MATTERS FROM THE FLOOR Jade Lomeli Johnson, 24830 Amlee Road, asked for an update regarding City water and paving for both Amlee and Glenn Roads. City Engineer Fauske stated that the topographic survey information has been taken in and they are in the process of getting the wetland information to draft a feasibility study. She explained that once the feasibility study is in draft form, they will have another neighborhood meeting to share the information and plans. She stated that they are anticipating that the draft feasibility study will be completed by late June or early July. Mayor Zerby suggested that Ms. Johnson make sure that the keep her informed of the upcoming informational meetings. Councilmember Siakel asked if Ms. Johnson had project. Ms. Johnson stated that she would like to have all of`the costs and future bills because she thinks she may have City Administrator Lerud stated that Ms. Johnson was frE any questions she may have. 4. She explained that she had made a few revisions to this portion to include the programs that may be used to help support affordable Councilmember Sundberg asked about the Tax Base Revitalization Account (TBRA) that was listed under a housing program. She asked for clarification of what this meant and if it meant that contaminated sites would be redirected and used for redevelopment as affordable housing. Planning Director Darling stated that she believes that is correct but noted that she has no experience using this program. She stated that it would give the City a funding option for this type of use. CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES June 10, 2019 Page 3 of 6 Councilmember Johnson stated that there was a question received from the public that asked if the City received funding for out -of- district families. He stated that he wanted to make it clear that City funding and school district funding were two entirely separate entities. Johnson moved, Sundberg seconded, Adopting RESOLUTION NO. 19 -056, "A Resolution Approving the 2040 Shorewood Comprehensive Plan and Authorizing Submission of the Plan to the Metropolitan Council," subject to review and comment by the Metropolitan Council and pursuant to State Statute and authorize staff to submit the plan to the Metropolitan Council. Motion passed 5/0. 8. ENGINEERING /PUBLIC WORKS A. Draft Speed Bump Policy Public Works Director Brown explained that the City Ponds community for the addition of a speed buml Freeman Park and many of the drivers in this area a discussing this and from a Public Works perspective; bump. She asked whether the City could instead have increased police patrol in this area during the busy times at the park. She stated that it would help solve the speeding issues without hindering the Public Works Department. She suggested consulting with the new Fire Chief to see if he had any opinion on the issue. Councilmember Sundberg stated that she thinks increased police patrol is a good idea and asked if there were any other traffic calming techniques that could be used instead of speed bumps. Councilmember Labadie noted that years ago the City had trouble with Freeman Park and the Tonka United soccer tournaments with people parking outside of designated parking spots which caused a lot of problems. He stated that the City was able to address this issue alongside Tonka United. She explained that Tonka United got the word out to parents that they would be towed if they parked outside of the designated parking spaces. She noted that there was also a police presence after those events which seemed to work well and take care of the problem. She CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES June 10, 2019 Page 4 of 6 suggested that the baseball association work together with the police department to address the speeding concerns in the area and get the word out to parents that they will be ticketed if they are speeding and there will be an increased police presence after events. She stated that she suspects that these parents are not trying to break the law, but because everyone is in a hurry these days, they simply are not thinking about their speed. She stated that she is hesitant to put together even draft language for this type of situation because of the precedent it may set for other areas of the City that aren't as unique as this location near a park. Mayor Zerby stated he supports having a policy because it provides a framework to have discussions with residents. Councilmember Siakel reiterated that she thinks speed bumps are not neighborly and will just bring resentment. She stated that really this is a police enforcement issue and she is not in favor of installing speed bumps. Mayor Zerby suggested having the Police Chief speak to the Council regarding speed enforcement efforts in this area. Councilmember Johnson asked if there was a way to Public Works Director Brown stated that there are tw+ noted that speed bumps are similar to stop signs. He stated the only questionable item staff discussed from their proposal is the "perform field survey" description because WSB may be able to perform this duty. He stated that after discussion', staff felt that there would be continuity in having Barr Engineering also provide this service, and additional survey work is needed for the storm pond modeling — work that was not done when WSB surveyed the area. Staff is recommending approval and noted that adequate funds from the Stormwater Management Fund area are available for this eroiect. Siakel moved, Johnson seconded, Accepting the Proposal for Professional Services for the Grant Street Project for Barr Engineering, for an amount not to exceed $44,700 and Adopting RESOLUTION NO. 19 -057, "A Resolution to Approve a Professional Services Agreement with Barr Engineering, City Project 18 -04." Motion passed 5/0. 9. GENERAL /NEW'BUSINESS — NONE 10. STAFF AND COUNCIL REPORTS A. Administrator and Staff 1. Shorewood Community and Event Center Update CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES June 10, 2019 Page 5 of 6 Administrator Lerud noted that he asked Parks and Recreation Director Grout to prepare an update every six months on the operations at the Shorewood Community and Event Center. He asked the Council to give feedback on any information that was not included in the report but they are interested in so it can be added in the future. Councilmember Sundberg asked if the operations are on track to meet or exceed last year revenue amounts. Administrator Lerud stated that he feels it is on track to exceed last year's revenue. B. Councilmember Johnson passed along a question from a resident asking when the goats will be coming back to deal With the buckthorn. Planning Director Darling stated that she has been told that they can come back in June or July but has not been given a more specific time frame to announce yet. Councilmember Sundberg stated that her neighborhood had another bout of pretty gross looking water and asked if the hydrants were flushed about two weeks ago. Public Works Director Brown stated that they have not flushed the hydrants. He stated that it is not unusual when everyone starts gearing up