Councilmember Sundberg arrived at the meeting at 7:02 p.m. 3. MATTERS FROM THE FLOOR Collette Morris — 5935 Afton Road, directed her comments to Director Brown and presented a picture of her curb and asked if she was still on his list. Director Brown stated that he was well aware of her concerns and explained for the benefit of the Council that there appears to have been plow damage along the curb. He stated that there is approximately one week of sweeping and water main flushing left and about a week after those are completed the City can begin addressing sod and curb damage followed by the regular routine of patching roadways. Ms. Morris stated that she had been thinking that behind. Director Brown stated that he understands her concern but the City iA of weeks, so it will take some time to make the transition. Ms. Morris stated that she also had a comment on the possible new aloud a letter she had sent via e -mail to Mayor Zerby expressing her all. He stated that Cajed is being used as a cut through road and reiterated that garbage trucks were not the problem. David Eisenmann, 26320 Shorewood Oaks Drive, asked for an update on the status of the mediation talks between the Ashland Woods Development and the City. He stated that he and his neighbors read with great surprise that there was no neighborhood association that had been promised during a Planning Commission meeting years ago. He and his neighbors are worried about water drainage and have been for about 10 years. He stated that prior City employees, who have since retired, told them that there would be annual inspections and the City would walk through those properties and make sure the drainage paths are cleared, which, as everybody knows now has not happened. He stated that it was about 4 years ago on a rainy day in June their 10 of their homes flooded after that development was built and caused thousands of dollars of damage to their basements. Administrator Lerud stated that mediation has been scheduled for next week. He stated that in this case the developer recorded the developer's agreement, but not the Homeowners Association documents. Councilmember Siakel stated that it is her understanding that the City is not solving a water problem of something that happened as a result of Ashland Woods. She noted that she was on the Council four years CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES MAY 29, 2018 Page 3 of 8 ago when the rain event that Mr. Eisenmann was talking about and to her recollection it was a 100 -year rain and the flooding was not a result of the Ashland Woods development. She stated that she appreciated Mr. Eisenmann coming to talk to the Council but thinks he may be trying to tie two things together that do not belong together. Mayor Zerby stated that the Council agreed to the Ashland Woods development because the maintenance of the drainage system was to be handled by the HOA, so the City does need to ensure that it is completed, as it was presented. He asked for clarification from Director Brown on whether any walk - through inspections had been completed by the City. Director Brown stated that the City has specific agreements for regional facilities, but if it serves just the development, like this one does, it is part of this agreement that the HOA would be responsible for the annual walk through of those ponds. He noted that he agreed with Councilmember Siakel that the Shorewood Oaks issue is different than the Ashland Woods issue. Mayor Zerby asked if the City would have ever said it would handle the annual walk through inspections. He stated that he was trying to get clarity without having the minutes of the meeting, Mr. Eisenmann referenced. Councilmember Johnson stated that he is a resident of Ashland. Woods and his understanding is that if the HOA was in place, as it should be, then it would be up to the residents to submit to the City a report that it had been inspected, verified and was in good standing and if not, it would be up to the HOA to make those corrections. 4. PUBLIC HEARING - None 5. REPORTS AND I A. Met Court+ Administrator Lerud noted 7,708. 6. PARKS TIONS Population Estimates estimate for the City effective April, 2017 was A. Report by Larry Brown on 05 -18 -18 Parks Commission Meeting Director Brown gave a brief overview of what was discussed at the May 18, 2018 Park Commission Meeting. He stated that the Parks Commission spent time discussing ongoing maintenance plans for the parks and what items in the parks are key focus areas aesthetically, when people enter the parks. They will review a proposed checklist and be discussing this issue on their upcoming Park Tour. They also discussed the possibility of an Adopt A Park program similar to Hopkins and Edina. He stated that staff will be doing some more research to see some of the details of the programs and see what has helped them succeed. 7. PLANNING - None 8. ENGINEERING /PUBLIC WORKS A. Award Quote for Watermain Improvements, Howards Point Road CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES MAY 29, 2018 Page 4 of 8 Director Brown explained that staff has been discussing replacing the hydrant valves and bolts that have routinely give the City problems as the reclamation project is happening, since there is work happening anyway. He stated that C.S. McCrossan had been given the opportunity to bid out the change order however they kept giving excuses to extend the length of the contract that staff was not satisfied with. Staff has chosen to deal directly with Minger Construction and a quote was received for the valve repair and for adding services to four homes that are in the area for $49,090.40. Staff is recommending approval. Mayor Zerby asked what cost savings there may be for residents to hook up to the watermain services. Director Brown stated that there would not be a cost savings and the go onto private property and make any