CALL TO ORDER
The regular meeting of the Shorewood City Council was called
to order by Mayor Rascop at 7:30 PM, Monday, April 11, 1983,
in the Council Chambers.
PLEDGE OF ALLEGIANCE AND PRAYER
The meeting opened with the Pledge of Allegiance and a prayer.
ROLL CALL
Present: Mayor Rascop, Councilmembers Haugen, Shaw,
Leonardo, and Stover.

APPROVAL OF MINUTES
Haugen moved, seconded by Shaw, to approve the minutes as
amended for the Council meeting of March 28, 1983. Motion
carried unanimously.
MATTERS FROM THE FLOOR
Clean-up Day
Residents asked the Council about when the City "Clean-up
Day" will be and what is necessary to do in order to obtain
a burning permit. Council will be deciding the time and
fee schedule later. They explained some of the necessary
steps for burning permit requests.

Complaint of Non-notification of Hearing
Mr. and Mrs. Mike Marl' were present to voice a complaint in
reference to receiving incorrect information as to the date
that the Council would be making their decision on the
Conditional Use Permit to allow the building of an office
building at the Southwest corner of Chaska Road and State
Highway #7. They were opposed to this construction and
the removal of the nature buffer to Highway #7.
Council apologized for the incorrect information they
received from staff. Marr's requested to see all the
plans for building, when they are submitted. Council
will instruct the Building Inspector to notify Marr's
when all the plans are received.

MATTERS FROM THE FLOOR continued
Timber Lane Lake Access
Steve Haskins from Timber Lane was present to thank the
Council for it's efforts in writing a letter to the
Governor's Task Force opposing the possible installation
of a lake access on Timber Lane.
PLANNING COMMISSION REPORT
Shaw indicated that the matters the Planning Commission
dealt with will be reviewed tonight with various other
agenda items. He also recommended that a representative
from the Planning Commission should be in attendance at
the Council meetings in the future.
ADMINISTRATIVE REPORT
Insurance Group
Administrator Uhrhammer requested insurance coverage with
the County Group Health Policy. One of the insurance
companies involved did not want to accept the City at this
time. Another review will be made in October. He felt
we should also research the possibility of joining the
League of Minnesota Cities Insurance Group.
"Clean-up Day"
1ge3 Budget did not contain enough money to subsidize

will review and submit user-fee rates at the next meeting.

State Aid Formula
The new State-aid formula will reduce Shorewood funding
approximately $26,000.00 from last years amount if accepted
at the current formula proposed.
PUBLIC HEARING - 8:15 PM
RESOLUTION NO. 28-83
Minnetonka State Bank-Sign Variance Request
BobM~ Dougall from the Minnetonka. State Bank was present to
request a square footage variance to allow them to install
3 signs containing one 81.5 square feet and two 18 square
feet. City ordinance allows one sign of 150 square feet
and two additional signs of 10 square feet. Mr. Mc Dougall
is requesting to be allowed two 8 foot variances for the
signs to be installed on the building.
Public comment portion was closed at 8:28 PM after receiving
comment from Bob Reutiman in approval of this request.
Shaw moved, seconded by Stover,to approve the variance as
requested. Motion carried 4 aye - 1 nay (Leonardo)
(Haugen noted her decision was based on the Planning Commission
recommendation)
RESOLUTION NO. 29-83
PRELIMINARY PLAT REVIEW
Oak Ridge Estates-3rd Addition
Joe Gorecki submitted the proposal for Oak Ridge Estates
3rd Addition containing 8 new lots. He submitted some
new changes as recommended and he feels they now have
complied with all requirements.
Engineer Norton reviewed various points that need to be
clarified.
1.) Legal change of road names within the sub division.
2.) The need for additional soil borings. Mr Gorecki
disagreed on the need, but the property owner,
Mr. Noble, agreed to have further borings done as
requested.
Council questioned the water system issue. Central well
versus individual well; Easements granted for utilities or
lines installed now for future use. Engineer Norton estimated
the cost of a Central well and lines a~ approximately $35,000.00,
which would be the same as individual well. Developer disagreed
with the central well because of the up front cost to him.
Council discussed "Water Policy". Attorney Larson determined
that there is no current policy in effect.