their irrigation systems for the summer that the system acts as though the hydrants are being flushed with the high usage. CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES June 10, 2019 Page 6 of 6 Councilmember Siakel stated that she was contacted by a resident who asked a lot of questions about how the City decides to update roads and about traffic issues. She stated that this discussion gave her the idea that perhaps the City should hold a general information open house about streets, in general. She stated that it may be helpful to explain the thought process and all of the background work and engineering that is done as part of decisions about the road system in the City. Mayor Zerby stated that he thinks it is a good idea and suggested that the meeting be videotaped so it can be linked on the website for people to watch who are unable to attend the meeting. He noted that he will be meeting with Police Chief Meehan this coming week and asked the Council to let him know if there were any specific issues that they would like him to bring up. He stated that the Greenwood area has recently experienced some garage break -ins and encouraged people to keep their garage doors closed even when they are home. 11. On January 14, 2019, the City Council provided direction to staff that they would be willing to allow food trucks in any park for special events, but had more concerns regarding alcohol. After discussing the issues, they directed staff to prepare ordinance amendments to allow alcohol in parks on a trial basis for one year. After one year, Council asked if Chief Meehan could discuss any impacts on the number of DWI's near the park or other alcohol - related incidences. Attached is an ordinance amendment to implement your direction. Staff did not include a one - year limit in the ordinance amendments. Instead, we propose to remove the code language should that be your direction after a few events have been held or at the one -year mark. Staff scheduled a review of the issues for the 1 sc City Council meeting in November so that if any policy or ordinance changes are needed, there is time to implement them before scheduling any events next summer. Staff also added a requirement that any private events with amplified music be approved by City Council. The Parks Commission reviewed the ordinance amendments at their June 11, 2019 meeting and voted unanimously to recommend approval. Financial or Budget Considerations: To reduce the cost of publication, staff has also attached a resolution approving a summary publication of the attached ordinance. The City Council discussed the issue and indicated they would be willing to allow Food Trucks in any park, but they had some concerns about allowing sales of alcohol in the parks. They directed staff that they would be willing to allow alcohol at events for one year on a trial basis in Badger Park only. Consequently, before you this evening is a draft ordinance for your review that accomplishes that task. There are a number of conditions that are attached to the approval, most of them revolve around the sale of alcohol. Please review the attached ordinance language and suggest changes to the language as may be needed. The Police Chief and the City Clerk have already reviewed the code language and the City Attorney is currently reviewing the code changes. No person shall mix or prepare liquor for consumption in any public place or place of business unless it has a license to sell liquor "on- sale" or a permit from the Liquor Control Director under M.S. § §340A.414 and 340A.504. APPROVAL OF AGENDA Gorham moved, Riedel seconded, approving the agenda for June 4, 2019, as presented. Motion passed 3/0. 2. APPROVAL OF MINUTES May 21, 2019 Gorham moved, Maddy seconded, approving the Planning Commission Meeting Minutes of May 21, 2019, as presented. Motion passed 2/0/1 (Riedel abstained). 3. PUBLIC HEARINGS Chair Maddy explained the Planning Commission is comprised of residents of the City of Shorewood who are serving as volunteers on the Commission. The Commissioners are appointed by the City Council. The Commission's role is to help the City Council in determining zoning and planning issues. One of the Commission's responsibilities is to hold public hearings and to help develop the factual record for an application and to make a non - binding recommendation to the City Council. The recommendation is advisory only. A. CUP FOR ACCESSORY SPACE OVER 1,200 SQUARE FEET Applicant: Mike Nicklaus Location: 27850 Woodside Road Planning Director Darling explained that the applicants propose to remove the existing home and construct a new home with two attached garages. She noted that this ordinance requires a CUP to allow 1,900 square feet of combined area of both accessory buildings where 1,200 square feet is allowed without a CUP. She stated that the property is tree covered and will be subject to tree preservation requirements. She stated that the square footage would be split between the two garage spaces on either side of the home. She stated that the south facing garage will be oriented towards the street and the north facing garage will be visible from the cul -de -sac. She noted that the applicant will also have to submit drainage calculations along with their building permit application. She stated that staff is recommending approval with the conditions as listed in the staff report. CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 2 of 10 Commissioner Riedel stated that in the conditions it mentioned that the front setback requirements were not met, but that revised plans were expected that would meet those setback requirements. Planning Director Darling stated that the applicant will be submitting revised plans and noted that she believes that the setback issue will be able to be accommodated because they are only eight- tenths of a foot off of what they need to be. Commissioner Riedel stated that there was also a back up generator and a free - standing light fixture mentioned. Planning Director Darling stated that the applicant needs to provide more information on those items to the City. Commissioner Riedel asked about staff's recommendation that the driveway be no greater than 25 feet in width. Planning Director Darling stated that the upper driveway is wider than the current ordinance will allow, so this is the time to address that discrepancy and bring it into compliance. Commissioner Gault arrived at the meeting. Chair Maddy asked if the City had limitations on how many driveways a parcel can have. Planning Director Darling explained that properties are limited to one driveway for each 120 feet of frontage. She noted that this property has about 500 feet of frontage, so they qualify for a second driveway. Chair Maddy asked Planning Director Darling to point out the front and rear lot lines. Planning Director Darling explained the location of the property lines. Commissioner Gorham stated that one of the plans shows an Option B and asked about the elevations in relation to the floor plans. He asked if the corridor was enclosed. Planning Director Darling stated that the corridor connects the exercise