CALL TO ORDER
The regular meeting of the Shorewood City Council was called to order
by Mayor Rascop at 7:35 PM, Monday, June 11, 1984, in the Council
Chambers of City Hall.
PLEDGE OF ALLEGIA~CE
The meeting was opened with the Pledge of Allegiance and a prayer
by Mayor Rascop.
ROLL CALL
Present: Mayor Rascop; Councilmembers Shaw, Stover, Gagne and Haugen.
Staff: Attorney Larson, Engineer Norton, Planner Nielsen, and
Clerk Kennelly.
APPROVAL OF MINUTES
Board of Review
Gagne moved, seconded by Stover to approve the Minutes of the Board
of Review meeting held May 24, 1984, as written. Motion carried
unanimously.
Audit Meeting
Gagne moved, seconded by Shaw to approve the Minutes of the Special
Audit Review meeting held May 29, 1984 as written. Motion
carried unanimously.
Regular Council Meeting
Stover moved, seconded by Gagne, to approve the Minutes of the
regular Council meeting of May 29, 1984 as corrected in the official
minute book. Motion carried unanimously.
INTRODUCTION OF ADMINISTRATOR
Mayor Rascop introduced the newly appoint~d Administrator, Daniel Vogt.
He will take the position effective July 9, 1984.
MATTERS FROM THE FLOOR
Chaska Road Drainage Problem
Gene Clapp of 6050 Chaska Road came forward to inform the Council
of a drainage ditch problem in front of his house and leading to
the professional building at 6000 Chaska Road. The storm sewer
appears to have collapsed and developed a very large hole and
potentially dangerous hole after the City tried to clean out the
drainage ditch.
Rascop directed the road department to repair the damage as soon as
possible.

Matters from the Floor, continued:
Lake Access - Dock Request
Howard Lerohl of 255e5 Birch Bluff Road asked the Council for the
right to reinstall the dock at the lake access at the extension of
Eureka Road as it has been installed in the past years. Council
had indicated last fall that policy on these accesses would be set
by this time. Mr. Lerohl would like a temporary permit to install
the dock until which time the Council has its policy in place.
This dock ~s for the convenience of the neighbors to use for fish-
ing, swimming, sunning, short term docking for picking up people
and errands - no overnight dockage. Gagne moved to approve the
installation of the dock, seconded by Haugen for discussion only.
She felt that no formal action should be taken until a public
hearing determined. the use. That they should install the dock
under the "Grandfathering" provision, Stover was in agreement.
Gagne moved, .seconded by Haugen to issue a temporary permit for the
dock installation until the public hearing can be set and a policy
can be adopted. Public hearing will be set for July 10, in front
of the Planning Commission. Motion was carried, 4 ayes - 1 nay (Shaw).
Zoning Complaint
A question on the zoning of 24590 Smithtown Road was presented.
The property is in a residential zone. Claire Towne will submit a
written complaint of a zoning violation to the City Clerk.
Request for Deferred Fees
RESOLUTION NO. 33-84
A request from a real estate agent representing Irma French of
23825 Smithtown Road to defer the simple subdivision fees until
the division has been completed due to financial hardship in this case.
Haugen moved, seconded by Gagne to approve the requested. Motion
carried unanimously.
PARK COMMISSION
Marty Jakel and Conrad Schmid reported on the progress of the
"Festival of Parks". Playground equipment is being installed at
Badger Park and will soon be installed at Manor Park. This equipment
has been paid for by donation through the "Century Club". A complaint
from Mr. and Mrs. Osha on the dust from trre access road to Freeman
Park was received. The cost of tar and oiling will be checked. Also,
additional patrolling will be requested for speeding violators.
FENCE PERMIT REQUEST
Sue Morgan and Linda Scott of 5235 Shady Lane requested permission to
install a 6 foot fence along the property line of 5255 Shady Lane
with a 42 inch fence on all other boundaries. Approval has been
received from the property owners of 5255 Shady Lane in writing.
Gagne moved, seconded by Shaw to approve the request as submitted.
Motion carried unanimously.

