CONVENE CITY COUNCIL WORK SESSION MEETING Mayor Zerby called the meeting to order at 6:00 P.M. Due to the Centers for Disease Control’s recommendation regarding limiting the number of people present at a meeting, and pursuant to MN Statute 13D.02, the Shorewood City Council met via electronic means. A. Roll Call Present. Mayor Zerby; Councilmembers Johnson, Labadie, Siakel, and Sundberg; City Attorney Keane; City Administrator Lerud; Finance Director Rigdon; Planning Director Darling; Director of Public Works Brown; and City Engineer Budde. CIP DISCUSSION City Administrator Lerud stated that on March 9, 2020 staff presented a draft CIP infrastructure plan for council comment and direction. He said staff had two takeaways from the meeting; first, the Council was interested in moving Strawberry Lane and the associated stormwater work up in the schedule. The second takeaway was needing a plan to address the roads that are not scheduled in the next 10 year so that those roads do not fall into disrepair. He explained that staff went back to the CIP to revise what was proposed in the earlier version. Lerud said the revised plan calls for an additional $2 million of mill and overlay work on roads where there is no water or storm sewer to be done in 2021. That work will ensure those roads are good for another 15 to 20 years. City Engineer Budde gave a brief overview of the revised CIP schedule. He reviewed the pavement ratings and some of the anticipated costs. He noted that Strawberry Lane has been moved up to 2022, which staff believes is the earliest that project can be completed because of the right-of-way acquisition that comes with this project. He reviewed the items that were removed from the CIP. Councilmember Johnson asked how the City will pay for the items in the CIP. Finance Director Rigdon stated gave a brief summary of the ways these projects can be financed, including increasing the levy as well as increasing utility rates. He stated that the CIP will be reviewed CITY OF SHOREWOOD WORK SESSION COUNCIL MEETING MINUTES APRIL 13, 2020 Page 2 of 2 annually with the hope that some of the costs may be able to come down. He stated that the City can complete these projects with adequate revenue in the utility funds and using street reconstruction bonds. Councilmember Sundberg asked what kind of overrun projections have been made for these projects. City Administrator Lerud noted that an annual inflation factor of three percent that has been included, as well as a 25 percent contingency. He reiterated Finance Director Rigdon’s point that this will be looked at annually and the Council can make decisions accordingly. He stated that the biggest financing component is the street reconstruction bond project and noted that there will be a public hearing for this at the first Council meeting in May. Mayor Zerby stated that the biggest projects for this year are on Enchanted and Shady Island and asked about the status of those projects. City Administrator Lerud stated that he has been told that there will be an item for Council approval regarding final specifications and plans at the next Council meeting. Public Works Director Brown stated that for that project, the City will need to advertise for 21 days, so he hopes that bids would be awarded by early June. He noted that it typically takes a contractor four to six weeks to get their bonding and insurance in place before construction begins. City Engineer Budde stated that he would estimate that the construction would last about a month. City Administrator Lerud stated that this project was anticipated to be completed before school buses resumed in the fall. Mayor Zerby expressed his concern with the very tight time frame and asked staff to coordinate to make sure that the timelines are met. Councilmember Johnson stated that although the financial impacts explained by Finance Director Rigdon are high, two of the things that the Council hears about from constituents most frequently are the condition of the streets and drainage. He stated that he feels this plan is a direct response to the feedback the Council has gotten from residents. Councilmember Labadie stated that she shares Mayor Zerby’s concern about the timeline and asked staff to make sure that they stay focused on the timeline. City Administrator Lerud agreed that staff will keep an eye on the timeline and noted that this document will be brought back for Council approval at an upcoming meeting. Mayor Zerby asked for a timeline of the upcoming projects so it is easier for the Council to stay in the loop and knowledgeable about the projects. 3. MATTERS FROM THE FLOOR Mayor Zerby explained that residents have been asked to submit comments in writing and asked if the Council had any matters to bring forward from residents. There were no comments received by Council or staff. 4. PUBLIC HEARING A. Assessment Hearing for 5440 Wedgewood Drive City Administrator Lerud explained that for approximately a year the City has been trying to gain rental code compliance for the property at 5440 Wedgewood Drive. He noted that this property is owned by someone who lives out of state and the City has received numerous complaints for non-compliance and maintenance problems. He stated that the property owner has been notified numerous times about the violations and several citations have been issued, however there has been very little compliance. He stated that the property is currently for sale and the City wanted to ensure that the City’s expenses, to date, were collected from the seller. He stated that the expenses, to date, are currently $6,151.56. He stated that the owner of the property was informed about this public hearing. There being no public comment, Mayor Zerby closed the Public Hearing. 