, the neighbor's house to the west is annroximatelv 70 feet away from the common lot line. -~ ~ The Applicants seek a variance which would allow the DeWitts to improve the premises with an addition which would not extend the premises toward the side lot-line but would extend the premises in a westerly direction along the exist- ing south wall of the residence. (See drawings and surveys). Owner/Applicant O'Neill has offered the subject pro~erty for sale for more than one year. The present offer (contingent upon the variance being granted) is the only viable offer they have received during that time. If the variance is not granted, the Applicant Delvitt will withdraw their offer and the Owner/Applicant O'Neill will loose the sale, which loss will create a severe financial hardshio for Owner/ Applicant O'Neill. On 13 August 1984, a sixty day delay was requested before the Council acted on the rezoning, development plan approval, and reconsideration of a Comprehensive Plan amendment for Shorewood Oaks. The 9 October Council meeting would have fallen within the time frame of the sixty day delay, but the meeting was postponed a week due to the Columbus Day holiday. The sixty day extension was requested to provide more time to resolve concerns over the proposed storm water and city water systems. Tim Phenow, the project engineer, and myself met with the Parks Commission on 20 August and 17 September to resolve their concerns over the storm water ponding proposed in Freeman Park. An agreement has been reached which stipulates that the Parks Commission must grant approval of the ponding design prior to final development plan approval by the Council. We feel that through a collaborative effort between the development team, city staff, and Parks Commission, a ponding design will be created which will be an attractive asset for Freeman Park. In regard to the water system, we are investigating alternatives with the understanding that the city has established a policy of non-expansion. The developer is analyzing the costs of constructing a private well, connecting into Chanhassen, and possibly extending a line from Boulder Bridge. When they reached the proposed ponding area, they explored the ravines and examined the 40" cul- vert. Our City Engineer was suprised to see what good condition it was in. They then returned to City Hall to continue the formal part of the meeting. CALL TO ORDER Chairman Roger Stein opened the formal part of the meeting in the Council Chambers at 7:00 PM. ROLL CALL Present: Chairman Roger Stein, Commissioner's Gordon Lindstrom, Gary Carl, Carol Butterfield, Con Schmid, Mari Kooi, and Marty Jakel; Council Liaison Tad Shaw; Planner Brad Nielsen; Engineer Jim Norton; and Deputy Clerk Sue Niccum. SHOREWOOD OAKS - continued Geoff Martin told the Commission that Shorewood Oaks' original plan was to use the natural drainage area. Gary Carl asked if, with the new project drainage, the natural drainage area wouldn't expand past what was shown on Shorewood Oaks' map. Tim Phenow, Shorewood Oaks' Engineer, said that the area shown on their map was that of a "100 year storm" and that the drainage from the new project was already included on the map. Commission would like to know how much additional water will be coming from the new project. They asked Shorewood Oaks if they would draw up a map showing them the difference. ID ~ . 'I,. . PARK COMMISSION MEETING FREEMAN p. TOUR MONDAY, SEMBER 17, 1984 page two Commission showed concern over the following: Wagner Pond-east of the BMX Track Engineer's Phenow and Norton said that the Wagner pond is 976', the "100 year storm" height is 969', a difference of 7'. The water would go up and over the railroad track area before it would ever back up and create problems in the Wagner Pond area. Will mon' "hard Surface" in new development cause problems? No. the total rainfall doesn't change, therefore the water runoff into the drainage area will be the same. Open Ponding Area - Is it feasible? Engineer Jim Norton suggested that Commission keep in mind the fact that Shorewood Oaks will bE' using perforated pipe, this will keep a flow moving. Commission dis~ussed different ways of maintaining a water level. A sluice gate ~as one of the solutions mentioned. Engineer Phenow felt this could create a maintenance problem. One of the Commission's concerns about open ponding was the idea of stagnant water becoming a breeding ground for algae and mosquitoes. The question be- ing how to prevent this problem. and keep a clean water level. Engineer Nortcn mentioned that the main concern at the Council meeting was shown by citizens on the north end of the proposed holding pond, they were afraid of the overflow coming through too fast and causing flooding problems on their property. Some of these properties already have existing problems. The drainage exiting the holding pond, E'quivalent to an 18" pipe. is already planned. Engineer Norton said that it is extremely important that the rate of discharge from the holding pond is limited. The holding pond overflow area consists of 11 acre feet of storage. Engineer ~orton asked what the Commission would think of having two holding ponds. one near the development. and one in the planned project area. Engineer Tim Phenow mentioned 2 things he had in mind: 1. Dig out and widen the gullies. This would not be too expensive. 