Dear George:
Mr. and Mrs. Lloyd M.Doyle, who now operate a trailer
coach park on Highway No.7 West of Hopkins, have
purchased the Hudlow property described as Lot 5,
Auditor's Subdivision No. 133, Hennepin County, Minn.,
which property, as you know, is across County Road 19
from the Peter Gideon monument and the East line of
which property is adjacent to the Tonka Terrace
Shopping Center lot.
Mr. and Mrs. Doyle have asked me to request from the
Excelsior Town Board, under Ordinance No. 17, of the
Town of Excelsior, a permit to operate a trailer coach
park on this five-acre tract of land. I would greatly
appreciate it if the Town Board could meet in special
session to consider this matter.
Mr. and Mrs. Doyle will, of course, comply with all of
the requirements of the Ordinance of the Town of
Excelsior and the state law. They have operated their
present ~railer coach park for two years. I would be
more than pleased to have Mr.. and Mrs. Doyle meet with
the Town Board to make a personal request in addition
to this letter and I greatly appreciate it if this
matter can be given as prompt action as possible.
It appears to me that in view of the fact that the land
in question is included in a commercial zone and the
ordinance of the township provides for issuance of a
permit, that this request for such a permit is in good
order.

Gentlemen:
Prior to your last Town Board meeting I addressed
a letter to the Board setting out some of the matters
which have occurred within the Township which have
led to the incorporation of the iillage of Greenwood.
Following my last letter the Town Board requested
that I proceed in an investigation of the facts of the
incorporation and present those facts to the Attorney
General, Miles Lord, for his consideration and make
a further application to him for a writ of quo warranto.
I requested that I be allowed to associate with another
counsel and that request was granted and I chose Mr.
Robert W. Dygert, attorney in Minneapolis, who has been
involved in three previous village contests.
A meeting was arranged with one of the assistants
in Mr. Lord's office in the forepart of January at
which time a verbal presentation of the case was made.
Maps and plats were prepared for the Attorney General
and a complete list of cases pertinent to the matter
was given to him. A few days later I received word
that the Attorney General's office would grant the
Town or any interested individual the privilege of
applying for the writ. This, of course, was not what
we ultimately wanted.
Through the help of the members of this Board a
meeting was arranged with Mr. George Scott, Hennepin
County Attorney! who after hear.ing the s\lIlfllarY.Qf the
facts felt the t;ounty might ha!e an interest in the
contest of the village. A further meeting was arranged
with Mr. Miles Lord at his office at which time Mr.
Scott was present as well as two of Mr. Lord's top
assistants. A thorough discussion of the problem was
had following which the Attorney General's office
requested that I prepare a brief and submit the same
as soon as possible. It was concluded that if there

appeared to be a fair chance of being successful in the
contest of the village the Attorney General's office
would waive its past policy and actually take on the case
itself .iThe: brief was prepared and a copy filed with
George Scott, Hennepin County Attorney as well as with
Miles Lord's office. I have had two adJitonal conferances
with Mr. Lord and have discussed the matter with those
assistants in his office who have been delegated the
job of determining whether or not the action might be
successfully maintained.
As I previously pointed out there is no precedent
for an attack on the theory which we must use. I do not
feel that the case would be strong enough to warrant
the expenditure of Town funds to bring the action;
however, the entire matter is one which has considerable
merit for the metropolitan areas and I feel that the
Attorney General would be justified in bringing the
question before the Supreme Court for a decision.
In the event that the Attorney General feels that
the risk for his office would be too great, then this
Board has done everything that it can properly do for
the protection of the residents of Excelsior Township.
I expect to have a decision from Mr. Lord's office in
the next few days~
To be entirely frank with you, I feel that our
position has been somewhat weakened by the adverse
publicity the Attorney General's office recently
received as a result of losing the fight on the state
reorganization act as well as the overruling of the
Attorney General's opinion regarding gambling devices.
Both Mr. Lord and Mr. Scott have been most cooperative
and have given us every consideration.
