CALL TO ORDER
The regular meeting of the Shorewood City Council was called to order
by Mayor Rascop ~t7:32 P.M. on Monday, Sept~mber 13, 1982 in the
Council Chambers.
PLEDGE OF ALLEGIANCE 'AND 'PRAYER
The meeting opened with the P1e~ge of Allegiance and a prayer.
ROLL CALL
Present: Mayor Rascop, Counci1members Gagne, Haugen, Shaw, and
Leonardo.
Staff: Attorney Larson, Engineer Norton, Administrator Uhrhammer,
and Clerk Kennelly. .
APPROVAL OF MINUTES
Moved by Gagne, seconded by Haugen, to approve the final draft, including
corrections, of the August 23, 1982 regular council minutes.
Motion carried unanimously.
Moved by Gagne, seconded by Leonardo, to approve the minutes, as written,
of the special meeting of August 30, 1982. Motion carried unanimously.
MATTERS FROM THE FLOOR
Jim Dutcher - Water Costs
Jim Dutcher requested the Council to approve the payment of $2,093.50
for his expense for the over-sizing of the water lines installed in
his Wild Duck III Addition. Engineer Norton's memo was reviewed with
reference to this project. ' , .
Mr. Dutcher also reques"ted the council to reconsider their previous
discussion to require two water meters per double bungalow. He feels
that one meter per unit is all that is necessary because he will be
receiving all the billings instead of his tenants. He would like to
exchange the water service cost from,:the beginning of service to pre-
sent in exchange for interest on the over-sizing costs; he feels this
is due him.
Rascop moved to table until further information can be obtained from
the staff regarding as-bui1ts, contractual agreement and costs.
Seconded by Leonardo. Motion carried unanimously.
Antenna Regulations
Mrs. Launesse Cousins asked if the city had any regulations prohibit-
ing or controlling 'the installation of satellite antennas. At present
the city has no restrictions on their installation. Mrs. Cousins felt
that there should be some control on there placement because of their
unsightliness.

Sigrt'PermitApplicatiort'~'Naegele'Signs
Mr. Mielke, Vice President of Naegele Sign Company, and Mr. Nie~ela,
owner of the Vine Hill Furniture Store, presented a request to 1n-
stall a new billboard (advertising sign) at 19385 State Highway 7.
They also requested permission to move the existing Liquor Store
sign closer to the highway.
Administrator Uhrhammer reviewed the application for the council.
The request is in full compliance with the current zoning ordinance
and has been approved by the city building inspector. Also, the
Liquor Store manager is in agreement with the location change of the
Liquor Store sign.
A second application will be submitted to move the existing sign.
Shaw moved, seconded by Gagne, to approve the change in the location
of the City Liquor Store sign.
Motion carried unanimously.
SIMPLE SUBDIVISION - R. A. Niglio
Brad Nielsen, city planner, and John Crouch, Niglio's attorney, reviewed
for the council the request for simple lot division of Mr. Niglio's
property located at 20625 Manor Road. Mr. Niglio also owns property in
Deephaven that will require access and utilities to be obtained through
the City of Shorewood.
Gagne moved, seconded by Haugen, to approve the simple subdivison of
two (2) lots to include:
1] Easements should be acquired over wetlands for drainage.
2] Drainage and utility easments should be provided along all lot
lines.
3] Limit any further division of this property until a complete
plan is submitted for reviewal, including plans for the portion
in Deephaven.
4] Provide an approved alternative access to existing residence from
Manor Road.
AMENDMENT TO COMPREHENSIVE PLAN -Crepeau Property
City Planner, Brad Nielsen, reviewed a memo from September 3rd stating
recommended changes in the Comprehensive Plan to create a Service .
Commercial District. Council had questions on the area to be changed.
A question on the status of the Minnetonka Dredging non-conforming use
permit will be researched.
Council felt that the process of notifying possible properties affected
by zoning changes were not adequate. Rascop questioned the necessity
for so many reserictionswithin this zone.
Further reviewal will be made by the council at a later date.