improvements. Councilmember Sundberg asked why only one bid was received foi Director Brown stated that there were two, but staff had vetoed., claimed this would add a delay in their mobilization and create an contract. Engineer Fauske stated that she has seen favorable bids coming in, so she thinks it is possible. Mayor Zerby asked what this would do to the City's fund balances. Administrator Lerud stated there are sufficient funds in the street and storm water funds, but an interfund loan from the sewer to the water fund will be necessary to fund the water work. Mayor Zerby confirmed that the City is planning to have an off -year next year and not complete any projects so there is time to replenish the funds and get ready for 2020. CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES MAY 29, 2018 Page 5 of 8 Jim McFarland, 6120 Riviera Lane, noted that Engineer Fauske has been great about communicating and sharing plans with the residents, but he still had a few questions. He asked if the properties on Yellowstone Trail would share the cost for the project or if the costs would just be focused on the residents of Riviera Lane. Engineer Fauske stated that because of the importance of creating the loop in the watermain system with the commercial area, it is being recommended that rather than an assessment process that the project be funded from the City funds and that properties who connect to the watermain have a connection charge. Mr. McFarland expressed concern from one of his neighbors that their existing pond may dry up if the drainage is changed to flow through the area differently. Engineer Fauske stated that she did not have that information at her fingertips, but, would be happy to provide that information to Mr. McFarland and the neighbor who is concerned about the pond levels. Mr. McFarland stated that he received a copy of the preliminary' design and was, quite surprised at the proposed tree loss. He stated that plans seem to require that 70 mature trees will be taken out and 5 of them are on his property. He asked if there were any options to reduce the number of trees that wouldbe affected by the project and whether there would be any efforts made to'reforest and replant the area. Engineer Fauske stated that the plans show tree removal based on what the City believes to be the worst - case scenario. She stated that the plans had been sent to S &S Tree experts for their opinion, because the City is sensitive to the neighborhoods desire to keep as many trees as possible. Councilmember Siakel stated that when this comes back before the Council, she would like to see more details about tree removal and some insight from the forester would be helpful. She stated she would also like to continue the discussion about benefitting properties and assessment because she feels the City should be treating people the same. Siakel moved, Johnson seconded, Adopting RESOLUTION NO. 18 -056, "A Resolution Approving Plans and Specifications and Authorizing Advertisement for Bids for the 2018 Reconstruction of Riviera Lane, Mann Lane and Shorewood Lane, and the Watermain Extension Along Yellowstone Trail (Club Valley Road to Riviera; Lane), Rivera Lane, State Highway 7(Riviera Lane to Lake Linden- brive) and Lake Linden Drive'(State Highway 7 to 6140 Lake Linden Drive), City Project 17 -04." Motion passed 4/0. C. ADDroval of Echo Road Easement: 5745 Echo Road Engineer Fauske reviewed the location of the easement at 5745 Echo Road and the feedback from the residents about the existing drainage patterns. She noted the existence of an existing pipe that is cracked and no longer functioning and presented photos that showed erosion in the area. Staff is recommending this easement to install some storm pipe and connect to the storm system and discharge it to improve the drainage system and reduce erosion. Siakel moved, Johnson seconded, Approving the Drainage and Utility Easement for 5745 Echo Road. Motion passed 4/0. D. Review Proposal to Evaluate Minnetonka Country Club Drainage CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES MAY 29, 2018 Page 6 of 8 Administrator Lerud stated that after the last meeting where the Mott's presented their belief that Mattamy Homes has caused drainage issues on their property, staff decided that an outside third party should look at the plans submitted and offer an opinion on the modeling and also complete some survey work on the site. Councilmember Siakel stated that she thinks this is a really good idea since the homeowner is saying one thing and the builder saying another. She asked if this is something that can be referred to, not just for the Mott property, but for the development as the Minnetonka Country Club is built out. Attorney Keane stated that was exactly why staff was recommending contracting with a third party to give an opinion on drainage issues in the area. He noted that Barr Engineering specializes in surface water management. Councilmember Sundberg asked if the Mott's were aware of this proposal and were supportive of the idea. Administrator Lerud stated that they were aware of the staff recommendation. . Councilmember Johnson asked if the final report came back with significant differences if the City would go back to the developer and have him pay for this work. Attorney Keane noted that it was premature to judge any course of action until there is a sense of what the findings are: Councilmember Siakel asked that Barr session to explain the findings. Accept Bids and Engineer Fauske reviewed'' a joint effort with the cities make a Dresentation to the Council at a future work pprove the Proposal for Barr Engineering to review and drainage at a cost not to exceed $12,500. Motion passed Contract for the 2018 Seal Coat Improvements reets for the 20f8 seal coat improvements. She noted that this is I Minnetrista in order to reduce the overall project costs. Mayor Zerby noted that the plans