Motian carried unanimausly. Mr. Gene Clapp Mr. Clapp questioned the manner in which the Medical Professianal Building parking lot at 24000 State Hwy 7 was installed. It was nat installed the same as the plans were submitted and a prablem with drainage may exist. Building Inspectar Miller has an appaint- ment set up to. ~iscuss the necessary changes to. the parking lat with the awners. Mr. Clapp will then be natified of the results. ~ . . Regular Council Meeting - 2 - June 14, 1982 Mr. Cene Clapp Mr. Clapp also questions what happened to the Water S~rvey that the Council was going to take? Council informed him that the cost was too high at this time and the money was net available in the budget to proceed with this project. ,Swimming Pool ,Request Mike McHugh, 5240 Shady Lane, submitted an application to install a swimming pool at 5240 Shady Lane with no variance necessary. Shaw moved, seconded by Haugen, to approve the application as submitted. Motion carried unanimously. PUBLIC HEARING -Larry:Wilson RESOLUTION NO. 52-82 (Building Height Variance Request) Public Hearing was opened at 8:06 P.M. to consider the request of Larry Wilson, 27965 Woodside Road, to construct an assessory building in excess of the minimum height requirement of 15'. No oral or written comments were received from the public. Public Hearing was closed at 8:10 P.M. Shaw's concerns were that the variance request should be due to a "hardship". He did not feel that this was true in this case. Haugen, moved, seconded by Gagne, to approve the height variance not to exceed 20' in height. Motion carried - 4 ayes, 1 nay (Shaw). VARIANCE REQUEST -:REAR:LOT LINE Mr. Robert E. Brown - Part of Lot 5 - Holtmere Addition, requested a variance in the rear lot line set back for the construction of his home, 25' from the rear lot line. This property was heavily filled and would be very difficult to build on if he had to comply with the standard set back. Moved by Rascop, seconded by Gagne, to approve the set back variance request as s.ubmitted. Motion carried unanimously. CIVIL DEFENSE.ORDINANCE -'Second Reading The second reading of the Minnesota Civil Defense Ordinance, as it pertains to the City of Shorewood, was presented. Haugen moved, seconded by Leonardo, to adopt this Ordinance as #129 of the City of Shorewood. Motion carried unanimously. Shaw moved, seconded by Gagne, to approve the appointment of Chief Earl Johnson as the Civil Defense Director, subject to his acceptance. Motion carried unanimously. Administrator Uhrhammer informed the Council that Detective Craig Anderson was in charge of preparing the Civil Defense Plan and ques- tioned who should be appointed Director. Shaw moved to withdraw his motion for appointment of Chief Johnson as Director. Motion for withdrawal seconded by Gagne. Council instructed Administrator to check on appropriate appointment. e e Regular Council Meeting - 3 - June 14, 1982 Matters from the Floor Ivy Lane ."No Parking Request". Mr. Reynolds of 20980 Ivy Lane questioned the resolution of the "No Parking" request. Council reviewed Chief Johnson's recommenda- tion. Mr. Reynolds informed the Council of the Police Department difficulty in enforcing the current Ordinance on 72 hour parking limits. Mayor Rascop requested Mr. Reynolds and neighborhood residents to keep him informed of this problem. PLANNING COMMISSION REPORT Chairperson Stover indicated that the Council would be submitting Commission recommendations on the Tingewood Stage Plan in writing. Informal discussion regarding the Deikel division was tabled due to no representation attending the meeting. PARK COMMISSION REPORT Marty Jakel of the Park Commission reviewed the presentation made by Administrator Uhrhammer regarding the financial status of City funds. He then suggested that the Park Commission try to keep park costs to a minimum. Procedures for future Park Commission appointments were discussed. ATTORNEY'S REPORT Vine Hill Rezoning Attorney Larson informed Council of the discrepancy in the legal description of the Vine Hill Floral Property rezoning. Attorney Larson will draw Zoning Amendment to the Ordinance when a correct description is obtained. Mac-In-Erney- Armor Lock & Key Co. Armor Lock & Key Company requested the City to pay outstanding bill for expenses on the Boulder Bridge Pumphouse for Mac-In- Erny Inc. and withhold it from the final payment on contract. Engineer Norton will prepare pay voucher and present it for payment. City ordered the installation and could be responsible for payment according to legal advice. Greenwood Lift Station No reply has been received from Greenwood regarding requested payment on Metro Purchase of lift station. Attorney was in- structed to proceed with litigation. City Hall EntrywayReport Engineer Norton reviewed letter from structual Engineer Jack Meyer regarding construction of the City Hall entryway. Some questions still remain but he recommended that no structual changes are necessary at this time. . e e E(;/;~.I ~~ Regular Council Meeting - 4 - June 14, 1982 City Hall Entryway (Continued) Mayor Rascop suggested the letter be submitted to Mr. Reese for comment and request the former Building Inspector, Jerome Studer and Mr. Reese to attend the July 12th Council Meeting. Council instructed Engineer Norton to submit Mr. Meyer's letter to a testing firm (Twin City Testing) for an est~mated cost in deter- mining the answers to other questions brought out by Mr. Meyer's letter. ENGINEER'S REPORT Badger Well "Hammering" Engineer Norton informed the Council of the correction of the Badger Well "hammering" problem. Vine Hill Bike Path Questions regarding the location of the 8' addition to Vine Hill Road for the purpose of extending a Bike Path along Vine Hill Road were asked by Council. Legal 1~abi1ity and reainte- nance responsibility were also questioned. The Administrator will research and clarify these questions at the next Council Meeting. \~) esbury Back-UpWell Bid and Specs \~ Engineer Norton requested to Council to proceed with the adver- ~ tisement fer Bids and Specifications. . ~ Haugen moved, seconded by Shaw, to instruct Engineer Norton to advertise for bids with specifications for the Amesbury West back-up well. Bids will be opened at City Hall at 11:00 A.M. July 8, 1982. Motion carried unanimously. ADMINISTRATIVE REPORT Map Contract Bids Bids from 3 firms were submitted for the creation of City Maps and assistance in revising the Zoning and Subdivision Ordinance. Grant monies are available for this project when we follow their specifications. Gagne moved, seconded by Haugen, to approve the lowest bid sub- mitted by Northwest Associated Consultants, Inc. Motion carried unanimously. Horse 'Inspector Appointment Rascop moved approval of Winifred Kohles as Shorewood Horse Inspector for 1983. Seconded by Shaw. Administrator would like to set a policy - not to provide this service anymore. Discussion regarding Amesbury pool filling and watering to common area followed. Amesb~ry Association will submit request for this service to the Council again. Financial Statement Financial Statement was