ORDINANCE NO. 55
An Ordinance Amending Ordi-
nance No. 44 Being An Ordi-
nance Adopting Uniform Build-
ing Code Short Form 1967 Ad-
dition By Reference.
The Village Council of the Vil-
lage of Shorewood does ordain:
Section 1. That Section 1 of
Ordinance No. 44 is hereby
amended to read as follows:
"Section 1. Building Regula-
tions. The Uniform Building
Code Short Form 1967 Addi-
tion, three copies of which are
on file in the office of the Vil-
lage Clerk, is hereby adopted
as the Building Code for the
Village for the purpose of reg-
ulating the construction, alter-
ation, moving, demolition, or
repair, and use of any build-
ing or structure within the Vil-
lage. Every provision contained
in this Code is hereby adopted
and made a part of this Ordi-
nance as if fully set forth here-
in; except, however, that the
minimum building permit fee
for construction or work for
which a permit is required
shall be $6.00."
Section 2. Effective Date. This
Ordinance becomes effective from
and after its passage and publi-
cation.

Village of Shorewood Ordinance No. 54
An Ordinance Regulating the Use
of Snowmobiles in the Village
of Shorewood and Providing
Penalties for Violations Thereof.
The Village Council of the Vil-
lage of Shorewood does ordain:
ARTICLE I
INTENT
Section 101. It is the intent of
this ordinance to supplement the
Laws of the State of Minnesota,
Chapters 168 through 171, Minne-
sota Statutes, with respect to the
operation of certain motor ve-
hicles commonly called snowmo-
biles.
ARTICLE II .
DEFINITIONS
The following words and phrases
when used in this ordinance have
the meaning as set out herein.
Section 201. "Operate."
Operate means to ride in or on
and control the operation of a
snowmobile.
Section 202. "Owner."
Owner means a person other
than a lien holder, having the
property in or title to a snowmo-
bile entitled to the use or posses -
-sion thereof.
Section 203. "Operator."
Operator means every person
who operates or is in actual phy-
sical control of a snowmobile.
Section 204. "Roadway.
Roadway means that portion of
a highway improved. designed or
ordinarily used for vehicular traf-
fic.
Section 205. "Snowmobile. "
Snowmohile treans a self -pro-
pelled vehicle desi, f(u travel
primarily on snow or ice or upon
a natural terrain steered by
wheels. skis or n;nners.
ARTICLE III
OPERATION ON VILLAGE
STREETS OR PUBLIC
PROPERTY
Section 301. Public Village
Streets and Public Property.
No person shall operate a snow-
mobile upon public property or
frozen surface of lakes within the
Village of Shorewood except as
provided in this ordinance. The
Village Council may by resolu-
tion, prohibit the operation of
snowmobiles on the roadway of
Village streets in the Village of
Shorewood when in the opinion
of the Village Council public
safety and welfare so requires.
Section 302. Direct Crossings.
A snowmobile may make a
direct crossing of a village street
or highway provided:
1) The crossing is made at an
angle of approximately 90 de
grees to the direction of the high-
way and at a place where no ob-
struction prevents a quick and
safe crossing; and
(2) The snowmobile is brought
to a complete stop before crossing
the shoulder or main traveled
l.ray of the highway: and
(3) The driver yields the right -
t/ way to all oncoming traffic

