MINUTES 1. CONVENE CITY COUNCIL WORK SESSION MEETING Mayor Zerby called the meeting to order at 5:30 P.M. A. Roll Call Present. Mayor Zerby; Councilmembers Siakel, and Sundberg; City Administrator Lerud; Finance Director Rigdon; Planning Director Darling; Director of Public Works Brown; and, City Engineer Fauske Absent: None. B. Review Agenda Siakel moved, Sundberg seconded, approving the agenda as presented. Motion passed 3/0. 2. CIP – CONTINUE DISCUSSION City Engineer Fauske noted that staff had taken the discussion items from the last few sessions and regrouped the updated pavement conditions and the PASER ratings to come up with some high-level cost estimates for the Council to consider. Councilmember Labadie arrived at 5:33. City Engineer Fauske stated that staff worked to make what they are recommending for 2019 more clear to the Council for projects using existing budget funds or with general obligation bonds. Councilmember Siakel noted that she felt the report was well prepared. She asked about MSA streets and MSA street funds and asked if the City had maximized those projects. She asked how the MSA funding worked. Director Brown stated that for MSA funding, the City receives two apportionments. The construction and maintenance allotment deposits actual money into the bank of about $180,000.00 per year. The second apportionment is held in an account at the State level and the City applies for reimbursement once the City has spent State aid dollars and that is around $220,000.00 per year. Councilmember Johnson arrived at 5:37. City Engineer Fauske stated that for State aid projects she recommends keeping the funding in one project rather than spreading it out over several projects, because of the amount of bookkeeping involved in State aid projects. City Administrator Lerud stated that he believes there is a negative balance currently because the Smithtown Trail was done with a commitment for future MSA dollars and he believes that at the end of 2017 there was a negative balance of in excess of $700,000. Finance Director Rigdon stated that it was a negative balance of $750,000. 2A Mayor Zerby stated that Enchanted Point is on the list as part of the recommended projects for 2019. He noted that the Council had discussed in the past raising the question of who should fund the road for paving an unpaved road. He stated that they had discussed the option of the general tax payers or just the residents of the road. He stated that paving the road will bring value to their homes and perhaps the residents should bear some of the costs. He understands that it is a short road and it makes sense to do it at the same time as the others in the area. Public Works Director Brown stated that the City has three gravel streets; Wiltsey Lane, Enchanted Point and Maple Avenue. He noted that the City has considered vacating Maple Avenue and shifting the one driveway that takes access off it over to Church Road. He stated the cost would be quite steep for residents on some of these gravel roads where there are no houses on the other side of the road. Councilmember Siakel asked if the gravel roads needed to be paved or if they could remain gravel. Public Works Director Brown stated there are three options: gravel, autoseal, or paving. He noted that the City had done the autoseal process in the past and it worked well, and the residents seemed pleased with it also. He stated that this option is significantly cheaper than paving. Councilmember Johnson asked how long the autoseal would last. Public Works Director Brown stated that there is about an eight-year life span before it starts to look ragged. Councilmember Siakel asked if any residents had requested the paving. Public Works Director Brown stated that some residents had requested it. Mayor Zerby would be interested to know the different in the pricing between the autoseal method and the paving and perhaps have a neighborhood discussion and see if the neighborhoods are interested in absorbing some of the costs for the upgrade. Councilmember Labadie stated that she would be interested in taking the costs out, for example twenty years, because having to redo a road in eight years should be factored into the overall cost. She stated that she would like the cost comparison to be apples to apples and asked about the life the pavement. Mayor Zerby stated that it seems like Eureka Road will need to be done sooner than 2024. He suggested flipping that road with the planned 2020 Road, Excelsior Boulevard. Public Works Director Brown stated that when staff looks at the roadways they also wrestle with how to rework the watermain links. He stated that he agreed that Eureka Road and Grant Lorenz are in very difficult shape. He stated that staff had chosen to work the watermain from the other end of the City. He suggested moving Edgewood Road to 2024 and keeping Excelsior Boulevard in 2020 plans. Councilmember Siakel stated that all of these roads are important and it appears as though the life cycles of the roads have all converged at one time. She stated that to bring up something Mayor Zerby has brought up in the past that the City should ask the residents about water hook ups. She stated that if two-thirds of the neighbors do not want water, perhaps the City should not have the added expense of installing the infrastructure. She asked about the possibility of bonding for more than $2.5 million to get more of these big projects done since interest rates are currently low. City Administrator Lerud stated that there will be a bond this year and then probably another subsequent two or three bond issues for upcoming years for future projects. He explained that the goal with these recommendations is to get these individual areas done and give time to look at the logical place to move forward and structure the debt. He stated that as far as the idea of doing a larger project in 2019, he understands Councilmember Siakel’s point, however, it is getting kind of late to do a much bigger project. 2A Councilmember Siakel asked if the City could bond for a larger amount of money now, but not complete all the work in 2019. City Administrator Lerud noted that he believes the projects could be put off to 2020 and still use the original bonding funds. He distributed a flow chart for looking at water hook ups. Councilmember Labadie asked if the City was looking at a percentage of households in a neighborhood that are interested in water hook ups. City Administrator Lerud suggested setting the percentage at something that is greater than the majority, perhaps sixty or sixty-five percentage and if that is the Council’s policy, then those residents get water. Public Works Director Brown stated that the ordinance currently states sixty-six percent. Councilmember Labadie stated that she thinks back to when the Council was originally discussing the country club project and the phrase was used that these were “generational decisions”. She stated that she thinks this is how the Council needs to look at water, as a generational decision. Mayor Zerby stated that the watermain availability was put in on Smithtown in 1994 or 1995 and people are still not hooking up. He stated that if he approached this as a business owner it would take a long time to see a return on his investment. He stated that perhaps there can be a “pre-sale” of connections included in the survey. Councilmember Siakel suggested some sort of incentive and noted that the City had charged $10,000 in the past and suggested offering an incentive of $7,500 if you sign up ahead of time, $10,000 at the time, and if you decided to hook up afterwards it would be the market rate, which she thinks is around $15,000. Councilmember Labadie stated that four years ago when she put her hat in and decided to run for Council, the number one question she was asked by residents was about her position on water hook ups. She stated that she believes the decision needs to be backed up by the ordinances because of what happened with just the thought of collective waste hauling. She stated that people are very passionate about choice and government involvement. Councilmember Siakel stated that she thinks the Council is considering more choice than they currently have if the City offers an incentive program. She asked staff what would happen if the City had bonded for money and then came through the neighborhood and the residents did not want to have water hook ups. She gave an example