Oak Ridge Estates 3rd addition-Preliminary Plat Review continued
Haugen moved, seconded by Leonardo, approval of the preliminary
plat with the following conditions:
1. Additional soil borings to be done to Engineer's
satisfaction.
2. Storm sewer and drainage constructed according to
City Engineer's specifications.
3. Streets and sanitary sewer system to City Speci-
fications.
4. Development agreement to be drawn up by City
Attorney and signed.
Motion carried unanimously by Roll Call vote. 5 ayes.
Mr. Noble thanked the Council and Staff for their cooperation
with his development.
Council Break: for student interviews at 9:15 PM; returned
at 9:30 PM.
REVIEW OF AMENDMENT TO ZONING ORDINANCE
Mortenson Property - 19545 & 19585 State Highway #7
Council reviewed the request to rezone this property from an
R-l, Residential Zone, to a C-l, Commercial Zone. Mr. Hubbard,
developer, presented plans for a II Self-Storage facility" for
that location. This facility would have an on-site manager
with a security system. Most of the storage buildings would
be 11 feet in height with 2 buildings at 20 feet in height.
Council had concerns about C-l zoning being the correct zone
for that area, and whether it was the best use of the property.
Haugen moved, seconded by Rascop, to refer this issue back to
the Planner and Administrator for further review of the
appropriate zoning for this area. Motion denied, 2 ayes,
3 nays (Shaw, Leonardo and Stover)
ORDINANCE NO. 143
MOVING OF BUILDINGS
The Council reviewed the 3rd reading of the proposed "Moving
of Buildings" Ordinance. A few alterations were made in wording.
Haugen moved, seconded by Leonardo, to adopt the proposed
Ordinance as amended. Ordinance was adopted by roll call vote.

Public Hearing FOR Cable T.V. will be held at City Hall
at 7:30 PM on Tuesday, April 12, 1983, for the purpose of
receiving comments from the public on the "request for
proposal".
Special Meeting
Stover requested the Council to set a special meeting for
the purpose of reviewing and setting Water policy and
consideration of any other needed policies.
This meeting will be held on May 4th at 6:00 PM at City Hall.

Acting Chairman Shaw called the April 19th Planning Comission meeting to order at
7:43 P.M.

REQUEST FOR SETBACK VARIANCE
Mr. and Mrs. Donald Wambold were present to request a variance to allow them to
remodel an existing house located at 28015 Woodside Road. The house was described
as a nonconforming structure. The Wambolds noted that the house was built prior
to adoption of the setback requirements in the current Zoning Ordinance. Letters
from the Wambolds and their realtors were referenced to cite the inadequacies of
the house and its unsaleability (see Planners report dated 17 April 1983, attach-
ment #2).
Mrs. Wambold explained that they planned to extend the house 23 feet to the west,
adding bedrooms and an entry (requiring a setback variance of 30.5 to 35 feet) and
additions of a kitchen, deck and gazebo to the east and south (requiring a 10 to
14 foot variance). Mr. Wambold noted that placement of the additions is limited
due to the location of the existing pool and trees.

Mr. Theodore Deikel has submitted a final plat for the Bay Park Addition.
As you recall the preliminary plat involved a lot width variance, allowing
a 50 foot strip along the northerly side of the property to serve as access
to the northernmost parcel which contains an existing house. City approval
of the variance and preliminary plat was contingent upon five specific
conditions (see Council minutes dated August 9, 1982).
The final plat is consistent with the approved preliminary plat. It should
be noted that Lot 2 is just over 150 feet wide along the lake. Drainage
and utility easements along property lines have been provided as per City
requirements. However the City Engineer has noted that the easements for
existing utilities have not been shown. These should be included on the
final plat.
Three of the Council's requirements relate to future division of the large
southerly parcel. These items should be addressed in a development agree-
ment between the City and develoner. The City Attorney is currently pre-
paringusaid development agreement.
While it is assumed that Outlot A will be ow.ned by the owner of Lot 2,
this should be specified in the development agreement. The agreement
should also clearly specify that future owners should be aware that Outlot
A is intended for future use as a public street.

