Dear Ms. Flynn:
It has come to the attention of the Council of the City of Shorewood
that there is a great deal of concern about the installation of a force
main along the south shore of Christmas Lake in Chanhassen. The Council
has discussed this matter with concerned residents of Chanhassen and our
City Engineer. The City at this time does not feel it has obtained
sufficient information to support Chanhassen citizen's recommendation
for a gravity line, but does support its concerns and would hope that
your Committee will recognize these concerns and not make a final
decision until all facts and information has been carefully studied.
We thank the Committee, in advance, for their recognition of concerned
citizens and your thorough investigation to best suit this system to
protect the ~nvironment in this area.

CALL TO ORDER
The regular meeting of the Shorewood City Council was called to order by
Mayor Rascop at 8:00 PM, Tuesday, May 29, 1984, in the Council Chambers of
City Hall.
PLEDGE OF ALLEGIANCE
The meeting was opened with the Pledge of Allegiance and a prayer by Mayor Rascop.
ROLL CALL
Present: Mayor Rascop, Councilmembers Gagne, Haugen, Shaw, and Stover.
Staff: Attorney Larson, Engineer Mittlesteadt, Planner Nielsen, Clerk Kennelly.
APPROVAL OF MINUTES
Gagne moved, seconded by Haugen to approve the minutes of the regular Council
meeting of May 14, 1984, as corrected. Motion carried unanimously.
NONCONFORMING USE - ZONING ORDINANCE TEXT AMENDMENT
ORDINANCE NO. 159
Planner Nielsen presented the second reading of the Zoning Ordinance Text
Amendment allowing variances for the expansion of nonconforming single-family
residential structures under reasonable conditions determined by the City Council.
The second reading was reviewed as revised from the first reading.
Haugen moved, seconded by Gagne to accept the second reading as originally drafted
ift the first reading. The Ordinance was adopted by Roll Call Vote - 4 ayes -
1 nay (Shaw).
8:00 PM PUBLIC HEARING - KEIFER VARIANCE
RESOLUTION NO. 28-84
The public hearing was opened at 8:40 PM for the purpose of obtaining a variance
to expand a nonconforming structure by adding a deck to the present structure
that will not increase the nonconformity. The public portion of the meeting was
closed by Mayor Rascop at 8:42PM without public comment.
Gagne moved, seconded by Rascop to approve the variance as requested. Variance
approved by Roll Call Vote - 5 ayes.

INFORMAL PRESENTATION - TRIVESCO
John Uban representing Trivesco rev ewed the changes that have been made in the
project since the last presentation
1) Multiple units reduced from 160 to 144.
2) Multiples will be moved further to the west, away from the existing
residential area, with lower density in the easterly buildings - 1.50 foot
setback from current residential area.
3) Ponding area enlarged.
4) 2.5 unit per acre density for overall project.
5) Reduction in commercial buildings to 4, plus a probabl~ restaurant ·
two-thirds of commercial used for retail and one-third office space.
No definite commitments have been made for any of the proposed commercial
area at this time.
Concerns from residents on the type of commercial zoning and uses that would be
allowed in that area. Planner Nielsen explained that the P.U.D zoning would
control the type of uses as determined by the Council in an agreement with the
developers. The uses would not necessarily follow along any of the existing
commercial zoning uses, the limitations would probably be more restrictive.
Council questioned sewer capacity and its preparation of an Environmental Assess-
ment Worksheet (E.A.W.). Mr. Uban said an E.A.W. would be requested at the
conclusion of the P.U.D. process. Engineer Mittlesteadt confirmed. the sewer
capacity of the current system is more than adequate to handle this project.
Mrs. Vogel of 19795 Excelsior Blvd. wanted to know what would happen if the
existing wells went dry because of the project. Engineer Mittlesteadt assured
her that the Jordan Strait contained enough water not to even be affected by this
project. The Jordon Strait is much deeper than the strait currently being used
for residential wells in the area. Mrs. Vogel also questioned "Why the developer
wanted to put so many people' in that area?". Mr. Uban indicated that there is a
need for that type of housing. ~onnie Workman of Deephaven disagreed with the
proposed intersection with stop lights and with any proposed restaurant construction.
Paul Seifert of 5515 Radisson Entrance questioned a traffic study and how large of
a area would be studied. Study will extend from Highways 7 and 101 to Christmas
Lake intersections, and north and south from Vine Hill Road in Deephaven to
Highway 101 south. Stephen Larson of 20435 Radisson Inn Road questioned the
type of restaurant, parking and traffic problems. Mr. Uban indicated a high
quality, sit-down, full service restaurant with liquor license, not a "bar scene"
type. Parking space available with a restaurant with limited shared parking area
available. Mrs. Vogel wanted to know who would have control over the condo's
and commercial projects after completion. Mr. Uban stated the condo's would be
individual purchases and the commercial would probably have an "investors group".
Rascop assured the residents that regardless of the ownership, the restrictions
placed on the project by the P.U.D. would always control the area uses.
Mayor Rascop thanked the audience for their comments and informed them that the
Public Hearing on the Comprehensive Plan Amendment aqd Rezoning will be held at
8:30 PM on Monday, June 11, 1984. All written and public comments will be
accepted at that time.