of Glen Road, which would have $450,000 for that purchase and asked what would happen with that bonded money if the residents did not want water. City Administrator Lerud explained that the bond money would be just for street work only. Councilmember Johnson noted that all three Enchanted streets are given a PASER rating of seven. City Engineer Fauske noted that these roads were seal coated two years ago which automatically brings the rating up to a seven and explained the roads will start deteriorating based on the number it started at before the sealcoat. Councilmember Johnson stated that he understands that, but that type of information it is not visible to the constituents. Councilmember Labadie reiterated her desire to know the price difference between doing another sealcoat and paving. City Administrator Lerud noted that is something the staff can take a look at after the road cores come in to see if a sealcoat would be a better idea and then consider bonding for a slighter larger amount and including Edgewood Road or Noble Road. He stated that staff can look at gathering more information and bring it back to the Council for a decision, but noted that it will need to be decided on relatively quickly in order to be done in 2019. Councilmember Siakel asked when the City Hall bonds would be coming off the books. Finance Director Rigdon stated that the City Hall bonds will come off in 2028. 2A City Engineer Fauske stated that if there was a way to authorize some of the work such as preparation of feasibility study and the pavement corings rather quickly, that would help with the timing. She noted that the islands could be added to the feasibility study after the pavement coring results are received. Mayor Zerby noted that it looks like the time for the 2019 projects is running out and stated that he could support staff recommendations for the 2019 street projects. Councilmember Siakel stated that she was in favor bonding and biting off something big so the City can get some of these projects done. Public Works Director Brown stated that staff will get information back to the Council as soon as they can. 3. WATER CONNECTIONS City Administrator Lerud stated that there are about 290 parcels that have water available but are not connected to the system. He explained that staff has looked at all the assessment projects done since 1985 and found about 68 parcels that have been assessed but not connected. Staff would like to do a few things: let residents know that it is available; offer testing through a contracted company; offer the option of paying the assessment at $1,000 a year with no interest until paid in full. He suggested keeping this option open until the end of 2019, and after January 1, 2020, if residents choose to connect, it will be at a higher rate. He stated that staff has heard from residents who would like to have City water. He stated that residents may not know that they can keep their well for irrigation purposes. Councilmember Sundberg asked if there would be some sort of educational component along with the options. City Administrator Lerud stated that there would be but he was not sure how it will look yet. Councilmember Sundberg asked if there have been many contaminants found in well water. City Administrator Lerud noted that arsenic has been found in some private wells in the city. Councilmember Labadie noted that there was a good job done a few years ago educating the public on radon and getting the detection devices installed in homes. Public Works Director Brown noted that there is flyer that was created about hooking up to City water. He noted that it is still used but needs to be updated. Councilmember Labadie asked how many people hooked up to water on Star Lane and Star Circle. City Engineer Fauske stated that about 40 percent of people in that project area have not hooked up to City water. City Administrator Lerud noted that paying $10,000 to hook up to City water is actually cheaper than a new well, which is around $15,000-$17,000. Councilmember Sundberg suggested that kind of information be highlighted for people because many of the wells in the City should be getting pretty old. City Administrator Lerud will bring back a draft of the educational plan and the mailings for residents to a future meeting. Councilmember Labadie suggested holding an Open House question and answer session with an engineer present. She stated that she would like to see this provided to all residents, not just certain streets. Mayor Zerby suggested having something like that in conjunction with another City event rather than having something scheduled separately. 4. 2019 OPERATING BUDGET Finance Director Rigdon reviewed the expenditures and noted that the budget is preliminarily set at $6,319,948. He noted that there is one additional part-time employee included in the budget that will be 2A half in Planning and half in Administration. He noted that the employee cost of living adjustment is included at three percent for 2019. Councilmember Johnson asked about the personnel related assumptions whether the time period of the overlap where the new building inspector and the current building inspector would both be employed at the same time had been accounted for. Finance Director Rigdon stated that his assumption is that overlap would be done by December. City Administrator Lerud stated that he believes the Building Inspector Pazandak will be done by the end of 2018. Finance Director Rigdon noted that the health insurance premiums are estimated to increase at ten percent and the employer contribution toward the premiums will increase $50 to $1,130 per month. He noted that a time study was done for the Public Works Department and the budgeting was adjusted to reflect the reality of their work hours. He noted that revenues are currently budgeted for $6,273,532. Councilmember Sundberg asked about the budget breakdown by department and whether this was typical for other cities he has worked with. Finance Director Rigdon noted that for most cities he has worked with it would typically break down to: 1. Public Safety, 2. Streets, and 3. General Government. He stated that they are currently proposing a use of reserves to balance the budget in an amount of $46,416, which is significantly less than last year when there was $174,097 budget for this purpose. He stated that the City could look at ways to eliminate this altogether and noted that he would personally like to see that so there is a structurally balanced budget. He reviewed the transfer for the Southshore Community Center and the Enterprise Funds. He stated that the preliminary property tax levy is at $5,530,322 and noted that the tax capacity rate has gone up while the tax rate has declined slightly, which means the property values have been increasing a little bit faster than what the City has been levying. He reviewed the tables that showed the impact for the property owners. Councilmember Siakel asked what were contractual services under Other Services and Charges. Finance Director Rigdon explained that it is for the police department service. Councilmember Siakel noted that she liked how he broke out under Other Financing Uses the Park improvement. She asked if the budgeted $42,000 was sufficient for what the Parks Commission needs to do. Finance Director Rigdon stated that this amount will be fine for a few years, but going out farther, that amount will not be enough. Councilmember Siakel asked if the Council could use some of the reserve funds to allocate money to park projects. Finance Director Rigdon stated that the Council could decide to use excess fund balance for that purpose. Mayor Zerby suggested looking at what the has actually been spent in the parks over the last few years and come up with an average and see about giving them money. Finance Director Rigdon stated that if the Council would look at the CIP for the Park Commission, $42,000 is not nearly enough on an annual basis to go toward the park improvements that have been identified. City Administrator Lerud stated that staff will present a preliminary budget for the September 10, 2018 meeting. 