include a large chunk of the west end of the City. He stressed the importance of good communication with residents throughout this project. He stated that he also thought Excelsior vas planning someixrprovements at 19 and Water Street which may close the intersection. He suggested looking at the timing of that project so it didn't create problems with traffic funneling through the area. Engineer Fauske improvements. will check with the City of Excelsior to find out the timing of their Mayor Zerby stated that he felt the usual signage that gave people the information on the construction and road closure plans which would include a start and end date would be helpful. Director Brown stated that the sealcoating process is very quick process and road closures are generally very brief. Sundberg moved, Siakel seconded, Approving RESOLUTION NO. 18 -057, "A Resolution Accepting Bids and Awarding Contract for the 2018 Seal Coat Project ", to the lowest responsive bid received CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES MAY 29, 2018 Page 7 of 8 for the Shorewood schedule, submitted by Allied Blacktop Co, of Maple Grove, MN, City Project No. 18 -05. Motion passed 4/0. 9. GENERAL /NEW BUSINESS - None 10. STAFF AND COUNCIL REPORTS A. Administrator and Staff 1. Monthly Budget Report Administrator Lerud stated that Interim Finance Director Rigdon is getting back on schedule in preparing the monthly budget reports. He noted that it appears to be proceeding as a very normal budget year, thus far. Mayor Zerby stated that he thinks the expenses for snow and ice removal maybe much larger than anticipated. Director Brown stated that he can address the large expense in the off - season. He explained that at the end of the salt season, the City tries to take advantage of the remaining contract balance of salt because the City has to take at least 80% of the contracted, amount and try to fill up the salt shed for the next year. Administrator Lerud stated that he did not have any information other than the information that was sent out via text when Pat McCarthy returned to the fire hall immediately after the fire. Mayor Zerby noted that he thinks 10 area fire departments responded and the City owes them gratitude for their assistance. He stated that two officers were sent to the hospital, one from Long Lake and one from Victoria because of the battling the fire in such extreme outside temperatures. B. Mayor and City Council Councilmember Siakel noted that she had attended the Park Board meeting and as part of the CIP discussion, she had thoughts that she didn't think the Park budget had ever been upped and has been around $40,000 since she started on the Council. She stated that for maintenance of the parks, she thinks the City may want to consider giving them a larger budget because she doesn't thinly what has been done is sufficient for future needs. Background: It takes many dedicated people to run and staff a successful election. This year we have recruited seventeen new election judges in Shorewood to add to our experienced judges. A huge thanks to all of those civic - minded individuals for their service! Elections administration is a continuum of a well -oiled machine with as many as ten judges in precincts 2, 3, and 4 and four or more serving precinct 1 on the Island. Trained election judges come and go, move from the community /state and retire from the work, and even include student judges. It is important to keep infusing new talent into the pool of election judges so that they can learn from the many years of experience of existing election judges. The attached resolution approves the list of Election Judges who are available to officiate at the Primary Election on August 14, 2018 and the General Election on November 6, 2018. It also provides the City Clerk the authority to assign additional individuals to serve as an Election Judge, if needed. Each municipality is required to establish an Absentee Ballot Board appointed by the council for both the Primary and General Elections for the purpose of processing the absentee ballots pursuant to Minnesota State Statute 20313.121. Walk -in absentee ballots for all precincts will be processed at City Hall; it is anticipated that two election judges may be selected to serve as the Absentee Ballot Board at City Hall. Mailed, military, and overseas absentee ballots are processed by Hennepin County. The attached resolution provides for these appointments. Financial or Budget Considerations: Election Judge expenses is included in the 2018 budget. S: �Parks�Badger Park�2017 -201H rehab Council CAF and Resolu tion RCAF 1H0612 Authorization Execution of County Agreemen t. docx Contract No: PR00000334 AGREEMENT FOR Badger Park This Agreement is between the County of Hennepin, State of Minnesota ( "COUNTY "), A -2300 Government Center, Minneapolis, MN 55487, and the City of Shorewood located at 5755 Country Club Rd, Shorewood, MN 55331 ( "LOCAL UNIT OF GOVERNMENT " herein "LGU"). Recitals Section 473.757, subd. 2 of Minnesota Statutes authorizes Hennepin County to make grants for youth activities and youth and amateur sports within Hennepin County with certain fiends collected as part of the sales tax authorized in Section 473.757, subd. 10 of Minnesota Statutes. 2. Pursuant to Hennepin County Board Resolution 09- 0320R3, Hennepin County created the Hennepin Youth Sports Program. The Hennepin Youth Sports Program makes grants for youth sports and activities and amateur sports within Hennepin County. For 2018, as part of the Hennepin Youth Sports Program, by Resolution No. 18- 0138R1, Hennepin County authorized an award of $25,000 to the LGU for playground project at Badger Park, 5745 Country Club Rd, Shorewood, MN 55331 NOW, THEREFORE, the parties hereto do hereby agree as follows: The parties agree as follows: TERM The LGU agrees to complete and provide all necessary documentation for payment for the Project described in Section 2 between January 1, 2018 and July 31, 2019. 