reviewed. Special meeting was set for June 22, 1982 at City Hall for the purpose of the audit review. MAYOR'S REPORT TonkaBay-Shorewood Storm Sewer Proiect Mayor Rascop reported on the joint meeting with Tonka Bay and Shorewood regarding the possible installation of a storm sewer system in the County Road #19 and Glen Road drainage district area. This would also benefit Tonka Bay. Tonka Bay did indi- cate that they may be interested in cooperating with this project. Police Formula Meeting The current police formula was discussed regarding possible changes in the formula. Recommendation for change in formula will be discussed at the first meeting in July. COUNCIL REPORT Public Address 'System Councilperson Haugen reviewed costs of a sound system for the City Hall Chambers. Staff to check with Mr. Reese to find out if an internal system was installed at the time of construction. League of Minnesota Cities Constitutional By-Laws Councilperson Haugen, requested a concensus vote of the Council regarding automatic appointment to the State Board of Directors when a person from your state is elected to the position of President or Vice-President ~ the National League Board. Council voted 4 ayes, 1 abstained (Haugen), not to approve the automatic appointment to the State Board. League of Minnesota Cities Foundation By-Law Council voted approval support in the clarification of the Foundation's By-Laws. MEMORANDUM TO: Shorewood Planning Commission, Mayor and City Council FROM: Brad Nielsen DATE: RE: FILE NO: 28 April 1982 Tingewood P.U.D. 656.09 (82.07) BACKGROUND Mr. Adrian Johnson has submitted plans for development of approximately six acres of land located in the southwest corner of the Highway 7/Radisson Entrance intersection (see Exhibit A, attached). The proposal is for a planned unit development consisting of three, four-family structures to be clustered in the center of the site and accessed by a private drive from Radisson Inn Road. The site is currently zoned R-1, Single Family Residence District, as is the property surrounding the proposed development. ISSUES AND ANALYSIS Based upon our review of the developer's plans, the Shorewood Comprehensive Plan and the existing Zoning Ordinance, the following issues are presented: A. Required Information. The applicant has submitted the information required under Section 27A, Subd. 5.A. In addition to the written and graphic information attached to this report, the following provides an area tabulation summary for the proposed development: Area % of Total Site Structures 3,700 sq.ft./structure 4% x 3 = 11,100 sq. ft. total Street 11,775 sq. ft. 5% Parking 4,550 sq.ft. 2% Common open space 233,499 sq. ft. Each unit would be individually owned with the entire area outside of the structures left in common ownership. To date, no information has been submitted pertaining to a homeowner's association nor to any restrictive covenants which are to be recorded with the property. The applicant should be prepared to address these items at the initial public hearing on the request. Land Use. B. As mentioned, the property in question is zoned R-1, which allows single family detached homes on 40,000 square foot lots. According to the applicant, a planned unit development approach has been selected due to several factors: 1. The property's proximity to Highway 7 detracts from its market- ability for large lot single family development. 2. Existing development in the vicinity has not adhered to the 40,000 square foot area requirement, nor the lot width or setback requirements of the R-1 District. 3. Density for planned unit development is related to the Compre- hensive Plan. The Plan suggests a density range for the area in question of 1-2 units per acre. 4. P.U.D. allows variety in housing types which allows clustering of units on the level portion of the site, leaving the steeper slopes relatively undisturbed. From a planning perspective, the development as proposed achieves a major objective of the P.U.D. provisions, that is. preservation of the na tura 1 features of the si te. As you may recall, a pre 1 imi na ry p 1 at had been previously approved for the site. Although only four lots were proposed, three of them required direct access to Radisson Entrance. The site alteration which would have been required to access and build on those lots would have exceeded the site alteration necessary to accommodate the P.U.D. now being proposed. Furthermore, by cluster- ing the structures in the center of the site, the resulting preserva- tion of vegetation and existing topography serves to create a buffer between the project and surrounding development. Finally, clustering the units allows a buffer for future residents of the project from Highway 7. Shorewood Planning Commission, Mayor and City Council 28 April 1982 Page Three One question arises concerning the proposed site plan. Except for garages and parking spaces, no provision has been made for any other accessory uses on the site. Such features as tennis courts, play equ.ipment, swimming pools, etc. are often included in the type of development which is being proposed. The question of outdoor storage of recreational vehicles (e.g. campers, motor homes, boats) also exists. If such uses are likely to be requested by future residents, perhaps / they should be addressed by the developer at this time. C. Transportation. This issue involves several elements. Questions related to design and ownership of the access road have already been addressed by the City Engineer in his letter to the City, dated 1 April 1982. Proposed off- street parking complies with the requirements of the Shorewood Zoning Ordinance. Overall traffic flow and volume remain to be addressed. Although attached housing typically generates fewer daily trips per unit than traditional single family housing, the proposed increase in density will undoubtedly result in a greater overall number of trips. For comparison purposes, the standard "rule of thumb II is 8-10 trips per day for single family detached and 5-8 trips for attached single family (particularly quads and townhouses). Assuming the site is capable of six lots under the R-1 requirements, we arrive at approxi- mately 48-60 trips per day. Trip generation for the proposed develop- ment is approximately 60-96 trips per day. In our opinion, this increase in traffic coupled with a poor circula- tion system on the north side of Christmas Lake create possibly the only negative aspect of the development proposal. Exhibit D, attached, pro- vides an overview of the area in question. While there are three places to access the site from eastbound Highway 7 (Radisson Inn Road, Radisson Entrance and Covington Road), it is presumed that most of the access tra!fic will come from westbound Highway 7 which is only served by Chrlstmas Lake Road. Radisson Inn Road is substandard, both in terms of ri ght-of-way wi dth and setback of abutting homes. In several cases garages are on or near the right-of-way line. Thus, extra traffic will undoubtedly have some impact on those existing residences. Egress from the site to Highway 7 can