M I t UTE S CALL TO ORDER The regular meeting of the Shorewood City Council was called to order cy Mayor Rascop at 7:38 P.M. on Monday, January 25, 1982 in the CounCil Chambers. PLEDGE OF ALLEGIANCE & PRAYER The meeting opened with the Pledge of Allegiance and a prayer. ROLL CALL: Present: Mayor Rascop, Council - Leonardo, Gagne, Haugen, and Shaw. Staff: Attorney Larson, Engineer Norton, Administrator Uhrhammer, and Clerk Kennelly. APPROVAL OF MINUTES - JANUARY 11, 1982 Correction: "Matters from the Floor" "Joe Gorecki stated a buyer for Lot 1, Block 4, Oak Ridge Estates, 2nd Addition requested in writing confirmation that the new owner of this lot would not be re-assessed for the same improvements at the time of final development of this project, that) had already been paid for on this lot." Leonardo moved, seconded by Haugen, to approve the minutes of the regular Council meeting of Monday, January 11th as corrected. : Motion carried unanimously. RESOLUTION NO. 22-82 Lee Webster - 25 Timber Lane, presented a building application for a detached garage with a request for set back variances from the lake and the road. Shaw moved, seconded by Haugen, to approve the request with Mr. webster supplying written approval from all owners of neighboring properties within 200' and approval of variance from the Minnetonka Watershed District. Motion carried unanimously on a roll call vote. PARK COMMISSION REPORT: Roger Stein ~eportedrin presentation of Freeman Park, made by Ann Bronken of Northwest Associated Consultants. Three plans were sub- mitted but none seemed to be acceptable to the Park Commission. "After Hours Ice Rink Rental" - Resolution 1-82-1 Formal recommendation was made by the Park Commission to set rules and regulations for "After Hours Ice Rink Rental" with a recommended rental fee. " Noved by Shaw, seconded by Haugen, to adopt a Resolution on "After Hours Ice Rink Rental Fees." Motion carried unanimously. . . Council Meeting - 2 - January 25, 1982 DOCK LICENSE APPROVALS: Boulder Brid~e.Farm Iric. RESOLUTION No. 23-82 Application or 40 docks was discussed regarding total docks, in comparison to homes completed.. The docks were all built at one time under approval of the P.U.R.D. Ordinance and arp. permanent. Moved by Haugen, seconded by Shaw, to approve the permit as applied for. Motion carried unanimously. Howard's Point Marina RESOLUTION No. 24-82 Application was submitted with the same number of docks proposed but with dock reconfiguration. Haugen moved to table the application until the next meeting to obtain input of neighbors. Motion died for lack of a second. Rascop made a motion to table and schedule a public hearing on the 22nd of February, seconded by Haugen. Motion carried - 4 ayes, 1 naye (Gagne). Adeline Johnston - 5645 Howards Point Road RESOLUTION No. 25-82 Motion to approve dock license as submitted was made by Haugen, seconded by Rascop. Motion carried unanimously. January 25, 1982 DIVISION DENIAL Lot 12 and 13 Radisson Inn Addition Resolution of denial was submitted by Attorney Larson the Council. Haugen moved, seconded by Shaw, to pass denial. Motion carried unanimously. RESOLUTION No. 31-82 at request of resolution of ATTORNEY'S REPORT Attorney Larson reported on his progress on terminating the business operation at R.R. Johnson's of 5355 Shady Hills Circle. He asked to report at the next meeting, February 8, 1982, all information and to have this operation totally removed by that time. Moved by Haugen, seconded by Rascop, to authorize the date of Febru- ary 8th as final removal date. Motion carried unanimously. Mayor Rascop requested Attorney Larson to obtain the third opinion on the construction of the entry way at City Hall. ADMINISTRATIVE REPORTS Resolution opposing the location of Solid Waste Sanitary Landfill (Site M) in Minnetrista was reviewed. Motion was made by Rascop to table until the next meeting for any further action. New arrangements were submitted to the Council for reviewal. MAYOR'S REPORT: CABLE TV MEETING Current 7 cities committee will be meeting with each of the mayors of their cities to express their concerns about reorganizing into a 13 cities committee. Discussion will be made on change at the meeting of February 4th at Tonka Eay City Hall. POLICE MEETING REPORT It was reported the Mayors' approved a raise for Chief Earl Johnson to $40,000.00 a year. Mayors' also approved the purchase of 2 new police cars to be purchased out of funds budgeted last year but not expended. D.N.R. The DNR made a request for endorsement to approve the purchase of a public access on a private road in Minnetrista. Minnetrista is opposing this purchase and would also like support in its opposi- tion. Council did not wish to express an opinion at this time. COUNCIL REPORT Water survey form will be submitted to city residents in February 1982. - APPROVAL OF CLAIMS AND ADJOURNMENT Moved by Gagne, seconded by Leonardo, to approve claims for payment to be followed by adjournment at 10:30 P.M. Minneapolis, Minnesota 55455 21 January 1982 Ms. Jan Haugen, councilwoman City of Shorewood 5755 Country Club Road Shorewood, MN 55331 Dear Ms. Haugen: This letter is in response to your request for information concerning a survey of residents about their views concerning development of the municipal water system. I have discussed the problem with several people at the Uni- versity and offer the following recommendations. If a survey is done it should be in a cost-effective