We are enclosing our Procedure for Drafting Ordinances and
Amending the Code for the convenience of and assistance to
anyone who may be drafting ordinances which amend your Code,
as well as to newly appointed or elected officials.
Clear and distinct instructions in an amending ordinance
regarding placement in the Code and detailing provisions which
the new legislation amends are important factors in eliminating
any chance for misinterpretation by the Codifier.
Please give a copy of the enclosed procedures to the appropriate
person or persons as an aid in ordinance preparation.

PROCEDURE FOR DRAFTING ORDINANCES
AND AMENDING THE CODE
1. Checking Code:
A. Before drafting a new ordinance, check the Code index to determine if
sections of similar subject matter are contained in the Code.
B. If sections with similar subject matter are found to be in the Code,
compare them against what is to be stated in the new ordinance.
IL Procedure for Drafting Ordinances: New ordinances often amend, repeal or
add new sections to the Code.
It is important when drafting these ordinances to mention, within the ordinance,
the affected Code section.
A. Effect of Title and Preamble of Ordinance: The title of an ordinance and
any introductory language appearing before the ordaining clause has no
legal effect. If the title states that it repeals (or amends or adds) certain
provisions, but the language after the ordaining clause does not so
state, the intended repeal, amendment or addition has not taken place.
B. Amending Existing Code Section: If the existing sections in the Code
can adequately cover the situation by being amended, the new
ordinance should simply amend these sections. Amend the Code section
specifically.
Examples: Section 10 -5 -1 of the Code is hereby amended to read as
follows:

Sections 10 -5 -1 through 10 -5 -8 are hereby amended to read as
follows:
C. Repealing Existing Code Section or Subsections: If the new ordinance
will completely supersede sections or subsections in the Code and there
are no replacement provisions, repeal the Code sections or subsections
specifically.
Examples: Sections through of the Code are hereby
repealed.

Dear Jackie,
Today I spoke with Bobbie Sweet, regarding the enclosed Ordinance
250 and the best way to handle. It will be a couple of months
before it is codified. In the meantime, I will need direction on
the best way to handle this and naturally the least expensive in
the long run. This ordinance will be reviewed again later in the
year.
Bobbie without seeing the ordinance suggested that a separate area
be set and change all code reference to show where located in the
code book. Am open to all suggestions. Furthermore, I will need
price proposals on each of the suggestions. Thank you so very much
and I look forward to hearing from you soon.
