Dear Jim:
Enclosed please find a copy of my letter to you of January 8,
1996 regarding the property located at 26040 Smithtown Lane in
Shorewood which is owned by my clients Richard and Joan Whetston.
I have not, as of yet, received any response to this letter. My
understanding is that the City may have been also contacted by Val
or Valeria Wirtz . Valeria Wirtz resides at 26005 Smithtown Lane,
which is part of Lot 95 of Auditor' s Subdivision 133, and adjoins
the vacated North-South portion of old Smithtown Road on the South.
Ms . Wirtz is represented by attorney David Usset, and I believe
they have contacted the City with regard to the intent of the
vacation of the road and whether the City' s resolution had the
effect of narrowing the remaining East-West portion of Smithtown
Road which was renamed Smithtown Lane. I told Mr. Usset that my
opinion was that the resolution vacating the portion of the road
did not affect the existing width of Smithtown Lane, but I believe
he has had some discussions with the City' s engineering department
regarding that issue.
Regarding the vacation of the West half of old Smithtown Road,
which is the matter that is of concern to my clients in this
matter, Mr. and Mrs . Whetston, I would appreciate it if you or
someone in your engineering department would contact me and
communicate what the City's position is regarding this property.
As I said in my January 9 letter, based on the language in the
City' s resolution it appears to me that the intent of the City was
to vacate that entire North-South portion of the old road lying
North of the sixty-foot diameter circle that was created in the
description.

If the City would like me to draft a potential description for
the West half of the old roadway, I would be happy to work with the
City and the Hennepin County Examiner of Titles Office to resolve

Dear Jim:
I represent Richard and Joan Whetston of 26040 Smithtown Lane
with regard to the addition of the West half of the vacated portion
of old Smithtown Road adjacent to their property. They are seeking
to have that land added to their Certificate of Title. I became
acquainted with Mr. and Mrs . Whetston and was asked to represent
them because I am also working with James and Barbara Neitge of
26000 Smithtown Lane and Terry McGinn of 25985 Smithtown Road who
are seeking to add the East half of vacated Smithtown Road to their
parcels .
In 1977 the City of Shorewood passed a Resolution apparently
intending to vacate all of that portion of old Smithtown Road. The
City had re-routed Smithtown Road to the North to remove the old
right-angle turn at the Southeasterly corner of the Whetston
property. The remaining East-West portion of Smithtown Road lying
along the South line of the Whetston property was not vacated and
was re-named Smithtown Lane. It provides access to Mr. and Mrs .
Whetston' s property and also to several parcels to the South, in
Lots 95, 96 and 97 of Auditor' s Subdivision No. 133 . It appears
that the City intended to vacate all of the North-South portion of
old Smithtown Road lying North of a sixty foot diameter cul-de-sac
which was created at the end of what then became Smithtown Lane.
A copy of the recorded Resolution is enclosed.
In the course of the procedure to add the West half of the
vacated street to the Whetston' s legal description I have been
working with Hennepin County Deputy Examiner of Titles Richard S.
Little. We have reached the conclusion that the effect of the
City' s Resolution is that the Westerly half of the North-South
portion of old Smithtown Road was not actually vacated because it

lies within Lot 110 of Auditor' s Subdivision No. 133 . The
Resolution only vacates that portion of old Smithtown Road lying
East of Lot 110, which is only the East half of the road. I have
enclosed a copy of the relevant portion of the plat of Auditor's
Subdivision No. 133 as well as a Old County Plat map for your
reference. The problem apparently arose because the City probably
did not realize that the West half of the old Roadway lay within
the metes and bounds description registered in Torrens case No.
2561 in 1928 . The land had been included in Auditor' s Subdivision
No. 133 in 1924 , but the Auditor' s Subdivision Plat clearly shows
the roadway within Lot 110, and within the description of the land
registered.
I have also enclosed a photocopy of the plat of Smithtown
Circle in which the Whetston property shows as an exception. As
you can see, it appears that the surveyor here also believed that
the portion of old Smithtown Road lying Easterly of the Whetston
property was not vacated, as he does not indicate it as vacated in
the plat.
The purpose of this letter is to formally request, on behalf
of Mr. and Mrs . Whetston, that the City take action to vacate that
part of old Smithtown Road lying North of the said 60 foot circle
and within Lot 110, Auditor' s Subdivision No. 133, which we believe
was the intent of the City all along. My client is certainly
willing to appear before the Planning Commission or City Council to
explain this request, if you believe such an appearance is
necessary. I would appreciate it if you would review this issue
and contact me at your convenience. If you need any additional
information, you can contact me or Mr. Little at the Hennepin
County Examiner of Titles office at 348-3191 .

