MATTERS FROM THE FLOOR There were none. 4. REPORTS A. Report on City Council Meetings of July 24, August 7 and August 14, 2000 — (Council member) In the absence of Councilmember Zerby, Park Commssion representative Bix reported no new information from the City Council meeting of July 24, 2000. City Engineer Brown reported on the meetings of August 7th and 14th, relaying that Council approved the ordinance pertaining to the Sock user fee. This approval leaves the Park Commission free to field feedback from various sports organizations. 40 B. Report on Land Conservation Environment Committee Activities — (Park Commissioner Berndt) i� PARK COMMISSION MINUTES TUESDAY, AUGUST 22, 2000 PAGE 2 OF 6 Commissioner Berndt was not present at the last LCEC meeting, however, she stated they had presented their budget to Council. Berndt was not certain whether the budget had been approved, but Engineer Brown relayed that it had been adopted as a part of the proposed budget. Brown also explained that Council was yet to act on this budget due to further discussion over fundraising initiatives for this committee. Berndt also reported on a grant for backyard composting bins. This grant was included in the budget as a way of subsidizing bins so the public would be able to purchase these items at a lesser cost. Berndt discussed other projects LCEC has been working on. First, an ordinance which would ban the use of phosphorous on lawns in the community, as well as, the commercial sale of phosphorous fertilizers; second, an educational program for the removal of buckthorn and how that can be done properly, third, LCEC had checked into the possibility of hiring a consultant to find the open spaces in Shorewood - but deemed this unnecessary due to the high cost of hiring such an individual; and finally, the LCEC was looking into a different way of holding their open house next year to make it more visible. Brown commented on the fertilizer issue, as it relates to Council, and the fact that they too would like to see a mandate come down from the legislature on this issue. 0 C. Report on "No Parking" Signs at Freeman Park — (City Engineer Brown) Engineer Brown reported that the signs were up. Chair Arnst inquired if the police would enforce these signs, to which Brown replied they would if called. However, Council must ask the police department to enforce them on a regular basis. D. Skate Park (Att.44D) • Update on Fundraising Schedule and Progress — (Park Commissioners Amst and Puzak) Chair Arnst reported that Commissioner Puzak, Mayor Love and Councihnember Zerby were presenting to Tonka Bay this evening asking them to contribute approximately $1,500.00. On Monday, August 21, 2000, the City of Excelsior unanimously approved a $2,500.00 contribution. Bringing the total to approximately $9,600.00. Arnst stated there would be a meeting with Greenwood the first Tuesday in September and a Deephaven meeting to follow later in the month. Amst then brought up the idea of using a "thermometer" type graph to chart progress and use as a fundraising tool at various public events like Apple Days, rotary functions etc. to generate excitement. Amst volunteered to put together such a display. • Update on Use of Church Parking Lot — (Park Commissioner Puzak) Arnst deferred to hear from Puzak on this subject later. PARK CO:YIMISSION MINUTES TUESDAY, AUGUST 22, 2000 PAGE 3 OF 6 • Availability of City Water at Site— (City Engineer Brown) Engineer Brown referred to his memorandum enclosed which addressed the feasibility of providing municipal water service to the proposed Skate Park. Due to the estimated cost of $9,045, the probability of poor water quality due to the distance from the water main and the poor condition of the existing well, availability is unlikely. Brown will, however, check into the condition of the existing well. • Report on Status of Blacktop Surface Post - Highway 7 Construction (City Engineer Brown) Brown referred to the copy of the letter that he sent to Mn/DOT. In this letter, Brown voiced concern over the condition of the pavement and Mn/DOT's use of the paved area. After this recent communication, Mn/DOT has begun to address the cosmetic issues by placing step one of a repair fix on the pavement. Although the first of many steps has been taken, it is not acceptable as it stands. Brown believes Mn/DOT is beginning to address the City's concerns and will finish the job. E. Report on Responses to Smithtown Road West Letter Regarding Trail Process— (City Engineer Brown)(Att. -#41F) Brown went over the tabulations from the comment cards. As it stands, there seems to be almost a 50150 split. With that in mind, Brown brought up a phone call he had received that day from a resident on Lake Linden Drive inquiring about the possibility of getting a trail along Lake Linden Drive due to concerns over excessive speeds in the area. Brown shared with her the Commission and Councils commitment to working with residents who want such an improvement in their neighborhood. This resident was convinced she could get 100% participation and support for such a project. Brown relayed to the Commission that he would not be surprised to see a petition from that area. Amst decided to put the Smithtown trail issue on the next agenda to discuss whether to move forward from this point or not. Brown discussed other options for Smithtown, with no real leadership for a trail at this point. By using state aid dollars Engineer Brown discussed overlay and shoulder options, as well as, the possibility of a sidewalk. 