ORDINANCE' NO. 28
AN ORDINANCE REGULATING
EKC'AVATION, REMOVAL OR
STORAGE OF ROCK, SAND,
GRAVEL, DIRT' OR O'THE'R
SIIMILAR MATERIAL WITHIN
THE LIMITS OF THE VI'L'LAGE
OF SHO'REWOOD
The Council of the Village of
Shorewood do ordain as follows:
SEiC'TION 1.
It shall be unlawful for any
person, firm or corporation to re-
move, store or excavate rock, sand,
gravel, dirt or similar material
within the limits of the Village of
Shorewood, except to the extent
required in connection with the
construction of a building for
which a. building permit has been
issued, without first having ob-
tained, from the Village Council,
a permit to do so.
SECTION 2.
An application for such permit
shall be accompanied by a drawing
made by a registered surveyor or
other competent person, showing
the location of the Proposed exca-
vation or storage and shall state
the amount of material which ils
to be removed, excavated or stored
and such other information as the
council may require from time to
time. Applications shall be filed
with the Village Clerk and shall
be accompanied by a fee of $10.00
payable to the village.
SECiTION 3.
The Village Clerk shall refer
the application to the Planning
Commission which commision shall
consider the application at its next
regular meeting, but not earlier
than 7 days. The petitioner or
representative shall appear before
the Planning Commission in order
to answer questions concerning
said application. The Planning
Commission shall investigate all
facts set out in the application.
Opportunity shall be given to any
person, firm or corporation to be
heard for or against granting the
permit. After such investigation
and hearing, the Planning Commis-
sion shall make its report to the
Village Council recommending or
not recommending application for
said permit.
SiECTION 4..
The Village Council shall, with-
in 60 days, after receiving the
report of the Planning Commis-
sion, grant or refuse to grant in
its discretion, the application for
the said permit.
SECTION 5.
The requirements of this ordi-
nance shall not apply to such ex-
cavations or storage of rock, sand,
gravel, dirt or similar material
as may be required by state, coun-
ty or village authorities in connec-
tion with construction or mainten-
ance of roads and highways with-
in the Village of Shorewood.
SECTION 6.
Any person, firm or corporation
who: violates or fails to comply
with any of the provisions of this
ordinance shall be guilty of a mis-
demeanor and, upon conviction
thereof, shall be punished by a
fine of not more than $100.00 or
by imprisonment for not to ex-
ceed 90' days for each offense.
Each day that the violation shall
be permitted to exist shall con-
stitute a separate offense.
SECTION 7.
This ordinance shall take effect
from and after its passage and
publication.

ENTITLED AN ORDINANCE

ENDANGERING THE HEALTH
AND WELFARE OF THE
PUBLIC AND PROVIDING FOR
SUMMARY DESTRUCTION OF
SUCH ANIMALS AND
IMPOSING A PENALTY FOR
VIOLATION OF SUCH
REGULATION
The Village Council of the Vil-
lage of Shorewood do ordain:
SECTION 1. That Section No.
8 of Ordinance No. 19 be and
hereby is amended to read as fol-
lows:
Section 8. Subdivision 1. Any
dog that habitually worries, chases
or molests persons traveling peace-
ably on the public road is hereby
declared to be a public nuisance.
Subdivision 2. Any dog that
habitually runs onto the public
road within the village to chase,
bark at, or interfere with auto-
•
mobiles traveling upon the public
road is hereby declared to be a
public nuisance.
SECTION 2. That this ordinance
shall take effect from and after
its passage and publication ac-
cording to law.

AN ORDINANCE TO CHANGE
VILLAGE ELECTION DATE
The Village Council of the Vil-
lage of Shorewood, Minnesota, do
ordain:
Section 1. Commencing with the
1960 village election, the regular
village election of the Village of
Shorewood shall be held annually
on the first Tuesday after the
first Monday in November of each
year.
Section 2. This ordinance shall
take effect upon its passage and
publication.
Adopted by the council this 13th
day of June ,1960.

