The City Council of the City of Shorewood (City
Council) does hereby ordains as follows:
Section 1. Definitions_ The following terms "
whenever used in this Ordinance shall be inter-
preted to mean:

Section 2. Intent. It is the intent of this interim
ordinance, pursuant to Minnesota Statutes §
462.355, subd. 4, to allow the City of Shorewood
sufficient time to complete the update of its com-
prehensive plan. This interim ordinance is adopted
for the purpose of. protecting the planning process,
the health, safety and welfare of the citizens and
property of the City of Shorewood.
Section n 3 Tempm= Prohibition. Pending the
completion of the update of the comprehensive
plan, no application shall be accepted, processed,
or approved for a subdivision within the City of
Section 4. Effectiv Date. This ordinance shall
take effect from and after its passage and publica-
tion and shall remain in effect until November 14,
1994, unless extended by adoption of resolution on

The City Council of the City of Shorewood (City
Council) does hereby ordains as follows:

Elderly Housing: A dwelling or group of
dwellings where the occupancy is restricted to
persons sixty -two (62) years of age or older, or

sons" under the Federal Fdir Housing Act and
complies with the requirements of Section
1201.03, Subd. 20 of the Shorewood Zoning
Ordinance.
Section 2. Intent. It is the intent of this interim
ordinance, pursuant to Minnesota Statutes §
462.355, subd. 4, to allow the City of Shorewood

The City Council of the City of Shorewood, Minnesota,
ordains:
Section 1: Section 902.04 of the Shorewood City Code
is amended as follows:
VEHICLE RESTRICTIONS: Except
police officers or duly authorized and uniformed
snow patrol personnel in performance of their
duties, no person in a City park or recreation area
shall:
Subd. 5. Operate .a motorized vehicle in
excess of 15 miles per hour.
Section 2. This Ordinance shall be in full force and

AN ORDINANCE ESTABLISHING
A DRY HYDRANT FIRE
PROTECTION UTILITY DISTRICT
The City Council of the GSty of Shorewood,
Minnesota, does ordain as f aws:
Section 1: The City of Shorewood Code of Or-
dinances Title 900 is amended to add Chapter
906, as follows:
906.01 ESTABLISHMENT OF UTILITY
- DISTRICT: The City does hereby establish a
dry hydrant fire protection utility district to
provide imp water availability for pur-
pases of fire protection of persons and

906.02 IMPROVEMENTS: The City may

The construction shall be conducted under the
direction of the City Engineer in accordance
with City standards and procedures for award -
ing construction contracts. The city shall own
and maintain the dry hydrant system.
906.03 FEES: The City Council may, upon
notice a d ppuublication to duly affected proper
ty owners, by resolution, establish a utility fee
to pay for the cost of the construction and in-
stallation of a dry hydrant rue protection utili-
ty system.
906.04 PAYMENT OF CHARGE:
Subd. 1. BILLING: Statements for
charges for dry hydrant fire protection utili-
tyy use and service for a quarterly period
shall be mailed to each mope y owner or
user on or before the tenth day nand shall be
due and payable on or before the last day of
the months of January, April, July and Oc-
tober following the quarterly period covered
by the statements.
Subd. 2. DELINQUENCIES: After the
last day of the month in which payment is
due, a penalty of ten percent (10 %) of the
unpaid account balance will be assessed and
added to the amount due on the account.
906.05 ESTABLISHMENT OF TAX
LIEN: Any past due dry hydrant fire protec-
tion utility fees in excess of ninety (90) days
past due on October 1 of any year may be cer-
tified to the County Auditor for collection with
real estate taxes in the following year pursuant
to Minnesota Statutes, Section 444.25. In addi-
tion, the City shall have the right to bring a
civil action or pursue legal remedies to collect
unpaid charges.
Section 2. This Ordinance shall be in full force
and effect from and after its passage and
publication.

