PLEDGE OF ALLEGIANCE'AND PRAYER The meeting opened with the Pledge of Allegiance and a prayer. ROLL CALL: Present: Mayor Rascop, Counci1persons Haugen, Shaw, Leonardo, and Gagne. Staff: Attorney Penberthy, Engineer Norton, Administrator Uhrhammer and Clerk Kennelly. APPROVAL OF MINUTES: Moved by Leonardo, seconded by Haugen, to approve the finaL draft of the July 12, 1982 Council minutes. Motion carried unanimously. PLUMBING PERMIT REQUEST FOR 'TENNIS COURT 'ACCESSORY BUILDING Mrs. Larry Wilson of 27965 Woodside Road presented a request for an additional bUilding permit for the purpose of installing a toilet and drinking fountain in an accessory tennis court building. This was not requested at the time that the variance was granted to construct the accessory building. Mr. Wilson had indicated that inside plumbing was not needed in the original request. Jhe sewer connection will be installed into the present resident line and will reqvJ~~n additional yearly ~ ) utility charge. ~ ~dministrator ~rhammer recommended on limiting the building per- f ~ \ mit to a sink, toilet and drinking fountain. V ~ ~Gagne moved to approve the limited plumbing permit request and I~ receipt of a written statement joining his 2 lots into one. ~ , Seconded by Leonardo. }P ~ Motion carried - 4 ayes, 1 nay (Shaw) \ JA e e Regular Council Meeting - 2 - July 26, 1982 MATTERS FROM THE FLOOR: Joe Gorecki '- OakRidge'Estates~2nd'Addition - ~.., Joe Gorecki presented a proposal to be allowed to develop Oak Ridge Estates - 2nd Addition by various phases. This proj~ct would re- quire an amended contract to the current developmental contract. Haugen requested a development completion time table. Gorecki agreed to concept in accordance with current economics and sale~ ability. He would like to submit complete subdivision of this area and develope each phase individually with improvements when monies are available. Engineer Norton would like to see a total utility plan and approve it prior to Phase I, starting installation of improvements. At this time, Gorecki would like to extend utility improvements through Phase I. Engineer Norton recommended a new plat be submitted with the final plan, showing all phases with quide11nes of when and what areas will be developed. Council requested all specifications be submitted and approved prior to the start of this project. Goreki requested bo be allowed to omit curb and gutters from project to conform with Oak Ridge 1st Addition. He also would like the Council to address the method of supplying water for this area. The Council indicated that these things would be addressed with the final platting. Curran Nielsen - Problem Geese Curran Nielsen, Mike Kramer, and Marge Yaeger, residents of Timber Lane, presented concerns of a dangerous health hazard that could arise from the excessive amount of goose droppings left on their yards from the large group of geese that are staying on their property. Mayor Rascop suggested passing an Ordinance prohibiting the feeding of Geese in Shorewood, 'and request the surrounding communities to adopt similar Ordinances. Council decided to have our local health authority inspect the properties and ask for suggestions to help the problem from the Department of Natural Resources, Fish and Game Authority, and the Lake Minnetonka Conservation District. ENGINEER'S REPORT:, I. & I. Analysis Study Engineer Andy Martin of Professional Services Group Inc. reviewed the 1&1 Analysis Study. He reviewed the cost of repairs to the line as opposed to the cost of the additional charges due to infil- tration. He pointed out problem areas of high monitored flow, these areas have the large Metro line flowing through them. e e Regular Council Meeting - 3 - July 26, 1982 1&1 Ana1ysis'Study'(Corttirtued) He estimated costs of repairing the city lines and costs of repairing Metro' 1ineg. Rascop moved, sec~nded by Haugen, to accept the I & I Analysis Study from Professional Service,Group and submit it to. the Metro Waste Control Commission (M.W.C.C.) for approval, then request M.W.C.C. to make repairs to their lines in Shorewood. Motion carried unanimously MAYOR'S REPORT Police Contract Rascop recommended that Shorewood not withdraw from the police contract at this time. Tonka Bay and Greenwood have verbally agreed to the budget presented by Shorewood. \(i~/ ~liCeBUdget'APprova1 . 'RESOLUTION #59-82 \)6 Rascop moved, seconded by Gagne, to approve a $225,000.00 \ Shorewood share for the South Lake Minnetonka Public Safety Department budget for 1983. Motion carried 4 ayes - 1 nay (Shaw). . Police Contract RESOLUTION #60-82 Rascop moved, seconded by Haugen, to approve a one-year police contract to contain: 1] Department to provide a Public Services Officer. 2] A re-defining of density. 