2. PROJECT CONTRIBUTION USE OF FUNDS MARKETING AND REPORTING The LGU shall be responsible for construction of the "Project" in accordance with the application submitted by the LGU to the Minnesota Amateur Spoils Commission. The LGU's "Application" for the Project dated 03/14/2018 is on file with Hennepin County and this Application is incorporated into this Agreement by this reference. Pursuant to the terms herein, the COUNTY shall contribute to the LGU an amount not to exceed $25,000. The LGU shall be solely responsible for securing all additional funds needed for completion of the Project. The LGU shall use all funds received under this Agreement for construction of the Project. The parties shall cooperatively and collaboratively develop Project marketing including but not limited to a permanent plaque or sign, news releases, public announcements, social media, video, civic opportunities, logos and community events. The LGU shall not unreasonably refuse or withhold participation from any COUNTY initiated marketing project, plan or strategy. The LGU shall provide advance copy of the LGU's independently developed messaging and marketing materials regarding the Project to COUNTY for review and approval. COUNTY may, in its sole discretion, reject any proposed marketing if COUNTY determines the proposed marketing does not reflect the spirit or intent of the Project, this grant or is otherwise contrary to COUNTY's best interests. Upon completion of the project, the LGU shall provide information, data, statistics and other metrics related to the project, facilities, participants and /or related activities, including but not limited to usage numbers, who is using the park, and what changes in usage were noted. This information shall be provided within one year of completion and on an annual basis for two years thereafter. PAYMENT FOR SERVICES Upon completion of the Project, the LGU shall submit a Certificate of Occupancy (when applicable) and /or an Affidavit of Project Completion (See Attachment A), as directed by COUNTY. Upon COUNTY's confirmation that the Project is complete, the LGU shall submit invoices for Project expenses with a Reimbursement Request letter in substantially the same content and character as Attachment B. If the total cost of the completed Project is less than the amount identified by the LGU in the budget the LGU submitted for the Project, the COUNTY's payment will be reduced based on a pro rata share of the difference between the budgeted amount and the actual amount. Payment shall be made directly to the LGU upon the presentation of a complete claim in the manner provided by law governing the COUNTY'S payment of claims and /or invoices. Payment shall be made within forty -five (45) days from receipt of the invoice. 4. PROFESSIONAL CREDENTIALS INTENTIONALLY OMITTED 5. INDEPENDENT CONTRACTOR LGU shall select the means, method, and manner of performing the services. Nothing is intended or should be construed as creating or establishing the relationship of co- partners 2 between the parties or as constituting LGU as the agent, representative, or employee of the COUNTY for any purpose. LGU is and shall remain an independent LGU for all services performed under this Agreement. LGU shall secure at its own expense all personnel required in performing services under this Agreement. Any personnel of LGU or other persons while engaged in the performance of any work or services required by LGU will have no contractual relationship with the COUNTY and will not be considered employees of the COUNTY. The COUNTY shall not be responsible for any claims that arise out of employment or alleged employment under the Minnesota Economic Security Law or the Workers' Compensation Act of the State of Minnesota on behalf of any personnel, including, without limitation, claims of discrimination against LGU, its officers, agents, LGUs, or employees. LGU shall defend, indemnify, and hold harmless the COUNTY, its officials, officers, agents, volunteers, and employees from all such claims irrespective of any determination of any pertinent tribunal, agency, board, commission, or court. Such personnel or other persons shall neither require nor be entitled to any compensation, rights, or benefits of any kind from the COUNTY, including, without limitation, tenure rights, medical and hospital care, sick and vacation leave, Workers' Compensation, Re- employment Compensation, disability, severance pay, and retirement benefits. NON - DISCRIMINATION A. In accordance with the COUNTY's policies against discrimination, LGU agrees that it shall not exclude any person from full employment rights nor prohibit participation in or the benefits of, any program, service or activity on the grounds of race, color, creed, religion, age, sex, disability, marital status, sexual orientation, public assistance status, or national origin. No person who is protected by applicable Federal or State laws against discrimination shall be subjected to discrimination. 