5. MATTERS FROM THE FLOOR CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES AUGUST 27, 2018 Page 2 of 6 George Greenfield, 24715 Yellowstone Trail, asked if the Council had received a report from the South Lake Police Department about the incident on July 13, 2018 on Oriole Avenue in Chanhassen. Mayor Zerby noted that the Council had received an e-mail with some of the information from the Police Chief, but was told that additional information would be coming from the agency in charge, which is Chanhassen. Mr. Greenfield stated that the SLPD informed him that they did not have a written report which to him seems odd considering the gravity of the situation. He stated that this matter happened more than five weeks ago and would ask that the Council contact the police to get a report to the City that can be reviewed by the public. He stated that he would hope the report would include information on the legal obligations of one police department that is asked to assist another police department in their jurisdiction. Mayor Zerby stated that this was a very serious matter and he would like to find out some more information. He will make a call to the Police Chief and find out if there can be more information that can be shared with the public. 4. PUBLIC HEARING 5. REPORTS AND PRESENTATIONS 6. PARKS 7. PLANNING A. Authorization of Riley Purgatory Bluff Creek Watershed District (RPBCWD) as the Local Governing Unit (LGU) for Wetland Conservation Act (WCA) Planning Director Darling explained that in 2008, the City entered into a joint powers agreement with the Minnehaha Creek Watershed District when the Riley Purgatory Bluff Creek Watershed District (RPBCWD) informed the City that it could not longer provide the relevant services to the City. She stated that the RPBCWD are ready to resume their role as the governing authority for the Wetland Conservation Act (WCA) permits and other general water permitting. Councilmember Sundberg stated that she is very supportive of this recommendation because the new RPBCWD staff has been in place for about three years and the Board is very competent and believes they are at a point where they can resume these responsibilities. Mayor Zerby asked if any revisions needed to be made to the Joint Powers Agreement with Minnehaha Creek Watershed District. Planning Director Darling stated that no changes will need to be made because it will automatically expire if the parties amicably agree that RPBCWD can take over these duties. Sundberg moved, Siakel seconded to approve, RESOLUTION NO. 18-082, “A Resolution regarding the Administration of the Minnesota Wetland Conservation Act and Other Duties”, appointing the Riley Purgatory Bluff Creek Watershed District as the Local Governing Unit for Permitting Administration of the Minnesota Wetland Conservation Act and Other Duties. Motion passed 5/0. 8. ENGINEERING/PUBLIC WORKS CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES AUGUST 27, 2018 Page 3 of 6 A. City Project 17-04, Mann Lane, Riviera Lane, Shorewood Land Street Reconstruction; Approve Change Order #1 City Engineer Fauske reviewed the items that have come up which require a change order in an amount of $10,801.73. She noted that one of the items was a wet tap watermain connection on Lake Linden Drive to avoid disrupting water services to Cub Foods. She stated that this change order is within the construction contingency. Siakel moved, Labadie seconded, Approving RESOLUTION NO. 18-083, “A Resolution Approving Change Order No. 1 for the 2018 Reconstruction of Riviera Lane, Mann Lane and Shorewood Lane and the Watermain Extension along Yellowstone Trail (Club Valley Road to Riviera Lane), Riviera Lane, State Highway Seven (Riviera Lane to Lake Linden Drive) and Lake Linden Drive (State Highway Seven to 6140 Lake Linden Drive)”, City Project 17-04. Motion passed 5/0. 9. GENERAL/NEW BUSINESS A. Southshore Center Update Administrator Lerud stated that the improvement project began last fall with the roof. He noted that all of the interior work had been completed, with the exception of the ceiling tile, which should be done shortly. He stated that staff is not ready to bring a recommendation of what to do with the circular ceiling are in the lobby. He stated that one thing that was not included in the budgeting process for this project was the lettering on the building as well as the other freestanding signs, a few televisions for presentation purposes and some furniture. He stated that staff is recommending this be paid out of an excess fund balance and be transferred into the project fund. He stated that staff is asking Council to decide on the new name for the building and staff is recommending Shorewood Community and Event Center. Johnson moved, Siakel seconded, Approving the Southshore Center be renamed to the Shorewood Community and Event Center. Motion passed 5/0. B. Milfoil Harvesting Mayor Zerby stated that he wanted to share information with the Council on information he had recently received regarding milfoil harvesting. He stated that Kathy and Dave Dalsin, 26860 Edgewood Road, are upset by the excess milfoil left behind during the harvesting process. He stated that they reported they spend an average of $1,500 cleaning it from their property. He showed some pictures of milfoil residue that is showing up around the City and a video that showed the harvester removing lily pads and not milfoil. He stated that there has been quite a bit of discussion about what the milfoil harvesting program accomplishes. He explained that there are other types of harvesting including hand pulling and a chemical process. He noted that the harvesters have been somewhat notorious for hitting things such as the power lines to Big Island and telephone cables in the water. He stated that he would like to ask the Council to ask the Lake Minnetonka Conservation District to pause the program for a year and see the impact that may have on the lake. He stated that the City of Orono and other interested entities, such as the Marina, have similar concerns about the harvesting. Councilmember Siakel asked if there was any way to tell what the impact of halting the program for a year would be. She stated that she feels the DNR has been missing in action on Lake Minnetonka. She stated that if the impact would have just a chance of being more of a nuisance it may garner some attention from the DNR. CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES AUGUST 27, 2018 Page 4 of 6 Mayor Zerby stated that he did not think there was a way to know what the impact will be until the harvesting is stopped. He stated that the permit with the DNR states that all the material must be removed, which is not happening. He knows that there are some residents who are considered potential legal action because they are in violation of the DNR permit. He reiterated that he would like to put the brakes on this program and look at these issues on a broader level. Councilmember Siakel noted that Mayor Zerby had referenced twenty percent of the weeds not being picked up by the harvesters and asked if there was a way to know how much milfoil is washed up due to regular boat traffic. She stated she would support taking a break to look at some other solutions to managing the lake. Councilmember Sundberg stated that she would feel more comfortable if there could be an expert brought it to give the Council a little more information about the effectiveness of harvesting and other options. Mayor Zerby stated that he will send a link to a University of Minnesota study and some other academic studies around this issue, but the science it not clear. He believes that the current approach on Lake Minnetonka is not effective and in essence is basically seeding other areas. Councilmember Siakel noted that to make the problem worse is that much of the milfoil is covered with zebra mussels. Councilmember Labadie stated that she agrees with Councilmember Sundberg and Councilmember Siakel and noted that there is also the starry stonewort plant that is also invasive. She stated that there is approximately 130 miles of shoreland around Lake Minnetonka and noted that even if the City banned the harvesting it may not have a large effect because of the remainder of the lake. She would like to get an expert in front of the Council to explain some things. She noted that she is unsure where Lake Winnipesaukee, that was referenced in the memo, is located and for what time period the study was conducted there. She stated that if there are other lakes that have stopped the harvesting of milfoil, she would like to see what their results are before the City Council decides. Councilmember Siakel stated that she is unsure if there is a lake that can compare to Lake Minnetonka because