MEMORANDUM
TO: Planning Commission, Mayor and City Council

RE: Wambold, Donald - Variance Request

Attached is a request from Mr. and Mrs. Donald Wambold to expand their exist-
ing house at 28015 Woodside Road (see Exhibit A, attached). The house is cur-
rently nonconforming due to inadequate setback on the east side (see Exhibit B,
attached). Since Section 10 of the existing Zoning Ordinance specifically pro-
hibits the expansion of nonconforming structures, the Wambo1ds have requested a
variance. Their request is expressed in detail in the attached letter, dated
11 April, from them to the Council and Planning Commission (see attachments
0-1, 0-2 and 0-3).
Their problem stems from a number of factors. First, their lot contains only
21,000 square feet in an R-1 District, which requires 40,000 square feet.
Secondly, they have a corner lot which requires larger side yard setbacks
abutting the street. Finally, the Zoning Ordinance has changed, more specifi-
cally defining where certain setbacks are required. This problem is high-
lighted when comparing the required setbacks shown on Exhibit B with the way
the lot was originally 1ayed out on Exhibit C. As can be seen, the property
(with the exception of the pool area) would conform if the north side were
considered the front. Unfortunately, variances are still required to allow
the proposed expansions, regardless of what is considered front or side.
As in the past, we suggest that the City review the proposed Zoning Ordinance
Revision currently under study by the City Council. Although the new ordi-
nance allows more flexibility than the existing, in that nonconforming structures
are a1lowd to expand as long as the nonconformity is not increased, this offers
little relief to the applicants. As proposed, both the garage addition and the
kitchen/deck/gazebo addition will increase the nonconformity of the house.

Attached are the drawings for the proposed addition for our home at
28015 Woodside Road.
We purchased the home in May of 1977 when we moved from Florida. We had
no indication at the time of purchase that the lot was considered sub standard,
nor that existing structure(s) were in violation of local set-back laws.
The planned addition is for the purpose of making our home more useable for
ourselves as well as making it saleable in the future.
You will note the date of the plan is 1981. My husband was transferred to
Indiana in 1979. We put our home up for sale in August of 1979 for $125,000.
The real estate market was a sellers market at that time and we were assured
by our brokers the house should sell quite rapidly for that figure. We had
our home on the market for 12 months until August of 1980, when we finally
gave up trying. We had lowered the price several times after buying a home
in Indianapolis. We sold the home in Indianapolis two months after putting
it on the market. My husband quit the company he was working for there and
returned to Minneapolis.
We again tried to sell the house in 1981 as we wanted to move on the lake and
needed larger bedrooms and kitchen. This time the house was on the market
six months before we again gave up.
Both times the house was on the market, we had excellent showings. During
the first month each time we averaged over 5 showings a week.
During discussions with the brokers, they advised us of the reasons people
were not interested in the house.
1) Bedrooms were too small (we can't have a dresser in the bedroom
because of the size).
2) Kitchen was too small and dark (there are only 3 recessed lights in
the kitchen and one small window).
3) No eating area in the kitchen (there's not even room for a chair).
4) No front entrance to the house.
5) The side and front yards are unusable (steep incline on the side, woods
in the front) and the back yard is too small and hilly.
6) No storage in garage.

We decided if we were to stay in the house, we had the same complaints. If
we ever expected to get a reasonable return on our investment, we would have
to correct its shortcomings. We went to an architect at Lyman Lumber, and
asked him to come out and see the property and draw up plans which would cor-
rect the defects. He drew up the plans understanding the limitations of the
lot (steep, hilly inclines which wash out during heavy rains).
During the past two years, we have been dealing with builders and rising
interest rates, trying to pick a time to start when costs would not be pro-
hibitive. We have selected the builder and the bank has agreed to the loan
at a rate which we could afford.
When we came to the City for a building permit we found that in order to make
the improvements required in order for our property to be worth what it is
currently being appraised, we must obtain a variance to extend beyond the
set back restrictions.
You will note from the drawing the existing house is 50+ feet from the lot
line on the North and West sides (although the pool and fence erected by the
previous owner is less than 10 feet on the West). The existing house is
approximately 33 feet from the East lot line.
For our proposed remodeling, we are requesting a 30.5-35 feet set back on the
West and an additional ten to fourteen feet on the East.
The neighbors adjacent to our property on the East and the South have agreed
with our plans as they will enhance the property and their view of it.
We request that you grant this variance to allow us to make our home not only
more livable for ourselves, but also to allow us a reasonable return on our
investment should we be required to sell in the future.

