The regular meeting of the Shore wood City Council was called to order by Mayor Rascop at 7:37 P.M. on Monday, Ausust 9, 1982 in the Council Chambers. PLEDGE OF '.ALLEGIANCE:& . APPROVAL OF.MINUTES Moved by Gagne, seconded by Haugen, to approve the final draft of the July 26, Council Minutes. Motion carried. . ~. Haugen moved, seconded by Gagne, to approve the minutes of the Special Council Meeting of July 27, 1982. Motion carried. MATTERS FROM THE FLOeR Ron Abresch ~ Diseased Elm , Ron Abresch of 25985 Smithtown Road would like the diseased elm tree removed that is on the railroad right-of-way adjacent to his property. hmdnistrator .to contact the County to allow Mr. Abresch to remove the tree hims,elf. Exhibition Driving Chief Johnson explained the purpose for the Exhibition Driving Ordi- nance. This Ordinance would provide an alternative charge, other than wreckless or careless driving, for a violation that would not endanger life or property. This would be a petty misdemeanor charge and would be more effective than a warning violation. Gagne moved, seconded by Rascop, to direct the Attorney to draw an Exhibition Driving Ordinance for the Council to review. Motion carried. ,'tt. PUBLIC HEARING - DEIKEL SIMPLE DIVISION ~ Attorney Hakewitz, representing Mr. Diekel, presented a proposal for a . simple division with variances. Public Hearing was opened at 8:0~'P.M.' The simple division will contain 2 lots, approximately 2; acres wi~h the existing dwelling needing a road frontage variance and a 6 acre residue lot with 100 to 180 feet of lake frontage. Rascop indicated the Planning Commission objection to 100' of lakefront for the 6 acre parcel. No public comment was presented and the public.portion of the Public Hearing was closed at B: 12 P.M. , _ Shaw moved, seconded by Haugen, to approve the division subject to: e . Regular Council Meeting - 2 - August 9, 1982 Deikel Public Hearing,(Contirtued) 1. The previously approved plat for the Bay Park Addition should be considered-a~re-subdivision sketch and recorded with the lot division. It will then be used as a guide for any future re-subdivision. 2. Any future re-subdivision of the southerly parcel will be done as a formal plat. 3. The southerly parcel should not be divided until the private road has been dedicated and improved. It should be noted that the road should be extended as shown on the previous plat. 4. Drainage and utility easements should be provided along the ~~ borders of the northerly parcel. 5. Residue 6 acre parcel to contain 180' of lakeshore. The recommended conditions should be specifically stated and recorded with the County so that any future owners are aware of them. The request and this report should:)be subject to review and comment by the City Attorney and City Engineer. Mrs. Deikel's attorney objected to the 180' lakeshore frontage. Shaw and Haugen withdrew point #5. Shaw moved, seconded by Haugen to approve the division concept to include above items 1 through 4. 5. Residue 6 acre lot to contain 120' or more of lake frontage. Also to submit the final plan to the council for approval Motion carried unanimously. MINNETONKA'STATE'BANK'-Review'of'New'Bartk'Site Design ~y Amendment to Conditional Use Permit RESOLUTION NO. Bob McDougall, Bob Weise, and Jim Grover of the Minnetonka State Bank presented a site plan change for the construction of the new bank build- ing. The bank was able to acquire permanent easement to some additional land. This additional land will omit point #2 of .the Conditional Use Permit listed in Resolution #70-81. Rascop moved, seconded by Haugen, to approve the amendment to the Con- ditional Use Permit and instructed the permanent easement to be regis- tered with the building permit when it is issued. ^~]V Roll call vote - 4 ayes. ,Carried.~- LOT,COMBINATIONREQUEST,- AMERICAN 'LEGION POST #259 RESOLUTION NO Request was made by Paul Christensen, representing the American Legion and the adjoining property owner, Horace Murfin, to divide off 18' from the Murfin property and combine it with the American Legion property located at 24450 Smithtown Road: Council reviewed the Ordinance and with legal advice determined that this complies with the Ordinance. Shaw moved, seconded by Haugen, to approve the division and combination of 18' additional feet to be combined with the American Legion property. Roll call vote - 4 ,Ayes - Carried. e e Regular Council Meeting - 4 - August 9, 1982 Council directed the Administrator to write a. letter to Dan Austin regarding the blocking of a culvert on his property, directing him not to plug that culvert. Request an extra copy of letter for his attorney. ENGINEER'S REPORT RESOLUTION NO. Engineer Frigaard submitted a suggested list of roads to be seal coated and requested the Council to approve Project 82-ST-l and authorize him to advertise for bids to be let on August 23rd. If the bids come in lower than anticipated the project will be extended to use up all the allocated road money. Gagne moved, seconded, by Haugen, to approve Project 82-ST-l and authorize the advertisement for August 23rd bid opening. Motion carried unanimously. ~ADGERFIELD'PUMPHOUSE RESOLUTION NO. Moved by Rascop, seconded by Shaw, to approve the final payment to the A&K Construction Company upon receipt of State Forml34 and lien wavers. Motion carried unanimously. AMESBURY'WEST CHANGE ORDER RESOLUTION NO. a request for a change order and