RAPID OIL CHANGE VARIANCE
RESOLUTION NO. 29-84
Attorney James Steilon and Ed Flaherty, President of Rapid Of 1, requested a
reconsideration of their variance request at the Council meeting of May 14, 1984.
The Council accepted the request and asked the City Attorney to clarify the
necessary vote needed to accept or deny a variance request. Attorney Larson
indicated that no definite law was set in reference to 3/5 or 4/5. vote ruling
and that the City would be able to defend its current requirement of a 4/5 vote.
A report was also received from Planner Nielsen on the usable area of this lot
configuration. Without variances, approximately 1000 square feet could be built
on, (e.g. a 20 X 50 foot building), and meet the setback requirement. Mr. Nielsen
felt that the lot configuration did create a "hardship" that would deem the lot
basically unusable without a variance being granted. Mr. and Mrs. Vogel had their
questions answered by Mr. Flaherty in reference to the amount of traffic flow
and ground wat~r run-off and sanitary waste disposal answered to their satisfaction.

ATTORNEY'S REPORT
Proposed Controlled Substance Ordinance
Council received the proposed Ordinance and the report from Police Chief Young
on the Ordinance. After discussion, Haugen moved to table indefinitely.
Motion carried.
Rudolph Miller Tennis Court Request
Mr. Miller of 26710 Edgewood Road submitted a revised request to place his
tennis court 50 feet from the tarred surface of Edgewood Road. Attorney Larson
indicated that the City had no additional right-of-way and we did not own any-
thing more than the tarred surface. Council instructed the building inspector
to issue the permit in accordance with City regulations.
ADMINISTRATIVE REPORT
Clerk Kennelly reviewed the activities of the International Municipal Clerks
Conference held in San Deigothe week of May 19th, 1984. Many thanks were given
to the Council for the opportunity to attend this Conference.
MAYOR'S REPORT
Assessor Discussion
Hennepin County submitted a letter notifying us of the cost of $20,000 for
assessor fees for 1985. Shaw di.scussed with Manager Madigan from Excelsior the
advantages and disadvantages of obtaining an "in house" assessor. Council
instructed the Clerk to place an ad for an "in house" assessor and inform the
County of our interest in bidding out the position.

Mayor's Report, continued:
Finance Department Memo
A request from the Finance Department informing the Council of an error in the
budget of additional funds of $29,000 over what is needed to pay the Metro
Waste Commission for deferred payments was recommended to be transferred to off-
set the water fund deficit. Council felt this would not allow an accurate
accounting of this fund.
Finance Director Beck informed the Council of the increasing nonpayment of
taxes which includes nonpayment of special assessments. She would like to
request a special audit of the special assessment funds. $2500 has been
budgeted for a bond study. .
RESOLUTION NO. 32-84
Haugen moved, seconded by Stover to approve the expenditure of $2000 for this
special assessment audit, if additional funds are needed, a later request will
be needed. Motion carried.
Clarification of Benefits
Clarification of what type of benefits can be covered by CDBG - Codification of
Ordinance, for Julie Story will be reviewed with Larry Blackstad, Administrator
of CDBG Funds.
Rascop moved, seconded by Haugen to reallocate funds from the General Budget to
cover the time Story has charged against general officeproc~dures with the
recommendation to have more time put in on the Codification procedure.
Motion carried.
COUNCIL REPORTS
Liquor Store Request
Council approved new signage in accordance with the City Ordinance for Shorewood
Liquor Store I. Motion carried.

rezoning to P.U.D. on the Trivescoproposal.