7. INDEMNIFICATION LGU agrees to defend, indemnify, and hold harmless the COUNTY, its officials, officers, agents, volunteers and employees from any liability, claims, causes of action, judgments, damages, losses, costs, or expenses, including reasonable attorney's fees, resulting directly or indirectly from any act or omission of LGU, a subcontractor hired by the LGU, anyone directly or indirectly employed by them, and /or anyone for whose acts and /or omissions they may be liable in the performance of the services required by this Agreement, and against all loss by reason of the failure of LGU to perform any obligation under this Agreement. Nothing in this Agreement constitutes a waiver by the LGUs of any statutory or common law defenses, immunities, or limits on liability. The LGUs cannot be required to pay on behalf of themselves and COUNTY to a third party, any amounts in excess of the limits on liability established in Minnesota Statutes Chapter 466 applicable to any one party. The limits of liability for COUNTY and LGUs may not be added together to determine the maximum amount of liability for LGUs. DATA PRACTICES LGU, its officers, agents, owners, partners, employees, volunteers and subcontractors shall abide by the provisions of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13 ( MGDPA), the Health Insurance Portability and Accountability Act and implementing regulations, if applicable, and all other applicable state and federal laws, rules, regulations and orders relating to data privacy or confidentiality. If LGU creates, collects, receives, stores, uses, maintains or disseminates data because it performs functions of the COUNTY pursuant to this Agreement, then LGU must comply with the requirements of the MGDPA as if it were a government entity, and may be held liable under the MGDPA for noncompliance. LGU agrees to defend, indemnify and hold harmless the COUNTY, its officials, officers, agents, employees, and volunteers from any claims resulting from LGU's officers', agents', owners', partners', employees', volunteers', assignees' or subcontractor's unlawful disclosure and /or use of such protected data, or other noncompliance with the requirements of this section. LGU agrees to promptly notify the COUNTY if it becomes aware of any potential claims, or facts giving rise to such claims, under the MGDPA. The terms of this section shall survive the cancellation or termination of this Agreement. 9. RECORDS — AVAILABILITY /ACCESS Subject to the requirements of Minnesota Statutes Section 16C.05, Subd. 5, LGU agrees that the COUNTY, the State Auditor, the Legislative Auditor or any of their authorized representatives, at any time during normal business hours, and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which are pertinent to the accounting practices and procedures of LGU and involve transactions relating to this Agreement. LGU shall maintain these materials and allow access during the period of this Agreement and for six (6) years after its termination or cancellation. 10. SUCCESSORS SUBCONTRACTING AND ASSIGNMENTS A. LGU binds itself, its partners, successors, assigns and legal representatives to the COUNTY for all covenants, agreements and obligations contained in the contract documents. B. LGU shall not assign, transfer or pledge this Agreement and /or the services to be performed, whether in whole or in part, nor assign any monies due or to become due to it without the prior written consent of the COUNTY. A consent to assign shall be subject to such conditions and provisions as the COUNTY may deem necessary, accomplished by execution of a form prepared by the COUNTY and signed by LGU, the assignee and the COUNTY. Permission to assign, however, shall under no circumstances relieve LGU of its liabilities and obligations under the Agreement. rd C. LGU may subcontract for the services to be performed pursuant to this contract. Permission to subcontract, however, shall under no circumstances relieve LGU of its liabilities and obligations under the Agreement. Further, LGU shall be fully responsible for the acts, omissions, and failure of its subcontractors in the performance of the specified contractual services, and of person(s) directly or indirectly employed by subcontractors. Contracts between LGU and each subcontractor shall require that the subcontractor's services be performed in accordance with the terms and conditions specified. LGU shall make contracts between LGU and subcontractors available upon request. 11. MERGER AND MODIFICATION A. It is understood and agreed that the entire Agreement between the parties is contained herein and that this Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter. All items that are referenced or that are attached are incorporated and made a part of this Agreement. If there is any conflict between the terms of this Agreement and referenced or attached items, the terms of this Agreement shall prevail. B. Any alterations, variations, modifications, or waivers of provisions of this Agreement shall only be valid when they have been reduced to writing as an amendment to this Agreement signed by the parties. 12. DEFAULT AND CANCELLATION A. If LGU fails to perform any of the provisions of this Agreement or so fails to administer the work as to endanger the performance of the Agreement, it shall be in default. Unless LGU's default is excused by the COUNTY, the COUNTY may upon written notice immediately cancel this Agreement in its entirety. Additionally, failure to comply with the terms of this Agreement shall be just cause for the COUNTY to delay payment until LGU's compliance. In the event of a decision to withhold payment, the COUNTY shall furnish prior written notice to LGU. B. The above remedies shall be in addition to any other right or remedy available to the COUNTY under this Agreement, law, statute, rule, and /or equity. C. The COUNTY's failure to insist upon strict performance of any provision or to exercise any right under this Agreement shall not be deemed a relinquishment or waiver of the same, unless consented to in writing. Such consent shall not constitute a general waiver or relinquishment throughout the entire term of the Agreement. D. This Agreement may be canceled with or without cause by either party upon thirty (30) day written notice. If COUNTY cancels this Agreement without cause upon thirty days written notice, COUNTY shall pay the LGU reasonable expenses incurred prior to the notice of cancellation. E. Provisions that by their nature are intended to survive the term, cancellation or termination of this Agreement include but are not limited to: INDEPENDENT CONTRACTOR; INDEMNIFICATION; DATA PRACTICES; RECORDS - AVAILABILITY /ACCESS; DEFAULT AND CANCELLATION; PROMOTIONAL LITERATURE; and MINNESOTA LAW GOVERNS. 