hayard; and
() In crossing a divided high -
way, the crossing is made only
at an intersection of such high-
way with another public street
or highway.
Section. 303. Emergency Use of
Snowmobiles.
A snow wobtle may be operated
upon any village street in an
emergency k'uring the period of
time when avid at locations where
snow upon the roadway renders
travel by automobile impractical.
Section 304. Highway Traffic
Act.
All provisions of the MShway
Traffic Regulation Act, Chapter
169 of Minnesota Statutes, shall
apply to the operation of snow-
mobiles upon streets and high-
ways, except for those relating
to required equipment, and ex-
cept those which by their nature
have no application.
Section 305. Snowmobile Reg-
istration.
No snowmobile shall be oper-
ated on public streets or public
land or frozen surface of lakes
within the Village of Shorewood
without having such a snowmo-
bile registered as provided for in
Section 168.842, Minnesota Stat-
utes.
Section 306. Operator's Driver's
License.
No snowmobile shall be oper-
ated on public streets of the Vil-
lage of Shorewood unless the op-
erator shall have a valid motor
vehicle driver's license issued to
him by the State of Minnesota.
or shall be accompanied by a li-
censed driver who is actually oc-
cupying a seat in the vehicle.
ARTICLE IV.
OPERATIONS GENERALLY
Section 401. Operations Gen-
erally
It shall be unlawful for any
person to drive or operate any
snowmobile in the following un-
safe or harassing ways:
(1) At a rate of speed greater
than reasonable or proper under
all t h e surrounding circum-
stances;
(2) In a careless, reckless and
negligent manner so as to en-
danger the person or property of
another or to cause injury or
damage thereto:

(3) While under the influence
of intoxicating liquor or narcotics
or habit - forming drugs;
(4) Without a lighted head and
tail light when required for
safety;
(5) In any planting or tree
nursery in a manner which dam-
ages or destroys growing stock.
(6) In a noisy manner con-
trary to Section 501 (3) of this
ordinance.
ARTICLE V.
UNLAWFUL ACTS
Section 501. Operation.
It shall be unlawful for any
person to operate a snowmobile
(1) On private property of an-
other without express permission
to do so from the owner or occu-
pant, of said property; or
(2) On publicly owned land,
including school, park property,
playgrounds and recreation area,
including frozen surface of lakes
located within the Village of
Shorewood, except where per-
mitted by Section 503 of this
ordinance.
(3) In a manner so as to create
a loud, unnecessary or unusual
noise which disturbs, annoys or
interferes with the peace and
quiet of other persons.
Section 502. Unattended Snow-
mobiles.
It is unlawful for the owner
or operator to leave or allow a
snowmobile to be or remain un-
attended on public property or
frozen surface of lakes within
the Village of Shorewood while
the motor is running, or with the
keys to start the same in the ig-
n;tion switch,.
Section 503. Exception.
Notwithstanding the provisjon�
of this ordinance the village
council of this village :nay, by
resolution, designate t,uhlic,lc
owned land areas and frozen lake
surfaces deemed available with-
in the limits of the Village of
Shorewood for use and operation
of a snowmobile when, in the
opinion of the council, public
safety and welfare is not adverse-
ly affected by such use.
ARTICLE VI.
EQUIPMENT
Section 601. Mufflers,
All snowmuhiles shall be
equipped with mufflers which are
properly atta -hed and which re-
duce the noise of operation of the
vehicle to a noise level which
shall not be a disturbance to
residences of the area of opera-
tion and no person shall use a
muffler cutout, bypass„ or simi-
lar device on said vehicles.
Section 602. Brakes.
All snowmobiles shall be
equipped with brakes adequate
to control the movement of and
stop and hold such vehicle in a
manner equivalent to an automo-
bile. All brakes shall be main-
tained in good working order.
Section 603. Safety Throttle.
All snowmobiles shall be
equipped with a safety or so-
called "dead man" throttle in
operating condition; a safety or
"dead man" throttle is defined
-i5 a device which, when pres

crator or throttle, causes the mo-
tul to he disengaged from the

ARTICLE VII.
INCORPORATION OF
STATE STATUTE
Section 701. Incorporation.

ence and made a part hereof as
fully and completely as though
set forth herein in full.
ARTICLE VIII.
DEFENSE.
Section 801. Defense.
It shall be sufficient defense to
the prosecution for violation of
Section 501 (1) and (2) that the
defendant has permission, in
writing, from the owner or law-
ful occupant of the land or the
village council has authorized,
by resolution, the use of public
land or frozen lake surface with-
in the Village of Shorewood for
operation of snowmobiles.
ARTICLE IX.
PENALTY
Section 801. po saft.
Any person violating the terms
of this ordinance shall, upon con-
viction thereof, be fined a sum
not to exceed $100.00 or shall be
imprisoned for a period not to
exceed 90 days.
ARTICLE X.
ORDINANCE EFFECTIVE
Section 1001.
This ordinance shall be in full
force and effect from and after
its passage and publication.