ATTORNEY'S REPORT "
Christmas Lake "Poirtt Access RESOLUTION NO. 71-82
Attorney Larson informed the Council that Tract E, Registered Land
Survey #241, was currently owned by the city through a tax forfeit-
ure; Tract H is available from the State because of tax forfeiture.
Attorney Larson submitted a Resolution to release this property back
to the State for:p~ivate and public sale so that it can be acquired
by the residents affected.
Moved by Haugen, seconded by Gagne~ to adopt the resolution as sub-
mitted. Motion carried una~imous1y.
PLANNING COMMISSION REPORT
"Larry Bader
Division request was tabled.
Nig1ioDivision
Review of Mr. Nig1io's division was made with a report going to
the council.
Tingewood
Tingewood presented their developmental stage plan. The
Planning Commission approved the plan on the contingency
of receiving the Engineer's recommendations.
Comprehensive Plan Amendment
A Public Hearing was held on the Comprehensive Plan Amendment
and the Amendment to the Zoning Ordinance #77, creating the
C-4 zone.
ENGINEER'S REPORT
Amesbury West
Engineer Norton informed the Council that the Amesbury West
project is near completion and the assessments against the
project should be assessed. McNulty Construction has waived
the Public Hearing and he would like to submit the assessment
rolls for adoption at the September 27, 1982 council meeting.
Attorney Larson submitted a Resolution authorizing the prepa-
ration of the assessment rolls.

Amesbury West .RESOLUTION~#72~82
Shaw moved, seconded by Haugen, to approve the resolution as
submitted by the Attorney.
Motion carried unanimously.
Amesbury Back-upWell
Engineer Norton presented a memo in reference to the installation
of the back-up well to be located in Amesbury. It was recommended
by the Engineer and Renner We11 Company, to move the location of
this well from the original site, to insure no installation prob-
lems. This change may increase the cost of construction.
Engineer Norton requested tenative concept approval to draw change
order for this project and request the council to be responsible
for any possible cost over-run above the $41,600.00 that McNulty
has agreed to pay. .Counci1 was in general agreement to the request.
COUNCIL REPORT
Cable TV
The Commission feels that they will receive the necessary signature
needed to proceed.
The changes requested by Shorewood will be submitted for considera-
tion after the contract is accepted. Three of the cities that have
already signed, have not withdrawn from their previous commission.
Haugen moved, seconded by Rascop, to appoint Haugen and Leonardo
as representatives to the Cable Commission at this time.
Motion carried unanimously.

According to the Zoning Ordinance, Section 11 "General Provisions", S1ibd. #7,
Sub-section A, the Council must deny the'variance requests, unless the Zoning
Ordinance is amended. The minimum set-back distance according to the Zoning
Ordinance is 35 feet. Both variance requests are asking for set-bacKs less
than 35 feet.
Both parties submitting variance requests have been notified of the set-back
problem and have been asked to modify the building plans that they have sub-
mitted. It is not known if modified plans will be submitted at the Council
meeting.

RESOLUTION FOR HEARING ON PROPOSED ASSESSHENT
WHEREAS, by resolution passed by the Council on the 13th
day of September, 1982, the City Clerk was directed to prepare a
proposed assessment roll for the street and utility improvmements in
Amesbury West: and
HTIEREAS, the Clerk has notified the Council that such
proposed assessment has been completed and filed in her office for
public inspection.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Shorewood, Minnesota:
1. A hearing shall be held on the 27th day of September,
1982 in the City Hall at 9:00 P.M. to pass upon such proposed
assessment. At such time and place, all persons owning property
affected by such improvement will be given an opportunity to be heard
with reference to such assessment.
2. That the City Clerk has received in writing from
McNulty Construction Company and R. James McNulty, Jr., its Vice
President, a waiver of the Notice of Hearing on the proposed
assessment and the Clerk is therefore instructed not to cause notice
of said hearing to be published in the newspaper or to give mailed
notice to said McNulty Construction Company.