13. CONTRACT PROCESSING AND ADMINISTRATION The Minnesota Amateur Sports Commission ( "MASC ") will serve as staff liaison in the grant process administration. Responsibilities will include but not be limited to: forwarding all required grant processing documents to LGU; and forwarding appropriate documents to COUNTY for processing and /or execution (i.e., grant contract and invoice requests). MASC will serve as contact for grant administration and /or processing inquiries. Thomas Rupp, or successor, shall manage this Agreement on behalf of the COUNTY and serve as contract liaison between the COUNTY and LGU. 14. COMPLIANCE AND NON - DEBARMENT CERTIFICATION A. LGU shall comply with all applicable federal, state and local statutes, regulations, rules and ordinances currently in force or later enacted. B. If the source or partial source of fiends for payment of services under this Agreement is federal, state or other grant monies, LGU shall comply with all applicable conditions of the specific referenced or attached grant. C. LGU certifies that it is not prohibited from doing business with either the federal government or the State of Minnesota as a result of debarment or suspension proceedings. 15. NOTICES Any notice or demand which must be given or made by a party under this Agreement or any statute or ordinance shall be in writing, and shall be sent registered or certified mail. Notices to the COUNTY shall be sent to the County Administrator with a copy to the originating Department at the address given in the opening paragraph of the Agreement. Notice to LGU shall be sent to the address stated in the opening paragraph of the Agreement. 0 16. PROMOTIONAL LITERATURE LGU agrees that the terms "Hennepin County" or any derivative shall not be utilized in any promotional literature, advertisements of any type or form or client lists without the express prior written consent of the COUNTY. 17. MINNESOTA LAWS GOVERN The Laws of the State of Minnesota shall govern all questions and interpretations concerning the validity and construction of this Agreement and the legal relations between the patties and their performance. The appropriate venue and jurisdiction for any litigation will be those courts located within the County of Hennepin, State of Minnesota. Litigation, however, in the federal courts involving the parties will be in the appropriate federal court within the State of Minnesota. If any provision of this Agreement is held invalid, illegal or unenforceable, the remaining provisions will not be affected. EMPLOYEE BENEFITS 7.01 Benefit Eligibility Regular, part-time employees, who work an average number of twenty (20) or more hours per week, shall receive employee benefits (i.e. vacation, sick leave, holidays, insurance, etc.) pro -rata based on the employee's regular weekly schedule in comparison to forty (40) hours per week. Benefit- eligible employees (a regular, part-time employee working a minimum of 20 hours per week but less than 3-2 30 hours per week) may participate in the City's health and life insurance programs if they wish to do so on a pro -rata basis of hours worked in comparison to forty (40) hours per week. (revised 7XW07; 12io9, 6Z12Z2018). For non - contract employees, the City shall pay an incentive payment of $100 per month for employees who select to opt -out of the Health Insurance Program. For contract employees, the City Administrator is authorized and directed to offer this benefit and execute with the appropriate labor organization, a letter of agreement regarding said benefit changes for unit employees. During a new or rehired employee's probationary period, vacation leave and sick leave shall be earned, but the employee shall not be allowed to take vacation until after completion of the probationary period. Sick leave may be taken during the probationary period not to exceed the sick leave time earned. The City reserves the right to change employee benefits in accordance with applicable law and contract. 7.02. Group Insurance A group insurance contract providing health, dental, life insurance, short-term, long -term and Accidental Death and Dismemberment (ADD) insurance benefits for the probationary and regular full -time employees and their dependents are offered by the City. All probationary employees are eligible to enroll in the group insurance program with the City; however, their coverage will commence subject to the terms and conditions of the City's contracts with its insurance carriers. The City will pay a monthly amount, to be determined by the City Council, toward group insurance premiums for regular and probationary full -time employees, and part-time employees working at least 32 30 hours per week, and their dependents. The insurance carrier shall be chosen by the employer, and a list of those available insurance carriers can be obtained by contacting the City Administrator. Notice of this application was mailed to all property owners within 500 feet of the property at least 10 days prior to the meeting. BACKGROUND Context. The property currently contains two buildings, a single - family dwelling which was built in 1912, and a detached garage of the same era. The lot is substandard for the R -IA, Single - Family Residential zoning district in which it is located. Consequently, Mr. Nill has requested a variance to build on a lot that does not meet 70 percent of the area requirement of the R- IA district. Nill Variance June 5, 2018 Mr. Nill's property is a rectangular- shaped lot located in the northeast quadrant of the intersection of Eureka Road and Mann Lane. The lot contains approximately 23,623 square feet of area and measures 117 feet wide at the 50 -foot building line. Neither the existing house nor the detached garage comply with current front or side yard abutting the street setback requirements. Mr. Nill proposes to remove both the house and detached garage in favor of a new home with an attached garage that will comply with all setback requirements of the R- IA zoning district. The floor plans and building elevations for the proposed new home are shown on the attached construction documents. Mr. Nill explains his request in the Applicant's Narrative. ANALYSIS A. Substandard Lots of Record. Section 1201.03 Subd. 2.c.