AN~L BMX MEMORANDUM AGREEME~
n
THIS MEMORANDUM AGREEMENT, made and e~tered into this 7 - day
of ~/l~ , 198~, by and between the Shorewood BMX Associa-
tion hereinafter called "Athletic Association", and the City of Shore-
wood, Oa Minnesota Municipal Corporation, hereinafter called "City":
1. The City agrees to provide to the Athletic Association the
exclusive use of the BMX bicycle track located at Freeman
Park city facilities for those dates and times which the
Athletic Association does agree to file with the City Admini-
strator on or before 7 days following the execution of this
agreement, provided said dates are specifically approved by
the City Council at its regularly scheduled meeting follow-
ing the filing of the same. The City Council shall have the
right to amend or change the dates and times of authorized
use as they deem to be in the best use of the City; dates so
approved shall not be subject to change without prior approval
of the City Administrator. Postponements may be made up on
substitute dates only after approval of such dates and times
have been obtained from the City Administrator.
2. The Athletic Association shall be solely responsible for main-
taining the track itself in a usable condition. It shall also
be responsible for all parking of spectator cars in designated
areas and for proper crowd control.
3. The Athletic Association agrees that no participant of any of
its sponsored events will be permitted to use the track unless
that participant is protected with a hard protective helmet and
pads completely covering the handle bars and frame of the bi-
cycle used on the track. The Association agrees to post this
regulation in a conspicuous place so that anyone attempting to
use the track during a period other than for sponsored events
will be informed of the minimum safety equipment required for
use of same.
4. The Athletic Association represents to the City that they are
operating the track on a non-profit basis and that all funds
charged for entry fees will be used by the Association for
costs, upkeep, and maintenance of the track and for prizes for
participants.
5. The Athletic Association agrees, before any use of the BMX
track is made, it shall file a copy of a liability insurance
policy naming the City as insured in the amount of $100,0001
$300,000. An explanation will also be included explaining
additional insurance coverage on race participants. .Use of
City's facilities shall not be permitted until these policies
are on file.

6. This agreement shall be in existence for the balance of 198~
subject to its being revoked on 10 days notice. In case of-
excess vandalism, or lack of control of spectators, or the
Association violates any terms of this contract, the City
shall be entitled to revoke use of the track by the Athletic
Association. The Association shall have an opportunity to
be heard before the City Council if they so desire during
the 10 day notice period.
7. Any use of the facility other than that authorized herein
shall result in an immediate forfeiture in further rights
of the Athletic Association to use the same.

EQUIPMENT AND MANPOWER SHARING AND USE AGREEMENT
BETWEEN THE CITIES OF SHOREWOOD AND TONKA BAY
WHEREAS, the Cities of Shorewood and Tonka Bay,
hereinafter referred to as Shorewood and Tonka Bay, desire to
enter into a mutual aid agreement recognizing the close
relationship that exists between the Cities, and
WHEREAS, Shorewood and Tonka Bay recognize the
financial advantages afforded to both communities through a
mutual aid and sharing of equipment and manpower arrangement,
and
WHEREAS, it is important to formalize the
relationship of the two communities with the sharing of the
equipment and manpower to assure the residents of each
community that each community is receiving equal benefits from
the sharing.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of approves the agreement and
administrative procedures concerning the sharing of equipment
and manpower between the Cities as set forth and attached
hereto and directs its Administrator and Public Works Director
to implement the policy agreement commencing on June 1, 1983.

EQUIPMENT AND MANPOWER BETWEEN .THE CITIES OF
SHOREWOOD AND TONKA BAY
PROCEDURE
1. RECORD KEEPING:
Each Community will keep a record of the equipment and
manpower loaned to and borrowed from the other community
on their equipment use record form.
[see Exhibit A]
2. PAYMENT OWED:
Once each quarter the Administrator's of Tonka Bay and
Shorewood will meet to compare the equipment use records
kept by each city; determine if differences exist on
records, and calculate the amount of money owed to the
other city, if any. If money is owed, it will be paid
within 30 days of the quarterly meeting date.
3. EQUIPMENT RENTAL RATES:
[see Exhibit B for rates]
In May of each year the Public Works Directors and City
Administrators of each city will meet to compare the
Existing Equipment Usage Rate with the Equipment Usage
Rate charged by Hennepin County. If the cities rates
are different than those charged by Hennepin County,
the cities rates will be changed so that they equal
the county's rate. In all cases the usage rates
charged for equipment will be equal to the rate
Hennepin County charges for a similar piece of equipment.
4. MANPOWER RATES:
Man hours will be charged on the basis of an actual
hourly Loaded Labor Rate per man - the Loaded Labor
Rate charge will be calculated as follows:
Annual salary + Annual Group Insurance Cost + Annual
PERA @ 6.7% of total salary + Annual Workmans Compen-
sation @ 6.8% of total salary ~ 2080 hours = Loaded
Labor Rate per hour.
Annual salary + Annual Group Insurance Cost + Annual
PERA at 5.5% of total salary + Annual FICA at 6.7%
of total salary + Annual Workman's Compensation at
6.8% of total salary ~ 2080 hours = Loaded Labor Rate
per hour.