SIMPLE SUBDIVISION - 5530 HOWARD'S POINT ROAD
RESOLUTION NO. 34-84
A request from Mrs. A.T. Ridinger of 5530 Howard's Point Road to
divide her lot into two (2) 40,000 + sq. ft. lots.
Gagne moved, seconded by Haugen to approve the simple subdivision
subject to a 5 foot dedication for roadway and subject to necessary
fees being paid. Also to include the removal of a shed on the newly
created lot. Motion carried unanimously.
8:00 PM PUBLIC HEARING - VARIANCE REQUEST - RICHARD GAY
Public hearing was opened at 8:20 PM to hear a request from Richard Gay
of 5480 Covington Road for a rear yard setback variance. A 15 foot
setback from rear lot line is being requested. Public portion of the
hearing was closed at 8:25 PM with no public comment.
Mr. Gay felt the variance was needed to reduce the amount of trees
to be removed for construction and retain the most privacy from
adjoining lots.
The Planning Commission did approve the 15 foot variance in exchange
for 65 foot front setback.
Stover moved, seconded by Gagne to approve the 15 foot rear yard
setback to include a 65 foot front setback and that no accessory use,
building or outside storage be located in the back yard setback area.
Roll Call Vote - 3 ayes, 2 nays (Haugen and Shaw). Motion denied.
Mr. Gay questioned the Council's reason for denial. Council directed
the Attorpey to draw a resolution of denial - Facts of Findings, this
will be presented to Council and Mr. Gay.
8:15 PM PUBLIC HEARING
VARIANCE REQUEST - KEITH BEDFORD
RESOLUTION NO. 35-84
The public hearing was opened at 8:38 PM to hear a request from
Keith Bedford of 24375 Wood Drive to expand a nonconforming structure.
Mr. Bedford would like to add a deck to his home that would not
increase the nonconformity. The public portion was closed at 8:42PM
without public comment.
Gagne moved, seconded by Stover to approve the variance as requested.
Motion carried unanimously by Roll Call Vote - 5 ayes.
8:30 PM PUBLIC HEARING
TRIVESCO - COMPREHENSIVE PLAN AMENDMENT AND REZONING TO P.U.D.
The public hearing was opened at 8:44 PM to hear a request for a
Comprehensive Plan Amendment and rezoning to a P.U.D. John Uban
presented a slide presentation for the Council and the audience of
the proposed Trivesco project. Trivesco is comprised of three
developers, Mark C. Jones, Robert Mason, and Steiner/Koppelman,
proposing a development that would include commercial, multiple family
and single family areas, with a residential park. A new intersection

Trivesco Public Hearing, continued:
off Highway 7 with a new collector street running south of Highway 7
to Covington Road. This would lighten the traffic load on Vine Hill
Road and the present intersection at Highway 7 and Vine Hill Road.
Public comments were taken from:
Richard Gay - 5480 Covington Road questioned at what time, in the
project, would the intersection be installed? Mr. Uban replied that
the project is proposed for a 4 year phasing, single family first.
The intersection will be in by the time the multiple would start. All
the information from the various reports and studies plus the highway
approval will have to be completed before the installation can be made.
Mr. Gay felt that the intersection should go in at the beginning of
the project.
Peter Boyer - 19685 Excelsior Blvd. spoke in opposition to the
commercial stage of the development and the new intersection. He
felt the intersection would not be needed if the commercial was
excluded. Mr. Uban said the new collector road and intersection would
improve the traffic problems and not cause any additional traffic
congestion on the highway. The commercial use along the highway was
the only acceptable use for that area.
Robert Peterson - 5474 Covington Road asked the following questions:
1) Will a restaurant be included in the commercial area? Mr. Uban
stated that there were no plans at this time.
2) Where would the new collector road meet Covington and would it
cause more traffic on Covington to the north? Planner Nielsen located
the proposed intersection with Covington and explained a "teeing"
that wou~d direct the traffic flow to the south.
3) Could the Highway Department recommend the new intersection to be
placed at the current entrance to Covington Road? It is possible,
but they felt it was not feasible and wouldn't be recommended.
Dr. Alex Janes - 5630 Christmas Lake Point asked the overall density -
2.5 units per acre. He felt the intersection should be installed at
the beginning of the project, the traffic would use Radisson Inn Rd,
this road cannot handle additional traffic flow.
Tory Miesen - 20090 Excelsior Blvd. stated concerns regarding drainage
problems that may be created by the comme~cial area. Mr. Uban 'explain-
ed that a larger ponding area will be put in to hold run-off until
it can flow off in a manner no faster or heavier than present run-off.
This will have to be approved by the Watershed District.
David Banker - 5530 Vine Hill Road said he felt the location of the
intersection of Covington to Vine Hill Roads has a bad site distance,
this location should be reconsidered.
Les Anderson - 5385 Shady Hills Circle said he felt single family could
replace the proposed multiple family because it is being done in other
cities along the highway. He also questioned whether there was a
need for commercial in that area.