there are three harvesters and the program has been going on since sometime in the 80s. Mayor Zerby stated that the milfoil problem and getting it out of the lake is a whole other discussion. He stated that the issue is that the harvesting is creating more of a mess and dumping this material on both private homeowners and businesses along the lake. Councilmember Sundberg stated that she is sympathetic to the lakeshore owners, but since there is not anything particularly time sensitive, she would like to take a few more weeks to gather more information before a decision is made. 10. Monthly Budget Report Finance Director Rigdon noted that the property tax revenue came in fairly high and he attributes that to the early payoffs that people made because of the tax reform. He stated that the rest of the report is straight forward. CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES AUGUST 27, 2018 Page 5 of 6 Other Director Brown stated he had nothing to report. Mayor Zerby noted that Public Works was still down three employees. Director Brown noted that he was actually only down two employees. Mayor Zerby asked about how the staff levels effected the department and if Council should be aware of needs. Director Brown stated that one individual is out on medical leave and should have an answer soon for the long-term prognosis. He stated that for the other opening there are interviews scheduled with five candidates. Mayor Zerby stated that he feels the work seems to be lagging a bit, for example the SeeClickFix items relating to tree trimming. Director Brown stated that there are seasons to Public Works and explained some of the projects and the race between time and weather to finish some of the projects. Mayor Zerby asked if the City could call in S&S Tree Removal to help with some of these tree trimming issues and noted that some of the on-line comments were related to obstructed views for driving. Director Brown stated that from a cost standpoint, that is really something the Public Works Department needs to tackle because it is too expensive to bring in S&S Trees for those types of projects. City Engineer Fauske stated that the contractor for the reconstruction project had to end early today due to the rain, so there is still one more water service to be installed on Yellowstone Trail and will then follow with patching to get the pavement back up to grade. The goal is to get this completed before school so buses did not have to drive through a construction zone. She noted that the storm sewer has been installed on Riviera Lane and are waiting for the phone lines to be moved over. She stated that there is a weekly meeting tomorrow with the contractor to discuss the schedule to communicate with residents. She stated that once the patching along Yellowstone Trail is completed, the contractor will move over to Shorewood Lane. She stated that Mann Lane will be scheduled once Xcel has provided a design and relocation for a power pole. She stated that sealcoating was scheduled to start today, but with the rain, it is anticipated that it will be later in the week. She stated that an update on Mill Street is that Hennepin County is anticipating curb removal to start on September 5, 2018. She noted that the striping plan includes a striped shoulder which raised the question of parking along Mill Street. She stated that currently, Excelsior has no parking from the bridge to Five Corners. She stated that staff has asked for some feedback from residents and has been in discussion with Excelsior about the parking issue. She stated that she plans to share more on this situation at a future Council meeting. City Engineer Fauske noted that the City is close to closing out the reclamation project. Director Brown stated that City Engineer Fauske mentioned a Texas underseal which is a new method that sealcoats the lower layers of asphalt before the final wearing surface down. He understands that people may be confused as they are watching the project be completed because it is a new process with an extra step. Councilmember Labadie asked for an update on the Starbucks project because she has had residents asking about it in anticipation of school starting. Planning Director Darling stated that the developer is in for a permit request to construct the building and is just missing the financial guarantees piece to gain approval and receive the building and right-of-way permits. She noted that staff had discussed this internally and has plans to restrict the work in the public right-of-way if they do not finish before school starts and will only allow the hours between 9:00 a.m. and 2:00 p.m. to do construction on the right-of-way improvements. In the past, the City of Shorewood has held their Truth-in-Taxation meeting on the first Monday in December; in 2018 that date is December 3. The council will then hold their regular meeting on December 10, at which time the Council will approve a final property tax levy and budget. Options: Holding the public meeting is mandatory, but the council can change the date on the attached Resolution if it wishes. PUBLIC HEARINGS Vice-Chair Davis explained the Planning Commission is comprised of residents of the City of Shorewood who are serving as volunteers on the Commission. The Commissioners are appointed by the City Council. The Commission’s role is to help the City Council in determining zoning and planning issues. One of the Commission’s responsibilities is to hold public hearings and to help develop the factual record for an application and to make a non-binding recommendation to the City Council. The recommendation is advisory only. A. PUBLIC HEARING – 7:10 – PRELIMINARY PLAT AND LOT AREA VARIANCE. Applicant: City of Shorewood Location: 22000 Stratford Place Director Darling explained that this is a request from the City of Shorewood for a variance to lot area and lot width in order to create a buildable lot at 22000 Stratford Place. She noted that this property was created to construct a wellhouse that was decommissioned in 2008 and has sat vacant since that time. The property is currently an outlot, which is an unbuildable parcel by city code. She stated that the City has requested that the legal description be altered in order to assign it a lot/block legal description. She noted that any home constructed on the property would have driveway access off of Apple Road so the stormwater features on the south side of the property is not disturbed. Staff recommends approval and noted that the City has received two letters from nearby property owners indicating concerns about the stormwater feature in this location that overflows and water often sits on this property. Vice-Chair Davis opened the Public Hearing at 7:10 P.M. noting the procedures used in a Public Hearing. Dan Fisk, 6100 Apple Road, stated that his driveway runs along the boundary of this property. He stated that he is not averse to the development of suitable housing, but has not seen any plans for this property yet. He stated that he would echo the concerns that were mentioned about the drainage problems. He stated that during the spring melt, the run off floods his driveway as well as after heavy rainfall. He stated that he believes a home and driveway will increase the runoff from this property. He reiterated that run off is already an issue that needs to be addressed even without putting in a home. He stated that if the Planning Commission approves this as a buildable lot, he hopes that they will address this runoff issue. Vice-Chair Davis confirmed that the drainage structure that is in place is under Mr. Fisk’s driveway. Commissioner Riedel asked if this was a French drain type structure. Mr. Fisk stated that they moved in five years ago and the culvert was already in place. He reiterated that the current situation is not adequate for the amount of water that flows across there. Al Whittaker, 23020 Stratford Place, stated that he agrees that Mr. Fisk’s driveway does flood. He asked if any of the work on groundwater holding area would affect the intersection of Apple Road and Stratford Place and who would be assessed for the costs. There being no additional comments, Vice-Chair Davis closed the Public Testimony portion of the Public Hearing at 7:16 P.M. Director Darling stated that one of the reasons the stormwater basin has been overflowing is because it needs some maintenance and this cost will not be assessed to homeowners. She stated that