Finance Committee Report
Committee questioned whether a new census should be pursued to obtain additional
road aide monies if a population of over 5,000 can be proven and submitted to
the State by October 1, 1984.. Needs Assessment Policy on road is not completed
and the October 1, 1984 deadline could not be met.
The Committee would like direction from Council. Council suggested adding more
members. Michael Fonte was suggested. Review Audit Report and compare 1983
Budget to 1984. Also do additional work that would not require the Finance
Director!l; time.
Liquor. Lease - Store II
Council reviewed the lease submitted by Ryan Construction for the lease of
Store II. Attorney Larson to review and make a recommendation.
Water Policy Discussion
Council discussed the criteria for implementing a "Water Policy". Areas of
of importance will be: financing; user charges; cost of improvement; bonding
capacity; etc.
Suggested conditions for extensions to water system:
1) New developments would be required to supply municipal water connections
or an adaptable central system where a development can support 10 or more lots.
2) Municipal system extensions for developed areas would be made where
economically feasible as petitioned by % (suggested percentage) of the
property owners in that area. These areas would be required to hookup and
would all be assessed for the improvement.
3) As water extension pass by existing homes to new developments, these
existing homes would be assessed for trunk lines but not assessed for
laterals until the owners want to accept the assessment or until they choose
to hookup to the system, no connections will be made without being assessed.
Council will continue to discuss further policies prior to implementation.

The Audit Review meeting for the City of Shorewood was called to order
at 7:00 PM, Tuesday, May 29, 1984 in the Council Chambers. Present
were Mayor Rascop; Councilmembers Gagne, Haugen, Shaw, and Stover; also
staff members, Finance Director Beck and Clerk Kennelly.
Jim Maiser, City Auditor with Matthias, Roebke & Maiser reviewed the
Audit letter and explained and answered questions asked by the Council.
The Liquor Store audit will be reviewed at a later date.

Enclosed please find an application for a fence permit for property
located at 5235 Shady Lane (see Site Location, Exhibit A, attached).
The request is explained in a letter from the applicant to the City
Council, dated 5 June 1984 (see Exhibit B, attached). A site sketch
(Exhibit C) illustrates the following:
South boundary - 6 foot cedar privacy fence.
East boundary and 89\ feet of the north boundary ~ 42 inch chain link fence.
Interior fence from north boundary to house - 42 inch cedar privacy fence.
Based upon the proposed plan and the provisions of Ordinance. 107, the
request requires Council approval and signed approval of the neighbors
adjoining the 6 foot portion of the fence (see Exhibit D, attached).

BACKGROUND
Mrs. A.T. Ridinger, 5530.Howard's Point Road, has requested approval
of a simple subdivision to divide her property into two lots. The
property is located just north of Edgewood Road on the west side of
Howard's Point Road (see Site locatipnmap, Exhibit A, attached).
Exhibit B illustrates how the lot is proposed to be divided.
The property is ~oned R-t, Single Family, contains approximately 110,000
square feet in area and is occupied by a single family residence.
ANALYSIS/RECOMMENDATION
Mrs. Ridinger's request is one of the easiest with which the Gityhas
had to deal in quite some time. Despite the house being located >too
near the water, both lots will conform to the area, width and depth
requirements of the R-1 District. There are, however, two minor issues
which should be addressed by the City_
1. Howard's Point Road is substandard in right-of-way width._ The
half-section map shows the r.o.w. as 40 feet. As in past
subdivision requests, the City should acquire the necessary ease...
ments wherever possible to bring the r.o.w. up to City standards.
Since it would not be fair to acquire the entirelO feet needed
to make Howard's Point Road 50 feet wide from the applicant's
property, the. City .should acquire five feet.. at this time. This
should not diminish-the required area of either lot.

