CONVENE CITY COUNCIL REGULAR MEETING Mayor Zerby called the meeting to order at 7:00 P.M. Those in attendance recited the Pledge of Allegiance A. Roll Call Present. Review Agenda Labadie moved, Siakel seconded, approving the agenda as presented. Motion passed 3/0. 2. CONSENT AGENDA Mayor Zerby reviewed the items on the Consent Agenda. He stated that the city received two grants totaling around $36,000 and thanked staff for their efforts to secure this money for the city. MATTERS FROM THE FLOOR Matt Doepke, 20350 Excelsior Blvd, stated that he would like to propose an amendment to the short-term rental ordinance that was put in place in 2016. He stated that he would like to see the ordinance amended to allow short term rentals in a shared living situation. He gave examples of how he thinks this amendment could benefit residents in the City. 4. PUBLIC HEARING 5. REPORTS AND PRESENTATIONS 6. PARKS A. Report of Commissioner Gallivan on October 8, 2019 Park Commission Meeting Parks Commissioner Gallivan gave an overview of the October 8, 2019 Park Commission Meeting as reflected in those minutes. 7. PLANNING 8. ENGINEERING/PUBLIC WORKS A. Accept Chaska Road Traffic Study City Engineer Fauske explained that the first draft of this traffic study was done last November and was based on July traffic information. She stated that Council had requested that it be sent back and traffic data be captured while school is in session. She noted that traffic counts were not conducted during the winter months because of the narrowing of roadways due to snow placement. She stated that the data was gathered during the last week of school which did include additional traffic volumes. She noted that the report also includes updated crash history information. She reviewed the identified issues and recommendations from the traffic studies for the Council to consider in both the short-term and the long-term. Mayor Zerby stated that there is an average of eight incidents a year happening in this corridor. He stated that one of the ideas to improve safety was lighting and asked if there was a light at the intersection of Highway Seven and Chaska Road. City Attorney Keane stated that there is not a light at that intersection. Mayor Zerby noted that that the crash information does not say what time of day the incidents are happening which he believes would be beneficial. He stated that he thinks the City should talk to the State and see what their thoughts are regarding this intersection. City Engineer Fauske asked if the Council would like clarification on the report or just to have staff follow up. Mayor Zerby CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES OCTOBER 28, 2019 Page 3 of 4 noted that he would like to have clarification on the time of the crash incidents. Councilmember Sundberg stated that she would also like to know if there is a back-up as people are exiting. Mayor Zerby stated that he did not think it needed to be an agenda item, but could just be a memo sent to Council will the additional information they have requested. Councilmember Siakel asked about the driver awareness signs. City Engineer Fauske explained that the driver awareness signs would be something like the flashing speed awareness signs. B. Miscellaneous City Drainage Structure Repairs City Engineer Fauske explained that Public works has identified four drainage structures in need of repair. She noted that there has been some difficulty in getting pricing from contractors because of the time of the year. She stated that the City got a quote from Minger Construction of a not to exceed $20,000. Sundberg moved, Siakel seconded, Adopting RESOLUTION NO. 19-100, “A Resolution Accepting Quote and Awarding Contract for the Drainage Structure Maintenance.” Motion passed 4/0. 9. GENERAL/NEW BUSINESS 10. STAFF AND COUNCIL REPORTS A. Administrator and Staff 1. September 2019 General Fund Budget Report Finance Director Rigdon gave a brief overview of the General Fund budget report through September 2019. He noted that that the second half of the property taxes will be received in December. He stated that he is expecting a budget surplus between one hundred and two hundred thousand dollars by year end. Other City Engineer Fauske reported that the mill and overlay project has been finished other than some cleanup work off the roadways. She stated that the crews that were working on the Vine Hill culvert did not get as far along as they had hoped last week and are still working. She stated that the hope is that they will be finished up tomorrow so the road can be reopened. Mayor Zerby asked if the roadways had been painted yet. City Engineer Fauske stated that because the weather is heading for a cold snap this week, she will need to contact some striping contractors and see if they are available and what the cold temperatures will mean to getting that work completed. Planning Director Darling