Mayor Zerby noted that because this meeting is being held virtually there will be no Matters from
the Floor, but encouraged resident to reach out to the Councilmembers if they had any issues
that they would like to see brought up at the next Council meeting.

Report on the March 10, 2020 Park Commission Meeting
A.
Planning Director Darling gave an overview of the action that took place at the March 10, 2020
Park Commission meeting as reflected in those minutes. She noted that the Park Commission
selected Back to the Future for the Movie in the Park on August 28, 2020.

8. ENGINEERING/PUBLIC WORKS
A. Authorization to Prepare Feasibility Report and Preliminary Design for
Shorewood Oaks Drainage, City Project 20-04
City Engineer Budde explained that a drain tile system was installed in 1987 below the streets of
the Shorewood Oaks development. He noted that they believe the drain tile was intended to
serve sump pumps from residential homes. He stated that over the years there have been several
instances where sump pumps have been unable to discharge enough water into the drain tile. He
stated that this area of the City was included in the draft Western Shorewood Drainage Study.
He stated that the recommendation is to disconnect the sump pump lines and install a catch basin
in the boulevard. He stated that staff is asking for authorization to prepare the feasibility report
and preliminary design for this project and noted that this had already been included in the CIP.
He gave a brief overview of how they intend to survey and gather information from each home to
ensure they do not forget anything.

Councilmember Johnson stated that some of the neighbors in Shorewood Oaks have taken it
upon themselves to video their lines to confirm that they were connected to the system. He asked
if that would be taken into consider as part of this or after the feasibility study.
City Engineer Budde stated that information would be explored as part of the questionnaire they
are sending out to residents. He stated that if the residents can share that information, the City
may not have to repeat the work.

9. GENERAL/NEW BUSINESS
A. Emergency Proclamation
City Administrator Lerud explained that on March 17, 2020, Mayor Zerby signed an Emergency
Declaration in response to the COVID-19 outbreak. He explained that adopting this resolution
will formalize the measures outlined in the emergency declaration. He stated that Planning
Commission meetings will only be held if needed, but noted that there may be a need for a
meeting in late April or early May in order to comply with the 60-day rule for an application. He
noted that Park Commission meetings have been cancelled until further notice. He stated that all
City buildings have been closed to the public. He gave an overview of the two items that were
added after the original version was distributed in the packet. He stated that the first addition is
that there will be no fees or charges assessed for late payments until December 31, 2020. He
explained that the second addition to the proclamation is that the City will not issue any solicitor,
transient merchant, peddler permits, effectively immediately, and will last until the cessation of the
emergency.

1. December 2019 General Fund Budget Report
Finance Director Rigdon gave a brief overview of the December 2019 General Fund Budget
Report and noted that although it was not finalized, it had been audited, so he does not expect it
to change much. He stated that there will be a formal presentation by the auditors on April 27,
2020.

Public Works Director Brown stated Public Works still has a full staff and work is continuing to
work, at this point. He stated that he met with Emergency Manager, Mike Meehan, the Fire Chief
as well as Public Works Superintendents for Tonka Bay and Excelsior. He stated that they
discussed assisting each other if any of the cities became short staffed as a result of the COVID-
19 outbreak. He noted that they are trying to minimize home visits, but other services should be
relatively uninterrupted or changed. He asked that the Council pass along any information or
concern from residents that they may hear about.
Planning Director Darling gave an overview on the procedures that have been put into place for
collecting planning and building permit applications as well as inspections. She explained that
they do have to carry on doing the majority of their work even if City Hall is closed. She stated
that there is an application drop box that has been placed just outside the door that will be
collected a few times per day. She stated that new home inspections will be proceeding as usual,
however, the inspectors need to be unaccompanied during their inspections. She noted that there
are some inspections that will be able to be handled via video conferencing rather than in person.
City Administrator Lerud stated that the information shared by Public Works Director Brown and
Planning Director Darling are also available on the City website along with additional information
pertinent the COVID-19/Coronavirus. He stated that the City Hall building is staffed during normal
working hours, but the doors will be locked and it is not open to the public.

