ORDINANCE PROHIBITING DISCRIM-
INATORY PRACTICES BASED ON
RACE, COLOR, CREED, RELIGION,
ANCESTRY, NATIONAL ORIGIN OR
SEX WITH RESPECT TO EMPLOY-
MENT, HOUSING ACCOMMODATIONS,
PROPERTY RIGHTS, EDUCATION,
PUBLIC ACCOMMODATIONS AND
PLBLlC SERVICES
THE VILLAGE COUNCIL OF THE
VILLAGE OF SHOREWOOD ORDAINS:
SECTION 1. Declaration of Policy and
Purposes.
It is the public policV of the Village of
Shorewood to assure for all persons free-
dom from discrimination because of race.
color. creed. religion. ancestry national
ori~in. or sex with respect i~ emplov-
ment. housing. property rights. educa-
tIon. public services and accommodations
which discrimination threatens the
rights. privile~es. opportunities and free-
dom of all persons and menaces the insti-
tutions and foundations of democracy. To
effectuate this policy the Village of Shore-
wood has heretofore on Januarv-13 1969
established a human relations co~mis:
s~o.n. the purpose of which is to secur:? all

hc services and education. and to assist
this village to implement the Minnesota
State Act against discrimination. bein~

SECTION 2. Without limitation the fol-

ral or request for assistance in procure-

Subd. 3. For any labor organization
because of race. color. creed. religion.
ancestry. national ori~in or sex to deny
full and equal membership ri~hts to an
applicant for membership or to a

wise discipline a member or to accord
adverse or unequal treatment to any
person with respect to his hiring. ap-
prenticeship. traininj!;. tenure. compen-
sation. upj!;rading. lavoff or any term or
condition of emplovment.
Subd. 4. For any person having any
interest in real property and any real
estate broker or real estate a~ent be-
cause of race. color. creed. religion.
ancestry. national origin. or sex to fail
or refuse to sell. rent. assign. or other-
wise transfer any real property to any
other person. or to accor4 adverse. or
unequal treatment to any person with
respect to the acquisition. occupancy.
use. and enjoyment of any real proper-

. Subd. 5. For any person en~aged in
the provision of public accommoda-
tions. because of race. color. creed. re-

son access to the use and benefit of the
services and facilities of such public

terms and conditions under which the

Subd. 6. For anv person enga~ed in
the provision of public services bv rea-

cestry. national origin. or sex. to fail or
refuse to provide to anv person access
to the use and benefit thereof. or to
provide adverse. or unequal treatment
to any person in connection therewith.
Subd. 7. For any person to conceal. or
attempt to conceal any unlawful dis-
crimination or to aid. abet. order. com-
pel. induce. or attempt to induce. an-
other person to discriminate in any
manner or to encourage or facilitate
discrimination. or to threaten. hinder.
or engage in any action against any
person who may proceed or desire to
proceed to enforce any part of this ordi-
nance by filing a complaint. or testify.

Subd. 8. For any person. bank. or
other financial institution to whom ap-
plication is made for financial or other
assistance for the purchase. improve-
ment. lease. construction. rehabilita-
tion. repair. or maintenance of any real
propertv to deny such application or
withhold the extension. modification or
renewal of any existin~ loan or to im-
pose rates. terms. or conditions differ-
ent from the usual in extendin~ such
financial assistance because of dis-
crimination a~ainst the applicant or
because of any intended use bV the ap-
plicant. or any of such applicants. les-
sees. tenants: or assigns.
Subd. 9. Terms used in this section
are defined as follows:

companies. financial institutions,
clinics and rest homes.

association of individuals who. within
the Village of Shorewood. hires or
employs any employee whose serv-
ices are partiallv or whOllV per-
formed in the Village of Shorewood
but the term employer shall not in-

the hiring or employment of a house-
hold domestic servant. or 12 I Anv
religious corporation or societv with
respect to hiring of individuals of a
particular religion or sex when reli-
gion or sex shall be a bona fide occu-
pational qualification for emplov-
ment. provided. such selection IS not
based on race. color. ancestry or na.
tionalorigin. .
SECTION 3. Contracts with the Village
of Shorewood.
In ani contract by or with the Village
of Shorewood, including any of its con-
tracting agencies, departments, and
agents there shall be included at least
the following provisions which shall bind
the other contracting party.
Subd. 1. That with respect to any .
and all action taken or acts performed
pursuant to said contract. such other
contracting party shall be deemed to be
an employer within the meaning of this
ordinance and shall be subject to the
provisions thereof.
Subd. 2. That in the event said other
contracting party fails to perform the
aforesaid contractual provisions. said
contract Olav forthwith be terminated
and cancelled in whole or in part by the
Village of Shorewood and said other
contracting party shall be liable for anv
costs or expenses incurred bv the Vil-
lage in obtaining from other sources.
the work and services to be rendered or
performed or the goods or properties to
be furnished or delivered to the Village
under the contract so terminated or
cancelled.
Subd. 3. That should the Village in a
proceeding brought as hereinafter pro-
vided, find that the said contracting
party has engaged in discrimination in
connection with anv such contract. and
if such contract remains unfinished. the
Yillage shall withhold up to 10 " of the
said contract price until such time as
the Village's order has been complied
with or said other contracting party has
been adjudicated not guilty of such dis-
crimination. If such contract has been
completed. the Village shall enter into
no further contracts with such con-
tracting party until such time as the
Village's findings and recommenda-
tions have been complied with or other-
wise satisfied.
Subd. 4. That said other contracting
party will permit access to anv and all
records pertaining to the hiring and
employment and to other pertinent
data and records for the purpose of
enabling the Village. the Commission.
its agencies. or representatives, to as-
certain compliance with the provisions
of this ordinance' applicable to said oth-
er contracting party.
Subd. 5. This section shall be binding )
on all subcontractors and suppliers.
SECTION 4. All officials. commission,
ers. . agents. employees and servants of
the Village of. ~horewood. elected or ap-
pointed. whether serving with or Without
compensation, shall observe the terms
and conditions of this ordinance.
SECTION 5. The human relations com-
missiop heretofore established by the Vil-
lage of Shorewood is reaffirmed in its ex-
istence and its purposes and duties sha'll
be as outlined and provided for therein. as
well as provided by Chapter 363 of Minne-
sota Statutes amended.
SECTION 6. Any person. firm. corpora-
tion or association of persons to violate
any provision of this ordinance or com-
mits anv unfair discriminatorv act as set
forth in'this ordinance or attempts. abets.
incites. compels or coerces another to do
so shall be guiltv of a' misdemeanor and
shall be fined a sum not to exceed $300.00
or shall be imprisoned for a period not to
exceed 90 davs. This ordinance shall take
effect upon passage and publication ac-
cording to law.