ORDINANCE NO. 53
An Ordinance Regulating the Use
of Vehicles and of Highways
Within the Village of Shore-
wood Incorporating Provisions
of the State Highway Traffic
Regulation Act by Reference
and Imposing a Penalty for Vi-
olation Thereof.
The Village Council of the Vil-
lage of Shorewood, Minnesota,
does ordain as follows:
SECTION 1. Highway Traffic
Act Incorporated by Reference.
The regulatory provision of the
"Highway Traffic Regulation
Act ", the same being Minnesota
Statutes, Chapter 169 as periodi-
cally amended up to and includ-
ing laws of 1967 are hereby adopt-
ed as a traffic ordinance regulat-
ing the use of highways, streets,
and alleys in the village and are
hereby incorporated and made a
part of this ordinance by refer-
ence as if set out herein in full.
SECTION 2. No Parking and
Limited Parking Zones.
The Village Council may, from
time to time, by motion or resolu-
tion designate portions of the
highways and streets within the
Village of Shorewood as no park-
ing zones or limited parking zones
and shall cause such zones to be
marked by appropriate signs. The
location of such signs limiting
parking shall be prima facia evi-
dence that the Village Council
has by proper resolution or mo-
tion authorized the establishment
of such no parking or limited
parking zones. The Council shall
make a determination of such no
parking zones or limited parking
zone for a longer period than is
specified on the signs marking
such zones and any violation
thereof shall be a misdemeanor.
SECTION 3. Passing School
Buses.
The driver of a vehicle upon a
street or highway in the village,
upon meeting or overtaking from
either direction any school bus,
which has stopped on the high-
way for the purpose of receiving
or discharging any school child or
children, shall stop the vehicle
immediately upon the extension of
a stop signal arm by the school
bus driver and shall remain
stopped until the school bus driv-
er retracts the stop signal arm,
but may then proceed with due
caution for the safety of such
children.
SECTION 4. Driver's License—
Vehicle Ownership — License Re-
quired.
No person shall drive or oper-
ate a motor vehicle upon any
street or highway in the Village
without having in his possession,
as required by Laws of the State'
of Minnesota, a valid driver's li-
cense or chauffer's license. No
person shall drive or operate a
motor vehicle belonging to an-
other without the owner's con-
sent. No person shall drive or op-
erate a motor vehicle without
(having thereon proper motor ve-
hicle license plates as required by
the Laws of the State of Minne-
sota.
SECTION S. Stopping or Park-
ing On Park or Public Lands.
No person shall stop, stand, or
park a vehicle or operate any ve-
hicle, or ride any bicycle or horse,
except in compliance with the di-
rections of a police officer, on any
park property or other public
grounds within the limits of the
Village of Shorewood, except
when such areas are designated
for any of such uses, and signs
prohibiting any of such uses on
any park property or public
grounds shall be complied with.
SECTION 6. Careless Driving
off Highways.
Any person who drives any ve-
hicle in such a manner on any
public or private grounds or park-
ing lot or on the frozen surface
of any body of water within the
limits or the harbor limits of or
adjacent to the limits of the Vil-
lage, so as to indicate a disregard
for the safety of persons or prop-
erty, shall be guilty of careless
driving and such careless driving
is a misdemeanor.
SECTION 7. Penalty.
Any violation of the provisions
hereof or of the statutes adopted
by reference in Section 1 is a vio-
lation of this ordinance when it
occurs within the Village of
Shorewood. Any person thus vio-
lating any provision of this ordi-
nance shall be guilty of a misde-
meanor and shall be punished by
a fine of not to exceed $100.00, or
by imprisonment in the County
Jail not to exceed 90 days; but, if
a minimum fine or imprisonment
is prescribed by the State High-
way Traffic Act for an offense,
such penalty shall apply to a per-
son convicted of the same offense
under this ordinance.
SECTION 8. Repeal.
Ordinance No. 38 of the Village
of Shorewood is hereby repealed.
SECTION 9. Effect.
This ordinance shall take effect
from and after its passage and
publication by law.