way without loss of integrity. We recommend a mail-out/mail-back survey. In order to give each household a chance to participate, I recommend the forms be mailed to every home. The results from this mailing will undoubtedly be subject to questions of bias. The response rate will probably be about one-third and there will be no way of knowing whether those not responding hold views different from those who do. Therefore we recommend a random sample of 250-300 households be identified for intensive efforts for obtaining a response from each. These efforts include several follow-up mailings and have been shown to raise res- ponse rates to 70 percent or more. At these rates, tabulated results will be statistically valid. The sample should be stratified so that each section of the city has a reasonable number of responses. Given the interest in the area around Badger Well, it may be well to sample at a somewhat higher rate there. I see no apparent reason why all residents should not receive the same survey form. The material sent out to people should conta.in a mix of educational ma- terial along with the asking of questions. The draft you sent me already does this to some extent. Missing is the cost factor. Most of the questions have this as an underlying factor, but people are being asked to respond without an explicit statement. Other than this, I find the questions well written and not leading. I would probably want to provide people with a range of responses, e.g. strongly agree, agree, neutral, disagree, strongly disagree. This will allow you to measure the intensity of feelings. A draft cover letter and reworkea portion of the survey are enclosed. The cost of the survey will vary by how much of the effort is don~.by city employees. If it were all done by them, the only out-of-pocket expenses would be printing and postage. CURA would be happy to provide technical guidance at no cost. If this is important to you and you cannot cover the personnel expenses, we might be able to contribute more than indicated. A telephone survey of 300 households would cost $3300. There are advantages and disadvantages to this system. The alternative is to make water available from a central system through underground pipes. This system too has advantages and disadvantages. The pros and cons of developing a muni- cipal water system are given below. The cons say: 1. It will cause more development. 2. It won't be any different from what we now get from our wells unless we add a softening proces~. 3. It is more expensive than our individual well systems. 4. No one needs it. 5. We have good fire protection. The pros say: 1. You will always have constant pressure on the lines. 2. The water will be better than water from an individual well. I 3. We will have water at all times (including storms) unless an overall disaster occurs. 4. It is cheaper to do -it now at today's prices than wait until tomorrow with inflation driving costs higher. 5. There are those that need and want city water. 6. Development will come even if we don't have city water, but the more wells put in the ground the, better the chances of the level of a neighbor's well being lowered, thus incurring redrilling costs. 7. Shorewood, Mn. 55331 For the past several months, The Mound City Council has been discussing a variety of changes that are coming down on our City. One of them is legislature mandates particularly those that relate to the lake Minnetonka Conservation District and its mandated dues payment system. The Mound City Council voted at its January 12th Council Meeting to send a letter to each member city asking if you also are concerned about LMCD and its cost and whether you would participate in a meeting to discuss a restructing of the LMCD and its authority. Most particularly as it: relates to the dues cost. Since any change that would be made will require at least eleven (11) cities or a legislative change in the law, it is critically important that those concerned join strongly together. If you share these concerns, please let us know and a meeting can be scheduled soon to discuss them in greater detail. The City of Orono strongly opposes this suggestion and wishes to suggest that perhaps this is the time to reaffirm our strong position in supporting the LMCD and its Board members representing the fourteen municipalities that have been so supportive of protecting our most valuable resource, Lake Minnetonka. The suggestion that we, as participating members of the LMCD, do not share in the mandate to regulate and protect our most valuable resource, Lake Minnetonka, which has been designated as a lake of metropolitan significance, does not seem to be consistent with our own individual City interests when considering the importance of all of our community plans, which are designed to encourage a strong business and residential atmosphere. Those of us who have been involved with legislative mandates have learned that the ones who get the job done are the ones who are actively involved in local community affairs and that is what the LMCD is all about. It is designed to allow the fourteen local lake communities as one body to make decisiops at a local level, rather than at a state or federal level. I believe we have learned, particularly in most receflt years, that this is the only effective and efficient way to balance the need to use and enjoy Lake Minnetonka today with the need to protect and pre~erve the lake for fu~ure generations.