updated the Council on the park projects at Freeman Park and Badger Park. She noted that because of the temperatures, it is not looking promising to complete the poured-in-place rubber surface installed for the playground this year. CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES OCTOBER 28, 2019 Page 4 of 4 Councilmember asked what would happen over the winter if the poured in place surface is not installed this year. Planning Director Darling explained that the park would remain closed over the winter if the surface is not installed. City Administrator Lerud explained that the City received notice from Hennepin County that the City was awarded the Tree Canopy grant for 2020. He noted that this money will be used for tree removal and replanting. He stated that the funds will also be used to improve the City’s record keeping for the tree inventory. He stated that per Public Works Director Brown, the pumping at Mary Lake is continuing and are hoping to finish pumping for the season by the end of this week. Mayor Zerby asked if there had been any progress on the Public Works building roof. City Administrator Lerud stated that he believes the spec is being worked on, but noted that it will be an extra project. B. Mayor and City Council Councilmember Labadie asked about the Tree Canopy grant. She asked if the tree removal would be mainly focusing on trees that have been identified as dying or if it will focus on ash trees. City Administrator Lerud stated that it will be exclusively be for ash trees. Mayor Zerby stated that the City had received the Most Engaged Residents award for Partner in Energy efforts because the City signed up the most residents for wind energy, per capita, for than any other participating city. 11. The office will be th closed a half-day on Tuesday, December 24, a full day on Wednesday December 25, and a full day on January 1, 2020. Phone and walk-in business is typically very slow the week between Christmas and New Year. In addition, many employees opt to utilize vacation days for some or many of these days. Staff is requesting to officially close city hall all day on Tuesday, December 24, 2019 for Christmas Eve. City hall staff may use personal, vacation, or accrued comp time for the additional four (4) hours not covered by the holiday pay. As established by the union contract, the public works department will remain open for the half day on December 24. City hall closures are posted on the city website, in the city’s social media postings, as well as being posted on the front door. Council Action Requested: Staff respectfully requests consideration of a motion authorizing the official closure of City Hall for the Christmas Eve holiday on December 24, 2019. Motion, second, and simple majority is all that is needed to approve. Page 1 #2D MEETING TYPE City of Shorewood Council Meeting Item REGULAR Title / Subject: Assessment Agreements for Water Connections Meeting Date: November 12, 2019 Prepared by: Joe Rigdon, Finance Director Reviewed by: Greg Lerud, City Administrator Attachment: Resolution Certifying Special Assessments on the 2020 Hennepin County Property Tax Rolls Background: Subsequent to the Council approving the notice and incentive program for properties that have access to public water, but are not connected to the municipal water system, staff has received many inquiries for additional information. An assessment agreement was developed in consultation with the city attorney, and in 2018, one property signed an assessment agreement, while fifteen properties have signed assessment agreements to date in 2019. The current water access charge of $10,000 is payable over 10 years at 0% interest upon certification. Prior water assessments collected are applied against the $10,000 access charge when applicable. Recommendation / Action Requested: Staff recommends approval of the Resolution Certifying Special Assessments on the 2020 Hennepin County Property Tax Rolls. Next Steps and Timeline: The assessments will be certified with the Hennepin County Assessor’s office. Upon adoption the clerk shall certify to the County Auditor the amount due, plus a certification fee as established in the Shorewood Master Fee Schedule and the County Auditor shall thereupon enter the amount as part of the tax levy on the premises to be collected during the ensuing year. Background: The City of Shorewood is responsible for providing water, sewer, stormwater, recycling and zoning services to property owners within the city limits. The city has established fees for the provision of these services as delineated in the City’s Master Fee Schedule. The city has a procedure for collection of past due fees pursuant to Shorewood City Code, Section 903.09. City staff has worked diligently to collect the delinquent amounts minimizing the unpaid charges to be certified. All delinquent accounts were notified of the process pursuant to state