she does not know of any roadwork that would be needed to accommodate this one home and reiterated that the driveway would access Apple Road. Commissioner Riedel asked if there was already a proposed buyer and if the lot would be sold on the open market. Director Darling explained that the Council did accept a Purchase Agreement for the property. She stated that the parcel was not for sale until the City was approached by someone interested in purchasing the property. She stated that the lot is somewhat compromised because of the drainage feature as well as the underground utilities that are still in place from the former wellhouse. She noted that the house plans do not include a basement. She stated that the property was appraised by the Hennepin County Assessor’s Office as well as an area realtor and the purchase price is in line with what those professionals indicated was a fair price. Commissioner Riedel asked if the purchaser of the property was aware of the concerns from the community and if they were still interested. Director Darling stated that they were aware of the concerns that had been raised and were still interested. Commissioner Riedel asked if Public Works was aware of the drainage issues in this area and if there were plans to include it in the long-term maintenance plans. CITY OF SHOREWOOD PLANNING COMMISSION MEETING AUGUST 28, 2018 Page 3 of 7 Director Darling stated that the drainage review was completed long before the e-mails from residents came in and noted that the City will be handling the maintenance of the basin because it is still City property. Vice-Chair Davis stated that this is beautiful piece of property, but the lot is very low. She asked where Apple Road falls in the road reconstruction plans because perhaps that reconstruction could help with some of the existing drainage issues. Director Darling stated that it is not planned within the next five years. Mr. Fisk stated that the road was worked on about two years ago. Commissioner Eggenberger asked what would be done for maintenance to the holding pond. Director Darling noted that it will be restored back to its original design. Commissioner Eggenberger asked about Mr. Fisk’s driveway and whether maintenance would include the culvert that runs under his driveway and perhaps making the culvert bigger. Director Darling stated that it is her understanding that the proposed maintenance would just be in the basin area. She stated that this culvert is not in City property and is not sure if it is in an easement or not. She stated that she will talk to the City Engineer about that issue. Commissioner Eggenberger stated that he was less concerned about approving this variance and looking towards what would happen when they tried to put a structure on the lot. He stated that now he is not sure that the two issues can be separated. He stated that he is not sure that he wants to approve something that will be a burden to other people in the neighborhood because of the water problems on the lot. Commissioner Riedel stated that he imagines once you making the holding pond deeper then the culvert run off wouldn’t be as affected and will be included in the stormwater management plan to clean out the basins every five or ten years. Commissioner Eggenberger asked if this variance was approved if it would have an affect on the variances that come from putting a dwelling on the lot. Director Darling noted that staff is not anticipating any variances for building a home and have been very clear with the buyer about the required setbacks and location of existing easements and how large the buildable area is. Vice-Chair Davis confirmed that the City will maintain the stormwater pond in perpetuity. Commissioner Riedel stated that if these variances are approved, this would move forward as a non- conforming lot and have to follow those guidelines. Director Darling stated that it will not be a non-conforming lot, it will conform to the ordinances, subject to the variances. Vice-Chair Davis stated that she does not see how this lot can be built on without bringing fill in because it is so low. She also thinks a swale will have to be created along the side lot line that hopefully will not drain onto Mr. Fisk’s property. She stated that she understands that her comments are possibly anticipating problems that do not exist yet, but feels it is a fair concern. He thinks any work done to the holding pond needs to include greater capacity than the original plans and current design. Commissioner Riedel stated that it is the City’s decision to sell this lot and the Planning Commission’s job is to see if the preliminary plat and the variances fit the requirements. He stated that it appears that the Planning Commission is debating whether they think it is a good idea to build there or not and that may not be the right question for the Planning Commission to be considering. Vice-Chair Davis stated that she agrees with Mr. Fisk that the stormwater holding pond likely should be enlarged to increase its capacity. Commissioner Gorham stated that many people have spoken about concerns with the runoff and suggested leaving it up to the City Engineers to determine whether the size of the holding pond is inadequate. Director Darling noted that the Engineering Department did run calculations based on the water that is flowing through the site and any increase, because of building a home, would be the responsibility of the buyer. Commissioner Gorham stated that the City would, in essence, be saying “buy at your own risk based on the information we gave you”. Eggenberger moved, Riedel seconded, to recommend approval of the preliminary plat and variances to lot area and width for the property at 22000 Stratford Place, with the request that the Council take into consideration the reservations the Planning Commission has about the buildability of the lot. MINOR SUBDIVISION AND SETBACK VARIANCE Applicant: Richard Denman Location: 5865 Glencoe Road Director Darling stated that this property is requesting a minor subdivision to create a new lot on the south side of the property to build a new home. She noted that the applicant is also asking for a setback variance in order to allow for a deck, porch and one cantilever would be constructed up to 20 feet where 30 is required. She noted that staff is recommending approval of the minor subdivision request with a few conditions. She stated that for the setback variance, the applicant has shown that the setback for Academy Avenue is larger than typical in the City. She noted that, if approved, this home would sit 42 feet away from the edge of the road which is greater than many homes in the area. She stated that staff is also recommending approval of the setback variance but notes that the applicant has met some of the conditions better than others. Commissioner Riedel asked why the right-of-way was so wide in this area. Director Darling noted that the right-of-way was dedicated with the plat but does not have a specific answer. She noted on the Glencoe side there are utilities close to the property line and on the Academy side there are also utilities, but they are not as close to the front property line as they are on Glencoe. CITY OF SHOREWOOD PLANNING COMMISSION MEETING AUGUST 28, 2018 Page 5 of 7 Rick Denman, 5865 Glencoe Road, stated that he and his wife purchased this property a short time ago. The existing home on the site was built in about 1910 and has had improvements over the years. He stated that they are planning to add a two-car garage and make other internal and external improvements on the existing home. He noted that there are currently two outbuildings on the site that they plan to demolish and take down. He stated that he works with Charles Cudd Company which are home builders. The existing home is a two-story home and their preference is to build a smaller, single-level living home. He stated that they love this location and noted that his wife had grown up on Christmas Lake. He noted that the building plans are for a modest sized home and gives a lot of privacy to the neighbor next door. He stated their children live out of state and their plans are to fix up the existing farm home and have their children stay there when they are in town visiting. Commissioner Riedel asked about the size of the porch, deck and cantilever portion of the master bedroom and whether their size could be reduced to comply with the setback requirements. Mr. Denman