Trivesco Public Hearing, continued:
Rosemary Lockwood - 19355 Shady Hills Road. Her concerns were addi-
tional drainage from this project would compound the current drainage
problem that currently goes through her lot. Mr. Uban and Engineer
Norton confirmed that the drainage area from this project will not
flow into her drainage area and will not cause an added problem.
Gary Mize - 20480 Radisson Inn Road expressed concerns about traffic
on Radisson Inn Road unless prohibited. Russ Stuart of 20505 Radisson
Inn Rd voiced the same concern.
Bonnie Workman - Excelsior Blvd., Deephaven wanted to know if an
Environmental Impact Study had been completed. Mr. Uban stated that
it will be called for at the proper timetable.
Wallace Wierson -19765 Excelsior Blvd. stated he was against the
commercial area. and thought it should be used for park land.
Marty Jakel - 5404 St. Alban's Bay Rd. stated as a Park Commission
member that the Commission felt this area was not good because it is
too close to the highway.
Paul Seifert - 5515 Radisson Entrance said he feels the project doesn't
properly address the traffic problem and a timetable should be a
priority. The P.U.D. zoning with a Development Contract will address
these problems. The developers can control the scheduling of the pro-
ject, but they have no control over other agencies that they have to
rely on for reports and permissions necessary.
Bob Morast - Traffic Engineer, Minnesota State Highway Department -
He indicated that some improvement on the signals at Highway 7 and
Vine Hill Road were planned, but will be delayed. They would like
more specific plans from the City.
Richard Gay - felt that the street plans should be done first and the
present park area owned by the State Highway Department should remain
intact and not be included in the area used for any intersection plans.
Marty Jakel - nas an extension of the proposed collector street been
addressed to the north of Highway 7? Developers do not need access to
the north. This will probably be addressed in the traffic study.
Wallace Wierson - the commercial area should be used as a natural
buffer if not a park use.
Pete Boyer - felt the intersection should be improved and remain at
the present location. Engineer indicated the area is not available
to correct and Deephaven opposes changes there.
Public portion of the meeting was closed at 10:04 PM. The hearing
was opened to Council comments.