area on the lower level with the bedroom that is above the garage. Commissioner Gorham stated that he would like to see the side elevation. Planning Director Darling noted the information in the packet that shows the elevation information. Mike Sharratt, 5590 Woodside Lane, stated that he is the architect for this project. He stated that the new home is proposed to be almost on the identical footprint of the existing home, but noted it is peculiar because there are three sides of the home that have a front yard setback of 50 feet. He noted that this family needs more than a two -car garage and explained the reasoning behind keeping the scale of a garage small that is facing Woodside Road with the larger garage space at the bottom near the cul -de -sac. He stated that he doesn't think most people will even be aware that there are four garage stall spaces on this property. CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 3 of 10 Commissioner Gault asked about the freestanding light fixtures and their impact on the neighboring properties. Mr. Sharratt stated that he did not have the lighting plan but, if he has anything to do with the design, people will not be able to see the filament of the bulb, just the effect of the light. Mike Nicklaus, 27850 Woodside Road, stated that he agrees with Mr. Sharratt that the light fixture will be shielded and noted that the lot is very wooded and will just give a bit of accent lighting on the driveway. He stated that the intent for the generator is not a whole house generator, but he would like to have the ability to have limited support during a power outage, such as power for the well. Riedel moved, Gault seconded, approving the CUP to Exceed 1,200 Square Feet of Area for Accessory Buildings for property located at 27850 Woodside Road, subject to conditions as listed in the staff report, as presented. Motion passed 4/0. Chair Maddy noted that he had forgotten to open this item for public comment and opened the Public Hearing at 7:24 P.M. There being no public comment, Chair Maddy closed the Public Hearing. Planning Director Darling asked that the motion be repeated, so it was officially documented after the Public Hearing. CUP FOR SPECIAL PURPOSE FENCE (BATTING CAGE) Applicant: Steve Bodine, John Kraemer and Sons Location: 26310 Birch Bluff Road Planning Director Darling stated that the applicant proposes to install a batting cage that is up to 19 feet high in some areas depending on where it falls on an existing retaining wall. She explained that the proposed posts would be 15 feet tall and the netting would be about 14 feet tall and would be installed above the existing retaining wall. She explained that staff recommends approval of the request subject to the conditions listed in the staff report. She noted that staff has received two letters regarding this application, one in opposition and one in favor. Commissioner Riedel stated that it appears that the CUP that allows special purpose fencing has more specific conditions than the CUP for accessory spaces. Planning Director Darling stated that she agrees that this type of CUP has just the subjective standards. Steve Bodine, John Kraemer and Sons, stated that they agree with the request by staff to request for a zoning permit. Chair Maddy asked when the scheduled completion date will be for this project. Mr. Bodine stated that the completion date is getting close because the final things are the turf play area and the batting cage. CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 4 of 10 Chair Maddy asked whether the pine trees would continue around the property Mr. Bodine stated that they will be continued to the edge of the driveway of the lot as soon as the turf play area is installed. Commissioner Gault asked about the height of the batting cage and why the netting couldn't just be hung at 10 feet. Mr. Bodine stated that if you want to play at a higher level, you need to see the trajectory of the ball, which requires a greater height for the netting placement. He explained that this size batting cage is used at both the high school and college level. He noted that their planned netting is a bit different than the example shown by Planning Director Darling and will not be as thick and knotted. Commissioner Riedel asked how visible the poles will be to the neighborhood Mr. Bodine stated that when the tree placement is completed you will only be able to see the posts from the driveway. He stated that it will be pretty hard to see and will be similar to a flag pole. Commissioner Gault asked it the intent was to light the batting cage area or have it only for daytime use. Mr. Bodine stated that he did not have the lighting plan for the property so he was unsure. Commissioner Gorham expressed concerns about the sound of the crack of a bat if more than just the homeowner uses the batting cage, such as a team batting practice. Mr. Bodine stated that he expected it to be the homeowner's son and perhaps a few of his friends that would be pitching to each other. He stated that he expects it to be just another activity available on the property and not a workout facility for the team. Chair Maddy asked if the City had seen many complaints of kid's recreational activities making too much noise. Planning Director Darling stated that the complaints that she has received are regarding lights being too bright at night, such as portable lights, on hockey rinks and for noise related to sport courts when people are playing too late at night. Chair Maddy opened the Public Hearing at 7:38 P.M. Tom Lesser, 26245 Birch Bluff Road, asked for clarification about the lighting plan for this area at night. He stated that batting cages can be very loud and asked if there would be any approved hours of use outlined for the batting cages. Chair Maddy asked if this use would be subject to the same noise restrictions as things like riding a lawnmower. Planning Director Darling stated that there is nothing specific relating to recreational facilities on private property and noted that she did not think the situation has come up in the past. She stated that a noisy gathering could result in a noise complaint to the police. She stated that the CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 5 of 10 City could also limit the amount of light that is allowed to be used at the batting cages as a condition. She stated that with a CUP there could be "hours of operation" included, but noted that including that kind of restriction for a residential use is a bit unusual. Commissioner Gault confirmed with the applicant that the netting is soft and will not produce any noise. There being no additional public comment, Chair Maddy closed the Public Hearing at 7:42 p.m. Mr. Bodine stated that it will be hard to use a batting cage with hard balls and bat at nighttime, even with lighting, so he does not think it will be an issue at night. Chair Maddy stated that he is uncomfortable putting "hours of operation" on private property and noted that it feels like an over reach by the City. Commissioner Riedel stated that he agreed that this will be best handled through existing lighting and