occur at Christmas Lake Road or at Covington. No access to Highway 7 is allowed at Radisson Entrance. Shorewood Planning Commission, Mayor and City Council 28 April 1982 Page Four D. Utilities, Grading and Drainage. Detailed information regarding these engineering aspects of the P.U.D. are not required at the concept stage of the process. The City Engineer has, however, provided general comments on these items. The concerns raised in his letter are considered technical in nature and are presumably resolvable. It appears that those issues presented would have arisen even if single family development were being proposed. RECOMMENDATION At the time the Comprehensive Plan was being prepared, it was our under:,,~ standing that preservation of the City.s natural environment was of utmost importance to Shorewood residents. Low density residential development was viewed as a means to that end. In our estimation the Tingewood P.U.D. demonstrates that large lots are not always the most effective way to pre- serve the natural features of the area. -:., ; With the exception of the increased traffic flow, any problems which may exist from either a planning or engineering standpoint seem to be solv- able through provisions in a development contract between the developer and the City. Such an agreement would be formulated during the next stage of the p.u.d. process, assuming the concept stage is approved. The units, which have been designed" to resemble typical single-family detached dwellings have a projected sale price of $65,000-$75,000. The cul-de-sac which provides access to the units is being proposed as a 20-foot wide private street. Relationship to Comprehensive Plan The Tingewood units are designed to provide new market rate housing, affordable to middle income individuals. The cluster arrangement conserves land, increases energy efficiency and protects the natural environment of the site, the most notable example of which is the extensive existing rree cover. By clustering the units and minimizing the intrusion of streets, 82 percent of the site will remain in an undisturbed, natural state. According to the Comprehensive Plan, Shorewood is to be preserved as a truly "suburban" community with an emphasis on natural and environmental features. The Tingewood proposal is designed to compliment this goal and to preserve the development character of the community. The private street system and single-family appearance of the structures should permit them to harmonize with the surrounding neighborhood. We have reviewed the Tingewood PUD information submitted to our office. While there were no detailed drawings on the proposed site grading and drainage plan, there was a general concept plan. Also not included was a drawing showing proposed utilities. possibly these drawings are prematu~e at this time. However, based on the concept plan, we have some 'concerns that must be addressed should this proposal be approved. 1. Drainage The proposed building layouts and apparent concern for maintaining the site cover as much as possible should alleviate any significant site drainage problems. However, the proposed private street and cul-de-sac may present a concentrated drainage problem at Radisson Inn Road. This potential problem must be addressed in the future. 2. Cul-de-Sac The layout and turning radius of the cul-de-sac should be reviewed. As it is shown on the general concept plan, it doesn't appear there is sufficient turning room to allow a semi-trailer to make the turn. A vehicle of this type could be a moving van, delivery truck or emergency vehicle. 3~ private Street A private street may sound desirable to a developer at this stage. Generally, however, once the development is totally occupied, the residents request the City to take over the street. Two main reasons for this request are maintenance and snow removal. These concerns should be addressed at this time. If the street changes from a private driveway to a public street, its design must be changed to conform more to the City standards. That change mainly consists of changing the width from 20' to 24' and providing a thicker section. The street grade must be flattened out as much as is practical. Sanitary Sewer As mentioned previously, there were no drawings showing the proposed sewer lines. Sanitary sewer is available in Radisson Inn Road. A new sewer line with manholes and appurtenant services will be required. Another item to discuss at this time is if the street remains priva~e~ does the sewer serving this PUD also remain private? When serving twelve residential units, it may not be a good idea to have the main line serving the units remain the responsibility of the residents. 5. Water Currently, municipal water is not available to service this property. Based on a previous policy, if a new development contained ten or more units, a central water system was required. That policy has been under review and is currently being revised as we understand. From an engineering standpoint, we believe it would be 'prudent to install'" an underground lateral line and services at this time. This would conform to the general understanding that a city water system will ultimately be installed. Water could be supplied by a single moderately sized well (30 - 50 g.p.m.). The previous comments reflect general concerns we have about the proposed PUD. They are intended to promote discussion and understanding rather than to say what's wrong with the proposal. PUBLIC HEARING: TINGEWOOD POO PROPOSAL At 8:04 P.M. Chairperson Stover read the legal notice pf the Public Hearing as pub- lished on April 21,' 1982. (Bruce Benson arrived at 8:06 P.M.) Mark Koegler of Schoell and Madson, Inc. presented an introduction to the Tingewood POO proposal as applied for by Adrian Jotmson. The site is bounded by Highway 7 to the north and west, Radisson Entrance to the east, residential property and Radisson Inn Road to the south. Koegler noted that it contains about six acres with rolling topography and mUch tree cover. He defined three drainage areas: 1) east toward Radisson Entrance; 2) north toward Highway 7; and 3) to the southwest cf the property. The soil type was listed as well drained. Koegler mentioned a 1973 preliminary plat and discussed the alternatives considered for the current proposal. It was agreed that developing the property into six single family detached units would require significant alterations to the site and the drainage. The developnent as now proposed would have a clustered approach with three structures con- taining twelve units. It would utilize a private cul-de-sac twenty feet in width and off-street guest parking would be provided. A manicured landscape around the units would qe maintained and most of the site would remain in its natural state. Koegler described the buildings as single family type structures and he passed around a photo of a similar unit. He stated that it would be condominiun type ownership of the units and that exterior maintenance, snow removal, etc. would be handled by a hane- owners association. Recreational vehicles would not be stored