2. Build a deep, more compact holding pond. This could be more expensive. Commissioners asked Council Liaison Shaw if there had been any other major issues regarding the Shorewood Oaks project brought up at the Council lev~l. He said they had discussed the density of the project. Commission has no problem with the area to be used but will continue discussion at an appropriate time on the possibility of making the ponding area smaller or having open water. Mari Kooi moved, Gary Carl seconded, to inform the Council that the Park Com- mission approves the project, and that the Park Commission requests to be included in the Engineer's discussion of the final plat regarding drainage and the ponding area. Motion Carried Francen has been secretary for the past three months and now a new committee member must take over these duties. Fonte volunteered to write the minutes for this meeting. COMMITTEE BY-LAWS Amlaw moved and the motion was approved, to let the record show an error in the approved City Council Meeting minutes of September 5, 1984. It was stated the Finance Committee presented By-laws to the City Council, however, it was only a discussion of ideas which Bridge gave to Stover. The Finance Committee had not discussed new By-laws yet. CITY BUDGET Frazier and Amlaw attended the final City Council Budget Meeting on September 24, 1984. At the meeting, 27 formal recommendations by the Finance Committee, concerning the Budget, were considered by the City Council. Frazier described the discussion on each recommenda- tion and it appeared they adopted approximately half of the recommen- dations. Many they rejected. We especially discussed the potential savings to the City by reducing Legal and Engineering expenses while keeping quality service. We went into a broader discussion of keying in on several issues that we feel we can act on. BY-LAWS to CITY COUNCIL We discussed and agreed on the following By-Laws to be recommended to the City Council for approval; we would like the City Council's approval, comments, etc before our next meeting. The recommended changes to the By-Laws are: 1] The Finance Committee will have a regular monthly meeting and special meetings. 2] Topic coordinators will go to Council meetings pertaining to his/her topic. September 27, 1984 3] Equal access to information and Staff for all members. 4] Chairman will be changed to Chair. 5] Guaranteed staff time for input to Committee on Audit and Budget, including City Administrator, Finance Director, and Mayor. 6] Finance Director to attend regular monthly meetings and when requested special meetings; other staff available at request of the Committee. 7] The Finance Committee will receive a copy of a rough draft of the minutes from City Council meetings. 8] City Council Agenda, for future meetings, made available to Finance Committee as soon as possible. 9] Must receive information sooner for the Committee to thoroughly review before presenting our recommendations to the City Council. (Specifically the City Budget - 1 to 2 months before the City Council acts on a proposed budget.) 10] Poor attendance at Committee meetings not be criteria for dismissal if the Chair is notified before the meeting if a member is unable to attend for good reason. Dear Dan: We recei ved a revi sed set of gradi ng and street pl ans for Waterford P .U.D. from Schoell & Madson, Inc. on October 10, 1984. Enclosed is a copy of their cover letter which discusses the revisions. The changes to the street grades and the resulti ng sewer changes appear accept- able. However, the changes to the watermain sizes have a more dramatic affect than what appears at first glance. Primarily, we are concerned about reducing the trunk main on Old Market Road from a 1211 pipe to a 1011 pipe. From an engineering standpoint we cannot suupport the size reduction. The carrying capacity of a 1211 pipe is equal to 1.6 - 1011 pipes. We will proceed with making the changes required on the sewer, water and street plans as discussed. Final trunk water pipe sizes require further discussion. The changes must be sent to the contractor, inspector and surveyor before any field work actually begins. The revisions consist of lowering the street grade in the Old Market Road - Waterford Place intersection by about six feet. The house pad elevations were similarly lowered. This revision will result in 1397 cubic yards of additional excavation and 9191 cubic yards less embankment construction. Also enclosed are copies of the sanitary sewer and watermain plan on which we have shown the proposed watermain revisions in red. In general, these consist of reducing the main size to 10-inch on Old Market Road, deleting about 260 feet of main by Covington Road, adding a 10-inch stub to the well site, adding an 8-inch stub on Chartwell Hill and reducing the main size of the last 230 feet on Chartwell Hill to 6-inch. We have reviewed the basement elevation for Lot 6, Block 4 on Chartwell Bill and feel that the elevation is appropriate. There is considerable filling required in the backyard for the present elevation. Therefore, the sanitary sewer elevation should be lowered. Please call if you have any questions.