Trivesco Public Hearing, continued:
Haugen asked when a "Marketing Study" would be done and "what if" it
showed no need for commercial uses. The Study would not be addressed
until after the Traffic Study was completed. The developers felt a
need for commercial was there or they would not have made a commitment
for that property. Mr. Robert Mason (developer) reviewed phasing of
the project. The first stage would be the single family on the
Clifford Trust and Rebers Construction land, the multiple family on
the northern portion of that property and the final stage of commercial
on the Murfin property. This property was included for the protection
of the rest of the development to insure the best use and quality of
this area.
Comprehensive Plan Amendment
Rascop moved to approve the Comprehensive Plan amendment and submit
to the Metro Council for review, Haugen seconded for discussion.
Shaw felt the draft of the amendment should be drawn prior to acting
on. Planner Nielsen suggested motion should be "to amend the land
use map and to reflect the change in transportation plan". After
further discussion, Rascop withdrew his motion.
Rascop moved to direct the Planner to draw the actual documents to be
presented to Metro Council to include the graphic map change and the
transportation plan. Amendment to include commercial, multiple family,
and single family uses, intersection and collector street, range of
density for residential areas, seconded by Haugen. Motion withdrew
after discussion by Rascop, accepted by Haugen.
RESOLUTION NO. 36-84
Haugen moved, seconded by Shaw to approve the Comprehensive Plan
amendment subject to approval of the final text amendment and graphics
to show commercial, multiple family, single family uses, and the
transportation plan. Motion carried unanimously - 5 ayes.
Council break - 11:30 PM to 11:40 PM.
AMESBURY WEST TRAIL DISCUSSION
A complaint was received from Mrs. Eisert of 20585 Garden Road on
June 8th that McNulty Corp. was installing a trail in the Amesbury
West project. Building Official Nielsen crrdered a "stop work" on the
project because he could not substantiate that permission had ever
been given to proceed with the trail.
Jim McNulty was present to request the right to continue the installa-
tion of the path, stating that he felt he had the right to install it
because it was on the original plans that were presented with the
Amesbury West plat. Council contends, according to the Council
minutes of April 26, 1982, that permission was only granted for the
swimming pool and tennis court and that the "foot path" request was
withdrawn on the right to return at a later date for permission to
install that path.

Amesbury West Trail Discussion, continued:
Haugen moved to table until further information can be obtained
seconded by Rascop. McNulty Construction can complete the traii on
the south side of the tennis court only.
Mr. McNulty would like to discuss the trail wi th Mrs. Eisert prior
to the discussion of the Council.
WATER POLICY
Council reviewed and discussed the proposed Water Policy items
suggested at the May 29th Council Meeting. Public comment from
Claire Towne of 24740 Smithtown Road questioning "why the Council
continues to bring up municipal water system issue when the residents
have stated they don't want water". The Council did not feel this
was true because' of comments received.
Council discussed with current developers various ways of handling
operating costs, assessment procedures, pay backs for oversizing,
and security of back-up wells. Council authorized Engineer Norton
to contact the City of Minnetonka and discuss additional water
connection or "back-up well" possibilities. Council would like a
presentation from a bonding consultant explaining services, interest
rates and a clarification of bondability of the City. Council
directed staff to contact the Springstead Company.
WATER FEASIBILITY STUDY ORDERED
RESOLUTION NO. 37-84
Shaw moved, seconded by Rascop, to direct the Engineer to prepare
a Water Feasibility Study for the area bounded by Christmas Lake
Point, north to Highway 7, east to Vine Hill Road and south to
Chanhassen boundary, also separate costs for Trivesco, Covington Vine
Ridge, and Near Mountain projects.
ATTORNEY REPORTS
Attorney Larson has received a request from Chanhassen requesting
Shorewood's support with the Metro Sewer Board to encourage them to
install a gravity line instead of a force main in the Pleasant View
Road - Christmas lake Road as was originally proposed.

ADMINISTRATIVE REPORTS
A request for a permanent position and raise for secretary/receptionist
Patti Ray.
Gagne moved, seconded by Haugen to appoint Ms. Ray as a permanent
employee. Motion carried.
Stover moved, seconded by Rascop, to allow a .97i an hour raise at
this time. Motion carried.

City Hall Painting
Two bids were received from painting contractors. Each were
over the budgeted $700.00 per painting.
Stover moved, seconded by Gagne to approve the bid from John
Annen Painting in the amount of $840.00. Motion carried.
APPROVAL OF CLAIMS AND ADJOURNMENT
Haugen moved, seconded by Gagne, to approve claims for payment to
be followed by adjournment at 2:05 AM. Motion carried unanimously.

at 7:30 PM on June 12, 1984, in the Council Chambers to review the
assessed valuation placed on real estate property in Shorewood.

Mr. Ron Mattson has applied for a building permit to convert 7000 square
feet of the Warner's Hardware Store located in the Shorewood Shopping
Center to office space for their corporate headquarters (see Exhibit A,
attached). Consistent with City policy, the permit request is referred
fo the Council for review.
From a zoning perspective the request presents no problems. A primary
concern is conformance with parking requirements. Since office space
requires less parking than retail, existing parking should be adequate.
Should additional signage be required for the new office space, the
permit application will be subject to Council review. It should be noted
that the unauthorized advertising banner which was located on the south
end of the building has been removed.

