Acknowledging that it 'a sad management issue, Chair Davis stated that it would be interesting to learn how big the herds have gotten near the Lake Minnewashta area. Quinlan asked what triggers this type of action and how it would be run. Brown stated that it is based on the number of complaints received from residents, as well as the fact that the deer population has become quite bold. He pointed out that that the MBRB has performed many of these types of hunts elsewhere with great success. Hensley asked what kind of signage would be posted. Brown stated that it would be posted on the website, and that surrounding neighbors would likely be notified in advance. He noted that the hunt can only take place in an area at least 4 acres in size. B. He enlisted each Commissioner to take a section from the list and begin their calling, encouraging members to identify anyone they have relationships with before proceeding. Hensley took the first 11 on the list; Trent the next 10; Norman the following 20; Quinlan the next 14; and the final page was divided in half for Young and Alegi; while Chair Davis created a list of others not listed. • 1 PARK COMMISSION MEETING MINUTES WEDNESDAY, SEPTEMBER 5, 2007 PAGE 3 of 3 • Chair Davis explained that the City would be selling advertising in a `passport' which will be circulated before and during the event containing coupons, ads, and a schedule of events. She noted that the passports could be handed out over the holidays in Excelsior promoting the event. • Trent asked how much the Commission would be asking for from the Council. Chair Davis felt a fair amount would be $2000 -3000, as other City Council's are similarly supporting their events within their city limits as well. She mentioned that they hope to do an ample amount of advertising, as was done for the Music in the Parkie's over the summer. Quinlan suggested they add counter -top displays with additionglas' s to set -up at each of the sponsor's places of business over the holidays. ek €�� 6. Resources summarizing activities, challenges, and recommendations for future growth of the City's park system for the City of Shorewood for the first half of 2007. Resources There is an old saying that "everything and nothing stays the same" and the first half of this year proved no exception. While the normal sporting seasonal cycles progressed though the year with timeless process, change was always within them. Community Rec. Resources began the spring sporting season with communication to each sports organization in early February. March brought the sports information meeting and schedules for the season after all documentation had been collected. Congratulations were in order for several of the sports organizations, and consistently to Minnetonka Girls Softball Association, for returning complete documentation packages early on in the process. Also, there were a few organizations that routinely lagged in getting documentation returned in a timely manner due their late sporting season. After much communication, all rosters and documentation were collected. Ongoing efforts continue to ensure completed information will be submitted in a timely manner each season. Each year the repoire Community Rec. Resources staff had attained helped the process to become more refined, and information and confidence between organizational representatives has grown as a result. There were several sports organization representatives that were new to the process this year and all acclimated well and stated they could easily work within the system presented to them for documentation collection. Community Rec. Resources Staff was proud of its efforts to bring organization and harmony to prior discontented organizations vying for field space within the City's premier park system. In addition, Community Rec. Resources Staff has had the pleasure of meeting with the Southshore Community Center's new coordinator to discuss and review seasonal rentals that would impact park usage, and was pleased to report there are few conflicts with parking at Badger Field as a result of this dialogue. • • • As part of the sporting seasons, there are always changes to the schedule. This year City Staff and Community Rec. Resources Staff worked together to discuss effective ways to document changes to the schedule so that communication between all parties was clear and concise. As the park system continues to sustain increased usage by a variety of participants, increased communication will continue to be "key" to providing successful field usage for all park users. While the number of sports organizations utilizing the fields remained similar to years past, the numbers of participants within organizations were growing and occasionally there were conflicted requests for park usage. This spring also saw an increase in the amount of "random" users, meaning those park users that requested a singular use of the parks for things like a tennis match, or church baseball game. Monitoring has always been an integral part of the services provided by Community Rec. Resources. Efforts in the first half of the year included monitoring of Badger hockey rinks (for the few short weeks of winter only), as