Councilmember Labadie reiterated Mayor Zerby’s recommendation for residents to contact the
Councilmembers with any concerns or issues that they would like the Council discuss, since there
will not be any Matters from the Floor right now. She assured residents that the Council will do
its best to address their concerns.
Mayor Zerby read aloud the following statement:
The City remains committed to maintaining vital and essential services for our residents. We are
also committed to maximizing communication and up to date information to residents on matters
pertaining to public safety, health facilities and availability of services. All forms of communication
will be used to get these messages across. Even though City Hall is closed, it is important to
know that City staff are working on location and remotely and are available by e-mail or phone.
Our City Hall hours are normally Monday through Friday 8:00 a.m. to 4:00 p.m. and our main
phone number is 952- 960-7900. Messages can be forwarded to the appropriate department.
Any service request from the public can be made using SeeClickFix, either by mobile application
or web application. This system is monitored Monday through Friday during regular business
hours. The Shorewood Community and Event Center is closed and believes they are no longer
accepting reservations. Planning and Zoning Counter is currently closed for in person
consultation but the public can communication with staff via e-mail or phone. The City can accept
materials electronically as well as paper submittals via the drop box or mail. You can visit the
City website for the e-mail addresses. Police, Fire and public departments are working to keep
their staff safe while continuing to provide essential services. New policies are being created to
prepared for staff shortages if needed and communication with surrounding cities is happening to
balance the needs of ourselves and our sister cities. With warm weather rapidly approaching it
will be increasingly important to keep social distancing in affect for all ages. While the very young
are less vulnerable, they are able to spread the virus to those who may be at risk. Our parks and
trails remain open for casual use. Please continue to follow all CDC and State recommendations
of helping prevent the spread of COVID-19 and stay alert for changing information on our City
services. Stay safe and remember to reach out to friends, family, and neighbors using phone
calls, video conferencing, and social media as much as possible.

For many months the Council and city staff have been discussing the capital
improvement plan (CIP) for infrastructure. The council has identified the use of the street
reconstruction bond authority as the preferred method of financing street reconstruction
improvements. The biggest advantage of using this method of financing is special assessments
for individual properties are not necessary.
The requested action tonight is to call for the public hearing at the May 11 City Council meeting.
Shannon Sweeny from David Drown Associates will be present at the public hearing to explain
how the street reconstruction improvement bonding process works, the limitations of the
program and how the program fits with the city’s infrastructure CIP.

RESOLUTION CALLING A PUBLIC HEARING ON THE PROPOSAL TO ADOPT A
STREET RECONSTRUCTION PLAN AND THE INTENT TO ISSUE GENERAL
OBLIGATION STREET RECONSTRUCTION BONDS
WHEREAS, the City of Shorewood, Minnesota (the "City"), proposes that it is the best
interest of the City to issue and sell its general obligation street reconstruction bonds (the
“Bonds”) pursuant to Minnesota Statutes, Section 475.58, subdivision 3b, as amended (the
"Act"), to finance the cost of street reconstruction projects, as described in the proposed street
reconstruction plan described below, a copy of which will be on file in the City Administrator's
office by the time notice of the required public hearing is published; and
WHEREAS, pursuant to the Act, the City is authorized to issue and sell its Bonds to
finance street reconstruction projects following adoption of a street reconstruction plan after a
public hearing on the street reconstruction plan and on the issuance of the Bonds, subject to
certain limitations as provided in the Act; and
WHEREAS, pursuant to the Act, the City has undertaken to prepare a street
reconstruction plan covering the years 2020 through 2024, which describes the streets to be
reconstructed, the estimated costs and any planned reconstruction of other streets in the City,
including the issuance of Bonds under the Act (the "Plan"), to determine the funding strategy for
street reconstruction projects.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood,
Minnesota, as follows:
1.Public Hearing. The Council hereby determines to call for and to hold a public
hearing on the Plan and the issuance of Bonds thereunder at a meeting of the Council to be held
on May 11, 2020, commencing at approximately 7:00 p.m.

Shorewood, Minnesota, for the purpose of conducting a public hearing on (a) the proposal to
adopt a street reconstruction plan covering the years 2020-2024 and (b) the intent to issue
general obligation street reconstruction bonds in an amount not to exceed $18,230,681 to finance
the street reconstruction improvements described in the street reconstruction plan.
A draft copy of the street reconstruction plan is on file with the City Administrator and is
available for public inspection on the City’s web site.
If a petition requesting a vote on the issuance of the general obligation street
reconstruction bonds is signed by voters equal to five percent of the votes cast in the last
municipal general election and is filed with the City Clerk within 30 days of May 11, 2020, the
City may issue the general obligation street reconstruction bonds only after obtaining the
approval of a majority of the voters voting on the question of the issuance of the general
obligation street reconstruction bonds.