Crosstown Sign Co. has applied for a sign permit on behalf of Rapid Oil
Change (to be located at 19467 State Highway 7). They propose a free-
standing pylon sign measuring 5' X 10' and containing 50 square feet
in area. A wall sign measuring 3' X 12' (36 sq. ft.) is also proposed
for the front of their new building. All signage complies with the
conditions of their variance and conditional use permit approvals.
Prior to erection of their new signs, all signs on the existing florist
building will be brought into conformance with their previous approvals.
Photographs of the proposed signs will be available at the Council
meeting on 25 June.

Please be advised .that I have been retained by Doris and Fred Nephew of 5890
Cathcart Drive in Excelsior, Minnesota. It is my understanding that the
Nephews reside within the boundaries of Shorewood.
I am writing to you on behalf of the Nephews in the hope that the City will
resolve a water problem which is being created by the existence of a drain
tile line flowing into a catch basin and culvert under Cathcart Drive adjacent
to my client's property. It is my understanding from talking to my clients
that Dean Johnson, who resides at 5875 Cathcart Drive, and who is a neighbor
of the Nephews, installed a sump pump that flows into an underground tile
line and empties into a catch basin, which in turn empties into a culvert
that is located under Cathcart Drive and which empties onto my client's land.
For a number of years now, the Nephews had been deprived of the full use
of their property due to an overflow of water onto their land, which we believe
to be because of the diversion from Mr. Johnson's sump pump and other surface
waters through the ground tile line into the city catch basin.
Last summer, which, if you will remember, was a relatively dry summer, the
water stayed on the Nephew property until approximately the middle of the
summer. As you can well imagine, the Nephews would like to see this drainage
problem remedied as soon as possible.
I am writing to the City of Shorewood because of my belief that the City
should be held liable for any damages that the Nephews suffer because of
its ~ence in this diversion by Mr. Johnson of tbe surface waters onto my
client's land.
As I am sure your city attorney can advise you, the municipality has the
same responsibility as a private landowner when it comes to the diversion
of surface waters. A municipality may not discharge into a water course
more water than it has capacity to carry, and cannot burden a lower neighbor
or landowner with more water than is reasonable.

It is our position that the diversion of the surface waters from the Johnson
property through the municipal drainage system, i.e. the catch basin and
culvert, is an unreasonable burden upon my client's property. Accordingly,
I would hereby request that the City plug the underground tile line that
flows into the catch basin or remedy the situation in some other way so that
my client's property will not have to continue to be subjected to this unreasonable
burden. Since it is my understanding that the City of Shorewood permitted
this drainage problem to arise in the first place, we are placing responsibility
on the City to alleviate it.
If I am not provided with a response from the City within the next 15 days,
it will be necessary to take action against the City in a Court of Law. I
look forward to hearing from you.

We have reviewed the preliminary information submitted on the Shorewood Oaks
Development Inc. and have the following comments:
1. Sanitary Sewer - Adequate sanitary sewer is available to service this
development with an all gravity system. However, the connection to the main line
pipe in Strawberry Lane is to an interceptor pipe owned and operated by the
Metropolitan Waste Control Commission (MWCC). A permit from them will be
required.
There are currently a few homes not served by City sewer that may be capable of
being served through this plat. Further investigation of this service may be
warranted.
2. Water - Municipal water is currently not available. A temporary connection
to Chanhassen as suggested by the developer may be an option. Further work on
this matter is required.
3. Storm Sewer - Storm Drainage has been addressed by the developer and is shown
on the Preliminary Drainage Plan Sheet 3 of 5. The discharge point of the drain-
age from this property is into Freeman Park. This does correspond to the Compre-
hensive Storm Water Plan. What must be realized 1s that periodically the low
area south of the tracks on the park property will be lnnundated. The only
change to the Preliminary Plan we see, at this time, is that the line on Maple
Avenue must be extended west to Strawberry Lane. Any comments received from the
drainage district review should also be incorporated.into the design.