Acting Chairman Shaw called the April 19th Planning Comission meeting to order at
7:43 P.M.

REQUEST FOR SETBACK VARIANCE
Mr. and Mrs. Donald Wambold were present to request a variance to allow them to
remodel an existing house located at 28015 Woodside Road. The house was described
as a nonconforming structure. The Wambolds noted that the house was built prior
to adoption of the setback requirements in the current Zoning Ordinance. Letters
from the Wambolds and their realtors were referenced to cite the inadequacies of
the house and its unsaleability (see Planners report dated 17 April 1983, attach-
ment #2).
Mrs. Wambold explained that they planned to extend the house 23 feet to the west,
adding bedrooms and an entry (requiring a setback variance of 30.5 to 35 feet) and
additions of a kitchen, deck and gazebo to the east and south (requiring a 10 to
14 foot variance). Mr. Wambold noted that placement of the additions is limited
due to the location of the existing pool and trees.
Commissioners Reese and Leslie noted a valid hardship. They commented that the
additions would not negatively impact the neighborhood or green space. Commissioner
Watten noted that the saleability of the house was not an item for the Commission to
address.
It was noted that the structure is nonconforming and the additions would expand the
nonconformity.
Joe Gorecki, 26890 Edgewood Road, felt that the additions to the home would improve
the area and would harmonize with the neighborhood.
.The Commission questioned whether other homes in the area meet the setback require-
ments. It was noted that some do, others do not.
Watten moved, Leslie seconded, to recommend that the Council approve the request
for variances. The motion carried unanimously, 6-0.

Attached is a request from Mr. and Mrs. Donald Wambold to expand their exist-
ing house at 28015 Woodside Road (see Exhibit A, attached). The house is cur-
rently nonconforming due to inadequate setback on the east side (see Exhibit B,
attached). Since Section 10 of the existing Zoning Ordinance specifically pro-
hibits the expansion of nonconforming structures, the Wambolds have requested a
variance. Their request is expressed in detail in the attached letter, dated
11 April, from them to the Council and Planning Commission (see attachments
D-1, D-2 and D-3).
Their problem stems from a number of factors. First, their lot contains only
21,000 square feet in an R-1 District, which requires 40,000 square feet.
Secondly, they have a corner lot which requires larger side yard setbacks
abutting the street. Finally, the Zoning Ordinance has changed, more specifi-
cally defining where certain setbacks are required. This problem is high-
lighted when comparing the required setbacks shown on Exhibit B with the way
the lot was originally layed out on Exhibit C. As can be seen, the property
(with the exception of the pool area) would conform if the north side were
considered the front. Unfortunately, variances are still required to allow
the proposed expansions, regardless of what is considered front or side.
As in the past, we suggest that the City review the proposed Zoning Ordinance
Revision currently under study by the City Council. Although the new ordi-
nance allows more flexibility than the existing, in that nonconforming structures
are allowd to expand as long as the nonconformity is not increased, this offers
little relief to the applicants. As proposed, both the garage addition and the
kitchen/deck/gazebo addition will increase the nonconformity of the house.

Attached are the drawings for the proposed addition for our home at
28015 Woodside Road.
We purchased the home in May of 1977 when we moved from Florida. We had
no indication at the time of purchase that the lot was considered sub standard.
nor that existing structure(s) were in violation of local set-back laws.
The planned addition is for the purpose of making our home more useable for
ourselves as well as making it saleable in the future.
You will note the date of the plan is 1981. My husband was transferred to
Indiana in 1979. We put our home up for sale in August of 1979 for $125.000.
The real estate market was a sellers market at that time and we were assured
by our brokers the house should sell quite rapidly for that figure. We had
our home on the market for 12 months until August of 1980. when we finally
gave up trying. We had lowered the price several times after buying a home
in Indianapolis. We sold the home in Indianapolis two months after putting
it on the market. My husband quit the company he was working for there and
returned to Minneapolis.
We again tried to sell the house in 1981 as we wanted to move on the lake and
needed larger bedrooms and kitchen. This time the house was on the market
six months before we again gave up.
Both times the house was on the market. we had excellent showings. During
the first month each time we averaged over 5 showings a week.
During discussions with the brokers. they advised us of the reasons people
were not interested in the house.
1) Bedrooms were too small (we can't have a dresser in the bedroom
because of the size).
2) Kitchen was too small and dark (there are only 3 recessed lights in
the kitchen and one small window).
3) No eating area in the kitchen (there's not even room for a chair).
4) No front entrance to the house.
5) The side and front yards are unusable (steep fncline on the side. woods
in the front) and the back yard is too small and hilly.
6) No storage in garage.