AN ORDINANCE AMENDING SECTION 501.03 OF THE
SHOREWOOD CITY CODE RELATING TO OPEN BURNING &
AMENDING CHAPTER 1301 BY ADOPTING AN OPEN BURNING PERMIT FEE
AND AMENDING THE POLICE AND FIRE ALARM PERMIT FEE
THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA, ORDAINS:
Section 1: Section 501.03 of the Shorewood City Code is hereby amended by repealing
Section 501.03 in its entirety and adopting the following:
Subd.1 Purpose: The City Council has determined that burningis not a necessity
and adequate refuse collection service is available in the City, and therefore the rules
4 and r egulations herein promulgated are necessary for the health and welfare of the
citizens of the City.
Subd. 2 Definitions: As used in this Chapter, the following terms shall have the
following meanings:
j A. Recreational Fire or Camp Fire: "Recreational Fire' or "Camp Fire"
f meals a fire set for cooking, warming, recreational or ceremonial es,
I which is not more than three (3) feet in diameter by three (3) feet and

2) Recreational Fire Burn Requirements: When a camp fire is used for
recreational purposes, it must be ignites!! with an approved starter using
dry clean wood; producing little detectable smoke, odor or soot beyond the
property line; conducted with an adult tending the fire at all times; ex-
tinguished com pletely before quitting the occasion; and respecting weather
l cenditions bas, burning bans, and air quality so that nuisance health
r' or safety hazards will not be created. Mobile cooking devices such as
manufactured hibachis, charcoal grills, wood smokers, and propane or
natural gas devices, are not defined as camp or recreational fires.
B. Open Burning: "Open Burning or `Open Fire" means a fire burning

D. Wood: "Wood" means dry, clean fuel only, such as twigs, branches,
limbs "presto logs ", charcoal, cordwood or untreated dimensional lumber.
, " Wood" does not include wood that is greet' with leaves or needles, rotten, wet,
oil soaked, or treated with paint, glue or fives. Clean pallets may be
used for recreation fires when cut into (3) foot lengths.
E. Burners: "Burners" or formerly called burn barrels are prohibited.
F. Burning Permit: A permit issued by the City Fire Marshal and the Min-
nesota Department of Natural Resources ca its representative authorizing fires
exempted from the general provisions berg, and setting conditions therefore.
Subd. 3. Open and Recreational Burning Prohibited Without a Permit: From and
after the effective date of this ordinance, except as herein otherwise provided, open
burning and recreational burning shall be prohibited within the City of Shorewood.
Subd. 4. Exemptions: Open burning and recreational burning of the types, and sub-
ject to the conditions as hereinafter stated, shall be exempt from the prohibition of Subd.
3 of this ordinance by permit only:
A. Recreational fires as defined herein.
B. Non - Recreational Open Burning: Fires under managed supervision for
which a �rn� permit has been obtained from the City Fire Marshal and,
where required by State law, from the Department of Natural Resources, but
r limited to the following:
k 1) Fires �rposely set for the instruction and training of public and in-
dustrial firef�ig6tirg personnel
I 2) Fires set for the elimination of a fire hazard which cannot be abated
by any other practicable means.
3) g Fires purposely set for forest, prairie grass conservation and game

and in accepted agricultural land management practices.
C. Exemption to conduct fires under this section does not excuse a person
from the consequences, damages or injuries which may result therefrom nor
does it exempt peson from regulations promulgated by the Minnesota
Pollution Controll l ency or any other governmental unit exercising jurisdic-
lion in mattes of pollutton or fns hazard regulation.
Subd. 5. Rules adopted by Reference: Minnesota Statutes 88.02-0.22,88.75, 86.76 and
Minnesota Uniform Fire Cade are hereby adoptet1hy reference and made apart of this
ordinance as if fully set forth at this point.
Subd. 6. Fees: Amy pe to obtain a permit for open burning shall pay the re-
quired fee, as established herein and amended from time to time by the Ci yf + Council`.
The City Fire Marshal shall have authority to waive the fee required under Subd. 4 of
this ordinance if deemed to be in the best mkrest of the health, safety and welfare of
the citizens or far the regeneration of vegetation.
Section 2 : Chapter 1301 of the Shorewood City Code is hereby amended by
adopting the following:
