08-068CITY OF SHOREWOOD RESOLUTION NO. 08-068 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR THE EXPANSION OF MINNEWASHTA ELEMENTARY SCHOOL WHEREAS, the Mimletonka Public School District (Applicant) is the owner of real property located at 26350 Smithtown Road in the City of Shorewood, County of Hennepin, State of Minnesota, legally described on Exhibit A, attached; and WHEREAS, the Applicant proposes to expand the existing school building in two phases to accommodate population growth within the school district; and WHEREAS, Phase I improvements include building new administrative offices on the south side of the building, remodeling existing space to create two additional classrooms, and adding two more classrooms to the southwest corner of the building; and WHEREAS, Phase II improvements include additional classrooms and a new gymnasium at the northwest corner of the building; and WHEREAS, schools are allowed by conditional use permit in residential zoning districts and the Applicant has applied for a conditional use permit to enlarge the school; and WHEREAS, Applicant's request was reviewed by the City Plaimer, and his recommendations were duly set forth in a memorandum to the Planning Commission, dated 13 September 2008, which memorandum is on file at City Hall; and WHEREAS, Applicant's request was reviewed by the City Engineer, and his recommendations were duly set forth in a memorandum to the Planning Commission dated 16 September 2008, which memorandum is on file at City Hall; and WHEREAS, after required notice, a public hearing was held and the application was reviewed by the Planning Commission at its regular meeting on 16 September 2008, the minutes of which meeting are on file at City Hall; and WHEREAS, Applicant's request for a conditional use permit was considered by the City Council at its regular meeting on 22 September 2008, at which time the Planner's memorandum, the City Engineer's memorandum and the minutes of the Planning Commission were reviewed and comments were heard by the Council from the City staff. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT district. The Subject Property is located in an R-lAsing1e-family residential zoning 2. The Subject property contains approximately 23.2 acres of land. 3. The Applicant's Phase I plans propose to add new administrative offices at the front of the building, remodel existing offices into classroom space; and add two new classrooms to the southwest corner of the building. 4. The Applicant's plans include a redesign and reconstruction of the parking lot, located in front of the building, increasing parking from 26 spaces to 42, including the 11 spaces that serve as a drop-off and pick-up area for parents who drive their children to school. 5. The Applicant's Phase II plans propose to add additional classrooms on the west side of the building and a new parking lot to be located on two parcels of land, located to the west of the existing parking lot. 6. The Applicant has submitted a landscaping plan showing additional trees to be planted around the perimeter of the new parking lot, which plan is attached hereto as Exhibit B. 7. The Applicant's plans include enlarging the storm water pond in the northwest corner of the site to accommodate the proposed addition and revised front parking lot and an underground storm water vault system to accommodate runoff from the new parking lot. CONCLUSIONS A. Based upon the foregoing, the City Council hereby grants the Applicant's request for a conditional use permit for the Phase II improvements, subject to the following: 1. Grading, drainage and erosion control shall comply with the recommendations of the City Engineer and the Minnehaha Creek Watershed District. 2. Landscaping, as shown on Exhibit B, shall be installed and maintained by the School District. The Applicant shall submit an overall master plan for the site, showing existing and proposed buildings, parking, recreational facilities wetlands and ponding. 4. Parking lot lighting shall be controlled to turn off at 10:30 P.M. The two parcels acquired by the School District shall be legally combined with the rest of the school property. -2- B. The City Clerk is hereby authorized and directed to provide a certified copy of this Resolution for filing with the Hennepin County Recorder or Registrar of Titles.