We decided if we were to stay in the house. we had the same complaints. If
we ever expected to get a reasonable return on our investment. we would have
to correct its shortcomings. We went to an architect at Lyman Lumber. and
asked him to come out and see the property and draw up plans which would cor-
rect the defects. He drew up the p1 ans understandi ng the .1 imitati ons of the
lot (steep. hilly inclines which wash out during heavy rains).
During the past two years. we have been dealing with builders and rising
interest rates, trying to pick a time to start when costs would not be pro-
hibitive. We have selected the builder and the bank has agreed to the loan
at a rate which we could afford.
When we came to the City for a building permit we found that in order to make
the improvements required in order for our property to be worth what it is
currently being appraised, we must obtain a variance to extend beyond the
set back restrictions.
You will note from the drawing the existing house is 50+ feet from the lot
line on the North and West sides (although the pool and fence erected by the
previous owner is less than 10 feet on the West). The existing house is
approximately 33 feet from the East lot line.
For our proposed remodeling, we are requesting a 30.5-35 feet set back on the
West and an additional ten to fourteen feet on the East.
The neighbors adjacent to our property on the East and the South have agreed
with our plans as they will enhance the property and their view of it.
We request that you grant this variance to allow us to make our home not only
more livable for ourselves, but also to allow us a reasonable return on our
investment should we be required to sell in the future.

CALL TO ORDER
The regular meeting of the Shorewood City Council was called
to order by Mayor Rascop at 7:30 P~i, Monday, April 11, 1983,
in the Council Chambers.
PLEDGE OF ALLEGIANCE AND PRAYER
The meeting opened with the Pledge of Allegiance and a prayer.
ROLL CALL
Present: Mayor Rascop, Councilmembers Haugen, Shaw,
Leonardo, and Stover.

APPROVAL OF MINUTES
Haugen moved, seconded by Shaw, to approve the minutes as
amended for the Council meeting of March 28, 1983. Motion
carried unanimously.
MATTERS FROM THE FLOOR
Clean-up Day
Residents asked the Council about when the City "Clean-up
Day" will be and what is necessary to do in order to obtain
a burning permit. Council will be deciding the time and
fee schedule later. They explained some of the necessary
steps for burning permit requests.
Complaint of Non-notification of Hearing
Mr. and Mrs. Mike Marr were present to voice a complaint in
reference to receiving incorrect information as to the date
that the Council would be making their decision on the
Conditional Use Permit to allow the building of an office
building at the Southwest corner of Chaska Road and State
Highway #7. They were opposed to this construction and
the removal of the nature buffer to Highway #7.
Council apologized for the incorrect information they
received from staff. Marr's requested to see all the
plans for building, when they are submitted. Council
will instruct the Building Inspector to notify Marr's
when all the plans are received.

MATTERS FROM THE FLOOR continued
Timber Lane Lake Access
Steve Haskins from Timber Lane was present to thank the
Council for it's efforts in writing a letter to the
Governor's Task Force opposing the possible installation
of a lake access on Timber Lane.
PLANNING COMMISSION REPORT
Shaw indicated that the matters the Planning Commission
dealt with will be reviewed tonight with various other
agenda items. He also recommended that a representative
from the Planning Commission should be in attendance at
the Council meetings in the future.
ADMINISTRATIVE REPORT
Insurance Group
Administrator Uhrhammer requested insurance coverage with
the County Group Health Policy. One of the insurance
companies involved did not want to accept the City at this
time. Another review will be made in October. He felt
we should also research the possibility of joining the
League of Minnesota Cities Insurance Group.
"Clean-up Day"
1ge3 Budget did not contain enough money to subsidize
tota I.ly a spring clean-up. Administrator Uhrhammer
will review and submit user-fee rates at the next meeting.
PUBLIC HEARING - 8:00 PM
RESOLUTION NO. 27-83

The new State-aid formula will reduce Shorewood funding
approximately $26,000.00 from last years amount if accepted
at the current formula proposed.