stated explained that the porch is 12 feet deep and he would like to keep that depth because reducing the size of the porch or the patio would make it less livable in terms of their use. He noted other homes in the neighborhood have zero setback. Vice-Chair Davis stated that she likes this use for the lot and likes that is a small home. Commissioner Riedel stated that he tends to take things literally and this appears to be new construction on a non-conforming lot. He stated that the City may want to revisit the side yard versus front yard setback because this was the same issue that was faced with a previous applicant. Director Darling noted that after discussion of the home on Marsh Pointe, the Council did ask staff to look into changing the ordinance to allow porches to encroach into the side yard setback. Commissioner Gorham stated that for the variance, he is of the opinion that this is essentially a self- created hardship. He noted that he attended a recent Council meeting where another subdivision was discussed and Councilmember Labadie asked the question “What is in it for Shorewood?” and he asked that same questions for this subdivision. He asked if the Planning Commission and the Council have been supportive of subdivisions in the past. Director Darling stated the City gets to define the standards under which lots can be created, so if the applicants can show that they can meet the requirements in the ordinance, there is not a whole lot of discretion. She stated that when they meet the requirements, subdivisions have been very consistently approved by both the Planning Commission and the Council. She noted that the lot is not a non- conforming lot but are asking for the setback variance for the porch and deck. Vice-Chair Davis stated that because of her rear yard setback, she has a 10x20 studio on the back of her home. She stated that she would be hesitant to make this space narrower because of her experience in her studio. Commissioner Eggenberger stated that he feels this is a beautiful home and will be an asset to the City. Eggenberger moved, Riedel seconded, to recommend approval of the minor subdivision and setback variance for Richard Denham at 5865 Glencoe Road, subject to conditions in staff report. Staff is recommending approval with the conditions listed in the report. Commissioner Eggenberger asked how things would work when the house was taken down and whether the basement would simply be filled in. Director Darling explained that in this case that option would be not be possible because it would interfere with the new structures, so they will need to take everything out. Chris Stephan, 4865 Ferncroft Drive, presented the corrected survey to the Commission. He noted that the plans presented tonight are just conceptual and understands that there will be changes made to comply with the requirements. REPORTS • Liaison to Council Council Liaison Johnson gave a brief report on matters considered and actions taken during Council’s August 13, 2018 and August 27, 2018, meetings (as detailed in the minutes for those meetings). Commissioner Eggenberger asked about the discussion surrounding single hauler garbage for the City. Director Darling noted that she knows it is on an upcoming Council work session but is not sure of the date. She stated that at the next Council work session there will be a full draft of the Comprehensive Plan available, so she will open that up as a Planning Commission work session also. Council Liaison Johnson noted that there was a certain process that had to be followed in order to discuss the possibility of a single hauler, such as some regulatory notices to the haulers. He stated that a lobbyist had sent out a flyer to the City that was misleading and noted that the City is following the required process. He clarified that the idea being discussed is not a single hauler for the entirety of the City, but splitting the City into three zones and that the haulers would have to competitively bid to get the zone. He noted that at some point there will be a public hearing so the residents can give them feedback. • Draft Next Meeting Agenda Director Darling stated there are two variance applications slated for the September 18, 2018, Planning Commission meeting, however she may push one of them to the October 2, 2018 meeting. At the August 28, 2018 meeting, the Planning Commission unanimously recommended approval of the request for preliminary plat and variances to lot area and width. The Planning Commission doesn’t review final plat applications. Two residents requested to speak at the hearing and two emails were received. After the meeting, staff received one additional email with photos indicating the water on the property. The residents raised concerns that the lot floods in the spring and after heavy rains. The Planning Commission indicated serious concerns with the drainage on and through the site. The property has a basin that collects and holds storm water and slows the release of the water off-site. Staff reviewed the amount and rate of storm water flowing through the site and the condition of the basin. The analysis indicates that the basin needs to be dredged to ensure it is functioning as originally designed. These improvements would be completed by the City as part of the sale. The property owner to the north noted that the water flows over his driveway each year and the culvert underneath his driveway is too small to accommodate the water now. Staff note that the route storm water passes across the property to the north is the natural drainage pattern in the area and the culvert was a private improvement to allow development to occur on that property. If the culvert needs to be enlarged, the expense would be the responsibility of the property owners. The speakers also asked if the costs associated with the storm water project would be assessed to the neighborhood. Staff responded that they would not be. In 2008, the city sealed the well and demolished the well house. The property has remained vacant. The property contains mature trees and is subject to tree preservation policy. A tree preservation plan would be required with the building permit. The site has no property within a shoreland or floodplain overlay district. On July 23, 2018, the City Council approved a purchase agreement for the property. ANALYSIS Two sections of the Shorewood City Code state that outlots are unbuildable: Section 1201.02 (Definitions) of the zoning ordinance reads: OUTLOT. A lot remnant or parcel of land left over after platting, which is intended as open space or other use, or which is reserved for future development and for which no building permit shall be issued. Section 1202.05. (Design Standards) subd. 2. e. of the subdivision regulations reads: e. Lot remnants / outlots.... Building permits shall not be issued for outlots or remnants. Consequently, before the city may sell the property to a buyer to construct a home on the lot, the City must alter the legal description to a lot /block legal description. The only means to alter the legal description is to replat the property and assign it a lot/block legal description. A. Preliminary Plat. Lot Width/Area: Section 1202.05 Subd. 2. c. of the subdivision regulations requires that all lots have adequate frontage on a city approved street to accommodate a driveway and required driveway setbacks. Additionally, section 1201.12 of the zoning regulations has specific area and width requirements for newly created lots. Stormwater Run -Off. The site contains a drainage feature for off -site storm water run -off and that feature would remain on the property. Construction of a new home on the lot would require additional rate control based on the amount of impervious surface proposed. Easements: Section 1202.05 Subd. 6 requires 10 -foot drainage and utility easements around the periphery of each lot and additional easements over the top of any utility lines. The plat includes 10 foot easements along the east and west boundaries of the lot and a 15 -foot easement on the north property line consistent with the original plat. The plat also includes an easement over the storm -water feature on the south side of the lot. This is consistent with city code requirements. Page 3 Access /Lot Frontage: Section 1202.05 Subd. 2. C. requires that every lot have adequate frontage on a city approved street to accommodate a driveway and section 1201.03 subd. 5 the