EASEMENT
KNOW ALL MEN BY THESE PRESENTS, THAT WHEREAS, The Minneapolis
& st. Louis Railway Company is the owner of certain right of way at
Fairview, Hennepin County, Minnesota; and
WHEREAS, Excelsior Township in Hennepin county, Minnesota,
desires the grant of an easement over a part of said right of wa:y for
public highway purposes; and
WHEREAS, The Minneapolis & st. Louis Railway Company is
willing to grant such easement.
NOW THEREFORE, The Minne.olis & st. Louis Railway Company,
a Minnesota corporation (herelnafter referred.to as the nRailway"), in
consideration of the ~ of One Dollar ($1.00), does hereby grant unto
EJtcelsior Township, Hennepin County, Minnesota (hereinafter referred to
as the "Township"), the ri ght and privilege .to locate am maintain a
Township Public Highway along the Northwesterly boUndary line of the
Railway'S 100-foot right of wa~ at Fairview, H. ennepin County, Minnesota,
trom a point opposite Station ~51 pluS 50, running lortheBatwardly to a
point opposite Station 445 plus 11, and an IS-foot wide connecting
crossing at grade over and across the Railway'S right of way and main
track at Station 445 plus 20 - said highway and crossing being shown in
red upon the print hereto attached, marked Exhibit nAn, and hereby made
a part hereof.
The above grant is conditioned -
(a) upon the rights of the Railway, Which rights
the Railway hereby reserves unto itself, its successors and
assigns, to operate and maintain its present as well as any
desired fUture tracks on its right of way over said highway
and crossing;
(b) upon the right of the Railway, which right
the Railway hereby reserves unto itself, its successors and
assigns to at any time cancel and terminate this easement by
giving thirty (30) days' prior written notice to the TownShip;
(c) that notwithstanding the immediately preced-
ing condition, this easement shall automatically cease and
ter.minate, without further act or deed, in the event that
(1) the said highway or (2) the said highway and crossing
shall be abandoned for active Township publie highway purposes;
(d) that upon the di scontinuance of the use of
the Railway's premises for the purposes herein granted, the
Township shall surrender and deliver said premises to the
Railway, its successors and assigns, without compensation to
the TownShip, the public or any other person whomsoever because
of such revesting.
IN TESTIMONY WHEREOF, said The MillI1eapolis & st. Louis Rail-
way Company, a co~o~ation of the State at Minnesota, has caused these
presents to be executed in its corporate name by its President and
Assi~t Secretary its c porate seal to be hereunto affixed this

RESOLUTION ACCEPTING HIGHWAY EASEMENT
'?JEEREAS, the Township has reque sted permission
of The Minneapolis & St. Lo~is' Railway Company to use a por-
tion of tl::B Railway's right of way at Fairview, Hennepin
County, Minnesota, for Township public highway purposes; and
WHEREAS, the Railway has presented to the
Township an easement for such purposes, bearing the legend at the
1iep of the page "3-19-54-", which was reviewed by the Township
Board members present, and has requested the Township to take
formal action accepting such easement; and
NOW THEREFORE, BE IT RESOLVED by the Township
of Excelsior, Her~epin County, Minnesota, that it accepts
sa! d easement in the form as presented by the Railway.