statute and had sufficient time to make payment arrangements or pay the unpaid charges. In addition, all delinquent account holders were notified that property owners wishing to object to proposed assessments against their property should attend the November 12, 2019 city council meeting where council would consider the assessment levied against their property. Action Requested: Staff respectfully recommends the city council hear and consider any property owner objections to the proposed assessments and approve (with changes if applicable) the Resolution Therein Certifying Unpaid Charges to the 2020 Hennepin County Tax Rolls. The council direction was to call for a public hearing to consider the request. The two site concepts included with this memo were shared at the October 15 work session. The exterior rendering of the first project concept was received since the work session. Staff did not receive an exterior rendering showing the elevation of the buildings if the easement was left in place. At the work session there was a question about the age of the city’s service lines. If the vacation is approved, Doran proposes to reconnect, at no cost to the city, public works and public safety service lines to new water and sewer mains that are proposed to be installed around the apartment building. If the easement is not vacated, staff would propose that at the time of construction of the project, that the city install new service lines in the easement to “re-start” the life on those lines. That work would be coordinated so it would not interfere with the apartment building construction. Staff expressed concerns about the close proximity of the public works building to the apartments with the first concept design, but the proposed project is a Tonka Bay project and they have approved an apartment project on this site. As was stated at the last work session, this project will be constructed but the final layout will be determined based on the council’s decision to vacate the easement. Financial or Budget Considerations: If the council decides to not vacate the easement, staff recommends that new water and sewer service lines be installed through the easement at the time the site work is being done on the buildings. That cost is estimated to be $40,000. The city will still be responsible for maintaining those lines. Page 1 service lines, as Doran has indicated replacement of those lines will be done at the time of the project. In addition, because the new mains will be constructed closer to the property line, the service lines the city will continue to be responsible for will be much shorter. Options: The decision to vacate the easement is entirely the City’s Council’s decision and no finding of fact or public purpose is needed as the basis of the decision. Two Resolutions have been included with this agenda item – one approving the vacation request, the other denying the request. A simple majority vote of one of the Resolutions is all that is required. Next Steps and Timeline: If the council decides to vacate the easement, staff will work with the City of Tonka Bay and the developer to ensure utilities to serve the public works and public safety facilities will be done to minimize disruption. RESOLUTION 19- CITY OF SHOREWOOD COUNTY OF HENNEPIN STATE OF MINNESOTA A RESOLUTION APPROVING THE REQUEST TO VACATE AN EASEMENT ACROSS 5609 MANITOU ROAD IN TONKA BAY WHEREAS, the City of Shorewood has a utility easement, Document No. 3650838, across 5609 Manitou Road in the City of Tonka Bay; and WHEREAS, the easement provides water and sewer service to the Shorewood Public Works building and the Public Safety building; and WHEREAS, the City of Shorewood received a request from a developer to vacate that easement in order to construct an apartment building project; and WHEREAS, a public hearing was held on November 12, 2019 to consider the request, NOW THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA AS FOLLOWS: 1. The City hereby approves the easement vacation with the following stipulations: a. The fully-executed vacation will be delivered at the time the new water and sewer service lines are installed and serving the public works and public safety buildings. b. PUBLIC HEARINGS Chair Maddy explained the Planning Commission is comprised of residents of the City of Shorewood who are serving as volunteers on the Commission. The Commissioners are appointed by the City Council. The Commission’s role is to help the City Council in determining zoning and planning issues. One of the Commission’s responsibilities is to hold public hearings and to help develop the factual record for an application and to make a non-binding recommendation to the City Council. The recommendation is advisory only. A. PUBLIC HEARING – P.U.D. Amendment to Reduce Front Setback for Certain Lots on Prestwick Court – Minnetonka Country Club Applicant: Gonyea Homes Location: 5820, 5840 