RES OLUTION APPRO VING O RIGHT-OF-W

WHEREAS, the City of Shorewood, identified the need for additional Right -of -Way on
Smithtown Lane for construction of a cul -de -sac; and
WHEREAS, Hennepin County owns property identification # 32- 117 -23 -13 -0035,
Outlot A Smithtown Circle plat, which is available for purchase; and
WHEREAS, Richard & Joan Whetston of 26040 Smithtown Lane would accept
property identification # 32- 117 -23 -13 -0035 in exchange for the needed Right -of -Way to
construct a cul -de -sac at the termination of Smithtown Lane.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
The City of Shorewood authorizes staff to acquire property identification # 32- 117- 23 -13-
0035, Outlot A Smithtown Circle plat, from Hennepin County for fair market value as shown on
Exhibit A for $592.70; and
BE IT FURTHER RESOLVED that the City Council of the City of Shorewood
authorizes staff to pay conveyance fees and convey said property upon receipt of deed to Richard
& Joan Whetston in exchange for Right -of -Way as shown on Exhibit B.
ADOPTED by the City Council of the City of Shorewood this 27th day of July, 2009.
