18-060CITY OF SHOREWOOD COUNTY OF HENNEPIN STATE OF MINNESOTA RESOLUTION 18 -060 • 1 1 � 1 111 1 '1 WHEREAS, the City of Shorewood regularly reviews the Shorewood Personnel Policy for compliance with local, state and federal regulations and best practices; and WHEREAS, for benefit plans beginning in 2016 employers may be subject to penalties if the organization meets the requirements and does not comply with Affordable Care Act (ACA) requirements to offer minimum essential health care coverage; and WHEREAS, in order for organizations to avoid penalties they must understand which employees are considered `full time' employees; and WHEREAS, In the year 2016, the ACA determined that a full -time employee is an individual reasonably expected to work at least 30 hours per week. WHEREAS, in review of Shorewood's Personnel Policy it was found that Section 7.01 Benefit Eligibility and 7.02 Group Insurance was never updated to include this 30 -hour full -time, benefit eligible status, but rather had it set at 32- hours. WHEREAS, this resolution updates the Shorewood Personnel Policy to bring the policy into compliance with the Affordable Care Act (ACA) requirements. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Shorewood hereby approves the updates to the Shorewood Personnel Policy, Section 7.01 and 7.02 changing the full -time benefit eligible status from 32 hours to 30 hours in compliance with the Affordable Care Act (ACA).