5. EDDY STATION A. Report on Construction Progress (City Engineer Brown) Brown reported that the groundbreaking ceremony took place this evening with representatives from the Eddy family in attendance. The project is approximately one week behind schedule, which is acceptable because the builder built in a four week delay due to the time frame required to receive block. Ellen Luken, • the architect for the project, has assisted in making some of the decor decisions needed in a timely fashion. Brown asked the Commission to relay to him any strong opinions they might have and assured the PARK COMMISSION MINUTES TUESDAY, AUGUST 22, 2000 PAGE 4 OF 6 • Commissioners he would poll their opinions as much as possible before making decisions. B. Discuss Sample Request For Proposal (RFP) and Recommend Changes and Schedule (Att.-#5B) Chair Amst offered the attached RFP up for comment from the Commission. Commissioners made changes as follows according to the original RFP. Commissioner Themig suggested adding a diagram of the park and taking out the requirement of a market study. Commissioner Dallman added, it might be useful to require vendors to share copies of their annual sales reports. Amst went on to specify that the vendor would not have exclusive use of the kitchen, that it may still be rented out, and that the concessions must be open during all scheduled events. Themig suggested separating, the criteria the concessionaire be required to meet from the things their proposals will address. Bix then advised changing that the specific percentage of the profits go to the City of Shorewood. Amst then removed the bullet third from the bottom regarding service for a portion of the season and went on to change the no alcoholic beverages statement to this operation must be in compliance with all relevant park ordinances. Finally, Brown said he would check on the current insurance figures and update the RFP accordingly. Chair Arnst inquired how long it would take the revised RFP draft to go through Council and into public hands once it is recommended by the Park Commission in September. Brown said he would check whether the initial RFP need even go to Council before being sent out, or if Council need only approve the final • contract between the vendor and the City. Arnst volunteered to assist Engineer Brown on the RFP draft to facilitate responses by Jan 1, 2001. More discussion ensued over how to publicize the RFP. Dallman suggested papers, mailers to sports organizations, rotaries, shriners anyone who may have interest. 6. VINE HILL TRAIL A. Report on Construction Process (City Engineer Brown) Brown reported that construction is coming to a close. The only issues that remain are warranties on the sal, cleaning up both the entryway of Waterford and Covington Roads little planting garden. Brown then said he had received numerous phone calls praising the Commission for taking this project on. No news on the eminent domain issues, it takes 90 -120 days to finish this process. B. Discussion and Decision on Ribbon Cutting Ceremony Arnst then suggested a ribbon cutting ceremony take place to thank the neighbors for their support. The decision was made to have the ceremony piggyback the next meeting on September 5th, 2000 at approximately 6:45 P.M. meeting at Covington and Vine Ridge Rd. Commissioner Puzak arrived at 8:15 P.M. Puzak elaborated on the report given earlier regarding Skate Park Fundraising. Puzak was pleased with the unanimous vote to donate $2,500 from the City of PARK COMMISSION MINUTES TUESDAY, AUGUST 22, 2000 PAGE 5 OF 6 • Excelsior. Having just returned from the City of Tonka Bay, Puzak indicated they agreed to contribute $1,600, which, added to our $7,500 brings us to approximately $11,200. After the Greenwood and Deephaven meetings in September, they will then be going to the private sector for contributions. Puzak went on to praise the Council and Commission for their involvement and commitment to this project. 7. RECYCLING IN THE PARKS A. Review New Recycling Information (Park Commissioner Berndt) Berndt discussed the use of recycling bins in the parks. She presented the Commission with a copy of a Minnesota statute requiring recycling containers within all state facilities. With this information Berndt encouraged the city to look at this obligation more closely. Berndt spoke to EZ Recycling about the prices of such services - $17.00 per month per receptacle. Brown voiced concerns. First, over the expense of such an endeavor based on the number of receptacles needed. Next, the extra manpower needed in the parks to handle this obligation - for example "Charlie ", and finally, the concern of vandalism. As it stands now, the trash receptacles must be nailed down and bags taken out individually. • B. Discussion and Decision on Implementing Recycling in Freeman Park After some discussion over the number of recycling bins required, and at which parks, many members felt it was worth looking into further. Arnst suggested there be further research and discussion on this issue and perhaps something could be implemented next spring. Brown reiterated his concern over requiring "Charlie" to take on this additional responsibility. 