Commissioner Leslie asked about the old shed on the piece of property to be divided
and was told it will come down.
Commissioner Reese asked about the sewer hookup. Planner Nielsen said there shouldn't
be any problems.
Reese moved, Benson seconded, to approve the subdivision request subject to the
requi.rements in the Planner's Report. Motion carried unanimously.
VARIANCE REQUEST - REAR YARD SETBACK ~ RICHARD GAY - 5480 COVINGTON ROAD .:#-7.
Mr. Gay appeared before the Commission to request a 15 foot rear yard setback to .build
a new home on his. property. He presented a model of the house and lot. He said one
of the reasons for his reque.St is the existing driveway easement through the Southeast:
corner of the lot, which limits the useful building area. He also mentioned the
following:
The area where he wishes to build is the only open area. He would lil<e.topreserve
the trees which provide privacy, wildlife and a natural noise barrier~
With the house situated this way, the sewer can be run ina straight<150 line to
the house.
An NSP utility easement of 10' to 15' runs along the southerly lot line~
The existing land contours provide a perfect site for the plannedwalk9ut.
The requested variance allows for the best all around lot use including the south
side where a double garage is eventually planned for storage of Classic cars.
The garage would be installed among the trees in a natural setting.
This is an upper bracket area where homes and lots are not considered conventional.
He wishes to retain as much of the natural surroundings as possible while blending
t!te structures into their surroundings.

Mr. Gay did mention the fact that the Peterson property, with 5 new homes going in,
abuts his property on the westerly side.
Planner Nielsen mentioned that the Peterson propery has covenants involved and
suggested a covenant on Mr. Gay's property.
Leslie moved, Boyd seconded, to recommend to Council to approve the variance for the
15 foot rear yard setback on the condition that the front yard setback is increased
to 65 feet with the requirement that there be no assessory use, building or outSide
storage in the back yard setback area. Motion carried unanimously.
VARIANCE REQUEST - EXPANSION OF A NONCONFORMING STRUCTURE - KEITH BEDFORD - #- g'
24375 WOOD DRIVE
Mr. Bedford was present to explain to the Commission that he wished to build a 14'
x 24' deck on the back of his house.
Planner's Report noted that the proposed deck win conform to the setback require-
ments of the current standards and will not increase the nonconformity of the existing
house.
Benson moved, Reese seconded, to recommend to Council to approve the variance requested
for the expansion of a nonconfroming structure. Motion carried unanimously.

Acting Council Liaison Haugen announced that the Council feels it will be of great
value if the Planning Commission members that cannot attend the meeting will can

8:30 PUBLIC HEARING- COMPREHENSIVE PLAN AMENDMENT AND CONCEPT STAGE OFA PLANNED
UNIT DEVELOPMENT (P.U.D.) -SHOREWOOD OAKS
Mr. Geoff Martin, of Howard Dahlgren Assiciates, made the presentation for
Shorewood Oaks. As a result of the April 3rd meeting, they are now proposing
the following:
96 single family units, .29townhouses,4.4 acres of open space with 30 foot
trail easements to Freeman Park, 2 entrances - State Highway 7 and Strawberry
Lane, and a dedication of an additional 17 foot r.o.w. for the future upgrading
of Strawberry Lane. Streets will have a 50 foot r.o.w.and a 30 foot tarred
surface. The density is 3.03 per acre. a 6' to 8 '.berm will be located along
the east property line as a buffer between Shorewood Oaks and Freeman Park.
They are requesting a 5 foot garage setback and a 10 foot house. setback.
Shorewood Oaks agreed to fillow all City Engineer Norton's recommendations
regarding sewer and water.

BACKGROUND
Mr. Richard Gay has requested a 15 foot rear yard setback to build a
new home on his property located at 5480 Covington Road (see Site
Location map, Exhibit A, attached). The property is zoned R-1, Single
Family Residential and is currently unoccupied except for a blacktop
driveway through the property to the lot ~outh.
The applicant cites the 20 foot easement, over which the driveway is
located, as the primary reason for the variance request. Exhibit B
shows his proposed site plan in relation to required and requested
setbacks.
A'NALYSIS!RECOMMENDATION
As shown on Exhibit B, the applicant wishes to place t.heproposed house
15 feet into the required 50 foot rear yard in order to keep the house
15 feet away from the existing driveway easement. Despite two factors
which tend to support the variance request, the variance is largelY
the result of the particular design of the proposed house.
One of the applicant's primary reasons for reql.lesting a variance is to
create some space between the house and the driveway. It should be noted,
however, that in doing so the house is moved 15 feet closer toa street
which will serve five homes in the Robert S.C. Peterson Addition. The
Peterson project is the second factor favoring the variance. Houses
in that project will be clustered and have been allowed to be as. close
as 35 feet from the r.o.w.

