Pub of Ordinance 58LEGAL NOTICES (Official Publication) ORDINANCR N0, 58 AN ORDINANCE RM ATING TO THE REGULATION AND KEEP- ING OF HORSES, COLTS AND PONIES WITHIN THE VIL- LAGE OF SHOREWOOD The Village Council of tha Village of Shore- wood does ordain: SECTION 1. No person, firm or corporation shall keep, stable so her - boor horses, colts or Ponies within the limits of the Village of Shorewood, upon land other than that classified and taxed as agricultural by the Village Assessor without first obtain- ing a permit from the Village Clark to so keep, stable, or har- bour said animals. Such person, firm, or corporation shall pay therefore to the Village Clark the sum of $10.00 for each horse requested for said permit. SECTION 2. Application for the Permit shall be made in writing by the owner of the animal or animals upon blanks or form furnished by the Village Clerk. Each application for a permit shall have thereon the correct legal description of the property on which the animals or animals will be kept and the name of the owner of the land; the total number of horses and information indentify ing each horse to be kept or stabled on said Land; the descrip- tion of shelter pro- vided for the animal or animals. SECTION 3. No permit shall be issued by the Village Clerk until the Animal Inspector, to be ap- pointed by the Council, has inspected the pre- mises upon which the animal or animals are to be kept. The fol- lowing standards are to be not and provided by the applicant be- fore a permit shall be issued. 1. An area where horses are kept, stabled, main - taifted or con- fined of at least a contiguous one- half acre. 2. Such area shall be enclosed by a stur- dy wood, metal or electrical fens which will keep the animal or animals confined therein. 3. A shelter or sta- bling facility which will keep the animal or an- imals comfortable and protected from the elements and which shelter or stabling facility shall be no closer than 100 feet from any structure other than the applicants which is used for residential pur- poses; in addition the shelter or stab- ling facility shall be so located so as not to create a pub- lic nuisance. 4. Clean and sanitary premises which will not be a harbour for rodent, flies and in- sects* 5. Areas where animals are confined should be of such a nature they can be used by the an- imal for grazing, but the areas shall be no closer than 75 feet from any structure other than the appli- casts, which is used for residential pur- poses. 6. The number of animals per one -half acre of confinement area shall be limited to one. 7. Keeping, storing, sta- bling or maintenance of said animals on the premises shall -not directly contribute to the pollution of any public body of Mater. SECTION 4. Upon receipt of an inspec- tion report from the Ani- mal Inspector disclosing that the applicant has comer+ plied with the standards provided by Section 3 above and upon approval of the application by the " Village Council, the V1- lags Clerk may issue a permit for the keeping of said horses, colts, or ponies which permit snall expire on the ensuing :5th day of May, unless sooner revoked as hereinafter provided, except that any applicant requesting a permit to keep, store, or stable three (3) or more horses, colts or ponies upon one parcel of land shall not be is- sued by the Clark until -2- the Village Council has determined that the keeping, storing, maintenance or sta- bling of said number of animals shall not be public nuisance. SECTION 5. Permits issued pur+- suant to this Ordi- nance may be re- voked by the Village Council if the Coun- cil finds, of ter in- vestigation by the Inspector and of ter holding a hearing thereon (notice of said hearing to be given to the holder of the permit) thatt 1. The premises up- on which the an- imal is kept is unsightly and a harbour for ro- dents, flies, and insects or 2. The winter ac- cumulation of manure is not removed from the premises prior to May 15th of each yearl burning of manure is prohibited, or 3. Accumulations of manure are not removed at such periods as will insure that no objectional ar- oma exists and that the require- ments of sub- division one a- bove are com- plied with: or 4. The applicant has failod to make a reason - abIa effort to keep the animal or animals under control and fen - ced within its areas or 5. The applicant has not met the stan- dards set forth in Section 3 of this Ordinance: or 6. The animal has been treated cruelly and in- humanly. 7. The keeping, storing or sta- bling of said animals is a public nuisance. SECTION 6. Any person violating the provisions of this ordinance shall be guilty of a mis- demeanor and shall upon conviction there, be punished by a fine of not to exceed $300.00 or by imprisonment of not not to exceed linty (90) days. SECTION 7, Ordinance No. 36 which was accepted December 11 1961 together with any amendments thereto, is hereby repealed. SECTION S. This ordinance shall take effect and be enforced after its pas- sage and publication ac- cording to law. Passed by the Council this 13th day of April, 1970. JACK T.