4. Streets - The streets as proposed appear acceptable, however design informa-
tion is required to show all horizontal and vertical curves are designed for 30
m.p.h. Along S.T.H. No.7, the right turn lane must be reviewed by MnDOT to
assure conformance with their standards for right turn lanes.

On 5 June the Planning Commission voted unanimously to recommend approvat of the
Shorewood Oaks Comprehensive Plan amendment and Concept Stage of a planned unit
development (P.U.D.). They also recommended Development Stage approval for the
single family portion of the project. Development Stage approval of the town-
houses is subject to additional information and further review.
Their recommendation was based upon a revised development plan which is explained
in written and graphic form in a memorandum from Geoff Martin to the City, dated
14 May 1984 (see Exhibit A, attached). The proposal is evaluated in a staff
report dated 1 June 1984 (see Exhibit B, attached).
As noted in paragraph six, page two of the staff report, it is requested at this
time that the Park Commission make a formal recommendation to the Council relative
to park dedication requirements. Aside from the dedication requirements, the Park
Commission raised concerns over access and drainage for the site.' These concerns
are addressed in the staff report and in a report from the City Engineer, dated
7 June 1984 (see Exhibit C, attached).
Relative to access, the project's entry and Freeman Park's entry will remain
separate. However, the right-turn lane off Highway 7 will be designed for both
entries. As far as drainage, the Engineer feels it is important for everyone to
know that the project does drain into Freeman Park and that the low area in the
Park will be subject to periodic inundation. This has been planned for since
1975 when the City prepared its stormwater management plan. The Freeman Park
Master Plan is designed to accommodate the ponding area. Any work done within
the Park will, of course, be paid for as part of the project.

RE: TRIVESCO - PROPOSED COMPREHENSIVE PLAN AMENDMENT
At the 11 June Council meeting the Council asked to see how the Comprehensive Plan
amendment proposed by Trivesco, Inc. would look in written and graphic form. As
I mentioned at the meeting, the amendment could be as simple as redrawing the
Proposed Land Use map to reflect the uses and densities proposed within the project,
or it could also involve specific rewording of portions of the text.
There are two elements of Shorewood's Comprehensive Plan which are affected by the
Trivesco proposal. Report No.4, Policy Plan/Development Framework, dated September
1981 deals with, among other things, land use and transportation. Report No.8,
Transportation Plan, dated October 1980, deals specifically with transportation.
The first page to be changed in Report No. 4 should be page 75 - the Proposed Land
Use map (see Exhibit A, attached). Exhibit B illustrates the land use pattern for
the area in question, incorporating that which is proposed by Trivesco. It should
be noted that the proposed land use pattern is consistent with the Concept Plan
section of the Comprehensive Plan (see pages 53-58).
Page 77 contains general written desciptions for various commE:lcicl areas within
the community. The last paragraph on that page d~scribes the Vine Hill Road/
Highway 7 area:
"The area in the vicinity of the Vine Hill Road/Highway 7 intersection is
primarily neighborhood and convenience type commercial. No change in use nor
expansion of the commercial zoning is proposed for this area."

It should be noted that additional detail will be proposed in the Area Plan to be
discussed further on in this report.
The next page to be changed is page 91 - the Transportation Plan (see Exhibit C,
attached). Exhibit D illustrates the revised Transportation Plan for the area in
question; The accompanying text to that map is found on page 93 and currently
reads:
"In addition to Eureka Road, it is suggested that Vine Hill Road be carefully
considered for collector status. Vine Hill Road is viewed as being an important
north-south route for the eastern portion of the community, forming a desirable
link between Highway 7 and the proposed Highway 62 crosstown route (see minor
arterials). While little development in Shorewood has impacted traffic on
Vine Hill Road (with the exception of the Vine Hill Road/Highway 7 intersection),
high density residential development in Minnetonka has had some influence on
traffic volume. It is felt that development in the eastern section of the City
will be influenced by the ultimate design of Vine Hill Road. Upgrading of
Vine Hill Road will necessitate a redesign of its intersection with Highway 7.
This intersection has been a subject of considerable concern to the City. The
City Engineer has submitted several alternative designs for the area which would
improve the existing situation, however, the City has, at this point, taken no
further action. It is strongly recommended that in its detailed facilities
plan for transportation, the City re-examine the Engineer's alternatives and also
the possibility of realigning the section of Vine Hill Road north of Highway 7
to connect straight southward. Whatever improvements are decided upon will
have to involve the Minnesota Department of Transportation."