Background:
Attached is the Shorewood Yacht Club’s annual multiple dock facility
license application. City Code section 1201.24, Subd. 10 states that renewal of the
license shall be granted provided the license terms and the terms of any conditional
use permits are complied with; in this case for the caretaker’s home and the outdoor
storage of boats. As indicated on the application, the owner agrees to arrange for the
necessary inspection to ensure that the number of slips and the length of certain boats
would conform to the original license. The inspection would be conducted when the
slips are occupied in the summer.
This license is for the current configuration of the docks. The applicant has stated
they are interested in reconfiguring the docks, but not for this year. Any changes to
the docks would require LMCD approval and must be reflected in their future license
requests.
Financial or Budget Considerations:
The fee for the license covers the cost of
processing the application and conducting the inspection.
Recommendation / Action Requested:
Staff recommend approval of the Multiple
Dock Facility License application for the Shorewood Yacht Club for the year 2020,
subject to the required inspection.

effective Tuesday, April 1, 2020.
Katriona began her employment with Shorewood on November 13, 2019 as a Planning
Technician with Shorewood’s Planning Department. Katriona was a great addition to
the team at Shorewood and will be missed. In a formal resignation letter, Katriona
explained she enjoyed getting to know the staff and working with the community. She
will be pursuing other opportunities. We wish Katriona the best in her future endeavors.

The city has a need for citizens to serve on advisory committees to the city
council. Pursuant to Shorewood City Code Chapter 202, the Shorewood Park Commission was
established and is advisory to the City Council. The Commission consists of five members who
must be current residents of Shorewood. Terms of appointment commence on March 1 and
terminate on the last day of February and run for three years. The purpose of the Park
Commission shall be to aid the City Council in the expenditure of monies so that the greatest
benefit may be obtained from the use and maintenance of the city parks.
Ed Rock was appointed to the Park Commission in 2016 with a term ending in February of
2017. He was reappointed to the Park Commission for an additional three-year term running
from 2017 through February of 2020. Ed made the decision to not apply for an additional term
to spend more time with his family.
Ed served most recently as the Vice-Chair of the Park Commission and was instrumental in so
much of the work done on the Commission. Ed contributed significantly to the most recent
playground rehabilitation efforts undertaken by the commission. He was especially helpful in
providing important information during site plan reviews. In addition, Ed and his family helped to
paint the hockey boards at Cathcart Park this past year and actively volunteered at Arctic Fever
events. Staff and Council are very grateful for his years of service.
A Crystal Engraved Service Award recognizing Ed Rock’s contributions on the Shorewood Park
Commission will be directly shipped to his residence.
The Shorewood City Council recognizes and expresses appreciation to Ed Rock for his
service on the Shorewood Park Commission and his dedication to the community.

Background:
At the August 26 council meeting, the Council authorized advertising for the
open position of LEO - Utilities in Public Works. The position was advertised. The first round of
the application period did not provide an acceptable candidate. Due to the holiday season, the
decision was made to not reopen the application period until after the first of the year. A second
advertising was done and those selected to proceed in the process were brought in to complete
a “hands-on” exercise to gauge their skill in equipment operation, and then they completed an
interview with Public Works Director Brown, Lead PW Supervisor Baumann, two members of
the public works department and City Administrator Lerud. A finalist was selected from that
process and he completed a background check conducted by the South Lake Minnetonka
Police Department, a pre-employment health exam and drug test, and a suitability test.The
results of those checks were acceptable to city staff.
Recommendation / Action Requested:
Staff recommends approving the following LEO - Utilities
job offer to Luke Weber:
1. Starting salary of $30.25 per hour.
2. Six-month probationary appointment with performance review at the end of six months.
3. All other benefits governed by the union contract and/or city personnel policy.
Next Steps:
If the Council approves hiring Mr. Weber, we will let the candidate know. He
indicated that he would need to give his present employer 14 days-notice.

Background:
The City has been trying to gain rental code compliance from the owner of
5440 Wedgewood Drive since April 2019. Here is a summary of the situation:
April 2019 – received complaint that home was being rented without a licenses and
home had maintenance problems, including mold in the basement and water issue.
May 1, 2019 – notified owner they were in violation of the city’s code. The property is
owned by an out-of-state corporation. No response received, so citation was issued on
May 24, 2019.
June 21, 2019 – the property owners submitted an incomplete rental license.