(3) of the Shorewood Zoning Code provides criteria for building on a substandard lot of record (a lot that existed prior to current zoning requirements and does not meet area or width requirements). The Code states that a lot is considered to be buildable if it complies with the following criteria: 1. The lot must be in separate ownership from adjoining properties. Mr. Nill does not own either of the adjacent properties. 2. The lot must meet at least 70 percent of the width and area requirements for the zoning district in which it is located. This requires a lot to be at least 84 feet wide and 28,000 square feet wide in the R -lA zoning district. Mr. Nill's lot is 4377 square feet short of the area requirement. The variance is discussed in B., below. 3. The proposed buildings must comply with the setbacks of the zoning district. The existing home as well as the detached garage on the property is 37 feet from the front and side abutting a street lot lines, where 50 is required. The proposed house complies with all of the R -IA setbacks. 4. The floor area of structures can not exceed 30 percent of the area of the lot. Total hardcover can not exceed 33 percent of the lot. The floor area of the proposed house and garage are 15.5 percent of the lot area. Hardcover would only amount to 16 percent and that figure includes a potential future 10' x 12'garden shed (not shown on survey). B. Variance. Section 1201.05 Subd. 3.a. of the Shorewood Zoning Code sets forth criteria for the consideration of variance requests. Following is how the applicant's request conforms to the criteria: -2- Nill Variance June 5, 2018 The variance, and its resulting construction and use, is consistent with the intent of the comprehensive plan and in harmony with the general purpose and intent of the zoning code. 2. Practical difficulties: Practical difficulties include three factors, all three of which must be met. Staff finds that the practical difficulties for the property are related to the original plat of the area. (a) Reasonable: The applicant has designed the new home to comply with setback requirements that are intended for lots twice the size of the subject property. (b) Self - imposed: The size of the lot is not the result of any action by the applicant. The property is part of "DeCamps Subdivision of Meakers Outlots" which was platted in 1919. The lot was developed well before Shorewood was incorporated as a City. (c) Essential Character: The home that the applicant proposes to build on the lot will not adversely affect the character of the existing neighborhood. The lot itself is situated across the street (Mann Lane) from two other properties that are also substandard to the same extent. 3. Economic Considerations: The applicant's practical difficulty is not economic in nature. 4. Impact on Area: The property owner is not proposing anything that would impair an adequate supply of light and air to an adjacent property, increase the risk of fire or endanger public safety, or increase the impact on adjacent streets. 5. Public Welfare: The variance, and its resulting construction, would not be detrimental to the public welfare, nor would it be injurious to other land or improvements in the neighborhood. 6. Minimum Necessary: The variance is the minimum necessary to make reasonable use of the property. The proposed house and garage are very much in scale with the size of the existing lot. RECOMMENDATION Based upon the preceding analysis, the request is considered to be consistent with the criteria for granting a lot size variance. In the end, this property will conform far more to Shorewood's existing building and zoning standards than if the variance were not granted. Approval of the applicant's plans is therefore recommended. The existing house does not meet current set back requirements. We learned only recently that there is an ordinance that requires lot size to be 40,000 square feet. This lot is 23,200 square feet. We were not informed of this requirement prior to lot purchase nor over the course of several months of interaction with Shorewood officials during design process. This variance request is to allow us to build a house on the lot despite its smaller size. We are not clear about the intent of the lot size requirement. It appears that there are several new homes adjacent to our property which do not meet the requirement and our proposed home would be very consistent with the character of adjoining properties. Obviously, if we are not granted the variance it renders our investment useless. We believe that our proposed structure would be a desirable improvement over what is presently there. There would be no detrimental impact on adjacent properties in terms of light, air, congestion, or matters of public safety. The variance would not be .detrimental to the public welfare nor injurious to other lands or improvements. In fact it would be an improvement to the overall appearance of the neighborhood. She noted that the applicant would like to remove the existing home and detached garage and build a new home with an attached garage. She reviewed the requirements for granting a variance to build on a substandard lot and noted the applicant is planning to install a rain garden on the property to help offset the additional impervious surface that is proposed. She stated that staff is recommending approval. Commissioner Gorham asked if there had been variances granted for the homes next door. Director Darling stated that she did not think so because