well as Manor and Freeman as they experienced the most intensive use this spring. Badger Park did not experience any significant issues this winter with the understanding that the winter season did not cooperate as most outdoor hockey enthusiasts would prefer, and rink usage was only available for approximately three weeks in early January. Minnetonka Lacrosse Association would normally have been utilizing field usage in the spring; however, City Staff requested Badger fields rest for the spring season. This shift caused Manor Park to experience heavier than normal usage. Despite this increased usage, Community Rec. Resources did not receive any concerns from the surrounding neighbors and in fact, received a comment from a parent of a participant stating it was great to see the park being so vitally utilized. Praise should also be given to the sports organizations, South Tonka Little League and Minnetonka Lacrosse for working so cooperatively together in what could have been a very difficult situation. Community Rec. Resources was also pleased to report there were no difficulties at Freeman Park throughout the spring sporting season. Traffic continued to flow and move well with the staggered schedule, directional traffic and carpooling efforts on behalf of the participants' parents. There were no tournaments scheduled at Freeman Park this year during the spring season as Tonka United Soccer decided to approach their tournament with a different venue. Community Rec. Resources Staff had the pleasure of attending the Music in the Park event in early July. This event was well attended by approximately 400 -500 people and was proclaimed a great success with several rounds of applause throughout the evening. In its third year of providing Park Coordinator services to the City of Shorewood, Community Rec. Resources continues to blend many arenas of knowledge and experience to provide the City with quality and value in assisting in the management of the City parks. We hope the City continues to be pleased with the result. Park usage is expanding and it will be critical over the course of the years to come that the City continue to meet that demand with efforts to sustain, maintain, and improve the quality of the park system throughout the City of Shorewood. There were a total of 10 kids that participated in the camp. The ages were: Total Age 1 7 1 8 1 /2 2 9 3 10 1 11 1 12 1 13 The kids were from both the west and east side of Shorewood (Smithtown Way, Maple Leaf Circle, Spruce Hill Court, Christmas Lake Point, Radisson Rd are a few locations). Mark Mueller from 3` Lair said that the feedback his instructors received from the kids was it was the best time ever!! They had a great time and learned a lot. The next camp will be October 18 and 19. There are 7 kids registered as of Friday, October 5. The ages range from 4 1 /2 to 11. Out of the seven kids registered, one is from Excelsior and two from Tonka Bay. The agreement will be used for those vendors that will be participating at Arctic Fever. The document is also being reviewed by the city attorney. • After the Park Commission has reviewed and approved the agreement, it will go to City Council for approval. • Independent Contractor Agreement This agreement is by and between the City of (City) and (Contractor). This agreement is in effect from 1 20 until Contractor Address: Contractor Phone: Contractor E -mail: Services to be provided by Contractor 20 It is understood that the Contractor is experienced and trained to provide services and that the City requires such services. Therefore, it is hereby agreed that the Contractor will provide the following services. 1. Instruction: 2. Supplies: 0 3. Equipment: • 4. Transportation: Services to be provided by the City It is understood that the City will provide the following services to facilitate and support the contracted services listed above. 1. Promotion: 2. Upon the successful completion of the specified services, the Contractor shall bill the City for services provided. The invoice will outline the services rendered, tax ID number or social security number and, if applicable, the dates and times the services were performed. Service Suspension and Cancellation • 1. If a contracted service fails to meet the required minimum number of participants, the service will be cancelled at no penalty to either the Contractor or the City. 2. If at any time the actions of the Contractor and /or their staff compromise the physical, mental or emotional safety of a participant, the City shall have the right to immediately suspend services until the issue has been resolved or the contract • terminated. 3. Either party to this agreement may terminate this agreement upon thirty (30) days written notice, except that if the Contractor fails to fulfill its obligations under this agreement in a proper and timely manner, or otherwise violates the terms of this agreement, the City shall have the right to immediately suspend the contracted services and to then terminate this agreement, if the Contractor has not cured the default -upon written notice. Business Expenses Any expenses incurred by the Contractor pursuant to providing the services, including but not limited to travel and phone expenses, are the sole responsibility of the Contractor. Insurance The Contractor and its subcontractors shall secure, maintain and furnish the City with proof of the following insurance: 1. Commercial General Liability insurance with limits of at least $1,000,000 per occurrence. The City shall be named as an additional insured and be provided with a copy of the Certificate of Liability. 