RE: Tobacco License for 24365 Smithtown Rd (Oasis Market)
The Oasis Market at 24365 Smithtown Road has a license to sell tobacco products. This
establishment has a new owner, and the existing tobacco license is not transferable to the new
owner. Today the new owner completed the Tobacco License Application and paid the required
fee for this license. He respectfully requested that the City act as quickly as possible to process
his license application, so he can continue to sell tobacco products at this site.
Shorewood City Code 302.03, Subd. 2, states: Action. The city may either approve or deny the license
or it may delay action for the reasonable period of time as necessary to complete any investigation of
the application or the applicant it deems necessary. If the city shall approve the license, the City
Administrator/Clerk shall issue the license to the applicant, If the city denies the license, notice of the
denial shall be given to the applicant along with notice of the applicant's right to appeal the decision.
Typically, background checks are completed on the establishment for renewal licenses. As this is
a new licensee, a background check on the establishment will be conducted with the license
renewal this fall, so as to have a few months history of the new licensee at this site.
The attached Resolution issues a license for the sale of tobacco products to Mr. Asad S. Elwir for
SASA, LLC, located at 24365 Smithtown Road. Staff recommends approval of the resolution to
issue the license for the period May 26, 2009 - October 31, 2009.

A RESOLUTION APPROVING LICENSES TO RETAILERS
TO SELL TOBACCO PRODUCTS
WHEREAS, the Shorewood City Code, Sections 302 and 1301 provide for the licensirn"
of the sale of tobacco products in the City; and
WHEREAS, said Code provides that an applicant shall complete an application, and
shall pay a licensing fee; and
WHEREAS, the following applicants have satisfactorily completed an application and
paid the appropriate fee.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
That a License for the sale of tobacco products be issued for the term from May 26, 2009
to October 31, 2009, consistent with the requirements and provisions of Chapter 302 of
the Shorewood City Code, to the following applicants:
