(Official Publication) ORDINANCE NO. 62 ORDINANCE PROHIBITING DISCRIM- INATORY PRACTICES BASED ON RACE, COLOR, CREED, RELIGION, ANCESTRY, NATIONAL ORIGIN OR SEX WITH RESPECT TO EMPLOY- MENT, HOUSING ACCOMMODATIONS, PROPERTY RIGHTS, EDUCATION, PUBLIC ACCOMMODATIONS AND PLBLlC SERVICES THE VILLAGE COUNCIL OF THE VILLAGE OF SHOREWOOD ORDAINS: SECTION 1. Declaration of Policy and Purposes. It is the public policV of the Village of Shorewood to assure for all persons free- dom from discrimination because of race. color. creed. religion. ancestry national ori~in. or sex with respect i~ emplov- ment. housing. property rights. educa- tIon. public services and accommodations which discrimination threatens the rights. privile~es. opportunities and free- dom of all persons and menaces the insti- tutions and foundations of democracy. SECTION 3. Contracts with the Village of Shorewood. In ani contract by or with the Village of Shorewood, including any of its con- tracting agencies, departments, and agents there shall be included at least the following provisions which shall bind the other contracting party. Subd. 1. That with respect to any . and all action taken or acts performed pursuant to said contract. such other contracting party shall be deemed to be an employer within the meaning of this ordinance and shall be subject to the provisions thereof. Subd. 2. That in the event said other contracting party fails to perform the aforesaid contractual provisions. said contract Olav forthwith be terminated and cancelled in whole or in part by the Village of Shorewood and said other contracting party shall be liable for anv costs or expenses incurred bv the Vil- lage in obtaining from other sources. the work and services to be rendered or performed or the goods or properties to be furnished or delivered to the Village under the contract so terminated or cancelled. Subd. 3. That should the Village in a proceeding brought as hereinafter pro- vided, find that the said contracting party has engaged in discrimination in connection with anv such contract. and if such contract remains unfinished. the Yillage shall withhold up to 10 " of the said contract price until such time as the Village's order has been complied with or said other contracting party has been adjudicated not guilty of such dis- crimination. If such contract has been completed. the Village shall enter into no further contracts with such con- tracting party until such time as the Village's findings and recommenda- tions have been complied with or other- wise satisfied. Subd. 4. That said other contracting party will permit access to anv and all records pertaining to the hiring and employment and to other pertinent data and records for the purpose of enabling the Village. the Commission. its agencies. or representatives, to as- certain compliance with the provisions of this ordinance' applicable to said oth- er contracting party. SECTION 6. Any person. firm. corpora- tion or association of persons to violate any provision of this ordinance or com- mits anv unfair discriminatorv act as set forth in'this ordinance or attempts. abets. incites. compels or coerces another to do so shall be guiltv of a' misdemeanor and shall be fined a sum not to exceed $300.00 or shall be imprisoned for a period not to exceed 90 davs. This ordinance shall take effect upon passage and publication ac- cording to law.