at this site. The units would be in the $65,000 to $75,000 range, probably attracting young professionals or retiring people - a mix of occupants. Koegler estimated the project would generate about 78 trips per day which he felt would be fewer than a developnent of single family dwellings. Koegler listed the advantages of a cluster type developnent as proposed: - 82% of the tree cover would be retained providing a buffer between Highway 7 and neighboring properties. - The density range was within the limits of Shorewood~s Comprehensive Plan. - The developnent would preserve the natural environment of the site. - The architectural style should integrate with the single family hanes in the neighborhood. Chairperson Stover asked for corrments from the audience. Jim Davis, 20885 Radisson Inn Road, emphasized the desirability of the Christmas Lake area for developers but maintained that the single family atmosphere should be protected. He noted that the developer's motive is to maximize return on investment and not to live 1 in and enjoy the area. His concerns included increased drainage problems; effects upon the water table and wells if twelve families move in; safety factors due to increased traffic on blind and narrow roads; and the adequacy of the streets to handle the addi- tional cars. Davis and Paul Seifert polled area residents and presented a petition. Although some pecple were missed, no one appeared to be for the proposal according to Davis. Eleanor Goodman, 5570 Shore Road, expressed concerns over the proposal's effects upon neighboring lots and the lake. She noted a 1939 easement on lot 11 whereby fourteen off-shore property owners had purchased the lot and its lake front for use as a pri- vate beach. She questioned the developer's plans for lake access. The developer stated that at this time private access.to Christmas Lake was not planned as part of the proposal. He added-ithat. it would be by way of a public beach. Kathy Schwartz, 790 Pleasant'. View Road - Chanhassen, expressed her interest in the en- vironmental quality of Christmas Lake as a nearby property owner. She made note of a Corps of Engineers hearing last year in which the deterioration of the lake was discus- sed; the possibilities of its future decline and the effect this might have upon prop- erty values surrounding the lake. She listed the following areas that the City of Shorewocxl might consider carefully. 1 ) To allow for five day holding of water fran a 25 year storm to protect the lake. 2) Access to this holding pond to insure cleaning. 3). No direct nmoff from the street into the lake. 4) A survey of present nmoff be taken to set limits for the development and to assure that the developer is not re~sible for currently existing conditions. 5) Careful restrictions be imposed during excavation - particularly if any clay soils are present. No straw bales be allowed for storm water retentionwt berms be utilized instead. 6) A linmblogist be hired at developer expense to guarantee lake protection. Arthur Lukens, 20915 Radiss6n ~nn Road, felt that in addition to the other statements made, the safety hazards and traffic problems on Radisson Inn Road were very important. Drainage and loss of property values should be considered also. Peggy Lukens asked why the property was being developed at all with the problems involved. Barb and ~slie "Nelson, 20820 Radisson Inn Road, felt that both the cluster concept and the plan to leave most of the tree cover undisturbed were good points of the proposal. They were concerned about the traffic and safety problems with the road, and winter conditions. They asked that the drainage and water access questions be addressed. Sam Jordon, 20665 Radisson Inn Road, reiterated the poor conditions on Radisson Inn Road. He questioned the desirability of a clustering of this size and felt that R-1 zoning was suitable. He suggested that drainage problems could probably be solved with storm sev;ers wt it should be the developer's obligation. Other local residents who voiced concerns over drainage problems, water quality, wells and safety! traffic issues were Mr. and Mrs. Horton Brooks, 21195 Radisson Inn Road, Mary Poulter, 20845 Radisson Inn Road, Mr. Arsts, 20960 Radisson Inn Road, and John McKellip, 21020 Radisson Inn Road. Mr. Brooks noted that at one time they had lost their well when the lake was being punped. k e PlANNING Ca-MISSION MINUTES e - 4 - MAY 4, 1982 PUBLIC HEARING, CONTINUED Bob Fayfield, 6005 Christmas Lake Road, spoke on behalf of the Christmas Lake Associ- ation. He emphasized two points to the City of Shorewood. He stated that the City had exercised good plaming in zoning the area for single family dwellings. The res- idents are nappy with it. They would like to see- the City act consistently in its zoning administration and discourage spot zoning. He read a letter written by the Shorewood City Council to the City of Chanhassen concerning a proposed developnent at the south end of Christmas Lake a few months ago. The letter urged Chanhassen to protect the rights and property values of others living in the area -arid ccnsider rezonip,g the area R-l with 4O,~ square foot lot requirements to keep the property ccmr.ensurate with the surrounding properties. . The public portion of the Hearing was closed at 8:57 P.M. Chairperson Stover noted that the letters the Plarming Conmission had received were consistent with the evening's discussion. CCmnisBiem ri1embers questioned the developer in regards to the water supply, the structures, future inhabitants, drainage surface, soil types, access, street size, road dedication and maintenance, easements, the home- owners consortium and density. Adrian Johnson stated that the buildings as proposed would each have two 2 bedroom and two 1 bedroom units, with 1~ to 2 baths, and a one car garage space per unit. He agreed that the nature of the desigp. would limit the number of people. Johnson projected that the occupants would be in the $36,000 to $50,000 familyincane range. A comparison was made as to the hard surface area for this type of developnent and one of six detached family dwellings. Total roof area for this proposal would be 11,100 square feet, plus parking and driveways would probably equal 26,000 or 27,000 square feet. Vern Watten estimated that six singl~ homes<.at 3,000 square feet each with paving might double the hard surface area developed. Koegler noted that the soils were Heyder Sandy Loam - well drained. He felt that there were no problems with ponding .on the site.