SHOREWOOD, MN 7:30 PM M I NUT E S CALL TO ORDER: The regular meeting of the Shorewood City Council was called to order by Mayor Rascop at 7:30 PM, Monday, August 8, 1983, in the Council Chambers. PLEDGE OF ALLEGIANCE AND PRAYER: The meeting opened with the Pledge of Allegiance and a prayer. ROLL CALL: Present: Mayor Rascop, Councilmembers Haugen, Shaw, Stover and Gagne. Staff: Attorney Larson, Engineer Mittelsteadt, and Clerk Kennelly APPROVAL OF MINUTES: Gagne moved, seconded by Haugen, to approve the minutes of July 25, 1983, as corrected in the official minute book. Motion carried unanimously. CITIZEN'S FORUM: Mr. and Mrs Roger Lindholm of 22020 Vine Street were present to question why they would have to go through a variance request to add to their existing home. Haugen reviewed the Ordinance in reference to changes to nonconforming structure and confirmed the Building Inspector's reason for requiring the variance procedure. GYPSY MOTH PRESENTATION: Meg Hanish from the Department of Agriculture addressed the Council with a slide presentation and an explanation of what can happen if the Gypsy Moth infects an area. Council thanked her for her time. 8:00 PUBLIC HEARING: Variance Request Sid Verdorn-2e210 Woodside Road RESOLUTION NO. 55-83 Mr. Verdorn was present to request the right to add a deck and garage to an existing nonconforming structure. This addition would not add to the nonconformity. Public portion of the hearing was closed at 8:10 PM. Haugen moved, seconded by Gagne, to approve by Resolution the variance as requested. Motion carried unanimously by roll call. ;tf\ . .REGULAR COUNCIL MEETING MONDAY, AUGUST 8, 1983 page two HAROLD JOHNSON REZONING AND REQUEST FOR SIMPLE SUBDIVISION~ 6055 Lake Linden Drive Mr. Johnson was present to request a simple subdivision of his property into 2 lots with a change in the road right-of-way dedication to the City. Stover requested the Council to reconsider their original vote on the rezoning of this property to R-3, seconded by Shaw. Motion carried unanimously. ~ Stover moved, seconded by Haugen to rezone the R-2 to R- 3.' RESOLUTION NO. 56-83 Stover motioned to approve the simple subdivision into 2 lots to include the 8,000 square foot road right-of-way dedication per the new configuration subject to the Engineer's approval. Seconded by Gagne. Motion approved by roll call vote. 5 ayes. Stover motioned, seconded by Shaw, to direct the staff to prepare an Amendment to Ordinance #77 rezoning the entire Johnson property from R-2 to R-4. Motion carried unanimously by roll call vote. CONDITIONAL USE PERMIT - TEX-SOTA MINI-STORAGE: Bruce Hubbard-19545 State Highway #7 Mr. Hubbard was present to request a Conditional Use Permit and 2 variances for this self-storage facility to be located at 19545 State Highway #7. The variances are for setbacks to residential districts to allow him to set the buildings back from the front line and preserve some existing trees. Council discussed changes in original building, proposed drainage, fencing and landscaping. Council break 9:05 Reconvened 9:15 RESOLUTION NO. 57-83 Haugen moved, seconded by Stover, to direct the Attorney to draw a Resolution approving the Conditional Use Permit and the 2 variances as requested. Motion carried unanimously by roll call vote. ATTORNEY'S REPORT: Austin Drainage Attorney Larson informed the Council that the City was not named in the Torrens Title of 1965 on the Dan Austin property at 4860 Rustic Way. Shaw requested the Attorney to check on any possible changes filed since that date. Haugen moved, seconded by Stover, to approve the second reading and adoption of the Ordinance. Adoption approved by roll call vote - 5 ayes. Ordinance Amendment - Swimming Pool setbacks ORDINANCE NO. 148 Council reviewed the second reading of the Ordinance to allow swimming pools and tennis courts a rear setback up to 60% of the zoning required for setback. Haugen moved to approve the second reading and adopt the Ordinance as written, Gagne seconded for discussion. Haugen motioned to delete "tennis courts" and "or tennis courts", seconded by Gagne, to approve the second reading and adopt this Ordinance. Adoption approved by roll call vote - 5 ayes. PLANNING COMMISSION REPORT: Shaw reported the Commission voted not to have the second meeting in August and to remind the Council that the second meeting is for the purpose of review only. The Commission reviewed the Hubbard and Verdorn requests. PARK COMMISSION REPORT: Marty Jakel asked for volunteers for the Festival of Parks dunk tank. Request from Commission was made to allow a temporary sign to advertise the Festival of Parks. Council approved unanimously. Request was made for the temporary sale of on-sale beer in the parks by the City for the Festival of Parks-August 13th and 14th only. Council approved unanimously. . ~LAR COUNCIL MEETING ~AY, AUGUST 8, 1983 page four ATTORNEY'S REPORT: Naegele Sign Issue Attorney Larson reviewed the status of the Naegele Sign Litigation and requested the Council for direction. Haugen moved, seconded by Shaw, to proceed with the legal suit to remove the sign at Christmas Lake Road and State Highway 7. Motion carried