0 2. Worker's Compensation insurance. 3. Commercial Automobile Liability insurance covering all owned, non -owned and hired - automobiles with limits of at least $500,000 per accident. (Required only if transporting participants). Acceptance of the insurance by the City shall not relieve, limit or decrease the liability of the Contractor. Any policy deductibles or retention shall be the responsibility of the Contractor. The Contractor shall control any special or unusual hazards and be responsible for any damages that result from those hazards. The City does not represent that the insurance requirements are sufficient to protect the Contractor's interest or provide adequate coverage. All policies of insurance shall provide that the insurance company will notify the City at least thirty (30) days prior to the effective date of any policy cancellation, modification or non - renewal prior to the date on which the Contractor or its consultants commences performance of its part of the work, evidence of coverage is to be provided to the City. The City may direct that copies of the actual insurance policies, or renewals or replacements thereof, be submitted to the City. Waiver The Contractor waives all its rights against the City for damages covered by property • insurance. The Contractor shall require a similar waiver from, all its consultants. The Contractor waives all of its rights of recovery against the City because of deductible clauses in, or inadequacy of limits in, any policies of insurance that are in any way related to the work and that are secured and maintained by the Contractor. The Contractor waives any of its rights of recovery against the City because of a lack of insurance coverage. The Contractor shall require similar waivers from all of its consultants. The Contractor shall waive all of its rights of recovery against the City for loss or damage to any of its equipment, machinery, tools or property that is used in connection with this Agreement. The Contractor shall require a similar waiver from all its consultants. • Hold Harmless The Contractor agrees to defend, indemnify and hold harmless the City, its officers and employees, from any liabilities, claims, damages, costs, judgments, and expenses, including attorney's fees, resulting directly or indirectly from an act or omission of the contractor, its employees, agents or employees of subcontractors, in the performance of this contract or by reason of the failure of the contractor to fully perform, in any respect, all of its obligations under this contract. Compliance with Statues The Contractor shall abide by all laws that govern the City and by the policies of the City, including but not limited to the Data Practices Act, records retention guidelines, non- discrimination and disability accommodation laws and guidelines. Data Practices The Contractor agrees to comply with the Minnesota Government Data Practices Act and all other applicable state and federal laws relating to data privacy or confidentiality. The Contractor will immediately report to the City any requests from third parties for information relating to this agreement. The City agrees to promptly respond to inquiries from the Contractor concerning data requests. The Contractor agrees to hold the City, its officers, department heads and employees harmless from any claims resulting from the Contractor's unlawful disclosure of use of data protected under state and federal laws. Audits The Contractor agrees that the City, its Auditor or any of their duly authorized representatives, at any time during normal business hours and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt and transcribe any books, documents, papers, and records that are relevant and involve transactions relating to this agreement. Applicable Law The law of the State of Minnesota shall govern all interpretations of this contract, and the appropriate venue and jurisdiction for any litigation which may arise hereunder will be in and under those courts located within the County of Hennepin, State of Minnesota, regardless of the place of business, residence or incorporation of the Contractor. Modification or Amendment No amendment, change or modification of this Agreement shall be valid unless in writing • and signed by the parties hereto. Entire Understanding This document and any exhibit attached constitute the entire understanding and • agreement of the parties, and any and all prior agreements, understandings and representations are hereby terminated and canceled in their entirety and are of no further force and effect. Unenforceability of Provisions If any provision of this Agreement, or any portion thereof, is held to be invalid and unenforceable, then the remainder of this agreement shall remain in full force and effect.
