RESOLUTION 20 -056
A RESOLUTION APPROVING TEMPORARY EXPANSION OF OUTDOOR PREMISES TO
ON -SALE ESTABLISHMENTS IN SHOREWOOD
WHEREAS, on May 20, 2020 Governor Walz signed Emergency Executive Order 20 -56
providing for bars and restaurants to open on June 1 for outdoor service so long as certain
conditions including social distancing are maintained to prevent the spread of COVID -19; and
WHEREAS, the MN Department of Public Safety, the League of MN Cities and Shorewood's
City Attorney have provided guidance to create a resolution that will allow Shorewood's local
On -Sale businesses to temporarily expand their outdoor service through an administrative
process; and
WHEREAS, this temporary approval process would be handled by the city clerk's office in
accordance with their respective On -Sale Licenses and communicated to all license holders
upon approval; and
WHEREAS, the temporary administrative process would include Shorewood's On -Sale
Establishments meet the following regulations:
1) The retailer must provide the city with proof that their liquor liability insurance covers alcohol
sales in any expanded outdoor spaces which, under MN Law, must be "compact and
contiguous" to the main structure.
2) The city must approve a map of the extended areas which limits guests to 50 for the entire
outdoor service area. Once city approves the map it must be sent to DPS, Alcohol and
Gambling Enforcement Division.
3) Local zoning and building codes would apply to any physical expansions such as new or
modified patios or decks.
4) Employees providing food or drink service must wear masks according to DEED guidance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood approves
a Temporary Expansion of Outdoor Premises for On -Sale Establishments.