There was no activity on the application, so on September 11, 2019, a 2 citation was
issued with notice of nonpayment of the first citation and accrued penalties. Owner
made payment on Oct. 7, 2019.
Nov. 8, 2019 – A third citation was sent.
Dec. 16, 2019 – A fourth citation was sent
Feb. 4, 2020 – Property owners submitted a furnace report that indicate furnace was not
functioning properly and provided a water test from a non-certified laboratory.
Feb. 12, 2020 – A fifth citation sent to property owners.
In March 2020, staff was informed that work was being done on the property without
permits. The building official confirmed. The city subsequently received a permit
application for a furnace installation and a plumbing permit for water treatment.
The city became aware that the property is for sale. In order to secure payment of the city’s
expenses to date, an assessment hearing has been called for to approve a special assessment
against the property.
Financial or Budget Considerations:
The city has incurred the following expenses related
to enforcement of the city’s residential rental code for the property at 5440 Wedgewood Drive:
Unpaid fees due on March 4 : $4,500.00
Late fees: : $ 750.00
Staff time and expense : $ 783.90
Cost of notice : $ 117.66
TOTAL $6,151.56

, the Inspec Inc. has prepared Plans and Specifications for the,
Public Works Facility Roof Project, City Project 19-06, to include removal of the
existing roof structure, furnishing and installing a new membrane roof structure
and appurtenances.
NOW, THEREFORE, BE IT RESOLVED
by the City Council of the City of
Shorewood, Minnesota:
1. The Plans and Specifications were prepared by inspec Inc. for such
improvement. Said Plans and Specifications are hereby approved
and shall be filed with the City Clerk.
2. The City Clerk shall prepare and cause to be inserted in the official
paper and according to Minnesota State Law an advertisement for
bids, upon the making of such improvement under such approved
plans and specifications. The advertisement shall be published for
3 weeks, shall specify the work to be done, shall state that bids will
be opened and considered by the city at the specified time and
date, in the City Hall Council Chambers, and that no bids will be
considered unless sealed and filed with the Clerk and accompanied
by a cash deposit, cashier’s check, bid bond, or certified check
payable to the Clerk for 5 percent of the amount of each bid.

Background:
A duly called public hearing was held earlier this evening regarding a proposed
assessment at 5440 Wedgewood Drive.
Recommended Action:
City staff recommends approving the assessment in the amount of
$6,151.56 for costs related to enforcing the city’s residential rental housing code. Because the
property is listed for sale, staff wanted to be sure that the existing property owners pay for any
compliance expenses prior to the sale and that future buyers were aware of the potential issues.
Staff will be considering other enforcement options, up to and including, ordering the building to
be vacated until structure is brought into compliance.
Next Steps and Timeline:

immediate recording so the assessment can be paid at the time of closing, should the property

A RESOLUTION ASSESSING UNPAID SPECIAL SERVICE CHARGES FOR
5440 WEDGEWOOD DRIVE
WHEREAS The City of Shorewood has a residential rental housing inspection
program that requires the property owner to maintain their rental property
in a safe and habitable condition; and,
WHEREAS The owners of the property at 5440 Wedgewood Drive, have not been
responsive to the city’s request for information and required inspections;
and,
WHEREAS Pursuant to proper notice duly given as required by law, the council has
met and heard and passed upon all objections to the proposed
assessment for the special service charges at 5440 Wedgewood Drive,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF SHOREWOOD,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part
hereof, is hereby accepted and shall constitute the special assessment against
the land named therein.
2. Such assessment shall be payable in a single installment to be payable on or
before the first Monday in January, 2021 and bear the interest rate of five (5.0)
percent per annum from the date of the adoption of this assessment resolution.
To the first installment shall be added interest on the entire assessment from the
date of this Resolution until December 31, 2020.
3. The property owner of any property so assessed may, at any time prior to
certification of the assessment to the county auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment, to
the city finance director, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution; and the
owner may, at any time, thereafter, pay to the city finance director the entire
amount of the assessment remaining unpaid, with interest accrued to December
31 of the year in which such payment is made. Such payment must be made
before November 15 or interest will be charged through December 31 of the next
succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the
county auditor to be extended on the property tax lists of the county. Such
assessments shall be collected and paid over in the same manner as other
municipal taxes.