noise ordinances. Planning Director Darling stated that the City could restrict the applicant from lighting the batting cage itself for nighttime use. Commissioner Gault confirmed with Planning Commissioner Darling that the only reason the applicants were applying for a CUP was because of the height of the poles and not having a batting cage on the property. Commissioner Riedel stated that the zoning allows for special purpose fencing and this is not an outrageous request. Mr. Bodine stated that he understands the restriction on lighting, but expressed concern about the need for lighting at dusk during different times of the year. He stated that completely restricting the lighting seems excessive. He noted that he thinks there will be the opportunity to provide subtle light rather than large stadium type lighting that will allow use of the cage, but will not disturb the neighbors. Commissioner Gault noted that in order to be effective, a batting cage needs bright, directional lighting, rather than down lighting. He suggested that the Commission limit the lighting to 10 feet up the poles rather than at the 19 feet point of the poles surrounding the batting cage. Mr. Bodine stated that he would support that because it would give lighting options, but would not be obtrusive to the neighbors. Commissioner Riedel stated that the intent, if this type of lighting is allowed, is that the batting cage not be used after dusk because that is when it will be most disruptive to the neighbors in terms of both noise and lighting. Commissioner Gorham stated that he does not want to have any gray areas and does not want to see any lighting on the batting cage. Mr. Bodine noted that there will be landscape type lighting in the area. Commissioner Riedel stated that would take care of "safety" lighting in the area CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 6 of 10 Chair Maddy expressed concern that the Commission did not have the exact lighting plan in front of them in order to evaluate the things that are being discussed. A member of the audience spoke about the existing tree cover on this lot noting that foliage will be gone by fall. Mr. Bodine asked what the City usually does with things like sport courts with regard to noise and lighting. Planning Director Darling noted that noise disturbances are police calls. Commissioner Gault stated that he is becoming concerned because every time the Commission comes up with lighting restrictions, Mr. Bodine comes up with an objection. He stated that he is starting to get the impression that Mr. Bodine is aware of the lighting plan for this property. Mr. Bodine stated that he has worked on this project long enough to know that sometimes ideas come up after things are built and wants to make sure that this is all covered. He stated that he is trying to get the same rights for his homeowner as those who have sport courts. Commissioner Gault stated that sport courts are a bit different because that is typically something like basketball which is a different noise than would come from a batting cage. Chair Maddy noted that sport courts also do not require a CUP and in this instance, the applicant is asking for a fence height two times what is allowed in the City. Gault moved, Riedel seconded, recommending the Council approve the CUP for Special Purpose Fence (Batting Cage) for the property located at 26310 Birch Bluff Road, subject to conditions as listed in the staff report and that no lighting will be installed with the intent of lighting the batting cage. Motion passed 4/0. C. MINOR SUBDIVISION; VARIANCE FOR FRONT SETBACK; CUP FOR FILL OVER 100 CUBIC YARDS (continued to July 2, 2019) Applicant: Joe Allen, Highland and Associates, Inc. Location: 5965 Grant Street Planning Director Darling noted that the applicants propose to demolish the existing home and subdivide to construct two new homes, which would include bringing over 100 cubic yards of fill to the site. She stated that the applicant needs additional time to submit revised plans, so she is suggested that public testimony be taken tonight and this item be continued to the July 2, 2019 Planning Commission meeting. PREAPPLICATION — COMPREHENSIVE PLAN AMENDMENT SKETCH REVIEW Applicant: Bill Stoddard, Stoddard Companies CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 7 of 10 Location: 25400 State Highway 7 (vacant parcel between Eureka Rd and Seamans Dr Planning Director Darling noted that the subject property is located between Eureka Road and Seamans Drive, north of State Highway 7. She stated that the applicant is asking for informal comments on a sketch plan for 20 small, single - family lots clustered along a new cul -de -sac. She noted that if the applicant comes forward with an application, it would need a Comprehensive Plan Amendment to be compatible with the proposed density, rezoning to amend the site to a PUD, a PUD concept, development and final stage review, as well as a preliminary and final subdivision. She showed examples of the home styles that are proposed and reviewed setbacks, traffic and parking. She stated that the applicant is looking for the Commission's opinion on the proposed plans. Commissioner Gorham asked if there was a watermain extension requirement with this development. Planning Director Darling noted that with any residential development that has more than 4 homes, there is a watermain extension requirement. Commissioner Gorham asked if there had been any notification put out regarding this proposed plan. Planning Director Darling stated that there had not been any notification because this is an informal sketch plan pre - application review providing informal comments. Commissioner Riedel asked if there would be enough pervious surface on the site with the proposed plan for stormwater management. Planning Director Darling stated that the Commission could provide an exception to the amount of impervious surface, but not to the amount of stormwater retention and those issues. Commissioner Riedel asked if Planning Director Darling felt there would be enough area on site to handle infiltration and absorption of the stormwater from the site. Planning Director Darling stated that the plans show a good -sized pond and the developer would have to provide the documentation that it could handle the appropriate amount of stormwater and drainage. Commissioner Gault asked about the location of the culvert that flows across State Highway Seven. Planning Director Darling stated that she believes it is in the southeast corner of the site. She stated that she is not sure if the pond will be kept in the same area as is proposed, once the engineers get involved. Commissioner Gault asked why this would be a cul -de -sac and not a straight through street between Eureka Road and Seamans Drive. Planning Director Darling stated that she takes responsibility for that design and explained the traffic situation in the area and why she recommended a cul -de -sac. CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 8 of 10 Chair Maddy confirmed that he had understood Planning Director Darling correctly that the neighbors were not notified of this