--Janet Leslie asked for clarification in regards to drainage from the neighbors to the west of the proposed developnent. They stated there was a problem during heavy rains but it was suggested that six single f~ ily homes might cause more problems thah the clustered developnent. The proposed street would be 400 feet in length and 20 feet wide with a turning radius that would acccmnodate emergency vehicles. The developers felt this was the only fea- sible access. There will be impact from the developnent but Koegler felt tha!: it WOuld not be substantial. The street would be a private road maintained by the homeowners association. Utilities (sewer) would be public with the appropriate easements as re- quired by Shorewood. Koegler stated they could not guarantee that the future homeowners would keep the road private indefinitely ~t noted that it was not very likely, looking at other consortiums, that they would turn the road over tb the -City. Frank Reese ob- served that the road as plamed encroaches upon the lot to the east. Johnson owns both properties so no easement problems were noted. It was suggested that traffic flow would probably follow the same course whether the developnent was clustered or single dwellings. The developer was asked if he would consider dedicating a 30 foot strip along Radisson 1m Road to alleviate traffic problems. - He- responded that it might be considered. The Plaming Conmission suggested that the developer consider the possibilities of low- ering the density of the proposal anYwhere from six to ten units. The developer had not looked into it at this time. The Conmission agreed that the clustering concept was ac- ceptable but the higher density was a concern. They also felt they needed more infor- mation as to the area water supply and depth of wells, possibly involving a study. MJre detailed plans on drainage and utilities would be part of the next stage. J{ . e PlANNING C<M1ISSION MINUTES e - 5 - MAY 4, 1982 PUBLIC HEARING, CONTINUED Bob Shaw made some suggestions as to items that might be considered in making the POO contract. He felt that clustering seemed to be the most efficient use of the site given the topography. 1 ) A 30 foot dedication be made along Radisson Inn Road. 2) Reduce the nunber of units from 12, to 8 or 9. 3) Stipulate a requirement for owner occUPancy. 4) Request very deep wells. 5) Increase the size and value of the units to be consistent with the area. Frank Reese felt the clustering ,concept works to the benefit of a site with steep slopes and that the planned unit approach is a good one given the unusual geographical features. Watten moved, Stover seconded, to defer recoomeridation of the Tingewood POO proposal un- til the June 1, 1982 meeting of the Planning Coomission allowing time to consider quest- ions raised during the hearing in regards to water supply, drainage, and road widths. The motion carried tmal1imously. ChairPerson Stover noted that additional written cooments would be accepted through June 1 st when the Corrmission would take action on the issue. The Corrmission suggested that the developer might consider the points brought up in the hearing- for discussion or clarifieation at the next meeting. They would not require ' additional plans at this stage and they discouraged the developer from bringing in an entirely new proposal. Planner Nielsen suggested there was room in the POO process for sane negotiation between the Planning Coomission and the developer. DISCUSSION OF FUTURE STUDY SESSIONS Bob Gagne reported a request by Charles Crepeau for annexation to Excelsior. This re- quest was partially due to the ,way his property is zoned. The issue of a light indus.:.. trial (manufacturing) zone might be addressed by the Planning Coomission. Funding for the Planner's attendance at sttJdy sessions had not been finalized yet. Chairperson Stover related that the Council suggested adding a Certificate of Occupancy to the Zoning Ordinance involving a final inspection by the Building Inspector. Adrian Jolmson, applicant, stated that he was asking for concept stage approval of the proposal with no changes incorporated. The Planning Coomission reviewed some areas of conciern from the Public Hearing. They agreed that drainage plans should be carefully addressed at the next level, the P.U.D. developnent stage. . ALso discussed were traffic related concerns such as safety factors on Radisson Inn Road; a possible land dedication along Radisson Inn Road; the future of the private road into the proposed developnent. The Planning Ccmnission raised question re the City water policy. It was noted that at this time no policy changes had been made and the. requirement for a well for any developnent greater than 10 units is still in effect. Chairperson Stover asked the deve'loper to clarify a corrm€mt in the May 4th Minutes regarding lake access. Mark Koegler (Scheell and Madson) 'stated that prior to the last meeting they were unaware of any private access and did not plan for lake ac-:" cess for the Home Owners Association at this time. Use of the lake ~uld be thrOUgh a suitable public access if one were provided by the City or the D.N.R. The Planning Coornission noted density as the major problem with the proposal. It was agreed that clustered housing is more appropriate given the geography of the area than single detached dwellings. CRFAPFAU PROPERTY ZONING Planner Brad Nielsen presented a report and gave the background infonnation regarding Charles Crepeau, Crepeau Ibcks, at 23443-5 Smithtown Road. He noted that Crepeau's attorney, Jom Lee, had made a request for detachment/ armexation fran Shorewood to Excelsior" to allow the continuation of his business and permit improvement and ex- pansion of the operation. In his report Nielsen outlined four options the City could follow to resolve the issue: 1) vake no action. 2) Vary or amend the Zoning Ordinance to allow expansion of the nOn- conforming use. 3) . Approve the detachment/annexation request. 4a) Amend the Zoning Ordinance to allow manufacturing in the R-5 district. b) Rezone the property to an existing coomercial district, then amend to incltrle fabrication/manufacturing. c) Create a new zoning district allowing manufacturing as a permitted or conditional use. The Planner recoomended that the City create a new zoning district and any concerns or limitations be incorporated into the ordinance. Nielsen cautioned that all possible effects of the action must be considered. Discussion of the situation also involved the zOning of the neighboring properti'es. It was noted that there is sane question as to the legality of the R-G zone for the Shorewood Nursery. It was suggested that Crepeau's use of the land should be studied and if determined acceptable sane way of giving him legal status should be addressed. Reese moved, Leslie seconded, to put the Crepeau Zoning issue on the next Study Session agenda. Although I am not fam- iliar with all the details of the project, I understand that the proposed plan is to rezone the area to R2, allowing three fourplexes to be built on the property. I assume that this represents higher density than previous zoning regulations allow. I also assume that these would be of high quality, graciously designed and built, to fit in with what the devel- oper and designer perceives as the nature of this area. My concerns for this proposed rezoning are as follows: 1) I believe that any propertyowner in this area would like to re- zone his property from Rl to R2, or perhaps even to commercial type property to increase the financial return on developing this land. In the six years I have lived in Shorewood, I have seen a number of efforts