RESOLUTION NO.
RESOLUTION ADOPTING ASSESSHENT
WI!EREAS, pursuant to Waiver of Notice of Hearing, the City
Council has met and heard and passed upon all the objections of the
proposed assessment for the Amesbury West improvementJ
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Shorewood, Minnesota:
1. That such proposed assessment, a copy of which is
attached hereto and made a part hereof, is hereby accepted and shall
constitute the special assessment against the lands named therein and
each tract of land therein included is hereby found to be benefitted
by the proposed improvement in the amount of the assessment levied
against it.
2. That such assessment shall be payable in equal
installments extending over a period of five (5) years. First
installment to be payable on or before the 1st Monday in January,
1983 and shall bear interest at the rate of % per annum from
the date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from the
date of this resolution until December 31, 1982. Each subsequent
installment when due shall be added interest for one year on all
unpaid installments.
3. The owner of any property so assessed may at any time
prior to certification of the assessment to the County Auditor pay
in whole the assessment on such property with interest accrued to the
date of payment to the City Treasurer, except no interest shall be
charged if the entire assessment is paid within thirty (3D) days of
the adoption of this resolution and he may at any time thereafter pay
to the City Treasurer the entire amount of the assessment remaining
unpaid ....,i th interest accrued to December 31 of the year in which such
payment is made. Such payment must be made before November 15th or
interest will be charged through December 31 of the next succeeding
year.
4. The Clerk shall forthwith transmit a certified
duplicate of this assessment to the County Auditor to be extended on
the property tax list of the County and such assessments shall be
collected and paid over in the same manner as other municipal taxes.

'rINGEWOOD P. U . D. PROPOSAL
Development stage plans for the Tingewood P.U.D. proposal, lladisson Inn Road,
were presented by Mark Koegler, Schoell and Madson, Inc.
Koegler noted that the new site plan is similar to the concept stage plans.
There are now nine units as suggested by the Planning Commission and Council.
Some modifications were made i~ the cul-de-sac to fit the natural grade, and
to accommodate emergency vehicles. The units are in an attached townhouse con-
figuration. Some architectural changes were noted due to the change from twelve
to nine units, and, the expected sales price rose from $75,000 to the $125,000/
$150,000 range. The impact on the site has changed little; about 78% of the
tree cover will be retained. Guest parking is still planned off the cul-de-sac.
Grading - Koegler noted that all but two of the units are walk-outs. They are
positioned.on the site to utilize the natural slope, causing less site disturb-
ance. The road is planned to leave the tree cover; some fill will be required
and a retaining wall. The slope of the road was noted as being most steep at
the entry to Radisson Inn Road - about 7t % grade.
Utilities - Koegler stated that the sewer system will tie into the existing man-
hole in the street (Radisson Inn Road). The water system will be a common well
as required by the City; six inches in diameter, twenty gallons per minute. The
well, as proposed, will be located in the center median area with a distribution
or pressure tank and four inch lines to the units.
Drainage - Koegler noted that the street drainage had been directed to the south
end of the cul-de-sac. Roof drainage has also been brought forward to the road.
Catch basins and a storm water retention area will be used. A berm winding
through the existing tree cover would form the retention area. Koegler stated
that the amount of water held would not remain long enough to affect the tree
cover, even as a result of heavy rains.
Landscaping - The proposed landscaping for the development was described by
Koegler as simplistic. He noted that they intended to retain the tree cover
and that the median area would be undisturbed. Major tree plantings are planned
around the units, along with foundation plantings. The homeowners association
will be responsible for maintenance of the landscaping. \'lateri.f'or plantings will
come from the pump building in? the center island.

Ownership - Koegler added that(<thadevelopment will have nine individual lots
owned by each resident and a common lot #10 under the association's control. He
noted that a right-of-way is planned for the eastern side of the property to
"clean..up" Radisson Entrance. 'Land wi:tlbbendedicated along Radisson Inn Road as
requested by the City. The property lines along the private drive have also been
shifted fifteen feet to the east placing the drive entirely inder the association's
ownership.
Koegler also noted that the owner of lot #11 had suggested an even land swap with
the developers to clean up lot lines.