RESOLUTION NO. 28-83
Minnetonka State Bank-Sign Variance Request
BobM~ Dougall from the Minnetonka State Bank was present to
request a square footage variance to allow them to install
3 signs containing one 81.5 square feet and two 18 square
feet. City ordinance allows one sign of 150 square feet
and two additional signs of 10 square feet. Mr. Mc Dougall
is requesting to be allowed two 8 foot variances for the
signs to be installed on the building.
Public comment portion was closed at 8:28 PM after receiving
comment from Bob Reutiman in approval of this request.
Shaw moved, seconded by Stover,to approve the variance as
requested. Motion carried 4 aye - 1 nay (Leonardo)

PRELIMINARY PLAT REVIEW
RESOLUTION NO. 29-83
Oak Ridge Estates-3rd Addition
Joe Gorecki submitted the proposal for Oak Ridge Estates
3rd Addition containing 8 new lots. He submitted some
new changes as recommended and he feels they now have
complied with all requirements.
Engineer Norton reviewed various points that need to be
clarified.
1.) Legal change of road names within the sub division.
2.) The need for additional soil borings. Mr Gorecki
disagreed on the need, but the property owner,
Mr. Noble, agreed to have further borings done as
requested.
Council questioned the water system issue. Central well
versus individual well; Easements granted for utilities or
lines installed now for future use . Engine_er Norton estimated
the cost of a Central well and lines a~ approximately $35,000.00,
which would be the same as individual well. Developer disagreed
with the central well because of the up front cost to him.
Council discussed "Water Policy". Attorney Larson determined
that there is no current policy in effect.

Oak Ridge Estates 3rd addition-Preliminary Plat Review continued
Haugen moved, seconded by Leonardo, approval of the preliminary
plat with the following conditions:
1. Additional soil borings to be done to Engineer's
satisfaction.
2. Storm sewer and drainage constructed according to
City Engineer's specifications.
3. Streets and sanitary sewer system to City Speci-
fications.
4. Development agreement to be drawn up by City
Attorney and signed.
Motion carried unanimously by Roll Call vote. 5 ayes.
l'-lr. Noble thanked the Council and Staff for their cooperation
with his development.

REVIEW OF AMENDMENT TO ZONING ORDINANCE
Mortenson Property - 19545 & 19585 State Highway #7
Council reviewed the request to rezone this property from an
R-l, Residential Zone, to a C-l, Commercial Zone. Mr. Hubbard,
developer, presented plans for a "Self-Storage facility" for
that location. This facility would have an on-site manager
with a security system. Most of the storage buildings would
be 11 feet in height with 2 buildings at 20 feet in height.
Council had concerns about C-l zoning being the correct zone
for that area, and whether it was the best use of the property.
Haugen moved, seconded by Rascop, to refer this issue back to
the Planner and Administrator for further review of the
appropriate zoning for this area. Motion denied, 2 ayes,
3 nays (Shaw, Leonardo and Stover)
MOVING OF BUILDINGS
ORDINANCE NO. 143
The Council reviewed the 3rd reading of the proposed "Moving
of Buildings" Ordinance. A few alterations were made in wording.
Haugen moved, seconded by Leonardo, to adopt the proposed
Ordinance as amended. Ordinance was adopted by roll call vote.

the purpose of reviewing and setting Water policy and
consideration of any other needed policies.
This meeting will be held on May 4th at 6:00 PM at City Hall.

Mr. Theodore Deikel has submitted a final plat for the Bay Park Addition.
As you recall the preliminary plat involved a lot width variance, allowing
a 50 foot strip along the northerly side of the property to serve as access
to the northernmost parcel which contains an existing house. City approval
of the variance and preliminary plat was contingent upon five specific
conditions (see Council minutes dated August 9, 1982).
The final plat is consistent with the approved preliminary plat. It should
be noted that Lot 2 is just over 150 feet wide along the lake. Drainage
and utility easements along property lines have been provided as per City
requirements. However the City Engineer has noted that the easements for
existing utilities have not been shown. These should be included on the
final plat.
Three of the Council's requirements relate to future division of the large
southerly parcel. These items should be addressed in a development agree-
ment between the City and develooer. The City Attorney is currently pre-
paring said d~velopment agreement.
While it is assumed that Outlot A will be owned by the owner of Lot 2,
this should be specified in the development agreement. The agreement
should also clearly specify that future owners should be aware that Outlot
A is intended for future use as a public street.