3J Each city to be financially responsible to pay for prosecution time charged for officers. Motion carried - 4 ayes - 1 abstain (Shaw). GAMBLING ORDINANCE - Second Reading The Gambling Ordinance was reviewed. Suggested changes in Section 5, Section 14, and Subdivision B. A third reading with these changes will be submitted for approval at the next Council meeting, August 9, 1982. AMENDMENT TO ZONING ORDINANCE - R-6 MOBILE HOME PARK Ordinance #77 Council reviewed the proposed Ordinance;Ques'tions on the meaning of "manufactured" or "mobile home" were asked. Haugen moved, seconded by Gagne, to waive the second reading and approve the Ordinance as submitted. Motion carried unanimously. e e Regular Council Meeting - 4 - July 26, 1982 MAYOR'S REPORT '(Continued) Enchanted' Point - .. Mayor Rascop removed.himself from the discussion because he resides on Enchanted Point. Jeff Soule and Jim Thibault of Enchanted Point requested a clarifica- tion on the status of 'their road; is it public or . e? he residents would like it to be private and are willing to maintain the road at their cost as they have in the Rast. _~~torney will clarify if the road was ever dedicated. - PARK COMMISSION REPORT Carol Chapman of the Park Commission reported on the reviewal of Ordinance #91, regulating Parks and Beaches. Wheeled vehicles have been prohibited from the trail syste~except snowmobiles, west of Excelsior. ' Vandalism signs have been ordered and will be installed when they are received. ,/~~ayor Rascop requested the Park Commission to review their sign policy -f ~egarding the billboards around the "old" baseball field. rLANNING'COMMISSION REPORT Mobile Home Ordinance Kristi Stoyer reported on the Planning Commission's Review of the Mobile Home Ordinance which was submitted to the Council. AttendanceProblems:~Planning'Commission Attendance problems were discussed. A policy for dismissal regarding absences and tardiness were to be set up. Mayor Rascop will talk to individuals that have a problem of non-attendance. A request, by Janet Leslie, for a two month leave of absence was granted. FLOOD PlAIN ~ AMENDING #109 Shaw reviewed the FloodPlain Ordinance amendment and insurance. <1HaUgen moved, seconded by Rascop, to waive the second reading of the Ordinance and adopt the amendment to Ordinance #109. Motion carried unanimously. COMPREHENSIVE.PLAN ,RESOLUTION NO.. /:./~~l- Revision of the Comprehensive Plan was reviewed in the form of an appendix to report 4 - Policy Plan/Development Framework. Haugen moved, seconded by Leonardo, to approve appendix and forward it to the Metropolitan Council. Motion carried. e e Regular Council Meeting - 5 - July 26, 1982 POLICE REQUEST - ... Chief Earl Johnson requested the City to pass an Exhibition "Driving Ordinance. Council would like to have Chief Johnson attend the next Council meeting and explain the type of Ordinance he would like passed. Widmer Brother. - Boulder.. Bridge RESOLUTION NO. b 2- ~ <is 2--- Engineer Norton submitted a revised voucher for payment to Widmer Brothers for the underground work at Boulder Bridge, for an addi- tional payment of $100.00. Rascop moved, seconded by Gagne, to approve this payment on Project 80-2. Motion carried unanimously. ADMINISTRATIVE REPORT Fee Report A fee reb~rt for variances, conditional use permits, zoning amend- ment, su ivisions was submitted to the Council. Gagne moved, seconded by Shaw, to adopt the fee schedule with the noted corrections. Motion carried. Zonin~Violations - 25985 SmithtownRoad Complaint was previously filed on 25985 Smithtown Road as a zoning violation, under operating a business in a residential district. ~~taff checked and found 8 t09 more similar violations in this area. " MISCELLANEOUS MATTERS ~ j tCounci1 instructed the weed inspector, Dennis Johnson, to inspect the ~roperty east of 24340 Yellowstone Trail for noxious weeds. Letters in opposition to the closing - one-way Country Club Road, Lake Linden Drive are on file at the city offices. Complaint on the temporary closing and signing of Vine Street have been made by various residents. {~uncil instructed Administrator Uh~hammer to have the old sign removed ~nd have a new sign placed on the front of City Hall. COUNCIL REPORTS . GABLE TV~.JOINT'POWER.AGREEMENT Haugen reviewed, for the Council, the responses received from the written cable survey. Gagne moved, seconded by Haugen for discussion, joining in the Joint Powers Agreement. " ~ e e Regular Council Meeting - 6 - July 26, 1982 Cable TV (Continued) Leonardo didn't feel enough residences are interested in cable. Council felt the ci~y should not risk city money to support the Cable. Commission; 'that the Cable Companies should support the Commissions. Questions about the contract as written, came up and were unanswered. E: ~ Amesbury Association again has -requested the use of the city hydrants for the purpose of watering open spaces. A complaint was also made regarding "brown water". Council discussion remained the same as in the past, city hydrants will not be used for open space watering. Engineer suggested that the watering of lawns through the resident's water softners could cause the brown water by using up the effectiveness of the softner. SEWER BILLING PROCEDURES Haugen reviewed the time consuming billing procedures currently used by Staff and suggested to the Council that the City bid out this project. PURCHASE ',OF EQUI:PMENT, Moved by Haugen~ seconded by