Koegler noted the following points in response to questions from the Planning
Commission and the audience.
Outlot #10 is common open area but not recreation space, leaving it in its natural
state.
Planner Nielsen noted that the City Engineer had suggested duel .catch basins, two
on each side of the street, due to the grade, and that the crown of the road be
adequate to force run-off into the basins. Koegler said that the basins shown on
the plans were on the property.
Koegler noted that the project~s engineers feel that four inch water lines are
adequate to serve the development. . He added that the developers would prefer to
let the water system stand as is with the smaller lines, rather than six inch
lines as proposed by the City Engineer. At such time that a municipal water
system comes in,the homeowners' · association would be assessed for six inch lines
and the hydrant would be added at that time. Koegler noted that with the proposed
twenty G.P.M. well, tp.e.hydrants.would be useless for fire protection and would
only serve to flush the lines. .
Koegler noted that the water system is two dead.-ends rather than a loop system due
to cost factors and the size of the development.
He said they had not ohecked with the fire department for their suggestions on the
hydrants or water system for fire protec~ion.
In regards to questions about wateringtthe cOlMlon area, Koegler estimated that the
sodded area around the units and the center area would need to be watered. This
would probably be supplied from the pressure tank.
The Planning Commission noted that many of the issues from the concept stage pro~
posal had been addressed. They felt that drainage had been a critical problem and
agreed that the City Engineer needs to expand on the issue before final approval
of the development.
Shaw moved, Spellman seconded, to recommend that the City Council approve the
development stage plans for;TingewoQ9.ocontingent:,uponLthe resolution of the drain-
age and water/hydrant questions.; /that grading pennits be withheld until these
issues are resolved and approval is. granted by the Watershed Distriot.
The motion carried unanimously.

Having received Concept Stage approval for the Tingewood planned unit
development consisting of three, 3-unit structures, Adrian Johnson has
submitted Development Stage plans for review by the City (see attached
exhibits).
. .
Due to the City Engineer's time being taken up recently by preparation
of assessment rolls, he will be unable to have a written report prepared
in time for the Planning Commission meeting. Consequently we are
submitting the following summary of issues which have been discussed
between our office and the Engineer's office:
1. Density. As directed by the City, the applicant has reduced the
project density from three, 4-unit structures to three, 3-unit
structures. As shown in the attached exhibits, the design of
the structures has changed as a result.
2. Stormwater Runoff. Drainage was, perhaps, one of the most critical
issues raised in the Concept Stage review. Although the applicant's
plans address drainage, the City Engineer has made the following
comments:
a. Dual catch basins should be required on each side of the
proposed road in order to catch all runoff coming down
the street. The road should be adequately crowned to
direct the runoff to the gutters.
b. Capacity of the proposed pond is questionable relative to
the amount of runoff which may occur. The applicant should
provide calculations of potential volume and velocity of
potential runoff. Volume of runoff should be compared to
capacity of the proposed ponding area. If found to be
insufficient, either the pond area and depth can be increased
and/or a longer pipe can be installed directing overflow to
the wetland area to the west.

c. Drainage should be subject to review and comment by the
Minnehaha Creek Watershed District.
3. Water.
a. Details should be provided as to size and design of the
proposed well.
b. At least two fire hydrants should be required where the
proposed watermain deadends. These will allow for future
hookup to a citywide system and can be used in the meantime
for maintenance of the private system.
c. A six inch pipe should be provided to allow for ultimate
hookup of the private system to a public system.
d. If water lines are located outside of the easement shown
on the preliminary plat, the easement should be increased.
4. Sanitary Sewer. While the street has been proposed as private,
it is unknown as of this writing as to whether private or public
ownership (and thus maintenance) of the sewer system is proposed.
While the ownership is not critical, if the City is to own the
system, the development agreement between the applicant and the
City should provide that the City is not responsible for any
restoration of pavement, sod, etc. which may be disturbed in
the maintenance of the system.
The gap in the utility easement should be closed forming a loop.
5. Street.
a. The size of the turnaround has been increased sufficiently
for maneuvering of emergency vehicles.
b. Prior to approval of a final plat, a typical street section
and plan profiles of the street should be submitted.
6. Preliminary Plat.
a. As per the Planning Commission's directions, the property
boundary adjacent to the road has been moved eastward so
that the private street is located entirely on 'the P.U.D.
si te.