zoning regulations requires a 40 -foot driveway setback from the intersection of property lines at the corner and a five -foot setback from side or rear property lines. The property is a corner lot and provides adequate area to construct a driveway to Apple Road consistent with setbacks. No driveway access would be permitted to Stratford Place due to the presence and location of the storm -water feature. Utilities: The lot has access to both municipal water (through the City of Chanhassen) and sewer (through the City of Shorewood) and the applicant is required to install services for the new home. A right -of -way permit issued by the City of Shorewood would be required for the work in the right -of- way as well as approval from the City of Chanhassen. B. Lot Area/Width Variances. The zoning regulations allow for variances upon showing that practical difficulties exist and that the request is consistent with the intent of the regulations. Section 1201:05 Subd. 2. b. of the Shorewood Zoning Code sets forth criteria for the consideration of variance requests. Staff reviewed the request according to these criteria, as follows: Intent of comprehensive plan and zoning ordinance: The proposal to sell the property for construction of a single - family home would be consistent with the residential land use designation in the comprehensive plan and the R -1C zoning district. 2. Practical difficulties: Practical difficulties include three factors, all three of which must be met: a) reasonableness; b) circumstances unique to the property and not caused by the landowner; and c) maintenance of the essential character of the area. a. Reasonable: Use of the property for a single - family home is a reasonable use in the R -1C zoning district. b. Unique /Self - Created: The property was created smaller to allow for a public purpose that is now obsolete. The city has no additional land to add to the size of the property. C. Essential Character: The addition of one single- family home would not alter the essential character of the area. 3. Economic Considerations: The variance is not a means to increase the value of the lot but to allow a private buyer the ability to use the lot. 4. and 5. Public Welfare /Injurious to Other Property. The City is not proposing anything that would impair an adequate supply of light and air to an adjacent property, increase the risk of fire or endanger public safety, unreasonably diminish or impair values in the neighborhood. 6. Staff concludes that the requested variance is the minimum necessary to alleviate the practical difficulties. As a longtime resident of Stratford Place (24000 Stratford Place) and owner of the largest creek bed easement along Apple Road Creek I would like to express my concern also about the suitability of the proposed possible build on the lot at 22000 Stratford Pl. The lot is indeed quite small and floods quite often during heavy rains in the summer despite the partial improvement of the creek bed project that was completed a few years ago. There is a collection pool that was dug during that project, but this often overflows and sometimes actually goes over the street on into the lot in question, thus filling the lot with water from the culvert and overflow above the road.. I would suggest the city engineer or some other qualified person come to look at the lot size as well as drainage around it before proceeding with any new proposals. It really would be considered part of the wetland on the other side of the adjoining driveway to the North. In my opinion. I regret I will not be able to make the planning meeting either. Please take these concerns into consideration carefully, as I think it would be possibly a liability for the city if the city sold it as a billable lot. I suspect there would be a large water problem in any basement, and land drainage also. However, we wanted to submit concerns regarding the buildable lot consideration notice for the 22000 Stratford Place location. We live on Stratford Place and thought it would be beneficial for the Planning Commission to be aware of some lot conditions that would cause concern for future builds. The small portion of land located on Stratford Place would be insufficient for driveway access as there is a standing neighborhood garden median. In addition, the lot is located at the bottom of a significant incline on Apple Road and Stratford Place and is the primary location for all water runoff - the lot floods anytime it rains and during winter thaw. Finally, located on the lot is a large drainage creek that flows from the top of Apple Road and under Stratford Place road. A development may cause disruption to the drainage system on the lot. The applicant said that it would be challenging to reduce the porch and be able to have a normal furniture arrangement. The applicant indicated that the patio could be reduced, but indicated that the size proposed wouldn’t impact the adjacent properties. Commissioner Gorham raised a concern that the subdivision yields benefit to the property owner, but how does the City of Shorewood benefit? Staff responded that the City adopts the regulations under which subdivisions can be approved and must review them according to those regulations. A utility connection agreement is required because the property is served with sewer and water services from the City of Excelsior. The resolution also authorizes the Mayor and City Administrator to execute the agreement. Financial or Budget Considerations: The fee paid by the applicant covers the cost of processing. The property contains mature trees and is subject to tree preservation. The site has no property within a shoreland or floodplain overlay district. The right -of -way for Glencoe Road was acquired after the home was constructed and the home is located 24 feet from the front property line where 30 feet is required. The home would continue as non - conforming building after the subdivision is granted. ANALYSIS A. Minor Subdivision. The applicant proposes to subdivide the property into two parcels, one for the existing house and one for a new home. All improvements (sheds, paver walks, etc.) currently straddling the new property line would need to be removed. Lot Width/Area: Section 1202.05 Subd. 2. c. of the subdivision regulations requires that all lots have adequate frontage on a city approved street to accommodate a driveway and required driveway setbacks. Additionally, section 1201.13 of the zoning regulations has specific area and width requirements for newly created lots. Economic Considerations: The applicant hasn't proposed the additions exclusively to increase the value of the home, but to increase the livability. 4. and 5. Public Welfare /Injurious to Other Property. The property owners are not proposing anything that would impair an adequate supply of light and air to an adjacent property, increase the risk of fire or endanger public safety, unreasonably diminish or impair values in the neighborhood. 6. The applicant has stated that the requested variance is the minimum necessary to alleviate the practical difficulties. However staff notes that the 10 -foot by 13 -foot porch, a 19.5 -foot by 11.5 -foot patio and the cantilevered portion of the master suite could be reduced in size without making any of the areas unusable. RECOMMENDATION Staff recommends approval of the minor subdivision based on the finding that the lots would be consistent with subdivision and zoning requirements with the following conditions: Prior to recording the subdivision, the applicant complete the following: a. Submit executed drainage and utility easements. b. Receive approval from the City of Excelsior to connect to their city water and sewer. c. Submit payment of fees for park dedication, water connection charges, and local sanitary sewer access charges. d. Remove all buildings and improvements that straddle the property line or are on the southerly lot. e. Revise the stormwater management plan as indicated by the City Engineer. Other conditions: a. Remove /trim vegetation on the corner of Academy Avenue and Glencoe Road. b. The City of Shorewood requires calculations for the 1 -, 10 -, and 100 -year events. HydroCAD results were provided for these events; update the existing and proposed conditions tables to reflect the runoff for the 1 -year event. Applicant updated memo. 2. The drainage areas should include all proposed improvements on the site. Extend XW and PW to Glencoe Road to include all of the proposed driveway. Revise drainage area PE to delineate which area goes to the stormwater storage area and which goes directly off -site. Note that these updates may change the proposed discharge rates off -site. Applicant updated HydroCAD modeling. Include revised drainage area maps. 3. Include existing and proposed discharge rates off -site by discharge point, (i.e. east and west). Proposed rates should not exceed existing rates by discharge point. Applicant updated modeling and memo. 4. The runoff for the 10 -year event in the proposed conditions table does not match the HydroCAD modeling. While runoff increases for this event, it is only by 0.05 cfs. This is considered a . negligible increase. Note: This will likely change based on Comment 2. Applicant updated proposed conditions table. The discharge rate$ oftsite to the wed increase in all storm events, from 0.07 to 0.09 cfs. Ultimately, the east and west discharge points outlet to the same basin. In the 10- and 100 -year events the total discharge offsite is decreased in proposed conditions. In the 1 -year event, total discharge is increased by 0.04 cfs. However, this is considered a negligible increase and acceptable. 