8. NEW BUSINESS Arnst asked for a report from the Foundation. Dallman noted there will be a meeting Wednesday, August 23, 2000. Puzak then pointed out that Tonka Bay and other cities will be funneling their Skate Park contributions through the Foundation. Brown reported that the City Council approved the plans and specifications for the installation of the Freeman Park water main and sanitary sewer project. Two issues forced this decision. First, there is a new building going up and they need to get sanitary sewer to it, and second, the water main loop will benefit the Shorewood Ponds project as well. After meeting with Bill Tripp from Hennepin County Regional Rail Authority and a representative of Hennepin Parks, it was decided to put the water main utility on the north side of the trail, boring under the trail in two locations. Notices will be going out to people who back up to Smithtown that this development will be going on. Arnst then questioned Brown what is happening with the tunnel under Highway 19. Brown replied that he would call Del Miller with Hennepin Parks to see where that stands. PARK COMiMISSION MINUTES TUESDAY, AUGUST 22, 2000 PAGE 6 OF 6 i . Brown added that Mn/DOT will be closing Highway 7 from Highway 41 into St. Bonifacius and traffic will be rerouted. Minnetonka plans skate plaza Plans to build a skateboard plaza next to the Glen Lake Activity Center in Minnetonka were discussed at an evening meeting at the center on Aug. 16. Perry Vetter, Minnetonka project and special event manager, said about 30 people attended the meeting and most were supportive of the plans for the skateboard plaza. There were, however, three or four people who expressed concerns at the meeting. These concerns included whether this was the right place for a skateboard park; constructing a skateboard park wouldn't solve a problem; and that the park would need to make accom- modations for kids ages 10 and under. According to Vetter, the skateboard plaza was originally a part of the Capital Plan for 2002; however, strong support from the community and businesses encouraged the city to go ahead with plans sooner. Now design and other steps will be completed this fall to make this 'skate plaza a real - ity for extreme sports enthusiast. Plans are to open the skate plaza next summer. The locatiori for the skate plaza is a unique one. There is a hill adjacent to the Glen Lake Activity Center, which will be removed and the skate plaza rebuilt in its place. At the council's Aug. 21 meet- ing, council members unanimously Supported the effort being spear- headed by Shorewood. Shorewood Mayor Woody Love, Park Commission member Dan Puzak and South Lake resident Tim Hughes presented the plan to the council. The plan calls for the installa- tion of ramps and other skating ap- paratus on the paved portion of the former rest area along Highway 7, near Old Market Road in Shore- wood. Shorewood would be responsi- ble for the ongoing operation and maintenance costs of the park, a park that would "meet the needs of young people in our community," Love said, citing a statistic that only 20 percent of children•partici- pate in traditional sports pro- grams. Excelsior Mayor John Anderson asked if the Minnesota Depart- ment of Transportation was con- cerned about the park's visibility from Highway 7. Love said that the park is not being treated different- ly than any other park visible from a highway and that some visibility of the park and its activities from the highway is beneficial. The neighborhood to the east of the proposed site has expressed op- position to the plan, Love noted. Those concerns have been ad- dressed, although not to the satis- faction of the residents, he added. Quarterly meetings with the neighborhood, to review the opera- tion of the skate park, are planned during the first year, he explained. Excelsior approved a $2,500 contribution, at the recommendation of its Park and Recreation Commission. Our viewpoint Skate park deserves opportunity to succeed The proposal to build a skate park for the South Lake area deserves an opportunity to succeed. A grassroots effort, inspired by youth that have identified a need for an in -line skate and skateboard facility, has been un- derway for more than two years. Now the Shorewood City Council is attempting to turn an old rest area into a skate park; with the help of the other South Lake cities. The South Lake area, is far from the first to recognize the need. The efforts of other cities to provide similar facilities have proven the interest for them exists. Those efforts also provide an opportunity to learn what works and doesn't work for skate parks. Shorewood has decided that the old rest area along Highway 7, near Old Market Road, is the best place to establish the park. While residents near the proposed site have expressed sev- eral concerns about the plan, the Shorewood Council has at- tempted to resolve them. And Mayor Woody Love has agreed to meet with neighbor- hood residents every three months during -the first year of the park's existence, noting the city will be able to pull the skate park equipment if the park creates too many problems. But abandoning the plan because of concerns about problems that might occur at the proposed site is wrong. The South Lake youth deserve'the opportunity to prove they can use a skate park responsibly. Although Shorewood has attempted to address the concerns of the residents, additional issues should be examined before the park is built. For example, the park has a limited number of parking spaces available. While it is envisioned that most park users will not be driving to the facility, it is inevitable that a day will come when there are more cars than spaces available. A plan for han- dling that situation before it creates an inconvenience for the neighborhood is essential. Several cities and service organizations have already made a financial contribution to the park, which has an estimated start- up cost of $35,000. Last week; Excelsior Councilmember,Tom Gilman suggested that South Lake youth be involved in fund raising for the park, giving them a sense of ownership in the park once it is built. That, too, deserves consideration. Nothing would better, con- vince the South Lake communities of the interest and need for such a facility than a fund - raising effort by those who would use the park. _ And perhaps such an effort would convince the naysaye'rs the South Lake youth deserve such a facility. www.mnSUn.com Tonka Bay Councilgives $1,600 Council votes to give a