CONVENE CITY COUNCIL REGULAR MEETING Mayor Zerby called the meeting to order at 7:00 P.M. 5755 COUNTRY CLUB ROAD COUNCIL CHAMBERS 7:00 P.M. Due to the Centers for Disease Control's recommendation regarding limiting the number of people present at a meeting and pursuant to MN Statute 13D.02, the Shorewood City Council meetings was held by electronic means. A. Roll Call Present. Mayor Zerby; Councilmembers Johnson, Labadie, Siakel, and Sundberg; City Attorney Keane; City Administrator Lerud; City Clerk Thone; Finance Director Rigdon; Planning Director Darling; Director of Public Works Brown; and, City Engineer Budde Absent: None B. Pledge of Allegiance C. Review Agenda Sundberg moved, Johnson seconded, approving the agenda as presented. Roll Call Vote: Labadie, Johnson, Siakel, Sundberg, Zerby voted Aye. Motion passed. 2. CONSENT AGENDA Mayor Zerby reviewed the items on the Consent Agenda. Labadie moved, Johnson seconded, Approving the Motions Contained on the Consent Agenda and Adopting the Resolutions Therein. A. City Council Regular Meeting Minutes of March 23, 2020 B. Approval of the Verified Claims List C. Call for Public Hearing on Street Reconstruction Plan, RESOLUTION NO. 20- 027, "A Resolution Calling a Public Hearing on the Proposal to Adopt a Street Reconstruction Plan and the Intent to issue General Obligation Street Reconstruction Bonds." D. Approve a Multiple Dock Facility License for Shorewood Yacht Club E. Accept Proposal for Geotechnical Services for the Mary Lake and Beverly Drive Outlet Projects, City Projects 19 -09 and 20 -03 respectively, RESOLUTION NO. 20 -028, "A Resolution Accepting a Proposal for Geotechnical Services for the Mary Lake Outlet Project, City Project 19 -09 and the Beverly Drive Outlet Project, City Project 20 -03." Roll Call Vote: Labadie, Johnson, Siakel, Sundberg, Zerby voted Aye. Motion passed. 3. MATTERS FROM THE FLOOR Mayor Zerby explained that residents have been asked to submit comments in writing and asked if the Council had any matters to bring forward from residents. There were no comments received by Council or staff. 4. PUBLIC HEARING A. Assessment Hearing for 5440 Wedgewood Drive City Administrator Lerud explained that for approximately a year the City has been trying to gain rental code compliance for the property at 5440 Wedgewood Drive. He noted that this property is owned by someone who lives out of state and the City has received numerous complaints for non - compliance and maintenance problems. He stated that the property owner has been notified numerous times about the violations and several citations have been issued, however there has been very little compliance. He stated that the property is currently for sale and the City wanted to ensure that the City's expenses, to date, were collected from the seller. He stated that the expenses, to date, are currently $6,151.56. He stated that the owner of the property was informed about this public hearing. There being no public comment, Mayor Zerby closed the Public Hearing. 5. REPORTS AND PRESENTATIONS - NONE 6. PARKS-NONE 7. PLANNING - NONE 8. ENGINEERING /PUBLIC WORKS A. Approval of Plans and Specifications and Authorization of Ad for Bids on Roofing Public Works Building, RESOLUTION 20 -029, CITY PROJECT 19 -06 CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES APRIL 13, 2020 Page 3 of 4 Public Works Director Brown stated that this is a project that was started last year. He stated that the Council had authorized InSpec to draw up plans and specifications. He noted that the plans and specifications have been completed and the projected costs are between two - hundred fifty - thousand dollars and two - hundred seventy -five thousand dollars. He stated that if this resolution is approved, bids will be opened via a Zoom meeting on May 5, 2020. He stated that staff is recommending approval. Siakel moved, Johnson seconded, Adopting RESOLUTION NO. 20 -029, "A Resolution Approving Plans and Specifications and Authorizing Advertisement for Bids for the Public Works Facility Roof Project, City Project 19 -06." Roll Call Vote: Labadie, Johnson, Siakel, Sundberg, Zerby voted Aye. Motion passed. 9. GENERAL /NEW BUSINESS A. Approve Assessment for 5440 Wedgewood Drive City Administrator Lerud stated that the Public Hearing for the assessment for 5440 Wedgewood Drive was held tonight and staff recommends that the assessment in the amount of $6,151.56 be approved to be assessed to the property and added to the taxes. Siakel moved, Johnson seconded, Adopting RESOLUTION NO. 20 -030, "A Resolution Assessing Unpaid Special Service Charges for 5440 Wedgewood Drive." Roll Call Vote: Labadie, Johnson, Siakel, Sundberg, Zerby voted Aye. Motion passed. 10. STAFF AND COUNCIL REPORTS A. Administrator and Staff Mill Street Update Planning Director Darling stated that a letter was sent to the property owners along the east side of Mill Street letting them know that the County and City would be suspending individual meetings regarding the project due to COVID -19 until the design portion of the project is complete. She noted that the design work will continue through the summer and they should be ready to have meetings with residents by the spring of 2021 to discuss potential impacts to individual properties. Mayor Zerby asked if this information was also posted on the City's website. 2. Badger Park Update Planning Director Darling stated that she has been in touch with the contractors regarding the poured in place rubber surface. She stated that the work should begin the first week in May, but noted that there are specific temperature requirements to complete the work. Other Public Works Director Brown stated the seasonal weight restrictions were lifted this morning, so signs have been removed and crews are continuing to sweep streets and fill potholes. CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES APRIL 13, 2020 Page 4 of 4 City Administrator Lerud reminded residents that the Open Book Meeting scheduled by Hennepin County for May 4, 2020 has been cancelled. He noted that there is information on the website about how to raise an issue regarding property values. He noted that the Council meeting remotely that way they are tonight would not have been possible a year ago with the technology that the City had. He stated that staff is very appreciative of the investment in the fiber -optic technology that was approved by the Council that allows these meetings to take place. B. Mayor and City Council Mayor Zerby stated that on April 9, 2020, the League of Women Voters and the Excelsior Chamber of Commerce held a Mayor's Forum via Zoom. He stated that it was recorded and is available on the LMCC website and encouraged residents to watch it. Mayor Zerby noted that he has called for a special closed City Council meeting on April 20, 2020. He stated that the meeting will be closed pursuant to State Statute 13D.05, Subd 3D, Attorney - Client privilege, for the purpose of discussing legal considerations relating to ongoing litigation to enforce the city's zoning code. 11.