Gagne, to approve the purchase of a Vibra Pac Roller in an amount not to exceed $5,000. Motion carried unanimously. EMPLOYEE REVIEWS 1] Public Works 'Director Moved by Mayor Rascop, seconded by Haugen, to increase the Public Works Director's salary 8%. Next performance review will be in August, 1983. MEMORANDUM - ..;.;, TO: Shorewood Planning Commission, Mayor and City Council Brad Niel sen FROM: DATE: RE: FILE NO: 25 May 1982 Deikel, Ted - Property Division 656.09 (82.10) BACKGROUND Mr. Ted Deikel has requested that the City approve a division of his property located at 27960 Smithtown Road (see Site Location Map, attached). In a letter to the City Council, dated 26 April 1982, Mr. Deikel asked that he be able to divide his property into two lots as shown on Exhibit B. The property currently contains a house, a cabin and a number of outbuildings. The property division would allow Mr. Deikel to sell off the house with approximately two and a half acres, while retaining the cabin and approxi- mately six acres. The division shown on Exhibit B has been drawn on a copy of a preliminary plat previously submitted by Mr. Deikel. As you may know, a final plat for the Bay Park Addition was approved in 1977. However, because Mr. Deikel was unable to receive approval of lake access for inland lots, he never recorded the plat. That plat would have created six lots, two of which had lake frontage. ISSUES AND ANALYSIS 1. Variance - Public Street Frontage. Section Y.D. of the Shorewood Sub- L division Ordinance requires that all lots abut a publicly dedicated street. Mr. Deikel has proposed that access to the northerly parcel ould be via a 50 foot wide private road from Smithtown Road. While e property is wide enough (345 feet) for both lots to have at least 1 0 feet {the required lot width),Mr. Deikel has requested the variance to allow for future subdivision of the southerly parcel. This request is $imilar to that which was approved for Ronald and Eugene Ofstead (see our staff report - Of stead Property Division, dated 25 February 1982). As in that request, it is recommended that the City stipulate that no further subdivision will be allowed until the street is ;J;1'" ublicly dedicated and constructed to City standards. The applicant's ~ ' , previous plat should be considered as a resubdlvision sketch or "ghost plat" and used as a guide for future subdivision. ~ 1'/f) Variance - Simple Subdivision. Again. similar to the Ofstead request, rv. ~ the variance required in 1. above technically precludes this request \ from the "simple subdivision" procedure. Since the street frontage variance is considered justified, it is also appropriate to allow the division without formal platting. Future subdivision will, however, requi re pl atti ng '- RECOMMENDATION Due to the similarity of this request to the Ofstead Property Division, it is recommended that it be approved in a similar fashion. The Deikel lot division should be approved only under the following conditions: 1. The previously approved plat for the Bay Park Addition should be considered a resubdivision sketch and recorded with the lot division. It will then be used as a guide for any future resubdivision. 2. Any future resubdivision of the southerly parcel will be done as a formal plat. 3. The southerly parcel should not be divided until the private road has been dedicated and improved. It should be noted that the road should be extended as shown on the previOUS plat. 4. Drainage and utility easements. should be provided along the borders of the northerly parcel. The recommended conditions should be speCifically stated and recorded with the County so that any future owners are aware of them. REPORTS City Council: Bob Gagne reported that the Tineewood P.U.D. proposal came before the Council at their June 28th ~eeting. A vote will be taken at the July 12, 1982 meetinc. The Council heard a request by the American Legion for a gamblinc ordinance in Shorewood. Negotiations on the Police Contract were in prosress. Gagne noted that the Council was concerned about poor attendance by Commission members at the Planning Commission meetings. Important items for the C~nmission to work on are the Mobihl~:anufactured Homes Ordinance needed by August 1st, and the proposed Zoning Ordinance by October 1st. Nayor Rascop was present c~nd reiterated the need for completion of the Zoninc Ordinance. Section 3. DEFINITIONS. Subd. A. For the purposes of this ordinance, the terms defined in this ordinance have the following meanings. Subd. B. "Gambling devices" mean those gambling devices known as "paddlewheels" or "pulltabs" or "tipboards", or apparatus used in conduction of raffles. Subd. C. "paddlewheel" means a wheel marked off into sections containing one or more numbers, and which, after being turned or spun, uses a pointer or marker to indicate winning chances. ~ Subd. D. "Tipboard" means a board, placard or other device measuring at least 12 inches square, marked off in a grid or similar pattern, in which each section contains a hidden number or numbers or other symbols, which determine the winning chances.