The preceding changes should also be incorporated into the Transportation Plan
(page 12).
The last section of the Plan affected by the Trivesco proposal is the Area Plan
for Planning District 13 found on page 120. The proposed development is not
considered to be in conflict with this section which reads:
"While the overall residential density of the District has been proposed as one
to two units per acre, the City recognizes that property adjacent to Highway 7
may not be appropriate for such use. In this regard, a somewhat higher density
residential use (three to six units per acre) or low intensity nonresidential
use (e.g. offices or other low traffic-generating commercial uses) may be
considered acceptable for development of the Highway 7 "corridor". Some sort
of planned unit development may be the best means of creating a desirable
transition from Highway 7 southward into lower density residential development
in the interior of the District. Wetlands and natural areas could be preserved
by clustering residential units.
As mentioned in the Transportation Plan, development of District 13 must relate
to two transportation issues: 1) improvement of the Vine Hill Road/Highway 7
intersection, including access via the southern service road of Highway 7
and 2) construction of the Highway 62 Crosstown route from Highway 101 to
Interstate 494. In reviewing any development request for the area in question
the issue of access must be addressed."

At the 3 April Planning Commission meeting and the 8 April Council meeting,
Marvin and Judy Janicke made an informal presentation of their plans to use
the property located at 5580 County Road 19 for a motor home rental operation
(see staff report dated 30 March 1984). The general concensus of both the
Commission and the Council was that the proposed use was acceptable for the
site, but both groups expressed some concern as to the zoning actions
necessary to accommodate the proposal.
As previously mentioned the current Zoning Ordinance does not address out-
door rental facilities in any of the commercial districts. Perhaps the
most similar use to what the Janicke's are proposing is Ucar sales and
display areasU allowed in the C-2 and C-3 Districts. The City must decide
which zoning district is most appropriate for the proposed use, determine
whether the use should be allowed as a permitted or conditional use and
amend the text of the Ordinance accordingly.
The new Zoning Ordinance currently being studied does contain prov1s1ons
for uopen or outdoor service, sale and rental as a principal or accessory
use" subject to several conditions by conditional use permit within the
C-2 District.(see Section 200.20 Subd. 4e., pg 111-27). It would be ~airly
simple to adapt that section of the new Ordinance to the existing C-2
District. However, considering the proximity of the site to residentially
zoned property, it is suggested that the City consider a less intense
commercial district - specifically the C-1 District.
Concern has been expressed that allowing outdoor rental in the C-l District
would not be appropriate for sites which are currently zoned C-l. That
concern could be eliminated by adding a condition stating that outdoor
rental would not be allowed when the property abuts a single family zoning
district.

RECOMMENDATION
Ordinance 152 already allows a residential dwelling unit in a commercial
district by conditional use permit (see Exhibit A, attached). Exhibits B
and C, attached are proposed amendments to the C-1 and C-2 Districts,
respectively. Of the two.. al ternativesthe City is urged to consider the C-1
District.
Regardless of which district is chosen, it is recommended that approval be
contingent upon a landscape plan being submitted which will effectively
screen the recreational vehicles from view of surrounding residential
properties. While it is realized that existing vegetation will provide
much of the necessary screening, it is felt that additional landscaping
will be needed. Once the landscape plan has been approved, a bond should
be required for 150 percentofa bid by a certified nursery. The bond or
a letter of credit should be effective for two full growing seasons.