and 5860 Prestwick Court CITY OF SHOREWOOD PLANNING COMMISSION MEETING October 22, 2019 Page 2 of 5 Chair Maddy opened the Public Hearing at 7:04 P.M. noting the procedures used in a Public Hearing. Planning Director Darling explained that the applicant has proposed amending the setbacks for three homes on Prestwick Court in order to save one or two mature oak trees. She gave an overview of the location of the lots and noted that the buyer for the lot at 5860 Prestwick Court is only interested in purchasing the lot if the mature oak tree can be saved. She stated that they are proposing to build the home closer to the street to protect the majority of the drip line area. She explained that staff had some concerns about the street view if there is only one house located on the angled portion of the street. She stated that because of this concern, she asked the applicant to include the two lots to the north as part of the PUD amendment. She noted that the setbacks along Prestwick Court are not consistent because of the idea that they may be able to save some of the trees. She noted that staff finds that the request meets the standards for the PUD. Commissioner Riedel stated that there are recommendations that appear to be designed to protect the trees from damage during construction. Planning Director Darling stated that staff is recommending that the applicant consult with an arborist or landscape architect on the appropriate construction techniques to minimize the impact of construction on the trees. She stated that the other conditions were to install tree preservation fencing around the drip line and not to have grading or alteration on the site prior to the building permit. She noted that there has already been mass grading on the site, but these areas were protected with the hope that they could be saved. Chair Maddy confirmed with Planning Director Darling that these were conditions attached to the building permit. Commissioner Eggenberger asked what would stop the homes on 5840 and 5820 from being built on the original setback. Planning Director Darling stated that she did not require them to be built forward because all of the setbacks are minimum, but noted that the Commission could do a “build to” line so they are as close to the street as the lot at 5860. Chair Maddy asked if 5880 was still under the applicant’s control. Planning Director Darling stated that she believes lot at 5880 is currently in for a Building Permit. Chair Maddy stated that his suggestion was going to be whether the City could push it forward five feet so there is more of a contour similar to what was done across the cul-de-sac. He stated that to do that may require an additional Public Hearing. Planning Director Darling stated that because of the road layout, she did not think that lot posed much of an issue. She stated that the Commission could still discuss the idea with the applicant. Rick Packer, Gonyea Homes, stated that the survey that they submitted shows where the home on 5880 would be and that he didn’t believe the change in setback would be as impactful. Commissioner Eggenberger asked if the applicant would be opposed to a “build to” line for lots 5840 and 5820. Commissioner Riedel stated that he assumed the large silver maple on lot 5860 would be taken down, but noted that the large oak trees are beautiful and he understands why they would want them saved, if possible. Commissioner Gorham asked if the applicant typically had an arborist or landscape architect consult during the construction phase. Mr. Packer stated that they do not, but they have no issue with that being a requirement in this situation. Commissioner Gorham stated that the condition about the applicant consulting with an arborist or landscape architect is not the most detailed direction and could be interpreted in various ways. He asked if the Commission would want to more clearly define those terms. Commissioner Riedel stated that he agreed that the phrase “consult” could be construed many ways. He noted that in this instance, both the builder and the buyer have interest in preserving the trees, so adding conditions may not be necessary. He stated that if the Commission wanted to be more definitive, they could say something like, “A written recommendation be provided by a certified arborist.” The Commission discussed whether or not to add an additional condition regarding recommendations by an arborist. Chair Maddy suggested that a condition be added that states, “With each of the three lots, the applicant shall obtain a written tree care summary from a certified arborist.” Mr. Packer asked if this would mean that the homeowner for the other two lots would have to save the trees. He stated that he has no problem with the certified arborist working on 5860, but isn’t sure about the other two lots yet. Chair Maddy stated that the condition could be specifically for lot 5860. Mr. Packer