b. Right-of~way has been dedicated for Radisson Inn Road.
c. The applicant has arranged an approximately even trade
of land with the owners of Lot 9 to the east, thus
simplifying the previous gerrymandered lot line.
RECOMMENDATION
In providing the preceding summary of issues relative to the Tingewood
P.U.D., we hope that we have not put words in the City Engineer's mouth.
Based upon our discussion, he will be sending a written report regarding
the project. In view of the technical nature of the issues yet to be
resolved, it is suggested that approval of the Development Stage be
contingent upon the Engineer's and Watershed District's favorable review
of those issues.

TINGEWOOD PUD
The Development Stage plans for the Tingewood PUD are in conformance
with the concepts portrayed and approved during the General.
Concept Plan phase. Changes have been made to reflect official
comments noted during the Planning Commission and City Council
reviews.
Specifically, the following changes have occurred:
1. Density/Housing Type: The total number of units has been
reduced from the 12 originally proposed to the 9 units
approved by the Planning Commission and City Council.
Since the units went from 4 per building to 3, architectural
changes have occurred. The nine units are in three clusters
with each unit facade having a varied surface treatment
emphasizing individual identities. The price of the units
has increased from the originally projected range of
$65,000-$75,000 to approximately $125~000~$150,OOO. Garage
space has been upgraded from one car per unit to two
attached garage stalls per unit. Purchasers of the units
are still expected to be young professionals and empty
nesters.
2. Cul-de-sac: The private entrance road remains unchanged.
The cul-de-sac has been enlarged partially in response to the
City Engineer's preliminary comments on truck access and
turning movements. Tree cover in the median area of the
cul-de-sac will remain largely undisturbed.
3. Property Lines: The property line separating Lot 6 (existing
house) and Lot 34 (proposed townhouses) has been moved to
the east in order to meet the City's requirement that the
street be located "completely in the PUD plat". This
adjustment permits the road to essentially follow the align-
ment of the existing dri'veway and avoids extensive tree
removal along the entrance area.
On the eastern side of the site, a land exchange is proposed
between Lot 6 and Lot 34, northerly exception 10 at the
request of the owner of Lot 34, exception 10. In addition to
the Site Plan, these areas are portrayed with the newly
assigned lot numbers on the preliminary plat.
4. Right-of-Way Dedication: Rights-of-way for .Radisson Inn
Road and Radisson Entrance have been dedicated on the
Preliminary Plat. The dedication of right-of-way along
Radisson Inn Road was required by the Planning Commission
and City Council and the dedication at Radisson Entrance
provides right-of-way along the existing road where none
previously existed.

The City Council of the City of Shorewood, ~1innesota does ordain:
Section 1. That Ordinance fIo. 53 be amended by adding
~ection 6. ~ as follows:
"Section 6. A. EXHIBITION DRIVITJG. No person shall operate any
motor vehicle with unnecessary exhibition of speed on any public or
private way within the city li~its. Prima facie evidence of such
unnecessary exhibition of speed shall be any or all of the
following:
(a) Unreasonable squealing or screeching sounds
emitted by the tires;
(b) The throwing of sand or gravel by the tires
of the vehicle;
(c) Unreasonable skid, sway or slide upon
acceleration or stopping."
Section 2. This ordinance shall be effective from and
after its passage and publication.

Dear Mr. Uhrhammer;
Concerning your letter of September 1,1982, Hennepin County must deny
the request of installing "Truck Routell signs on County Road #19 at the
intersection of Country Club Road and Smithtown Road. The reason being
that all county roads are truck routes and to sign a portion would be
inconsistent and could possibly lead to confusion by truck drivers.
Presently no county road has IITruck Route" signing.
This denial, however, does not preclude the City from installing signs
on the city streets to alleviate the problem of trucks using the street
for access to TH 7.