proposed sketch plan. Planning Director Darling stated that is correct, nor was there mailed notice for the last developer's proposed sketch review. Bill Stoddard, Stoddard Companies, stated that it is important to him to do something that fits in with the neighborhood and yet meets today's needs. He stated that people really like buying, new, smaller homes that include a small HOA so the outside yard area is taken care of. He noted that because of the water table in the area, these homes will not have basements, so they would like to have the option for one -story or two -story designs. He stated that he would like to have a neighborhood meeting to explain the concept to the neighbors fairly early in the process. He stated that one of the next steps will be to do soil borings. Mike Steadman, 24505 Niblick Alcove, stated that he is a new construction specialist for Burnett and he feels there is a tremendous need for new, affordable housing with a zero lot line development. He stated that he thinks this development could be very unique and desirable. Commissioner Riedel stated that the price point suggested for these units does not qualify as affordable housing. Mr. Steadman stated that it is affordable compared to Minnetonka Country Club. Commissioner Gault asked if the intent was to build these homes to order or to build them to spec and then sell them. Mr. Stoddard stated that he has a handful of builders that are very interested in this project. He stated that they will start at one end and build in phases and build as the purchase agreements are in place. Chair Maddy explained that there is a traffic bottle neck in this area along Eureka Road especially during sporting events. He stated that under the current zoning, this property is entitled to seven lots without requiring a CUP or rezoning the property. He stated that the thirteen extra homes would bring about 140 extra automobile trips to this area which is a cause for great concern by residents in the area. He shared other concerns that were shared by the residents from the last proposal. Commissioner Riedel noted that he had taken a drive to this property today after the rainstorm and the amount of standing water was impressive. He stated that the water table, the wetland designation and the stormwater management for this site may be a significant challenge. Chair Maddy stated that higher density for this particular parcel will be a challenge and was the biggest concern shared by the area residents, for good reason. Commissioner Riedel stated that the outcome of the last proposal for this parcel was that they recommended that a traffic study be done. He explained that because of the feedback from both the City and the neighborhood, the developer saw that the project was unlikely to move forward, and was unwilling to complete the traffic study. He stated that concerns about additional traffic in this area are very real. CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 9 of 10 Commissioner Gorham stated that people were very upset about the last proposal and were very vocal about their concerns for traffic in the entire area, including unsafe speeds and pedestrian dangers. Commissioner Riedel stated that the plan proposed is quite good because all the properties are on the north side and it preserves quite a bit of the tree cover between State Highway 7 and the property. He explained that his concerns are with the density and the number of cars this proposed development would add. Mr. Stoddard asked if the property to the west was a multi - family development. Planning Director Darling stated that it is a quad home development called Shorewood Pond which was approved as a PUD in 1999. Chair Maddy suggested that the Commission go through the list item by item and give their feedback. The consensus of the Commission is that: 1) the density shown does not appear to be acceptable; 2) the design height of the dwellings appears to be acceptable if they are mixed and not a row of two story homes with a 14 foot setback 3) the reduced setback seems acceptable; 4) traffic analysis should be required with school in session; 5) setback from Eureka Road and Seamans Drive should be 35 feet; 6) right -of -way dedication should be consistent with City code, but discuss the possibility of narrowing the streets and only allowing parking on one side of the street; 7) consider increasing the radius of the cul -de -sac; 8) watermain should be extended to the north and south to allow for further extension in the future; 9) work with City and MCWD for stormwater treatment and provide soil borings; 10) impervious surfaces limited to 33 percent and 25 percent within the shoreland district; 11) add language to HOA documents that restricts the use of the garages as outlined being cautious and vigilant about enforcement and making sure the language is actually included by the HOA before building permits are issued; 12) provide a tree inventory and protect the trees; 13) consider increasing the number of trees above what is required to add additional buffer; 14) amend the shoreland district to accommodate the channel that lies below the OHWL on the north side of Minnewashta Lake. Commissioner Riedel stated that items 2 -14 are all great and things that can be addressed, but item 1 is not because the density proposed is too much. Riedel moved, Gorham seconded to recommend to the Council that items 2 through 14 of the proposed conditions are generally acceptable as outlined above, but the density appears to be unacceptable for this development based on traffic concerns. ZONING ORDINANCE AMENDMENT — SECTION 1201.03, SUBD 2D Planning Director Darling stated that a draft ordinance amendment was included in the packet to remove the requirement for a CUP for accessory buildings over 1,200 square feet, but continue to require the same conditions. She explained that staff is also proposing some housekeeping changes to the language. She stated that in order to amend the ordinance, a Public Hearing will be necessary. Commissioner Riedel stated that he is in favor of this amendment, but, noted that in general, he is in favor of Conditional Use Permits. CITY OF SHOREWOOD PLANNING COMMISSION MEETING June 4, 2019 Page 10 of 10 Chair Maddy stated that he fully supports cleaning up the code and agrees with the proposed amendments. Riedel moved, Gorham seconded, to recommend approval to the Council for the zoning text amendments regarding oversized accessory buildings and cleaning up the language as proposed. Commissioner Gault asked what ordinance would be applied if someone wanted to put up a structure that is not a building, such as a windmill. Planning Director Darling stated that the height limitation would apply and it is in a different part of the code. She stated that when she brings the final form of this amendment back for the Public Hearing, she will include that section of the code as well. Commissioner Riedel asked what part of the code a gazebo or a patio would fall Planning Director Darling stated that a gazebo would be considered a building and a patio would be considered a structure. Chair Maddy asked where a