in this area, and although I under- stand them from a financial increase point of view, I certainly hope that the Planning Commission will continue with its re- solve of the last few years to resist any efforts to increase density unless a very unusual situation arises. I do not con- sider increase to the profit on sale of lands to be such a reason. Secondly, this particular development faces a unique and dan- gerous access situation because of the legally limited access on Highway 7, and because of the fact that Radisson Inn Road and Radisson Inn Extension are at present substandard and over-utilized roads, The addition of any increased housing, much less increased density, would seriously endanger the health of children and aduJts in the area. Anyone who has &F .. e e Chairman Shorewood Planning Commission April 19, 1982 Page 2 driven by Radisson Inn Road in front of this property will know it is nearly impossible to widen the road without tearing down present homes or large numbers of mature trees. To do any of these things would be to accelerate an already dangerous water runoff situation. Finally, the effect of increasing density on the water ecology of the area could only be adverse. How adverse it might be is only subject to expert interpretation and speculation. For all of the above reasons, I respectfully request that the Planning Commission will approve the Tingewood Project only if it conforms to the present zoning laws. No person shall make a false representation in an application. The City Council shall act upon any such application within 180 days from the date of application, but it shall not issue a license until at least 30 days after the application has been made. '4 # e e AN ORDINANCE LICENSING AND REGULATING THE CONDUCT OF GAMBLING, REPEALING INCONSISTENT ORDINANCES, AND PROVIDING A PENALTY FOR VIOLATION. The Council of the City of ordains: Section 1. PURPOSE. The purpose of this ordinance is to closely regulate and control the conduct of gambling. Section 2. PROVISIONS OF STATE LAW ADOPTED. The provisions of Minnesota Statutes, Chapters 325.54, 349, 609.75, 609.76 and Laws of Minnesota, 1978, Chapter 507, relating to the definition of terms, licensing, and restrictions of gambling are adopted. Section 3. GAMBLING DEVICE; POSSESSION OF. The intentional possession of wilful keeping of a gambling device upon any licensed premises is cause for the revocation of any license under which the licensed business is carried on upon the premises where the gambling device is found, provided that possession of the gambling devices commonly known as "paddlewheels" o~ "tipboards'l or apparatus used in conducting raffles on the premises of a non-profit organization and operated by organizations licensed for such operation pursuant to this ordinance shall not be cause for revocation of a license. Section 4. RESTRICTIONS. Every licensee shall be responsible for the conduct of his place of business and for conditions of sobriety and order therein. No licensee shall keep, possess, or operate, or permit the keeping, possession, or operation of, on the licensed premises, or in any room adjoining the licensed premises, any slot machine, dice, or any gambling device or apparatus, nor permit any gambling therein, nor permit the licensed premises or any room in the same, or in any adjoining building, directly or indirectly under its control to be used as a resort for prostitutes or other disorderly persons, except that gambling devices may be kept or operated and raffles conducted on licensed premises and adjoining rooms when such activities are licensed premises and adjoining rooms when such activities are licensed by this City Council. No person under 18 years of age shall be exployed in any rooms constituting the place in which intoxicating liquors are sold at retail "on-sale", musicians or to perform the duties of a busboy or dishwashi.ng services in places defined as a restaurant or hotel or motel serving food on rooms in which intoxicating liquors are sold at retail "on-sale". Section 5. GAMBLING DEVICES. Subdivision 1. For the purposes of this section the terms defined in this section have the meanings given them. Subd. 2. "Gambling devices" mean those gambling devices known as "paddlewheels" or "tipboards", or apparatus used in conducting raffles. Subd. 3. "Paddlewheel" means a wheel marked off into sections containing one or more numbers, and which, after being turned or spun, uses a pointer or marker to indicate winning chances. -1- e e Subd. 4. "Tipboard" means a board, placard or other device measuring at least 12 inches square, marked off in a grid or columns, in which each section contains a hidden number or numbers o~ other symbol, which determines the winning chances. Subd. 5. "Raffle" means a game in which a participant buys a ticket for" a chance at a prize with the winner determined by a random drawing to take place at a location and date printed upon the ticket. Subd. 6. "Profit" means the gross receipts from the operation of gambling devices and the conduct of raffles, less reasonable sums expended for prizes, local licensing fees, taxes and ~aintenance costs for the devices. Subd. 7. "Active Member" means a member who has paid all his dues to' the organization and has been a member of the organization for at least six months. Subd. 8. Nothing in this section shall be constued to authorize any use, possession or operation of: . (a) Any gambling device which is activated by the insertion of a coin or token; or (b) Any gambling game or device in which the winning numbers, tickets or chances are in any way determined by the outcome of any athletic contest or sporting event. (c) Slot machines, roulette wheels, punchboards and pinball machines which return coins or slugs, chips or tokens of any kind, which are redeemable in merchandise or cash. Section 6. LICENSE FEES. Subd. 1. (a) The annual fee for the operation of gambling devices are defined in this ordinance shall be $20.00. (b) The fee for the operation of gambling devices for an approved organization which will conduct no more than three gambling occasions annually is hereby waived. Subd. 2. Application procedure. Application for a license shall be made in the manner prescribed by the council. No person shall make a false representation in an application. The council shall act upon said application within 90 days from the date of application, but shall not issue a license until at least 30 days after the date of application. Section 7. PERSONS ELIGIBLE FOR A LICENSE. Licenses shall be issued only to a fraternal, religious, veterans or other non-profit organization which has been in existence for at least three years and has at least 30 active members. The following may be eligible for a gambling license; "Any corporation, fund, foundation, trust or association organized for exclusively scientific, literary, religious, charitable, educational, or artistic purposes, or for the purpose of making contributions to or for the use of the United States of America, the state of Minnesota or any of its political subdivisions for exclusively