5. Verify that the roof configuration and gutters on the proposed structure will direct water as shown on the proposed conditions plan. Based on current modeling, 2119 sf of impervious surface is routed to the stormwater storage area, compared to 2218 sf of net new impervious. Because less than 100 sf of net new impervious surface is not routed to the stormwater storage area, the treatment is considered sufficient. Note: This will likely change based on Comment 2. This will be considered sufficient. 6. Verify the design details of the stormwater storage area. Consider including a detail for this feature. a. Is there going to be draintile at the 968 elevation? If so, add this to the model. Where will the draintile outlet; is any erosion protection needed? Draintile was added to plans. How will draintile outlet? The draintile elevation is 967.1, but is shown daylighting at approximately 971.0. Model the infiltration rate through the rock media (max of 1.63 in /hr per Minnesota Stormwater Manual), routed to the 4" draintile. Note that this may affect the HWL of the stormwater storage area. b. The rock section needs to drawdown in 48 hours to allow for storage in a subsequent storm event. Without draintile, assuming an infiltration rate of 0.06 in /hr, the rock section can only be 3 inches deep. Draintile has been added. Assuming an infiltration rate of 1.63 in /hr (HSG A per Minnesota Stormwater Manual), the 4 ft rock trench will drawdown in less than 48 hours. 7. Freeboard requirements from the 100 -year high water level (HWL) of the stormwater storage area are as follows. In addition to the structures on the subdivided lots, freeboard should also be met at the existing dwelling to the east of the property. a. 1 foot to the low floor elevation. If it can be demonstrated that this standard creates a hardship, the following will be acceptable. L The basement floor will be one foot above the highest anticipated groundwater elevations that can result from high surface water elevations elevation groundwater elevations during the 100 -year event. Applicant indicated that above requirement is met. b. 3 feet to the low opening elevation. However, if 3 feet is a hardship, 2 feet will be acceptable if the following conditions are met: i. That, within the 2 -foot freeboard area, stormwater storage is available which is equal to or exceeds 50% of the stormwater storage currently available in the basin below the 100 -year elevation. ii. That a 25% obstruction of the basin outlet over a 24 -hour period would not result in more than 1 foot of additional bounce in the basin. iii. An adequate overflow route from the basin is available that will provide assurance that one foot of freeboard will be maintained for the proposed low building opening. As a condition of approval, staff recommends the applicant submit executed copies of drainage and utility easements prior to recording the subdivision with Hennepin County. Access /Lot Frontage: Section 1202.05 Subd. 2. C. requires that every lot have adequate frontage on a city approved street to accommodate a driveway and section 1201.03 Subd. 5 of the zoning regulations requires a 40 -foot driveway setback from the intersection of property lines at the corner and a five -foot setback from the side and rear property lines. The property is a corner lot and both lots would provide an adequate amount of lot width to construct a conforming driveway consistent with setbacks. Visibility at the corner is compromised by landscaping, staff recommend the plantings be trimmed back consistent with zoning ordinance requirements. Shoreland Overlay Requirements: Because the property is within the shoreland overlay district for Lake William and the northerly property would directly abut the lake, the following requirements would also apply: Setback to the OHWL: 50 feet. Maximum Impervious Surface Coverage: 25 feet Lot Width at lakeshore setback: 75 feet required about 79 feet proposed. (northerly lot only) Side yard setbacks: 30 feet combined (northerly lot only) Staff notes that the plans show an approximate location for the OHWL and consequently recommends the applicant revise the plans to shown the correct location. Whether the OHWL is at the approximate located noted or the 930 topography line, the applicant would meet the required setback. Staff further notes that the concept house on the northerly lot does not meet the required combined side -yard setbacks. Staff included a condition that the plans submitted for building permit meet the requirements of City Code. Wetland: The shoreland of Lake William is also wetland. The applicant is required to provide 35 feet of adjacent land into a wetland buffer and protect both the wetland and wetland buffer with conservation easements. All structures must be setback 15 feet from the wetland buffer. Staff Page 3 recommends the applicant revise the plans to show the delineated edge of the wetland and the wetland buffer on the plans. Stormwater Run -Off. Staff reviewed the storm water calculations based on the additional impervious created by the construction of new homes on the property. The applicant has proposed a rain garden for each of the new parcels. The city's engineering staff review of the proposal is attached. Subject to the review comments, the applicant's proposal would be able to meet the city's requirements for rate control. Utilities: The lots have access to municipal sewer. A right -of -way permit issued by the City of Shorewood would be required to install services. Water must be provided by private wells. Tree Preservation: The applicant has identified several significant trees that would be removed to accommodate the improvements. Based on the size of the trees removed and the size of the property, eight new trees would need to be planted on the lots. There is adequate room for the additional trees on the two lots and the applicant has shown climate - tolerant species. RECOMMENDATION Staff recommends approval of the minor subdivision based on the finding that the lots would be consistent with subdivision and zoning requirements with the following conditions: Prior to recording the subdivision, the applicant complete the following: a. Submit executed drainage and utility easements and a conservation easement over the wetland and wetland buffer. b. Submit fees for park dedication and local sanitary sewer access charges. c. Remove all buildings and accessory structures. d. Revise the stormwater management plan as indicated by the City Engineer. e. Revise the plans to correctly indicate the ordinary high water level (930), the wetland and the wetland buffer on the plans and correct the setback to the OHWL as may be needed. Other conditions: a. Remove /trim vegetation on the corner of Femeroft Drive and Ivy Lane. b. With each building permit application, the applicant shall submit a tree preservation/landscaping plan signed by a licensed forester, arborist or landscape architect. C. Prior to installing services or conducting other work in the right -of -way, obtain a right - of -way permit. d. Prior to construction of improvements on either lot, the applicant must acquire the appropriate permits. All construction must be consistent with the requirements of City Code.