Attached is a request from Mr. and Mrs. Donald Wambold to expand their exist-
ing house at 28015 Woodside Road (see Exhibit A, attached). The house is cur-
rently nonconforming due to inadequate setback on the east side (see Exhibit B,
attached). Since Section 10 of the existing Zoning Ordinance specifically pro-
hibits the expansion of nonconforming structures, the Wambolds have requested a
variance. Their request is expressed in detail in the attached letter, dated
11 April, from them to the Council and Planning Commission (see attachments
D-1, D-2 and D-3).
Their problem stems from a number of factors. First, their lot contains only
21,000 square feet in an R-1 District, which requires 40,000 square feet.
Secondly, they have a corner lot which requires larger side yard setbacks

Attached are the drawings for the proposed addition for our home at
28015 Woodside Road.
We purchased the home in May of 1977 when we moved from Florida. We had
no indication at the time of purchase that the lot was considered sub standard,
nor that existing structure(s) were in violation of local set-back laws.
The planned addition is for the purpose of making our home more useable for
ourselves as well as making it saleable in the future.
You will note the date of the plan is 1981. My husband was transferred to
Indiana in 1979. We put our home up for sale in August of 1979 for $125,000.
The real estate market was a sellers market at that time and we were assured
by our brokers the house should sell quite rapidly for that figure. We had
our home on the market for 12 months until August of 1980, when we finally
gave up trying. We had lowered the price several times after buying a home
in Indianapolis. We sold the home in Indianapolis two months after putting
it on the market. My husband quit the company he was working for there and
returned to Minneapolis.
We again tried to sell the house in 1981 as we wanted to move on the lake and
needed larger bedrooms and kitchen. This time the house was on the market
six months before we again gave up.
Both times the house was on the market, we had excellent showings. During
the first month each time we averaged over 5 showings a week.
During discussions with the brokers, they advised us of the reasons people
were not interested in the house.
1) Bedrooms were too small (we can't have a dresser in the bedroom
because of the size).
2) Kitchen was too small and dark (there are only 3 recessed lights in
the kitchen and one small window).
3) No eating area in the kitchen (there's not even room for a chair).
4) No front entrance to the house.
5) The side and front yards are unusable (steep incline on the side, woods
in the front) and the back yard is too small and hilly.
6) No storage in garage.

We decided if we were to stay in the house, we had the same complaints. If
we ever expected to get a reasonable return on our investment, we would have
to correct its shortcomi ngs. We went to .an architect at Lyman Lumber, and
asked him to come out and see the property and draw up plans which would cor-
rect the defects. He drew up the plans understanding the limitations of the
lot (steep, hilly inclines which wash out during heavy rai~s).
During the past two years, we have been dealing with builders and rlslng
interest rates, trying to pick a time to start when costs would not be pro-
hibitive. We have selected the builder and the bank has agreed to the loan
at a rate which we could afford.
When we came to the City for a building permit we found that in order to make
the improvements required in order for our property to be worth what it is
currently being appraised, we must obtain a variance to extend beyond the
set back restrictions.
You will note from the drawing the existing house is 50+ feet from the lot
line on the North and West sides (although the pool and fence erected by the
previous owner is less than 10 feet on the West). The existing house is
approximately 33 feet from the East lot line.
For our proposed remodeling, we are requesting a 30.5-35 feet set back on the
West and an additional ten to fourteen feet on the East.
The neighbors adjacent to our property on the East and the South have agreed
with our plans as they will enhance the property and their view of it.
We request that you grant this variance to allow us to make our home not only
more livable for ourselves, but also to allow us a reasonable return on our
investment should we be required to sell in the future.

marketing the subject property with our company. One
listing period was 12 months and the second for 6 months.
Extensive efferts were maae to sell the property with no
offers being tendered.
The primary reason in our experience in showing the prop-
erty and also receiving comments from other Multiple List-
ing companies showing the property are the following.
Inadequate size of bedrooms
No true front entry
inadequate kitchen size
No space for entertaining guests
Our opinion is that the subject property could be made
marketable with an expansion of the existing home to
correct tbe~existing functional ob1so1esencez.