recommend- Engineer Frigaard submitted ed approval. Haugen moved, seconded by Gagne, to #80-3. Motion carried unanimously. approve change order #3 for Project ~MESBURY WEST CHANGE 'ORDER RESOLUTION NO~ Voucher #5, including change order #3, was recommended by payment to Richard Knutson Inc. for Project #80-3. Rascop moved, seconded by Haugen, to approve paymen~ of Voucher #5. Motion carried unanimously. ALBITZ ADDITION~ SEWER'ACCEPTANCE Engineer Frigaard requested the Council to formally accept the sewer extension in the Albitz Addition. After discussion regarding the ~ad placement and completion of necessary rip-rapping, Haugen,recommended tabling the acceptance of the sewer ,improvement until developer can be notified of requirements necessary to complete access road to project. ADMINISTRATIVE. .REPORT Responses to 'One-Way Streets Comments fr?m Bob Reutiman,Gene Clapp, and Chuck Latterner were ex- pressed in opposition to the one-way of Lake Linden Drive and Country Club Road. A signed petition in opposition was also submitted to the Council 'by Mr. Reutiman. ..- Mayor Rascop tabled any action until August 23rd Council Meeting when the entire Council can be present. e e Regular Council Minutes - 5 - August 9, 1982 GOOSE PROBLEMS kealth officers inspected the area on Timber Lane where there is a high concentration o~geese. He felt there was no health damage in- volved. Administrator will contact the Game and Wildlife Department and request them to remove the geese. fUEHLING DOCK -TIMBER LANE, A letter directed to the assessor was received requesting the installa- tion of a dock on Timber Lane. Mr. Fuehling, owner of a double bungalow on' Smithtown Road. The dock has already been installed. Council directed the Administrator to notify them to remove the dock ~~because it does not comply with the City Ordinance. 'MAYOR ',S 'REPORT Police Contract Rascop tabled discussion of the police contract until a complete Council will be in attendance. fOUNCIL REPORT Request was made by the Amesbury Association to be allowed to fill the wild life pond with city water. Council denied request. Building inspector was complemented for his efficient job effort. Gagne questioned why the inspector was taking a city truck home. The Administrator will clarify use with,Mr. Miller. Arneson and N,ancy K. Arneson, husband and wife. At the time of the sale we discovered that Title Insurance Company of Minnesota required us to get easements for access to the public road. Later we discovered that some of the necessary road access had been forfeited to the State of Minnesota and acquired by the City of Shorewood. I've been told that Shorewood acquired title to Tract E, Registered Land Survey No, 241. I'd like to ask that Shore- wood also acquire Tract H and then give to the Arensons and other neighbors up there an easement so that they have access to the public road. I understand that the homeowners would possibly be required to pay real estate taxes in the future, and would be responsible for main- tenance of the road. My wife and I have had to place $10,000.00 in escrow which won't be released to us until access to public roads is provided. ~ Thank you for your help. C~'ren Nielson 5435 'Timber Lane (474'r..ro) 7/19/82 I talked to Dick Wendsell, U.S. - "" Fish and Wildlife Service, (725-1830). The only time that the geese can be caught is when they are in moUlt. The moulting season just ended. , M~. Wends ell said he would be glad to talk to Mr. Neilson, it you wish him to do so, call him. He also suggested that Mr. Neilson put up a fence. If the geese are walking in from the bay, it will stop them, if they are flYing in other methods will have to be used. At'l'ERNA TIVES 1. "Tell the City Fathers to write a let.ter of request." They have had too much trouble in the past with groups of people trYing to protect the geese and chasing them away from the nets, hasseling the workers, etc. They would also have to have Police Pro- tection. 2. Council can pass a law "No feeding ducks or geese in the City". (It was mentioned that this is probably something like trYing to license catsl) 3. fTopane tanks that let off loud noises approximately once a minute. (t:ot feasible as sound equals shotgun blast every minute night and day. Used on farms in the country.) 4. Open hunting season. (Coinciding with state season) This depends on whether or not the city has a no hunting ban. This would be a Council decision and need state approval. 5. All the old <mes had their '.;ings clipped and were taken to Carlos Avery. They will be shipped to Oklahoma and their wings wUl be clipped again so they can't fly. The charges ,...ere paid by the people that requested them. The young geese "ere t8.ken to Carver Park. Their wings were also clipped. They will be going to the Tennessee Valley Authority, also paid by them. 57 geese ''1ere e[;ain released into Lake Calhoun. .... This was done at your request in response to complaints of the Neilsen family and their neighbors. The problem as stated to me was copious amounts of goose droppings near their lake shore and a connection between a health hazard and these droppings. As you know, we spoke to Mrs. Neilsen, took a walking tour of the area in question, and did indeed find copious amounts. of bird droppings. I have researched this question with the appropriate people at the State Board of Health and various infectious disease consultants. On behalf of Minnesota Transit and the Minnetonka School District, we would like to go on record as strongly opposing the proposed changes. This opposition is based upon the following factors: 1) The change would severely limit accessability to the area making the transporation of students extremely cumbersome. . 