5. REPORTS AND PRESENTATIONS - NONE 6. PARKS - NONE 7. PLANNING - NONE 8. ENGINEERING/PUBLIC WORKS A. Approval of Plans and Specifications and Authorization of Ad for Bids on Roofing Public Works Building, RESOLUTION 20-029, CITY PROJECT 19-06 CITY OF SHOREWOOD REGULAR COUNCIL MEETING MINUTES APRIL 13, 2020 Page 3 of 4 Public Works Director Brown stated that this is a project that was started last year. He stated that the Council had authorized InSpec to draw up plans and specifications. He noted that the plans and specifications have been completed and the projected costs are between two-hundred fifty- thousand dollars and two-hundred seventy-five thousand dollars. He stated that if this resolution is approved, bids will be opened via a Zoom meeting on May 5, 2020. He stated that staff is recommending approval. Approve Assessment for 5440 Wedgewood Drive City Administrator Lerud stated that the Public Hearing for the assessment for 5440 Wedgewood Drive was held tonight and staff recommends that the assessment in the amount of $6,151.56 be approved to be assessed to the property and added to the taxes. Labadie, Johnson, Siakel, Sundberg, Zerby voted Aye 10. STAFF AND COUNCIL REPORTS A. Administrator and Staff 1. Mill Street Update Planning Director Darling stated that a letter was sent to the property owners along the east side of Mill Street letting them know that the County and City would be suspending individual meetings regarding the project due to COVID-19 until the design portion of the project is complete. She noted that the design work will continue through the summer and they should be ready to have meetings with residents by the spring of 2021 to discuss potential impacts to individual properties. Mayor Zerby asked if this information was also posted on the City’s website. 2. Badger Park Update Planning Director Darling stated that she has been in touch with the contractors regarding the poured in place rubber surface. She stated that the work should begin the first week in May, but noted that there are specific temperature requirements to complete the work. Other Public Works Director Brown stated the seasonal weight restrictions were lifted this morning, so signs have been removed and crews are continuing to sweep streets and fill potholes. He noted that there is information on the website about how to raise an issue regarding property values. He noted that the Council meeting remotely that way they are tonight would not have been possible a year ago with the technology that the City had. He stated that staff is very appreciative of the investment in the fiber-optic technology that was approved by the Council that allows these meetings to take place. B. Mayor and City Council Mayor Zerby stated that on April 9, 2020, the League of Women Voters and the Excelsior Chamber of Commerce held a Mayor’s Forum via Zoom. He stated that it was recorded and is available on the LMCC website and encouraged residents to watch it. Mayor Zerby noted that he has called for a special closed City Council meeting on April 20, 2020. He stated that the meeting will be closed pursuant to State Statute 13D.05, Subd 3D, Attorney- Client privilege, for the purpose of discussing legal considerations relating to ongoing litigation to enforce the city’s zoning code. 11. At the April 21, 2020 meeting, the Planning Commission unanimously recommended approval of the variances to lot area and width to redevelop the lot for a new home, based on the finding that the applicant has met the variance criteria. The applicant was present at the meeting; no one from the public requested to speak, although two letters of support were received. One issue discussed at the Planning Commission is a requirement of Section 1201.03 Subd. 2.c (3) of the zoning regulations that provides criteria for building on a substandard lot of record without variance. The applicant could not meet all the criteria and consequently had to apply for a variance. The criteria the Planning Commission was most concerned with was that property owners may not redevelop non-conforming lots without variance if they own adjacent parcels that could be consolidated together to create a conforming lot. This language is in code because the goal of the zoning regulations is to reduce the number of nonconformities and gain compliance. Although Ms. Joyce is a partial owner of the adjacent property she is not the sole owner of that lot, which is owned by a limited liability corporation (LLC). The ownership structure is different and staff consider the property owned separately. Financial or Budget Considerations: The application fees cover the cost of processing the request. Recommendation / Action Requested: Staff and the Planning Commission recommend approval of the request for variances to lot area and width to redevelop the lot for Anne Joyce at 20505 Radisson Road. Additional utility improvements include sanitary sewer rehabilitation to reduce inflow and infiltration and the extension of new watermain, including services, along Woodside Road from Howards Point Road to Boulder Bridge Drive, Woodside Lane and Kathleen Court. WHEREAS , WSB has been directed by City Staff, with guidance from Blondo Consulting, to move forward with bidding the improvements in preparation for construction anticipated to begin in mid-summer of 2020, following final approval from the Minnesota State Archaeologist, the Minnesota Indian Affairs Council, and the Minnesota State Historical Preservation Office. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood, Minnesota: 1. The Plans and Specifications were prepared by the WSB for such improvement. Said Plans and Specifications are hereby approved and shall be filed with the City Clerk. 2. The City Clerk shall prepare and cause to be inserted in the official paper and according to Minnesota State Law an advertisement for bids, upon the making of such improvement under such approved plans and specifications. The new law provides the authority to allow some existing on-sale licensees to make off-sales of malt liquor, hard seltzer, cider, and wine with a prepared take-out order, without obtaining an additional license. The law will expire when the closure of restaurants as set forth in Executive Order 20-04, as modified and extended by Executive Orders 20-18 and 20-33, or any other subsequent order, expires, or is terminated or rescinded. It is subject to the following limitations; 1) the off-sale is made in conjunction with the sale of prepared take-out food; 2) the alcohol is sold in its original, unopened packaging; 3) it is no more than 72 ounces total for malt liquor, hard seltzer or cider and no more than 750 milliliters of wine per order; 4) Licensee must confirm person picking up order is 21 years of age; 5) Licensee must notify insurer that it is making off-sale sales; 6) No delivery of off-sale beverages; 7) City has right to prohibit off-sales by resolution; 8) Qualifying licensee is restaurant that holds on-sale liquor, or on-sale wine license as approved by the City and State of MN.