public purposes, or for any combination of the above enumerated purposes, if no part of the net income of any such corporation, fund, foundation, trust or association inures to the benefit of any private member, stockholder, or individual; or any clubs organized and operated exclusively for pleasure, recreational, or other non-profitable purposes, no part of the net income of which inures to the benefit of <1ny private member, stockholder, or individu<11". -2- e - ~ection 8. PROFITS. Profits from the operation of gambling devices or the conduct of raffles shall be used solely for lawful purposes, and as authorized at a regular meeting of the organization. "Lawful purpose" means one or more of the following: (a) benefiting persons by enhancing their opportunity for religious or educational advancement, by relieving or pro- tecting them from disease, suffering or distress, by con- tributing to their physical well-being, by assisting them in establishing themselves in life as worthy and useful citizens, or by increasing their comprehension of the de- votion to the principles upon which this nation was founded; (b) initiating, performing, or fostering worthy public works or enabling or furthering the erection or maintenance of public structures; (c) lessening the burdens borne by government or voluntarily supporting, augumenting of sup- plementing services which government would normally render to the people; or (d) the improving, expanding, maintaining or repairing real property owned or leased by an organization. "Lawful purposes" does not include the erection or acquis- otion of any real property, unless the city council specific- ally authorizes the expenditures after finding that the property will be used exclusively for one or more of the purposes specified in this clause." Section'g. CONDUCT OF GAMBLING. All operation of gambling devices and the conduct of raffles shall be under the supervision of a single gamb- ling manager designated by the organization. The gambling manager shall be responsible for gross receipts and profits from gambling devices and raffles and for their operation. The gambling manager shall be responsible for using profits for a lawful purpose. Subd. 2. Bond. The gambling manager shall provide a fidelity bond in the sum of $10,000.00 in f~vor of the organization conditioned on the Faithful performance of his duties. This requirement may be waived upon showing proof of a blanket bond in the favor of the organization in which the designated gambling manager is included. Bond is hereby waived for an approved organization as defined under Section 6, Subd. 1 (b) of this ordinance. Subd. 3. Qualifications of gambling manager. The gambling manager shall be an active member of the organization and shall qualify under state law. Section 10. COMPENSATION. No compensation in excess of $20 for gambling occasion, not to exceed $30 a week shall be paid to any person in connectio:" with the operation of a gambling device or the conduct of a raffle by a licensed organization. No person who is not an active member of an organ- ization, or its auxiliary, or the spouse or surviving spouse of an active member may participate in the organization's operation of a gambling device or conduct of a raffle. Section 11. REPORTING REQUIREMENTS. Subd. 1. (a) Each organization licensed to operate gambling devices shall keep records of its gross receipts, quwntity of free plays, if any, expenses and profits for each single gathering or occasion at which gambling devices are operated or a -3- e e raffle is conducted. All deductions from gross receipts for each single gathering or occasion shall be documented with receipts or other records in- dicating the amount, a description of the purchased item or service or othe' reason for the deduction, and the recipient. The distribution of profits shall be itemized as to payee, purpose, amount and date of payment. (b). Gross receipts from the operation of gambling devices and the conduct of raffles shall be segregated from other revenues of the organization, including bingo gross receipts, and placed in a separate account. Each organization shall have separate records of its gambling operations. The person who accounts for gross receipts, expenses and profits from the operation of gambling devices or the conduct of raffles may be the same person who accounts for bingo gross receipts, expenses and profits. . Subd. 2. Each organization licensed to operate gambling devices or to conduct raffles shall report monthly to its membership, and to the licensing local unit of government, its gross receipts, expenses and ~rofits from gambling devices or raffles, and the distribution of profits itemized as required in this subdivision. Subd. 3. Records required by this section shall be preserved for three years, and organizations shall make available their records relating to the operation of gambling devices and the conduct of raffles for public inspection at reasonable times and places. Section 12. ELIGIBLE PREMISES. Gambling devices shall be operated and raffles conducted by a licensed organization only upon premises which it,owns or leases, except that tickets for raffles may be sold off the premises. Leases, unless authorized in another location by the local unit of government, shall be for a period of not less than one year and shall be in writing. The local unit of government may authori~ raffles to be conducted by a licensed organization on premises not owned or leased by the organization. No lease shall provide that rental payments be based on a percentage of receipts or profits from gambling devices or raffl Copies of all leases shall be provided to the licensing local unit of gover~ mente Section 13. PRIZES. Total prizes resulting from any single spin of a paddlewheel, or from any single seal of a tipboard, shall not exceed $150. Total prizes awarded in any calendar year by any organization from the operation of paddlewheels and tipboards and the conduct of raffles shall not exceed $50,000. Merchandise prizes shall be valued at fair market re- tail value. Section 14. BINGO. Nothing in this ordinance shall be construed to authorize the conduct of bingo during the operation of gambling devices without acquiring a separate bingo license. Section 15. PENALTIES. Violation of any provision of this section is a misdemeanor. This subdivision shall not preclude civil or criminal action under other applicable law or preclude any agency of government from investigating or prosecuting violations of the provisions of this section. A person convicted of violating any provision of this ordinance shall be subject to a fine of not more than $500 or imprisonment for a term not to exceed 90 days or both. -4- . e e Section 16. NOT BETS. The operation of a gambling device or the conduct of a raffle as set out in this ordinance shall not'be deemed a bet. Section 17. SUSPENSION AND REVOCATION. Sibd. 1. Any license may be suspended or revoked for any violation of this ordinance. A license shall not be suspended or revoked until the proceduralreq~irements of Subd. 2 have been complied