REGULAR COUNCIL MEETING
OCTOBER 24� 1977
ROLL CALL
The last regular meeting of the city council was called at 7:30 p.m. on October 24,
1977 at the Minnewashta Elementary School. Mmebers present were Mayor Frazier,
Keeler, Haugen and Reiland. Naegele was absent. Others present were Attorney
Kelly, Engineers Norton and Mittelsteadt and clerk Wiltsey.
APPROVAL OF MINUTES
Motion by Haugen, seconded by Reiland to approve the minutes of September 27 and
October 3 as submitted. Motion carried unanimously.
WATER STUDY REPORT - IMPROVEMENT
Resolution No. 79-77
Councilwoman Haugen reviewed the water study report that she had prepared and distri-
buted to the council. Based on the results of the survey and study, Haugen offered
a resolution recommending that the council does not proceed with the municipal
water improvements at this time. Motion seconded by Reiland. Voting in favor
of the resolution were, Reiland, Haugen, Keeler and Frazier. No votes against.
Motion carried.
After council rejection of the water improvements Haugen asked that the minutes
include "that the vote reflects the feelings of the majority of the people in
Shorewood so that some time in the future the council will not be accused of
being derelict in their duty by not proceeding with the water improvements at a
time when the cost was more favorable to the city and its residents".
PUBLIC HEARING
%\ VACATION - Portion Smithtown Lane
i Resolution No. 81-77
Upon legal published and posted notice a hearing was called on the proposal to
vacate a portion of the old Smithtown Road as a result of the relocation of the
road at the S-curve. No objections or concerns were registered. Motion by Haugen
seconded by Keeler to approve a resolution to vacate that portion of Smithtown
Road as described in the resolution. Motion carried unanimously.
WEYKER ADDITION - FINAL APPROVAL
Resolution No. 80-77
Moved by Keeler,seconded by Reiland to approve the final amended plat of Weyker
Addition, subject to the applicable park capital improvement donations and any
additional sewer charges, further, to authorize the Mayor and Clerk to execute
said plat.
BOULDER BRIDGE DEVELOPMENT - EXTENSION
Due to further delays on environmental assessments reviews and hearings, Tom
Wartman appeared before the council to request a second extension of 90 days for
submission of the final plat of the Boulder Bridge Development. Motion by Keeler,
seconded by Haugen to approve the extension. Motion carried unanimously.
HOWARDS POINT MARINA -
Cigarette License:
Motion by Haugen, seconded by Keeler to approve an application for cigarette
license fro m Howards Point Marina, Sue Brecke, Vice President (formerly Kehoes
Resort) - which license shall expire the 31st of December, 1977. Motion carried
by a 3 to 1 vote. Reiland, Haugen and Keeler voted aye and Frazier voted nay.

The City Council of the City of Shorewood does resolve:
That on & ber A 1977, at 7:30 o 'clock p.m. in the council
; _ chambers at the Minnewashta Elementary Grade School the council
will hear all interested parties upon the question of the petition
to vacate a portion of Smithtown Road in Auditor's Subdivision
No. 133, Hennepin County, Minnesota, described as follows:
That part of Smithtown Road according to the plat of
Auditor' s Subdivision No. 133, on file in the office of
the Registrar of Titles, Hennepin County, Minnesota,
lying easterly of lot 110, westerly and northerly of
lot 94, southerly of a line 33 feet southerly of and
parallel with the following described Line A and
northerly of a 60 foot radius curve, the center of
circle of said curve is the point of termination of
the following described Line B:
Line A is described as commencing at the intersection
of the north' line of the South Half of Section 32,
Township 117, Range 23, said Hennepin County and the
center line of Grant Lorenz Road; thence southerly