In spite of these factors the question must be asked as to whether a
reasonablyslzed home could be built within the buildable area of the
lot. The answer is that,yes, a house with a more conventional floor
plan could easily fit within the setbacks. With some rearrangement,
the proposed floor plan even fits (see Exhibit C).
Thus, despite the existing driveway and the reduced setbacks in the
Peterson project, the applicant's request does not meet the test for
variance approval. While it is suggested that approval not be granted,
if for some reason the City feels the request is reasonable, then the
front yard setback should be increased to 65 feet, in which case the
applicant will not be granted greater privilege than other property
owners in theR-1 District.

BACKGROUND

Mr. Keith Bedford has requested a building permit,to.add a deck to th~
rear of his house, located at 24375 Wood Drive (see Site Location map,
Exhibit A, attached). As can be seen on Exhibit B, the existing house
is approximately 9 feet from the easterly lot line and 26 feetf,l;om the
street right-of-way. Since the setbacks forthe'R-1 ZoningPistdct in
which the property is. located are 50 feet for the front yard and 10 feet
for side yards, the applicant's house constitutes a nonconforming
structure. Section 10 of our current Ordinance states that nonconforming
structures shall not be expanded. As a consequence Mr. Bedford has
requested a variance.
ANALYSIS/RECOMMENDATION
According to our records the applicant's house was built in 1972 at
which time the zoning standards for single family residential were
similar to our currentR-2,District requirements. The year after the
house was built, the City changed its standards but neglected to p.roperly
zone the area in which Mr. Bedford's home was located. This does not,
howeyer, explain why the house ended up being 26 feet from the road
instead of 35 feet. which was required in 1972.
As you know the proposed1"lew Zoning Ordinance provides .more flexibility
with regard to expansion of nonconforming single family homes. Specifi-
cally, such structure,s maybe expanded, by conditional use permit, as
long as the nonconformity is not increased. As an interim ,"asure, until
the new Ordinance is adopted, the City has adopted Ordinance No. 159
allowing such situations to be handled through a variance procedure.

The applicant's request is a good example. of how the new Ordinance
proVisions are intended to be used. The proposed deck will conform to
the setback requirements of the current standards and will not increase
the nonconf()rmity of the existing house.
If the request was being processed under the terms of the new Ordinance,
one of the conditions to be considered.would bea setback trade...off.
That is, whereagivansetback isreducedbelowthat which is required,
the City may require additional setback on the op.posite $ide. In .
Mr. Bedford's case, for example, instead of a 50!oot rear yard. 'the
City could require that a 74 .footrear yard setback be maintained to
make up for the 24 foot setback reduction in the front. Similarly,
an 11 foot setbatkcould be required on the westerly side to makeup
for the 9 foot setback on the easterly side. The. intent of such
requirements would be to maintain the amount of open space required by
the Ordinance and that in granting the vai-iance (or conditional. use .
permit) the City would not be allowing the applicant more rights than
other property owners within the same zoning district.'
In Mr. Bedford's particular case, these additional requirements may be
somewhat academic. Due.to the fact that the lot was platted into a
pond, an automat:icsetback of approximately 220 feet is established
at the rear of the lot. Also, given the proximity of the northwest
corner of the house to the street, expansion of house westward is quite
limited.
Based upon the preceding, it is suggested that the Planning Commission
recommend approval of the. variance with no special conditions attached.