with, provided that in cases where probable cause exists as to an ordinance violation, the city may temporarily suspend upon service of notice of the hearing provided for in Subd. 2. Such temporary suspension shall not exceed two weeks. , Subd. 2. Procedure. A license shall not revoked under Subd. 1 until notice and an opportunity for a hearing have first been given to the licensee. The notice shall be personally served and shall state the. ordinance provision reasonably believed to be violated. The notice shall also state that the license may demand a hearing on the matter, in which case the license will not be suspended until after the hearing is held. If the licensee requests a hearing one shall be held on the matter by the council at least one week after the date on which the request is made. If as a result of the hearing, the council finds that an ordinance violation exists, then the council may suspend or terminate the license. Section. EFFECTIVE DATE. This ordinance becomes effective upon its passage and publication according to law. MEMORANDUM TO: Shorewood Mayor and City Council FROM: Brad Nielsen DATE: 24 June 1982 RE: FILE NO.: Shorewood Comprehensive Plan Status 656.03 As you are aware the Metropolitan Council staff has suspended their review of Shorewood's Comprehensive Plan, pending submission of additional in- formation. They have requested the following items: 1. Land Use Plan for the year 1990. 2. Map indicating the number of existing and potential intercommunity s~wer service areas for Shorewood and adjoining communities. 3. Tabulation of existing and future sewer connections by service area (from 2. above) along with capacity needs by year for the next five years. 4. An updated implementation schedule for adoption of official controls. The Land Use Plan for 1990 i.s causing the greatest delay in submitting the requested information. Shorewood's Comprehensive Plan contains a Proposed Land Use Plan on page 75 of the Policy Plan/Development Frame- work (Report No.4, dated September 1981). This map and the land use acreages contained in the table on page 79 represent saturation develop- ment. The Metropolitan Council has asked that the City project where and how much development will occur by the year 1990. This has proven difficult to do for two reasons. First, when we were directed to make changes to the Population and Household Projections Based Upon Proposed Land Use Plan (pages 78 and 79), the Council felt that Shorewood's future population and household figures would not reach the Metropolitan Council roo ions. hile we agree with the City, the City's position is based primarily on opinion and not supported by data. Secondly, projection of land use is typically based upon a city's plans for extension of services, roads, etc.. Currently the entire community is served by sanitary sewer and, except for possible upgrading, the primary road system is in place. He intend to prepare a map showing areas of the city for which development has been approved or proposed (e.g., Boulder Bridge Farm, Near Mountain, Amesbury, etc.) indicating the number of units and acres to be developed. Staging plans for these projects should provide a fairly accurate picture of land use for 1990. As far as the sewer information mentioned in 2. and 3., the City Engineer - has indicated that these items may already be available in an inflow and infiltration study which is scheduled to be presented to the City in the near future. We have arranged a meeting with the Engineer for Monday to discuss these items. At this time it would be desirable for the Council to authorize the Engineer to prepare whatever of the required information will not be in his report. Finally, we need to know approximately when the City intends to complete its review of the Zoning and Subdivision Ordinances so that we can inform Met Cquncil. Possibly this could be determined at your meeting on 28 June. At this time we are suggesting that the requested information be provided to Met Council in the form of an attachment or addendum to the Policy Plan/Development Framework document rather than totally revising the Land Use Plan section. We intend to have a draft prepared for your 12 July meeting. Although the items requested by Met Council are primarily informational in nature and not anticipated to present controversy, the Council may wish to refer th~ addendum to the Planning Commission for their review and comment prior to approval by the Council. In order gain the greatest public input the Deephaven City Council has called a Public Hearing for Tuesday, July 6, 1982 at 8:00 P. M. to con- sider the closing of Vine Street, either temporarily or permanently, at the Deephaven/Shorewood city line. The City Engineer sugges'ted the continually increasing traffic on Hooper Lake Road could be controlled by a series of one-way streets, upgrading of the streets or closing Vine Street at either the Deephaven/Shorewood city line or at Manor Road. Because Vine Street is partially in Deephaven and partially in Shorewood, the Shorewood City Council was approached for their advice and consent. On May 10 the Shorewood City Council indicated that none of the current proposals are acceptable at this time. In order ot obtain input from the public on this request the Deephaven City Council.has called a PUBLIC HEARING FOR TUESDAY, JULY 6, 1982 AT 8:00 P. M. AT THE DEEPHAVEN CITY HALL, 20225 COTTAGEWOOD ROAD, to consider the closing of Vine Street, either temporarily or permanently, at the Deephaven/Shorewood city line as shown on the accompanying map. You are being given notice because your property would be affected directly or indirectly through additional traffic and/or elimination of an alternate route. JU". fm HO TO: Shorewood City Council FROM: Gary Larson, City Attorney RE: Ordinance No. 70, Wetland Ordinance for the City of Shorewood In conversation with Rob RascOp today, he asked that I write each of you and relate mv conversation with him. As YOll all know, the City of Shorewood passed a Hetland Ordinance in March of 1973, and to date there has been no serious challenge of that ordinance. I do, however, have one reservation concernirig strict enforcement of the ordinance. It was my understanding that when the ordinance was passed and the map was drawn which actually designates the wetland area of the City, the map was not drawn by the City Engineer and was a free-hand drawing using a magic marker on a City topigraphical map. My impression also is that there was not alot, if any, engineering data supplied or used in determining the wetland areas, but rather the area was marked because of some markings on the map itself. If push comes to shove, we may have some difficulty in sustaining the actual location of any given line around a wetlands area. I discussed th is matter wi th L1 im Norton on several occasions and ,Jim does not agree with my concerns. He apparently feels comfortable with the lines as drawn on the official map. For your information, I also enclose a copy of the Krahl case, which Bruce Malkerson refers to in his letter on several occasions.