2) This action would cause school buses to travel un- necessary miles adding additional time to routes and unnecessarily consuming additional fuel. 3) The safety of students would not be enhanced by the proposed changes. In fact, students may be required to walk further distances since the overall trans- portation system must be completed within a limited time frame. Since 1973 we have made special asses sment payments directly to the City of Shorewood on 83 units at $2,200.00 per unit for a total of $182,600.00. In addition, from 1973 to 1981 we made principal pay- ments directly to Hennepin County in the amount of $81,452.55 along with interest payments of $90,206.98. We are informed that in November of 1981 the City credited ano1iher $91, ISO. 00 A 9 a res.ult of the City failing to credit payments in the year in wh ich they were made, the principal balance continued to incur interest as though principal had not been paid. Accordingly, we believe an interest credit is due for interest that accrued on previous ly paid principal amounts. We have been told we will receive credit for these three units on the Amesbury West assessment. We propose that we be refunded the $34,117.00 of interest it paid on previously paid principal. I suggest that the $10,974.45 referred to above be credited as paid and the City reimburse US for the remaining amount of $23,202.55. The purpose of the special study was to assist City personnel in determining pay- ments made by the McNulty Construction Company since 1973 on the Amesbury special assessments in relation to the total amount assessed and due from this contractor on this project. In order to complete the study, several assumptions were made based on discussions with City personnel and information received. They are as follows: 1) In addition to the special assessments principal assessed through Hennepin County of $212,253, the McNulty Construction Company was liable for an additional charge of $39,600, plus accrued interest at 6.5 percent based on an additional 22 sewer and water units at $1,800 each. This additional charge was to be satisfied by payments from the McNulty Construction Company directly to the City of Shorewood in amounts of $2,200 for each lot sold. Dear Mr. Uhrharrmer: A study has been completed to determine reasonable and safe speed limits for Garden Rd and West In., as requested by the Shorewood City Council. The study results show 15 MPH to be a reasonable and safe speed limit for both roads. Before issuing a "Speed Limit Authorizationll for 15 MPH speed limits, however, we would like to point out two possible problems with such a speed limit. First is the necessity of adequately signing the speed zone; and second is the possibility of other requests for speed limits resul ting in a variety of speed zones wi thin one residential area. The signing problem can be partly alleviated by adding Rustic Way to the speed zoning request. This addition will avoid the necessity of installing a IIEnd Speed Zone" sign on West In. irrmediately prior to the sharp curves on Rustic Way. A separate 10 MPH speed limit could be authorized for Rustic Way, or a 15 MPH limit could be used with curve signs and 10 MPH advisory speedplates. Whatever signing is used, it is probable a minimun of five signs will be needed to adequately post speed limits for enforcement purposes on Garden Rd. and West In. It is possible that the 15 MPH speed limit will be noticed by residents along other streets who will request lower speed limits for their streets. In such an event, we would have to evaluate each street separately which could result in varying speed limits wi thin the area. This would make adequate signing even more of a problem. There appear to be three options for the City regarding speed signing on these roads: 1) Ask for authorization of a legal 15' MPH speed limit and install signing 'f4. . accordingly. (If this course of. action is selected, we would prefer a request also be submitted for speed zoning Rustic Way.) 2) Install diamond shape warning signs such as "Restricted Sight Distance" wi th advisory speed plates in lieu of legal speed limits. 3) Do nothing, relying on road characteristics and the fact that most traffic is local to restrict speed. Considering the poSSible problems mentioned earlier, alternative two might be the best solution. Regarding the residents I request for other signing, the "Slow Children" sign should not be used because it is not a standard sign. The one such existing sign on Garden Rd. should be removed. If such signing is deemed necessary, a diaroond shape sign should be used which conforms to the Manual on Uniform Traffic Control Devices. Safety at the intersection of Garden Rd. and West In. can best be improved by removal of vegetation to provide good sight angles. If sufficient sight distance cannot be obtained, signing can be used, such as a "Yield" sign or "Stop"Sign and possibly advance warning signs. There is nothing in accident history, however, to indicate such signing is needed. We would appreciate a written notification of the course of. action preferred by Shorewood.