stated that he is hopeful that the other owner will want to save the other significant oak tree. Commissioner Eggenberger asked if the Commission wanted to add a condition regarding the “build to” line as suggested. Commissioner Gault stated that he understands that the second oak tree is scheduled to come down but asked if the Commission could add a condition that it be preserved. Commissioner Riedel stated that he is strongly in favor of preserving the second oak tree, but questions whether this would be within the scope of the Planning Commission. He asked Planning Director Darling if a stipulation that trees cannot be cut would be in the purview of the Planning Commission. Planning Director Darling stated that the Planning Commission could make that a requirement. PUBLIC HEARING – PRELIMINARY AND FINAL PLATS FOR JARRETT ADDITION Applicant: Sathre-Bergquist, Inc. Location: 5315 Howards Point Road Chair Maddy opened the Public Hearing at 7:30 P.M. noting the procedures used in a Public Hearing. Planning Director Darling explained that the applicant would like to subdivide the property at 5315 Howards Point Road into two lots and construct one new home, with the existing home remaining. She stated that staff recommends approval based on the finding that the lots would be consistent with subdivision and zoning requirements and subject to the conditions as listed in the staff report. She stated that they are also recommending an additional condition that there be an encroachment agreement to allow the existing improvements to remain in place. David Pemberton, Sathre-Bergquist, Inc., stated that he is available to answer any questions the Commission may have. He stated that the homeowners’ plan is to build a new home on the northerly lot and then gift the existing home to a family member. Commissioner Riedel stated the engineer’s memo dictates that the applicant install stormwater management features and asked if any trees would be taken out for the holding ponds. Mr. Pemberton stated that they will not be taking out any trees for the infiltration basins. Commissioner Gault asked why the lot lines weren’t just shifted a bit in order to take care of the hard cover requirements. Mr. Pemberton stated that may be an option. Commissioner Gault noted that lots 1 and 2 were reversed between the staff report and the engineer’s memo. Mr. Pemberton clarified that Lot 1 is the larger lot with the existing home. FOR 5820, 5840, AND 5860 PRESTWICK COURT WHEREAS , Gonyea Homes, Inc. (Applicant) has requested an amendment to the Minnetonka Country Club PUD to allow reduced front setbacks on three lots in the PUD and on the properties legally described as: Lots 1, 2 and 3, Block 1, Minnetonka Country Club, Third Addition, according to the recorded plat thereof, Hennepin County, Minnesota; and WHEREAS, the Applicant proposes the reduced setbacks of 30 feet instead of 40 feet to allow the preservation of two mature oak trees that were previously approved to be removed. MEETING TYPE Regular Meeting City of Shorewood Council Meeting Item Title / Subject: Update on Fire Lane Enforcement Meeting Date: November 12, 2019 Prepared by: Marie Darling, Planning Director Background: At the January 15, 2019 joint worksession with the Planning and Parks Commissions, the Commissioners determined the next step in examining the fire lane issue was to survey and identify the boundaries of the fire lanes, and from there the Commissions would take the lead on re-examining how the fire lanes are being used and what changes to the regulations may be needed. The surveying and other work would not be completed until next spring. At the October 15, 2019 City Council meeting, a Councilmember indicated that until staff can complete the larger study on the fire lanes, they should enforce the current regulations, which would include the prohibition on vehicles accessing Lake Minnetonka on the Grant Lorenz fire lane. To that end and unless directed otherwise, staff would begin the following procedures:  Send a letter to the interested residents and the adjacent property owners letting them know that the city will be enforcing the current regulations until a fire lane study is completed.  Send a letter to those residents that have blocked access to the fire lane on Enchanted Island with permanent improvements with a deadline to remove their personal property.  Place barriers in the Grant Lorenz fire lane to impede vehicle access, but not pedestrian access, to the lake. As the above involves enforcing current regulations, no action from the City Council is needed unless the City Council finds additional action is warranted. Financial or Budget Considerations: Cost is limited to the public works staff time and equipment to place barriers in the fire lane. Cost of the fire lane study is anticipated to include surveying costs and staff time to prepare materials and advertise the meetings.