screened in porch would fall in the code. Planning Director Darling explained that usually screened in porches are attached to the home so they would not be subject to the accessory building limitation, but if they were detached, they would. The proposal requires a CUP to allow 1,900 square feet of combined area of both accessory buildings where 1,200 square feet is permitted without a CUP. The proposed attached garage accessed from the south side of the home would be about 800 square feet and the attached garage and storage area accessed from the north side of the home would be is 1,100 square feet. Notice of this application was published in both the City's official newspapers and mailed to all property owners within 500 feet of the property at least 10 days prior to the meeting. Page 2 BACKGROUND Context: In 1965, the property was created as part of the Woodside subdivision and the home was constructed in 2005. The lot contains mature trees and is subject to the City's tree preservation policy. The subject property is within the shoreland overlay district for Lake Minnetonka. ANALYSIS Section 1201.03 Subd. 2. d. (4) of the zoning regulations provides specific conditions for granting conditional use permits for accessory buildings with a combined area over 1,200 square feet. The following is how the applicant's plans comply with the code: Dominance of the principal structure: The total area of accessory buildings (1,900 square feet) does not exceed the floor area (3,036 square feet) above grade of the proposed home. Ten percent of lot area: The total area of accessory buildings (1,900 square feet) does not exceed 10 percent of the minimum lot size for the R -lA zoning district (.10 x 40,000 = 4,000 square feet). Consideration of other buildings, drainage, and landscaping: The proposed house and garage would minimize the appearance of the attached garages by: South facing garage: The narrowest portion of the garage with two garage doors is oriented to the street. North facing garage: The side of the garage would be visible from the cul -de -sac, rather than the garage doors. The City Engineer would complete a full review of the site drainage with the building permit application. The applicant is substantially increasing impervious surface on the property and would need to control the rate of run -off from the improvements and infiltrate water if possible. -2- Page 3 Staff recommends including a condition requiring the applicant to submit drainage calculations with a building permit application. Tree preservation: The applicant indicates three trees would be removed. With their building permit application, the applicant must provide a landscaping plan to show where they would provide the seven required replacement trees. RECOMMENDATION Conditional use permits are reviewed according to standards listed in Section 1201.04 Subd 1. d. 1. of the zoning regulations and those specifically listed elsewhere in the zoning ordinance. Staff reviewed the request according to the standards and finds that they are met, as follows. Specifically, staff found the requests are consistent with the Comprehensive Plan, other uses in the neighborhood, would not tend to depreciate the area, and conforms to the applicable regulations of City Code. Staff also looked at the proposed use to determine if it would overburden the City's service capacity and could be accommodated with the existing public services and streets. Provision of municipal sewer would not be overburdened by the construction of the accessory buildings, nor would they encourage traffic beyond the capacity of the street. Should the application be recommended for approval, staff recommends that the following conditions be included into any approving resolution forwarded to the City Council: Prior to issuance of a building permit, the applicant shall submit the following, consistent with city regulations, policies and guidelines: o Submit a stormwater management plan including supporting drainage calculations. o Revise the plans to show conforming setbacks for the home and all accessory structures. o Revise the driveway accessing Woodside Road to no greater than 25 feet wide at the property line. o Show proposed grading on the survey. o A tree preservation/landscaping plan consistent with the City's tree policy. o Submit fixture details for the freestanding light fixtures and a sound source study for the backup generator. This application resulted from a concern raised by the Building Official earlier this year when the poles were installed. The proposed posts would be 15 feet tall and the westernly two posts would be installed on top of a four foot retaining wall. The netting would be about 14 feet tall and would also be installed above the retaining wall which varies in height due to the grades on the south side of the wall. The location of the batting cage is shown in the photo to the right, marked with an arrow. Notice of this application was published in both the City's official newspapers and mailed to all property owners within 500 feet of the property at least 10 days prior to the meeting. Page 2 BACKGROUND Context: Construction of the home began in 2015. The batting cage location did not require tree removal and is in the same approximate location as a previous sport court. The subject property is within the shoreland overlay district for Lake Minnetonka and the shoreline is also within the 100 -year floodplain. Applicable Code Sections: Section 1201.01 (Definitions): Fence: A partition, structure, wall or gate erected as a dividing marker, barrier or enclosure. Section 1201.03 Subd. 2 f. (9) (b) (iii) of the zoning regulations allows chain link or woven wire fences used for the enclosure of tennis courts or other recreational purposes not exceeding 10 feet in height. Section 1201.03 Subd. 2 f. (11) of the zoning regulations allows fences for special purposes and fences differing in construction, height or length in any district in the city by issuance of a conditional use permit. The photo to the right is an example of what the batting cage would look like when fully installed and the photo below shows the installation of the cage to date. The base of the batting cage would be crushed rock similar to the surface of a ballfield pitcher's mound and batter's box. The applicant proposes to set the batting cage 135 feet from the front property line and 21 feet from side the property line where 50 and 10 feet (respectively) are required. ANALYSIS Section 1201.04 Subd. 1. d. of the zoning regulations provides general conditions for granting conditional use permits. The following is how the applicant's plans comply with the code: • Comprehensive Plan: The batting cage would be consistent with the policies and provisions of the Comprehensive Plan. • Compatibility with Other Land Uses in the Area/General Welfare: While not common, batting cages have become more popular with residents and are unlikely to depreciate the area. The applicant's alternative, a 10 -foot tall chain link fence cage, would have a greater impact due to the constant noise when balls hit the metal fence. The applicant would screen the view