Shorewood, Minnesota, ordains:
Section 1.
That Section 1 of Ordinance Number 5`

ORDINANCE PROHIBITING DISCRIM-
INATORY PRACTICES BASED ON
RACE, COLOR, CREED, RELIGION,
ANCESTRY, NATIONAL ORIGIN OR
SEX WITH RESPECT TO EMPLOY-
MENT, HOUSING ACCOMMODATIONS,
PROPERTY RIGHTS, EDUCATION,
PUBLIC ACCOMMODATIONS AND
PUBLIC SERVICES
THE VILLAGE COUNCIL OF THE
VILLAGE OF SHOREWOOD ORDAINS:
SECTION 1. Declaration of Policy and
Purposes.
It is the public policy of the Village of
Shorewood to assure for all persons free-
dom from discrimination because of race,
color, creed, religion, ancestry, national
origin, or sex with respect to emplov-
ment, housing, property rights, educa-
tion, public services and accommodations
which discrimination threatens the
rights, privileges, opportunities and free-
dom of all persons and menaces the insti-
tutions and foundations of democracy. To
effectuate this policy the Village of Shore-
wood has heretofore on January, 13, 1969,
established a human relations commis-
sion, the purpose of which is to secure all
citizens equal opportunity. housing, pub-
lic services and education, and to assist
this village to implement the Minnesota
State Act against discrimination, being
Chapter 363 of Minnesota Statutes.
SECTION 2. Without limitation the fol-
lowing are declared to be discriminatorv.
unfair, unlawful and are hereby prohibit-
ed.
Subd. 1. For an employer because of
race, color, creed, religion, ancestrv.
national origin or sex, to hire or fail or
refuse to hire, to discharge an employ-
ee or to accord adverse or unequal
treatment to any person or employee
with respect to application, hiring,
training, apprenticeship, tenure, pro-
motion. upgrading, compensation, lav-
off, discharge, or any term or condition
of employ rent.
Subd. 2. For an employment agency
because of race, color, creed, religion,
ancestry, national origin or sex to ac-
cord adverse or unequal treatment to
any person in connection with any ap
plication for employment or any refer-
ral or request for assistance in procure-
ment of employees or to accept any
listing of employment with such condi-
tion or conditions.
Subd. 3. For any labor organization
because of race, color, creed, religion,
ancestrv, national origin or sex to deny
full and equal membership rights to an
applicant for membership or to a
member: to expel, suspend, or other-
wise discipline a member or to accord
adverse or unequal treatment to anv
person with respect to his hiring, ap-
prenticeship, training, tenure, compen-
sation, upgrading, layoff or any term or
condition of employment.
Subd. 4. For an person having any
interest in real property and any real
estate broker or real estate agent be-
cause of race, color, creed, religion,
ancestry, national origin, or sex to fail
or refuse to sell, rent, assign, or other-
wise transfer any real property to any
other person, or to accord adverse, or
unequal treatment to anv person with
respect to the acquisition, occupancy.

Subd. 8. For any person, bank, or

tion, repair, or maintenance of any real
property to deny such application or
withhold the extension, modification or
renewal of anv existing loan or to im-
pose rates, terms, or conditions differ-
ent from the usual in extending such
financial assistance because of dis-
crimination against the applicant or
because of anv intended use by the ap-
plicant, or anv of such applicants, les-
sees, tenants; or assigns.
Subd. 9. Terms used in this section
are defined as follows`.

association of individuals who, within
the Village of Shorewood. hires or
employs anv employee whose serv-
ices are partially or wholly per-
formed in the Village of Shorewood
but the term employer shall not in-

respect to hiring of individuals of a
particular religion or sex when reli-
gion or sex shall be a bona fide occu-
pational qualification for employ-
ment, provided, such selection is not

tional origin.
SECTION 3. Contracts with the Village
of Shorewood.
In an., contract by or with the Village
of Shorewood, including any of its con-
tracting agencies, departments, and
agents there shall be included at least
the following provisions which shall bind
the other contracting party.
Subd. 1. That with respect to any
and all action taken or acts performed
pursuant to said contract, such other
contracting party shall be deemed to be
an emplo within the meaning of this
ordinance and shall be subject to the
provisions thereof.
. Subd. 2. That in the event said other
contracting party fails to perform the
aforesaid contractual provisions, said
contract may forthwith be terminated
and cancelled in whole or in part by the
Village of Shorewood and said other
contracting party shall be liable for any
costs or expenses incurred by the Vil-
lage in obtaining from other sources
the work and services to be rendered or
performed or the goods or properties to
be furnished or delivered to the Village
under the contract so terminated or
cancelled.
Subd. 3. That should the Village in a
proceeding brought as hereinafter pro-
vided, find that the said contracting
party has engaged in discrimination in
connection with any such contract, and
if such contract remains unfinished, the
Village shall withhold up to 10 of the
said contract price until such time as
the Village's order has been complied
with or said other contracting party has
been adjudicated not guilty of such dis-
crimination. If such contract has been
completed, the Village shall enter into
no further contracts with such con-
tracting party until such time as the
Village's findings and recommenda-
tions have been complied with or other-
wise satisfied.
Subd. 4. That said other contracting
party will permit access to an and all
records pertaining to the hiring and
employment and to other pertinent
data and records for the purpose of

SECTION 5. The human relations com-
mission heretofore established by the Vil-
lage of Shorewood is reaffirmed in its ex-
istence and its purposes and duties shall
be as outlined and provided for therein, as
well as provided by Chapter 363 of Minne-
sota Statutes amended.
SECTION 6. Any person, firm, corpora-
tion or association of persons to violate
any provision of this ordinance or com-
mits anv unfair discriminatory act as set
forth in'this ordinance or attempts. abets.