unanimously. ENGINEER'S REPORT: Engineer Mittelsteadt reviewed the cost of the installation of the water line requested by Mr. Shaddrick of 23625 Smithtown Road to be paid for by CDBG fund. The cost will exceed the amount allocated by the City in that CDBG fund. Clerk Kennelly was in contact with Mr. Blackstead, he said the Council can reallocate funds from other areas to cover this project if they want to pursue this water service. Council directed staff to find the available funds. ADMINISTRATIVE REPORT: RESOLUTION NO. 58-83 A Resolution was submitted to adopt the Section 8 Income limits to adjust the gross annual income limits for CDBG funds for Public Facilities Assessment grants. Haugen moved, seconded by Shaw, to approve this Resolution as drawn. Motion carried unanimously by roll call vote. RESOLUTION NO. 59-83 A Resolution was submitted to adopt the Section 8 Income limit to adjust the gross annual income limits for CDBG funds for Utilities connection grants. Stover moved, seconded by Gagne, to approve this Resolution as drawn. Motion carried unanimously by roll call vote. MAYOR'S REPORT: Comprehensive Plan is finally being reviewed by the Metro Council. Grays BaiK~~ been closed for two weeks for clean up of the Creek. COUNCIL REPORTS: Cable meeting at City Hall on August 9, 1983. Complaint-A letter was received with a complaint along the Chanhassen boundary of a dusty road (Teton) because of commercial use on the Chanhassen side, also requesting the repair of a culvert hit by a vehicle. Staff will follow up and report back to Council. SHOREWOOD MEMO: DATE: 19 August 83 TO: City Council FROM: Brad Nielsen Ryan Construction has submitted plans to remodel the space formerly occupied by Jason's Clothing Store in the Shorewood Village Center to accommodate a Champion Auto Parts Store. Based upon past policy of having the City Council review all commercial building permits, the plans will be presented at the Council meeting Monday evening. (612) 474-3236 MEMORANDUM TO: CITY COUNCIL FROM: BRAD NIELSEN DATE: 19 AUGUST 1983 RE: BROWN, ROBERT E. - REAR YARD SETBACK VARIANCE FILE NO.: 405 (83.31) BACKGROUND At the City Council meeting on 15 June 1982 Mr. Robert E. Brown received approval of a 25 foot variance to the rear yard setback requirement in the R-1 zoning district (see Exhibit A, attached). Since the Zoning Ordinance states that variances are only good for one year from the date of approval, Mr. Brown's variance has expired. Consequently, he must go back through the variance procedure. The property in question is located at approximately 20680 Garden Road (see Exhibit B, attached). As can be seen on Exhibit C, the property is taken up by a designated wetland. According to the applicant, the wetland was filled at the time sanitary sewer was constructed in the area. Based upon his soil survey of the property, the only buildable portion of the lot lies in the northeast corner. In order to build in that corner, he needs a 25 foot variance to the 50 foot setback requirement (see Exhibit D). ANALYSIS/RECOMMENDATION The applicant has proposed to build into the hill at the rear of his prop- erty so as to avoid poor soils covering much of the lot. To deny the var- iance would require that applicant place the structure on soils of extremely questionable bearing capacity. To remedy the situation would be extremely difficult and probably cost prohibitive. The variance is seen as a means of allowing the applicant to make reasonable use of his property - construction of a single family dwelling. . A Residential Community on Lake Minnetonka's South Shore sa ~ . . City Council 19 August 1983 Page Two Even though the wetland area has been filled, it still remains a designated wetland on the Shorewood Wetland map. This presents a problem in that the Wetlands Ordinance contains no provision for amending the map. Since the applicant's plan requires his driveway to be located over the wetland area, the request must also include a variance to the Wetland Ordinance. In this regard the City should consider an amendment procedure for the Wetlands Or- dinance at some time in the future. Note: Since this request was previously approved by the Council and since the Planning Commission chose not to have a second meeting in Au- gust, the request has not been referred to the Planning Commission. Council informed him that the cost was too high at this time and the money was net available in the budget to proceed with this project. Swimming Pool Request Mike McHugh, 5240 Shady Lane, submitted an application to install a swimming pool at 5240 Shady Lane with no variance necessary. Shaw moved, seconded by Haugen, to approve the application as submitted. Motion carried unanimously. PUBLIC HEARING - Larry Wilson RESOLUTION NO. 52-82 (Building Height Variance Request) Public Hearing was opened at 8:06 P.M. to consider the request of Larry Wilson, 27965 Woodside Road, to construct an assessory building in excess of the minimum height requirement of 15'. No oral or written comments were received from the public. Public Hearing was closed at 8:10 P.M. Shaw's concerns were that the variance request should be due to a "hardship". He did not feel that this was true in this case. Haugen, moved, seconded by Gagne, to approve the height variance not to exceed 20' in height. Motion carried - 4 ayes, 1 nay (Shaw). VARIANCE REQUEST - REAR LeT LINE Mr. Robert E. Brown - Part of Lot 5 - Holtmere Addition, request~d a variance in the rear lot line set back for the construction of his home, 25' from the rear lot line. This property was heavily filled and would be very difficult to build on if he had to comply witt the standard set back. Moved by Rascop, seconded by Gagne, to approve the set back variance request as submitted. Motion carried unanimously. CIVIL DEFENSE ORDINANCE - Second Reading ORDINANCE #129 The second reading of the Minnesota Civil Defense Ordinance, as it pertains to the City of Shorewood, was preseLted. Haugen moved, seconded by Leonardo, to adopt this Ordinance as #129 of the City of Shorewood. Motion carried unanimously. Shaw moved, seconded by Gagne, to approve the appointment of Chief Earl Johnson as the Civil Defense Director, subject to his acceptance. Motion carried unanimously. Administrator Uhrhammer informed the Council that Detective Craig Anderson was in charge of preparing the Civil Defense Plan and ques- ( tioned who should be appointed Director. RESOLUTION NO. \ WHEREAS, Tex-sota Construction has applied for a Conditional Use Permit for the construction of mini-storage facilities on property described as: WHEREAS, the property is zoned C-1, which provides for conditional use permits for self-storage facilities; and WHEREAS, applicant has requested a variance to the fifty-foot setback adjoining residential district; and WHEREAS, the City Planning Commission and the City Planner have recommended approval of the Conditional Use Permit and Variance; and WHEREAS, the City Council, o~~he motion of ~Ja~ ________________, and seconded by _ ~A~~ , moved to direct the City Attorney to draw a resolution setting forth findings and conclusions and granting applicant's request for the Conditional Use Permit and Variance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood that finds the following facts: 1. That the subject property is zoned C-1. 2. That the request of the applicant meets all requirements of the City ordinances, with the exception of the setback on the east and south boundaries of the property. ~ 3. That the proposal as made by the applicant ~ a forty-foot setback on the eaBt property line and a thirty-five foot setback on the south property line and that applicant could meet the setbacks by moving the project closer to the north and west ~ property lines. However, moving the project in that direction would destroy a significant number of mature trees and screening for the project. CONCLUSIONS That based on the foregoing the City Council of the City of Shorewood concludes: ... ~qG\ . . ... That the application of Tex-Sota for a Conditional Use Permit and Variance as set out hereinabove be and hereby is granted, subject to the following conditions: 1. That the property is screened and landscaped in accordance with the landscape plan approved by the City Council and attached as an exhibit. 2. That the entire facility is enclosed by means of a peripheral building except that along the east side of the property a seven-foot chain-link fence will be constructed. 3. That access to the facility shall be by security gate. 4. That the hours of operation shall be limited to 7 a.m. to 10 p.m., Sunday through Thursday; 7 a.m. to 12 midnight, Friday and Saturday. 5. That any lighting on the premises shall be hooded and so directed so that it is not visible from the public right-of-way and any abutting residential district. 6. That the structure shall conform to the height restriction of the C-1 district and additionally, all structures within fifty feet of any property line shall be limited to one story or fifteen feet, whichever is less. 7. That all storage shall~onfinJto enclosed permanent structures. 8. storage only. allowed. That the use of the structure shall be limited to No retail service business or workshop shall be 9. That the facility shall have one residential dwelling unit to be used by a resident caretaker or manager. 10. That the entire area, other than occupied by buildings and plantings, shall be surfaced with material which will control dust and drainage and is subject to the approval of the City Engineer. 11. That the facility shall provide off-street parking spaces for no less than six cars. No on-street parking shall be allowed by the facility. 12. Ed Bergslien 24785 Smithtown Road I would recommend that the committee be comprised of a minimum of three members and a maximum of six members. The appointed members would be regular voting members. I also recommend that one Council member serve as a liaison to the committee, with the right to vote in issues only when there is a tie vote of the appointed members. The issues that the committee will be addressing are very complicated, and each member will need much education on governmental accounting, fund management, and Shorewood's current financial situation. The educational process will probably take the rest of this year.