they are all older homes as well. She noted that the home to the east had met the criteria so a variance was not required for them to build the new home. Chair Maddy opened the meeting for public comment at 7:31 p.m. and being no comments were given, closed it at 7:31 p.m. Commissioner Gorham asked what state the current home is in because there is a statement in the applicant's narrative that says if the variance wasn't granted, it would render the investment useless. Commissioner Davis stated that the current home is an eyesore and she had almost turned it in to the City. Lynn Nill, stated that the property was sold to them with the existing house as a tear -down and was never advertised as habitable. ANC CITY OF SHOREWOOD RESOLUTION NO. 18- A RESOLUTION GRANTING A VARIANCE TO CONRAD LEE NILL ON PROPERTY LOCATED AT 5885 EUREKA ROAD WHEREAS, Conrad Lee Nil (Applicant) is the owner of real property located at 5885 Eureka Road, legally described as: Lot 1, DeCamp's Subdivision of Lot 6, Meakers Outlots, Hennepin County, Minnesota; and, WHEREAS, the Applicant has a lot with 23,623 square feet of area where the ordinance requires 40,000 square feet in the R -lA zoning district; and WHEREAS, the Applicant has applied for a variance to lot area to redevelop the lot; and WHEREAS, the Applicant's request was reviewed by the planning staff, whose recommendation is included in a memorandum for the June 5, 2018 meeting of the Planning Commission, a copy of which is on file at City Hall; and WHEREAS, the Planning Commission held a public meeting June 5, 2018 to review the application, the minutes of which meeting are on file at City Hall; and WHEREAS, the City Council considered the application at its regular meeting on June 12, 2018, at which time the planning staff memorandum and the Planning Commission's recommendations were reviewed and comments were heard by the City Council from the Applicant and staff, and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. The subject property is located in an R -IA zoning district, which requires 40,000 square feet of area per lot. 2. The existing home and garage on the property are nonconforming, being located less than 50 feet from the front property line and side lot line abutting a public street as required in the R -lA district. 3. The Applicants propose to remove the existing home and detached garage and build a new home with an attached garage. 4. The new home would meet all required setbacks. CONCLUSIONS A. The Applicants have satisfied the criteria for the grant of a variance under the Shorewood City Code and has established practical difficulty as defined by Minnesota Statutes. B. Based upon the foregoing, the City Council hereby grants to the Applicants a variance to redevelop a substandard lot of record as shown on the plans submitted May 17, 2018, subject to the following conditions: 1. Background: City staff has received numerous calls and complaints about contractor and construction workers' vehicles parking on city streets around this construction site. The complaints are based on access to the road, creating congestion, school bus and pedestrian safety, as well as visibility issues. Staff has tried to work with the construction project manager on these concerns, and there has been some effort on their part to address these concerns. The improvement has not been consistent, and the neighborhood complaints continue. In the public interest, it is the judgement of the staff that more restrictive parking measures are required. Options: 1. Approve Monday- Friday, 7:00 AM — 5:00 PM, no parking zones on the roadways affected by the construction at the site. These roads include Grant Lorenz, Birch Bluff, Edgewood, and Elmridge Circle. 2. Approve no parking as in option one, except permit a designated area immediately adjacent to the property on Edgewood that four vehicles (cars, trucks or trailers) could park on the north side of Edgewood. 3. Take no action. Financial or Budget Considerations: Depending on the council decision, there could be expense in purchasing and installing no parking signs. Recommendation / Action Requested: Staff recommends that the council adopt Resolution No. 18 -64 that restricts construction - related on- street parking in the area surrounding 26310 Birch Bluff Road. Next Steps and Timeline: Staff will implement the council's decision. You indicated that you had not seen noticeable improvement in the on-street parking situation. I disagree. As we told you during our meeting we would add a full time person whose only duties would be to direct and control traffic. VVe had a person \n place onthat same day. This person ia dedicated to working on that corner to aid in directing traffic not only for our construction project, but also with the increased traffic from the City's road work on Howards Point Road. That's not even considering the other construction of homes along Edgewood Road over the last few years, and the normal levels of traffic of the local citizens on these roads. parking in those sighted areas of Birch Bluff Road, Grant Lorenz and Edgewood Road. I could side with blocking of roads but that is not the case. Many of the added signs to limit and direct traffic in these areas of concern, had been installed by John Kraemer & Sons under the direction of the client in an effort to reduce our impact to the neighborhood, Regardless of whether or not your staff continues to receive complaints regarding the activity nnthose surrounding streets, we have received a great number of compliments for our efforts. Unfortuno1eky,| believe we have a silent majority of neighbors that like the investment that our client has brought to this neighborhood and the City as a whole. Early In the permitting process with the City, it was expressed that the City of Shorewood would prefer that client build this home in Shorewood and not at another site ina neighboring city.
