Staff ReportsRESOLUTION NO. 19 -083 CITY OF SHOREWOOD A RESOLUTION INITIATING THE VACATION PROCESS FOR MAPLE AVENUE WHEREAS, Minnesota Statute 412.851 establish a process to allow statutory cities to initiate vacation of public rights -of -ways; and, WHEREAS, Maple Avenue has limited public benefit that could be served equally as well with a drainage and utility easement; and WHEREAS, Maple Avenue has substantial public cost for year round maintenance to serve one home which could be equally served from Church Road. NOW, THEREFORE, IT IS RESOLVED that the City Council of the City of Shorewood, Minnesota initiates the process of vacating the public right -of -way, but maintaining a drainage and utility easement. FURTHER, THE CITY COUNCIL HEREBY AUTHORIZES and directs staff to schedule a public hearing no earlier than September 23, 2019 after the adjacent property owners and the public are noticed as required by Minnesota State Statute 412.851. The City has been maintaining the roadway, including both the gravel surface and maintaining the driveway, for decades. Church Road is closer to the home than Strawberry Lane. A sewer main lies within the Maple Avenue right -or- way. Staff proposes the following: • reorient the driveway to Church Road so that the public street connection is closer to the home • remove the unnecessary gravel and replace with topsoil and seed • vacate the right -of -way back to the adjacent property owners • retain a drainage and utility easement over the entirety of the right -of -way to allow future maintenance of the sewer main State stature allows cities to initiate vacations by resolution, but requires a public hearing on the vacation action prior to approval. Staff has a concrete contractor working in the area and could complete the improvements before winter, reducing the need to plow the street this winter. Financial or Budget Considerations: The cost of vacating the roadway includes publication of the public hearing, the cost of curb improvements, topsoil, and seed. The savings include the cost maintenance of the gravel road and reduced snow plowing. Recommendation / Action Requested: Staff recommends initiating the vacation process. Any action on this request would require a simple majority. Next Steps and Timelines: Should the City Council initiate the vacation, staff would advertise the public hearing for September 23, 2019. Maple Avenue is a short, public street with an unpaved access for one property. Due to the ongoing staff time and expense of maintaining this access, City staff will be proposing to vacate Maple Avenue back to the four adjacent properties. If the vacation is approved, the city would reorient the existing driveway to Church Road. When the City Council begins the process to vacate the right -of -way, city staff would schedule a required public hearing on the topic. If a public hearing is set, you would receive a notice in writing at least 10 days prior to the meeting. Public improvements to reorient the existing driveway would not likely occur unless the vacation is approved. The purpose of this letter is a courtesy notice of the project so that you are aware that this change in your neighborhood may occur and allow you the opportunity to ask questions, if you have them.