of the batting cage from the abutting property to the west with the existing trees and would plant additional spruce trees adjacent to Edgewood Road to screen the -2- Page 3 cage from view. The photo to the right has an arrow indicating the visible posts for the batting cage. Where the gate is now, the applicant would plant additional spruce trees eliminating the view from the street. • Public Services: The proposed batting cage would not impact the provision of municipal sewer or streets. • General Regulations: The proposed batting cage conforms to the zoning district's setback requirements. RECOMMENDATION Staff recommend approval of the request, subject to the applicant requesting (and receiving) a zoning permit for the completion of the batting cage or modifying the building permit to include the batting cage consistent with city regulations, policies and guidelines. CONTEXT The lot was created as part of the Meakers Outlots to Excelsior subdivision in 1884 and was further subdivided into two lots by resolution prior to modern record keeping. The property is currently vacant. There are three wetland basins on the property, two on the west side of the site which are shown together on the sketch plan and one on the south side of the property. When the property is subdivided, wetland buffer requirements would apply. The property is not within the 100 -year floodplain, but the southern portion of the site is within the Shoreland Overlay District for Lake Minnewashta. The site contains mature trees and is subject to tree preservation with development. The properties to the north, east and south are developed with single - family homes and the properties to the west are developed with four -unit townhouses (quadraminiums). PROPOSAL The applicant's sketch plans (attached) show 20 houses to be clustered along a new street with a cul- de -sac at the end. This leaves the south side of the property to be left open for the future residents and stormwater needs. The type of home proposed is frequently called detached townhouses, villas or cottage homes. The homes would be slab on grade (no basement) and either one story, 1' /2 story, or two - stories with about 1,760 to 2,448 square feet. Having living area above the main floor is very important to the applicant because this type of home usually has bedrooms in the basement. Because of the high water table on the property and in the area, the applicant would not likely be able to construct basements and the upper level provides flexibility for the future homeowners. The homes would be between 36 and 40 feet wide. Graphics for the units are attached. The dwellings are estimated to sell starting at about $500,000. A homeowner's association would maintain the site. The developer notes that common maintenance and the type of homes proposed appeal to empty nesters, singles, and young married couples. Land Use /Density: The current density permitted is about seven homes with one unit per acre. At sketch stage, the proposed density and the number of units is still fluid. The applicant's sketch shows 20 units which is 2.81 units per gross acre of land. The density could rise or fall as other factors impact the plan, such as the removal of wetland and wetland buffer acreage from the calculation, the required setbacks and the amount of right -of -way dedicated for Seamans Drive and Eureka Road Page 3 For comparison, the Shorewood Ponds development to the west was approved with a density of 3.26 dwellings per gross acre. Setbacks: To accommodate the clustering of all the units on the north side of the development, the applicant is requesting reduced setbacks from the front property line and side property lines although they would maintain at least a 35 -foot rear setback to the north property line to allow for landscaping and would continue to look for ways to push the homes closer to the wetlands to the south as they prepare a full application. The proposed setbacks are as follows and the R -1D (smallest single - family district) setbacks are also included for comparison: Setback R -ID Applicant's Proposal Front 30 ft 15 ft Side loft 7 ft (between units) Rear 35 ft 35 -40 ft Side Abutting Eureka/Seamans 30 ft 35/25 ft The 15 -foot front setback combined with the distance between the front property line and the curb /street (about 11 feet) would accommodate vehicle parking on the driveway. This setback is similar to the distance between the private drives and the garage faces in the Shorewood Ponds development. Some of the buildings could meet a greater setback, which could break up the views of the homes from Eureka Road and Seamans Drive, but may increase tree removal. Utilities: The site has access to municipal water and sewer. The applicant would be required to provide treatment, rate and volume control. Stormwater: The applicant has proposed to include stormwater treatment for their development. Additionally, much of the stormwater from this property flows south to Lake Minnewashta through a culvert under State Highway 7, away from poorly draining areas to the west and north of the property. Full details on the stormwater plan must be provided with any formal application and the applicant's proposal must be consistent with City, MnDOT and MCWD requirements. The MCWD reviewed a previous concept and the results of their review were available to the applicant as preliminary comments. Tra ic: Although the access point to State Highway 7 is conveniently located to the site, traffic backups do occur in morning and evening peak hours. Similarly, morning and evening backups occur at Smithtown Road. Consequently, with the application for a comprehensive plan amendment, staff recommends the applicant submit a traffic analysis (completed through the City's Traffic Engineer) to determine the impact of the development on the two intersections and at the intersection of the new street and Eureka Road. Streets /Public Rights -of -Way /Parking: The applicant would be required to dedicate the new street right -of -way and build the new street to city standard as part of their application. The required right - of -way width is 50 feet for the street with a 50 -foot radius for the cul -de -sac right -of -way. Staff also recommends requiring the applicant to dedicate additional right -of -way for the adjacent Eureka Road and Seamans Drive so that the City has the right -of -way needed for future road reconstruction projects. The required amount of right -of -way is 50 feet for each street. Page 4 The applicant shows a 28 -foot wide street which would allow for on- street parking for guests and to accommodate future parties and other events. In addition, the driveway and garages for each home would provide four parking spaces. Staff recommends the applicant include conditions in their homeowners association documents that requires the garages to be used for parking of at least one vehicle (rather than used exclusively for storage) and no recreational vehicles, including trailers, boats, RVs, etc. be allowed in the garages or anywhere in the development due to the reduced setbacks. Wetlands: The Minnehaha Creek Watershed District (MCWD) has reviewed a wetland delineation and has identified three wetland basins. Two of the basins are combined together on the west side of the site. The buffers and setbacks on the two wetlands appear to be conceptually consistent with City Code. Tree Preservation: The site is subject to tree preservation. Staff recommends completing a tree inventory and identifying the best trees on the site and working around them where possible. The City's tree preservation regulations and policy would apply to any future development application. COMMENTS Staff (including staff from the MCWD and the fire department) propose the following comments. Those based on subjective standards show both positive and negative options. The Planning Commission may add to, remove, or amend them. 1. The density shown appears (or does not appear) to be acceptable based on the location, layout, existing government services, and complicating factors such as the high water table, wetlands, etc. 2. The design and height of the dwellings with one, 1 -1/2 or two - stories appears (or does not appear) to be acceptable based on the location, surrounding uses, reduced setbacks, high water table, wetlands, etc. 3. The reduced setbacks needed for the clustered development seems (does not seem) like an acceptable trade for the amount of open space provided and type of unit proposed. 4. With a comprehensive plan amendment application, the applicant should provide a traffic analysis (through the City's Engineer) for Eureka Road at the new street intersection and the State Highway 7 and Smithtown Road intersections to determine the impact of the proposed development. 5. The setback from both Eureka Road and Seamans Drive should be 35 feet to allow for additional room for landscaping and screening for the new homes from the noise and activity on the existing streets. 6. Right -of -way dedication should occur consistent with City Code for the new and adjacent city streets and result in a minimum of 50 feet of right -of -way, except as indicated in number 7 (below). 7. Increase the radius of the cul -de -sac to 45.5 feet and the ROW to 100 feet. 8. The watermain should be extended to the north and south extent of the right -of -way along Seamans Drive to allow for further extension in the future. 9. Work with the City and MCWD for stormwater treatment and provide a plan consistent with the requirements. Provide soil borings that verify separation requirements between the buildings and the water table. 10. Impervious surfaces on the private property shall be limited to 33 percent for all portions of the property outside the shoreland district and 25 percent within the shoreland district. Page 5 11. Add language into the HOA documents that restrict the use of garages to require a minimum of one car to be parked within the garage and prohibit parking of recreational vehicles in the development or in the garage. Consider increasing the number of trees above those required to provide additional buffer between the development and the two existing homes to the north. 14. Amend the shoreland district to accommodate a channel that lies below the OHWL on the north side of Minnewashta Lake. The City received bids on Thursday, June 18, 2019, and WSB has prepared a bid results letter with recommendation for awarding the project and summary of bids received. The Lowest responsive bid received is from Bituminous Roadways, Inc. of Mendota Heights, Minnesota, with their grand total bid of $539,693.00. The Engineer's Estimate, prepared prior to receiving bids, was $569,220. Financial Impact: The Council approved a budget of $608,000 at the May 28th City Council meeting for bituminous mill and overlay improvements in 2019. The Applicant shall dedicate a staff person as a lot attendant to direct traffic to the off - site parking facilities. Mission Statement: The City of Shorewood is committed to providing residents quality public services, a healthy environment, a variety of attractive amenities, a sustainable tax base, and sound financial management through effective, efficient, and visionary leadership. $6,000,000 $5,000,000 $4,000,000 $3,000,000 $2,000,000 $1,000,000 $0 — GENERAL FUND REVENUES Taxes Licenses and Intergovernmental Charges for Fines and Special Miscellaneous Permits Services Forfeitures Assessments ■ 05/31/18 ■ 05/31/19 2019 Budget Expenditures: • General government expenditures through May 2019 were $630,213 (44.0% of budget), or 1.0% higher than 2018. o City Council year -to -date expenditures through May 31 were 1.8% higher than the prior year. • Administration year -to -date expenditures through May 31 were 1.1 % higher than the prior year. • Finance department expenditures were 41.9% of budget. • The Professional Services department expenditures were 46.2% of budget, due to the inclusion of 50% of County assessor fees in January 2019. • Planning expenditures were 38.0% of budget and were 19.2% lower than the prior year, due to comprehensive plan costs in 2018. • Municipal building expenditures were 69.7% of budget, due to inclusion of annual insurance costs recorded early in 2019. • Public safety expenditures were $1,201,157 through 05/31/19 (52.9% of budget), increasing 7.3% from $1,119,130 through 05/31/18. o Police expenditures were at 50.2% of budget through May 2019, or 2.3% higher than the prior year. o Fire expenditures were at 52.1% of budget through May 2019, or 4.1% higher than the prior year. o Protective inspections were 85.5% of budget through May 2019. The cost overage is related to unbudgeted personnel transition costs, including severance payouts. • Public works expenditures totaled $395,649 through 05/31/19 (35.9% of budget), increasing from $377,810 through 05/31/18. o General public works operating costs were 6.6% higher through 05/31/19, while ice and snow removal costs were virtually unchanged through 05/31/19. • Parks and recreation expenditures amounted to $79,864 through May 2019, a 22.2% decrease from 2018, reflecting a shift in personnel costs to other departments and utility funds. • Budgeted transfers out to other funds were $1,186,305 through May 2019, as compared to $1,163,895 through May 2018. IJN18?Aa i CITY OF SHOREWOOD We need your help! We have some concerns in the Shorewood Pond, Senior living area. We live on Park Lane, which joins Freeman Park. On Game nights the cars park up and down Park Lane, on both sides of the street! OUR CONCERNS ARE: • Emergency vehicles cannot get through to reach their destination. This could delay any emergency medical help needed. This could mean life or death to the person needing help. • The post Person often cannot get into the mail boxes and this delays the deliveries. • Many of the residents have problems getting into or out of their driveways. • This is a Senior Citizen resident area and often we, at this time, cannot ride our bikes, scooters or walk our dogs along Park Lane. • To post "No Parking" on one side of the street would open up our street for Fire trucks, First responders, emergency trucks, mail delivery and the people who often are afraid to walk or even take their pets out for a walk during this time of day.