AN ORDINANCE AMENDING
AN ORDINANCE
ESTABLISHING HARBOR
LIMITS, AND PROHIBITING
NUISANCE'S THEREIN.
THE VILLAGE COUNCIL OF
SHOREWOOD ORDAINS:
,SECTION 1. Subsection 5 of
SECTION 7 of An Ordinance Es-
tablishing Harbor Limits and Pro-
hibiting Nuisances Therein, being
Ordinance No. 12 of this Village,
is •hereby amended to read as fol-
lows:
Subsection 5. The failure to
equip and to operate a boat, ves-
sel or watercraft in accordance
with the provisions of Chapter 361
of Minnesota Statutes, as amend-
ed, which statutes are hereby
adopted and incorporated herein
and made a part hereof by refer-
ence, as fully as if set forth here-
in and made a part hereof by ref-
erence, as fully as if set forth
in. Provided, however, that these
additional requirements shall be
met by all owners and operators
of watercraft within the harbor
limits established herein, namely:
a) All watercraft in use or un-
derway between sunset and sun-
rise shall be equipped with and
have in operation red and green
running lights in the forward sec-
tion of the boat, and a white light
at the stern or on the superstruc-
ture, which white light shall be
visible on a dark night with clear
atmosphere for a distance of two
miles from any direction. Provid-
ed however, that motor powered
watercraft under 16 feet in over-
all length may use portable lights,
Which must be clamped on the
watercraft when in use; and, non-
powered watercraft may use a
portable single white light which
is visible from any direction for
a distance of two miles on a dark
night with clear atmosphere.
b) All watercraft when at an-
chor or drifting must show a white
light visible from any direction
for a distance of one mile, and
such light shall be lit from sun-
set to sunrise, except that a wa-
tercraft anchored in a cove within
one hundred feet of shore and 200
feet away from normal navigation
and any watercraft anchored at a
dock or pier need not have the
white light lit.
(c) All watercraft shall have on
board and readily accessible life
preservers, vests, or other similar
buoyant devices capable of keep-
ing every person on board afloat.
d) No watercraft other than an
authorized Water Patrol Boat or
other police watercraft shall use
or display a red light, except a
red running light.
e) No watercraft other than an
authorized Water Patrol Boat or
other police watercraft shall use
or display a police, sheriff or law
enforcement officers flag, or any
device designed to simulate such
a flag.
f) No person shall board, use,
damage or tamper with a water-
craft, except when done by the
owner or with the owner's mn-
sent.
g) No person under fifteen years
of age shall operate a watercraft
powered by a motor of ten horse
power or more, unless accom-
panied by a competent person
fifteen years of age or older.

LIMITS AND PROHIBITING
NUISANC'E'S THEREIN, being
Ordinance No. 12 of this Village,
is hereby amended to read as
follows:
Subsection 6. The failure to tow
or to operate a watercraft towing
one or more persons behind a wa-
tercraft on water skies, aqua - plane,
surfboard, saucer, or similar de-
vice, except in compliance with
these regulations:
a) Every person being towed
shall wear a life vest, belt or
other buoyant device, except with
written permission of County
Sheriff.
b) Not more than two persons
may be towed at one time, except
with written permission of the
County Sheriff.
C) No person shall be towed
from one -half hour after official
sunset to sunrise.
d) No person shall be towed by
a rope, cable or other towing de-
vices longer than 85 feet, except
with a written permit of the
County Sheriff.
e) No person shall operate a
watercraft when towing a person,
and no person being towed, shall
come within 150 feet of any bath-
ing area, skin diver's warning
flag, swimmer, or raft, watercraft,
dock or pier except that raft, dock,
or pier from which he is operat-
ing.
f) No person shall tow or be
towed unless two competent per-
sons are on board the watercraft.
The driver of such watercraft shall
be at least fifteen years of age,
and must watch where the water-
craft is being driven at all times.
The second person on board the
watercraft shall be an observer,
and shall be at least twelve years
of age, and shall watch the person
or persons being towed at all
times.
g) No person shall drag an un-
occupied tow line behind a water-
craft for an unreasonable length
of time.
h) No person shall tow or be
towed into or through a marked
Channel connecting two bodies of
water.
SECTION III. SECTION 6 of -tn
Ordinance Establishing Harbor
Limits and Prohibiting Nuisan-
ces Therein is amended by add-
ing thereto Subsection 12, read-
ing as follows:
Subsection 12. Operating any
watercraft, automobile, vehicle or
powered propelled device on the
open water, or upon an ice covered
body of waiter, in such a manner
as to endanger life, limb or prop-
erty.
SEiCTION IV. Effective date.
This ordinance shall take effect
and be in full force from and af-
ter its passage and publication.