dollar per resident to Shorewood skate park By Kurt Nesbitt Sun Newspapers Following a short presentation by a small delegation from Shorewood, the Tonka Bay City Council voted to give a do- nation of $1 per resident to the Shorewood Park Foundation to aid in the construction of a skate park. The decision was made by a unanimous vote at the council's regular meeting Aug. 22. Population estimates put the total amount of the donation at $1,600. If realized, the park would "give teenagers a place to gather without fear of harassment and intimidation from police and local business owners," said Tim Hugh- es, 17, of Excelsior, who gave input into the design of the park. Dan Puzak of the Shorewood Park Com- mission said a former rest area at Highway 7 and Old Market Road in Shorewood is where the park would be located, although Manitou Parkin Tonka Bay was considered at one point. Councilmember Guy Sasanfar asked what Shorewood was doing to address noise and safety concerns. Shorewood Mayor Woody Love respond- ed to Sasanfar by saying three public meet- ings were held in Shorewood, which ad- dressed these issues, but did not alleviate all resident concerns. Love said he offered to meet to address those concerns and that he would continue to monitor the situation. When Sasanfar asked if the neighbors accepted the proposal Love said, "I think they would rather we not have done it." Tonka Bay resident Elaine Anderson replied to the comment later, saying that the ball field that used to be in her neigh- 0 borhood a few years ago never presented a problem. "I hate it when there's no place for kids to go," she said. The proposal was started two years ago after a South Lake teenager came before the Shorewood City Council and said, "I know where I can't skate, but I don't know where I can skate," said Dan Puzak of the Shorewood Park Commission. Love said the total cost of the project is estimated at about $40,000 and that the project has financial commitments from private businesses. Shorewood has ear- marked $7,600 for park equipment and will provide the manpower to build and main- tain the project, should it materialize. In addition, Love is seeking donations on a dollar- per - resident basis from Shorewood's neighbors. So far, Excelsior has given $2,500 for equipment. Love said Green- wood and Deephaven's donations have not been approved by the cities' councils yet. Love said he hopes to have the park "up and running by next year." Neighbor of proposed park feels ignored To the editor: I am a concerned senior living near the proposed park area being planned for skateboarding. The City Council has been repeatedly advised of our concerns re: the po- tential disturbance to our small re- tirement community, e.g. parking limitations, noisy, drug use, garbage, no adequate police super- vision, etc. The Council members and particularly the mayor have indicated that they do not consider our concerns relevant. No time for senior concerns — who do you think well vote for at the next election? It is possible that this could be accomplished by simply modifying some of our current administrative practices. As you are aware the fee that was adopted is $5.00 per player per sport per year. Through all the discussions relative to user fees the component that has been most elusive is the number of participants for each of the sports. While representatives of the sports organizations have suggested "ball park" numbers (seems like an appropriate phrase here!) of their participants, the exact numbers are somewhat unknown at present. We have checked with Minnetonka Community Education Services to see if they receive rosters of players for purposes of scheduling fields and rinks. They neither require nor need to know how many players there are. Their primary interest is in the number of teams. So it is necessary for us to obtain some sort of master roster from each of the sports organizations. We have to believe that such rosters exist for purposes of communication within each league. The next question is when to collect. From an administrative perspective it would be easiest for the City to do it all at one time at the beginning of the year, similar to the issuance of various licenses. It seems clear that this would not work for the sports organizations because their sign -ups are spread throughout the year, and they would not have a roster at the beginning of each year, unless rosters from the previous year were used. Consequently, we are suggesting that the roster and the fee for each year be PRINTED ON RECYCLED PAPER Memorandum Re: Collection of Park User Fees 1 September 2000 • submitted with the certificate of insurance that is already being required from the sports g q p organizations. Just as they can not start play until the insurance has been paid, they can not start play until the user fees have been paid. Exhibit A is a copy of the letter that is sent out to each sports organization prior to their respective season. It is recommended that staff simply modify this letter to include the requirement of the roster for the season and payment of the fees. A draft of the revised letter will be available for your review at your meeting on Tuesday, 5 September. It is important that the letter be clear, without seeming threatening, that in order to play, you have to pay. I will not be able to attend your meeting on Tuesday due to the normal Planning Commission meeting that night. Consequently, if you have any questions relative to this matter, please do not hesitate to contact me prior to Tuesday night's meeting. Since the office is closed on Monday for the Labor Day weekend, and Tuesdays are largely taken up by staff meetings, you may wish to try me at home on Monday afternoon or evening (763 -566- 8355).