NOTICE IS HEREBY GIVEN that the City Council of the City of Shorewood will hold
a Public Hearing in the Council Chambers of the Shorewood City Hall, 5755 Country
Club Road, Shorewood, Minnesota, on Monday, 11 June, 1984 at 8:30 P.M. or as soon
thereafter as possible. The purpose of the Hearing is to consider a request by
Trivesco, Inc. for a Comprehensive Plan amendment and rezoning from R-1, Single
Family Residential, to P.U.D., Planned Unit Development for property between
State Highway 7 and Covington Road west of Vine Hill Road, said property described
as:
Lots 31, 32, and 33, except Cartway, Auditor's Subdivision No. 141; and
that part of Government Lot 4, Section 36, Township 117, Range 23, described
as commencing at a point on the north line of said Government Lot 4, distance
308.5 feet east from the southeast corner of the northwest ~ of the northeast
~ said Section 36, thence south at right angle with said north line, distance
259.91 feet then deflecting right 107 degrees 32 minutes, 21 seconds, distance
474.18 feet, thence deflecting left 26 degrees 28 minutes, 21 seconds, to the

Dear Shorewood City Council Members:
On the 11th of June, there will be a Public Hearing regarding the
Trivesco Development on the frontage road of Highway 7. Our neghborhood
has significant concerns regarding this possible future development.

There is much doubt in our minds as to whether commercial
development on the frontage road is really necessary. ,
If a restaurant facility of the type of Cattle Company or
Chi-Chi's is allowed, it certainly does not fit in with the
residential character of our neighborhood. Do we want or need
a restaurant that will serve such a large (and non-Shor:ewood)
population?
The restaurant will probably want to use the parking lots of
the other three buildings, thereby increasing even more its
size of clientele.
You may be aware that the State Legislatune is toying with
a bill to allow liquor establishments to remain open until
3:00 a.m.
Lqstly, we all know that traffic on Covington Road and Radisson
Road has been a problem for many years, and there is significant
travel by people who do not live in the neighborhood. This
type of restaurant facility would certainly make a bad situation
worse.

I and the neighborhood area urge you to look carefully at this proposal.
We certainly welcome additional residential neighbors. However, we are
not interested in the full service liquor-restaurant facility in our
neighborhood that would prima~serve people coming off of Highway 7.

7. COMPREHENSIVE PLAN AMENDMENT TEXT
The addition of the commercial land use designation to the upper nine
acres of the Trivesco land is reasonable because the traffic can be
handled safely and efficiently without encumbering residential streets
using the proposed collector and Highway 7 intersect~on as the main means
of ingress and egress. The land is not suitable for residential because
of the poor soil conditions and the close proximity of the highway.

RE: PROPOSED WATER SYSTEM FOR THE SOUTHEAST SECTOR, CITY OF SHOREWOOD
Dear Ladies and Gentlemen,
Installation of a community water system appears to be both economically and
socially the most responsible act the City of Shorewood could undertake. My name is
Eric Canton. I speak for Robert Sommer and the other owners of the proposed
Covington Vine Ridge residential development site located at the intersection of
Covington Road and Vine Hill Road. The Covington Vine Ridge site is approximately 42
acres in size.
Individual men and women, families, and empty-nesters have all
availability of quality housing in a price range they could afford.
Shorewood has recognized the importance of these needs as they have
Shorewood.
Your approval of our concept and development stage plans reflect your
recognition of the need to accomodate growth on a planned and secure basis, mindful
of the standards for structural and aesthetic quality that have been the hallmark of
Shorewood throughout its history. If you decide in favor of a municipal water system
to serve this section of Shorewood, your decision would be socially responsible
because it reflects the need to provide a community service to residents in a manner
that permits the greatness amount of investment on the part of an individual
homeowner to be in the aesthetic standards - the quality of life reflected in his
shelter.

At the same time, your support of this water system will also reflect economic
responsibility, in that it allows the economy of scale to reduce the cost per unit
for water to an affordable level. The economic impact of individual wells, as an
example, we suspect, would increase the price on these units to the point that they
would not be competitive with units of comparable size and quality of construction
now being built in the City of Chanhassen, only a short distance away.
Shorewood has historically sought first to create an umbrella of order for a
city that grew up in an entirely laissez faire environment, as did so many
communities surrounding Minneapolis and St. Paul. It sought to reflect the mood of
the pendulum's swing in favor of very conservative and single-minded housing policies
that were compatible with the economic realities of more affluent times.
You are responsible and have shown the wisdom to bring Shorewood forward to
address new economic realities, new business, and new shelter realities that suffer
from events as far away as Argentina and the Middle East.
You will steer your ship wisely through these turbulent seas by accomodating the
changing needs of your citizens. Another step compatible with those wise decisions
you have already made is the implementation of a water system that continues your
strong sense of social and economic responsiblity.