JUMAR Motor Home Leasing is a family owned and operated
business that leases "Class A" motorhomes to vactioners. We
have been in operation for one year. During that year, the
business operated for six months in Minnesota and six months in
Florida. We pride ourselves on our personal service and luxury
units. Our clientel consists primarily of families. We do not
now, nor intend to start selling any parts or vehicles. Our
business plan calls for the purchase of new units, a payback
of four to five years and the replacement of units at that time.
This will provide continuity and keep the luxury image.
We have a signed purchase agreement with Mr and Mrs Jim
Borchert for their home at 5580 County Road 19. The purpose
of purchasing this home is to allow is to reside and operate a
business at the same location. This will not only save us time,
but allow us to live in this beautiful home as well. We are
asking for a conditional use permit, a rezoning of the property
and/or a text ammendment to facilitate same.
We have appeared before both the Planning Commission
and the City Council to present this idea and appreciate the
suggestions and input from everyone.

APPLICATION FOR CONDITIONAL USE PERMIT,
TEXT AMMENDMENT AND ZONING CHANGE
5580 County Road 19 Shorewood
A plan is attached showing the location of all buildings, location
and number of parking spaces, circulation, elevations and driveways.
The proposed changes are: resurface the existing driveway, add parking
pads for a total of eight vehicles. These pads will be either
concrete block or rei forced concrete. By using pads instead of
full parking areas, the natural drainage will continue and the
site will maintain a residential atmosphere. From the street,
they should have limited visibility. The pads will be approximately
18" x 24" and will be located on the South side of the lot, maintaining
a fifty foot setback~ At this time, no parking is planned for
the North side of the site because of the natural drainage.
Anticipated growth is; 1984 three units, 1986 five units with
a maximum total of eight units by 1991. The pads will be added
only as required.
Live trees, shrubs and bushes now existing will be maintained
on all sides of the property. Conifers and other low shrubs will
be added as necessary to ensure ground level screening and privacy
for all neighbors. The appearance from county road 19 will be
esthetically pleasing, appearing as a "nonnal" residential piece.
The pool and back yard will be fenced as per code. Material
used will be cedar in the form of an off-set fence similar to the
one existing. This would be done immediately.
The room at the rear of the house that is currently the family
room would become office. This room has a private entry, allowing
use without disrupting a nonnal family living pattern. It cannot
be seen from the front of the property.
GA~AGE'
The on11lttructural change that is Plan~ is an addition
to the garage. We would like to raise the roof approximately three
feet and bring the building forward approximately four feet. This
would allow us to park the motorhomes inside the building for cleaning
and oil change. NO MECHANICAL WORK will be done on the premisis.
The most visible change will be the addition of an eleven foot over-
head garage door. There are no planned changes to the house proper.

SIGNING
We request that we be allowed a wooden sign, approximately
3'x51 with routed letters to be placed near the street. This
sign would not be lit and would blend with the area. It would
be similar in type to the Shorewood Nursery sign.
TIMING
Our current thirty-three foot unit is booked from June 30,
1984 to July 13, 1984. It is again booked from July 14, 1984 to
August 17, 1984. We anticipate a two day service and cleaning
time between bookings. The units will be on the site a minimum
amount of days. We have an agreement with Floyd Chapman of
Orlando Florida to rent the vehicles for us from November to
May. We anticipate continuing this practice. This means that
we will be operating in Minnesota for only half of the year.
The majority of our business is done by phone. Occasionally
a family will come to inspect the unit before renting, but this is
done on an appointment basis (since we both work full time) so we
are able to limit the traffic to a degree. We feel that by working
by mail and phone, the impact on the traffic pattern in Shorewood
will be limited.

consultants in an attempt to see if a consulting firm could produce a
methodology that cities could share to reduce costs in meeting the spirit
of the legislation. It was made clear that cities would have the option
of choosing to participate in the joint effort or withdrawing and doing
their own Comparable Worth study once a consultant had been selected.
The initial cost involved is estimated to be approximately $200.00 per
city.
A representative of your City did not attend the meeting on June 1, and
we would like to give you this opportunity to participate in this
procedure. If you wish to do so, please indicate by signing your name
at the bottom of this memo and returning it to Labor Relations Associates,
Inc., 7501 Golden Valley Road, Golden Valley, Minnesota 55427 as soon as
possible.
A committee of managers will be meeting this week to begin drafting
language for the RFP. If you have any questions about the discussion
